He stated that the pedestrian, Jerome was crossing in the crosswalk traveling Westbound towards Foster St, successfully passed through the lane where vehicles were traveling Northbound on Walnut St and was then hit by the Toyota Prudish in the lane going Southbound. Jerome was already halfway through the crosswalk at this point. It was dark, but there was a streetlight directly over this crosswalk on Walnut St creating a semi-lit area for visibility. Mrs. Gittes stated that she didn't see him because he was wearing dark clothing and it was dark outside. She saw him when it was too late. There was no damage to her vehicle. Mrs. Gittes was given a monetary citation (T0646789) for 89/11 Crosswalk Violation. pictures were taken at the scene and the photo SD card was sent to IT. Traffic Bureau update (Officer Gaudet): I was asked to follow up with the injured pedestrian involved in this accident, Jerome Schectman (S77606276). Schectman stated he was attempting to cross Walnut Street east to west towards Foster Street. Schectman stated he entered the crosswalk after observing no cars traveling towards him in the Northbound lane of Walnut Street. Schectman stated he began walking across the street and stopped in the middle of Walnut Street after observing 2 vehicles traveling towards him in the Southbound lane. Schectman stated as the first vehicle went by, he stared at it as it traveled past him and down the street. Schectman stated as he looked back at the second car it was traveling right at him and he was unable to get out of the way. Schectman stated the vehicle hit him on his right side. McBride stated after she told the operator that she wasn't hurt, the operator returned to her vehicle and left the area, possibly towards Commonwealth Avenue. McBride could not provide any additional information about the operator of the vehicle involved. McBride stated she then walked to Newton North High School. McBride stated she went to her morning class but left and texted her mother to tell her she was involved in an accident. McBride stated she was shaken up by the accident, but reported no injuries. Newton Medics evaluated McBride and obtained a patient refusal. McBride was advised that due to the reported age of operator, they may be a student at the high school. McBride was advised that if she sees the operator to obtain her information/contact NPD. I checked the area of Lowell Avenue and Highland Street for the vehicle involved/witnesses with a negative result. A portion of Newton North's athletic fields are next to this intersection. Newton North stated there are no surveillance cameras in this area. The witness stated that MV1 nearly missed a fire hydrant and a utility pole on the sidewalk. MV1 had a flat front passenger side tire, and minor scrapes on the body. I spoke with the medics who were still treating the operator for her diabetic issue. I observed the operator was in and out of consciousness, and unable to speak about the accident. It took several minutes for the operator to regain her consciousness, however she was still not able to answer simple questions coherently and was transported to Newton Wellesley hospital for further evaluation. The injured pedestrian, Officer Steven Emmanuel, was transported to Newton Wellesley Hospital prior to my arrival on scene. I spoke with the operator of MV1, Officer Justin Lau. Lau stated he was on duty in his official capacity as a Newton Police Officer while operating a City of Newton owned 2018 Ford Fusion (MA: 9PYM80, Newton PD #1319). Lau stated he was parked on Plymouth Road (N) at Cochituate Road and was speaking with Officer Steven Emmanuel. Lau stated Emmanuel was standing next to the front driver side door area of his vehicle in the roadway. Lau stated a large delivery trucked approached their location on Plymouth Road from Woodward Street and was attempting to make a right turn onto Cochituate Road. Lau stated Emmanuel directed him to back his vehicle up so the delivery truck could get by their location. Lau stated he cut the wheel of the vehicle he was operating to the right; and very slowly began to back up from his location. Lau stated he was attempting to back the vehicle up to get closer to the curbing and out of the roadway. Lau stated as the vehicle was in motion the front driver side wheel made contact with Emmanuel's left foot. Emmanuel's left foot subsequently became lodged in the front driver side wheel well area. Emmanuel fell to the ground in obvious pain. Emmanuel directed Lau to pull the vehicle forward in an effort to release his foot. Emmanuel's foot was freed and NPD Dispatch was notified of the accident. Pictures were taken of MV1 and submitted to the IT Bureau. I observed no damage to the front driver tire area. I spoke with Officer Steve Emmanuel in the Newton Wellesley Hospital emergency room where he was being evaluated for a left foot injury. Emmanuel stated at the time of the accident he was working a paid detail for Paramount Pictures on Plymouth Road in his official capacity as a Newton Police Officer. Emmanuel stated he was speaking with Officer Lau on Plymouth Road at Cochituate Road. Emmanuel was standing in the street on his post and Lau was sitting in MV1 (parked). Emmanuel stated a Fed Ex delivery truck approached their location in the roadway and was attempting to get by them. Emmanuel stated Lau began to back his vehicle up in an effort to get out of the way of the delivery truck. Emmanuel stated the front driver side tire of MV1 ran over his left foot. After the tire ran over his foot, it then became lodged in the wheel well and he fell to the ground. She stated that she didn't see Vehicle #1 approaching until it was too late to get out of the way. It should be noted that Ms. Nguyen was not attempting to cross inside of a crosswalk, and was wearing dark colored/Navy Blue clothing. There was a golden doodle dog in the back seat of the MV at the time of the accident, unrestrained. There were no obstructions hanging from the mirror or windshield area. The front drivers