On arrival, I located the vehicle operator, identified as Mr Stuart Phillips who was operating MA Reg 8VVP40, an '03 Jaguar S Type model. Mr Phillips was walking around the backyard after the collision and appeared coherent as to what had transpired. He sustained a laceration to the top of his head and was bleeding heavily. We sat him down in a lawn chair prior to medics arrival to evaluate. When asked what happened, he stated he ""hit the gas instead of the brakes"". I asked him where did the accident begin? He stated he was turning around at the end of Troy Lane (a dead end cul de sac) and crashed through the fence there. Mr Phillips was alert and speaking clearly. I asked him if he was on any medication? He stated he was taking Plavix only, a blood thinner. I asked about his medical history and he stated he was released from Spalding Rehab today for treatment from a stroke and was receiving occupational therapy. Medics arrived to evaluate and he was transported to NWH for treatment. An investigation of the crash path of the vehicle revealed the following based on tire tracks and damage left behind: The vehicle crashed through the fence at the end of the cul de sac belonging to 41A Helene Rd; Vehicle drove over that back lawn, clipped the back deck attached to the rear of the house; damaging the base of the deck and lattice below; Vehicle travelled over the patio, then crashed through shrubbery down an embankment leading to the backyard of 132 Evelyn Rd; Vehicle drove through backyard of 132 Evelyn, then continued along the side of the house where it drove over damaging three retaining walls and clipped a large tree; After driving over the third retaining wall, vehicle continued through the backyard of 126 Evelyn, causing significant lawn damage; Vehicle continued until it hit the back of the house at 126 Evelyn; there, it drove over the rear patio before it struck a ground level basement window and window well; It came to a rest there where the vehicle caught on fire under the hood. Witnesses helped extinguish the fire with a garden house (see incident report #19020129) until NFD arrived to knock it down. Significant front lawn damage to 126 Evelyn occurred as well as NFD was arriving on scene to what was first reported as a structure fire. Several photos of the area were taken by myself. The truck uprooted the tree causing two branches to fall across the roadway and the sidewalk square to be displaced. We were able to move the branches out of the roadway to allow traffic to pass. I spoke with the bicyclist involved in the crash, Steven Greenzang (S96615185). Greenzang stated he was traveling Westbound on Beacon Street in the shoulder lane on his black Specialized bicycle. Greenzang had a yellow reflective vest on and was wearing a helmet at this time. Greenzang stated a vehicle in the travel lane to his left drove by him and hit the mirror located on his left handlebar. I observed damage to the mirror. Greenzang report no injuries. I spoke with the operator of MV1, Sarah Bonfanti (S66811372). Bonfanti stated she was parked in front of 1411 Beacon Street waiting to pick up a co-worker that resides at that address. Bonfanti stated a bicycle traveling on the sidewalk to her right crashed into the passenger side door mirror of her 2008 Toyota Scion (MA: 681YH1). Bonfanti stated the bicyclist was acting ""crazy"" during her interaction with him and he was trying to take her picture. Bonfanti stated she got back into her vehicle and moved up the roadway to wait for police to arrive on scene. I canvassed the area where the accident occurred with Sgt. Dempsey. There was glass from the passenger side mirror of MV1 and Greenzang's bicycle in the main travel lane of the roadway and the shoulder lane where Greenzang stated he was traveling. We also observed a large tree and a telephone pole on the sidewalk next to the roadway where the accident is alleged to have occurred. After speaking with all parties involved, observing the location of the glass in the roadway from the crash, and the location of the tree and telephone pole on the sidewalk where he accident occurred; Greenzang would not have been able to operate his bicycle on the sidewalk and be close enough to the roadway to make contact with MV1. Prior to clearing the accident, I asked Bonfanti if she had any questions and if she wanted to report any injuries. Bonfanti stated she was hit by the bicyclist during her exchange with him and began grabbing her left leg. I asked Bonfanti why she did not inform the officers on scene that she was assaulted. Bonfanti stated she said something to our Dispatch when she called. I asked Bonfanti if her leg was injured. Bonfanti stated I was putting words in her mouth and that she was just scratching her leg. Due to the scene, and the location of the cars in a busy street, I was not able to do a MV