At the time, the road surface was dry and the weather was cloudy. Traffic was particulary heavy as there were several streets in the area still blocked off for the Walk for Hunger and there were participants still walking the route in the area. My attention was drawn to the intersection of Centre Street and Bowen Street as there was a motor vehicle travelling southbound on Centre Street with their left turn signal on attempting to take a left turn on to Gibbs Street. Gibbs Street was temporarily blocked to non-residential motorists as there were several pedestrians in the road crossing over Gibbs Street. As the motor vehicle attempted to turn, there were several pedestrians in the crosswalk crossing over Gibbs Street. The vehicle had stopped halfway into the northbound lane on Centre Street blocking on coming traffic. The operator appeared to realize Gibbs Street was blocked and attemped to turn the vehicle back into the southbound lane to continue southbound on Centre Street. As the vehicle turned back into the southbound traffic lane, the vehicles rear end collided with Officer Richard Clements, who was operating NPD motorcycle unit 533. Officer Clements was traveling southbound on Centre Street and was passing the vehicles in the southbound traffic lane which were currently all at a standstill. Officer Clements had his emergency lights activated as he was on his way to remove traffic cones from the street to open up all the traffic lanes along the event route. Officer Clements was working the City of Newton detail for the Walk for Hunger assigned to the motorcycle to assist with traffic. Officer Clements front wheel, left side of the motorcycle and left leg collided with the rear end of the motor vehicle. The impact of the crash caused him to fall off the left side of the motorcycle and land on the street face first. At this time I immediately ran from my post to Officer Clements location and radioed dispatch that a motorcycle officer was down and that I needed assistance. As I approached Officer Clements he was face down, unconcious and breathing. I was able to roll Officer Clements into the recovery position and at this time Officer Clements regained conciousness and was able to speak and stated "" What happened? What was that lady doing she turned right into me"". I advised Officer Clements that he had just been involved in an accident and to stay still and that help was on the way. The operator of the motor vehicle identified as Helen Leibner (S52717988) stopped her vehicle immediatley after the crash and got out of her vehicle to offer her assistance. I advised Helen and several other witnesses and bystanders who were now crowding around Officer Clements and I to back away from the scene and to not move any of the vehicles involved. Officer Selig arrived on scene and was able to help crowd control until further help arrived. Helen and all witnesses were advised to stand by for police to take their statements. While tending to Officer Clements he was disoriented and made several attempts to move his body to which I had to physically hold him still to prevent possible further injuries. While speaking with Officer Clements I noticed blood coming from the inside of his mouth. Officer Clements was in a noticeable amount of pain. He complained of head, back and left leg pain. Officer Clements was wearing a yellow ANSI certified Newton Police reflective jacket and a Newton Police issued motorcycle helmet. Once the paramedics and fire personnel arrived I was able to speak to the operator of the motor vehicle and several other witnesses. Helen stated she was traveling southbound on Centre Street operating her blue 2014 Audi A4 (MA REG 213BC9). Helen states she was attempting to take a left turn onto Gibbs Street and activated her left turn signal. Helen states she had stopped halfway into the northbound lane as several pedestrians were crossing Gibbs Street in the crosswalk at the time. Helen states after the pedestrians cleared she saw the traffic cones blocking the street and realized the street was closed. Helen states she turned her vehicle back into the southbound traffic lane and did not see Officer Clements or the motorcycle until impact. Helen was not injured and her motor vehicle sustained moderate rear end damage. Her motor vehicle was able to drive away from the scene. Witness Adron Gordon (S90357161) stated he was participating in the Walk for Hunger and had just crossed over Gibbs Street when the crash occured. He stated he witnessed the Officer on the motorcycle with the emergency lights on traveling southbound on Centre Street behind the motor vehicle. The motor vehicle stopped in traffic attempting to turn left onto Gibbs Street. He states then the vehicle made a slight turn back into the southbound traffic lane and the motorcycle collided with the rear end of the motor vehicle. He states the Officer then fell off the motorcycle landing in the middle of Centre Street. Witness Elizabeth McCarthy (S00242346) and Katherine Regan (S43486601) stated they both were in the same vehicle together stopped in traffic in the northbound lane of Centre Street just before the set of lights at Centre Street and Bowen Street. Both witnesses stated they do not remember if the driver of the motor vehicle had the turn signal on but they did see her attempt to turn onto Gibbs Street. They stated they also saw the motorcycle with emergency lights activated travel southbound on Centre Street approaching behind the vehicle. Witnesses state the motor vehicle then suddenly turned back into the southbound lane and the motorcycle collided with the passenger side tailight of the motor vehicle. Both witnesses state the motorcycle attemped to turn away from the vehicle to avoid the crash but was unable to do so. Witness Nina Wang (S39460985) stated she was parked on the southbound lane of Centre Street just prior to the crash scene. Nina states she was in her City of Newton DPW marked vehicle with the hazards on as she was working to assist with traffic safety for the Walk for Hunger. Nina states she witnessed the motorcycle travel southbound on Centre Street and pass the vehicles stopped in the traffic lane. Nina states the motorcycle passed the traffic using the left side and had the emergency lights activated. Nina states the motorcycle was just passing through the green light at Centre Street and Bowen Street when the motor vehicle that was stopped at the lights attempting to take a left turn onto Gibbs Street. Nina states the vehicle then abruptly jerked her car to