Bryant stated as he came to a stop in traffic, MV2 crashed into the rear of the vehicle he was operating. I observed minor damage to the rear bucket area of MV1. Bryant reported no injuries on scene and signed a patient refusal with Newton Medics. Bryant works for the Utilities Department with the DPW. The operator of MV2, Andrew Bell (NJ: B23900426706004), stated he was operating his 2013 Volkswagon (NJ: C54KKJ) Eastbound on Webster Street past Cherry Street. Bell stated he was following MV1 a little too close while they were traveling down Webster Street. Bell stated while traveling down Webster Street he looked down quickly but does not remember why, and when he looked up MV1 had come to a stop. Bell stated he could not avoid crashing into the rear of MV1. I observed significant damage to the front hood/windshield area of MV1. Bell was transported to Newton Wellesley Hospital with a minor injury. Traffic Bureau Update (Officer Gaudet): On Monday, February 4, 2019 I made contact with the President of Metrowest Packaging, Brian Hersh. Hersh stated his company does fulfillment deliveries for Amazon. Hersh was advised that a vehicle registered to his company was allegedly involved in a hit and run accident. Hersh was provided information on the vehicle involved. Hersh stated an employee named Alexis was operating MA CON:T65665 on the date of the accident and provided a phone number for this party. On Tuesday, February 5, 2019 I spoke with Alexis Laporte-Soto (S84358654). Laporte-Soto stated he was operating a 2017 Mercedes Sprint van (MA CON:T65665) in Newton for Metrowest Packaging on the date of the accident. I explained to Laporte-Soto the vehicle he was operating was alleged to have been involved in a hit and run accident on Highland Street in Newton. Highland Street is a public way maintained by the City of Newton. Laporte-Soto stated the vehicle he was operating hit the driver door mirror of a parked card on Highland Street. Laporte-Soto reported the accident as mirror (MV2 passenger side) to mirror (MV1 driver side). Laporte-Soto stated after his passenger side door mirror made contact with MV1's driver side door mirror, he stopped his vehicle 15 feet down the road. Laporte-Soto stated he walked up to the car he hit and saw the mirror was bent back but there was no damage. Laporte-Soto stated he waited near the car for 10 minutes and the owner never showed up. Laporte-Soto also stated a ""random guy"" took a picture of his license plate. Laporte-Soto stated he said ""hi"" to this party but the party ignored him and left the area. The witnesses stated the operator of MV#2 was cleaning the snow off her vehicle, got into her vehicle then backed out of her parking space striking MV#1. The witnesses took a digital photograph of MV#2's registration (MA REG 763YC9). They described the operator of MV#2 as an Asian female in her 40's, 5'1"" in height, operating a black colored ""Buick"" S.U.V type vehicle. MV#1 sustained minor damages to its front passenger door and bumper. A query of MA REG 763YC9 showed that it was registered to an Asian female to a black colored ""Buick Rendezvous"". The owner of MV#1 stated the owner of MV#2 also has a business in the same building at 630 Commonwealth Ave (Move2Boston Group). I spoke to the registered owner of MV#2 via telephone and she stated she was parked in the rear parking lot on Rice St but denied making contact with any vehicles. I could not observe MV#2 as it was not at the scene. At 14:40 I returned to 1066 Centre St and was able to observe MV#2. MV#2 displayed minor scrapes to its front driver's side bumper which was consistent relative to where both vehicles were parked. The weather at the time of the accident was cloudy and the road conditions were dry. Both streets are public ways in the City of Newton. Upon arrival I observed the victim identified as Glenn Butcher (MA OLN S36552335), inside the ambulance getting medical attention. Butcher was getting a bandage applied to his left leg and complained of leg, back and neck pain. Butcher appeared visibly shaken and in pain. Butcher stated he had the green traffic light and was travelling eastbound on Beacon Street crossing Centre Street and then continuing straight crossing Herrick Road. Butcher stated MV1 was travelling westbound on Beacon Street and took a left turn onto Herrick Road and collided into his bicycle. Butcher states upon impact he flipped over his bicycle and landed on the hood of MV1, before rolling off and landing on the ground. Butcher states he was wearing his helmet which was present. Butcher states his bicycle ended up partially under MV1. Butcher states the operator of MV1 pulled his vehicle to the side of the road and got out of his vehicle and spoke to several witnesses briefly. Butcher states the operator then left the scene without properly exchanging information and did not wait for the police to arrive. Butcher described the vehicle as a dark gray Honda, and described the operator as an older white male, 5'10 approximately 80 years old with white hair. Butcher was also able to provide an email address for another bicyclist who witnessed the accident. The witness left his information with Butcher prior to my arrival. Fire fighters on scene were able to get the registration number of the vehicle from the witness (MA REG 4CX148) and gave it to Officers on scene. Butcher was transported by Medic 1 to NWH with minor injuries. His bicycle had visible damage to the frame area and skid marks were present on both tires. 