I then traveled to Negoshians and spoke with the Owner Ted Negoshian. He stated his company is responsible for plowing the Ferguson lot. I showed him a security clip of the white truck plowing in the parked vehicle and Negoshian stated that he doesn't have any white trucks that plow for him only black ones. I then traveled to the City of Newton Highway Department and spoke with Superintendent Michael Arpino. I showed him the security video and he stated that the white truck in question was not a city owned or sub-contracted vehicle because the trucks would have a green flag on their mirrors or writing on the door. I also spoke with Newton Control Clerk Mark Parsons who viewed the City of newton GPS from the night of the storm and confirmed that no city vehicles or sub-contracted vehicles were on Ramsdell St between 2am and 3am. Impact caused the gate to bend in several areas and rendedered it inoperable in the down position. SLOSS contacted building maintenance and was awaiting their arrival. SLOSS further stated he works 4 days a week and the security gate is usuall lifted between 4 and 5 am every morning. SLOSS stated their are sometimes cones also blocking the gate, but not always, this morning was a busy morning and cones were not in front of the gate. After speaking with SLOSS I spoke with the operator, SHIELDS David, who stated he comes to the gym the same time every morning and the security gate is usually up, but when the gate is down it is difficult to see. He also had another member of the gym come talk to me and stated that the gate is difficult to see when it is in the down position. SHIELDS stated this morning he did not realize the gate was down and drove into it causing the damage. KRAUSE states she blew her horn, but the dump truck coninued on striking her vehicle on the drivers side rear. Impact from the collision caused significant damage to the drivers side of the vehicle in addition to deploying the side air bags in her vehicle. KRAUSE was evaluated by medics and refused transport to the hospital. She states she is uninjured just shaken up. Secondly, I spoke with the operator (BENNETT Paul A Jr) of MV#2 (KW Dump Truck). BENNETT states he was following another dump truck through the parking lot to the back exit on Florence Street to deliver asphalt to a construction job. In front of Seasons 52 he states he stopped at the stop sign and proceeded through unaware that MV#1 was in front of him striking the MV on the drivers side. There was no damage to the dump truck other than some marks on the front bumper. Motor vehicle crash occurred in a parking lot containing many stores, restaurants and a supermarket (Wegmans). Where the crash occurred was in front of Seasons 52 at a stop sign. At the stop sign is an island angled in such a manner to push vehicles to stay to the right and not make any turns. However, there are no signs displaying turning restrictions. The dump truck attempted to cross over the main entrance from rte9 to the parking lot containing the tent for SoulCycle and exit through the back of the parking lot. Traffic Bureau update (Officer Gaudet): I was able to obtain footage of the crash from Chestnut Hill Security. The video captures the crash from a distance. It showed a newer model black station wagon (possibly a Subaru) enter the parking area traveling North near MV1. Mr. Drukman stated the crash occurred on Monday, August, 2, 2021, at the Jewish Community Center located at 333 Winchester Street, Newton sometime around 1600 hours. Mr. Drukman stated his vehicle was parked unoccupied in the parking lot and was struck by another vehicle. Mr. Drukman stated his 2017 Subaru Forester (MA: WA1/UIY) had damage to the driver side rear fender. Mr. Drukman stated a passersby forwarded pictures of the other vehicle involved in the crash. The other vehicle is a 2016 BMW 5 series (MA: 1691DR) registered to Mr. Richard Parker (S75189008). Mr. Drukman forwarded me the pictures he received and there is damage to the front passenger side bumper/fender area of this vehicle. These photos were submitted to the IT Bureau to be added to this report. I spoke with Mr. Parker via telephone. Mr. Parker stated he was operating his vehicle in the parking lot of the JCC at the time and date of the crash. Mr. Parker acknowledged his vehicle made contact with another vehicle while he was attempting to park. Mr Parker stated after making contact with the other vehicle, he exited that parking spot because it was too tight and parked in another parking spot. Mr. Parker stated there is no new damage to his vehicle and the damage I described in the pictures Mr. Drukman forwarded to me was old. I advised Mr. Parker that I was citing him for leaving the scene of property damage. Mr. Parker admitted to crashing into MV1 as he was attempting to park in the JCC parking lot. Mr. Parker knowingly made contact with another vehicle and made no effort to exchange information with the owner of the vehicle he crashed into. No injuries were reported. On arrival, I spoke to the operator of the semi-trailer truck which is a 2006 Peterbilt Model 327 with MA APP Reg. # 3827B. The operator was identified as Robert Lawton (MA D/L # S92175566). Mr. Lawton works for Commonwealth Construction and Utilities which is owned by the Distefano Corporation in Watertown, MA. They are contracted with the City of Newton to remove debris such as concrete from the city yard. At the time, Mr. Lawton was standing on a ladder attached to the trailer overseeing it being loaded up by a city backhoe. The truck was parked and facing in a westerly direction. During the loading process, the backhoe was pulling forward towards the truck in a westerly direction. The front left side wheel of the backhoe struck the truck's driver's side rear mud flap area denting it. The mud flap is made of metal and covers the four rear tires from front to back. Both Mr. Lawton or the operator of the backhoe never realized the truck had been struck until another worker from Commonwealth Construction noticed it. The backhoe is a yellow 2014 JCB 3CX14 with MA Apportioned Reg. # M88532. The operator of the backhoe Michael Daniele (MA D/L # S43438211) works for the City of Newton Dept. of Public Works out of 74 Elliot Street. There was no damage to the backhoe. The crash occurred at a y type walkway/driveway near the Shaw Building dining hall. The weather at the time was clear and approximately 50 degrees and the road conditions were dry. On arrival, I spoke to the operator of the DPW vehicle identified as William Bertrand (MA D/L # S24973075 ). Bertrand was operating a 2016 Ford Escape color black bearing MA Municipal registration # M2534A at the time of the crash. He states that he was at the Shaw campus building to conduct an inspection and was parked at a y type walkway/driveway outside of the building. When leaving, he attempted to make a three point turn to exit the driveway. While backing, he states that his foot slipped transitioning from the gas to the brake and he struck a light pole near the edge of the driveway. He says the back up sensors never alerted him of the pole either. The Ford Escape sustained minor scrape marks to the driver's side rear bumper area. As a result of the impact, the light pole cracked at the base and was knocked over on to the ground. Campus Security was on scene and will notify school administration regarding the damage to the pole. I took digital photos of the scene and submitted them to the I.T.
