The reporting party of the stolen truck and uninvolved occupant is identified as City DPW worker George Sementelli. The witness/passerby who discovered the collision is also a DPW worker, identified as Donny Brandt. Pursuant to an investigation outlined in incident #19002213, the operator at the time of the crash was determined to be Michael Carter. It is believed that Carter stole the vehicle from 295 Auburn St, fled the area, and ultimately crashed in front of 1970 Beacon St. Corroborating facts outlined in the incident report put Carter as the operator. The vehicle itself was located partially on the sidewalk and partially on the road, therefore Carter is being cited with MGL 89/4A - Marked Lanes Violation (T1268423). Due to the fact it is believed that Carter fled the scene after the crash, MGL 90/24/C - Leaving the Scene of Property Damage was added as well as MGL 90/23/D Operating After a Suspended LIcense, and MGL 90/24/O - Reckless Operation of a Motor Vehicle. The crash occurred during busy weekday commuting about 0.7 miles from Angier Elementary School. The last 3 charges mentioned have been listed on a second citation (T1268422). Officer Brooks also issued T0648082 for OUI Drugs MGL 90/24/G. See the incident report for details about this charge. In total, there are (3) citations issued to Carter. The vehicle sustained heavy front end damage. It should be noted that the utility pole a couple of houses down from the crash site (Beacon/Varick Rd, pole #212) sustained fresh, minor superficial damage, consistent with the vehicle crashing into it before verring onto the sidewalk. Pictures have been taken and submitted to the IT bureau. Tody's responded and towed the vehicle to the police garage for processing due to the pending other criminal charges involved in this accident/incident. I observed tire tread marks across the front lawn of 107 Dartmouth St. I then observed a vehicle in the bushes toward the left front side of the house. The vehicle; NY Reg. The vehicle was unoccupied and secured. I felt the hood of the car which was still warm from the engine. I checked the immediate area surrounding the crash scene for an operator but found no one. I radioed to other responding units to canvas the neighborhood and surrounding area for the operator on foot. I spoke to the homeowners at 107 Dartmouth St., identified as Anthony and June Limberis. Mrs. Limberis stated she heard a load noise and a car engine revving. She stated when she looked out the window she observed a W/M tall, thin, wearing tan khakis and a light colored plaid shirt walking across the front lawn. He proceeded up Dartmouth St. (northbound) toward Commonwealth Ave. Newton Fire Dept arrived on location to check the crash scene and vehicle for possible leaking fluids and any other hazards. Eric Adams stated his father John was the operator of the vehicle. Eric Adams had a strong odor of Alcoholic beverage emanating from his person and breath. He continued to slur his speech and was unsteady on his feet as he spoke. He was swaying back and forth and side to side as he spoke to me. Officer K. Donahue and Sgt. Devine were on scene at this time and also made the same observations. Multiple times we had to grab hold of Eric Adams to keep him from losing balance and falling. We spoke with Eric and John Adams for several minutes as their accounts of what took place were not consistent. I asked Eric Adams where the keys to the vehicle were. Eric Adams immediately pulled the starter key to the vehicle from his front right pocket. Eric Adams became defensive and belligerent when questioned about who was operating the vehicle. John Adams appeared tired (as if he just woke up) and confused as to the situation. Sgt Devine and I both spoke with Eric Adams and John Adams. Although both men claim John Adams was the operator of the vehicle, a clear determination was uncertain. A query of both mens driver's license status on NY Licenses came back active. Eric Adams has two prior DUI's on his RMV record. Officer Donahue and Sgt. Devine escorted the two men to 93 Dartmouth St. Eric Adams stated they were staying at that residence which is his sister's house. I stayed at the crash scene to document information and assist with clearing the MV from the property with Tody's Towing Service. As they were walking away I observed Officer Donahue and Sgt. Devine continue to have to assist Eric Adams with staying on his feet. Approximately ten minutes later as I was speaking with the aforementioned homeowners Mr.