19 photographs of the scene and the bicycle were taken and sent to the IT dept. email. Officer Gabriel transported the bicycle to the station where it was logged into Property & Evidence for safekeeping. Dispatch was able to query the registration which came back to a gray, 2010 Honda Accord registered to a Matthew Sugarman (MA OLN S38601397), out of W. Roxbury. Dispatch contacted the Boston Police Dept. and had them send an Officer to the address to try to make contact with Sugarman. Sugarman was advised to contact the Newton Police Dept. and I was able to speak with him on the telephone. Sugarman states he was driving the vehicle today and was involved in an accident with a bicycle. Sugarman states he was travelling westbound on Beacon Street and was taking a left onto Centre Street not Herrick Road. While speaking with Sugarman he seemed confused as to his location during the accident and was adamant that he was turning left onto Centre Street and not Herrick Road. I advised Sugarman that I was on scene with the first responding Officers and the accident clearly occurred at the intersection of Beacon Street and Herrick Road based upon the final resting place of the bicycle. Sugarman went on to state that his vehicle was already turning when the bicycle struck his vehicle and he believed it was the bicyclists fault. I advised Sugarman it appears the bicyclist had the right of way since it was traveling straight and that because his vehicle was taking a left turn, he failed to yield for on coming traffic at an intersection. When asked why he did not stay at the scene of the accident Sugarman stated he got out of his vehicle and spoke to the bicyclist and he ""seemed okay"". Sugarman states he then left the scene while the victim was still sitting on the ground. I asked Sugarman if he had ever been involved in accident before and he replied ""no."" I advised Sugarman that I am currently looking at his drivers history and see nine accidents that he was involved in. Sugarman stated ""he has never been in accident like this before."" I then asked Sugarman what the law states when you are involved in an accident and he was not able to provide me with an answer. I advised him that the law states you must stop and exchange information before leaving the scene of an accident. Again he stated the bicyclist seemed okay and ""he had somewhere to be so he left."" Sugarman has an extensive drivers history including nine surchargeable accidents, reckless operation, two different charges of leaving the scene property damage and two immediate threat affidavits filed against him. I advised Sugarman that I will be mailing him a citation for Ch89 s8 Fail to yield to oncoming traffic, and Ch90 s24 Leaving the scene of personal injury. I also filed an immediate threat form with the registry. I emailed the witness using the information he provided to the Newton Fire Dept that was on scene and received a phone call back from the witness identified as Bruce Adams. See witness report for his statements. I contacted the Bank of America located at 808 Beacon Street in Newton, as they are the closest business to that intersection with video surveillance. I spoke with George Walsh (781-834-8275) who stated they do not have any working cameras on that side of the building to the bank. For this report the bicyclist is entered as a non-motorist for validation purposes. Witness Bruce Adams (MA OLN S96398108) stated that he was riding his bicycle travelling behind the victim about 100 feet away. Adams states he was watching the victim and had a clear view of him as he travelled behind him, through the green traffic light heading eastbound on Beacon Street. Adams stated he witnessed MV1 travelling westbound on Beacon Street take a sharp left turn onto Herrick Road which turns into Union Street. Adams stated that the vehicle turned left colliding into the bicycle and there was no possible way the bicyclist had time to stop to avoid the collision. Adams stated the victim flew over his handle bars and fell on top of MV1's hood and then landed on the ground. Adams stated the victim's bicycle was stuck under MV1's front bumper. Adams stated the operator of MV1 backed his vehicle up with the bicycle still attached to his vehicle bumper and pulled MV1 over to the side of the road. The operator then got out of his vehicle and walked up to the victim who was laying on the ground visibly in pain. Adams stated the operator asked the victim if he was okay to which the victim did not immediatley reply as he was visibly shaken up. Adams stated the operator then walked back to his vehicle and attempted to leave the scene and