(both public ways in the City of Newton), for a report of a motor vehicle vs pole accident with injury, airbag deployment and entrapment. Upon arrival, I exited my cruiser with my medical bag and AED and went to assist the motorist involved in the crash. MV1 (MA Passenger: 255ZA9) was completely off the roadway and on the shoulder of the road (facing Eastbound) with its nose contacting the light pole ( Verizon Pole #:103/80), which was now broken and listing to the side. Attempts to open the doors were unsuccessful and I attempted to communicate with the operator through a partially broken driver's window frame which was bent. The operator was slumped forward with his hand cradling his head and he was unable to speak, but was breathing. Newton Fire arrived and attempted to gain access to the vehicle via several manual tools with no success and instead deployed the Jaws of Life which was successful. Newton Fire also made entry into the rear passenger compartment because we viewed a child's car seat and checked with negative results for any child in the vehicle. Once the operator was cut out of his seatbelt and safely out of MV1 and on board Newton Medic 1, I entered the ambulance where he was identified as Mark Topham. It should be noted that Topham was having difficulty answering basic questions such as his name, date of birth, today's date, Etc. At one point when he was asked what today's date was, he gave his birth date of February 21, 1983 and it took him several attempts to say his last name, I had to run him over the air with a partial name to ascertain who he is. Also of note, in my presence and that of Sgt. Devine, Topham informed the medics that he had been consuming alcoholic beverages prior to the crash. Upon viewing the scene, I noted that the roadway was lit and I did not observe any skid marks on the dry, ice-free payment, indicating that there was unlikely any braking or swerving to avoid the collision. I spoke to the reporting party, Lindsay Giardina, she stated that she was traveling on Dedham St. when she heard what she believed to be a motor vehicle crash. When she came upon said crash, she attempted to assist the operator, as she was an off duty firefighter. She was unable to gain access to the inside of the vehicle, but communicated to the operator in the same manor as I did. She stated that she was able to smell the odor of an alcoholic beverage emanating from the operator. Topham was transported to Beth Israel of Boston, where he was assigned patient record number 3109921. I attempted to speak with him at the hospital, but was unable to do so because of his current state; I noted several injuries on Topham, such as a bloody lip, a wound to his lower left side and a wound to his left leg. I made the following observations of the crash scene , Center St is a two lane public way in the city of Newton that runs north to south. I observed a city of Newton contracted Cataldo ambulance stopped in the south bound lane of Center St at Cabot St. The ambulance was MA AMN registration AMB 370 a 2017 Ford Econo Line that had heavy damage to the front end and driver's side fender. I observed that the front tire of the ambulance was snapped off and was pushed back towards the driver's side door. I further observed that both of the front and side air bags of the ambulance were deployed. The front of the ambulance's final point of rest was 8'8"" from a fixed overhead light pole on the northeast corner of Center St at Cabot St. The ambulance's front passenger side tire was 4'3"" front the curb on the Cabot St side. The ambulance's rear passenger side tire was 2'3"" from the Cabot St side curb. The ambulance's rear driver side tire was 5'1"" from the double yellow line on Center St. The ambulance's front driver side tire was 6'3""from the Center St double yellow line. The width of Center St from the double yellow line to the Center St curb is 15'' and 16'"" to the Sergeant St side. I observed a 2011 Mazda 3 with MA PAN registration 6KJ783 facing south bound in the north bound lane. The Mazda had heavy damage to it's front end, and I observed that it's front tires had snapped off. The Mazda's roof had been removed by Newton Fire to extract the occupant. The front of the Mazda's final point of rest was 40'3"" from a fixed overhead light pole on the northeast corner of Center St and Sergeant St. The Mazda's front passenger tire was 4'6"" from the double yellow line on Center St. The Mazda's rear passenger side tire was 7'6"" from the Center St double yellow line. The Mazda's rear passenger side tire was 1'2"" from the Center St double yellow line. The Mazda's front driver's side tire was on the curb on the Sergeant St side of Center St. There were no skid marks from the Mazda which indicates that no braking occurred. At the time of the crash, the Cataldo Ambulance was being operated by Paramedic Corey Bohan and Paramedic Tom White was in the front passenger seat. Bohan stated that he was operating his vehicle southbound on Center St towards Cabot St after clearing a medical call. There were no patients in the ambulance at the time of the crash, and Bohan