She stated that she is staying with the children at 65 Falmouth Road Newton MA with the childrens grandmother due to the fact the parents are in New York doing a continuing education program until Friday January 18, 2019. She stated she is not familiar with the area, she was traveling south on Lexington Street approaching Freeman Street when she glanced at the map on her cell phone. She stated she did not observe the color of the traffic signal and did not observe the rear brake lights in vehicle one. All parties were evaluated in vehilce two by medics with no injury. I spoke with the childrens mother Sarah Lapaix 1-203-685-2809 who confirmed Ms. Heimbrock's statement about the care of the children. I did observe an expired inspection sticker as of 12/18 on vehicle one. Therefore due to operator of vehicle two's statement I checked the rear brake lights. When the brake pedal was pressed the left brake light and top(3rd) brake light was operational but the right rear brake light was not operational. Tody's towing arrived on scene and towed both vehicles top their lot. Ms. Heimbrock made arrangements for transport of herself and the children. Ms. Farnese was transported to Newton Wellesley Hospital for non life threatening injuries. I advised all parties of the process and gave them each others information. The listing for that plate comes back to a 2010 Lexus ES350 color gray. I was then showed the video surveillance from the JCC's cameras and it shows an older white female exiting the lobby wearing a winter hat and carrying a bag with purple flower designs on it. She then walks through the lot and enters a gray Lexus ES350. The Lexus then starts backing out of the spot. The Lexus then continues backwards in to the other side of the parking stalls and strikes M/V 1 on the driver's side front door. The Lexus then pulls forward and leaves the scene without stopping or providing her information. As the Lexus is leaving, you can see there is a dent to the driver's side rear bumper. The video is not clear enough to see the plate on the Lexus or clearly see the operator's face. After, I located a number for the owner of the Lexus M/V 2 (Tania Lefman). I spoke to Lefman on the phone and she stated that she was backing out of the JCC parking lot at that time and felt a tiny bump to her rear end. She says that she could not stop in time due to the icy parking lot and then left the area thinking that nothing was wrong, it was only minor. Traffic Bureau Update (Officer Gaudet): On Monday, February 4, 2019 I made contact with the President of Metrowest Packaging, Brian Hersh. Hersh stated his company does fulfillment deliveries for Amazon. Hersh was advised that a vehicle registered to his company was allegedly involved in a hit and run accident. Hersh was provided information on the vehicle involved. Hersh stated an employee named Alexis was operating MA CON:T65665 on the date of the accident and provided a phone number for this party. On Tuesday, February 5, 2019 I spoke with Alexis Laporte-Soto (S84358654). Laporte-Soto stated he was operating a 2017 Mercedes Sprint van (MA CON:T65665) in Newton for Metrowest Packaging on the date of the accident. I explained to Laporte-Soto the vehicle he was operating was alleged to have been involved in a hit and run accident on Highland Street in Newton. Highland Street is a public way maintained by the City of Newton. Laporte-Soto stated the vehicle he was operating hit the driver door mirror of a parked card on Highland Street. Laporte-Soto reported the accident as mirror (MV2 passenger side) to mirror (MV1 driver side). Laporte-Soto stated after his passenger side door mirror made contact with MV1's driver side door mirror, he stopped his vehicle 15 feet down the road. Laporte-Soto stated he walked up to the car he hit and saw the mirror was bent back but there was no damage. Laporte-Soto stated he waited near the car for 10 minutes and the owner never showed up. Laporte-Soto also stated a ""random guy"" took a picture of his license plate. Laporte-Soto stated he said ""hi"" to this party but the party ignored him and left the area. She says that the vehicle slowed down after and then continued to leave the scene of the accident. She then took a photo of the above listed registration plate. I attempted to contact the owner of M/V # 2 (Jali Medical Inc Waltham, MA) and the receptionist was not able to provide any information at the time. I was told to call back the next day. I gave the vehicle and registration info to the person inquiring if they could find a possible driver and call back. While working on this report, I observed that the owner of M/V # 2 was involved in a past accident in our system and the operator at the time had an address of 66 Country Club Rd. Newton. On 03/20/19 at approx. 09:30 hours, I went over to this address and observed M/V # 2 in the driveway with an operator inside. Officer Selig tracked down the owner of MA Registration 3EF576 at 20 Hale Street and the operator of MV2 admitted to being in the parking lot but denied striking MV1. It should be noted that while at Mr. Wendt's residence both Officer Selig and I observed MA reg 3EF576 parked in driveway of 20 Hale Street with damage to the left rear bumper consistent with how the witnesses stated MV2 struck MV1. Based on the 2 witness statements that express that the operator of the Nissan Pickup knew he struck another vehicle and still left the scene I issued the operator of MV2, Mr. Spencer Wendt, Massachusetts Uniform Citation T1443928, a criminal application to appear in Newton District Court for 90-24 Leaving the Scene of Property Damage. At the time, the road surface was dry and the weather was cloudy. Traffic was particulary heavy as there were several streets in the area still blocked off for the Walk for Hunger and there were participants still walking the route in the area. My attention was drawn to the intersection of Centre Street and Bowen Street as there was a motor vehicle travelling southbound on Centre Street with their left turn signal on attempting to take a left turn on to Gibbs Street. Gibbs Street was temporarily blocked to non-residential motorists as there were several pedestrians in the road crossing over Gibbs Street. As the motor vehicle attempted to turn, there were several pedestrians in the crosswalk crossing over Gibbs Street. The vehicle had stopped halfway into the northbound lane on Centre Street blocking on coming traffic. The operator appeared to realize Gibbs Street was blocked and attemped to turn the vehicle back into the southbound lane to continue southbound on Centre Street. As the vehicle turned back into the southbound traffic lane, the vehicles rear end collided with Officer Richard Clements, who was operating NPD motorcycle unit 