Beacon Street is a public way maintained by the City of Newton. I spoke with the operator of MV1 while Newton Fire and Medics attended to the injured bicyclist. Andrei Jordao (S09978620) stated he was parked in his 2019 Hyundai Kona (NY: JFP5331) at a metered parking spot in front of 847 Beacon Street, Newton. Jordao stated he opened his driver door to exit his vehicle when a passing bicyclist crashed into the door. Jordao stated he did not look back at traffic prior to opening the door. Jordao stated the bicyclist fell to the roadway. I observed moderate damage to the driver side door and it was unable to close as a result of the collision. I spoke with the injured bicyclist, Leonard Engel (S53573803). Engel stated he was operating his bicycle Westbound on Beacon Street in the travel lane. Engel stated a vehicle to his right opened it's driver door into the roadway and he was unable to avoid hitting it. Engel stated he fell over the top of his handlebars and onto the roadway. Engel stated he injured his right shoulder/arm/neck area and his right ankle. Engel also had a small injury to his left knee. Engel stated he does not believe he hit his head as a result of the accident. Engel was wearing a helmet, I observed some scratch marks on it. Engel signed a patient refusal with Newton Medics. I observed damage to the rear tire area of Engel's black and green Giant bicycle. There was also damage to chain/pedal area. Engel's estimated the value of the bicycle at $4,000.00 USD. Massachusetts Uniform Citation T1271041 was mailed to Jordao for Chapter 90, Section 14 (Open car door into traffic). Tody's responded the removed MV1 from the roadway. MV2 sustained damage to its right rear bumper/quarter panel area. Upon speaking with the operator of MV1, an employee of Tony's Auto Services, he stated that he was test riding the vehicle after they made repairs to its power steering system. He stated that as he traveled eastbound on Watertown St. at approx 30MPH, the vehicle's brakes failed and he guided MV1 towards the tree in an attempt to stop it without injuring anyone. Todys Services took custody of MV1. Newton Fire cleaned up the leaking fluids and the operator of MV1 signed a patient refusal with Newton Medics. Newton Dispatch notified the city to see if they wished to inspect the tree which was still freestanding and appeared to only suffer minor damage. Tony's Auto Services notified the owner of MV1 and I notified the owner of MV2 of the crash. I submitted a picture of the tree to IT to be attached to this report. Operator of MV1 swerved to the right to avoid a collision and as a result crashed into the stop sign on John St. and the side of 335 Boylston St. Witness 1, who was parked at 325 Boylston St. saw the incident and corroborated MV1's story. The vehicle then rolled onto the passenger side. In order to extract both occupants of the vehicle, Newton Firefighters used the Jaws of Life to remove the roof of the vehicle. Firefighters also had to remove several sections of a chain link fence belonging to the property owner of 19 Kappius Path. Newton Medics obtained patient refusals from both occupants. No injuries were reported. The vehicle was towed from the scene by Todys and an inventory sheet was completed by Officer Emmanuel. Five photographs of the scene were submitted to the IT Bureau. Upon arrival with Cataldo Medics and Newton Fire, I observed Catherine Chapman being treated in the westbound lane a few feet in front of a 2010 Hyundai Elantra (MA Reg. 4KH 743). The vehicle had a shattered windshield. Ms. Chapman appeared to be wearing a dark colored jacket and dark pants. The operator of the motor vehicle, Emily Shuman, stated she was traveling westbound in the outside lane when Ms. Chapman stepped in front of her car from the eastbound lane. I also spoke with a witness, Malcolm Robinson, who stated Ms. Chapman was crossing the street from the eastbound lanes with two other people. The other two people stopped in the middle of the street but Ms. Chapman kept walking and was struck. The other two people were Victor Polk and Halimah Polk, both of which confirmed the witness statement. Ms. Chapman was transported by Cataldo to Brigham & Womens Hospital with non-life threatening injuries. Gedansky stated that the front passenger side of vehicle one struck the front driver's side of vehicle two. Vehicle one had no damage and Gedansky was not injured. Vehicle two had damage to it's driver's side mirror and driver's side front bumper. I took photos of vehicle two and forwarded the disk to the NPD's IT bureau. Upon arrival the victim, Elizabeth Cantwell was laying in the street and receiving treatment from NFD and Cataldo. The operator of Ma Reg. 192HV0 was Margaret Meehan. Meehan was visibly upset and was hearing impaired, as a result Meehan was unable to communicate what happened in the accident. At this time we were able to contact Meehans daughter, Bernadette Conley 781-248-6222. Cantwell was transported to Beth Israel Hospital. Traffic Bureau was notified. I went to the BI hospital to get a statement from Cantwell. Cantwell states that her husband parked their vehicle across the street from Starbucks. Cantwell states that she stood next to her car to cross the street. Vehicle 1 came to a stop and Cantwell believed that the vehicle was going to let her cross the street (not in crosswalk). Cantwell states that when she went to cross the street vehicle 1 hit her, causing her to land on the hood and then rolled off onto the street. At this time Cantwell has a dislocated hip and head injury. I took photos of the scene. Meehans vehicle was parked in a legal spot and I transported her to NHQ where she was picked up by her daughter Bernadette Conley.