estimated he was travelling 25 MPH . Bohan stated within less than two seconds he observed a vehicle traveling towards him northbound on Center St in the southbound lane and estimated it's speed to be approximately 80 to 100 MPH.Bohan stated he was able to slow to a near stop and had moved his vehicle towards the right shoulder on Center St before the Mazda struck his vehicle head on. Bohan stated that after forcing his way out of the driver's seat of his vehicle, he rendered medical aid to the operator and only occupant of the Mazda, Jessica Pondish. Bohan stated that Pondish speech was slurred and he detected an odor of an alcoholic beverage emanating from her breath and person. Bohan was later transported to Newton Wellesley Hospital for evaluation. The passenger in the ambulance, Tom White stated to officers that he was working on the ambulance's laptop computer and did not see anything leading up to the impact from the crash. White stated that he was able to force himself free of the passenger side of the ambulance, and rendered medical aid to Pondish. White stated that Pondish was "" in and out of it "" and did not appear coherent.White stated that he asked Pondish if she had consumed any alcoholic beverage and she nodded in the affirmative. White Stated that he was unsure if Pondish understood his questions. White stated that he did not detect any odor of an alcohol beverage emanating from Pondish's breath or person. White was transported to Newton Wellesley Hospital for evaluation. Pondish was freed from her vehicle after approximately 22 minutes by Newton Fire Department units by utilizing special extraction tools. Pondish was transported by Newton Medic Unit Two to the Brigham and Women's Hospital in Boston for treatment. From 06/08/2019 to 06/10/2019 Pondish had two surgeries and was unable to speak due to her condition. On 06/10/2019 myself and Officer Gaudet were able to speak with Pondish in her hospital ICU room at the Brigham and Women's Hospital. Pondish's parents Lorena and John Pondish were present while we spoke with her. Officer Gaudet asked Pondish about the events that led up to the crash. Pondish stated that on 06/07/2019 she was at a friend's residence in Norton, MA. Pondish stated that while at her friend's residence she consumed a bottle and a half of Riesling wine. After Pondish's admission myself and Officer Gaudet stopped our conversation with her. I read Pondish her rights directly from a Miranda card and explained them in full before allowing her to continue speaking with myself and Officer Gaudet about the events of that led to the crash. Pondish stated that she understood her rights. Officer Gaudet asked Pondish if she had consumed any alcoholic beverages prior to driving home to her residence in Newton. Pondish stated that she drank a bottle and a half of Riesling wine by herself between the hours of 1700 and 0000 hours on 06/08/2019. Officer Gaudet asked Pondish how large the bottles of wine was that she drank, and she stated that they were average size. Officer Gaudet asked Pondish how she perceived her state of being was after consuming a bottle and a half of wine. Pondish stated that she felt "" buzzed "" . Pondish stated that she left her friend's residence in Norton at approximately 0100 hours on 06/08/2019 to return to her residence in Newton. Pondish stated that she does recall the events leading up to the crash, except that she tried to make a phone call but the person did not pick up. Pondish stated that her seat belt was on and that she was not texting while operating her vehicle. Pondish stated that her injuries consisted of a broken left elbow and internal injures to her intestines. On 06/09/2019 I spoke to Cataldo Paramedic Robert Canning and Stephen Heirholcer who were the medic unit that transported Pondish to the Brigham and Women's Hospital. Canning stated that he rendered medical aid to Pondish for approximately 20 minutes while Fire units worked to free her. Canning stated that Pondish's legs were pinned under her vehicle's dashboard. Canning stated that during the approximately 20 minutes that he was in close proximity to Pondish he could detect a strong odor of an alcoholic beverage that was emanating from her breath and person. Canning stated that once Pondish was freed he continued to treat and monitor her during the transport to the Brigham and Women's Hospital. Canning stated that when he asked Pondish if she had consumed any alcoholic beverage she stated that she had. Paramedic Heirholcer stated that he did not detect any odor of an alcoholic beverage emanating from Pondish's breath or person. Based upon the physical evidence at the crash scene, and statements made to officers by all of the above mentioned persons, Pondish is being charged with violation of MGLs 90/24j OUI liquor, 90/24e negligent operation of a motor vehicle, 89/4a failure to stay within marks lanes, and 90/17 speeding. On 06/12/2019 at the conclusion of the crash investigation I issued MA Criminal Application T 1269996 in hand to Pondish at her hospital room and explained to her what action she needed to take with court. On 06/11/2019 