533. Officer Clements was traveling southbound on Centre Street and was passing the vehicles in the southbound traffic lane which were currently all at a standstill. Officer Clements had his emergency lights activated as he was on his way to remove traffic cones from the street to open up all the traffic lanes along the event route. Officer Clements was working the City of Newton detail for the Walk for Hunger assigned to the motorcycle to assist with traffic. Officer Clements front wheel, left side of the motorcycle and left leg collided with the rear end of the motor vehicle. The impact of the crash caused him to fall off the left side of the motorcycle and land on the street face first. At this time I immediately ran from my post to Officer Clements location and radioed dispatch that a motorcycle officer was down and that I needed assistance. As I approached Officer Clements he was face down, unconcious and breathing. I was able to roll Officer Clements into the recovery position and at this time Officer Clements regained conciousness and was able to speak and stated "" What happened? What was that lady doing she turned right into me"". I advised Officer Clements that he had just been involved in an accident and to stay still and that help was on the way. The operator of the motor vehicle identified as Helen Leibner (S52717988) stopped her vehicle immediatley after the crash and got out of her vehicle to offer her assistance. I advised Helen and several other witnesses and bystanders who were now crowding around Officer Clements and I to back away from the scene and to not move any of the vehicles involved. Officer Selig arrived on scene and was able to help crowd control until further help arrived. Helen and all witnesses were advised to stand by for police to take their statements. While tending to Officer Clements he was disoriented and made several attempts to move his body to which I had to physically hold him still to prevent possible further injuries. While speaking with Officer Clements I noticed blood coming from the inside of his mouth. Officer Clements was in a noticeable amount of pain. He complained of head, back and left leg pain. Officer Clements was wearing a yellow ANSI certified Newton Police reflective jacket and a Newton Police issued motorcycle helmet. Once the paramedics and fire personnel arrived I was able to speak to the operator of the motor vehicle and several other witnesses. Helen stated she was traveling southbound on Centre Street operating her blue 2014 Audi A4 (MA REG 213BC9). Helen states she was attempting to take a left turn onto Gibbs Street and activated her left turn signal. Helen states she had stopped halfway into the northbound lane as several pedestrians were crossing Gibbs Street in the crosswalk at the time. Helen states after the pedestrians cleared she saw the traffic cones blocking the street and realized the street was closed. Helen states she turned her vehicle back into the southbound traffic lane and did not see Officer Clements or the motorcycle until impact. Helen was not injured and her motor vehicle sustained moderate rear end damage. Her motor vehicle was able to drive away from the scene. Witness Adron Gordon (S90357161) stated he was participating in the Walk for Hunger and had just crossed over Gibbs Street when the crash occured. He stated he witnessed the Officer on the motorcycle with the emergency lights on traveling southbound on Centre Street behind the motor vehicle. The motor vehicle stopped in traffic attempting to turn left onto Gibbs Street. He states then the vehicle made a slight turn back into the southbound traffic lane and the motorcycle collided with the rear end of the motor vehicle. He states the Officer then fell off the motorcycle landing in the middle of Centre Street. Witness Elizabeth McCarthy (S00242346) and Katherine Regan (S43486601) stated they both were in the same vehicle together stopped in traffic in the northbound lane of Centre Street just before the set of lights at Centre Street and Bowen Street. Both witnesses stated they do not remember if the driver of the motor vehicle had the turn signal on but they did see her attempt to turn onto Gibbs Street. They stated they also saw the motorcycle with emergency lights activated travel southbound on Centre Street approaching behind the vehicle. Witnesses state the motor vehicle then suddenly turned back into the southbound lane and the motorcycle collided with the passenger side tailight of the motor vehicle. Both witnesses state the motorcycle attemped to turn away from the vehicle to avoid the crash but was unable to do so. Witness Nina Wang (S39460985) stated she was parked on the southbound lane of Centre Street just prior to the crash scene. Nina states she was in her City of Newton DPW marked vehicle with the hazards on as she was working to assist with traffic safety for the Walk for Hunger. Nina states she witnessed the motorcycle travel southbound on Centre Street and pass the vehicles stopped in the traffic lane. Nina states the motorcycle passed the traffic using the left side and had the emergency lights activated. Nina states the motorcycle was just passing through the green light at Centre Street and Bowen Street when the motor vehicle that was stopped at the lights attempting to take a left turn onto Gibbs Street. Nina states the vehicle then abruptly jerked her car to the right and collided with the motorcycles left side. Nina states she heard a loud crash and witnessed the Officer fall off the motorcycle and land face first onto the street. The motorcycle's final resting place was on its left side approximately two feet away from where Officer Clements was located. The motorcycle sustained moderate damage to its left side, including the front wheel well and undercarriage. The motorcycle left scuff marks on the street which were measured and photographed. Several photographs of the scene and damage to both vehicles were taken and submitted to the IT Bureau. The motorcycle was towed by Todys. Centre Street and Bowen Street are both public ways maintained by the City of Newton. The injured motorcyclist, Officer Clements, was transported to Saint Elizabeth Hospital with fire fighters on board. I was able to follow up with Officer Clements on the phone the next day who was admitted over night at the hospital. Officer Clements stated he has no recollection of the accident and can only remember driving down Centre Street to begin to pick up cones to open up all lanes of traffic. Officer Clements stated he suffered a brain bleed, head, back, left foot and right thumb injuries. The pedestrian identified as Donna Kalikow (S24151638) stated she was standing in an open parking space for a few seconds, attempting to walk across the street to enter