The operator of veh #2 stated the operator of veh #1 was walking around and yelling about the accident for a period of time and then eventually grabbed his chest and fell to the ground complaining of pain. From the result of my investigation it appears as if veh # 1 attempted to turn from the wrong lane and veh # 2 was passing in the ""suicide lane"", also wrong lane. The fire department was attempting to wake the operator who was unresponsive. The fire department ended up administering 2 doses of Narcan to the operator before he became responsive. The operator was transported to Newton Wellesley Hospital by Cataldo for further evaluation. Based on the accident scene, it appears the operator was traveling southbound on Cherry street, crossed over the center line into oncoming traffic, striking the fire hydrant in front of 154 Cherry street, and then crossed back over into the correct lane of traffic before coming to rest in front of 171 Cherry street. The vehicle was towed by Tody's towing, and an inventory form was filled out and filed. The operator was mailed MA Uniform Citations T0648078 and T0648079 charging him with MGL 89/4A Marked Lanes violation, 90/24 OUI Drugs, 90/24(2)(A) Operating to Endanger/Negligent operation, 90/11 No License in Possession, and 90/11 No Registration in Possession. The witness stated they were traveling westbound on Watertown street behind MV1, when it suddenly left the roadway to the right, striking the curb, before returning to the roadway and stopping. The witness stated that MV1 nearly missed a fire hydrant and a utility pole on the sidewalk. MV1 had a flat front passenger side tire, and minor scrapes on the body. I spoke with the medics who were still treating the operator for her diabetic issue. I observed the operator was in and out of consciousness, and unable to speak about the accident. It took several minutes for the operator to regain her consciousness, however she was still not able to answer simple questions coherently and was transported to Newton Wellesley hospital for further evaluation. The area the crash occured was a high pedestrian traffic area, and both an elementary and middle school are within walking distance of the accident. Upon arrival I found that Newton Police Motorcycle #1 was involved in a crash while helping to assist a funeral that had just left the Our Lady Church property. Police MC #1 is MA MMC7219, a 2016 Harley Davidson motorcycle. The motorcycle was operated by Officer Rocco Marini. MV #2 was also located on scene and parked in the Whole Food parking lot. This vehicle is MA Reg. 7VN155 a 2017 Lexus ES350. This vehicle was operated by Diana Simkin. Officer Marini reported that he was traveling westbound on Washington Street when he was hit by MV #2 that was making a left (opposite direction) into the Whole Foods parking lot. Officer Marini was in the right hand lane escorting the long line of cars that was part of a funeral procession. These vehicles were in left westbound lane. Officer Marini reported he was in the right hand lane and had his emergency lights on when the collision occurred. Officer Marini did not see MV #2 prior to collision. Officer Marini reported that the front of his motorcycle hit the rear passenger side tire of MV #2. Officer Marini was taken from the scene by Ambulance to Newton Wellesley Hospital. I spoke to the operator of MV #2 Diana Simkin. Simkin reported she was traveling east on Washington Street and wanted to make a left into Whole Foods parking lot when the crash occurred. Simkin reported she was waved into the lot by an unknown motor vehicle headed in the opposite direction. Simkin was not sure which lane this person waved from. Simkin made the left into the lot and was not aware of the crash or did she see MC 1 until she was stuck in traffic in the parking lot and some woman knocked on her window. Simkin reported that she never saw an police emergency flashing lights either. There was minimal damage to Simkin's vehicle. There was scuff marks on the passenger rear tire. Simkin also did not report any injuries. MC #1 sustained some front damage to the wheel fender fairing. The motorcycle was taken from the scene by Tody's. Pictures were taken on scene by Officer McSweeney and given to IT for downloading purposes. While on scene Officer McSweeney and myself went to New England Diamond and Jewelry at 660 Washington Street. We met the owners Dave and Robert Alpert (617-243-0099) who reported that they have video of the collision. In the video I observed at 1346hrs the funeral begin to pass the Whole Foods entrance. At 1348hrs the video shows MV #2 come up in the easttbound lane and stop. The vehicle stops and waits until an unknown white SUV stops to allow MV #2 to make a left turn into the lot. Once