She stated she did not observe the color of the traffic signal and did not observe the rear brake lights in vehicle one. All parties were evaluated in vehilce two by medics with no injury. I did observe an expired inspection sticker as of 12/18 on vehicle one. Therefore due to operator of vehicle two's statement I checked the rear brake lights. She then ran in to the JCC for approximately one minute and when she returned she observed her driver's side front door was struck. I observed significant damage to the door frame and the door would not close. The owner called for a private tow to remove the vehicle. The staff at the JCC stated that a Martha Bixby gave her number and stated that she observed a black colored car with MA reg. # 934HH4 strike M/V 1. I attempted to call the number and left a message. The listing for that plate comes back to a 2010 Lexus ES350 color gray. I was then showed the video surveillance from the JCC's cameras and it shows an older white female exiting the lobby wearing a winter hat and carrying a bag with purple flower designs on it. She then walks through the lot and enters a gray Lexus ES350. The Lexus then starts backing out of the spot. The Lexus then continues backwards in to the other side of the parking stalls and strikes M/V 1 on the driver's side front door. The Lexus then pulls forward and leaves the scene without stopping or providing her information. As the Lexus is leaving, you can see there is a dent to the driver's side rear bumper. The video is not clear enough to see the plate on the Lexus or clearly see the operator's face. After, I located a number for the owner of the Lexus M/V 2 (Tania Lefman). I spoke to Lefman on the phone and she stated that she was backing out of the JCC parking lot at that time and felt a tiny bump to her rear end. She says that she could not stop in time due to the icy parking lot and then left the area thinking that nothing was wrong, it was only minor. I advised her there was significant damage to the other car. Traffic Bureau Update (Officer Gaudet): On Monday, February 4, 2019 I made contact with the President of Metrowest Packaging, Brian Hersh. Hersh stated his company does fulfillment deliveries for Amazon. Hersh was advised that a vehicle registered to his company was allegedly involved in a hit and run accident. Hersh was provided information on the vehicle involved. Hersh stated an employee named Alexis was operating MA CON:T65665 on the date of the accident and provided a phone number for this party. On Tuesday, February 5, 2019 I spoke with Alexis Laporte-Soto (S84358654). Laporte-Soto stated he was operating a 2017 Mercedes Sprint van (MA CON:T65665) in Newton for Metrowest Packaging on the date of the accident. I explained to Laporte-Soto the vehicle he was operating was alleged to have been involved in a hit and run accident on Highland Street in Newton. Highland Street is a public way maintained by the City of Newton. Laporte-Soto stated the vehicle he was operating hit the driver door mirror of a parked card on Highland Street. Laporte-Soto reported the accident as mirror (MV2 passenger side) to mirror (MV1 driver side). Laporte-Soto stated after his passenger side door mirror made contact with MV1's driver side door mirror, he stopped his vehicle 15 feet down the road. Laporte-Soto stated he walked up to the car he hit and saw the mirror was bent back but there was no damage. Laporte-Soto stated he waited near the car for 10 minutes and the owner never showed up. Laporte-Soto also stated a ""random guy"" took a picture of his license plate. Laporte-Soto stated he said ""hi"" to this party but the party ignored him and left the area. I asked Laporte-Soto why he did not call Newton Police to assist him in finding the owner of the vehicle he hit. Laporte-Soto stated he didn't know. I also advised Laporte-Soto that the name of the owner of the vehicle he hit was printed on the driver side door next. The owner's phone number and email address were also printed on the driver door. Laporte-Soto stated he didn't see that. I spoke with the owner of MV1, Jason Correria. Correria stated a co-worker observed the entire accident and observed MV2's passenger side mirror hit MV1's driver side mirror. She says that the vehicle slowed down after and then continued to leave the scene of the accident. She then took a photo of the above listed registration plate. I attempted to contact the owner of M/V # 2 (Jali Medical Inc Waltham, MA) and the receptionist was not able to provide any information at the time. I was told to call back the next day. I gave the vehicle and registration info to the person inquiring if they could find a possible driver and call back. While working on this report, I observed that the owner of M/V # 2 was involved in a past accident in our system and the operator at the time had an address of 66 Country Club Rd. Newton. On 03/20/19 at approx. 