visor was down. There was no airbag deployment. I observed significat damage to the front passenger side windshield area. The MV was towed by Tody's due to its shattered windshield. No citation will be issued to Loper-Sengupta. The solar glare caused her to not able to see the pedestrian. At the time, the road surface was dry and the weather was cloudy. Traffic was particulary heavy as there were several streets in the area still blocked off for the Walk for Hunger and there were participants still walking the route in the area. My attention was drawn to the intersection of Centre Street and Bowen Street as there was a motor vehicle travelling southbound on Centre Street with their left turn signal on attempting to take a left turn on to Gibbs Street. Gibbs Street was temporarily blocked to non-residential motorists as there were several pedestrians in the road crossing over Gibbs Street. As the motor vehicle attempted to turn, there were several pedestrians in the crosswalk crossing over Gibbs Street. The vehicle had stopped halfway into the northbound lane on Centre Street blocking on coming traffic. The operator appeared to realize Gibbs Street was blocked and attemped to turn the vehicle back into the southbound lane to continue southbound on Centre Street. As the vehicle turned back into the southbound traffic lane, the vehicles rear end collided with Officer Richard Clements, who was operating NPD motorcycle unit 533. Officer Clements was traveling southbound on Centre Street and was passing the vehicles in the southbound traffic lane which were currently all at a standstill. Officer Clements had his emergency lights activated as he was on his way to remove traffic cones from the street to open up all the traffic lanes along the event route. Officer Clements was working the City of Newton detail for the Walk for Hunger assigned to the motorcycle to assist with traffic. Officer Clements front wheel, left side of the motorcycle and left leg collided with the rear end of the motor vehicle. The impact of the crash caused him to fall off the left side of the motorcycle and land on the street face first. At this time I immediately ran from my post to Officer Clements location and radioed dispatch that a motorcycle officer was down and that I needed assistance. As I approached Officer Clements he was face down, unconcious and breathing. I was able to roll Officer Clements into the recovery position and at this time Officer Clements regained conciousness and was able to speak and stated "" What happened? What was that lady doing she turned right into me"". I advised Officer Clements that he had just been involved in an accident and to stay still and that help was on the way. The operator of the motor vehicle identified as Helen Leibner (S52717988) stopped her vehicle immediatley after the crash and got out of her vehicle to offer her assistance. I advised Helen and several other witnesses and bystanders who were now crowding around Officer Clements and I to back away from the scene and to not move any of the vehicles involved. Officer Selig arrived on scene and was able to help crowd control until further help arrived. Helen and all witnesses were advised to stand by for police to take their statements. While tending to Officer Clements he was disoriented and made several attempts to move his body to which I had to physically hold him still to prevent possible further injuries. While speaking with Officer Clements I noticed blood coming from the inside of his mouth. Officer Clements was in a noticeable amount of pain. He complained of head, back and left leg pain. Officer Clements was wearing a yellow ANSI certified Newton Police reflective jacket and a Newton Police issued motorcycle helmet. Once the paramedics and fire personnel arrived I was able to speak to the operator of the motor vehicle and several other witnesses. Helen stated she was traveling southbound on Centre Street operating her blue 2014 Audi A4 (MA REG 213BC9). Helen states she was attempting to take a left turn onto Gibbs Street and activated her left turn signal. Helen states she had stopped halfway into the northbound lane as several pedestrians were crossing Gibbs Street in the crosswalk at the time. Helen states after the pedestrians cleared she saw the traffic cones blocking the street and realized the street was closed. Helen states she turned her vehicle back into the southbound traffic lane and did not see Officer Clements or the motorcycle until impact. Helen was not injured and her motor vehicle sustained moderate rear end damage. Her motor vehicle was able to drive away from the scene. Witness Adron Gordon (S90357161) stated he was participating in the Walk for Hunger and had just crossed over Gibbs Street when the crash occured. He stated he witnessed the Officer on the motorcycle with the emergency lights on traveling southbound on Centre Street behind the motor vehicle. The motor vehicle stopped in traffic attempting to turn left onto Gibbs Street. He states then the vehicle made a slight turn back into the southbound traffic lane and the motorcycle collided with the rear end of the motor vehicle. He states the Officer then fell off the motorcycle landing in the middle of Centre Street. Witness Elizabeth McCarthy (S00242346) and Katherine Regan (S43486601) stated they both were in the same vehicle together stopped in traffic in the northbound lane of Centre Street just before the set of lights at Centre Street and Bowen Street. Both witnesses stated they do not remember if the driver of the motor vehicle had the turn signal on but they did see her attempt to turn onto Gibbs Street. They stated they also saw the motorcycle with emergency lights activated travel southbound on Centre Street approaching behind the vehicle. Witnesses state the motor vehicle then suddenly turned back into the southbound lane and the motorcycle collided with the passenger side tailight of the motor vehicle. Both witnesses state the motorcycle attemped to turn away from the vehicle to avoid