the right and collided with the motorcycles left side. Nina states she heard a loud crash and witnessed the Officer fall off the motorcycle and land face first onto the street. The motorcycle's final resting place was on its left side approximately two feet away from where Officer Clements was located. The motorcycle sustained moderate damage to its left side, including the front wheel well and undercarriage. The motorcycle left scuff marks on the street which were measured and photographed. Several photographs of the scene and damage to both vehicles were taken and submitted to the IT Bureau. The motorcycle was towed by Todys. Centre Street and Bowen Street are both public ways maintained by the City of Newton. The injured motorcyclist, Officer Clements, was transported to Saint Elizabeth Hospital with fire fighters on board. I was able to follow up with Officer Clements on the phone the next day who was admitted over night at the hospital. Officer Clements stated he has no recollection of the accident and can only remember driving down Centre Street to begin to pick up cones to open up all lanes of traffic. Officer Clements stated he suffered a brain bleed, head, back, left foot and right thumb injuries. The pedestrian identified as Donna Kalikow (S24151638) stated she was standing in an open parking space for a few seconds, attempting to walk across the street to enter J.P. Licks. Donna stated she was standing in the marked parking space waiting for traffic to stop to safely cross the street. Donna states the cars stopped to let her cross and she proceeded into the roadway. She states MV1 was attempting to back into the parking space that she was standing in and struck her right side and knocked her to the ground. Donna states the operator of MV1 stopped the vehicle when he realized he had struck her and got out to contact 911. Donna appeared to have minor injuries and complained of head pain. Medics transported Donna to NWH to be further evaluated. The operator of MV1 identified as Christopher Moos (S24090966) stated he was attempting to parallel park into an empty parking space and never saw the pedestrian standing in the space. Christopher stated as he was backing up into the space he was notified by a bystander that he just struck a pedestrian. Christopher stated he immediately stopped the vehicle and got out to assist the pedestrian and contact 911. Christopher stated he was not travelling no more than 5mph at the time of the accident. MV1 did not have any damage to the vehicle and was able to leave the scene. Christopher reported no injuries. Several photographs were taken of the scene and submitted to the IT Bureau. Walnut St is a public way in the city of Newton. Beaver stated that he did not see the pedestrian prior to the crash and that his vehicle was travailing approximately 5 to 10 MPH. Beaver stated that the pedestrian was knocked to the ground but got up and walked around. The pedestrian, NNHS student Benjamin Donovan stated that he was crossing east to west in the marked crosswalk in front of 321 Walnut St. Donovan stated that he saw Beaver's vehicle approaching him at approximately 5 to 10 MPH. Believing that Beaver was stopping to let him cross , Donovan stated that he held up his left hand to signal to Beaver that he was going to cross. Donovan stated that Beaver's vehicle struck him on his left side and knocked him to the ground. Donovan stated that he had minor scrapes on his right side as a result of falling to the ground. Donovan stated that he did not lose consciousness and was transported via EMS to Newton Wellesley Hospital for treatment. I took photos of Beaver's vehicle and forward the disk to NPD IT Bureau. I issued Beaver MA Citation T 1269995 and cited him for a violation of MGL Ch 89 C 11, failure to yield to a pedestrian in a crosswalk. On 06/12/2019 I was forwarded an E-mail from Capt Anastasia of a video of the crash that was taken from a camera that was mounted on the roof of 321 Walnut St. The video shows Donovan walking into the marked crosswalk from the east side of Walnut St and hold up his left had to Beaver's on oncoming vehicle. Beaver vehicle appears to be travailing faster than the 5 to 10 MPH that Beaver believed that he was travailing. The video shows that Beaver did not brake until Donovan was struck and landed on his vehicles hood. Donovan was thrown approximately 10 feet from Beaver's vehicle and landed on his right side on the roadway. Gianelly stated she was crossing Walnut Street in a marked crosswalk towards Washington Park after leaving the Newton Senior Center located at 345 Walnut Street, Newton. Gianelly stated a vehicle exited Washington Park and turned left onto Walnut Street directly at her. Gianelly stated she believes the driver did not see her. Gianelly stated the vehicle hit her while she was in the marked crosswalk on her left side. Gianelly stated she then fell to the roadway. Gianelly was taken to St. Elizabeth's hospital in Boston for injuries to her ribs, back, and sides. I spoke with the operator of MV1, Alex Cook-Williams (S13317988). Cook-Williams stated he was operating his 2009 Pontiac Vibe (MA: 222FV5) Westbound on Washington Park towards Walnut Street. Cook-Williams stated he came to stop at the intersection and observed no traffic in either direction of Walnut Street. Cook-Williams stated he made a left turn onto Walnut Street and did not see the crossing pedestrian until it was too late. Cook-Williams stated he slammed on his brakes and the pedestrian landed on his hood. Cook-Williams stated the pedestrian then fell to the roadway. Cook-Williams reported no injuries. Cook-Williams stated he did not know if the pedestrian was in the crosswalk or not at the time of the crash. I observed minor damage to the passenger side hood/bumper area. Cook-Williams stated he was not distracted at the time of the accident. Helen stated she was able to walk to the side of the road after impact but complained of knee pain. Medic 2 responded and Helen signed a patient refusal. Sgt. Lee transported Helen to the Franklin Elementary School where she was picking up her children and then she left on her own accord. The operator of MV1 identified as James Bond (S93760526) stated he was taking a left turn from Derby Street onto Waltham Street and did not see the pedestrian in the crosswalk until he struck her with his vehicle. Prior to my arrival, the pedestrian involved left the scene and did not want to speak to the officer nor wanted medical attention. Ofc. Claflin then cancelled Cataldo Ambulance. The pedestrian, Mary Alexander, left her information with a store employee prior to leaving. I spoke to the operator of MV # 1 (Joshua Randel MD Lic.