a letter of preservation was sent to Brigham and Women's Hospital requesting that a sample of Pondish's blood, urine and medical records be saved. On 06/12/2019 Brigham and Women's Hospital confirmed that a sample of Pondish's blood had been preserved. As of 06/12/2019 a search warrant for Pondish's blood sample was pending. Photos of the involved vehicles and of the crash scene were taken and downloaded by the NPD's IT Bureau. Both involved vehicles were towed from the crash scene and towed motor vehicle forms were filled out. An Iphone and backpack belonging to Pondish were taken from her vehicle for safekeeping and returned to her on 06/11/2019. MV2 collided with MV1 in the area of 281 Lexington St. A witness, John Maclellan (off-duty police officer Watertown) who was in the area of Lexington St and Orris St. stated that he heard a vehicle beeping repeatedly and then heard a collision. Maclellan came outside to find MV2 over the double yellow lines facing oncoming traffic. MV2 had damage to its passenger front and MV1 had damage to its drivers side rear. Maclellan told MV2 operator, Renato Ribeirodasilva, to move his vehicle to a safe location on the right side of the road and get out of the vehicle to exchange paperwork with the other driver involved (MV1, Gorman). Maclellan phoned Newton PD to notify of the accident and as he was on the line, he witnessed both parties getting into a heated arguement on the sidewalk outside of their vehicles. MV2 operator, Renato Ribeirodasilva was taken into custody for the following charges: 90/24J - OUI Liquor, 90/24E - Neglegant Operator of a MV, and 89/4A - Marked Lanes Violation. MV1 was towed by towed by Tody's. Gonzales was transported to Beth Isreal in critical condition. When Gonazales was in the back of the ambulance, myself and medics smelled an odor of an alcoholic beverage emanating from Gonzales. All first responders thoroughly checked the surrounding area for a helmet but one could not be located. Due to Gonzales' critical condition and urgency to get to the hospital, and ID was not thoroughly looked for on his person. Ofc. Guarino, N491, retrieved an ID from Gonzales upon arrival at Beth Isreal Hospital. Ofc. Stake filled out a towed inventory form. Pictures taken and sent to IT. Sgt. Lee was notified and will be following up with this incident. MV1 operator, Angel Gonzales is being charged with the following (MA Uniform Citations T1442823 & T1442824): 90/24J - OUI Liquor (public way) 90/24E - Negligent Operation of a MV (operating recklessly at a high rate of speed) 89/4A - Marked Lanes 90/23 - Attaching Registration Plates (attaching registration plates to motorcycle to conceal the fact that it was unregistered. Registration plate on the motorcycle came back to a 2002 Honda VT750 motorcycle, MA Reg: 1T3988; VIN on the motorcycle came back to a 2005 Suzuki GSXR60, MA Reg: 1L4389) 90/9B - Unregistered MV (motorcycle 2005 Suzuki MA Reg: 1T3988 was confirmed unregistered by RMV) 90/23D - Operating MV with a Suspended License (RMV confirmed that Gonzales' license was suspended S94722414) (see Incident #19039806 for more details). For QED purposes, the charge 266/139 - Stolen Registration was added to this report because 90/23 - Attaching Registration Plates was not an option. Due to Gonzales' hospitalization, the citations will be mailed to his last known address. Officers were able to rise a Harold Curtis, the father of Anthony Curtis (owner of MV2, the GMC Yukon) at 185 Waltham St. He was notified of the incident and advised to call their insurance company. Curtis mentioned that he has cameras facing the street where the incident took place and will see if he can retrieve the footage for us. Officers went to go observe the vehicle and it had major front end damage and had collided with a stone wall belonging to 239 Webster St. When asked if he hit a stone wall, Feinberg said ""no, I just hit a curb"". He had no memory of hitting a stone wall. Resident of 239 Webster St was also the reporting party, James Pelis, said that he heard tires screeching and then a crash. He came outside and saw a MV up on the sidewalk and a male individual approximately 250lbs, heavyset, grey sweatpants and a dark shirt walking Eastbound on Webster St away from the crashed MV (this description fit Feinberg). Pelis assumed it was the driver but never saw him get out of the car. Feinberg was transported to NWH by medics. Korgaonkar stated he was driving home from Brookline somewhere in the area of Commonwealth Ave. and Washington St. I asked Korgaonkar where he was specifically coming from and he stated ""Abbey"". I asked Korgaonkar if he had anything to drink while he was there to which he stated ""two drinks"". It should be noted Korgaonkar was unsteady on his feet and seemed extremely confused about what just happened. Given the damage from the crash, my conversation with Korgaonkar, and Korgaonkar's current state, I asked him if he was willing to perform Field Sobriety Tests. Korgaonkar stated he was willing to take the tests. I asked Korgaonkar if he wears glasses or contacts to which he stated ""no"". I asked Korgaonkar if