The operator was transported to Newton Wellesley Hospital by Cataldo for further evaluation. Based on the accident scene, it appears the operator was traveling southbound on Cherry street, crossed over the center line into oncoming traffic, striking the fire hydrant in front of 154 Cherry street, and then crossed back over into the correct lane of traffic before coming to rest in front of 171 Cherry street. The vehicle was towed by Tody's towing, and an inventory form was filled out and filed. The operator was mailed MA Uniform Citations T0648078 and T0648079 charging him with MGL 89/4A Marked Lanes violation, 90/24 OUI Drugs, 90/24(2)(A) Operating to Endanger/Negligent operation, 90/11 No License in Possession, and 90/11 No Registration in Possession. Officer Donahue took pictures of the fire hydrant and crash scene, which have been submitted to the IT Bureau. Upon my arrival Cataldo medics were treating the operator of MV1(MA REG 159EF6) for a diabetic issue. I spoke with a witness to the accident who did not wish to leave their information. The witness stated they were traveling westbound on Watertown street behind MV1, when it suddenly left the roadway to the right, striking the curb, before returning to the roadway and stopping. The witness stated that MV1 nearly missed a fire hydrant and a utility pole on the sidewalk. MV1 had a flat front passenger side tire, and minor scrapes on the body. I spoke with the medics who were still treating the operator for her diabetic issue. I observed the operator was in and out of consciousness, and unable to speak about the accident. It took several minutes for the operator to regain her consciousness, however she was still not able to answer simple questions coherently and was transported to Newton Wellesley hospital for further evaluation. MV1 was towed from the scene by Tody's, and an inventory form was filed and submitted. The area the crash occured was a high pedestrian traffic area, and both an elementary and middle school are within walking distance of the accident. I observed tire tread marks across the front lawn of 107 Dartmouth St. I then observed a vehicle in the bushes toward the left front side of the house. The vehicle; NY Reg. JHE8252, Porsche color blue. The RMV info on the plate came back registered to Porsche;of ;South. Registration plate type: Dealer Assignment. 185 W Sunrise HWY; Freeport,NY (no further info). The vehicle was unoccupied and secured. I felt the hood of the car which was still warm from the engine. I checked the immediate area surrounding the crash scene for an operator but found no one. I radioed to other responding units to canvas the neighborhood and surrounding area for the operator on foot. I spoke to the homeowners at 107 Dartmouth St., identified as Anthony and June Limberis. Mrs. Limberis stated she heard a load noise and a car engine revving. She stated when she looked out the window she observed a W/M tall, thin, wearing tan khakis and a light colored plaid shirt walking across the front lawn. He proceeded up Dartmouth St. (northbound) toward Commonwealth Ave. Newton Fire Dept arrived on location to check the crash scene and vehicle for possible leaking fluids and any other hazards. As I was talking with the firefighters we were approached by two men. One of the men was intoxicated. He was unsteady on his feet, had glassy bloodshot eyes, and was slurring his speech. The man was a W/M tall/thin approx. 6'2"" and was wearing tan khakis and a light colored plaid shirt. He was identified as Eric Adams DOB 09/18/1969. The second man with him was identified as John Adams DOB 02/07/1936; An elderly W/M approx. 5'6"" also wearing tan khakis and a light colored plaid shirt. Eric Adams stated his father John was the operator of the vehicle. Eric Adams had a strong odor of Alcoholic beverage emanating from his person and breath. He continued to slur his speech and was unsteady on his feet as he spoke. He was swaying back and forth and side to side as he spoke to me. Officer K. Donahue and Sgt. Devine were on scene at this time and also made the same observations. Multiple times we had to grab hold of Eric Adams to keep him from losing balance and falling. We spoke with Eric and John Adams for several minutes as their accounts of what took place were not consistent. I asked Eric Adams where the keys to the vehicle were. Eric Adams immediately pulled the starter key to the vehicle from his front right pocket. Eric Adams became defensive and belligerent when questioned about who was operating the vehicle. John Adams appeared tired (as if he just woke up) and confused as to the situation. Sgt Devine and I both spoke with Eric Adams and John Adams. Although both men claim John Adams was the operator of the vehicle, a clear determination was uncertain. A query of both mens driver's license status on NY Licenses came back active. Eric Adams has two prior DUI's on his RMV record. Officer Donahue and Sgt. Devine escorted the two men to 93 Dartmouth St. Eric Adams stated they were staying at that residence which is his sister's house. I stayed at the crash scene to document information and assist with clearing the MV from the property with Tody's Towing Service. As they were walking away I observed Officer Donahue and Sgt. Devine continue to have to assist Eric Adams with staying on his feet. Approximately ten minutes later as I was speaking with the aforementioned homeowners Mr.