J.P. Licks. Donna stated she was standing in the marked parking space waiting for traffic to stop to safely cross the street. Donna states the cars stopped to let her cross and she proceeded into the roadway. She states MV1 was attempting to back into the parking space that she was standing in and struck her right side and knocked her to the ground. Donna states the operator of MV1 stopped the vehicle when he realized he had struck her and got out to contact 911. Donna appeared to have minor injuries and complained of head pain. Medics transported Donna to NWH to be further evaluated. The operator of MV1 identified as Christopher Moos (S24090966) stated he was attempting to parallel park into an empty parking space and never saw the pedestrian standing in the space. Christopher stated as he was backing up into the space he was notified by a bystander that he just struck a pedestrian. Christopher stated he immediately stopped the vehicle and got out to assist the pedestrian and contact 911. Christopher stated he was not travelling no more than 5mph at the time of the accident. MV1 did not have any damage to the vehicle and was able to leave the scene. Christopher reported no injuries. Several photographs were taken of the scene and submitted to the IT Bureau. The pedestrian, NNHS student Benjamin Donovan stated that he was crossing east to west in the marked crosswalk in front of 321 Walnut St. Donovan stated that he saw Beaver's vehicle approaching him at approximately 5 to 10 MPH. Believing that Beaver was stopping to let him cross , Donovan stated that he held up his left hand to signal to Beaver that he was going to cross. Donovan stated that Beaver's vehicle struck him on his left side and knocked him to the ground. Donovan stated that he had minor scrapes on his right side as a result of falling to the ground. Donovan stated that he did not lose consciousness and was transported via EMS to Newton Wellesley Hospital for treatment. I took photos of Beaver's vehicle and forward the disk to NPD IT Bureau. I issued Beaver MA Citation T 1269995 and cited him for a violation of MGL Ch 89 C 11, failure to yield to a pedestrian in a crosswalk. On 06/12/2019 I was forwarded an E-mail from Capt Anastasia of a video of the crash that was taken from a camera that was mounted on the roof of 321 Walnut St. The video shows Donovan walking into the marked crosswalk from the east side of Walnut St and hold up his left had to Beaver's on oncoming vehicle. Beaver vehicle appears to be travailing faster than the 5 to 10 MPH that Beaver believed that he was travailing. The video shows that Beaver did not brake until Donovan was struck and landed on his vehicles hood. Donovan was thrown approximately 10 feet from Beaver's vehicle and landed on his right side on the roadway. I left a message with the operator of MV2, Colleen Butaney, who returned my call and stated she was traveling Westbound on Washington St. in the left lane approaching the red light at Lowell Ave. She stated she started to proceed into the right lane but saw MV1 and turned back into the left lane. She stated the operator of MV1 rolled down her window and stated that she just side swiped her car, to which she responded ""no I didn't but I am happy to pull over"". She stated at this time the light turned green and MV1 continued straight on Washington St. and didn't pull over. The weather at the time of the accident was clear and sunny. The road surface was dry. Beacon Street and Paulson Road are both public ways maintained by the City of Newton. I spoke with the injured bicyclist in front of 165 Paulson Road, Alexander Mendonez. Mendonez stated he was traveling Westbound on Beacon Street on his bicycle near Paulson Road. Mendonez stated he observed a late model gray sedan ""inch to a stop"" on Beacon Street (W) at Paulson Road. Mendonez stated he did not remember if the vehicle had it's right directional on at the time. Mendonez stated as he was traveling through the intersection with the vehicle on his left, the vehicle took a right turn onto Paulson in front of him. Mendonez stated he attempted to brake and veer to the right of the vehicle, but was unable to avoid the collision. Mendonez stated his left side made contact with the rear passenger door/rear fender area of the vehicle. Mendonez fell to the roadway and the vehicle left the area Northbound on Paulson Road. Mendonez was unable to see who was operating the vehicle. Newton Medics responded and treated Mendonez for injuries to his left knee/arm area. Mendonez signed a patient refusal with Newton Medics. I observed minor damage to the left handlebar area of Mendonez's bicycle (black Trek). Mendonez was wearing a white helmet at the time of the accident with a blue shirt and white and black shorts. Pictures were taken of the area and bicycle and submitted to the IT Bureau. Mendonez was able to provide a partial Massachusetts registration of ""7BS32"". I attempted run this plate with multiple combinations. I searched the area for a vehicle matching the description given by Mendonez with a negative result. On July 16, 2019, I spoke with a witness to the incident Mark O'Hearne. O'Hearne stated he was traveling Westbound on Beacon Street a few car lengths behind where the accident occurred. O'Hearne stated he observed a bicyclist on the right side of the road abruptly stop and fall to the roadway. O'Hearne stated he observed a vehicle in the path of the bicycle. O'Hearne stated the vehicle did not stop after the bicyclist fell and took a right onto Paulson Road from Beacon Street. O'Hearne stated he followed the vehicle involved in the accident to Commonwealth Avenue, and while doing so took a picture of the vehicle's license plate. O'Hearne stated he did not observe who was driving the vehicle. The Massachusetts registration provided to me by O'Hearne is 7BS322. This vehicle comes back to a 2010 Volkswagon Jetta registered to Peter Giorgi (S20952090) out of Paxton, Ma. I spoke with Peter via telephone. Peter acknowledged he is the registered owner of the vehicle, but stated his daughter was using the vehicle and was in the Newton area. I spoke with Lindsey Giorgi (S35711247) via telephone. Traffic Bureau Update (Officer Gaudet): On Tuesday, July 6, 2019, I attempted to make contact with the registered owner of MV2, Daniel Kuksin (S61105670), with a negative result. A Hit and Run inquiry was mailed to the Kuksin. On 08/07/2019 the owner of MA reg#149DE7 came into headquarters to discuss what happened. Cook-Williams stated he came to stop at the intersection and observed no traffic in either direction of Walnut Street. Cook-Williams stated he made a left turn onto Walnut Street and did not see the crossing pedestrian until it was too late. Cook-Williams stated he slammed on his brakes