&Mrs. Limberis. Officer Donahue and Sgt. Devine returned to the crash scene. As they were updating me we observed Eric Adams returning to the crash scene. He was stumbling and swaying as he walked and repeatedly almost fell. Officer Donahue and Sgt. Devine immediately intercepted and assisted him before he fell. As they were assisting him again I continued speaking with the homeowners. Suddenly I heard Officer Donahue and Sgt. Devine struggling with Eric Adams who was now on the ground and resisting being handcuffed. I ran to assist them. Eric Adams continued to resist and be uncooperative until he was appropriately restrained in handcuffs. Eric Adams was placed under arrest by officer Donahue for Disorderly Conduct and Resisting Arrest. Reference Officer Donahues Newton Police Incident Report #19016484. The vehicle NY Reg. Operator of MV1 swerved to the right to avoid a collision and as a result crashed into the stop sign on John St. and the side of 335 Boylston St. Witness 1, who was parked at 325 Boylston St. saw the incident and corroborated MV1's story. A second witness, who I was unable to make contact with stopped and gave MV1 his phone number of (508)215-4951 and texted MV1 that he caught up with the possible vehicle, MA Reg 9BT373, which comes back to DESOUZA PLASTERING SERVICES INC. I will attempt to make contact with an operator during their business hours. The owner of 335 Boylston St, Onir Spiegel, was on scene, was given the incident number and was advised to contact her insurance company. MV1 was towed from the scene by Tody's and the operator signed a patient refusal from the Medics. Pictures were taken at the scene of the damage and submitted to IT to be attached to this report. After parking, she was sitting in her motor vehicle when she heard a bump to her driver's side rear end from MV2 backing up from a parking spot across from her. She says the operator of MV2 turned and looked at her and kept proceeding (NB) on Charlemont towards Needham Street. She then exited her vehicle to try and get the operator's attention to no avail. She took a photo of MV2 which was a black Toyota Highlander bearing MA reg.# R85045. She described the operator as a white female in her forties with possibly dark curly hair. The weather at the time of the crash was overcast. The road surface was dry. Beacon Street and Roslyn Road are both public ways maintained by the City of Newton. I spoke with the bicyclist involved in the crash, Steven Greenzang (S96615185). Greenzang stated he was traveling Westbound on Beacon Street in the shoulder lane on his black Specialized bicycle. Greenzang had a yellow reflective vest on and was wearing a helmet at this time. Greenzang stated a vehicle in the travel lane to his left drove by him and hit the mirror located on his left handlebar. I observed damage to the mirror. Greenzang report no injuries. I spoke with the operator of MV1, Sarah Bonfanti (S66811372). Bonfanti stated she was parked in front of 1411 Beacon Street waiting to pick up a co-worker that resides at that address. Bonfanti stated a bicycle traveling on the sidewalk to her right crashed into the passenger side door mirror of her 2008 Toyota Scion (MA: 681YH1). Bonfanti stated the bicyclist was acting ""crazy"" during her interaction with him and he was trying to take her picture. Bonfanti stated she got back into her vehicle and moved up the roadway to wait for police to arrive on scene. I canvassed the area where the accident occurred with Sgt. Dempsey. There was glass from the passenger side mirror of MV1 and Greenzang's bicycle in the main travel lane of the roadway and the shoulder lane where Greenzang stated he was traveling. We also observed a large tree and a telephone pole on the sidewalk next to the roadway where the accident is alleged to have occurred. After speaking with all parties involved, observing the location of the glass in the roadway from the crash, and the location of the tree and telephone pole on the sidewalk where he accident occurred; Greenzang would not have been able to operate his bicycle on the sidewalk and be close enough to the roadway to make contact with MV1. Prior to clearing the accident, I asked Bonfanti if she had any questions and if she wanted to report any injuries. Bonfanti stated she was hit by the bicyclist during her exchange with him and began grabbing her left leg. I asked Bonfanti why she did not inform the officers on scene that she was assaulted. Bonfanti stated she said something to our Dispatch when she called. I asked Bonfanti if her leg was injured. Bonfanti stated I was putting words in her mouth and that she was just scratching her leg. Bonfanti then stated she was hit in the right shoulder. I asked Bonfanti if she would like an ambulance to respond and evaluate her. Bonfanti declined and stated she was more concerned about her mirror. I advised Bonfanti if she wanted to pursue charges against Greenzang she could do so in Newton District Court. I listened to the 9-1-1 recording Bonfanti made in regards to this incident. Bonfanti stated a pedestrian busted out her window. Bonfanti then stated to our dispatcher that the bicyclist lost control of his bicycle and smashed into her car. The parking lot is a public/thru way that motorists use to access the Star Market along with other businesses. The weather at the time was cloudy and rainy and the parking lot was saturated. Prior to my arrival, the pedestrian involved left the scene and did not want to speak to the officer nor wanted medical attention. Ofc. Claflin then cancelled Cataldo Ambulance. The pedestrian, Mary Alexander, left her information with a store employee prior to leaving. I spoke to the operator of MV # 1 (Joshua Randel MD Lic.