# R534440603244) who stated that he was travelling through the third row of the Star Market parking lot at an appropriate speed. He was then attempting to make a left turn near the entrance/exit of the store. He says that there was a large white van parked in the end handicapped spot towards the left of him. He says the van was sticking out in the spot limiting his visibility. As he was half way through his left turn and coming around the corner, he was not able to see a pedestrian pushing a shopping carriage. He then struck the carriage that was being pushed by Mary Alexander. He further says that the cart jolted Ms. Alexander and she fell down to the ground. At the time, Alexander was walking through the lot near the store entrance heading back towards the parked cars. She was not in the crosswalk at the time which was approximately ten feet down from her location. After, I attempted to go to Ms. Alexander's residence to follow up. I spoke to her friend who was bringing up Alexander's groceries and she stated that she decided to go to Newton Wellesley Hospital for treatment. I then spoke to Ms. Alexander in the lobby of the hospital. She stated that she was exiting the store through the lot with her shopping carriage. She believes she was approximately eight feet away from the door when all of a sudden she only saw red coming at her. She believes MV # 1 was speeding at the time. I asked her if she was struck by the vehicle or was the shopping carriage only struck. She replied that she did not know and only remembers falling to the ground after. She sustained a large bruise to the inside palm area of her right hand and her left knee was swollen. Digital photos of the scene were taken and pictures of Ms. Alexander's injuries were taken at the hospital. As far as possible video surveillance, I was told that the Loss Prevention Department has to access the video. On 11/13/19 at approximately 14:20 hours, I went in to the Star Market and spoke to the manager, Nidal Rajeh, inquiring about possible video surveillance. He said there is coverage in the parking lot and he was able to show me the video. A copy of the video would have to be done by Loss Prevention which I requested. I observed at the 12:12pm mark in the video, MV # 1 was parked five spots up from the third row of the lot that he was exiting. I also observed a white transport van parked in the end handicapped spot mentioned by the operator but it was parked correctly and not limiting visibility. Next, MV # 1 backs out of the spot and drives forward going at a reasonable speed. The pedestrian (Alexander) has already exited the store with her carriage and is walking at an angle toward the same third row of parked cars. As the pedestrian is walking towards the direction of MV # 1, it appears that the pedestrian should be visible to him. MV # 1 then starts to take the left turn around the corner without slowing or stopping and strikes the carriage head on. Due to the impact, Alexander then loses grasp of the carriage and it goes past her twisting her body around. She then hits and rolls up on the hood of the vehicle on her left side. MV # 1 then suddenly stops and immediately gets out and provides assistance to the pedestrian. The witness stated that the truck was moving slowly as he made the turn. The witness stated that as he was making the turn, he observed the side mirror hit the pedestrian, knocking him over. I finally spoke with the pedestrian. He stated that he does not remember getting hit by the mirror of the truck. Multiple pictures were taken of the scene. MV#1 had no visible damage to the vehicle, but the passenger side mirror was pushed back against the door. The pedestrian was transported to Brighams by medics with apparent minor injuries. Gilmore stated he began to make his right turn onto Crafts Street when his vehicle made contact with a pedestrian in the roadway. Gilmore stated he did not see the pedestrian until contact was made. I observed no damage to the right passenger side of MV1 where the contact occurred. Gilmore reported no injuries. The injured pedestrian, Charles Doris-Pierce (S68331436), was transported to Brigham and Women's Hospital in Boston for his injuries. I followed up with him in the Emergency Department. Doris-Pierce stated MV1 was stopped at the stop sign on California Street. Doris-Pierce stated he entered the marked crosswalk and began to cross California Street at Crafts Street. Doris-Pierce stated MV1's right passenger side tire ran over his foot. Doris-Pierce stated he then slammed on the hood of MV1. Doris-Pierce stated MV1 continued and he was knocked to the ground. Doris-Pierce reported injuries to his foot, thigh, and back. On arrival, the injured pedestrian was in the process of being transported to Newton Wellesley Hospital with minor injuries. I spoke with the operator of the vehicle involved in the crash, Menachem Uminer (S43996134). Uminer stated he was operating his vehicle on Brookline Street (S) towards Hartman Road. Uminer stated he was stopped in traffic on Brookline Street prior to the crash. Uminer stated the vehicle in front of him proceeded to travel straight from it's stopped position and he then began to follow the traffic on Brookline Street. Uminer stated he did not see anyone in the vicinity of his vehicle as he began to travel straight from his stopped position. Uminer stated as he was traveling by Hartman Road, the front passenger side area of his vehicle made contact with a pedestrian on the right side of Brookline Street at Hartman Road. Uminer stated he did not see this party until after they were struck and he then proceeded to pull his vehicle over. Uminer stated he was operating his vehicle at a very low speed at the time the collision took place. After speaking with Uminer, I observed the white 2017 GMC Yukon (MA: 9NX525) involved in the crash parked on Brookline Street (S) just past Hartman Road. Uminer stated the vehicle had been moved after the collision took place. I observed no obvious damage to the body of the vehicle on the front passenger side area where the collision took place. The front passenger door mirror was folded inward towards the door. Uminer stated he believes the front passenger door mirror was the point of contact between his vehicle and the pedestrian. I spoke with a witness to the crash, Ashley Garcia (S94193596). Garcia stated she was attempting to cross