and the pedestrian landed on his hood. Cook-Williams stated the pedestrian then fell to the roadway. Cook-Williams reported no injuries. Cook-Williams stated he did not know if the pedestrian was in the crosswalk or not at the time of the crash. I observed minor damage to the passenger side hood/bumper area. Cook-Williams stated he was not distracted at the time of the accident. He was then attempting to make a left turn near the entrance/exit of the store. He says that there was a large white van parked in the end handicapped spot towards the left of him. He says the van was sticking out in the spot limiting his visibility. As he was half way through his left turn and coming around the corner, he was not able to see a pedestrian pushing a shopping carriage. He then struck the carriage that was being pushed by Mary Alexander. He further says that the cart jolted Ms. Alexander and she fell down to the ground. At the time, Alexander was walking through the lot near the store entrance heading back towards the parked cars. She was not in the crosswalk at the time which was approximately ten feet down from her location. After, I attempted to go to Ms. Alexander's residence to follow up. I spoke to her friend who was bringing up Alexander's groceries and she stated that she decided to go to Newton Wellesley Hospital for treatment. I then spoke to Ms. Alexander in the lobby of the hospital. She stated that she was exiting the store through the lot with her shopping carriage. She believes she was approximately eight feet away from the door when all of a sudden she only saw red coming at her. She believes MV # 1 was speeding at the time. I asked her if she was struck by the vehicle or was the shopping carriage only struck. She replied that she did not know and only remembers falling to the ground after. She sustained a large bruise to the inside palm area of her right hand and her left knee was swollen. Digital photos of the scene were taken and pictures of Ms. Alexander's injuries were taken at the hospital. As far as possible video surveillance, I was told that the Loss Prevention Department has to access the video. On 11/13/19 at approximately 14:20 hours, I went in to the Star Market and spoke to the manager, Nidal Rajeh, inquiring about possible video surveillance. He said there is coverage in the parking lot and he was able to show me the video. A copy of the video would have to be done by Loss Prevention which I requested. I observed at the 12:12pm mark in the video, MV # 1 was parked five spots up from the third row of the lot that he was exiting. I also observed a white transport van parked in the end handicapped spot mentioned by the operator but it was parked correctly and not limiting visibility. Next, MV # 1 backs out of the spot and drives forward going at a reasonable speed. The pedestrian (Alexander) has already exited the store with her carriage and is walking at an angle toward the same third row of parked cars. As the pedestrian is walking towards the direction of MV # 1, it appears that the pedestrian should be visible to him. MV # 1 then starts to take the left turn around the corner without slowing or stopping and strikes the carriage head on. Due to the impact, Alexander then loses grasp of the carriage and it goes past her twisting her body around. She then hits and rolls up on the hood of the vehicle on her left side. MV # 1 then suddenly stops and immediately gets out and provides assistance to the pedestrian. CORDERO's son and husband arrived on scene and I was able to confirm her information. Both stated that CORDERO did not have an active license. Newton Dispatch ran all information for CORDERO and confirmed she was unlicensed. The weather at the time of the crash was overcast. The road surface where the crash took place was dry. Brookline Street and Hartman Road are both public ways maintained by the City of Newton. On arrival, the injured pedestrian was in the process of being transported to Newton Wellesley Hospital with minor injuries. I spoke with the operator of the vehicle involved in the crash, Menachem Uminer (S43996134). Uminer stated he was operating his vehicle on Brookline Street (S) towards Hartman Road. Uminer stated he was stopped in traffic on Brookline Street prior to the crash. Uminer stated the vehicle in front of him proceeded to travel straight from it's stopped position and he then began to follow the traffic on Brookline Street. Uminer stated he did not see anyone in the vicinity of his vehicle as he began to travel straight from his stopped position. Uminer stated as he was traveling by Hartman Road, the front passenger side area of his vehicle made contact with a pedestrian on the right side of Brookline Street at Hartman Road. Uminer stated he did not see this party until after they were struck and he then proceeded to pull his vehicle over. Uminer stated he was operating his vehicle at a very low speed at the time the collision took place. After speaking with Uminer, I observed the white 2017 GMC Yukon (MA: 9NX525) involved in the crash parked on Brookline Street (S) just past Hartman Road. Uminer stated the vehicle had been moved after the collision took place. I observed no obvious damage to the body of the vehicle on the front passenger side area where the collision took place. The front passenger door mirror was folded inward towards the door. Uminer stated he believes the front passenger door mirror was the point of contact between his vehicle and the pedestrian. I spoke with a witness to the crash, Ashley Garcia (S94193596). Garcia stated she was attempting to cross Brookline Street at Spaulding Lane. Garcia stated she entered the marked crosswalk and was a few steps into Brookline Street when a black colored vehicle traveling on Brookline Street (N) slammed on its brakes near the crosswalk. Garcia stated she looked to her left at the vehicle and then heard a thud to the right from the area where the crossing guard was standing near Hartman Road. Garcia stated she looked over and saw a crossing guard on the roadway on Brookline Street (S) at Hartman Road. The injured pedestrian involved in the crash is Cassandra Alexander (S23636307). Alexander is a crossing guard for the City of Newton and is assigned to the intersection of Brookline Street and Hartman Road for the Memorial Spaulding school crossings. This crash occurred while Alexander was performing her official duties. Alexander was wearing her department issued yellow reflective jacket at the time of the crash. I spoke with Alexander at Newton Wellesley Hospital where she was being treated for her injuries. Alexander stated she was performing her duties as a crossing guard at the intersection of Brookline Street and Hartman Road. Alexander stated she had just finished crossing