# R534440603244) who stated that he was travelling through the third row of the Star Market parking lot at an appropriate speed. He was then attempting to make a left turn near the entrance/exit of the store. He says that there was a large white van parked in the end handicapped spot towards the left of him. He says the van was sticking out in the spot limiting his visibility. As he was half way through his left turn and coming around the corner, he was not able to see a pedestrian pushing a shopping carriage. He then struck the carriage that was being pushed by Mary Alexander. He further says that the cart jolted Ms. Alexander and she fell down to the ground. At the time, Alexander was walking through the lot near the store entrance heading back towards the parked cars. She was not in the crosswalk at the time which was approximately ten feet down from her location. After, I attempted to go to Ms. Alexander's residence to follow up. I spoke to her friend who was bringing up Alexander's groceries and she stated that she decided to go to Newton Wellesley Hospital for treatment. I then spoke to Ms. Alexander in the lobby of the hospital. She stated that she was exiting the store through the lot with her shopping carriage. She believes she was approximately eight feet away from the door when all of a sudden she only saw red coming at her. She believes MV # 1 was speeding at the time. I asked her if she was struck by the vehicle or was the shopping carriage only struck. She replied that she did not know and only remembers falling to the ground after. She sustained a large bruise to the inside palm area of her right hand and her left knee was swollen. Digital photos of the scene were taken and pictures of Ms. Alexander's injuries were taken at the hospital. As far as possible video surveillance, I was told that the Loss Prevention Department has to access the video. On 11/13/19 at approximately 14:20 hours, I went in to the Star Market and spoke to the manager, Nidal Rajeh, inquiring about possible video surveillance. He said there is coverage in the parking lot and he was able to show me the video. A copy of the video would have to be done by Loss Prevention which I requested. I observed at the 12:12pm mark in the video, MV # 1 was parked five spots up from the third row of the lot that he was exiting. I also observed a white transport van parked in the end handicapped spot mentioned by the operator but it was parked correctly and not limiting visibility. Next, MV # 1 backs out of the spot and drives forward going at a reasonable speed. The pedestrian (Alexander) has already exited the store with her carriage and is walking at an angle toward the same third row of parked cars. As the pedestrian is walking towards the direction of MV # 1, it appears that the pedestrian should be visible to him. MV # 1 then starts to take the left turn around the corner without slowing or stopping and strikes the carriage head on. Due to the impact, Alexander then loses grasp of the carriage and it goes past her twisting her body around. She then hits and rolls up on the hood of the vehicle on her left side. MV # 1 then suddenly stops and immediately gets out and provides assistance to the pedestrian. Due to the video surveillance, Mr. Randel will be issued/mailed MA Uniform Citation # T2012347 for Ch. 90/14/A Failure to slow for a pedestrian.","[""Bus"", ""Citation"", ""Crash"", ""Crosswalk"", ""Ems"", ""Hospital"", ""Ped"", ""Pictures"", ""Rain"", ""Speed"", ""Walk""]","[""Inattention""]",[19],/static/reports/1900001164.pdf,/static/images/1900001164.png,"2040 Commonwealth Avenue, Auburndale, MA 02466, USA",42.3469722,-71.2448227,0,2020-10-07T12:34:21.316012 1900001183,2019-11-19T19:05,2019-11-19,19:05,2040 COMMONWEALTH AVE,SOUTH 2040 COMMONWEALTH AVE,,0,15,1,0,"Operator of MV1 parked his car in the parking lot and went into the business, when he returned there was damage to the front passenger bumper area. When I arrived on scene I observed a male party with blood on his head, and another male party standing next to him, later identified as Elmer Lopez.. I asked Elmer which car he was driving, and he stated that he was in MV#1. I asked Elmer what happened, and he stated that he and the other man with him, identified as Ricardo Deras, were in the rear seat with another male party, and that there were two other parties in the front seat, one of them was driving, he was not able to provide me with a name of who was driving. I asked him where everyone else was, and Elmer stated that after the crash, the got out of the car and ran away. At