09:30 hours, I went over to this address and observed M/V # 2 in the driveway with an operator inside. She then continues to exit the garage scraping the entire passenger side of her car along the device that is attached to the wall. I viewed the garage door and there was significant damage as it became detached from the wall. The door had to be placed out of service. After I spoke to Ms. Weinstein who admitted to striking the side of the garage door but only thought there was damage to her vehicle. A Hit and Run inquiry was mailed to the Foster. On Thursday, March 28, 2019, I spoke with Norman Foster in the Newton Police Traffic Bureau. Foster stated at the date and time of the accident he was stopped in traffic a few cars back from the red light. Foster stated he felt something ""restraining"" his vehicle, and then backed up a few feet. Foster stated he then left the area. At the time, the road surface was dry and the weather was cloudy. Traffic was particulary heavy as there were several streets in the area still blocked off for the Walk for Hunger and there were participants still walking the route in the area. My attention was drawn to the intersection of Centre Street and Bowen Street as there was a motor vehicle travelling southbound on Centre Street with their left turn signal on attempting to take a left turn on to Gibbs Street. Gibbs Street was temporarily blocked to non-residential motorists as there were several pedestrians in the road crossing over Gibbs Street. As the motor vehicle attempted to turn, there were several pedestrians in the crosswalk crossing over Gibbs Street. The vehicle had stopped halfway into the northbound lane on Centre Street blocking on coming traffic. The operator appeared to realize Gibbs Street was blocked and attemped to turn the vehicle back into the southbound lane to continue southbound on Centre Street. As the vehicle turned back into the southbound traffic lane, the vehicles rear end collided with Officer Richard Clements, who was operating NPD motorcycle unit 533. Officer Clements was traveling southbound on Centre Street and was passing the vehicles in the southbound traffic lane which were currently all at a standstill. Officer Clements had his emergency lights activated as he was on his way to remove traffic cones from the street to open up all the traffic lanes along the event route. Officer Clements was working the City of Newton detail for the Walk for Hunger assigned to the motorcycle to assist with traffic. Officer Clements front wheel, left side of the motorcycle and left leg collided with the rear end of the motor vehicle. The impact of the crash caused him to fall off the left side of the motorcycle and land on the street face first. At this time I immediately ran from my post to Officer Clements location and radioed dispatch that a motorcycle officer was down and that I needed assistance. As I approached Officer Clements he was face down, unconcious and breathing. I was able to roll Officer Clements into the recovery position and at this time Officer Clements regained conciousness and was able to speak and stated "" What happened? What was that lady doing she turned right into me"". I advised Officer Clements that he had just been involved in an accident and to stay still and that help was on the way. The operator of the motor vehicle identified as Helen Leibner (S52717988) stopped her vehicle immediatley after the crash and got out of her vehicle to offer her assistance. I advised Helen and several other witnesses and bystanders who were now crowding around Officer Clements and I to back away from the scene and to not move any of the vehicles involved. Officer Selig arrived on scene and was able to help crowd control until further help arrived. Helen and all witnesses were advised to stand by for police to take their statements. While tending to Officer Clements he was disoriented and made several attempts to move his body to which I had to physically hold him still to prevent possible further injuries. While speaking with Officer Clements I noticed blood coming from the inside of his mouth. Officer Clements was in a noticeable amount of pain. He complained of head, back and left leg pain. Officer Clements was wearing a yellow ANSI certified Newton Police reflective jacket and a Newton Police issued motorcycle helmet. Once the paramedics and fire personnel arrived I was able to speak to the operator of the motor vehicle and several other witnesses. Helen stated she was traveling southbound on Centre Street operating her blue 2014 Audi A4 (MA REG 213BC9). Helen states she was attempting to take a left turn onto Gibbs Street and activated her left turn signal. Helen states she had stopped halfway into the northbound lane as several pedestrians were crossing Gibbs Street in the crosswalk at the time. Helen states after the pedestrians cleared she saw the traffic cones blocking the street and realized the street was closed. Helen states she turned her vehicle back into the southbound traffic lane and did not