The operator of MV#1 was upset and sitting in MV#1 when I interviewed her and only stated that her left hip hurt. Operator #1 refused medical treatment at that time and wanted to wait for her mother to arrive before making any decisions. The operator of MV#2 stated that he was traveling east on Commonwealth Ave in the area of #2102 in the left hand lane when a pedestrian appeared in the roadway. According to operator #2, he cut his steering wheel to the left to avoid the pedestrian and struck MV#1. No tows and only a minor injury to the operator of MV#1, though she did not want to be evaluated by the medics. Two independent witnesses to the crash gave me similar statements that operator #2 had driven on the wrong side of the road prior to the crash and was operating at a high rate of speed. Operator #2 cited for failure to obey signage. Only after I completed this report, was I notified by Cheryl Petitti, the mother of Marisa Petitti that Marisa was not operating MV#1 at the time of the crash and that she may have been struck by MV#2. I re-interviewed both witnesses and they confirmed that Marisa was in fact the pedestrian crossing the street, which I did not know, but they did not witness her being struck by MV#2 due to their view being obstructed. Cheryl Petitti also states that she was contacted by another witness, who had left prior to my arrival, that has information to provide. The weather at the time of this incident was overcast. The road surface in the area of the incident was mostly dry. Midland Avenue and Riverdale Avenue are both public ways in the City of Newton. I spoke with Mr. William Shea (S45354021), a foreman for Diaz Construction who was working on a job site next to 10 Midland Avenue at the time of the incident. Mr. Diaz stated while working with Mr. Silvestre Laneiro (S45163124) and Mr. Leonardo Alvarenga (S63414490), they observed a green Ford Taurus (MA: 6BF469) traveling towards the area of their job site while traveling North on Riverdale Avenue. Mr. Shea stated he observed a white male party vomiting what appeared to be blood out of the driver side window of the vehicle. Mr. Shea stated he then observed the vehicle's driver side area crash into numerous cement posts in front of 10 Midland Avenue (PSMJ Resources, Inc.) at a low rate of speed. The vehicle then traveling over a large mental plate in the roadway covering a trench and it continued down Riverdale Avenue until it crashed into the front driver side tire of a parked 1998 Volvo 828 rock truck owned by Diaz Construction. This vehicle was parked unoccupied on the roadway inside the jobsite. Mr. Shea stated they all went over to the vehicle to assist the driver, later identified as Mr. Richard Proia (S25282466). Mr. Shea stated there was a large amount of blood all over Mr. Proia's face, person, and vehicle and he was continuing to throw up blood. Mr. Proia was transported to St. Elizabeths Hospital in Boston by Newton Medics prior to my arrival. Due to Mr. Proia's condition at the time of his transport, Sgt. Michael Wade of the Newton Police Traffic Bureau contacted Trooper Mark Delaney of the Middlesex County CPAC who declined jurisdiction in the event that Mr. Proia succumbs to his injuries. I contacted Trooper John Paul from the MSP Reconstruction Unit to make him aware of the crash. MSP declined to respond. I notified Mr. Proia's daughter, Jennifer Proia, that her father had been transported to the hospital after being involved in the crash. Photos were taken of the crash scene and submitted to the IT Bureau. I observed damage to the front passenger side bumper/fender area of Mr. Proia's vehicle. I observed very minor damage to the front driver side tire area of the Volvo rock truck involved in the crash. Mr. Proia's vehicle was removed from the roadway by Tody's Towing. Officer Wilson canvassed the area for surveillance footage of the incident with a negative result. Sgt. Wade received a call from Dr. Grivetti (2021-10751) from the Medical Examiners Office a short time after Mr. Proia was transported to St. Elizabeths. Dr. Grivetti stated he received a call from the hospital notifying him that Mr. Proia has passed away and he was making notification to us. Dr. Grivetti stated it is his understanding that Mr. Proia suffered an aggressive GI bleed leading to cardiac arrest.