the crash but was unable to do so. Witness Nina Wang (S39460985) stated she was parked on the southbound lane of Centre Street just prior to the crash scene. Nina states she was in her City of Newton DPW marked vehicle with the hazards on as she was working to assist with traffic safety for the Walk for Hunger. Nina states she witnessed the motorcycle travel southbound on Centre Street and pass the vehicles stopped in the traffic lane. Nina states the motorcycle passed the traffic using the left side and had the emergency lights activated. Nina states the motorcycle was just passing through the green light at Centre Street and Bowen Street when the motor vehicle that was stopped at the lights attempting to take a left turn onto Gibbs Street. Nina states the vehicle then abruptly jerked her car to the right and collided with the motorcycles left side. Nina states she heard a loud crash and witnessed the Officer fall off the motorcycle and land face first onto the street. The motorcycle's final resting place was on its left side approximately two feet away from where Officer Clements was located. The motorcycle sustained moderate damage to its left side, including the front wheel well and undercarriage. The motorcycle left scuff marks on the street which were measured and photographed. Several photographs of the scene and damage to both vehicles were taken and submitted to the IT Bureau. The motorcycle was towed by Todys. Centre Street and Bowen Street are both public ways maintained by the City of Newton. The injured motorcyclist, Officer Clements, was transported to Saint Elizabeth Hospital with fire fighters on board. I was able to follow up with Officer Clements on the phone the next day who was admitted over night at the hospital. Officer Clements stated he has no recollection of the accident and can only remember driving down Centre Street to begin to pick up cones to open up all lanes of traffic. Donna stated she was standing in the marked parking space waiting for traffic to stop to safely cross the street. Donna states the cars stopped to let her cross and she proceeded into the roadway. She states MV1 was attempting to back into the parking space that she was standing in and struck her right side and knocked her to the ground. Donna states the operator of MV1 stopped the vehicle when he realized he had struck her and got out to contact 911. Donna appeared to have minor injuries and complained of head pain. Medics transported Donna to NWH to be further evaluated. The operator of MV1 identified as Christopher Moos (S24090966) stated he was attempting to parallel park into an empty parking space and never saw the pedestrian standing in the space. Christopher stated as he was backing up into the space he was notified by a bystander that he just struck a pedestrian. Christopher stated he immediately stopped the vehicle and got out to assist the pedestrian and contact 911. Christopher stated he was not travelling no more than 5mph at the time of the accident. The operator of MV2 was evaluated by Cataldo PB3 and signed a patient refusal. MV3 was towed by Bobby Donahue from Todys Towing. It sustained heavy front end damage, front air bag deployment and a small spill from the engine block. Operator of MV3 was evaluated and transported to NWH by PB3 for minor injuries. The three pedestrians witnessed the accident. All three stated that MV1 stopped to allow them to cross and they saw MV2 also come to a complete stop. The pedestrian, NNHS student Benjamin Donovan stated that he was crossing east to west in the marked crosswalk in front of 321 Walnut St. Donovan stated that he saw Beaver's vehicle approaching him at approximately 5 to 10 MPH. Believing that Beaver was stopping to let him cross , Donovan stated that he held up his left hand to signal to Beaver that he was going to cross. Donovan stated that Beaver's vehicle struck him on his left side and knocked him to the ground. Donovan stated that he had minor scrapes on his right side as a result of falling to the ground. Donovan stated that he did not lose consciousness and was transported via EMS to Newton Wellesley Hospital for treatment. I took photos of Beaver's vehicle and forward the disk to NPD IT Bureau. I issued Beaver MA Citation T 1269995 and cited him for a violation of MGL Ch 89 C 11, failure to yield to a pedestrian in a crosswalk. On 06/12/2019 I was forwarded an E-mail from Capt Anastasia of a video of the crash that was taken from a camera that was mounted on the roof of 321 Walnut St. The video shows Donovan walking into the marked crosswalk from the east side of Walnut St and hold up his left had to Beaver's on oncoming vehicle. Beaver vehicle appears to be travailing faster than the 5 to 10 MPH that Beaver believed that he was travailing. The video shows that Beaver did not brake until Donovan was struck and landed on his vehicles hood. Donovan was thrown approximately 10 feet from Beaver's vehicle and landed on his right side on the roadway. The operator stated she never saw the bicyclist, and that she was traveling less than a mile per hour when she made contact. It should be noted that the sun was setting and the operators vision would have been impaired by the sun at the location of the accident. MV1 had a minor scuff mark on the front bumper. I spoke with the bicyclist who stated he was traveling westbound on Washington street and was crossing over Dunstan street when he was struck by MV1. He stated he was knocked off the bike, scraped his arm, and had minor back pain. The mirror on the right side of his bike was broken. The bicyclist was wearing greenish gray clothing, and was not wearing protective equipment such as a helmet. The bicyclist signed a refusal from Cataldo and was given a copy of the report number. I spoke with the bicyclist involved in the crash, Steven Greenzang (S96615185). Greenzang stated he was traveling Westbound on Beacon Street in the shoulder lane on his black Specialized bicycle. Greenzang had a yellow reflective vest on and was wearing a helmet at this