see Officer Clements or the motorcycle until impact. Helen was not injured and her motor vehicle sustained moderate rear end damage. Her motor vehicle was able to drive away from the scene. Witness Adron Gordon (S90357161) stated he was participating in the Walk for Hunger and had just crossed over Gibbs Street when the crash occured. He stated he witnessed the Officer on the motorcycle with the emergency lights on traveling southbound on Centre Street behind the motor vehicle. The motor vehicle stopped in traffic attempting to turn left onto Gibbs Street. He states then the vehicle made a slight turn back into the southbound traffic lane and the motorcycle collided with the rear end of the motor vehicle. He states the Officer then fell off the motorcycle landing in the middle of Centre Street. Witness Elizabeth McCarthy (S00242346) and Katherine Regan (S43486601) stated they both were in the same vehicle together stopped in traffic in the northbound lane of Centre Street just before the set of lights at Centre Street and Bowen Street. Both witnesses stated they do not remember if the driver of the motor vehicle had the turn signal on but they did see her attempt to turn onto Gibbs Street. They stated they also saw the motorcycle with emergency lights activated travel southbound on Centre Street approaching behind the vehicle. Witnesses state the motor vehicle then suddenly turned back into the southbound lane and the motorcycle collided with the passenger side tailight of the motor vehicle. Both witnesses state the motorcycle attemped to turn away from the vehicle to avoid the crash but was unable to do so. Witness Nina Wang (S39460985) stated she was parked on the southbound lane of Centre Street just prior to the crash scene. Nina states she was in her City of Newton DPW marked vehicle with the hazards on as she was working to assist with traffic safety for the Walk for Hunger. Nina states she witnessed the motorcycle travel southbound on Centre Street and pass the vehicles stopped in the traffic lane. Nina states the motorcycle passed the traffic using the left side and had the emergency lights activated. Nina states the motorcycle was just passing through the green light at Centre Street and Bowen Street when the motor vehicle that was stopped at the lights attempting to take a left turn onto Gibbs Street. Nina states the vehicle then abruptly jerked her car to the right and collided with the motorcycles left side. Nina states she heard a loud crash and witnessed the Officer fall off the motorcycle and land face first onto the street. The motorcycle's final resting place was on its left side approximately two feet away from where Officer Clements was located. The motorcycle sustained moderate damage to its left side, including the front wheel well and undercarriage. The motorcycle left scuff marks on the street which were measured and photographed. Several photographs of the scene and damage to both vehicles were taken and submitted to the IT Bureau. The motorcycle was towed by Todys. Centre Street and Bowen Street are both public ways maintained by the City of Newton. The injured motorcyclist, Officer Clements, was transported to Saint Elizabeth Hospital with fire fighters on board. I was able to follow up with Officer Clements on the phone the next day who was admitted over night at the hospital. Officer Clements stated he has no recollection of the accident and can only remember driving down Centre Street to begin to pick up cones to open up all lanes of traffic. Officer Clements stated he suffered a brain bleed, head, back, left foot and right thumb injuries. Donna stated she was standing in the marked parking space waiting for traffic to stop to safely cross the street. Donna states the cars stopped to let her cross and she proceeded into the roadway. She states MV1 was attempting to back into the parking space that she was standing in and struck her right side and knocked her to the ground. Donna states the operator of MV1 stopped the vehicle when he realized he had struck her and got out to contact 911. Donna appeared to have minor injuries and complained of head pain. Medics transported Donna to NWH to be further evaluated. The operator of MV1 identified as Christopher Moos (S24090966) stated he was attempting to parallel park into an empty parking space and never saw the pedestrian standing in the space. Christopher stated as he was backing up into the space he was notified by a bystander that he just struck a pedestrian. Christopher stated he immediately stopped the vehicle and got out to assist the pedestrian and contact 911. Christopher stated he was not travelling no more than 5mph at the time of the accident. Believing that Beaver was stopping to let him cross , Donovan stated that he held up his left hand to signal to Beaver that he was going to cross. On 06/12/2019 I was forwarded an E-mail from Capt Anastasia of a video of the crash that was taken from a camera that was mounted