inventory of MV#1 until after it was towed by Todys. The inventory was done at Todys Service station, and a MV inventory sheet was filled out and placed the in appropriate box. I took three pictures of the damaged tree and submitted them to IT to be attached to this report. While I was taking the pictures of the tree, two males were walking past the scene. I stopped both parties and questioned them about the incident. They stated that they had been in the car, but had not been driving. I asked them if the knew who the driver was, and they told me that they did not know the name of the driver. Due to no witnesses observing the driver and all parties stating that it was someone else, I was not able to determine a driver of the vehicle. I contacted the vehicle owner Edward G. Murray Jr. He confirmed that he had knowledge of the crash. His son Edward G Murray III was the operator at the time of the crash. Murray III had a female passenger Diana Moreno 07/12/2004. I spoke with both Murray Jr. and Murray III via telephone. Murray III stated he was driving following his GPS and suddenly an animal which he believed to be a small dog suddenly ran in front of the car. Murray III swerved to avoid hitting the animal and drove off the road and collided into the tree. He stated the crash was at approx. 0950 on 09/19/2020. I also spoke with Diana Moreno (passenger), via telephone. She could not tell me what preceded the crash as she was looking at her cell phone just prior to the crash. Murray III and Moreno confirmed they were not injured as a result of the crash. Murray III contacted his father and informed him of the crash. Neither party contacted police. Stomberg stated he was driving south on Parker St toward the VA Hospital for his work shift. Stomberg stated he was tired and did not feel alert. Stomberg also stated there was a heavy fog that made the road difficult to see. Stomberg's vehicle veered off the side of the road and collided with the pole causing heavy front end damage. Stomberg did not show any signs of being impaired by alcohol. An inventory of Stomberg's vehicle showed no discovery of any alcohol. It should be noted that on my way to the accident scene, I observed a very heavy fog on Parker St that made it difficult to see the road in front of me. She took a right turn onto Vine Street from LaGrange Street and began travelling westbound. FOSTER stated that she was travelling too fast and didnt realize how the road curved causing her to veer off the road and strike a large tree in the front of 130 Vine Street. FOSTER was travelling at a speed fast enough to cause the vehicle to flip onto its roof in the opposite lane of traffic. FOSTER admitted to me she was travelling too fast on the road. Vine street is a winding road that is not very well lit. Speed limit on the road is 20mph and its estimated FOSTER was travelling at least 30-45mph. The speed coupled with FOSTER's lack of familiarity with the area and her inexperience driving were all contributing factors to the crash. FOSTER was issued Massachusetts Uniform Citation T2012909 with the following civil motor vehicle infractions; C90 s18 SPEEDING (Posted) C89 s4a Marked Lanes Violation. FOSTER was transported to Beth Israel hospital by the medics and I was unable to issue the citation in hand at the time of the crash. Upon my arrival at the crash scene with Sgt Devine I was briefed by Officers Daly and Anderson, ( see Ofc Daly's report for further information CAD # 20054728 in regard to changes take out against the operator of the truck ) I made the following observations of the crash scene, Nahanton St is a public way in the City of Newton that is a two way roadway divided by an unprotected merdium ( double yellow line ) that runs east to west. The roadway surface was wet due snow and ice. The roadway was plowed and the snow was pushed to the shoulder, althought wet the roadway was icy. There was approximately 2 inches of snow on the shoulders of the roadway. The road was light with overhead head street lights. The posted speed limit is 25 MPH. I observed a 2013 Chevrolet Silverado pick up truck that had major front end damage. The Chevrolet was at an angle with it's front end facing west bound and resting on the grass shoulder and into a wooded area. The Chevrolet rear was sticking out into the shoulder of the east bound lane of Nahanton St. The passenger side front and rear doors of the Chevrolet had been removed by the fire department to extricate the driver and passenger. The driver and passenger side air bags were deployed . The front passenger side windshield of the Chevrolet was completely missing and the driver's side had completely shattered. The front tires, hood, and engine had been compacted on it's self. The front and rear driver's side doors had been mechanically open by the fire department. The speedometer needle