that is when Adams stood infront of MV1 to stop him from leaving the scene. Adams stated he then removed the bicycle from underneath the bumper of MV1 and placed it on the side of the road. Adams stated the operator got out of his vehicle again and walked up to the victim and asked him ""what do you want to do?"". Adams stated the victim did not respond and that is when the operator got back into his vehicle and drove away, leaving the scene before any emergency response arrived. It appears that the operator of M/V # 2 side swiped M/V # 1 as it was passing by on Dedham Street. I observed marks to the driver's side rear door area and the side view mirror was broken. On 03/20/19 at 08:47 hours, I spoke to the witness, Kawtar Bhih, on the phone and she stated that she was parked on the opposite side of where the accident took place. Bhih observed a gray Honda Accord with an elderly female operating M/V # 2 on Dedham Street almost side swiped another parked car before side swiping M/V # 1. She says that the vehicle slowed down after and then continued to leave the scene of the accident. She then took a photo of the above listed registration plate. I attempted to contact the owner of M/V # 2 (Jali Medical Inc Waltham, MA) and the receptionist was not able to provide any information at the time. I was told to call back the next day. I gave the vehicle and registration info to the person inquiring if they could find a possible driver and call back. While working on this report, I observed that the owner of M/V # 2 was involved in a past accident in our system and the operator at the time had an address of 66 Country Club Rd. Newton. On 03/20/19 at approx. 09:30 hours, I went over to this address and observed M/V # 2 in the driveway with an operator inside. After inquiring about the accident, she stated she was driving down Dedham Street when she heard a noise coming from her passenger side view mirror as she had struck something. She then left the scene not thinking it was serious. I observed fresh damage to her passenger side mirror along with other marks along the doors which appeared to be older. At the time, the road surface was dry and the weather was cloudy. Traffic was particulary heavy as there were several streets in the area still blocked off for the Walk for Hunger and there were participants still walking the route in the area. My attention was drawn to the intersection of Centre Street and Bowen Street as there was a motor vehicle travelling southbound on Centre Street with their left turn signal on attempting to take a left turn on to Gibbs Street. Gibbs Street was temporarily blocked to non-residential motorists as there were several pedestrians in the road crossing over Gibbs Street. As the motor vehicle attempted to turn, there were several pedestrians in the crosswalk crossing over Gibbs Street. The vehicle had stopped halfway into the northbound lane on Centre Street blocking on coming traffic. The operator appeared to realize Gibbs Street was blocked and attemped to turn the vehicle back into the southbound lane to continue southbound on Centre Street. As the vehicle turned back into the southbound traffic lane, the vehicles rear end collided with Officer Richard Clements, who was operating NPD motorcycle unit 533. Officer Clements was traveling southbound on Centre Street and was passing the vehicles in the southbound traffic lane which were currently all at a standstill. Officer Clements had his emergency lights activated as he was on his way to remove traffic cones from the street to open up all the traffic lanes along the event route. Officer Clements was working the City of Newton detail for the Walk for Hunger assigned to the motorcycle to assist with traffic. Officer Clements front wheel, left side of the motorcycle and left leg collided with the rear end of the motor vehicle. The impact of the crash caused him to fall off the left side of the motorcycle and land on the street face first. At this time I immediately ran from my post to Officer Clements location and radioed dispatch that a motorcycle officer was down and that I needed assistance. As I approached Officer Clements he was face down, unconcious and breathing. I was able to roll Officer Clements into the recovery position and at this time Officer Clements regained conciousness and was able to speak and stated "" What happened? What was that lady doing she turned right into me"". I advised Officer Clements that he had just been involved in an accident and to stay still and that help was on the way. The operator of the motor vehicle identified as Helen Leibner (S52717988) stopped her vehicle immediatley after the crash and got out of her vehicle to offer her assistance. I advised Helen and several other witnesses and bystanders who were now crowding around Officer Clements and I to back away from the scene and to not move any of the vehicles involved. Officer Selig arrived on scene and was able to help crowd control until further help arrived. Helen and all witnesses were advised to stand by for police to take their statements. While