on the roof of 321 Walnut St. The video shows Donovan walking into the marked crosswalk from the east side of Walnut St and hold up his left had to Beaver's on oncoming vehicle. Beaver vehicle appears to be travailing faster than the 5 to 10 MPH that Beaver believed that he was travailing. The video shows that Beaver did not brake until Donovan was struck and landed on his vehicles hood. Donovan was thrown approximately 10 feet from Beaver's vehicle and landed on his right side on the roadway. The weather at the time of the accident was clear and sunny. The road surface was dry. Beacon Street and Paulson Road are both public ways maintained by the City of Newton. I spoke with the injured bicyclist in front of 165 Paulson Road, Alexander Mendonez. Mendonez stated he was traveling Westbound on Beacon Street on his bicycle near Paulson Road. Mendonez stated he observed a late model gray sedan ""inch to a stop"" on Beacon Street (W) at Paulson Road. Mendonez stated he did not remember if the vehicle had it's right directional on at the time. Mendonez stated as he was traveling through the intersection with the vehicle on his left, the vehicle took a right turn onto Paulson in front of him. Mendonez stated he attempted to brake and veer to the right of the vehicle, but was unable to avoid the collision. Mendonez stated his left side made contact with the rear passenger door/rear fender area of the vehicle. Mendonez fell to the roadway and the vehicle left the area Northbound on Paulson Road. Mendonez was unable to see who was operating the vehicle. Newton Medics responded and treated Mendonez for injuries to his left knee/arm area. Mendonez signed a patient refusal with Newton Medics. I observed minor damage to the left handlebar area of Mendonez's bicycle (black Trek). Mendonez was wearing a white helmet at the time of the accident with a blue shirt and white and black shorts. Pictures were taken of the area and bicycle and submitted to the IT Bureau. Mendonez was able to provide a partial Massachusetts registration of ""7BS32"". I attempted run this plate with multiple combinations. I searched the area for a vehicle matching the description given by Mendonez with a negative result. On July 16, 2019, I spoke with a witness to the incident Mark O'Hearne. O'Hearne stated he was traveling Westbound on Beacon Street a few car lengths behind where the accident occurred. O'Hearne stated he observed a bicyclist on the right side of the road abruptly stop and fall to the roadway. O'Hearne stated he observed a vehicle in the path of the bicycle. O'Hearne stated the vehicle did not stop after the bicyclist fell and took a right onto Paulson Road from Beacon Street. O'Hearne stated he followed the vehicle involved in the accident to Commonwealth Avenue, and while doing so took a picture of the vehicle's license plate. O'Hearne stated he did not observe who was driving the vehicle. The Massachusetts registration provided to me by O'Hearne is 7BS322. This vehicle comes back to a 2010 Volkswagon Jetta registered to Peter Giorgi (S20952090) out of Paxton, Ma. I spoke with Peter via telephone. Peter acknowledged he is the registered owner of the vehicle, but stated his daughter was using the vehicle and was in the Newton area. I spoke with Lindsey Giorgi (S35711247) via telephone. Giorgi stated she was operating MA: 7BS322 in Newton yesterday, but does not recall being in an accident. Giorgi stated she is not familiar with the area and does not know the area where the accident occurred. Giorgi stated there is no damage to her vehicle and stated she does not believe she hit anyone. Giorgi emailed me 4 photos of her vehicle where I described the damage would be. I observed a small area of minor damage to the rear passenger side door area of this vehicle. After speaking with all parties involved, I am requesting a hearing in Newton District Court for Chapter 90, Section 24 (Leaving the Scene, Personal Injury). Giorgi was advised and mailed Massachusetts Uniform Citation T1269847. A telephone search revealed a phone number of (269)857-7814 for him out of Aiken, SC and the Foxborough address but the number is not in service. UPDATE: I was provided a phone number for Masterson from N. Attleboro PD. On 08/16/19 at 12:45 hours, I spoke to Sheila Masterson who stated she was driving MV2 at the time of the reported accident. She stated that she was unaware that she struck MV1 and saw the other operator looking at her but thought nothing of it. Healy also made an attempt to make contact with Kenneth Doucette later on in the evening and had negative results. I left a voicemail message to the witness and have yet to receive a return call for questioning. This will be further investigated on my next tour of Duty. **UPDATE Wednesday 09/04/19** At approximately 10:00 a.m. I went to 41 Thaxter Street to once again attempt to make contact with Kenneth Doucette and had negative results. I left another voicemail for the witness Claudio