Brookline Street at Spaulding Lane. Garcia stated she entered the marked crosswalk and was a few steps into Brookline Street when a black colored vehicle traveling on Brookline Street (N) slammed on its brakes near the crosswalk. Garcia stated she looked to her left at the vehicle and then heard a thud to the right from the area where the crossing guard was standing near Hartman Road. Garcia stated she looked over and saw a crossing guard on the roadway on Brookline Street (S) at Hartman Road. The injured pedestrian involved in the crash is Cassandra Alexander (S23636307). Alexander is a crossing guard for the City of Newton and is assigned to the intersection of Brookline Street and Hartman Road for the Memorial Spaulding school crossings. This crash occurred while Alexander was performing her official duties. Alexander was wearing her department issued yellow reflective jacket at the time of the crash. I spoke with Alexander at Newton Wellesley Hospital where she was being treated for her injuries. Alexander stated she was performing her duties as a crossing guard at the intersection of Brookline Street and Hartman Road. Alexander stated she had just finished crossing two pedestrians in the marked crosswalk on Hartman Road when observed a pedestrian enter the crosswalk on Brookline Street at Spaulding Lane. Alexander stated she began to enter the intersection of Brookline Street at Hartman Road with her hands up and her department issued yellow reflective jacket on in an effort to stop traffic in the area to allow the pedestrian in the marked crosswalk safely cross. Alexander stated she was struck on her left side by a passing vehicle. Alexander stated she did not see the vehicle and fell to the roadway. Alexander stated as she was falling to the roadway she extended her right arm in an effort to brace her fall. Alexander stated she had injuries to her arms and legs and was sore from the collision. I spoke with a second witness to the crash via telephone, Anand Vaidya (S43996134). Vaidya stated he was stopped in traffic behind MV1 on Brookline Street (Southbound). Vaidya stated he observed the vehicle in front of MV1 proceed straight on Brookline Street after being stopped in traffic. Vaidya stated he then observed MV1 proceed straight on Brookline Street at Hartman Road at a low rate of speed. Vaidya estimated the speed of MV1 at this time to be 5 miles per hour. Vaidya stated a crossing guard was on the right side of the roadway on Brookline Street at Hartman Road wearing a yellow and black reflective jacket and snow pants. Vaidya stated the crossing guard had her back towards him and MV1, and extended her arm out to stop traffic. Vaidya stated at this time MV1 rolled by the crossing guard at a low rate of speed and the front right fender area of the vehicle hit the left rear leg/lower back area of the crossing guard. Vaidya stated the crossing guard bounced off of the car and fell to the roadway. Vaidya stated he believes MV1 was unaware he hit the crossing guard and observed the vehicle travel another 10 feet until it came to stop on Brookline Street. Vaidya stated the crossing guard was not in a marked crosswalk at the time of the crash. Wint was driving a 2018 Chevrolet Colorado pick up tuck ( MA reg 8CA823 ) that Auto Zone leases from Lease Plan USA Ltd. Wint stated that he was headed to Webster St in Newton to pick up a delivery. Wint stated that as he approached the area of 277 Lexington St he believed that the traffic light that is at the marked crosswalk was green for south and north bound traffic. Wint stated that he did not see any pedestrians in the crosswalk, until he heard the sound of an object impacting into the front driver's side of his vehicle. Wint stated that he stopped his vehicle approximately ten yards past the crosswalk and got out. Wint stated it was then he realized that his vehicle had stuck a female and a dog. Wint stated that he was not operating any electronic devices at the time of the crash, and I observed none in his vehicle. Wint stated he was not injured in crash. Wint's vehicle had damage to the driver's side mirror and lower molding of the driver's side front door. Wint's vehicle did not require a tow. Witness Bessy Shanks stated that she was driving in her vehicle behind Wint's vehicle south bound on Lexington St. Shanks stated that Wint's vehicle was driving slow and swerving approximately two blocks prior to the crash. Shanks stated that she believed that Wint may of been distracted. Shanks stated that south and north bound traffic was stopped because that cross walk light was red and that a female and a dog were crossing from the east to west in the marked crosswalk in font 227 of Lexington St. Shanks stated that the front driver's side of Wint's vehicle srtuck the female and the dog as they were approximately halfway into the crosswalk. Shanks stated that the female and dog both fell to the ground after the crash. Witness Elizabeth Keegan stated that she was driving in her vehicle south bound on Lexington St two vehicle behind Wint's vehicle. Keegan stated that she was not sure what color the traffic light was at the time of the crash, but traffic was stopped both not and south bound traffic was stopped. Keegan also stated that Wint's vehicle "" didn't even slow down "". Keegan stated that Wint's vehicle struck the female pedestrian and the dog as they were in the marked crosswalk in front of 277 Lexington St. Witness Henry Taylor stated that his vehicle was the first one stopped at the red crosswalk light at 227 Lexington St in the north bound lane. Taylor stated that north and south bound traffic was stopped and that Wint's vehicle did not stop and stuck a female pedestrian and a dog in the crosswalk. Witness Jacqueline Deos stated that her vehicle was stopped behind Taylor's north bound on Lexington St. Deos stated that north and south bound traffic was stopped for the red light . Deos stated that Wint's vehicle did not stop and that it struck a female pedestrian and a dog in the marked crosswalk. The pedestrian in the crosswalk was identified as Xiaoping Sun. Sun stated that she and her dog stopped on the south bound side of the marked crosswalk across from 227 Lexington St. Sun stated that she activated the crosswalk light and waited until the light was red for north and south bound traffic, and that the walk single was activated. Sun stated that she looked to her left and saw traffic north bound traffic was stopping. Sun stated that she turned to her right and entered the marked crosswalk. Sun stated