this point, medics arrived on scene and began to tend to Ricardo. I next spoke with the owner of MV#2, Jim Silva. Jim stated that he was in his home when he heard a loud crash. Jim stated that he came out of the house in time to witness the two males I was speaking with looking at the car, and he also stated that he observed three parties walk away from the scene, two heading east on California St, and one heading north on Fair Oaks Ave. MV#1 and MV#2 were towed off scene by Todys. Due to the scene, and the location of the cars in a busy street, I was not able to do a MV inventory of MV#1 until after it was towed by Todys. The inventory was done at Todys Service station, and a MV inventory sheet was filled out and placed the in appropriate box. I took three pictures of the damaged tree and submitted them to IT to be attached to this report. While I was taking the pictures of the tree, two males were walking past the scene. I stopped both parties and questioned them about the incident. They stated that they had been in the car, but had not been driving. I asked them if the knew who the driver was, and they told me that they did not know the name of the driver. Upon arrival, I spoke with the operator of MV1 (MA Veteran:J706), who stated that as he sat stationary in his vehicle just before entering pump: 3, MV2 backed up from pump: 1 and struck MV1 in the front bumper, despite him activating his horn and keeping it active as she continued to back up. The operator of MV1 then approached the driver's side door of MV2 to exchange information, however the operator of MV2 drove off; the operator of MV1 provided MA Pass: 8SV842 being attached to MV2 and I noted damage to the front bumper of MV1. I spoke to witness 1 via phone and he concurred with the operator of MV1's account of the incident. It should be noted that witness 1 could see the crash well from his vantage point by pump: 2. The operator of MV2 could not be reached by this officer for comment. Natick PD responded to the operator of MV2's residence and observed damage to MV2's rear bumper. They requested the operator of MV2 contact me via phone and she stated she would; Natick PD did not get a contact number for her. Natick PD informed us to expect her call and a few minutes later, dispatcher Kelly stated that she received a call from the operator of MV2, who immediately hung up once the call was answered. It should be noted that since she called on the business line and immediately hung up, we were not able to retrieve her phone number as the system does not store it. Due to the operator of MV2 failing to provide her information after the crash/fleeing the scene and her not being cooperative with my investigation, I have issued her by mail MA Criminal Citation:T2013367 for violating one count of MGL. Note: the clerk at Sunoco stated that the cameras at the pumps do not store footage. **Update** At approximately 1540HRs on Thursday, 01/07/2020, I spoke with the operator of MV2 via telephone. She contacted the Newton Police Traffic Bureau and provided her phone number, who in turn forwarded it to me. She stated to me that on the night in question, she was at the pumps and the pump she initially wished to use (pump: 1) had a sign on it to pay inside. She then elected not to use said pump and backed her car up and heard the operator of MV1 activate his horn. She stopped and was unaware that she struck MV1. When she saw the operator of MV 1 exit his vehicle, she assumed he was going to pump gas. She then stated she left the gas station because she was frustrated and did not intend to leave the scene of an accident. I advised the operator of MV2 that since I was unable to speak with her that night, I had already issued her MA Criminal Citation:T2013367 for violating one count of MGL. A photo was sent over in the email of the utility trailer and signboard knocked over on it's side over the sidewalk. The utility trailer is 2020 Wanco color orange bearing MA Official registration # M9994A. The trailer was parked in the bicycle lane of the northbound travel lane next to 275 Brookline Street. On 06/15/21 at approximately 09:00 hours, I went over to 110 Crafts Street and was told that the trailer/signboard was in the garage. The trailer was already being repaired to be placed back in to service. It had sustained damage to the two rear brackets where the jacks are located and the license plate bracket and registration plate were bent. The signboard message frame board is no longer aligned properly as a result of the accident but reportedly still functions. After, I then responded back to 275 Brookline Street and took digital photos of the scene. I observed in the bike lane at the accident scene two small pieces of lens covers to a vehicle with no identifying marks. I also did a canvass for possible surveillance cameras in the area. There was no response at number 269 and 275 Brookline Street but I left a note for them to call me. 283 Brookline Street has no surveillance cameras. Memorial Spalding School is across the street from the accident and I observed a camera on the side of the building which faces the staff parking lot on to Brookline Street. Mr. Stickney was provided with my email and will send over any possible footage if he has it. At approximately 12:45 hours, I spoke to Mike Sylvester who resides at 275 Brookline Street. He stated that he had surveillance footage and emailed it over to me. I viewed the footage which is a camera that views his approx. 