Silva and had negative results. I then spoke to Traffic Officer M. Gaudet to inform him about this incident and he stated that he will follow up with this investigation. Traffic Bureau update (Officer Gaudet): On September 4, 2019, I attempted to make contact with the witness to the crash, Claudio Silva, with a negative result. RP went to hospital (Faulkner) on his own for lower back pain and has not been to work since. RP was able to take picture of the side of the delivery van. The van belonged to Shortstop Distribution Inc (508-655-5948). RP left a message that morning. He was texted by Gedeon (786-352-6695) who stated there was a language barrier and he didn't understand what had happened. RP advised Gedeon to talk to his lawyer or the police. Traffic Bureau Update (Officer Gaudet): On Monday, September 9, 2019 I attempted to make contact with the operator if MV1, Gedeon Duarte, with a negative result. A Hit and Run motor vehicle inquiry was mailed to Duarte. I spoke with the injured party, Kevin Coston, via telephone on September 9, 2019. Coston stated he is an employee at the Whole Foods located at 916 Walnut Street, Newton. Coston stated on August 23, 2019 a black van backed into him as he was kneeling on the ground taking off his knee pads in the loading area of the store. Coston stated he approached the driver who remained in the vehicle to speak with him after he was hit. Coston described the driver as a heavy set Spanish male. Coston stated the operator of the vehicle rolled down his window, took his headphones out of his ear, said sorry, and left the area. Coston stated he contacted the Newton Police to report the accident but was told he needed to come in person to file the report. Coston stated he was unable to come to the station to file the report until September 8, 2019. On Friday, September 13, 2019, I spoke with Gedeon Duarte at the Newton Police Department. Duarte stated he spoke Portuguese and did not speak English. With the assistance of David Sargent from the Language Line (1-800-225-5254) translating, I was to speak with Mr. Duarte in the Traffic Bureau. Duarte stated he was making a delivery at Whole Foods and was waiting for another truck to leave so he could leave the area. Duarte stated a male party (Coston) came up to his driver door and was yelling him. Duarte stated that due to language barrier he was unable to understand what the person was saying to him, but stated the male party was yelling, ""Fuck you! Fuck you!"" Duarte stated he did not know what was going on and stated he left the area to allow the male party to calm down. Duarte stated he returned a minute later the male party did not want to speak with him. Duarte stated he returned a second time later in the morning and Coston was not there. Duarte stated he received a call from his employer stating Kevin Coston had called for him and he was provided with Coston's phone number. Duarte stated he texted Coston to find out what happened that morning. Duarte showed me a text message exchange from August 23, 2019 at 9:03 A.M. between himself and a party listed as ""Kevin Whole"". In the text messages, Duarte stated he is the driver of the van and that his supervisor called him. The other party responded and stated ""Talk to the police and my lawyer"". Duarte stated that he did not understand what happened and that he returned to whole foods. Duarte ended the text exchange with ""927535425 my number of policy..."" Duarte stated he had no idea he made contact with Coston and stated at the time of the alleged accident he did not hear/see/feel anything otherwise he would have stopped. Duarte's information has been updated in this report to reflect him as the operator/vehicle involved. Duarte also submitted pictures of the rear of his vehicle, a 2008 black Ford E350 (MA: 8NY171), from the day of the accident. Photos were submitted to the IT Bureau. Sebastian was not complaining of any pain and did not need any medical attention. I then asked Sebastian what happened tonight. Sebastian stated he had just left a friends house and was driving the Jeep Westbound on Commonwealth Ave. He was driving through the intersection with Washington St when he became distracted and looked away from the road. At this point, his Jeep had jumped the curb and crashed into the traffic light pole. The traffic light pole was knocked down and blocked the road Westbound on Commonwealth Ave. Cruisers were used to block the road until Daegle Electric had arrived on scene to clear away the debris. The Jeep was towed by Tody's and a towed motor vehicle form was filed. Due to Sebastian's failure to pay attention, Sebastian Pike was issued Massachusetts Uniform Citation #T2079375 for 90/24 Negligent Operation and 89/4a Marked Lanes Violation. A copy of the report was attached to the citation and submitted to the police prosecutors box as a Criminal Application. Sebastian's Father, Jeffrey Pike, had arrived on scene and drove his son home for the night.
