Update January 1, 2019 16:15 hours: I was able to contact the owner of MV2, who admitted that she was the operator of the vehicle and that she was in the vehicle alone. The operator of MV2 said that the operator of MV1 was driving very slow and stopped in the right lane so she attempted to pass the vehicle. MV1 began turning and MV2 struck MV1. The operator of MV 1 said that she was nervous and left the scene because her phone died and attempted to contact the Newton Police in the morning. I am mailing citation T1441275 to Cecelia Spangenberg for MGL90/24C, leaving the scene of property damage. Photographs of the bumper have been submitted to IT to be attached to this report. On arrival, I observed Mv#1 MA Reg 5TWS10 with heavy front end damage wedged in between two other vehicles parked in marked spaces. #1 operator, in the driver's seat, was being evaluated by Medics. #1 was identified as Mary Jane Hymanwegscheider (10/14/38). I first made contact with a witness identified as Sharon Corliss. Ms Corliss stated she was sitting in her parked vehicle and observed Mv#1 backing out of the end spot next to CVS. She explained once #1 had came to a stop from backing, #1 then pulled forward, drove over a curb island and continued driving straight into the two parked vehicles. Ms Corliss stated it appeared #1 was travelling about 5mph preceeding the crash. After the medics intial evaluation of Ms Hymanwegscheider, I was able to ask her what happened? She stated she backed out of her space, hit the curb going forward and then put her foot on the gas instead of the brake before the collision. She was deliberate when speaking and appeared confused. She reported to medics she had no medical history and was not using any medications including allergy medication as well. She reported she did not hit her head after the collision. She was then transported to NWH for further evaluation after medics discovered her blood/sugar readings were very low. I advised Ms Hymanwegscheider her vehicle had heavy damage and was being towed by Tody's and to expect paperwork at the conclusion of the crash investigation. It appeared #1 struck Mv#2 first on its driver's side rear before striking Mv#3 parked next to it on the passenger side rear. #1 wedged itself between #2 and #3, #3 was then pushed to the left into the passenger side of Mv#4. #2 and #3 sustained heavy rear end damage. #4 sustained light damage. #1 towed by Tody's with heavy front end damage. #2 arranged for her own tow through her insurance company. A note was left on #3, and #4 was able to be driven from the scene. Ms Hymanwegscheider is showing no MV infraction/no accident history. Based on the accident scene, it appears the operator was traveling southbound on Cherry street, crossed over the center line into oncoming traffic, striking the fire hydrant in front of 154 Cherry street, and then crossed back over into the correct lane of traffic before coming to rest in front of 171 Cherry street. The vehicle was towed by Tody's towing, and an inventory form was filled out and filed. Pursuant to an investigation outlined in incident #19002213, the operator at the time of the crash was determined to be Michael Carter. It is believed that Carter stole the vehicle from 295 Auburn St, fled the area, and ultimately crashed in front of 1970 Beacon St. Corroborating facts outlined in the incident report put Carter as the operator. The vehicle itself was located partially on the sidewalk and partially on the road, therefore Carter is being cited with MGL 89/4A - Marked Lanes Violation (T1268423). Due to the fact it is believed that Carter fled the scene after the crash, MGL 90/24/C - Leaving the Scene of Property Damage was added as well as MGL 90/23/D Operating After a Suspended LIcense, and MGL 90/24/O - Reckless Operation of a Motor Vehicle. The crash occurred during busy weekday commuting about 0.7 miles from Angier Elementary School. The last 3 charges mentioned have been listed on a second citation (T1268422). Officer Brooks also issued T0648082 for OUI Drugs MGL 90/24/G. See the incident report for details about this charge. In total, there are (3) citations issued to Carter. The vehicle sustained heavy front end damage. It should be noted that the utility pole a couple of houses down from the crash site (Beacon/Varick Rd, pole #212) sustained fresh, minor superficial damage, consistent with the vehicle crashing into it before verring onto the sidewalk. Pictures have been taken and submitted to the IT bureau. He immediately pulled into the Jiffy Lube lot to check on her. I took pictures of the scene and the MV. They were TOT IT. After