75 foot driveway leading out to Brookline Street. There is a fence and bushes behind where the signboard is located which limits it's view. The video shows the accident took place on 06/11/21 at 18:48 hours. It was also reported by Newton Dispatch that one of the occupants on the bus had suffered an arm injury as a result of the crash. Meadowbrook Road is a public way maintained by the City of Newton. The road surface at the time of the crash was dry. The weather at the time of the crash was clear and sunny. When I arrived, I was updated by Officer Iarossi that the crash involved a City of Newton contracted school bus transporting students from the Williams School (141 Grove Street, Newton). The students were participating in ""Step Up"" day and were leaving Brown to go back to Williams. Officer Iarossi stated a student on the bus was injured as a result of the crash. Tegan Quirk was transported by Fallon Medics to Newton Wellesley Hospital with a right arm injury. The remaining students that were on the bus reported no injuries to staff at the time and were moved to another bus to be transported back to the Williams School. I asked the Brown staff that was assembled in front of the school to contact the Williams School and ask them to hold the children involved in the crash at the school once they arrived. I made this request so we could make sure there weren't any new injuries reported; and I wanted to inquire if any of the children witnessed the incident. The staff stated they would contact Williams and relay the request. I spoke with the operator of the school bus (MA BUN: BU44536), Mr. John Aubert (S48613114). Mr. Aubert stated he was operating bus #361 while transporting students from Brown Middle School to the Williams School. Mr. Aubert stated as he was preparing to leave Brown, he made an announcement to students on the bus to sit down. Mr. Aubert stated he got the okay to leave from one of the staff members on the bus. Mr. Aubert stated there was another bus parked in front of him prior to leaving. Mr. Aubert stated he began to reverse the bus to create distance from the bus in front of him, and then operated the bus forward to exit from his position on the right side of the road and merge into the travel lane to his left around the bus parked in front of him. Mr. Aubert stated as he merged onto the roadway, he heard screaming from the students on the bus and the rear passenger side of the bus made contact with a brick support column in front of the school positioned along the sidewalks edge next to the roadway. Mr. Aubert stated he exited the bus and observed a student's arm pinned on the rear passenger side of the bus between the side of the bus and the brick column. Mr. Aubert stated he got back in the bus and reversed it until the students arm was free. Mr. Aubert stated at this time, staff helped the injured student. The staff there helped facilitate transportation for the remaining students back to the Williams School. Mr. Aubert reported no injuries, but was concerned for the welfare of the student. After speaking with Mr. Aubert, I observed damage to the school bus and the brick support column as a result of the crash. I observed fresh damage (scrapes) to the rear passenger side of the school bus between the last passenger side window and the back of the bus. I also observed fresh damage to the brick support column. The column is a support to an overhead covering that runs from the sidewalk to the front entrance of the school. There was fresh paint transfer from the bus and a crack in the column. Pictures were taken of the damage and submitted to the IT Bureau. The travel lane where the crash took place is a one way access road that runs from Meadowbrook Road to the front of the school, and exits onto a parking lot between the Brown Middle School and the Oak Hill Middle School. I responded to the Williams School to follow up with staff there regarding this crash. All of the students that were involved in the crash had been released prior to my arrival. I spoke with the Principal of the Williams School, Ms. Ayesha Farag, Ms. Michal Shapiro (Social Worker), and Ms. Katie Costello (School Nurse) about the students on the bus. They stated no injuries were reported to them, and they notified the parents of the involved parties about the crash. They also provided me with contact information for all of the students on