that she and her dog had crossed over the north bound side of Lexington St and she then looked to her right and saw Wint's vehicle not stopping and "" going very fast "". Sun stated that the front driver's side mirror of Wint's vehicle stuck her in the face . Sun stated that as she fell to the ground she was struck on the left leg by Wint's driver's side. Sun stated that she did not lose consciousness after she had fallen to the ground. Sun was transported via EMS to The Brigham and Women's Hospital for treatment for head and neck injuries and abrasions to her legs. Sun's dog died as a result of being struck by Wint's vehicle. Photo's of the crash site and of Wint's vehicle were taken and the disc was downloaded by the NPD's IT Bureau. Before leaving the crash site, I tested the crosswalk lights and they were in working order. Based upon my observations of the crash site, Wint's vehicle, and the statements made to me, I concluded that Wint was at fault for this crash. I spoke to the operator of the city vehicle (MV# 1) identified as Brian Quiles who works for the City of Newton DPW Utilities Department. He was operating a 2019 Ford F550 dump truck color white bearing MA Official Tag# M3120A at the time. Mr. Quiles states he was operating eastbound attempting to exit the parking lot of 1220 Chestnut Street and turn left on to Oak Street. While attempting to exit the lot, he states that he stopped for a pedestrian crossing the street. At this point, he heard glass shatter but did not realize his truck was ever struck. He then got out and observed that MV# 2 backed in to the rear passenger side of his truck. There was no apparent visible damage to the city vehicle as a result of the accident. I then spoke to the operator of MV# 2 identified as John Deming who was operating a 2017 Honda CRV color green bearing MA reg.# RWCF30 at the time. He states he was parked in the last spot in the parking lot across from the All Star Liquors near the Oak Street entrance/exit. He then attempted to back up his CRV attempting to exit the lot. He says that he observed MV # 1 in the rear of him but thought he had enough room to back up around the truck. He says that he was using his back up camera and misjudged the distance and struck the passenger rear end area of MV# 1. As a result, his rear windshield shattered and he also sustained damage to his driver's side rear brake light cover area. Digital photos were taken of scene and submitted to the I.T. The weather at the time was 60 degrees ( localconditions.com) and the sky was clear and sunny. The road surface was dry. The parking lot is a thru way that the public use to enter/exit the lot or park there. On arrival at the same time with the Fire and Medics, I observed a female laying in the middle of the lot facing down on her back. A small red and gray CVS like type shopping carriage was knocked over and resting on it's side in front of the victim's head. The carriage was moved to the side in order to tend to the victim I also observed a black Honda Civic bearing MA reg.# 3741TW that was involved in the accident. The Honda was out of the parking spot resting approximately two feet away from the pedestrian's legs. I then spoke to the pedestrian identified as Darla Gipson in the rear of the ambulance. She sustained an abrasion to her front left shoulder and arm area which I observed. She also complained of left knee and elbow pain. She stated that she walking through the middle of the parking lot pushing the carriage by the door entrance in a westerly direction towards Chestnut Street. She states that she never saw a vehicle backing up and then she was suddenly struck and believes she was pushed underneath the vehicle. She was then transported to Newton Wellesley Hospital by Cataldo Ambulance. I then spoke to the operator of the Honda Civic identified as Linda Burke (MA S70320414). Ms. Burke was parked in the first spot to the right of the walkway that leads to the entrance/exit doorway. I asked her what occurred and she stated that she was backing her vehicle up to exit the parking lot when she looked behind her not seeing anything in sight. She then started backing up and struck the pedestrian without realizing it. She says the driver of a green cab and his female customer who were no longer on scene were yelling at her to stop her vehicle because the pedestrian was underneath it. She then stopped her vehicle. I observed minor scrapes to the entire rear bumper of the vehicle so it is unknown where it actually struck the pedestrian/carriage. I observed no obvious signs of damage to the carriage. It should be noted that Ms. Burke's Honda does not have a back up camera or back up sensors. There are no surveillance cameras to the apartment complex and no witnesses came forward for the accident. As a result of the investigation, Ms. Burke will be issued Uniform Citation # T1271069 for Newton City Ordinance 19-75 Failure To Use Care in Backing. Techler stated that he was not injured and his vehicle did not require a tow. Le stated that he is a student at Newton North High School and was riding his bike a Giant mountain bike to school. Le stated that he was stopped on his bike on the northeast corner of the intersection of Linwood Ave and Walnut St. Le stated that he saw a pedestrian latter identified as Jason Kaufman walking west bound in the crosswalk from the east side of Walnut St to the west side of Walnut St. Le stated that as Kaufman was crossing over Walnut St he assumed that it was clear to cross over Walnut St while riding his bike. Le stated that he was unsure if the yellow flashing crosswalk lights were activated. Le stated that he rode his bike off of the side walk at the northeast corner of Walnut St at Linwood Ave. Le stated that he did not ride his bike in the marked crosswalk that run from east to west over Walnut St at Linwood Ave. Le stated he rode his bike diagonally into the intersection towards the south west corner of the intersection. Le stated that he did not see Techler's vehicle prior to entering the intersection. It should be noted that at the time of the crash Le was wearing earphones and stated the he was listening to music. Le stated that he was not injured in the crash and signed a patient refusal from in the presence of his father Thanh Le who responded to the crash scene. Le's bike had damage to the front tire and front breaks. Based upon statments made to me by Le, Techler and my observations of the crash area, I believe that they both bear responsibility for the cause of the crash. Le was not