further investigation, on 2/7 the operator was cited for 90/14 failure to stop for pedestrian. I spoke with Kenneth via phone and advised him of the update. The citation was mailed to him. I am charging for 90/14 failure to stop for a pedestrian. She then ran in to the JCC for approximately one minute and when she returned she observed her driver's side front door was struck. I observed significant damage to the door frame and the door would not close. The owner called for a private tow to remove the vehicle. The staff at the JCC stated that a Martha Bixby gave her number and stated that she observed a black colored car with MA reg. # 934HH4 strike M/V 1. I attempted to call the number and left a message. The listing for that plate comes back to a 2010 Lexus ES350 color gray. I was then showed the video surveillance from the JCC's cameras and it shows an older white female exiting the lobby wearing a winter hat and carrying a bag with purple flower designs on it. She then walks through the lot and enters a gray Lexus ES350. The Lexus then starts backing out of the spot. The Lexus then continues backwards in to the other side of the parking stalls and strikes M/V 1 on the driver's side front door. The Lexus then pulls forward and leaves the scene without stopping or providing her information. As the Lexus is leaving, you can see there is a dent to the driver's side rear bumper. The video is not clear enough to see the plate on the Lexus or clearly see the operator's face. After, I located a number for the owner of the Lexus M/V 2 (Tania Lefman). I spoke to Lefman on the phone and she stated that she was backing out of the JCC parking lot at that time and felt a tiny bump to her rear end. She says that she could not stop in time due to the icy parking lot and then left the area thinking that nothing was wrong, it was only minor. I advised her there was significant damage to the other car. OWNER REPORTS NO INJURY AND WAS ADVISED O CONTACT HIS INSURANCE COMPANY. ATTEMPTS TO MAKE CONTACT WITH THE OWNER OF VEHICLE #2 WAS UNSUCCESSFUL AT THIS TIME. FOUND A SECOND NUMBER ( 860-301-1336 ) FOR THE METROWEST PACKAGING COMPANY AND LEFT ANOTHER VOICE MAIL.WILL TRY TO MAKE CONTACT AGAIN BEFORE PURSUING OTHER OPTIONS. Traffic Bureau Update (Officer Gaudet): On Monday, February 4, 2019 I made contact with the President of Metrowest Packaging, Brian Hersh. Hersh stated his company does fulfillment deliveries for Amazon. Hersh was advised that a vehicle registered to his company was allegedly involved in a hit and run accident. Hersh was provided information on the vehicle involved. Hersh stated an employee named Alexis was operating MA CON:T65665 on the date of the accident and provided a phone number for this party. On Tuesday, February 5, 2019 I spoke with Alexis Laporte-Soto (S84358654). Laporte-Soto stated he was operating a 2017 Mercedes Sprint van (MA CON:T65665) in Newton for Metrowest Packaging on the date of the accident. I explained to Laporte-Soto the vehicle he was operating was alleged to have been involved in a hit and run accident on Highland Street in Newton. Highland Street is a public way maintained by the City of Newton. Laporte-Soto stated the vehicle he was operating hit the driver door mirror of a parked card on Highland Street. Laporte-Soto reported the accident as mirror (MV2 passenger side) to mirror (MV1 driver side). Laporte-Soto stated after his passenger side door mirror made contact with MV1's driver side door mirror, he stopped his vehicle 15 feet down the road. Laporte-Soto stated he walked up to the car he hit and saw the mirror was bent back but there was no damage. Laporte-Soto stated he waited near the car for 10 minutes and the owner never showed up. Laporte-Soto also stated a ""random guy"" took a picture of his license plate. Laporte-Soto stated he said ""hi"" to this party but the party ignored him and left the area. I asked Laporte-Soto why he did not call Newton Police to assist him in finding the owner of the vehicle he hit. Laporte-Soto stated he didn't know. I also advised Laporte-Soto that the name of the owner of the vehicle he hit was printed on the driver side door next. The owner's phone number and email address were also printed on the driver door. Laporte-Soto stated he didn't see that. I spoke with the owner of MV1, Jason Correria. Correria stated a co-worker observed the entire accident and observed MV2's passenger side mirror hit MV1's driver side mirror. Correria stated his co-worker then observed MV2 travel down Highland Street with out stopping and pull into the Santander parking lot located at 1314 Washington Street. Correria