time. Greenzang stated a vehicle in the travel lane to his left drove by him and hit the mirror located on his left handlebar. I observed damage to the mirror. Greenzang report no injuries. I spoke with the operator of MV1, Sarah Bonfanti (S66811372). Bonfanti stated she was parked in front of 1411 Beacon Street waiting to pick up a co-worker that resides at that address. Bonfanti stated a bicycle traveling on the sidewalk to her right crashed into the passenger side door mirror of her 2008 Toyota Scion (MA: 681YH1). Bonfanti stated the bicyclist was acting ""crazy"" during her interaction with him and he was trying to take her picture. Bonfanti stated she got back into her vehicle and moved up the roadway to wait for police to arrive on scene. I canvassed the area where the accident occurred with Sgt. Dempsey. There was glass from the passenger side mirror of MV1 and Greenzang's bicycle in the main travel lane of the roadway and the shoulder lane where Greenzang stated he was traveling. We also observed a large tree and a telephone pole on the sidewalk next to the roadway where the accident is alleged to have occurred. After speaking with all parties involved, observing the location of the glass in the roadway from the crash, and the location of the tree and telephone pole on the sidewalk where he accident occurred; Greenzang would not have been able to operate his bicycle on the sidewalk and be close enough to the roadway to make contact with MV1. Prior to clearing the accident, I asked Bonfanti if she had any questions and if she wanted to report any injuries. Bonfanti stated she was hit by the bicyclist during her exchange with him and began grabbing her left leg. I asked Bonfanti why she did not inform the officers on scene that she was assaulted. Bonfanti stated she said something to our Dispatch when she called. I asked Bonfanti if her leg was injured. Bonfanti stated I was putting words in her mouth and that she was just scratching her leg. Bonfanti then stated she was hit in the right shoulder. I asked Bonfanti if she would like an ambulance to respond and evaluate her. The operator continued to drive northbound on Centre St before pulling over just before the crosswalk at Centre St and Pleasant St. The operator then continued driving forward and struck a pedestrian crossing in the crosswalk Officer Selig and I saw the pedestrian being struck before landing on top of the Toyota Corolla hood, and falling forward onto the street. Officer Selig and I spoke with the two parties involved. I spoke with the victim, who was identified as Vivian Rubinstein (Vivian). Vivian crawled towards the sidewalk of Centre St while clutching her lower back. Initially Vivian denied being injured and refused medical aid. The Toyota Corolla operator was identified as the register owner Elise Ruben (Elise). Elise stated to Officer Selig that her front windshield was foggy and when she noticed the blue lights, she attempted to pull over. Elise stated she did not see the pedestrian in the crosswalk. Elise appeared very upset and refused medical treatment. Officer Selig was able to speak to two witnesses of the accident. The witnesses were identified as Stephan Aparicio (Stephan) and Mikaela Rice (Mikaela). Stephan said he was behind the victim in the same crosswalk. Stephan stated he saw the Toyota stop in front of the crosswalk and then drove forward hitting the female. He was then attempting to make a left turn near the entrance/exit of the store. He says that there was a large white van parked in the end handicapped spot towards the left of him. He says the van was sticking out in the spot limiting his visibility. As he was half way through his left turn and coming around the corner, he was not able to see a pedestrian pushing a shopping carriage. He then struck the carriage that was being pushed by Mary Alexander. He further says that the cart jolted Ms. Alexander and she fell down to the ground. At the time, Alexander was walking through the lot near the store entrance heading back towards the parked cars. She was not in the crosswalk at the time which was approximately ten feet down from her location. After, I attempted to go to Ms. Alexander's residence to follow up. I spoke to her friend who was bringing up Alexander's groceries and she stated that she decided to go to Newton Wellesley Hospital for treatment. I then spoke to Ms. Alexander in the lobby of the hospital. She stated that she was exiting the store through the lot with her shopping carriage. She believes she was approximately eight feet away from the door when all of a sudden she only saw red coming at her. She believes MV # 1 was speeding at the time. I asked her if she was struck by the vehicle or was the shopping carriage only struck. She replied that she did not know and only remembers falling to the ground after. She sustained a large bruise to the inside palm area of her right hand and her left knee was swollen. Digital photos of the scene were taken and pictures of Ms. Alexander's injuries were taken at the hospital. As far as possible video surveillance, I was told that the Loss Prevention Department has to access the video. On 11/13/19 at approximately 14:20 hours, I went in to the Star Market and spoke to the manager, Nidal Rajeh, inquiring about possible video surveillance. He said there is coverage in the parking lot and he was able to show me the video. A copy of the video would have to be done by Loss Prevention which I requested. I observed at the 12:12pm mark in the video, MV # 1 was parked five spots up from the third row of the lot that he was exiting. I also observed a white transport van parked in the end handicapped spot mentioned by the operator but it was parked correctly and not limiting visibility. Next, MV # 1 backs out of the spot and drives forward going at a reasonable speed. The pedestrian (Alexander) has already exited the store with her carriage and is walking at an angle toward the same third row of parked cars. As the pedestrian is walking towards the direction of