&Mrs. Limberis. Officer Donahue and Sgt. Devine returned to the crash scene. As they were updating me we observed Eric Adams returning to the crash scene. He was stumbling and swaying as he walked and repeatedly almost fell. Officer Donahue and Sgt. Devine immediately intercepted and assisted him before he fell. As they were assisting him again I continued speaking with the homeowners. Suddenly I heard Officer Donahue and Sgt. Devine struggling with Eric Adams who was now on the ground and resisting being handcuffed. I ran to assist them. Eric Adams continued to resist and be uncooperative until he was appropriately restrained in handcuffs. Eric Adams was placed under arrest by officer Donahue for Disorderly Conduct and Resisting Arrest. Reference Officer Donahues Newton Police Incident Report #19016484. The vehicle NY Reg. I spoke to witness, HARRIS, who stated that she was traveling Southbound on Adam Street when she saw MV1 in the wrong lane traveling toward her at a high rate of speed. HARRIS stated that MV1 then turned into the utility pole located outside of 109. MV1 took out the pole, side swiped MV2 and then hit MV3 head on. Operator of MV1 stated that he was traveling Northbound on Adam Street when he sneezed. At this point, he said his eyes were off the road and the next thing he could remember was being in the parking lot of 109 Adam Street after the accident. There was significant damage to the front of MV1 with airbag deployment. Operator of MV1 was checked out by the medics for a head injury and signed a refusal. Operator of MV1 was asked if he had consumed any alcohol or taken any medication today and he declined. Officer Spinney (N491) asked if he was willing to do a Field Sobriety Test, and he stated yes. Operator of MV1 did not show any signs of intoxication. Operator of MV2 stated that he had parked his car outside of 109 Adam Street and was sitting in the driver seat when he was hit by MV1 and also the utility pole. Operator of MV2 was able to exit his car. He was evaluated by the medics and signed a refusal. MV2 has significant damage to the right side and windshield. MV3 was parked in the lot of 109 Adam Street facing Southbound. MV1 hit MV3 head on. There was significant damage to MV3 front end. The electric meter attached to 109 Adam Street was ripped off the house. There are no signs of damage to the house to report at this time. MV1 was towed by Tody's. Eversource arrived on scene. Operator of MV1 was issued a citation for marked lanes violation. En route to the location with Ofc Gourdeau, it was determined by first arriving Ofc Gourdeau that a vehicle had crashed through a fence at the end of Troy Lane and came to rest in the backyard of 126 Evelyn Rd. On arrival, I located the vehicle operator, identified as Mr Stuart Phillips who was operating MA Reg 8VVP40, an '03 Jaguar S Type model. Mr Phillips was walking around the backyard after the collision and appeared coherent as to what had transpired. He sustained a laceration to the top of his head and was bleeding heavily. We sat him down in a lawn chair prior to medics arrival to evaluate. When asked what happened, he stated he ""hit the gas instead of the brakes"". I asked him where did the accident begin? He stated he was turning around at the end of Troy Lane (a dead end cul de sac) and crashed through the fence there. Mr Phillips was alert and speaking clearly. I asked him if he was on any medication? He stated he was taking Plavix only, a blood thinner. I asked about his medical history and he stated he was released from Spalding Rehab today for treatment from a stroke and was receiving occupational therapy. Medics arrived to evaluate and he was transported to NWH for treatment. An investigation of the crash path of the vehicle revealed the following based on tire tracks and damage left behind: The vehicle crashed through the fence at the end of the cul de sac belonging to 41A Helene Rd; Vehicle drove over that back lawn, clipped the back deck attached to the rear of the house; damaging the base of the deck and lattice below; Vehicle travelled over the patio, then crashed through shrubbery down an embankment leading to the backyard of 132 Evelyn Rd; Vehicle drove through backyard of 132 Evelyn, then continued along the side of the house where it drove over damaging three retaining walls and clipped a large tree; After driving over the third retaining wall, vehicle continued through the backyard of 126 Evelyn, causing significant lawn damage; Vehicle continued