in a marked crosswalk and was not sure if the flashing yellow crosswalk lights were activated. Le also was listening to earphones while crossing diagonally into the intersection. I spoke with the operator of MV1, Mr. Joshua Champion (SA1310472). Mr. Champion stated he was operating his 2013 Lincoln MKS (MA: VT41980) while attempting to exit the Avalon parking lot at the Boylston Street (E) off ramp. Mr. Champion stated he was monitoring the traffic to merge and as he started to make his right turn his vehicle crashed into the left side of a pedestrian in the roadway. Mr. Champion stated he did not see the pedestrian as he was making his turn. I observed no damage to the area where the pedestrian made contact with the car. Photos were taken and submitted to the IT Bureau. The injured pedestrian, Mrs. Joan Contompasis, stated she was walking on Boylston Street (W) with her husband. Mrs. Contompasis stated she entered the roadway from off the sidewalk to cross the Avalon parking lot exit and continue on Boylston Street. Mrs. Contompasis stated she believed MV1 had stopped to allow her and her husband to cross. Mrs. Contompasis stated the vehicle then accelerated and it's front passenger side bumper area crashed into her left side. Mrs. Contompasis fell to the roadway. Mrs. Contompasis was transported to Newton Wellesley Hospital for injuries to her right foot and knee. I spoke with a witness to the crash, Mr. Michl Contompasis. Mr.Contompasis stated he was walking with his wife Joan on Boylston Street (W). Mr. Contompasis stated he was walking just ahead of his wife as they crossed the Avalon at Chestnut Hill exit at Rt. 9. On my arrival the fire and medics were speaking with the pedestrian that was struck. He identified himself as SEAN DAZET, DOB 04/3/81, #28 Ashmont Ave, Newton. He stated while walking on the sidewalk with his dog S/B on Nevada St he observed a vehicle backing out a driveway to #266 Nevada St. He said the vehicle was probably ten feet away from him when he yelled out to the driver but the vehicle was already on him. Mr DAZET unable to retreat out of the way put up his left hand to brace for the impact. Mr DAZET was then struck from the vehicles passenger side rear bumper. He was knocked back but never fell to the ground. Mr DAZET reported the vehicle backing out was going he estimated between 5/10 miles per hour prior to the crash. Mr DAZET reported to the medics he was experiencing left hip and left shoulder pain. However he signed a patient refusal. I spoke with the operator of involved vehicle identified as Patrick Alvarez. He stated while he was backing out from the driveway to #266 Nevada St his vehicle made contact with the pedestrian. He further stated he never saw the person walking past the driveway as he was backing up until he heard him yelling out. He immediately stopped his vehicle. The accident was a low impact crash. Mr DAZET was given the operator's information along with his insurance in case he had to seek further treatment for his non visible injuries. Finally Mr DAZET did indicate he probably will follow up with his primary care doctor on Monday. The weather at the time of the crash was cloudy and overcast. The road surface at the time of the crash was dry. The Newton Centre Municipal Parking Lot is open for public travel and use and is maintained by the City of Newton I spoke with the operator of the 2016 Audi 32 (MA: 4PL345) involved in the crash, Mr. Peter Schiller (S26414610). Mr. Schiller stated he entered the Newton Centre lot from Langley Road and made a right turn to enter the back row of parking stalls. Mr. Schiller stated he then took a left turn into the parking area to look for a spot. Mr. Schiller stated he did not see the pedestrian in the roadway in time and his vehicle's front end crashed into the pedestrian. Mr. Schiller estimated the crash happened right near the first car parked in the row closest to where he entered. I showed Mr. Schiller the believed area of impact was actually 3 car stalls in, and the crash occurred in the middle of the travel way. I asked Mr. Schiller if he has any medical conditions or takes any medication that would effect his ability to operator a motor vehicle. Mr. Schiller stated he does not. Mr. Schiller reported no injuries as a result of the crash. I observed very minor damage to the front hood/bumper/fender area of his vehicle from where the crash took place. I did observe soil covering the hood area. The injured pedestrian was carrying a plant with soil in the pot. I asked Mr. Schiller if he could recall where he made contact with the pedestrian or how the pedestrian ended up in front of his vehicle. Mr. Schiller stated he thought the injured pedestrian was running towards his car when the made his turn. I spoke with a witness that remained on scene, Mr. Nicholas Ryland. Mr. Ryland stated he was walking in the Newton Centre lot while pushing his daughter in her stroller. Mr. Ryland stated he observed MV1 enter the lot from Langley Road and took the right turn into the lot at a high rate of speed. Mr. Ryland stated he stopped with the stroller next to the first vehicle parked in the roadway where the last parking stalls begin. The MV1's driver side operated past Mr. Ryland's left side, took a left turn, and then Mr. Ryland stated he heard the crash. The crash took place in the middle of the roadway in between the parking stalls to the East and West of MV1. I responded to Brigham and Women's Hospital in Boston to follow up with the pedestrian injured in the crash, Ms. Sophia Alexandridies (S49399467). Ms. Alexandridies was transported to the emergency department by Fallon Medics with multiple injuries including a head injury. Due to Ms. Alexandridies's injuries, I was unable to obtain a statement from her about the events of the crash. I spoke with Ms. Alexandridies's daughter, Christina, in the emergency department. Christina stated Ms. Alexandridies suffered a head injury, along with possible broken ribs and an injury to her left shoulder. Most of the injuries reported are on Ms. Alexandridies's left side, the presumed area of impact with the vehicle. Due to the circumstances of this crash, and Mr. Schiller being involved in another surchargeable crash on April 28, 2021, a Request for Immediate Threat License Suspension was submitted to the Registry of Motor Vehicles at DCUImmediateThreat@massmail.state.ma.us. Mr. Schiller is also being cited with Massachusetts Uniform Citation 119853AB for Newton City Ordinance Chapter 19, Section 75 (Fail To Use Care). On September 2, 