two pedestrians in the marked crosswalk on Hartman Road when observed a pedestrian enter the crosswalk on Brookline Street at Spaulding Lane. Alexander stated she began to enter the intersection of Brookline Street at Hartman Road with her hands up and her department issued yellow reflective jacket on in an effort to stop traffic in the area to allow the pedestrian in the marked crosswalk safely cross. Alexander stated she was struck on her left side by a passing vehicle. Alexander stated she did not see the vehicle and fell to the roadway. Alexander stated as she was falling to the roadway she extended her right arm in an effort to brace her fall. Alexander stated she had injuries to her arms and legs and was sore from the collision. I spoke with a second witness to the crash via telephone, Anand Vaidya (S43996134). Vaidya stated he was stopped in traffic behind MV1 on Brookline Street (Southbound). Vaidya stated he observed the vehicle in front of MV1 proceed straight on Brookline Street after being stopped in traffic. Vaidya stated he then observed MV1 proceed straight on Brookline Street at Hartman Road at a low rate of speed. Vaidya estimated the speed of MV1 at this time to be 5 miles per hour. Vaidya stated a crossing guard was on the right side of the roadway on Brookline Street at Hartman Road wearing a yellow and black reflective jacket and snow pants. Vaidya stated the crossing guard had her back towards him and MV1, and extended her arm out to stop traffic. Vaidya stated at this time MV1 rolled by the crossing guard at a low rate of speed and the front right fender area of the vehicle hit the left rear leg/lower back area of the crossing guard. Vaidya stated the crossing guard bounced off of the car and fell to the roadway. Vaidya stated he believes MV1 was unaware he hit the crossing guard and observed the vehicle travel another 10 feet until it came to stop on Brookline Street. Wint was driving a 2018 Chevrolet Colorado pick up tuck ( MA reg 8CA823 ) that Auto Zone leases from Lease Plan USA Ltd. Wint stated that he was headed to Webster St in Newton to pick up a delivery. Wint stated that as he approached the area of 277 Lexington St he believed that the traffic light that is at the marked crosswalk was green for south and north bound traffic. Wint stated that he did not see any pedestrians in the crosswalk, until he heard the sound of an object impacting into the front driver's side of his vehicle. Wint stated that he stopped his vehicle approximately ten yards past the crosswalk and got out. Wint stated it was then he realized that his vehicle had stuck a female and a dog. Wint stated that he was not operating any electronic devices at the time of the crash, and I observed none in his vehicle. Wint stated he was not injured in crash. Wint's vehicle had damage to the driver's side mirror and lower molding of the driver's side front door. Wint's vehicle did not require a tow. Witness Bessy Shanks stated that she was driving in her vehicle behind Wint's vehicle south bound on Lexington St. Shanks stated that Wint's vehicle was driving slow and swerving approximately two blocks prior to the crash. Shanks stated that she believed that Wint may of been distracted. Shanks stated that south and north bound traffic was stopped because that cross walk light was red and that a female and a dog were crossing from the east to west in the marked crosswalk in font 227 of Lexington St. Shanks stated that the front driver's side of Wint's vehicle srtuck the female and the dog as they were approximately halfway into the crosswalk. Shanks stated that the female and dog both fell to the ground after the crash. Witness Elizabeth Keegan stated that she was driving in her vehicle south bound on Lexington St two vehicle behind Wint's vehicle. Keegan stated that she was not sure what color the traffic light was at the time of the crash, but traffic was stopped both not and south bound traffic was stopped. Keegan also stated that Wint's vehicle "" didn't even slow down "". Keegan stated that Wint's vehicle struck the female pedestrian and the dog as they were in the marked crosswalk in front of 277 Lexington St. Witness Henry Taylor stated that his vehicle was the first one stopped at the red crosswalk light at 227 Lexington St in the north bound lane. Taylor stated that north and south bound traffic was stopped and that Wint's vehicle did not stop and stuck a female pedestrian and a dog in the crosswalk. Witness Jacqueline Deos stated that her vehicle was stopped behind Taylor's north bound on Lexington St. Deos stated that north and south bound traffic was stopped for the red light . Deos stated that Wint's vehicle did not stop and that it struck a female pedestrian and a dog in the marked crosswalk. The pedestrian in the crosswalk was identified as Xiaoping Sun. Sun stated that she and her dog stopped on the south bound side of the marked crosswalk across from 227 Lexington St. Sun stated that she activated the crosswalk light and waited until the light was red for north and south bound traffic, and that the walk single was activated. Sun stated that she looked to her left and saw traffic north bound traffic was stopping. Sun stated that she turned to her right and entered the marked crosswalk. Sun stated that she and her dog had crossed over the north bound side of Lexington St and she then looked to her right and saw Wint's vehicle not stopping and "" going very fast "". Sun stated that the front driver's side mirror of Wint's vehicle stuck her in the face . Sun stated that as she fell to the ground she was struck on the left leg by Wint's driver's side. Sun stated that she did not lose consciousness after she had fallen to the ground. Sun was transported via EMS to The Brigham and Women's Hospital for treatment for head and neck injuries and abrasions to her legs. Sun's dog died as a result of being struck by Wint's vehicle. Photo's of the crash site and of Wint's vehicle were taken and the disc was downloaded by the NPD's IT Bureau. Before leaving the crash site, I tested the crosswalk lights and they were in working order. The crash caused moderate damage to the brick facade and inside wall of the tile store. A short time later, Revzin drove back into the parking lot where I spoke with her. Revzin stated she didn't know why her car had accelerated into the building but she was having some personal issues and may have been distracted. She explained that she left the area because she was shaken up but then as she had time to clear her head, thought she should return to the store. I observed a gash on his head right above his eye and noticed all airbags had been deployed in his vehicle. I asked him to sit down and I radioed for an ambulance. Kiflit stated that he was driving EAST on Watertown St when he collided with a unoccupied parked car (a red 2015 Jeep Wrangler, MA Con R22519) which was parked on the street outside of 856 Watetown St. Kiflit was driving his girlfriend's car (a gray 2020 Nissan Sentra, MA Reg 1ANN57) and was on his way home in Watertown. When I asked for Kiflit's license, he told me that he only has a permit and has yet to take the test. He apologized repeatedly. Kiflit did not have any passengers in his vehicle. Kiflit said the roadway was so dark and he didn't see the parked Jeep. He claimed he was not speeding. There was minimal damage done to the drivers side rear bumper of the Jeep. On arrival at the same time with the Fire and Medics, I observed a female laying in the middle of the lot facing down on her back. A small red and gray CVS like type shopping carriage was knocked over and resting on it's side in front of the victim's head. The carriage was moved to the side in order to tend to the victim I also observed a black Honda Civic bearing MA reg.