tending to Officer Clements he was disoriented and made several attempts to move his body to which I had to physically hold him still to prevent possible further injuries. While speaking with Officer Clements I noticed blood coming from the inside of his mouth. Officer Clements was in a noticeable amount of pain. He complained of head, back and left leg pain. Officer Clements was wearing a yellow ANSI certified Newton Police reflective jacket and a Newton Police issued motorcycle helmet. Once the paramedics and fire personnel arrived I was able to speak to the operator of the motor vehicle and several other witnesses. Helen stated she was traveling southbound on Centre Street operating her blue 2014 Audi A4 (MA REG 213BC9). Helen states she was attempting to take a left turn onto Gibbs Street and activated her left turn signal. Helen states she had stopped halfway into the northbound lane as several pedestrians were crossing Gibbs Street in the crosswalk at the time. Helen states after the pedestrians cleared she saw the traffic cones blocking the street and realized the street was closed. Helen states she turned her vehicle back into the southbound traffic lane and did not see Officer Clements or the motorcycle until impact. Helen was not injured and her motor vehicle sustained moderate rear end damage. Her motor vehicle was able to drive away from the scene. Witness Adron Gordon (S90357161) stated he was participating in the Walk for Hunger and had just crossed over Gibbs Street when the crash occured. He stated he witnessed the Officer on the motorcycle with the emergency lights on traveling southbound on Centre Street behind the motor vehicle. The motor vehicle stopped in traffic attempting to turn left onto Gibbs Street. He states then the vehicle made a slight turn back into the southbound traffic lane and the motorcycle collided with the rear end of the motor vehicle. He states the Officer then fell off the motorcycle landing in the middle of Centre Street. Witness Elizabeth McCarthy (S00242346) and Katherine Regan (S43486601) stated they both were in the same vehicle together stopped in traffic in the northbound lane of Centre Street just before the set of lights at Centre Street and Bowen Street. Both witnesses stated they do not remember if the driver of the motor vehicle had the turn signal on but they did see her attempt to turn onto Gibbs Street. They stated they also saw the motorcycle with emergency lights activated travel southbound on Centre Street approaching behind the vehicle. Witnesses state the motor vehicle then suddenly turned back into the southbound lane and the motorcycle collided with the passenger side tailight of the motor vehicle. Both witnesses state the motorcycle attemped to turn away from the vehicle to avoid the crash but was unable to do so. Witness Nina Wang (S39460985) stated she was parked on the southbound lane of Centre Street just prior to the crash scene. Nina states she was in her City of Newton DPW marked vehicle with the hazards on as she was working to assist with traffic safety for the Walk for Hunger. Nina states she witnessed the motorcycle travel southbound on Centre Street and pass the vehicles stopped in the traffic lane. Nina states the motorcycle passed the traffic using the left side and had the emergency lights activated. Nina states the motorcycle was just passing through the green light at Centre Street and Bowen Street when the motor vehicle that was stopped at the lights attempting to take a left turn onto Gibbs Street. Nina states the vehicle then abruptly jerked her car to the right and collided with the motorcycles left side. Nina states she heard a loud crash and witnessed the Officer fall off the motorcycle and land face first onto the street. The motorcycle's final resting place was on its left side approximately two feet away from where Officer Clements was located. The motorcycle sustained moderate damage to its left side, including the front wheel well and undercarriage. The motorcycle left scuff marks on the street which were measured and photographed. Several photographs of the scene and damage to both vehicles were taken and submitted to the IT Bureau. The motorcycle was towed by Todys. Centre Street and Bowen Street are both public ways maintained by the City of Newton. The injured motorcyclist, Officer Clements, was transported to Saint Elizabeth Hospital with fire fighters on board. I was able to follow up with Officer Clements on the phone the next day who was admitted over night at the hospital. Officer Clements stated he has no recollection of the accident and can only remember driving down Centre Street to begin to pick up cones to open up all lanes of traffic. Officer Clements stated he suffered a brain bleed, head, back, left foot and right thumb injuries. Upon arrival I first spoke to the pedestrian who was inside the ambulance getting medical attention. The pedestrian identified as Donna Kalikow (S24151638) stated she was standing in an open parking space for a few seconds, attempting to walk across the street to enter