2021, I contacted Mr. Schiller to provide him with additional information about the crash. Mr. Schiller stated he did not realize Ms. Alexandridies was injuried in the crash. Mr. Schiller also stated he has no recollection of being involved in a crash in April. Mr. Schiller was advised to contact his insurance company to inquire about his last crash. Photos were taken of the area and MV1 and submitted to the IT Bureau. The operator stated as she turned through the intersection, she observed the front of her MV strike the pedestrian, the pedestrian dropped to the ground and the MV#1 pulled over to the right side of Parmenter Rd. When asked, the operator stated she were not distracted while operating her MV. When I arrived Mrs. Wei was sitting in the cross walk directly next to the north west corner of that intersection. When asked about her injuries, she stated her hip hurt, she showed me an abrasion on her right elbow/forearm and her lower body was sore. I also observed one of Mrs. Wei's sneakers was on the ground next to her. Mrs. Wei was sitting the entire tire time, did not appear to have any serious injuries and attempted to get up shortly after I arrived, but advised her to remain sitting. Paramedics evaluated Mrs. Wei for minor injuries at the scene and she chose not to be transported to a local hospital for her injuries. I did not observe any damage to MV#1, which the operator confirmed. Beacon St and Grant ave are both public ways in the city of Newton. I spoke to a female party, later identified as Jennifer Diamond, who stated she was hit by a vehicle. Ms. Diamond was visibly shaken up but stated she was not injured. She stated that she was walking Eastbound in the crosswalk on Beacon St crossing the intersection of Grant Ave when she was lightly hit on the right side of her body by a motor vehicle, which caused her to fall to the ground. She stated the vehicle was taking a left onto Grant Ave from Beacon St. She stated the operator, later idenified as, Georgia Giannakopoulos got out of the vehicle to check on her. Ms. Diamond took a photo of the license plate (MA Registration 5SV474 ). Ms. Diamond states the operator then got into her vehicle and drove Northbound on Grant Ave. A witness, Andrew Greenberg, stated he saw a gray Honda CRV take a left onto Grant Ave from Beacon St and hit Ms. Diamond causing her and her dog to fall to the ground. While on the phone with dispatch, he gave the license plate of Massachusetts Registration: 5SV474 (registered to Georgia Giannakopoulos). He also stated, he saw the operator get out of the vehicle to check on Ms. Diamond and when traffic started to build up she became frantic and left, heading Northbound up Grant Ave. I then responded to the residence of Ms. Giannakopoulos. When asked what happened during the accident, Ms. Giannakopoulos stated she was in the car with her granddaughter and was in a rush because her granddaughter had to take a test. She stated she took a left onto Grant Ave from Beacon St when her granddaughter yelled and she hit Ms. Diamond who was in the crosswalk. She stated that she got out of the car to check on Ms. Diamond, who implied she was ok. Ms. Giannakopoulos stated she then went back into her vehicle to drive home and call the police. I spoke with the pedestrian involved in the crash, Ms. Sharon Sabin. Ms. Sabin stated she entered the roadway to cross near 281 Beacon Street (S to N). Ms. Sabin stated she believes she was in the marked crosswalk at this time. Ms. Sabin stated she observed a vehicle to her left stop to let her cross. Ms Sabin stated a the second vehicle (MV1) did not stop and made contact with the tips of her boots. Ms. Sabin was evaluated by Fallon Medics and signed a patient refusal. Ms. Sabin report no injuries. I observed no damage to the boots Ms. Sabin was wearing at the time of the crash. I spoke with the operator of MV1, Ms. Hallie Geller. Ms. Geller stated she was operating her 2014 Toyota Prius (MA: 2AS375) in the area of 281 Beacon Street when a police vehicle with it's emergency lights and siren approached her from behind. Ms. Geller stated as she attempted to pull over to the right side of the road so the cruiser could pass, Ms. Sabin stepped into the crosswalk. Based on my observations, it is unclear if MV1 made contact with Ms. Sabin's toes. She states she was trying to drive passed MV#! that was parked on the side of the road and thought she had enough room between the oncoming traffic and the MV#1. Heinrich reported no injuries and no damage to his vehicle. I then was able to speak to the pedestrian involved who was identified as Emily Singley. Singley stated she was walking eastbound on Hammond St just past Priscilla Rd and saw vehicle 1 stopped at the stop sign so she believed it was safe to cross. As she was crossing she noticed vehicle 1 come at her and had no time to react. She was struck by vehicle 1 and knocked backwards onto the pavement. Singley had scratches to her left arm/elbow and believed she bumped her head but signed a patient refusal with the medics. Where Singley crossed there was no crosswalk but there was a curb cut in the sidewalk for pedestrians. Singley was about half way across the road when she was struck. Based on the statements given by the involved parties I issued Heinrich MA Uniform Citation #T1448567 in hand for 90/18A Failure to yield for a pedestrian. Officer Gilfoy faxed over a copy of their report (report #22-0316). Andrea Simms reported to Lasell PD that on 04/19/2022 between 2130 and 2200 hours she was walking down Woodland Rd and was about to cross Lake Ave when her attention was drawn to a vehicle parked on Lake Ave. She said it looked like the vehicle was waiting to back out of Lake onto Woodland and she waited approximately 1 minute before crossing behind the vehicle. As Simms crossed the vehicle backed up and struck her left knee/thigh. Simms walked over to the passenger side of the vehicle and spoke to the operator who was very apologetic and stated she did not see her. Simms then left the area and did not think to report it until she was advised to the next day by another student. The vehicle operator was identified as Nicole Catania. Catania stated she had just dropped a friend off on Lake Ave and was waiting for traffic on Woodland Rd to go by before she backed out onto the street. As she backed out she heard what sounded like someone hitting her trunk with their hand. Catania stated that a party then came to her passenger side window and Catania stated that Simms never said she was struck but Catania