THE CALL WAS RECEIVED FROM THE ENVIRONMENTAL POLICE WHO WERE ON-SCENE. ON-SCENE PRIOR TO MY ARRIVAL WERE CAPTAIN DOWLING AND TRAFFIC SERGEANT LEE. CATALDO MEDIC 2 AND AMBULANCE 1 ARRIVED ON-SCENE, SHORTLY AFTER I DID. UPON MY ARRIVAL, I OBSERVED A SILVER HONDA CIVIC WITH HEAVY FRONT END DAMAGE. THE VEHICLE DISPLAYED MASSACHUSETTS REGISTRATION 7ZF784. TWO PEOPLE WERE STANDING BESIDE THE VEHICLE. A MAN AND A WOMEN SAID THEY HAD BEEN IN THE CAR. THE MAN, LATER IDENTIFIED AS BENJAMIN SMALL STATED HE HAD BEEN OPERATING THE VEHICLE. THE WOMAN, LATER IDENTIFIED AS KIMBERLY OAKES, STATED SHE WAS A PASSENGER IN THE VEHICLE. I ASKED THEM IF THEY WERE OK OR NEEDED MEDICAL HELP AND THEY SAID THEY WERE NOT INJURED. THE MEDICS CHECKED OUT MR SMALL ( MEDICS ELISE GADANSKY AND ROBERT ANDERSON) WHICH INCLUDED CHECKING FOR LOW BLOOD SUGAR, DUE TO HIS INABILITY TO SPEAK CLEARLY AND LEGIBLY. HIS BLOOD SUGAR CHECKED OUT FINE. I THEN ASKED MR SMALL WHAT HAD HAPPENED. HE STATED THAT HE WAS TRAVELING WESTBOUND ON DEDHAM ST WHEN ALL OF A SUDDEN A WHITE MINI VAN CROSSED OVER THE DOUBLE YELLOW LINE AND WAS HEADING TOWARDS HIM. HE STATED THAT IN ORDER TO AVOID A HEAD ON COLLISION, HE SWERVED RIGHT, OFF THE ROAD AND STRUCK A TELEPHONE POLE (LATER DETERMINED TO BE UTILITY POLE #60 LOCATED IN FRONT OF 556 DEDHAM STREET). HE STATED THAT HE PULLED OVER ONTO MEADOWBROOK RD. BOTH DEDHAM STREET AND MEADOWBROOK RD ARE PUBLIC WAYS IN THE CITY OF NEWTON. AS I WAS TALKING TO MR SMALL HE APPEARED TO SPEAK VERY SLOWLY, HE APPEARED TO BE LETHARGIC, BUT I COULD NOT DETECT ANY ODOR OF AN ALCOHOLIC BEVERAGE ON HIS BREATH. NEXT I SPOKE TO MS OAKES WHO STATED SHE IS MR SMALL'S GIRLFRIEND. SHE STATED SHE WAS A PASSENGER IN THE FRONT SEAT OF THE CAR. SHE ALSO STATED THAT MR SMALL WAS OPERATING THE VEHICLE WHEN A VEHICLE HAD CUT THEM OFF FORCING THEM OFF THE ROAD INTO THE TELEPHONE POLE. DUE TO THE FACT THAT WE COULD NOT SMELL ANY ALCOHOLIC BEVERAGE ON HIS BREATH, CAPTAIN DOWLING REQUESTED THAT A DRUG RECOGNITION EXPERT (DRE) BE CALLED TO THE SCENE. DISPATCH NOTIFIED SURROUNDING CITIES AND TOWNS OF OUR NEED FOR A DRE. NOBODY WAS ABLE TO RESPOND. TRAFFIC OFFICER WADE RESPONDED TO THE SCENE AND PERFORMED A ROADSIDE ASSESSMENT ON MR SMALL. SEE HIS SUPPLEMENTAL REPORT. BASED ON OFFICER WADES ROADSIDE ASSESSMENT AND MY ON-SCENE OBSERVATIONS, I PLACED MR SMALL UNDER ARREST FOR OUI DRUGS, MARKED LANES, AND NEGLIGENT OPERATION OF A MV. MR SMALL WAS HANDCUFFED AND SEARCHED BY OFFICER WADE. PRIOR TO TRANSPORT, CRUISER 499 WAS SEARCHED BY OFFICER WADE FOR CONTRABAND WITH NEGATIVE RESULTS. OFFICER WADE THEN PLACED MR SMALL INTO CRUISER 499 AND SEAT BELTED HIM. WHILE OFFICER WADE DID THIS, OFFICER WILSON AND I DID AN INVENTORY OF THE VEHICLE. DURING THE INVENTORY, 9 CVS PAPER PRESCRIPTION PRINTOUTS WERE FOUND. THEY WERE ALL IN MR SMALL'S NAME FOR THE DRUG ""ADDERALL"" (8) OR ""KLONOPIN"" (1). ALSO FOUND WAS A SMALL YELLOW PLASTIC PRESCRIPTION TYPE BOTTLE CONTAINING AN UNKNOWN LIQUID. OFFICER WILSON PLACED THE BOTTLE OF UNKNOWN LIQUID INTO A BAG AND HAD IT LATER EXAMINED AT THE NPD STATION BY DET. ROBINSON OF THE DRUG UNIT (HE DETERMINED IT TO BE NOT SUSPICIOUS AND IT WAS DISPOSED OF). THE VEHICLE WAS THEN TOWED BY TODY'S TOWING. THE CVS PAPER PRESCRIPTION PRINTOUTS WERE REMOVED AND PLACED INTO PROPERTY AND EVIDENCE. TOWED MV AND PROPERTY AND EVIDENCE FORMS WERE FILLED OUT. PICTURES OF THE VEHICLE AND DAMAGED TELEPHONE POLE WERE TAKEN BY OFFICER WILSON. OFFICER WILSON TURNED THE DISC OVER TO DIRECTOR SMITH, WHO DOWNLOADED THEM. The vehicle is idenitified by a still photo submitted by the witness as a 2016 Kia Sportage bearing Massachusetts registration 2BZH27. This vehicle is registed to Ms. Jennifer Mc Quiggan (S30952065). I contacted Ms. Mc Quiggan and asked about her vehicles involvement in the crash on March 10, 2022. Ms. Mc Quiggan stated she was operating the vehicle at the time of the crash on Adams Street and thought she hit a snow bank. I advised Ms. Mc Quiggan that I had just finsihed reviewing the footage of the crash that was submitted by a witness and it shows her vehicle vearing off of the road and crashing into a parked vehicle. After reviewing the