stated his co-worker saw the operator of MV2 exit his vehicle, check his passenger side door mirror for damage, and leave the area. Vehicle #1 had significant damage to the front and right quarter panels. It was straddled between the travel lanes and did not have the keys in the ignition. It was immediately apparent that operator #1 suffered an injury to his head, as there was a moderate amount of blood and small pieces of glass stuck in his forehead area. I observed operator #1 to be unsteady on his feet, have bloodshot eyes and slurred speech. I could detect a moderate odor of alchoholic beverage coming from operator #1 as I was approaching him, which was apparent from about an arms length away (it should be noted that medics were already en route to the scene at this time). Prior to the medics arrival, I asked operator #1 for a brief synopsis of what transpired. Operator #1 stated that he had just left Paddy's Pub and was driving westbound on Hunter St (which is approximately 1/8 mile from our location) when he collided head on with vehicle #2. Vehicle #2 was not immediately visible upon police arrival, however was pointed out as being located at the intersection of Hunter and Putnam St. I asked operator #1 where he was heading, as Hunter St is a back road not directly in the vicinity of Paddy's. Operator #1 could not answer the question and also remained silent when I asked him how much alcohol he had consumed this evening. At this time the medics arrived on scene. I asked operator #1 for the car keys to reliquish to the tow truck operator, which is standard operating practice. Operator #1 reached into his pocket and then provided me with the keys. Due to concern over operator #1's obvious head trauma, he was then transported to NWH to be evaluated while the investigation continued on scene. Two other parties approached myself and Officer Selig. One was the operator of vehicle #2, MA reg 1RD999. Operator #2 is identified as Luke Ferdinands DOB 5/11/80. The other party who approached is identified as Douglas Dasilva-Pimenta DOB 6/2/86 (Dasilva-Pimenta will now be referred to as operator #3). Operator #2 states that he was taking a right onto Hunter St from Putnam St, when he observed vehicle #1 on the wrong side of the road approaching him head on. Operator #2 states vehicle #1 then collided head on with him, took a right onto Putnam St, and continued onto the Washington St overpass near 1354 Washington St. Operator #3 states he was inside of #5 Hunter St when he heard a loud crash coming from outside. He looked out the window and saw vehicle #1 traveling at a high rate of speed on Hunter St towards Putnam St. Operator #3 observed damage to the right side of his parked vehicle (now referred to as vehicle #3) MA reg 7CAK80. He immediately got in his vehicle and proceeded to follow vehicle #1, which then crashed into vehicle #2 head on. Operator #1 did not stop until it was obvious that operator #3 was following close behind. This ultimately landed vehicle #1 at it's final location near 1354 Washington St. Vehicle #1 and vehicle #2 were not driveable and were towed to Tody's. It should be noted that there was a passenger in vehicle #2 at the time of the collision. Airbags were deployed and medics checked out both operator and passenger. Both declined transport. The passenger is identified as Elizabeth Ferdinands DOB 5/22/53.Ferdinands' version of events coincide with that of operator #2. Upon speaking with Officer Selig it was learned that operator #1 dropped his cell phone several times as he was holding it on scene. Both Officer Selig and operators #2 and #3 observed this. Operators #2 and #3 both expressed concern over the obvious odor of alcohol eminating from operator #1, and the fact that he was unsteady on his feet. I responded to NWH to follow up with operator #1 however he did not wish to speak further. He did express concern over the well being of all parties involved. She says that the vehicle slowed down after and then continued to leave the scene of the accident. She then took a photo of the above listed registration plate. I attempted to contact the owner of M/V # 2 (Jali Medical Inc Waltham, MA) and the receptionist was not able to provide any information at the time. I was told to call back the next day. I gave the vehicle and registration info to the person inquiring if they could find a possible driver and call back. While working on this report, I observed that the owner of M/V # 2 was involved in a past accident in our system and the operator at the time had an address of 66 Country Club Rd. Newton. I viewed the garage door and there was significant