still apologized and told her she never saw her. Simms replied ""OK"" and walked off. Catania never reported the incident because she did not believe there was anything to report. In the report I received from Lasell it stated that they had reviewed CCTV from Karandon House that showed Catania backing up and stopping to allow a passing vehicle to continue on Woodland. Simms is then observed crossing behind Catanias vehicle as it stopped for the other vehicle and it could not be determined if she was struck or hit the trunk with her hand. This area of Beacon Street is a public way maintained and owned by the City of Newton. The weather at the time was 81 degrees and partly cloudy (wunderground.com). The road conditions at the time were dry. On arrival, I spoke to the pedestrian involved in the crash identified as Thomas Jones. He stated the crash took place on 06/09/22 approximately between the hours of 14:05 and 14:10. He further stated that this occurred at 808 Beacon Street while he was crossing Beacon Street near the Bank of America. He says that he pushed the button to activate the crosswalk yellow flashing signal lights. It should be noted that I am familiar with this location and it does have a marked crosswalk on both sides of 808 Beacon Street with yellow flashing signals that can be activated. Once activated, he says a vehicle traveling eastbound on Beacon Street stopped for him. He then entered the crosswalk from the eastbound side of Beacon Street going across the street with his walking cane. He kept walking in to the westbound travel lane of Beacon Street when he was suddenly struck by a motor vehicle. Thomas could not provide what type or color of the vehicle. As a result, Thomas fell forward and was knocked down to the ground on both hands and knees. He also says that his right cheek and eyeglasses struck the pavement which damaged the lens to his glasses. He sustained a bruised (black and blue) right eye. He says approximately seven days later he started having neck pain to which he has been receiving medical attention for. He also states an upper right side tooth implant fell out of his mouth. After the crash, he states he was helped up by two unknown bystanders. An elderly white female who was operating the vehicle that struck him approached him. Thomas says that the female told him that she did not see him crossing the street as she was looking down and not up at the time. She provided him with her name of Jill Levin and her telephone number before leaving. Thomas states he was wearing gray colored khaki pants, sneakers, and a light blue t-shirt at the time of the crash. Next, I attempted to call the number for Jill Levin and left her a message to call me back. At approximately 14:45 hours on this date, Ms. Levin came in to NPD Headquarters and spoke to me. I asked her if she was involved in a accident during the month of June. She stated that there was an incident on a Thursday approximately three weeks ago in June of 2022 at approximately 14:30 hours. She says she was driving her 2013 Lexus 450RX color gray bearing MA reg. # 6RK464 westbound on Beacon Street near address number 808. She saw an older male crossing in the crosswalk and she says that she stopped for him. The male then suddenly fell down in front of her car. She states that she never struck him with her vehicle. She then got of her vehicle and asked him if he needed any assistance to which he replied that he was fine and did not need anything. He provided his name to her. She then provided her name and phone number on a piece of paper. I asked Ms. Levin why she would provide her information to Mr. Jones if no accident occurred. She replied that it was the right thing to do as far as checking on him and seeing if he needed any assistance. I then inquired why Mr. Jones would alledge that she stated to him on scene that you did not see him crossing the street. Also, that you were looking down and not up. Ms. Levin denied ever stating this to Jones. I then went outside and looked at her Lexus 450RX to check for any damage to the front end of the vehicle. I observed two small scratches to the passenger side front bumper which appear unrelated. The marks were indicative of white paint transfer from having contact with another vehicle. Ms. Levin did not know where the marks came from. I advised her that I would investigate this further and check to see if there is surveillance footage from the Bank of America or other source. After, I attempted to call Bank of America and could not reach anyone there. I will check the area and go to the bank on 07/08/22 during my next shift. On 07/08/22 at approximately 09:10 hours, I went up to 808 Beacon Street and observed no other surveillance cameras in the area. I went in to the Bank of America and spoke to the branch manager. He showed me the multiple camera angles they have, but none show out in to Beacon Street. As a result of this investigation and the statements made by both parties, I believe that Mr. Jones was struck by Ms. Levin's vehicle. The fact that Ms. Levin got out of her vehicle to check on Jones and provide her information to him even though she claims no accident took place is highly unlikely. Therefore, I am issuing Ms. Levin MA Uniform Citation # 507419AB for Chapter 89/11 Crosswalk Violation. The citation was mailed out on 07/08/22. Ms. Shur stated she approached the intersection and her attention was focused to her left as she was attempting to merge onto Beacon Street. Ms. Shur stated when she started to make her turn, she crashed into a crossing female pedestrian. Ms. Shur and her passenger, Mr. Leonid Shur reported no injuries. I observed minor damage to the front passenger side of MV1. I spoke with the pedestrian involved in the crash, Ms. Sonig Varadian. Ms. Varadian stated she was crossing Beacon Street in the marked crosswalk (S to N) towards Dalton Road. Ms. Varadian stated as she was in the crosswalk, MV1 took a right turn out of the parking lot of 714 Beacon Street and crashed into her left side. Ms. Varadian stated she then rolled and fell onto the roadway. Ms. Varadian had numerous scrapes and cuts on her person as a result of the crash and signed a patient refusal with Newton Medics. A witness to the crash, Ms. Rebecca Fishman, stated she observed the crash as she was traveling on Beacon Street (W) towards Dalton Road. Ms. Fishman stated she observed the female pedestrian in the roadway crossing and observed MV1 take a right turn out of the parking lot to 714 Beacon Street and crash into the pedestrian.