J.P. Licks. Donna stated she was standing in the marked parking space waiting for traffic to stop to safely cross the street. Donna states the cars stopped to let her cross and she proceeded into the roadway. She states MV1 was attempting to back into the parking space that she was standing in and struck her right side and knocked her to the ground. Donna states the operator of MV1 stopped the vehicle when he realized he had struck her and got out to contact 911. Donna appeared to have minor injuries and complained of head pain. Medics transported Donna to NWH to be further evaluated. The operator of MV1 identified as Christopher Moos (S24090966) stated he was attempting to parallel park into an empty parking space and never saw the pedestrian standing in the space. Christopher stated as he was backing up into the space he was notified by a bystander that he just struck a pedestrian. Christopher stated he immediately stopped the vehicle and got out to assist the pedestrian and contact 911. Christopher stated he was not travelling no more than 5mph at the time of the accident. The driveway runs east to west and Thangthong's vehicle was heading west into the driveway as the sun was in the Western sky creating a glare. Thangthong stated that she did no see anything in the driveway prior to her pulling into it. Thangthong stated that she felt the front of her vehicle strike what she described as "" something "" and stopped her vehicle. Thangthong stated that she put her vehicle in reverse and then into park and exited her vehicle to see what she had struck. Thangthong stated that she saw her two nieces, Kalla Mongkhonlertsirkul age three and Kelley Mongkhonlertsirkul age seven laying in the driveway in front of her vehicle. Thangthong stated that she then realized that her vehicle had stuck her two nieces as they were in the driveway. Both of the Mongkhonlertsirkul sisters were conscious and alert and were able to walk to an ambulance for transport to Newton Wellesley Hospital for treatment. Thangthong stated that she and her son were not injured in the crash. I observed no damage to Thangthong's vehicle. I responded to the Newton Wellesley Hospital and spoke with the Mongkhonlertsirkul sisters and their mother Piyada Kellum. Kellum stated that her oldest daughter Kelly is a student at the Franklin Elementary School . Kellum stated that her daughters told her that they were playing in their driveway when their aunt's vehicle entered the driveway and did not stop. I spoke with both of the Mongkhonlertsirkul sisters who told me that they tried to get out of the way of their aunt's vehicle but could not in time. The Mongkhonlertsirkul sisters stated that they were both struck in the back and fell to the ground between the two front tires of their aunt's vehicle. Kalla Mongkhonlertsirkul had scrapes to her right knuckles. Kelly Mongkhonlertsirkul had lacerations to her lower left arm and the left side of her face near her eye. I spoke with hospital staff who stated that there did not appear to be any broken bones or other internal injures. The pedestrian, NNHS student Benjamin Donovan stated that he was crossing east to west in the marked crosswalk in front of 321 Walnut St. Donovan stated that he saw Beaver's vehicle approaching him at approximately 5 to 10 MPH. Believing that Beaver was stopping to let him cross , Donovan stated that he held up his left hand to signal to Beaver that he was going to cross. Donovan stated that Beaver's vehicle struck him on his left side and knocked him to the ground. Donovan stated that he had minor scrapes on his right side as a result of falling to the ground. Donovan stated that he did not lose consciousness and was transported via EMS to Newton Wellesley Hospital for treatment. I took photos of Beaver's vehicle and forward the disk to NPD IT Bureau. On 06/12/2019 I was forwarded an E-mail from Capt Anastasia of a video of the crash that was taken from a camera that was mounted on the roof of 321 Walnut St. The video shows Donovan walking into the marked crosswalk from the east side of Walnut St and hold up his left had to Beaver's on oncoming vehicle. Beaver vehicle appears to be travailing faster than the 5 to 10 MPH that Beaver believed that he was travailing. The video shows that Beaver did not brake until Donovan was struck and landed on his vehicles hood. Donovan was thrown approximately 10 feet from Beaver's vehicle and landed on his right side on the roadway. The weather at the time of the crash was overcast. The road surface where the crash took place was dry. Brookline Street and Hartman Road are both public ways maintained by the City of Newton. On arrival, the injured pedestrian was in the process of being transported to Newton Wellesley Hospital with minor injuries. I spoke with the operator of the vehicle involved in the crash, Menachem Uminer (S43996134). Uminer stated he was operating his vehicle on Brookline Street (S) towards Hartman Road. Uminer stated he was stopped in traffic on Brookline Street prior to the crash. Uminer stated the vehicle in front of