the bus at the time of the crash. I spoke with the three teachers that were on the bus at the time of the crash, Ms. Kimberly Andersen, Ms. Tess McLean, and Ms. Katherine O'Leary. All three teachers stated prior to the bus leaving Brown Middle School they accounted for all of the students and were ready to leave to travel back to the Williams School. One of the teachers recalled hearing the bus driver make an announcement to the bus that they were about to leave, but could not recall the exact wording of the announcement. The teachers stated as the bus began to move, they heard screaming from the rear of the bus, looked back, and saw a student's arm stuck outside the window. After realizing the student was injured, they assisted with helping to free the student from his pinned position. They helped the injured student until EMS arrived on scene. They assisted the remaining students by directing them away from the crash and onto another bus for transportation back to Williams. The three teachers reported no injuries as a result of the crash. I responded to the Newton Wellesley Hospital Pediatric Emergency Room to check on the status of the injured student, Tegan Quirk. I spoke with Tegan and his mother, Kathryn Quirk in his room. While attempting to talk to Tegan and his mother, Tegan became very upset and did not want to talk about the specifics of the crash. Out of courtesy for Tegan, I exited the room and spoke with his mother outside the room. I explained to Ms. Quirk the events of the crash, and how her son's arm became injured. I asked Ms. Quirk if she could assist me with faciliating a conversation with Tegan about the events of the crash. I explained to her I understood how traumatic the events of the crash were for her son, but as part of my investigation I would need to find out what led to Tegan's arm being outside the bus window at the time of the crash. While speaking to his mother, Tegan explained that he was waving to a friend with his arm out of the bus window when the bus started to move. Tegan stated his arm hit the column, and became stuck between the bus and the column. Tegan stated he was screaming for the bus to move and that it took forever for the bus to move so he could free his arm. Tegan stated the bus driver gave no warning to the students that the bus was going to start moving. The staff at Newton Wellesley Hospital stated Tegan has a right arm injury. The severity of the injury is unknown at this time due to further examination that needs to take place. I advised Ms. Quirk about the conversations I had with the other parties involved. I spoke with Mr. David Stickney (Head of Facilities) from the Newton Public Schools to try and obtain footage of the crash. Mr. Stickney stated unfortunately there is not footage of the crash from the Brown Middle School or Oak Hill Middle School surveillance cameras. I advised Ms. Regina Moody (Newton Public Schools Transportation Director) about the crash. Ms. Moody was able to show me footage of the incident from the camera inside the bus. In the footage, the bus driver can be heard announcing to the students prior to the bus moving, ""Guys, guys, get off the seat and sit correctly"". One of the teachers can be seen doing a count of the students. The teacher is heard saying to the student, ""Everyone needs to be in a seat and sitting at 3 and 2 and 1 and thank you."" Student are observed still standing up. The teacher is then heard saying, ""sit down sit down."" After the teacher passes the students in the back of the bus, she says, ""We are good."" to the front of the bus. Students are then observed standing after she passes. As the bus begins to back up, students can be observed standing in the rear of the bus and not sitting down on their seats. As the bus moves forward, a student (Tegan Quirk) can be seen standing on his seat and extending his right arm out of the last window on the passenger side of the bus. Screaming can then be heard as his arm makes contact with a support column on the passenger side of the bus. The bus is stopped, the driver exits the bus to asses what happend, gets back on the bus, and reverses the bus a short distance. The injured students right arm is released and he brings his arm back into the bus through the window. The amount of time between the students arm being pinned against the column to when it is released is approximately 40 seconds. After speaking with all parties involved and reviewing the footage from inside the bus, it appears that Bus #361 was pulling out of it's parked position in front of the Brown Middle School to enter the roadway and return students to the Williams School. A student that was sitting in the last row on the passenger side of the bus extended his right arm out of a window next to his seat to say goodbye to a friend. While his right arm was extended out of the rear passenger side window of the bus , the bus collided with a brick support column