MV # 1, it appears that the pedestrian should be visible to him. MV # 1 then starts to take the left turn around the corner without slowing or stopping and strikes the carriage head on. Due to the impact, Alexander then loses grasp of the carriage and it goes past her twisting her body around. She then hits and rolls up on the hood of the vehicle on her left side. MV # 1 then suddenly stops and immediately gets out and provides assistance to the pedestrian. Doris-Pierce stated MV1 was stopped at the stop sign on California Street. Doris-Pierce stated he entered the marked crosswalk and began to cross California Street at Crafts Street. Doris-Pierce stated MV1's right passenger side tire ran over his foot. Doris-Pierce stated he then slammed on the hood of MV1. Doris-Pierce stated MV1 continued and he was knocked to the ground. Doris-Pierce reported injuries to his foot, thigh, and back. I went to the BI hospital to get a statement from Cantwell. Cantwell states that her husband parked their vehicle across the street from Starbucks. Cantwell states that she stood next to her car to cross the street. Vehicle 1 came to a stop and Cantwell believed that the vehicle was going to let her cross the street (not in crosswalk). Cantwell states that when she went to cross the street vehicle 1 hit her, causing her to land on the hood and then rolled off onto the street. At this time Cantwell has a dislocated hip and head injury. I took photos of the scene. Meehans vehicle was parked in a legal spot and I transported her to NHQ where she was picked up by her daughter Bernadette Conley. There were several live primary wires down on Floral St and Walnut St. Unit N-498 Officer Raymond blocked off Walnut St at Centre St, Unit N-502 Officer Nardelli blocked off eastbound Floral St and I blocked off Walnut St at Lincoln St. The surrounding pedestrian sidewalks were all taped off with Police caution tape. MV#1 struck the low hanging wires on Walnut St at the intersection of Floral St. Utility pole #A (47/12 ) located on Walnut St directly in front of the parking of the ""Orchid Dry Cleaners"" at 1175 Walnut St was cracked at the base. Utility pole #B was located on the westbound side of Floral St was split at the base and was dangling over the parking lot at 1175 Walnut St. Utility pole #C was located on the eastbound side of Floral St and was completely removed from its foundation and was now leaning on the building at 1182 Walnut St. The street/ stop sign of Floral St was damaged with the ""Stop"" sign and the ""Floral St"" sign completely removed from the pole (Located on the eastbound side of Floral St). A city tree limb that was damaged and landed on top of parked Vehicle #2 (Parked on the eastbound side of Floral St across from 49 Floral St. Wisconsin registration 850TGM). The owner of vehicle #2 was informed of the damage. Traffic Officer Gaudet took digital photographs of the damaged street/ stop sign and the damaged city tree. The witness Pat O'Hara of 1185 Walnut St stated MV#1 did not cause the accident but a previous bigger truck did. All he could provide was that the vehicle was a big truck travelling northbound on Walnut St. The witness Edna Jacquet stated she was parked on Walnut St (Parked between 09:00 to 09:15) at the MBTA bridge facing southbound when she observed the accident. Edna stated she observed the operator make eye contact with her and she proceeded to honk her horn in attempts to stop him. Edna stated the vehicle that caused the accident was a white colored 18 wheeler type of truck with the markings of ""3 letters"" all in different colors. Edna have a company video camera that faces forward attached to her vehicle that may have captured the accident. I spoke to her company manager Lisa Sanella at ""TransAction Corporate Shuttles"" located at 5 Wheeling Ave in Woburn MA and she will notify me if she is able to view video footages. The building owner of 1170- 1176 Walnut St Stas Gavronsky have a surveillance camera that faces Walnut St southbound towards Floral St. He will review the video footages once power have been restored that the area and notify me. On 01/07/2020 Lisa Sanella contacted me stating that they were able to review video footages from the front facing camera of Edna's shuttle bus. She stated that the involved vehicle was described as a big white colored 18 wheeler type of truck and did not have a front registration plate but did display the commercial company name of ""GHG Logistics"". Lisa stated the accident was time recorded at 09:13. Lisa made a copy of the video footage and will attempt to email it or deliver a flashdrive to me. An internet search of GHG Logistics showed that it is a distribution company out of 6390 Hedgewood Dr suite #300 out of Allentown PA. This company distributes wholesale sushi to the northeast area and their delivery trucks are equipped with ""Rydsmart"" GPS tracking devices enabling them to know their locations at all times. I spoke to Joanna Gerwig who is the store support team leader of the ""Wholefoods"" located at 916 Walnut St inquiring about a possible sushi delivery and she confirmed that GHG Logistics does regular deliveries and did deliver items yesterday morning between 08:00 -09:00. She stated that the truck displayed trailer #250634-481801 and that the driver was described as a big sized white male by the name of ""Will"" with a contact number of (570) 350-3453. She also have video footages of the truck making the delivery and provided me with their contact number of (800) 668-7700 and their corporate number of (484) 223-4502 (Confirmed to be the same company as my internet search). I viewed the video footage from Transaction Corporate Shuttles and it showed the 18 wheeler truck was travelling northbound on Walnut, catching the utility wires above and causing an electrical spark on the eastbound side of Floral St. It showed the truck slowed down and then continued to travel northbound. I spoke to Will at (570) 350-3453 and he confirmed he was making deliveries to the Wholefoods and