damage as it became detached from the wall. The door had to be placed out of service. After I spoke to Ms. Weinstein who admitted to striking the side of the garage door but only thought there was damage to her vehicle. While backing the wrong way, #1 veered into Mv#2 that was legally parked in a space on Pleasant St. #2 was sitting in her MV, not operating, at the time of the collision. #1 passenger side rear struck #2 driver's side front. Dispatch was able to get in touch with the vehicle owner Jaleh Jalili who stated her son Pouya Jalili was driving her car last night. While canvassing the neighborhood of Elinor Rd , Sgt. O'Connell was able to find a tire marks on a lawn and a downed ""Sharp Bend"" sign in front of #273 Dedham St. This crash site is approximately 1/4 mile away from where the parked car was found. I went to #273 Dedham St and witnessed fresh tire marks that went up on the curb onto the lawn of #273 Dedham St, over a vacant sign post hole and then a ""Sharp Bend"" sign that was half bent and then resting in the South brake down lane of Dedham St.. There was also a plastic black part of a car along with two (2) metal parts to the under side heat shield of an exhaust. The owner of #273 Dedham St was not home so I left a message on his door regarding this incident. Tody's was called and David showed up and towed the car from the scene. Officer Hagopian went to the residence of Pouya Jalili and spoke with him. Pouya told Officer Hagopian that he was involved in a spin out somewhere on Rt 9. in Wellesley and his bumper became detached. He then pulled into the CVS in Newton at #978 Boylston St where he pulled his bumper the rest of the way off. He then told Officer Hagopian that he continued down Rt 9 until he realized his car wouldn't make it any further and that's when he pulled off and parked on Elinor Rd. He then called a friend to pick him up and drive him home. On the way back to the station I stopped by #978 Boylston St with Officer Benes. He found a Grey rear bumper which is believed to belong to Pouya Jalili's car. I called David Donahue (Tow Driver) and asked that he look under the Honda to see if it had its heat shield. MV3 was parked in the lot of 109 Adam Street facing Southbound. MV1 hit MV3 head on. There was significant damage to MV3 front end. The operator was uninjured. I then spoke with the operator of MV2(RI COM 81082) who stated he was traveling eastbound on Watertown street, and observed MV1 crossing over the center line. The operator of MV2 stated he tried to get out of the way but MV1 continued into his lane and struck him head on. MV2 had damage to the drivers side front end. The operator stated that he was suffering from shoulder pain to his right shoulder. The operator of MV2 was transported to Newton Welleseley by Cataldo. En route to the location with Ofc Gourdeau, it was determined by first arriving Ofc Gourdeau that a vehicle had crashed through a fence at the end of Troy Lane and came to rest in the backyard of 126 Evelyn Rd. On arrival, I located the vehicle operator, identified as Mr Stuart Phillips who was operating MA Reg 8VVP40, an '03 Jaguar S Type model. Mr Phillips was walking around the backyard after the collision and appeared coherent as to what had transpired. He sustained a laceration to the top of his head and was bleeding heavily. We sat him down in a lawn chair prior to medics arrival to evaluate. When asked what happened, he stated he ""hit the gas instead of the brakes"". I asked him where did the accident begin? He stated he was turning around at the end of Troy Lane (a dead end cul de sac) and crashed through the fence there. Mr Phillips was alert and speaking clearly. I asked him if he was on any medication? He stated he was taking Plavix only, a blood thinner. I asked about his medical history and he stated he was released from Spalding Rehab today for treatment from a stroke and was receiving occupational therapy. Medics arrived to evaluate and he was transported to NWH for treatment. An investigation of the crash path of the vehicle revealed the following based on tire tracks and damage left behind: The vehicle crashed through the fence at the end of the cul de sac belonging to 41A Helene Rd; Vehicle drove over that back lawn, clipped the back deck attached to the rear of the house; damaging the base of the deck and lattice below; Vehicle travelled over the patio, then crashed through shrubbery down an embankment leading to the backyard of 132 Evelyn Rd; Vehicle drove through backyard of 132 Evelyn, then continued along the side of the house where it drove over damaging three retaining walls and