# 3741TW that was involved in the accident. The Honda was out of the parking spot resting approximately two feet away from the pedestrian's legs. I then spoke to the pedestrian identified as Darla Gipson in the rear of the ambulance. She sustained an abrasion to her front left shoulder and arm area which I observed. She also complained of left knee and elbow pain. She stated that she walking through the middle of the parking lot pushing the carriage by the door entrance in a westerly direction towards Chestnut Street. She states that she never saw a vehicle backing up and then she was suddenly struck and believes she was pushed underneath the vehicle. She was then transported to Newton Wellesley Hospital by Cataldo Ambulance. I then spoke to the operator of the Honda Civic identified as Linda Burke (MA S70320414). Ms. Burke was parked in the first spot to the right of the walkway that leads to the entrance/exit doorway. I asked her what occurred and she stated that she was backing her vehicle up to exit the parking lot when she looked behind her not seeing anything in sight. She then started backing up and struck the pedestrian without realizing it. She says the driver of a green cab and his female customer who were no longer on scene were yelling at her to stop her vehicle because the pedestrian was underneath it. She then stopped her vehicle. I observed minor scrapes to the entire rear bumper of the vehicle so it is unknown where it actually struck the pedestrian/carriage. I observed no obvious signs of damage to the carriage. It should be noted that Ms. Burke's Honda does not have a back up camera or back up sensors. There are no surveillance cameras to the apartment complex and no witnesses came forward for the accident. Le stated that he rode his bike off of the side walk at the northeast corner of Walnut St at Linwood Ave. Le stated that he did not ride his bike in the marked crosswalk that run from east to west over Walnut St at Linwood Ave. Le stated he rode his bike diagonally into the intersection towards the south west corner of the intersection. I spoke with operator one Mr. Smith he stated he was in the left travel lane heading east on Washington Street when vehicle one swerved left into his lane to go towards Mass pike entrance ramp and had contact with his vehicle. Operator of vehicle two Ms.Bovell stated she was traveling east on Washington Street and observed vehicle one traveling in the middle of both east bound lanes of Washington Street. She stated he then merged left traveling in the left lane of Washington Street and she traveled in the right lane. She stated while traveling vehicle one merged into her lane and side swiped her in the left rear. Upon obtaining all documents, vehicle one operated by Mr. Smith was missing his registration plates, registration and any documents of status of the vehicle. Upon further investigation Mr. Smith had a suspended license of January 26, 2021, in addition the vehicle vin number(1FT7X2B68BEC58523 - 2011 FORD TRUCK ) came back inactive on December 16, 2020, which was allegedly sold to Mr. Smith. in the middle of December 2020. Mr. Giannetti stated as a result of the crash his vehicle sustained a flat tire to the front passenger side. Mr. Giannetti stated he left the area and then circled back around for the other vehicle but could not find it. Mr. Giannetti stated because of the flat tire he continued to a nearby gas station to try and get the flat tire repaired. Brentwood Ave is a two way non divided public way in the City of Newton that runs east to west from Greenlawn Ave to Walnut St. Brentwood Ave is a thickly settled residential area with a 25 MPH speed limit. The roadway conditions at the time of the crash were wet due to rain. I observed MA reg 111ZS1 a 2020 Honda Civic parked on the side of Brentwood Ave just passed the intersection of Judith Rd facing westbound. I observed that the Honda had damage to it's front driver's side bumper. When I inspected the Honda I observed that the driver's side headlight casing was cracked and a piece of it was missing. I further observed an approximately six inch in diameter spider web like crack in the lower driver's side windshield. The windshield crack was inward , indicating that an external object had caused the damage. There was another single crack onn the driver's side windshield that extended from the hood to the roof. The operator of the Honda , Lisabeth Ioannilli stated that on 04/29/2021 at 15:20 hours she was driving westbound on Brentwood Ave near the intersection of Judith Rd. Ioannilli stated that she estimated that the speed of her vehicle was approximately 25 to 30 MPH. Ioannilli stated that she did not see a bicyclist in her path of travel until the point of impact when her vehicle was aproximately 3/4 of the way passed the intersection of Judith Rd. Ioannilli stated that her vehicle's front driver's side bumper made contact with the bicyclist. Ioannilli stated that the bicyclist was tossed off of her bike and onto the hood and windshield of her vehicle before rolling onto the ground. Ioannilli stated that she pulled her vehicle to the side of the road and went to check on the bicyclist. Judith Rd is a public way in the City of Newton that runs east and then turns south from Walnut St to Brentwood Ave. There are no traffic control devices at the intersection of Judith Rd and Brentwood Ave. Ioannilli stated that she was not injured in the crash and her vehicle did not require a tow. At the crash scene, the bicyclist , Lucia Campbell, a student a FA Day Middle School ( DOB 11/08/2006 ) was being treated in an ambulance and was transported to Boston Children's Hospital for treatment. Campbell was conscious and was able to answer questions from EMS members. Campbell stated that she was