had stopped at 54 MPH. The Chevrolet left the roadway and left tire marks in the snow in the eastbound bike lane of Nahanton St. At a 106.4 feet from the beginning of the tire marks the first point of impact was with two tree stumps that were 3.5 feet from the roadway, four feet tall and 3.5 feet in diameter. The tire marks continue in the east bound bike lane and exit the roadway and onto a dirt shoulder at 136.1 feet from the beginning of the tire marks. The truck continued to the right of a utility pole and then it's passenger side made contact with a tree at 170.8 feet from the begin of the tire marks. The tree was 12 feet from the bike lane approximately 5 feet in diameter. The impact with the tree caused the truck to turn so that the rear was facing north east on the dirt shoulder and bike lane. The final point of rest of the rear passenger side tire was 200 feet from the beginning of the tire marks. The truck's rear diver side tire final point of rest was 209 feet from the beginning of the tire marks. The front driver's side tire was compacted into the trucks engine and the passenger side front tire was located behind the tree approximately 20 feet from the roadway. Sgt Devine took photos of the crash area and of the truck and the disk was download by the NPD's IT Bureau. The truck was towed from the crash scene by Todys's Towing to their lot for storage, I fill out a towed motor vehicle form. There were no reported witness who observed the crash. The crash was reported by an unknown passerby. She reported traveling W/B on Watertown St when she observed the Black Suburban who had been coming E/B suddenly veer off the road and crash into a tree. Witness stopped her vehicle and exited to check on the condition of the driver. She observed the operator whom she thought to be having a medical emergency. Witness then noticed a small child in the back seat. The car doors were all locked but witness was able to get the child to unlock the doors. Witness then removed the child from the car and held him to police arrived on scene. Operator had to be coaxed out of her vehicle with the assistance of medical personnel. She described watching on the video a black sedan possibly a Buick crash into the building back up and continue on Walnut St N/B. She stated no plates, operators or passengers could be seen on the video. The vehicle was parked in the driveway with heave side damage. Brisk came to the door eating a muffin and asked me to come in. I asked Brisk what had happened and he stated he asked the workers to move the trailer and they refused and waved him by. He attempted to get by and struck the trailer. There appeared to be several involved vehicles to this crash however two of them had been parked prior to the crash. The vehicle which the two unidentified males were standing by was MA reg. 9HY939, a 1988 Black Ford F150 PU, listed registered owner was a Peter J. Jara-Castro, #28 Ridge Ave, Lynn Ma. Mr Castro was one of the two males standing by that truck. The above vehicle appeared to have been travelling N/B on Centre St when it skidded off the road, jumping the curb striking a 1 foot slate retaining wall to the property to #573 Centre St. It continued onto that property driving over shrubs, small trees, then onto the driveway(same address) which is actually on Newtonville Ave, hitting the homeowners 2007 Nissan Versa, Ma reg. 6BH269, forcing it into more shrubbery. The Truck continued across Newtonville Ave where it struck another parked vehicle, a Grey 2019 Volkswagon, Ma reg. 1NFC27 on the rear passenger side pushing it forward. The truck finally came to a stop after driving into a wooden fence to the property of #559 Centre St.(Fence is on Newtonville Ave.) I spoke with the owner of the truck after he was evaluated by the Medics, who spoke limited English. The owner of the truck Peter Jara-Castro finally said he was driving the truck prior to the crash. His statement was he was travelling N/B down Centre St when another vehicle came out from Newtonville Ave causing him to slam on his brakes. Mr Castro doesn't remember much after that, possibly from hitting his head. At this time I couldn't determine who the actual driver was. Both Mr Castro and the passenger, sustained injuries but both declined to go to the hospital. Both were later picked up by an UBER driver. A Firefighter heading to work reported seeing the truck pass him on Centre St N/B at high rate of speed but never saw the driver or the actual crash. Both property owners that sustained damage were given Trucks insurance info. Pictures were taken by both property owners. Vehicle #1 and vehicle #2 were towed from scene. Both sustained heavy damage. Vehicle #3 sustained minor damage I was unable to make contact with that owner at this time. However later in the day I was able to make contact with owner of vehicle #3.