clipped a large tree; After driving over the third retaining wall, vehicle continued through the backyard of 126 Evelyn, causing significant lawn damage; Vehicle continued until it hit the back of the house at 126 Evelyn; there, it drove over the rear patio before it struck a ground level basement window and window well; It came to a rest there where the vehicle caught on fire under the hood. Witnesses helped extinguish the fire with a garden house (see incident report #19020129) until NFD arrived to knock it down. Significant front lawn damage to 126 Evelyn occurred as well as NFD was arriving on scene to what was first reported as a structure fire. Several photos of the area were taken by myself. The pedestrian, NNHS student Benjamin Donovan stated that he was crossing east to west in the marked crosswalk in front of 321 Walnut St. Donovan stated that he saw Beaver's vehicle approaching him at approximately 5 to 10 MPH. Believing that Beaver was stopping to let him cross , Donovan stated that he held up his left hand to signal to Beaver that he was going to cross. Donovan stated that Beaver's vehicle struck him on his left side and knocked him to the ground. Donovan stated that he had minor scrapes on his right side as a result of falling to the ground. Donovan stated that he did not lose consciousness and was transported via EMS to Newton Wellesley Hospital for treatment. I took photos of Beaver's vehicle and forward the disk to NPD IT Bureau. I issued Beaver MA Citation T 1269995 and cited him for a violation of MGL Ch 89 C 11, failure to yield to a pedestrian in a crosswalk. On 06/12/2019 I was forwarded an E-mail from Capt Anastasia of a video of the crash that was taken from a camera that was mounted on the roof of 321 Walnut St. The video shows Donovan walking into the marked crosswalk from the east side of Walnut St and hold up his left had to Beaver's on oncoming vehicle. Beaver vehicle appears to be travailing faster than the 5 to 10 MPH that Beaver believed that he was travailing. The video shows that Beaver did not brake until Donovan was struck and landed on his vehicles hood. Donovan was thrown approximately 10 feet from Beaver's vehicle and landed on his right side on the roadway. Martinez stated the vehicle locked up and she made contact with MV2. Martinez reported no injuries on scene. I observed moderate damage to the front driver side area of MV1. The operator of MV2, Gerard Kenneally (S75917793), stated he operating his 1999 Ford E150 (MA: 3AL821), Southbound in the area of 802 Walnut Street, Newton. Kenneally stated MV2 was traveling Northbound on Walnut Street and crossed over the double yellow line and side swiped the driver side of his vehicle. Kenneally reported no injuries on scene. I observed moderate damage to the driver side of MV2 from the driver door to the rear bumper area. I spoke with a witness to the accident, Bryan Stewart, via telephone. Stewart stated he was traveling Southbound on Walnut Street behind MV2 at the time of the accident. Stewart stated he observed MV1 drive over the double yellow line and into their travel lane. Stewart stated 3/4 of the vehicle was in the Southbound lane while it was traveling Northbound. Stewart stated MV1 crashed into MV2. Stewart stated if MV2 was not in front of him then MV1 would have crashed into him. I spoke to witness 1 via phone and he concurred with the operator of MV1's account of the incident. It should be noted that witness 1 could see the crash well from his vantage point by pump: 2. The operator of MV2 could not be reached by this officer for comment. Natick PD responded to the operator of MV2's residence and observed damage to MV2's rear bumper. They requested the operator of MV2 contact me via phone and she stated she would; Natick PD did not get a contact number for her. Natick PD informed us to expect her call and a few minutes later, dispatcher Kelly stated that she received a call from the operator of MV2, who immediately hung up once the call was answered. It should be noted that since she called on the business line and immediately hung up, we were not able to retrieve her phone number as the system does not store it. Due to the operator of MV2 failing to provide her information after the crash/fleeing the scene and her not being cooperative with my investigation, I have issued her by mail MA Criminal Citation:T2013367 for violating one count of MGL. Ch. 90 S. 24 (Leaving The Scene Of An Accident After Property Damage). Note: the clerk at Sunoco stated that the cameras at the pumps do not store footage. **Update** At approximately 1540HRs on Thursday, 01/07/2020, I spoke with