until it hit the back of the house at 126 Evelyn; there, it drove over the rear patio before it struck a ground level basement window and window well; It came to a rest there where the vehicle caught on fire under the hood. Witnesses helped extinguish the fire with a garden house (see incident report #19020129) until NFD arrived to knock it down. Significant front lawn damage to 126 Evelyn occurred as well as NFD was arriving on scene to what was first reported as a structure fire. Several photos of the area were taken by myself. The memory chip was TOT the I.T. bureau to be attached to this report. Tody's towing towed the vehicle out of the backyard by accessing the rear driveway of 132 Evelyn Rd. Mr Phillips cited for Negligent Operation and an Immediate Threat for License Suspension/Revocation faxed to the RMV. I was able to obtain a statement from operator #1 while medics and fire were en route. Operator #1 told me that she was driving eastbound on Watertown St when vehicle #2 (MA reg 1BSN69) pulled out to take a left from the Shell Gas Station at 979 Watertown St. Operator #1 had to swerve to the right in order to avoid a collision with vehicle #2. This caused vehicle #1 to crash into the exterior brick wall of 966 Watertown St. There was airbag deployment and visible structural damage to the business, however it did not appear severe. The operator of vehicle #2 was still on scene and confirmed the events that operator #1 spoke of. Operator #2 stated she did not see vehicle #1 as she was pulling out due to heavy traffic flow and parked cars. Vehicle #2 did not make contact with any other car or structure. Vehicle #1 sustained heavy front end damage and was towed by Tody's. Operator #1 was checked out by the medics but declined transport. The owner of the business affected was notified and responded to the scene. He was provided this report number for insurance purposes. No emergency accomodations or notifications needed be made in regards to the damage. It should be noted that a witness remained on scene and verified what operator #1 said transpired. Upon my arrival the Fire Department was already there and I was met by the owner of the building Bruno DiFazio. The vehicle that had struck the building had left the scene but he showed me security footage of the crash. The video showed a white S.U.V. (later determined to be Mass. Reg# 6GEL40 White 2017 Acura RDX owned and operated by Eleonora Revzin) pull slowly into a parking spot and then accelerate up and over the curb and into the building. The crash caused moderate damage to the brick facade and inside wall of the tile store. A short time later, Revzin drove back into the parking lot where I spoke with her. Revzin stated she didn't know why her car had accelerated into the building but she was having some personal issues and may have been distracted. She explained that she left the area because she was shaken up but then as she had time to clear her head, thought she should return to the store. There was minor damage to her vehicle and she stated she was not hurt and didn't want me to call the Medics for an evaluation. I issued Revzin Mass. Citation #T2013436 in hand for N.C.O. 19/75- Failure to use care in stopping and a verbal warning for leaving the scene. Fire arrived on scene and was able to slow the leak of the gas and I was able to speak with the reporting party identified as SANFORD Troy. Troy states that he is an employee at 188 Florence Street and got to work a little early this morning. He states that he stayed in his car awaiting the start of his shift and must have fallen asleep with his foot on the brakle and the transmission still in reverse. When he fell asleep he states his foot must have come off the brake causing him to back into the gas meter of 160 Boylston Street. The impact not only damaged the gas meter, but also did damage to the rear center of Troy's vehicle. Through my observations of Troy's demeanor and actions he did not appear to be impaired in any way. Troy stated that he did not get much sleep last night and was tired. Multiple witnesses stated that the vehicle was traveling WB and when it came around the bend in the road the operator lost control and spun clockwise into the pole. The vehicle ultimately rested facing the direction it came from, eastbound. NFD responded and was able to free the remaining two passengers from the vehicle. All passengers were transported to Beth Israel Boston for treatment. While on scene, I spoke with the passenger from the front seat who stated they were traveling westbound towards Needham and the operator just lost control around the bend due to the wet surface. There were no other vehicles involved in the accident, Tody's responded to tow the vehicle. Verizon was notified of their utility pole being damaged. I responded to the hospital to follow up with the occupants but was only allowed to speak with the passengers and not the operator as he was in critical condition