was on Walnut St at approximately 09:00. Will stated the top corner portion of his truck did catch the above wires and heard a ""twang"". Will stated he briefly stopped and did not observed any damages so he continued to make his deliveries. Will stated he have been making the same delivery route for 2 years and never had an issue with low hanging wires. Will's full name is William L. Gray and have a Pennsylvania driver's license # 24551299. The truck's registration is apportioned Indiana 2917618. He says that he did not activate the cross walk signal but thought it was clear to proceed as Webster Street had a red light signal. While attempting to cross, he says that the westbound lane of Webster Street received a green light and MV1 proceeded to turn left on to Cherry Street from Webster Street. He then looked at the motorist and thought that she saw him. Once she kept approaching and realizing that he was not seen, he started to back track but was struck by the front end of MV1. Lorenz then tumbled back and fell down to the ground. He says that he got up feeling fine and alerted the motorist that he was struck. The two of them exchanged information and then left the scene with out notifying 911 of the accident. After, Lorenz then came in to Newton Police Headquarters to report it. I observed a small round swollen red mark to the inside of his right knee area and a red mark to the back left side of his neck. Digital photos were taken of his injuries. Mr. Lorenz declined medical attention and wanted this incident documented in case his possible injuries worsened. I then spoke to the operator of MV1, Sharon Pywell (MA S23277423), on the phone after. Pywell stated that she was operating her Toyota Prius bearing MA reg. # 2197RW on Webster Street facing westbound at Cherry Street waiting for the green signal to turn left on to Cherry Street. Once the light changed, she attempted to turn and never saw a pedestrian trying to cross Cherry Street. I asked her if she ever felt contact to which she replied that she was not aware that she ever struck someone. She further says that once she did see him, she believed that he never lost his balance or ever fell down. DRIVER STATES SHE WAS TRAVELING S-BOUND ON WALNUT AND STOPPED TO LET A PEDESTRIAN CROSS THE STREET. WHILE STOPPED SHE WAS HIT IN THE REAR BY VEHICLE #2. VEHICLE #2 STATES HE WAS TRAVELING S-BOUND ON WALNUT. HE STATES VEHICLE #1 STOPPED ABRUPTLY AND HE WAS UNABLE TO STOP ON THE WET PAVEMENT AND HIT HER VEHICLE. CHAN was later evaluated by her primary care physician, which advised her to monitor her wrist for any development of injury in the coming days. I spoke to the owner of MV1, who stated his son was driving the car today. Operator of MV1 stated he was pulling out of a driveway next to 17 Herrick Rd and looked both ways before pulling out, but did not see the pedestrian walking in front of his car. He states he got out and asked if she was ok, and she continued to walk away without talking. I did not observe any injuries on CHAN while speaking with her and she denied any further medical attention. I spoke with the bicyclist who was complaining of left wrist and left hip/ tailbone pain. The bicyclist was driving Southbound on Langley Rd on the sidewalk on his black bicycle with no lights. He said that as he was traveling on the sidewalk on Langley Rd, crossing the intersection of Union St (just outside of the crosswalk), he was struck on his right front of the bicycle causing him to fall on his left side. The bicyclist was not wearing a helmet and did not have any lights on his bicycle. He was wearing a blue jacket and dark pants on a black bike. The operator of MV1 spoke with Sergeant M. Wade and Officer Bergdorf. MV1 said that he was traveling East on Union St and stopped at the stop sign and did not see any pedestrians or traffic coming. He proceeded across Langley Rd and struck the bicyclist with the front driver's side of his vehicle. Officer Bergdorf took photos at the scene, which were submitted to IT to be attached to this report. The bicyclist was transported to Newton-Wellesley for medical treatment. The weather at the time of the crash was overcast. The road surface where the crash took place was dry. Brookline Street and Hartman Road are both public ways maintained by the City of Newton. On arrival, the injured pedestrian was in the process of being transported to Newton Wellesley Hospital with minor injuries. I spoke with the operator of the vehicle involved in the crash, Menachem Uminer (S43996134). Uminer stated he was operating his vehicle on Brookline Street (S) towards Hartman Road. Uminer stated he was stopped in traffic on Brookline Street prior to the crash. Uminer stated the vehicle in front of him proceeded to travel straight from it's stopped position and he then began to follow the traffic on Brookline Street. Uminer stated he did not see anyone in the vicinity of his vehicle as he began to travel straight from his stopped position. Uminer stated as he was traveling by Hartman Road, the front passenger side area of his vehicle made contact with a pedestrian on the right side of Brookline Street at Hartman Road. Uminer stated he did not see this party until after they were struck and he then proceeded to pull his vehicle over. Uminer stated he was operating his vehicle at a very low speed at the time the collision took place. After speaking with Uminer, I observed the white 2017 GMC Yukon (MA: 9NX525) involved in the crash parked on Brookline Street (S) just past Hartman Road. Uminer stated the vehicle had been moved after the collision took place. I observed no obvious damage to the body of the vehicle on the front passenger side area where the collision took place. The front passenger door mirror was folded inward towards the door. Uminer stated he believes the front passenger door mirror was the point of contact between his vehicle and the pedestrian. I spoke with a witness to the crash, Ashley Garcia (S94193596). Garcia stated she was attempting to cross Brookline Street