affixed to the sidewalk in front of the school. When the bus made contact with the column, the students right arm made contact with a brick support column and became pinned between the column and the passegner side of the bus. After the students arm was freed from it's pinned position, the student was able to bring his arm back into the school bus and was transported to Newton Wellesley Hospital for a right arm injury.","[""Bus"", ""Crash"", ""Ems"", ""Hospital"", ""Pictures"", ""School"", ""Solar""]","[""Inattention""]",[19],/static/reports/2100000437.pdf,/static/images/2100000437.png,"125 Meadowbrook Rd, Newton, MA 02459, USA",42.3091306,-71.1898743,0,2021-06-29T16:27:15.688148 2100000486,2021-07-02T13:17,2021-07-02,13:17,83 WALNUT ST,WEST 83 WALNUT ST,,0,10,0,0,"ON 7-2-21 AT APPROX. 1317HRS. Kaplan stated the accident was very obvious as damage was unfolding while Mr Benjamin was attempting to squeeze between Mv#1 and another vehicle. Kaplan stated after realizing he (Mr Benjamin) could not fit he started to drive away. Kaplan stated it drew the attention of another witness (unknown) standing on the street when both walked up to Mr Benjamin's vehicle and asked him if he was going to leave a note for the damaged vehicles. Benjamin refused. Kaplan described Benjamin's overall demeanor as ""rude."" Kaplan stated he told Benjamin he has cameras capturing the incident. Not until then, Benjamin got out of his car and left a note on only the other vehicle reported to be minor license plate damage. Kaplan stated Benjamin never left a note on Mv#1, the vehicle with obvious moderate damage. Kaplan stated he actually viewed the note left on the other vehicle and said it was illegible. Kaplan told Benjamin this and Benjamin yelled to him ""mind your own business"" and drove away. Kaplan stated his ring doorbell camera was not positioned to capture any of the incident. Operator of bicycle continued on foot on his path home where he was picked up by his father and brought by his father to NWH for cuts on his face and hands. Operator of Bicycle was disoriented and stated he did not know where the accident occurred, manner of collision, MV1's description or if he was wearing a helmet. Mr. Gershon stated he was traveling on Walnut Street (N) in the right shoulder lane towards the area of Hull Street and Kirkstall Road. Walnut Street, Hull Street, and Kirkstall Roads are all public ways maintained by the City of Newton. Mr. Gershon stated while operating his blue Trek gravel bicycle he continued on Walnut Street when a black vehicle (no further description) appeared out of no where on his left hand side and entered his travel lane. Mr. Gershon stated he did not have time to react and crashed into the rear passenger side of the vehicle. Mr. Gershon stated he does not recall anything between the time he made contact with the vehicle and the time he came to a rest on the roadway. Mr. Gershon stated the vehicle never made an attempt to stop and it left the area. Mr. Gershon stated after the crash he began walking towards the Newtonville Square area until his father picked him up and brought him to Newton Wellesley Hospital. Mr. Gershon stated he suffered injuries to the right side of his face, his right should, right hand, and was diagnosed with a concussion as a result of the crash. Mr. Gershon initially believed the vehicle entered Walnut Street from either Kirkstall Road. Kirkstall Road is on the Eastbound side of Walnut Street and if a vehicle exited the street onto Walnut Street it's driver side would be facing Mr. Gershon's direction of travel. Hull Street is on the Westbound side of Walnut Street. Hull Street supports one-way traffic and traffic can only enter Hull Street from Walnut Street. If the vehicle were to enter Mr. Gershon's travel lane as he described, the vehicle would have to travel Eastbound on Hull Street in violation of the one-way restriction to take a left onto Walnut Street and travel Northbound. Mr. Gershon stated it is possible the vehicle may have exited a driveway from a residence on the Westbound side of Walnut Street, taking a left turn to travel Northbound. After speaking with Mr. Gershon about his injuries and his attempt to avoid crashing into the vehicle, we surmised Mr. Gershon attempted to travel around the vehicle's left side prior to impact, with the right side of his person crashing into the vehicle. Mr. Gershon stated he was not wearing a helmet at the time of the crash and there were not lights or reflective equipment on his bicycle. Mr. Gershon stated he was wearing a gray and white hooded sweatshirt with jeans at the time of the crash. Mr. Gershon stated he returned to the scene after the crash and discovered his bicycle resting near the lawn of a residence on Walnut Street in the area of the crash on the Westbound side of the street. Mr. Gershon stated there was extensive damage to the front wheel and the frame of the bicycle was bent in half.