with a broken femur and head injuries. Ingrid states she drove to the site to take pictures of the workers whom she believed to be working in violation of Newton's city noise ordinance. She pulled over to the side of the road to take a picture with her cell phone, but didnt realize her foot came off the brake pedal causing her to strike the dumpster. Fire and Medics also responded to the crash and ingrid signed a patient refusal after being evaluated by the medics Tody's responded and towed the vehicle. At the Hospital I spoke with the Operator of Vehicle #1. Operator states that she was driving home from a friends house and didn't remember any of the details of the crash. From my investigation, as well as the statement from the witness, it appears Vehicle #1 under steered while trying to make a left turn. The vehicle struck the curb, left the roadway and rolled onto its side. The driver was issued a citation for a Marked Lanes violation. On arrival I observed MA 6CM450 in the backyard of #40 unit C. It was stationary against the large AC Compressor in the rear of the unit, and appeared to had run over several large shrubs before coming to a stop. I spoke with vehicle owner and operator Marion Cohen 8/27/46. Cohen stated that as she was parking in the rear lot of the complex, she accidentally mistook the brake for the gas pedal. She in turn ended up going over the curb and through some bushes before hitting the compressor. There was a passenger in the vehicle identified as Milton Kornfeld 3/10/42. Both occupants were checked out by medics and declined transport. The airbags did not deploy. There does not appear to be any structural damage to anything other than the compressor. NFD checked the integrity of the house, and the compressor was unplugged. I took pictures of the scene and submitted the memory card to IT. Homeowner Xiaozhi Zhao and his family were present inside at the time of the collision and are unharmed. Tody's responded and removed the vehicle from the property. It sustained heavy front end damage and was towed to their lot via flatbed. A m/v inventory form was filled out. The weather at the time of the crash was clear and sunny. The road surface was dry. Beacon Street is a public way maintained by the City of Newton. I spoke with the operator of the vehicle involved in the crash, Dina Hudson (S33833807). Ms. Hudson stated she was sitting in her 2015 white Jeep Grand Cherokee (MA: 727SZ7) that was parked (E) in a metered parking spot in front of 780 Beacon Street. Ms. Hudson stated traffic in the Eastbound lane of Beacon Street to her left was stopped. There was a red light ahead at the intersection and traffic had built up past where her vehicle was parked. Ms. Hudson stated she opened her driver side door while she was looking for her debit card to go to the bank. Ms. Hudson stated at this time a bicyclist was traveling at a high rate of speed around the stopped traffic towards the intersection and crashed into her driver side door. Ms. Hudson stated the operator of the bicycle then traveled further up the roadway and crashed behind a vehicle stopped in traffic. Ms. Hudson stated she was unsure if the bicyclist crashed into the stopped vehicle or if it had landed on the roadway just before it. Ms. Hudson stated the bicyclist then got up from the roadway and began yelling at her that the crash was her fault. I observed a few small fresh scrapes on the outside of the driver side door area. When I initially arrived at the crash location, I observed Officer Lazarakis checking on his well-being of the injured bicyclist, Marc Lind. Lind was observed laying on the sidewalk in front of 780 Beacon Street. After being evaluated by Newton Medics, I spoke with Mr. Lind. Mr. Lind stated he was traveling on his Trek bicycle Eastbound on Beacon Street towards Langley Road. Mr. Lind stated while traveling through the area at this time, traffic in the Eastbound Lane was stopped and there was a red light ahead of him at the intersection. Mr. Lind estimated his speed at this time to be 10-12 miles per hour. Mr. Lind stated as he travelled past the Santander Bank at 780 Beacon Street, the operator of a parked white Jeep to his right abruptly opened their door into traffic. Mr. Lind stated he attempted to avoid the vehicles door and veered to the left. Mr. Lind stated the right end of his handlebar made contact with the door and as he traveled forward and applied his brakes his right side crashed into the rear of a vehicle stopped in traffic ahead of him. Mr. Lind stated he crashed to the roadway on his right side. Mr. Lind was able to move to the side of the roadway and wait for Newton PD, Fire, and Medics to respond. Mr. Lind reported injuries to his right arm, side, and leg area. Mr. Lind signed a patient refusal with Newton Medics and was transported away from the area by his wife with his bicycle. I observed no substantial damage to his Trek bicycle. At the time of the crash, Mr. Lind was