Upon arrival I met with the operator of the truck, Lucky Thipharacksa d.o.b. 10-8-84 of 25 Bradley Avenue Hamdon CT., who works for MKN UNITED INC. 1039 STATE STREET SUITE 203 BETTENDORF, I.A. 52722. He stated he was traveling west on Watertown Street when the top right portion of the truck had impact with a City tree. As a result of the impact, the tree took down Verizon cable wires, causing damage to the right side of the house number 279/281 Watertown Street ( gutters, masonry-brick, landscape, and possible other house damage. The resident at 267 Watertown Street was notified of the tree down near and partially against the property fence. I advised her if there is damage to contact me after tree removal and I will add information to the report. Forestry was notified to remove the tree, the owner of 279/281 Watertown Street was notified of process and report. Verizon was notified of wires. I conducted a post crash level one inspection on the truck which I placed Out Of Service due to the damage. The driver was arrangements for the tow. Below is inspection findings. Kolaczyk stated that she was looking to her left at on coming traffic on Crafts St and had began to turn right when crash occurred. Kolaczyk stated that she did not see Pishtikova before the crash. Pishitkova stated that she entered the marked crosswalk at Crafts St and Albemarle Rd after she saw that Kolaczyk vehicle had stopped. Pishtikova stated that she walked around the front of Kolaczyk's vehicle and it then turned into her at a very low speed. Pishtikova stated that the front drivers side quarter panel of Kolaczyk's vehicle struck her right side. Pishtikova stated that her right ankle was sore but refused medical treatment. Pishtikova signed a patient refusal form provided to her by Newton Medic Unit Three. I took photos of Kolaczyk's vehicle and the disk was downloaded by the NPD's IT bureau. Kolaczyk's vehicle had no damage and did not require a tow. Kolaczyk stated that she was not injured in the crash. I issued Kolaczyk MA Uniform Citation T2016945 and cited her for a violation of MGL 89/11 , failure to yield to a pedestrian in a crosswalk.