he had any medical conditions that would affect his ability to take the tests to which he stated ""no"". I asked Korgaonkar if he felt comfortable in the shoes he was wearing to which he stated ""yes"". I brought Korgaonkar over to a clear spot on the side of the road on the fog line where the area was illuminated by the street light and cruiser spotlight. There were no blue lights on the cruisers. I used a field sobriety card I carry with me on my person to explain and instruct the tests. The first test I administered to Korgaonkar was Horizontal Gaze Nystagmus. I explained to Korgaonkar I was going to use a pen as the stimulus and to only follow it using his eyes only, not his head. Korgaonkar stated he understood the directions. The first attempt, Korgaonkar follow the pen using his head. I explained to Korgaonkar not to follow the pen using his head, but his eyes only. Korgaonkar stated he understood. The second attempt, Korgaonkar followed the pen using his head. I advised Korgaonkar again, to only use his eyes. On the third attempt, Korgaonkar followed the pen using his eyes only and I saw distinct nystagmus at maximum deviation and onset of nystagmus prior to 45 degrees. The second test I administered was the 9 Step Walk and Turn. I demonstrated the test for Korgaonkar and instructed him on how to complete the test. I placed my left foot on the fog line and right foot, heal to toe in front of the left. I demonstrated three heal to toe steps on the line, counting out loud, and keeping my hands by my side. Korgaonkar was advised to take 9 heal to toe steps, and then turn around and complete 9 more heal to toe steps. Korgaonkar stated he understood. During the test Korgaonkar did not place his heal to toe on steps 3,4,5. Korgaonkar almost fell over on the fourth step. Korgaonkar did not count out loud his steps and was using his arms for balance. On Korgaonkar's return, he did not count out loud again, almost fell to the side on step 6, was using his arms for balance, and stopped the test on his own at step 7. The third test I administered was the one leg stand. I explained to Korgaonkar the instructions and demonstrated the test for him. Korgaonkar stated he understood. I placed my hands by my side, feet together, raised my right foot six inches while looking at my foot, and counted 1001, 1002, 1003. I asked Korgaonkar if he understood, and not to stop counting until I told him to. Korgaonkar stated he understood. On the first attempt, I told Korgaonkar to start and he didn't lift a foot off the ground. On the second attempt, Korgaonkar lifted his left leg off the ground two inches, was looking straight ahead, and was not pointing his left foot. I explained to Korgaonkar his foot needed to be six inches off the ground, pointed, while keeping his eyes on his foot. On the third attempt, Korgaonkar dropped his left foot on 1004 and lost his balance on 1012. I concluded the test at 1020 counts. Based on my observations and Korgaonkar's performance on the field sobriety tests, I concluded that Korgaonkar had been operating a motor under the influence of alcohol. Korgaonkar was handcuffed (DL), searched, and placed in the rear of 496 where he was seat belted. The prisoner compartment was checked prior to and after transportation to NPD. Korgaonkar was booked by Sgt. Fleming and processed by Officer Ka. Donahue in the normal fashion. During booking, Korgaonkar was read his rights and asked if he wanted to take a breathalyzer test. Korgaonkar refused the breathalyzer test. Korgaonkar was notified his license was suspended, and his MA drivers licensed seized. Officer L. Mr. Cocuzzo observed Power drive into his driveway with the two flat tires and heavy front end damage. When Power exited the vehicle Cocuzzo yelled over to him but stated Power's was unable to communicate clearly to him. Cocuzzo observed Power's walk into his residence at 12 Rockland and then bereaved the vehicle slowly roll back out of the driveway. Medic 3 and Tody's responded to the scene. Due to the heavy damage and two flat tires Tody towed the vehicle. A towed motor vehicle inventory report was filled out. Medic 3 was called to the scene to evaluate the health of Power's. Officer Tocci and myself located Power's in the residence passed out on the couch. Empty alcohol cans were all around Power's. After several attempts to wake up Power's he finally came too. Power's speech was severely slurred, he could barely keep his eyes upon and he lacked the ability to stand up without assistance. The Medics transported Power's to Newton Wellesley. MV2 operator, DAVIS observed the flashing light vehicle continue straight on Commonwealth Ave. MV2 continued his drive from Chestnut St to Temple St to Putnam St where he observed that same vehicle, MV1, driving around the rotary on Washington St over the Mass Pike heading in his direction. DAVIS stated that MV1 pinned MV2 by the driver's side door (B pillar). DAVIS was exiting his vehicle when MV1 closed in on his leg, injuring DAVIS with the car door and HELMS front bumper. Damage was visible on MV1 passenger side front bumper and MV2 driver's side door. DAVIS