the operator of MV2 via telephone. She contacted the Newton Police Traffic Bureau and provided her phone number, who in turn forwarded it to me. She stated to me that on the night in question, she was at the pumps and the pump she initially wished to use (pump: 1) had a sign on it to pay inside. She then elected not to use said pump and backed her car up and heard the operator of MV1 activate his horn. She stopped and was unaware that she struck MV1. When she saw the operator of MV 1 exit his vehicle, she assumed he was going to pump gas. Mellett stated that the mechanical arm that is used to pick up trash barrels was not in the fully closed position. Mellett stated that the his truck's mechanical arm was still partially extended and that the clamps on the arm were in the open position when he attempted to pass the parked vehicle. I told Mellett it was my understanding that the trash truck could not be put into drive as long as the arm was still extended. Mellett stated that the truck can be driven with the arm still partially extended. Vehicle one had no damage and vehicle two had damage to it's rear driver's side bumper and lower quarter panel. Neither vehicle required a tow, and I took photos of both vehicles. Traffic Bureau Update (Officer Gaudet): On July 27, 2020, I attempted to contact the registered owner of MV1, Toghrul Mustafayev (SA0610793), with a negative result. A ""Hit and Run"" inquiry was mailed to Mustafayev. On Tuesday, August 4, 2020, I spoke with Mustafayev via telephone. Mustafayev stated he is the owner of MV1 and recalls being involved in an incident on July 24, 2020 in front of 115 Elm Street, Newton. Elm Street is a public way maintained by the City of Newton. Mustafayev stated he was operating his vehicle (2007 Toyota Prius, MA: 93A250), while leaving a parking spot in front of 115 Elm Street. Mustafayev stated as he left the parking spot his vehicle touched another vehicle. Mustafayev stated he exited his vehicle and observed no damage to the other vehicle involved. Mustafayev stated he looked around for the other owner but could not find them. A query of Mustafayev's license status shows it is suspended as of November 18, 2019. I asked Mustafayev if he was aware of his license status. Mustafayev stated he knew it was suspended but he was only changing parking spots when the crash occurred. On arrival at the same time with the Fire and Medics, I observed a female laying in the middle of the lot facing down on her back. A small red and gray CVS like type shopping carriage was knocked over and resting on it's side in front of the victim's head. The carriage was moved to the side in order to tend to the victim I also observed a black Honda Civic bearing MA reg.# 3741TW that was involved in the accident. The Honda was out of the parking spot resting approximately two feet away from the pedestrian's legs. I then spoke to the pedestrian identified as Darla Gipson in the rear of the ambulance. She sustained an abrasion to her front left shoulder and arm area which I observed. She also complained of left knee and elbow pain. She stated that she walking through the middle of the parking lot pushing the carriage by the door entrance in a westerly direction towards Chestnut Street. She states that she never saw a vehicle backing up and then she was suddenly struck and believes she was pushed underneath the vehicle. She was then transported to Newton Wellesley Hospital by Cataldo Ambulance. I then spoke to the operator of the Honda Civic identified as Linda Burke (MA S70320414). Ms. Burke was parked in the first spot to the right of the walkway that leads to the entrance/exit doorway. I asked her what occurred and she stated that she was backing her vehicle up to exit the parking lot when she looked behind her not seeing anything in sight. She then started backing up and struck the pedestrian without realizing it. She says the driver of a green cab and his female customer who were no longer on scene were yelling at her to stop her vehicle because the pedestrian was underneath it. She then stopped her vehicle. I observed minor scrapes to the entire rear bumper of the vehicle so it is unknown where it actually struck the pedestrian/carriage. I observed no obvious signs of damage to the carriage. Wolf stated the car then rolled over and she was able to climb out on her own. Wolf had a laceration to the head that was bleeding so Newton Medics transported her to NWH for treatment. Wolf had a moderate smell of alcoholic beverages emanating from her person and glassy eyes and was slurring her words. Wolf was not asked to do field sobriety due to her injuries.