at Spaulding Lane. Garcia stated she entered the marked crosswalk and was a few steps into Brookline Street when a black colored vehicle traveling on Brookline Street (N) slammed on its brakes near the crosswalk. Garcia stated she looked to her left at the vehicle and then heard a thud to the right from the area where the crossing guard was standing near Hartman Road. Garcia stated she looked over and saw a crossing guard on the roadway on Brookline Street (S) at Hartman Road. The injured pedestrian involved in the crash is Cassandra Alexander (S23636307). Alexander is a crossing guard for the City of Newton and is assigned to the intersection of Brookline Street and Hartman Road for the Memorial Spaulding school crossings. This crash occurred while Alexander was performing her official duties. Alexander was wearing her department issued yellow reflective jacket at the time of the crash. I spoke with Alexander at Newton Wellesley Hospital where she was being treated for her injuries. Alexander stated she was performing her duties as a crossing guard at the intersection of Brookline Street and Hartman Road. Alexander stated she had just finished crossing two pedestrians in the marked crosswalk on Hartman Road when observed a pedestrian enter the crosswalk on Brookline Street at Spaulding Lane. Alexander stated she began to enter the intersection of Brookline Street at Hartman Road with her hands up and her department issued yellow reflective jacket on in an effort to stop traffic in the area to allow the pedestrian in the marked crosswalk safely cross. Alexander stated she was struck on her left side by a passing vehicle. Alexander stated she did not see the vehicle and fell to the roadway. Alexander stated as she was falling to the roadway she extended her right arm in an effort to brace her fall. Alexander stated she had injuries to her arms and legs and was sore from the collision. I spoke with a second witness to the crash via telephone, Anand Vaidya (S43996134). Vaidya stated he was stopped in traffic behind MV1 on Brookline Street (Southbound). Vaidya stated he observed the vehicle in front of MV1 proceed straight on Brookline Street after being stopped in traffic. Vaidya stated he then observed MV1 proceed straight on Brookline Street at Hartman Road at a low rate of speed. Vaidya estimated the speed of MV1 at this time to be 5 miles per hour. Vaidya stated a crossing guard was on the right side of the roadway on Brookline Street at Hartman Road wearing a yellow and black reflective jacket and snow pants. Vaidya stated the crossing guard had her back towards him and MV1, and extended her arm out to stop traffic. Vaidya stated at this time MV1 rolled by the crossing guard at a low rate of speed and the front right fender area of the vehicle hit the left rear leg/lower back area of the crossing guard. Vaidya stated the crossing guard bounced off of the car and fell to the roadway. Vaidya stated he believes MV1 was unaware he hit the crossing guard and observed the vehicle travel another 10 feet until it came to stop on Brookline Street. Vaidya stated the crossing guard was not in a marked crosswalk at the time of the crash. Wint was driving a 2018 Chevrolet Colorado pick up tuck ( MA reg 8CA823 ) that Auto Zone leases from Lease Plan USA Ltd. Wint stated that he was headed to Webster St in Newton to pick up a delivery. Wint stated that as he approached the area of 277 Lexington St he believed that the traffic light that is at the marked crosswalk was green for south and north bound traffic. Wint stated that he did not see any pedestrians in the crosswalk, until he heard the sound of an object impacting into the front driver's side of his vehicle. Wint stated that he stopped his vehicle approximately ten yards past the crosswalk and got out. Wint stated it was then he realized that his vehicle had stuck a female and a dog. Wint stated that he was not operating any electronic devices at the time of the crash, and I observed none in his vehicle. Wint stated he was not injured in crash. Wint's vehicle had damage to the driver's side mirror and lower molding of the driver's side front door. Wint's vehicle did not require a tow. Witness Bessy Shanks stated that she was driving in her vehicle behind Wint's vehicle south bound on Lexington St. Shanks stated that Wint's vehicle was driving slow and swerving approximately two blocks prior to the crash. Shanks stated that she believed that Wint may of been distracted. Shanks stated that south and north bound traffic was stopped because that cross walk light was red and that a female and a dog were crossing from the east to west in the marked crosswalk in font 227 of Lexington St. Shanks stated that the front driver's side of Wint's vehicle srtuck the female and the dog as they were approximately halfway into the crosswalk. Shanks stated that the female and dog both fell to the ground after the crash. Witness Elizabeth Keegan stated that she was driving in her vehicle south bound on Lexington St two vehicle behind Wint's vehicle. Keegan stated that she was not sure what color the traffic light was at the time of the crash, but traffic was stopped both not and south bound traffic was stopped. Keegan also stated that Wint's vehicle "" didn't even slow down "". Keegan stated that Wint's vehicle struck the female pedestrian and the dog as they were in the marked crosswalk in front of 277 Lexington St. Witness Henry Taylor stated that his vehicle was the first one stopped at the red crosswalk light at 227 Lexington St in the north bound lane. Taylor stated that north and south bound traffic was stopped and that Wint's vehicle did not stop and stuck a female pedestrian and a dog in the crosswalk. Witness Jacqueline Deos stated that her vehicle was stopped behind Taylor's north bound on Lexington St. Deos stated that north and south bound traffic was stopped for the red light . Deos stated that Wint's vehicle did not stop and that it struck a female pedestrian and a dog in the marked crosswalk. The pedestrian in the