wearing a white t-shirt, black shorts, black, shoes, and a gray helmet with sunglasses. I spoke with a witness to the crash, Steve Worthington. Mr. Worthington stated he was stopped in traffic on Beacon Street about 4 vehicles back from the red light. Mr. Worthington stated he looked out of his passenger door mirror and observed a bicyclist ""whipping"" down Beacon Street in between vehicles parked on the side of the road and vehicles stopped in traffic at the red light. Mr. Worthington estimated the speed of the bicycle to be approximately 20 miles per hour. Mr. Worthington stated the bicyclist had to ""lean"" by his vehicle to get by. Mr. Worthington stated a vehicle just ahead of him that was parked opened their door and the bicyclist made contact with the door. Mr. Worthington stated the bicyclist then went down in front of the car that was in front of him. Rosa was transported by Newton Medics to NWH and her car was towed by Todys. I then spoke with Ashurov the operator of Veh 2. Ashurov stated he was sitting stopped in traffic when the car in front of him ""Veh 1"" began to reverse and struck him at aprox 1 to 2 miles an hour. Ashurov stated he got out to see if the woman was alright and she stated that he had hit her and an argument insued. There was no damage observed on either vehicle. There were no witnesses and no cameras in the area. The weather at the time was 60 degrees ( localconditions.com) and the sky was clear and sunny. The road surface was dry. The parking lot is a thru way that the public use to enter/exit the lot or park there. On arrival at the same time with the Fire and Medics, I observed a female laying in the middle of the lot facing down on her back. A small red and gray CVS like type shopping carriage was knocked over and resting on it's side in front of the victim's head. The carriage was moved to the side in order to tend to the victim I also observed a black Honda Civic bearing MA reg.# 3741TW that was involved in the accident. The Honda was out of the parking spot resting approximately two feet away from the pedestrian's legs. I then spoke to the pedestrian identified as Darla Gipson in the rear of the ambulance. She sustained an abrasion to her front left shoulder and arm area which I observed. She also complained of left knee and elbow pain. She stated that she walking through the middle of the parking lot pushing the carriage by the door entrance in a westerly direction towards Chestnut Street. She states that she never saw a vehicle backing up and then she was suddenly struck and believes she was pushed underneath the vehicle. She was then transported to Newton Wellesley Hospital by Cataldo Ambulance. I then spoke to the operator of the Honda Civic identified as Linda Burke (MA S70320414). Ms. Burke was parked in the first spot to the right of the walkway that leads to the entrance/exit doorway. I asked her what occurred and she stated that she was backing her vehicle up to exit the parking lot when she looked behind her not seeing anything in sight. She then started backing up and struck the pedestrian without realizing it. She says the driver of a green cab and his female customer who were no longer on scene were yelling at her to stop her vehicle because the pedestrian was underneath it. She then stopped her vehicle. I observed minor scrapes to the entire rear bumper of the vehicle so it is unknown where it actually struck the pedestrian/carriage. I observed no obvious signs of damage to the carriage. It should be noted that Ms. Burke's Honda does not have a back up camera or back up sensors. There are no surveillance cameras to the apartment complex and no witnesses came forward for the accident. As a result of the investigation, Ms. Burke will be issued Uniform Citation # T1271069 for Newton City Ordinance 19-75 Failure To Use Care in Backing. The accident is reported to have occurred on Thursday September 17th 2020 at 10:00am. At the time of the accident the weather was partly cloudy and the road surface was dry. Captain Roche stated he was working at the station that day when a Cataldo Ambulance truck MA AMR:AMB41 slowly backed up and struck the top of the ladder on the Ladder Truck#1 MA MVN: MF463. Ladder #1 was parked and unoccupied at the time in front of the Fire Station. At the time no damage was reported on either apparatus. Today damage was noticed on the top part of the ladder. Pictures were taken of a crack and some damage to the ladder. I spoke with the operator of the ambulance identified as EMT James Perry (S14785886 ) who stated on Thursday at around 10:00am he was delivering spare parts to another ambulance and was slowly backing up in front of the Fire Station. James stated he was going about 2MPH when he bumped into the front of Ladder #1. James stated there was no damage reported to either apparatus at the time. This minor accident occurred on City of Newton Property in the driveway of Fire Station #2. No injuries were reported.