him proceeded to travel straight from it's stopped position and he then began to follow the traffic on Brookline Street. Uminer stated he did not see anyone in the vicinity of his vehicle as he began to travel straight from his stopped position. Uminer stated as he was traveling by Hartman Road, the front passenger side area of his vehicle made contact with a pedestrian on the right side of Brookline Street at Hartman Road. Uminer stated he did not see this party until after they were struck and he then proceeded to pull his vehicle over. Uminer stated he was operating his vehicle at a very low speed at the time the collision took place. After speaking with Uminer, I observed the white 2017 GMC Yukon (MA: 9NX525) involved in the crash parked on Brookline Street (S) just past Hartman Road. Uminer stated the vehicle had been moved after the collision took place. I observed no obvious damage to the body of the vehicle on the front passenger side area where the collision took place. The front passenger door mirror was folded inward towards the door. Uminer stated he believes the front passenger door mirror was the point of contact between his vehicle and the pedestrian. I spoke with a witness to the crash, Ashley Garcia (S94193596). Garcia stated she was attempting to cross Brookline Street at Spaulding Lane. Garcia stated she entered the marked crosswalk and was a few steps into Brookline Street when a black colored vehicle traveling on Brookline Street (N) slammed on its brakes near the crosswalk. Garcia stated she looked to her left at the vehicle and then heard a thud to the right from the area where the crossing guard was standing near Hartman Road. Garcia stated she looked over and saw a crossing guard on the roadway on Brookline Street (S) at Hartman Road. The injured pedestrian involved in the crash is Cassandra Alexander (S23636307). Alexander is a crossing guard for the City of Newton and is assigned to the intersection of Brookline Street and Hartman Road for the Memorial Spaulding school crossings. This crash occurred while Alexander was performing her official duties. Alexander was wearing her department issued yellow reflective jacket at the time of the crash. I spoke with Alexander at Newton Wellesley Hospital where she was being treated for her injuries. Alexander stated she was performing her duties as a crossing guard at the intersection of Brookline Street and Hartman Road. Alexander stated she had just finished crossing two pedestrians in the marked crosswalk on Hartman Road when observed a pedestrian enter the crosswalk on Brookline Street at Spaulding Lane. Alexander stated she began to enter the intersection of Brookline Street at Hartman Road with her hands up and her department issued yellow reflective jacket on in an effort to stop traffic in the area to allow the pedestrian in the marked crosswalk safely cross. Alexander stated she was struck on her left side by a passing vehicle. Alexander stated she did not see the vehicle and fell to the roadway. Alexander stated as she was falling to the roadway she extended her right arm in an effort to brace her fall. Alexander stated she had injuries to her arms and legs and was sore from the collision. I spoke with a second witness to the crash via telephone, Anand Vaidya (S43996134). Vaidya stated he was stopped in traffic behind MV1 on Brookline Street (Southbound). Vaidya stated he observed the vehicle in front of MV1 proceed straight on Brookline Street after being stopped in traffic. Vaidya stated he then observed MV1 proceed straight on Brookline Street at Hartman Road at a low rate of speed. Vaidya estimated the speed of MV1 at this time to be 5 miles per hour. Vaidya stated a crossing guard was on the right side of the roadway on Brookline Street at Hartman Road wearing a yellow and black reflective jacket and snow pants. Vaidya stated the crossing guard had her back towards him and MV1, and extended her arm out to stop traffic. Vaidya stated at this time MV1 rolled by the crossing guard at a low rate of speed and the front right fender area of the vehicle hit the left rear leg/lower back area of the crossing guard. Vaidya stated the crossing guard bounced off of the car and fell to the roadway. Vaidya stated he believes MV1 was unaware he hit the crossing guard and observed the vehicle travel another 10 feet until it came to stop on Brookline Street. Vaidya stated the crossing guard was not in a marked crosswalk at the time of the crash. Wint was driving a 2018 Chevrolet Colorado pick up tuck ( MA reg 8CA823 ) that Auto Zone leases from Lease Plan USA Ltd. Wint stated that he was headed to Webster St in Newton to pick up a delivery. Wint stated that as he approached the area of 277 Lexington St he believed that the traffic light that is at the marked crosswalk was green for south and north bound traffic. Wint stated that he did not see any pedestrians in the crosswalk, until he heard the sound of an object impacting into the front driver's side of his vehicle. Wint stated that he stopped his vehicle approximately ten yards past the