did not want medical treatment for his leg. Stated by operator HELMS in MV1: MV1 was being followed by MV2 in a dangerous manner in front of City Hall on Commonwealth Ave. MV2 operator, DAVIS, exited his vehicle when MV1 was stopped at the red light (Commonwealth Ave/Chestnut St). MV2 operator, DAVIS, threatened HELMS and brandished a knife. HELMS stated that he was scared for his life. At some point in the interaction, DAVIS got out of his vehicle again and brandished the knife again. HELMS was able to escape DAVIS and continue driving until he reached the backyard of the police station. During my interview with HELMS in the backyard I observed him trembling uncontrollably. I asked if he took anything tonight to which he said no, he was just cold. I asked if he smoked anything and he said he smoked a little marijuana earlier this afternoon but nothing since. HELMS is physically unable to complete field sobriety due to his past injuries including a TBI from a motorcycle accident, a rollover car accident and a bicycle accident where he was not wearing a helmet. He stated that he has multiple pins and plates in various parts of his body and does not feel safe doing field sobriety. I did not observe any odor of alcohol and HELMS stated that he has been sober for 10 years now. A MV search was conducted as well as pat frisk of DAVIS for officer safety. No knife was found on his person or in his vehicle. A MV search was conducted of HELMS vehicle due to arrest. Tody's towed HELMS' vehicle. In front of 190 Tremont St, I also observed a black BMW 528 bearing Massachusetts Registration: 1FDB38 ( Vehicle 2) with heavy damage along the passenger side of the vehicle and the front right wheel was completely detached from the axel. All the airbags in the vehicle were deployed, and it appeared that vehicle 2 was traveling Eastbound on Tremont St when it crashed into vehicle 1 at an angle. It should be noted that there were multiple deep scratches/dents on the hood, roof, and drivers side panels of vehicle 2 that were not consistent with the crash that just occurred; which indicates the operator was in multiple accidents prior to this one. Pro-tech Towing was also on scene to tow vehicle 2. I then spoke to the owner of vehicle 1, Ryan Desrosiers, who stated that his vehicle was parked on the side of the road when he heard a crash outside at approximately 2345hrs. Mr. Desrosiers stated when he went outside, he discovered his vehicle pushed in front of his driveway, approximately 10-15 feet from where he parked it, and the operator of vehicle 2 standing outside. Mr. Desrosiers stated when he spoke to the operator, he smelled like alcohol and had slurred speech. The operator, later identified as, Benjamin Wadsworth, told Mr. Desrosiers that he was ""coming from in town"" and ""probably should have taken a Lyft tonight."" When Mr. Desrosiers tried to exchange information, Mr. Wadsworth took Mr. Desrosiers' phone number and then texted him a link to a generic RMV website. Mr. Desrosiers then said Mr. Wadsworth called a tow company for his vehicle and insisted on paying out of pocket tomorrow for the damage to Mr. Desrosiers' vehicle but told him if he wanted he could call his insurance company. It should be noted that Mr. Wadsworth did not provide his name, address, or insurance company to Mr. Desrosiers prior to leaving. I had dispatch run a query on vehicle 2 (MA Reg: 1FDB38) and it came back registered to Benjamin Wadsworth out of 13 Charmane Rd East Falmouth, Massachusetts. While speaking with Mr. Desrosiers, the driver of the tow truck called Mr. Wadsworth cell phone to notify him that he was not going to be towing his vehicle. I was then able to get on the phone and speak with him, and he identified himself as Benjamin Wadsworth and admitted to being involved in the accident that just occurred. When I asked Mr. Wadsworth his location because I was concerned for his well-being due to the severity of the crash and airbag deployment, he stated he was at his apartment in Brighton. When I asked for the address of his apartment, he refused to give it to me and stated he was fine. I stated to Mr. Wadsworth that because he only gave limited information and then left the area that he could be charged with Leaving the scene of a collision, to which he replied, ""I am in law school you can see the books in the back of my car, you can't do that, you have my plate, he can look that information online."" When asked about having an address out of Falmouth, Mr. Wadsworth stated he has two addresses because he attends school in the area. It should be noted that while speaking with Mr. Wadsworth on the phone, his speech was slurred, slow, and dilerbrate, consistent with being intoxicated. Tody's towing arrived on scene and took possession of Mr. Wadsworth's vehicle. I then tried a second time to speak with Mr. Wadsworth via a phone call to get him to agree to a well-being check. Mr. Wadsworth, again, refused to provide me with his address in Brighton, insisting he was fine. Although Mr. Wadsworth sounded intoxicated, he did not sound injured and was coherent when answering my questions.