wearing a helmet at the time of the crash and that she rode her bike south on Judith Rd and was turning eastbound onto Brentwood Ave when the crash occurred. I spoke with Campbell's parents Adam Campbell and Iris Delasota who stated that their daughter was under going x rays and other tests to determine if she has internal injuries. I took photo's of the bike, Honda and crash scene and the disk was downloaded by the NPD's IT Bureau. Based upon my investigation of this crash I concluded that Ioannilli was at fault for it. I issued via US mail Ioannilli MA Uniform Citation T1446633 and cited her for a violation of MGL 90/14 failure to use care while approaching a bicyclist. The Tedeschis does have cameras facing the parking lot, however, the employee working at the time of the crash did not have access to them and advised that the manager would be able access the footage tomorrow. On Monday, May 3, 2021, I investigated a Hit and Run crash that occurred at 98 Winchester Street, Newton on May 2, 2021 (Crash#2100000303). I responded to Tedeschi's located at 98 Winchester Street, Newton in an attempt to recover surveillance footage of the crash. I spoke with the owner who allowed me access to review footage from the date and time of the crash. At approximately 1223 hours a black/dark blue Volkswagon sedan is observed entering the Tedeschi's parking lot from Dedham Street (N). The vehicle is observed taking a wide left turn around another vehicle that enters the parking lot from the Winchester Street entrance (E). The front passenger side bumper/fender area of the Volkswagon crashes into the rear passengers side of MV1 (NY: HXZ4415). The Volkswagon is then observed leaving the parking lot (W) out of the Winchester Street side of the lot. The Volkswagon then leaves view of the camera. The Volkswagon's back rear window has white lettering on the bottom. I searched CopLink for registration matches from the Newton area that contain characteristic from the reported registration provided by a witness. MA: 826PH4 comes back to a blue Volkswagon Passat registered to Ms. Joanne Medoff (S95046822) with an address out of 115 Upland Avenue, Newton. This address is 0.1 miles away from where the crash took place. I arrived at 115 Upland Avenue and observed a dark colored Volkswagon Passat (MA: 826PH4) parked in the driveway. This vehicle had moderate recent damage to it's front passenger side bumper/fender area that would be consistent with the crash from Tedeschi's. This vehicle also had the same white lettering present on the bottom of the rear window as the vehicle in the surveillance footage. I rang the doorbell to this address and spoke with Mr. Colby Medoff (S13831145). Mr. Medoff stated the vehicle in the driveway is his but it is registered to his mother. Ms. Medoff came to the door and I explained the circumstances for me speaking with them. After speaking to Mr. Medoff, he admitted to being the operator of the Volkswagon when it crashed into the rear passenger side of MV1. I asked Mr. Medoff why he did not stop and provide his information to the owner of the other vehicle. Mr. Medoff stated he was scared. Mr. Medoff was provided with Massachusetts Uniform Citation 990226AA in hand for Chapter 90, Section 24 (Leaving the Scene of Property Damage). Mr. Medoff was advised. I spoke with the operator/owner of veh #2, Diana Gabriela Valencia who stated she was driving South down Winchester St. when veh #1 stopped suddenly in front of her at the intersection of Dedham St.. She attempted to swerve right to avoid the vehicle but she didn't have time and struck the passenger side rear bumper. As I was in my cruiser preparing the exchange information, Valencia came to my window and informed me that her vehicle was unregistered. A R.M.V. query confirmed that Massachusetts license plate attached to the front and rear of the vehicle she was operating, a black 2009 Hyundai Accent , was active on a Grey 2013 Volkswagon Jetta owned by her boyfriend Frederic James Malesevic. Valencia produced a bill of sale for the Hyundai Accent from Vigeant's Auto Sales, INC of Lowell with a purchase date of 10/17/20. Valencia stated she never drove the vehicle before today and was in the registration process through the mail to the R.M.V.. Valencia was handed Mass. There are signs posted at both entrances to the parking lot stating, ""RESTRICTED AREA Newton Police Department Authorized Vehicles Only Beyond This Point. As I entered my cruiser, I observed a red 2020 Jeep Wrangler (CT: AX89516) parked directly across from my cruiser facing Eastbound. This vehicle was not parked in a marked parking spot and was the last vehicle in the parking lot from the Cherry Street entrance on the North side of the lot. I observed that the front bumper of this vehicle made contact with the rear bumper area of a parked 2018 Tesla Model 3 (EV3617 ). I exited my vehicle and walked over to the vehicles to investigate if a crash had occurred. I observed a black male party sitting in the front passenger seat of the Jeep. The driver seat was vacant. The Jeep had its driver door and passenger door windows rolled down. The vehicle was not running and there were no keys in the ignition. As I approached the passenger side door, the male passenger appeared to be asleep and I could detect a moderate odor of alcoholic beverage emanating from the passenger seat area. I woke up the passenger and inquired where the driver of the vehicle was. The passenger identified himself by his Connecticut ID as Masengo Kabongo (#178372788). Mr. Kabongo stated his cousin Marcel was the operator of the vehicle and they had pulled into their current parking spot so Marcel could run an errand. Mr. Kabongo stated he did not know where his cousin was, and he could not locate his phone to contact his cousin. I asked Mr. Kabongo if he was aware he was parked in the Newton Police Station parking lot and that the vehicle he was sitting in crashed into an employee's vehicle parked in front of them. Mr. Kabongo stated he was not aware. Mr. Kabongo appeared to be very confused with the situation and continued to state he did not know why they were there and where his cousin was. The registered owner of the Tesla arrived and assessed the damage to his vehicle. I observed minor damage to the rear bumper area to MV2. There was also minor damage to the front bumper of MV1. The owner of MV2 was able to review footage of the crash from his vehicles exterior surveillance system. While viewing this video with him, I observed MV1 enter the Newton Police Department parking lot from Cherry Street and pull right behind MV2. MV1 appeared to be occupied by two black males at this time. One in the passenger seat and one in the driver seat. MV1's front bumper area is then observed crashing into the rear