crosswalk and got out. Wint stated it was then he realized that his vehicle had stuck a female and a dog. Wint stated that he was not operating any electronic devices at the time of the crash, and I observed none in his vehicle. Wint stated he was not injured in crash. Wint's vehicle had damage to the driver's side mirror and lower molding of the driver's side front door. Wint's vehicle did not require a tow. Witness Bessy Shanks stated that she was driving in her vehicle behind Wint's vehicle south bound on Lexington St. Shanks stated that Wint's vehicle was driving slow and swerving approximately two blocks prior to the crash. Shanks stated that she believed that Wint may of been distracted. Shanks stated that south and north bound traffic was stopped because that cross walk light was red and that a female and a dog were crossing from the east to west in the marked crosswalk in font 227 of Lexington St. Shanks stated that the front driver's side of Wint's vehicle srtuck the female and the dog as they were approximately halfway into the crosswalk. Shanks stated that the female and dog both fell to the ground after the crash. Witness Elizabeth Keegan stated that she was driving in her vehicle south bound on Lexington St two vehicle behind Wint's vehicle. Keegan stated that she was not sure what color the traffic light was at the time of the crash, but traffic was stopped both not and south bound traffic was stopped. Keegan also stated that Wint's vehicle "" didn't even slow down "". Keegan stated that Wint's vehicle struck the female pedestrian and the dog as they were in the marked crosswalk in front of 277 Lexington St. Witness Henry Taylor stated that his vehicle was the first one stopped at the red crosswalk light at 227 Lexington St in the north bound lane. Taylor stated that north and south bound traffic was stopped and that Wint's vehicle did not stop and stuck a female pedestrian and a dog in the crosswalk. Witness Jacqueline Deos stated that her vehicle was stopped behind Taylor's north bound on Lexington St. Deos stated that north and south bound traffic was stopped for the red light . Deos stated that Wint's vehicle did not stop and that it struck a female pedestrian and a dog in the marked crosswalk. The pedestrian in the crosswalk was identified as Xiaoping Sun. Sun stated that she and her dog stopped on the south bound side of the marked crosswalk across from 227 Lexington St. Sun stated that she activated the crosswalk light and waited until the light was red for north and south bound traffic, and that the walk single was activated. Sun stated that she looked to her left and saw traffic north bound traffic was stopping. Sun stated that she turned to her right and entered the marked crosswalk. Sun stated that she and her dog had crossed over the north bound side of Lexington St and she then looked to her right and saw Wint's vehicle not stopping and "" going very fast "". Sun stated that the front driver's side mirror of Wint's vehicle stuck her in the face . Sun stated that as she fell to the ground she was struck on the left leg by Wint's driver's side. Sun stated that she did not lose consciousness after she had fallen to the ground. Sun was transported via EMS to The Brigham and Women's Hospital for treatment for head and neck injuries and abrasions to her legs. Sun's dog died as a result of being struck by Wint's vehicle. Photo's of the crash site and of Wint's vehicle were taken and the disc was downloaded by the NPD's IT Bureau. Before leaving the crash site, I tested the crosswalk lights and they were in working order. Based upon my observations of the crash site, Wint's vehicle, and the statements made to me, I concluded that Wint was at fault for this crash. Fleming stated the real of his vehicle crashed into the front of MV2. I observed damage to the sand dispensing attachment on the rear of MV1. Fleming reported no injuries. I spoke with the operator of MV2, Lisa Perry (S21890600). Perry stated she was operating her 2016 Honda Pilot (MA: 5WP321) on Franklin Street (N) towards Shornecliff Road. Perry stated she was stopped behind MV1 when it backed up and crashed into the front of her vehicle. I observed damage to the front bumper/light area of MV2. Perry reported no injuries. A query of Perry's registration status through Newton Dispatched stated it was expired. Perry was able to renew her registration on scene and was issued Massachusetts Uniform Citation T2013858 in hand for Chapter 90, Section 9 (Expired Registration). The crash caused moderate damage to the brick facade and inside wall of the tile store. A short time later, Revzin drove back into the parking lot where I spoke with her. Revzin stated she didn't know why her car had accelerated into the building but she was having some personal issues and may have been distracted. She explained that she left the area because she was shaken up but then as she had time to clear her head, thought she should return to the store. There was minor damage to her vehicle and she stated she was not hurt and didn't want me to call the Medics