footage of the crash and obtaining an admission by Ms. Mc Quiggan that she was operating MV2 at the time of the crash, I issued Ms. Mc Quiggan Massachusetts Uniform Citation 328660AB for Chapter 90, Section 24 (Leaving the Scene of Property Damage) and Chapter 89, Section 4A (Marked Lanes Violation). Upon arrival I spoke with the operator of MV 1, who stated that she was on the left lane on Washington St waiting to turn left onto Hovey street. She stated that the oncoming vehicles stopped for her to turn left on Hovey St when MV2 swerved around the vehicles and crashed into her causing major damage to the center front and right side of the MV. The operator of MV1 stated that she had a dash cam that caught the whole accident on video and they she would provide the video so I can view it. I then spoke to the operator of MV2, who stated that he was driving in far right lane Westbound on Washington St when the operator of MV1 turned left and hit him causing major damage to the center front and left side of the vehicle. He stated that he had the right of way and that there were no cars in front him which is why he continued driving straight. He also stated that he did nothing wrong and that he was following the speed limit. The operator of MV1 was able to send the dash cam footage from the accident. Based on my observations the video was consistent with the statement that operator of MV1 gave. In the video it is clear that MV1 had the right of way to make the left turn onto Hovey St. The operator of MV2 was mailed Mass Uniform Citation T1445888 fir M.G.L 89 4A Marked Lanes violation. Washington Street is a public way maintained by the City of Newton. The weather at the time of the crash was clear and sunny. The road surface was dry. The operator of MV1, Mr. Michael Donovan (S45451533), stated he was operating his 2014 PTRB 388 Tractor Truck (MA: 1AB55A) on Washington Street (S) past One Newton Place. Mr. Donovan stated he came to a stop at the red light at this intersection and was intending on proceeding straight onto the I-90 (W) onramp. Mr. Donovan stated his vehicle was affixed to a 2009 trailer (ME: 2373708) at the time of the crash. Mr. Donovan stated as the light at the intersection turned green, he proceeded to travel forward and the passenger side of his trailer crashed into a vehicle stopped in the roadway to his right. The two vehicle became stuck due to the impact. Mr. Donovan reported no injuries. I observed minor damage to the middle passenger side area of the trailer Mr. Donovan was towing. The operator of MV2, Mr. Christopher Berganti (S43175732), stated he was operating his 2018 Kia Stinger (MA: 722XV4) on Washington Street (S) past One Newton Place. Mr. Berganti stated he merged into the left lane at the intersection to continue straight onto the I-90 (W) onramp. Mr. Berganti believe the travel lane at the intersection near the light was for two lanes of travel. As the light turned green, the vehicle to his left (MV1), began to travel straight through the intersection. Due to the length of the tractor trailer, as it was navigating it's way through the travel lane it's passenger side crashed into entire length of MV2's driver side. Mr. Berganti stated he attempted to pull to the right prior to impact but was unsuccessful. Mr. Berganti reported no injuries. I observed significant damage to the entire driver side of MV2. MV2 was removed from the roadway by Tody's towing. It should be noted in the area where the crash occurred, it is wide enough to support two lanes of travel but it is not lined. Traffic was observed occupying two lanes in this area but it is unclear due to a lack of markings whether or not it is intended to support 1 or 2 lanes of travel.","[""Crash"", ""Solar""]","[""Lane departure""]",[9],/static/reports/22000323.pdf,/static/images/22000323.png,"275 Washington St, Newton, MA 02458, USA",42.3581264,-71.185233,0,2022-04-27T16:27:12.814580 22000334,2022-04-22T17:56,2022-04-22,17:56,90 COMMONWEALTH AVE,WEST 90 COMMONWEALTH AVE,,0,25,0,0,"Vehicle 1 was in the left turn only lane and attempting to make a left turn while Vehicle 2 was in the adjacent straight only lane to the right.