this unknown SUV stops, the video shows that MV #2 makes the left and hits MC #1 as he is traveling straight ahead with his emergency lights on. It appears from the video that MC #1 had no warning and could not brake his motorcycle. The video shows a long line of cars in this funeral procession with their emergency flashing lights on. Due to the angle of the video and vehicles I am unable to tell if this SUV had their flashing lights on. The video was sent to Director Smith in IT for downloading purposes. I went to Newton Wellesley Hospital and spoke with Officer Marini. He was reporting soreness to his left elbow. Officer Marini was released from the Hospital and taken back to the station at about 1500hrs. Based on the facts of the investigation, I have issued MA Uniform Citation T0340444 to Diana Simkin for violating 89/8: failure to yield the right of way and for violating 89/7A: interference with an emergency vehicle. Simkin was notified of this citation via telephone at 1730hrs on this day and this citation was mailed to her address. Multiple witnesses stated that the vehicle was traveling WB and when it came around the bend in the road the operator lost control and spun clockwise into the pole. The vehicle ultimately rested facing the direction it came from, eastbound. NFD responded and was able to free the remaining two passengers from the vehicle. All passengers were transported to Beth Israel Boston for treatment. While on scene, I spoke with the passenger from the front seat who stated they were traveling westbound towards Needham and the operator just lost control around the bend due to the wet surface. There were no other vehicles involved in the accident, Tody's responded to tow the vehicle. Verizon was notified of their utility pole being damaged. Pictures were taken of the scene and turned over to IT to be uploaded to this report. I responded to the hospital to follow up with the occupants but was only allowed to speak with the passengers and not the operator as he was in critical condition with a broken femur and head injuries. The rear passenger stated that he didn't think his son, the operator, was going that fast but he lost control around the bend, he was suffering from neck pain and is in fair condition. Stomberg did not show any signs of being impaired by alcohol. An inventory of Stomberg's vehicle showed no discovery of any alcohol. There appeared to be several involved vehicles to this crash however two of them had been parked prior to the crash. The vehicle which the two unidentified males were standing by was MA reg. 9HY939, a 1988 Black Ford F150 PU, listed registered owner was a Peter J. Jara-Castro, #28 Ridge Ave, Lynn Ma. Mr Castro was one of the two males standing by that truck. The above vehicle appeared to have been travelling N/B on Centre St when it skidded off the road, jumping the curb striking a 1 foot slate retaining wall to the property to #573 Centre St. It continued onto that property driving over shrubs, small trees, then onto the driveway(same address) which is actually on Newtonville Ave, hitting the homeowners 2007 Nissan Versa, Ma reg. 6BH269, forcing it into more shrubbery. The Truck continued across Newtonville Ave where it struck another parked vehicle, a Grey 2019 Volkswagon, Ma reg. 1NFC27 on the rear passenger side pushing it forward. The truck finally came to a stop after driving into a wooden fence to the property of #559 Centre St.(Fence is on Newtonville Ave.) I spoke with the owner of the truck after he was evaluated by the Medics, who spoke limited English. The owner of the truck Peter Jara-Castro finally said he was driving the truck prior to the crash. His statement was he was travelling N/B down Centre St when another vehicle came out from Newtonville Ave causing him to slam on his brakes. Mr Castro doesn't remember much after that, possibly from hitting his head. At this time I couldn't determine who the actual driver was. Both Mr Castro and the passenger, sustained injuries but both declined to go to the hospital. Both were later picked up by an UBER driver. A Firefighter heading to work reported seeing the truck pass him on Centre St N/B at high rate of speed but never saw the driver or the actual crash. Both property owners that sustained damage were given Trucks insurance info. Pictures were taken by both property owners. Vehicle #1 and vehicle #2 were towed from scene. Both sustained heavy damage. Vehicle #3 sustained minor damage I was unable to make contact with that owner at this time. However later in the day I was able to make contact with owner of vehicle #3. She was given all vehicle #1 information along with his insurance. A citation for speeding was later issued after investigation was completed and witness statement.
