After further observations of the downed tree and viewing additional damage to MV#1, it appears to me that the passengers side of MV#1 struck the city owned tree, knocking it down which then took down the wires. Upon arrival, I spoke with the vehicle owner, Joanne Murphy. Murphy said she had her car parked in the neighbors driveway. Murphy said there were numerous large white vans parked at the house throughout the due to work that was being done. Murphy said she went to pick up the children from school at approximately 14:45hrs and returned to the house at approximately 15:00hrs. Murphy said she noticed damage to the rear driver side bumper near the wheel well. It should be noted there is a sizeable dent with white paint marks. Murphy did not witness another vehicle strike her vehicle. Murphy and her neighbors are unaware of the name of the company who is doing the work at the house. I advised Murphy to contact the landlord to see if they can locate the name of the company who is doing the work at the house. I canvassed the area for cameras yielding negative results. There were no injuries and Murphy's vehicle is able to drive without any issues. At 19:30hrs Murphy came into the Newton Police Station to provide me with the other driver's information. Murphy said she was contacted by Rostyslav Bulat, who said he was the driver who hit her vehicle. Bulat provided Murphy with all of his information. I called Bulat and asked him what had transpired. Bulat said he was not aware that he had struck Murphy's vehicle and was notified by his boss that Murphy's vehicle was struck as Bulat backed out of the driveway. Bulat said once he found out he struck the vehicle he got Murphy's information and provided her with all of his information. I advised Bulat that he has to be careful driving and if he hits a vehicle he must stop to provide his information. Bulat was apologetic and said he would be in contact with Murphy throughout the insurance process to ensure it gets done. It should be noted that Bulat has an active license from Ukraine. Bulat has lived in Massachusetts for approximately 2 months and has been in contact with the RMV to get a Massachusetts's license. Sylvia stated that as her vehicle slowed to turn left onto Charlemont St it's front driver's side struck a pedestrian in a crosswalk. Sylvia stated that she did not see the pedestrian prior to the crash due to the area not being lit. It should be noted that the over head street light was inoperable, and the cross walk was not illuminated or reflective. The crosswalk sign that was posted before the crosswalk was not reflective. Sylvia stated that she was unaware that a crosswalk was at the crash location. Sylvia was not injured in the crash , and her vehicle had no damage to it. The pedestrian Nivicha Morpeau stated that she was in the crosswalk in front of 241 Needham St when she was stuck by the front driver's side of vehicle one. It should be noted that Morpeau was wearing dark clothing at the time of the crash. Morpeau complained of back pain, but refused medical treatment and transportation to the hospital. Morpeau singed a patient refusal form provide to her by Medics. Based upon statements made to me by Sylvia and Morpeau I issued Sylvia MA Uniform Citation T 2016746 and cited her for a violation of Newton City ordnance 19/116 failure to stop for a pedestrian in a crosswalk. No injuries were reported. On arrival, I spoke to the operator of the semi-trailer truck which is a 2006 Peterbilt Model 327 with MA APP Reg. # 3827B. The operator was identified as Robert Lawton (MA D/L # S92175566). Mr. Lawton works for Commonwealth Construction and Utilities which is owned by the Distefano Corporation in Watertown, MA. They are contracted with the City of Newton to remove debris such as concrete from the city yard. At the time, Mr. Lawton was standing on a ladder attached to the trailer overseeing it being loaded up by a city backhoe. The truck was parked and facing in a westerly direction. During the loading process, the backhoe was pulling forward towards the truck in a westerly direction. The front left side wheel of the backhoe struck the truck's driver's side rear mud flap area denting it. The mud flap is made of metal and covers the four rear tires from front to back. Both Mr. Lawton or the operator of the backhoe never realized the truck had been struck until another worker from Commonwealth Construction noticed it. The backhoe is a yellow 2014 JCB 3CX14 with MA Apportioned Reg. # M88532. The operator of the backhoe Michael Daniele (MA D/L # S43438211) works for the City of Newton Dept. of Public Works out of 74 Elliot Street. There was no damage to the backhoe.