bumper area of MV2. The Newton Police Department IT Bureau was able to observe the crash from a surveillance camera affixed to the Newton Police Department maintenance garage (facing Cherry Street). The video captures MV1 entering the parking lot and crashing into the rear of MV2. A black male with light colored shorts and a dark T-shirt is observed exiting the driver side door and walking away from the area up Cherry Street (S) to Washington Street. I explained to Mr. Kabongo that the crash was captured on our surveillance system and that his cousin appeared to be the operator. Mr. Kabongo stated his cousin was currently in Newton District Court being arranged for a previous incident (Report #21027283). I looked up recent bookings for NPD and I observed a party matching the name Mr. Kabongo provided. On Friday, June 25, 2021. Mr. Marcel Mengue-Ngoumou was arrested and cited by the Newton Police Department for OUI (Subsequent Offense), Negligent Operation, Marked Lanes, Open Container, and Unlicensed Operation. I contacted the Newton Police Department Court Prosecutor, Officer Hagopian, to see of Mr. Mengue-Ngoumou was still present in Newton District Court. Officer Hagopian stated he contacted the court and Mr. Mengue-Ngoumou was waiting to be arraigned. Myself and Officer Hagopian responded to Newton District Court to try and speak with Mr. Mengue-Ngoumou. Upon entering Session 1 in NDC, the lone individual sitting in the gallery was a party matching the description of the party from the surveillance footage. I spoke with Assistant District Attorney Nathan Stetson who was present in the court room. I apprised him of the current incident that Mr. Mengue-Ngoumou was involved in and told him I was going to speak with him. Mr. Mengue-Ngoumou at this time was sitting on the second to last bench on the left side of Session 1 as you walk into the courtroom. The exit to the courtroom was behind him. I approached Mr. Mengue-Ngoumou from the front of the courtroom and explained to him that I had just spoken to his cousin in the parking lot of the Newton Police Department. I explained to him the vehicle his cousin was sitting in had crashed into a parked vehicle belonging to a Newton Police Department employee. I explained to Mr. Mengue-Ngoumou that his cousin had identified him as the operator of the vehicle. I then asked Mr. Mengue-Ngoumou who was operating the vehicle when they were traveling to court today. Mr. Mengue-Ngoumou stated he was the operator. I asked Mr. Mengue-Ngoumou if he knew he had parked in the Newton Police Department parking lot. Mr. Mengue-Ngoumou stated he did not. I asked Mr. Mengue-Ngoumou if he knew he crashed into a parked vehicle in the parking lot. Mr. Mengue-Ngoumou stated he did not. I asked Mr. Mengue-Ngoumou if he knew he was not supposed to be operating a vehicle because of his incident from the other night and his license being suspended. Mr. Mengue-Ngoumou stated he did. I apprised ADA Stetson to my conversation with Mr. Mengue-Ngoumou. Mr. Mengue-Ngoumou was issued Massachusetts Uniform Citation 054528AB in hand for Chapter 90, Section 23(K) (Operating a MV after suspension, subsequent offense), and Chapter 90, Section 24 (Leaving the Scene of Property Damage). Mr. Mengue-Ngoumou knowingly crashed into MV2, parked his vehicle, took the keys from the ignition, and left the area with out making an effort to contact the owner of MV2. The 2020 Jeep Wrangler from the crash was removed from the Newton Police Department parking lot by Tody's towing. A towed MV form was completed and submitted. Mr. Drukman stated the crash occurred on Monday, August, 2, 2021, at the Jewish Community Center located at 333 Winchester Street, Newton sometime around 1600 hours. Mr. Drukman stated his vehicle was parked unoccupied in the parking lot and was struck by another vehicle. Mr. Drukman stated his 2017 Subaru Forester (MA: WA1/UIY) had damage to the driver side rear fender. Mr. Drukman stated a passersby forwarded pictures of the other vehicle involved in the crash. The other vehicle is a 2016 BMW 5 series (MA: 1691DR) registered to Mr. Richard Parker (S75189008). Mr. Drukman forwarded me the pictures he received and there is damage to the front passenger side bumper/fender area of this vehicle. These photos were submitted to the IT Bureau to be added to this report. I spoke with Mr. Parker via telephone. Mr. Parker stated he was operating his vehicle in the parking lot of the JCC at the time and date of the crash. Mr. Parker acknowledged his vehicle made contact with another vehicle while he was attempting to park. Mr Parker stated after making contact with the other vehicle, he exited that parking spot because it was too tight and parked in another parking spot. Mr. Parker stated there is no new damage to his vehicle and the damage I described in the pictures Mr. Drukman forwarded to me was old. I advised Mr. Parker that I was citing him for leaving the scene of property damage. Mr. Parker admitted to crashing into MV1 as he was attempting to park in the JCC parking lot. Mr. Parker knowingly made contact with another vehicle and made no effort to exchange information with the owner of the vehicle he crashed into. The pictures submitted by Mr. Drukman of his vehicle show obvious fresh damage as a result of a crash. After completing my investigation, Mr. Parker will be mailed Massachusetts Uniform Citation 089044AB for Chapter 90, Section 24 (Leaving the Scene of Property Damage). Hammond St and Lawrence Rd are both public ways in the City of Newton. Upon my arrival I spoke with the operator of vehicle one Evandro Ribeiro. Ribeiro stated that he was driving his van ( MA commercial registration W13024 2016 Ford Transit van ) south bound on Hammond St near Lawrence Rd. Ribeiro stated that as he was turning right onto the west bound lane of Lawrence Rd a bicyclist struck the front passenger side door of his van. Ribeiro stated that he activated the right turn signal of his van before turning right onto Lawrence Rd. Ribeiro stated that he did not see the bicyclist prior to the crash. Ribeiro stated that he was not injured in the crash and his van had no damage to it. I also spoke with the bicyclist Kevin Recor who stated that he was riding his bike south bound on Hammond St near Lawrence Rd when Ribeiro's van turned to the right in front of him. Recor stated that he did not recall if Ribeiro's van had it's right turn signal activated before it turned. Recor stated he did not have enough time to stop before the crash. Recor suffered minor lacerations to his left arm and left leg as a result of the crash. Recor was evaluated by Medics at the crash scene and refused further medical aid. I took photos of Ribeiro's van and Recor's bike and the disk was downloaded by the NPD's IT Bureau.