for an evaluation. I issued Revzin Mass. The bicyclist stated that the operator of MV1 did not come to a stop at the stop sign. The bicyclist was complaining of minor leg pain, but signed a patient refusal with Cataldo. The bicyclist was dressed in black pants, and a gray sweater, and was not wearing a helmet. The bicycle sustained damage to the handlebars. At the time of the accident the sun was setting, however the street lights had not yet come on. I then spoke with the operator of MV1 who stated she was traveling southbound on Linwood avenue, and was attempting to turn right onto Watertown street when she struck the bicyclist. The operator stated she never saw the bicyclist before the collision. The front of MV1 sustained minor damage. I was able to speak with a witness to the accident over the phone after clearing the scene. The witness stated that MV1 failed to stop at the stop sign at the intersection of Linwood and Watertown street, and that the bicyclist was already well into the crosswalk at the time of the collision. Operator of vehicle two stated that he did not see vehicle one before pulling away from the northside curb on Sylvester Rd. Bertram stated as he made his turn MV1 crashed into him. Bertram fell to the roadway and sustained an injury to his left leg/foot. Bertram was wearing a helmet at the time of the crash. Bertram signed a patient refusal with Newton Medics. Bertram has a learner permit to operate the moped. Bertram's moped was removed from the roadway by Tody's Towing. A witness to the crash, Michael Rothstein, stated he observed the crash right at impact and observed the moped fall to the roadway. I spoke with vehicle owner and operator Marion Cohen 8/27/46. Cohen stated that as she was parking in the rear lot of the complex, she accidentally mistook the brake for the gas pedal. She in turn ended up going over the curb and through some bushes before hitting the compressor. There was a passenger in the vehicle identified as Milton Kornfeld 3/10/42. Both occupants were checked out by medics and declined transport. The airbags did not deploy. There does not appear to be any structural damage to anything other than the compressor. NFD checked the integrity of the house, and the compressor was unplugged. I took pictures of the scene and submitted the memory card to IT. Homeowner Xiaozhi Zhao and his family were present inside at the time of the collision and are unharmed. Tody's responded and removed the vehicle from the property. It sustained heavy front end damage and was towed to their lot via flatbed. A m/v inventory form was filled out. The weather at the time was 60 degrees ( localconditions.com) and the sky was clear and sunny. The road surface was dry. The parking lot is a thru way that the public use to enter/exit the lot or park there. On arrival at the same time with the Fire and Medics, I observed a female laying in the middle of the lot facing down on her back. A small red and gray CVS like type shopping carriage was knocked over and resting on it's side in front of the victim's head. The carriage was moved to the side in order to tend to the victim I also observed a black Honda Civic bearing MA reg.# 3741TW that was involved in the accident. The Honda was out of the parking spot resting approximately two feet away from the pedestrian's legs. I then spoke to the pedestrian identified as Darla Gipson in the rear of the ambulance. She sustained an abrasion to her front left shoulder and arm area which I observed. She also complained of left knee and elbow pain. She stated that she walking through the middle of the parking lot pushing the carriage by the door entrance in a westerly direction towards Chestnut Street. She states that she never saw a vehicle backing up and then she was suddenly struck and believes she was pushed underneath the vehicle. She was then transported to Newton Wellesley Hospital by Cataldo Ambulance. I then spoke to the operator of the Honda Civic identified as Linda Burke (MA S70320414). Ms. Burke was parked in the first spot to the right of the walkway that leads to the entrance/exit doorway. I asked her what occurred and she stated that she was backing her vehicle up to exit the parking lot when she looked behind her not seeing anything in sight. She then started backing up and struck the pedestrian without realizing it. She says the driver of a green cab and his female customer who were no longer on scene were yelling at her to stop her vehicle because the pedestrian was underneath it. She then stopped her vehicle. I observed minor scrapes to the entire rear bumper of the vehicle so it is unknown where it actually struck the pedestrian/carriage. I observed no obvious signs of damage to the carriage. It should be noted that Ms. Burke's Honda does not have a back up camera or back up sensors. There are no surveillance cameras to the apartment complex and no witnesses came forward for the accident. As a result of the investigation, Ms. Burke will be issued Uniform Citation # T1271069 for Newton City Ordinance 19-75 Failure To Use Care in Backing.