crosswalk was identified as Xiaoping Sun. Sun stated that she and her dog stopped on the south bound side of the marked crosswalk across from 227 Lexington St. Sun stated that she activated the crosswalk light and waited until the light was red for north and south bound traffic, and that the walk single was activated. Sun stated that she looked to her left and saw traffic north bound traffic was stopping. Sun stated that she turned to her right and entered the marked crosswalk. Sun stated that she and her dog had crossed over the north bound side of Lexington St and she then looked to her right and saw Wint's vehicle not stopping and "" going very fast "". Sun stated that the front driver's side mirror of Wint's vehicle stuck her in the face . Sun stated that as she fell to the ground she was struck on the left leg by Wint's driver's side. Sun stated that she did not lose consciousness after she had fallen to the ground. Sun was transported via EMS to The Brigham and Women's Hospital for treatment for head and neck injuries and abrasions to her legs. Sun's dog died as a result of being struck by Wint's vehicle. Photo's of the crash site and of Wint's vehicle were taken and the disc was downloaded by the NPD's IT Bureau. Before leaving the crash site, I tested the crosswalk lights and they were in working order. Based upon my observations of the crash site, Wint's vehicle, and the statements made to me, I concluded that Wint was at fault for this crash. Eastbourne RD is a public way which runs from Ward St north bound intersecting with Ireland Rd on the far north end. Ireland RD is a public way which runs west to east. Both the east end and the west end of Ireland Rd are dead ends. The crash occured on Ireland Rd's east end near the intersection of Eastbourne Rd. The crash involved Vehicle 1 described as a 2016 Acura SUV color grey bearing MA passenger registration 3RB127. Vehicle 1 had a valid inspection sticker which expires on 08/30/2020. Vehicle 1 was operated by its owner identified as Barbara Ball. Ball has an active MA Operators License (S18727836). The involved pedestrian was identified as Bruce Terrio. Terrio is an employee of Feeney Brothers Utility Services. Feeney Brothers Utility Services is a contractor of National Grid Gas Company. Upon arrival I observed the following: The crash occurred in the daylight hours around 10:30am on Ireland Rd near the intersection of Eastbourne Rd. At the time of the crash the weather conditions were clear, 48 degrees Fahrenheit and overcast skies (weather.gov). The area where the crash occurred was an active construction site for Feeney Brothers Utility Services. The area of the crash is a dead end. The area is accessed from Ward St from either Eastbourne Rd or Coolidge Rd. The entrances of both Eastbourne Rd and Coolidge Rd had construction signs indicating utility work in the area. At the time of the crash, all roadways were open to vehicle traffic. On the eastbound side of Eastbourne Rd just prior to the intersection of Ireland Rd, I observed a large air compressor which was parked in the roadway facing south bound. No traffic cones were located near the air compressor. To the right of the air compressor were thick green bushes. A wooden fence was located to the right side of the green bushes. On the east side of Ireland Rd I observed a large excavated hole on the right side of the roadway. The hole was near the intersection of Eastbourne Rd and was located approximately three feet from the curb. I observed four traffic cones, two on the front side and two on the left side of the hole. Located on the front edge of the hole was a tire print. Vehicle 1 was located on the west end of Ireland Rd. The front passenger tire of Vehicle 1 had fresh dirt located on the sidewalls and the tire tread. Vehicle 1 appeared to have no visible damage. The pedestrian (Terrio) was being treated by EMS and Fire for injuries. Terrio was wearing brown pants and a green reflective safety vest. I spoke with the operator of Vehicle 1 Barbara Ball. Ball stated that she was operating Vehicle 1 northbound on Eastbourne Rd near the intersection of Ireland Rd. Ball stated that she made a right turn onto Ireland Rd and drove on to the edge of the excavated hole. Ball stated that her vehicle then made impact with Terrio who was in the hole. Ball stated that she immediately stopped, backed out of the hole and called 911. Ball stated that prior to making a right turn onto Ireland Rd, there were no traffic cones in the roadway or next to the hole. Ball stated that as she made the right turn onto Ireland Rd she did not observe Terrio or the hole until it was too late. Ball states that she resides at 80 Eastbourne Rd which is the residence located to the immediate right of the crash location. Ball states that she had been recently parking on Ireland Rd due to ongoing construction at her residence. Ball states that she was traveling at a slow speed prior to impact. At the time of the crash there were three other Feeney Brothers employees working at the site. These workers were identified as Steven Gamble, Mike Cabrinma and Gerard McComaskey. At the time of the crash all three workers were located further up Eastbourne Rd near the intersection of Coolidge Rd and did not observe the crash. At the time of the crash, Newton Police Sergeant Glenn Chisholm was working a paid detail for Feeney Brothers. Sergeant Chisholm stated that he did not observe the crash.Terrio was transported by Cataldo EMS for minor injuries. Several photos were taken of the scene. Photos were taken of the hole with traffic cones and without traffic cones. All photo's were submitted to the IT Bureau. After clearing the scene, I responded to St Elizabeth's Hospital in Brighton, MA to interview Terrio. Terrio stated that at the time of the crash he was standing in the hole on Ireland Rd performing gas utility work. Terrio stated that the front passenger side bumper of Vehicle 1 struck him in the right shoulder. Terrio stated that the impact caused him to lose his balance and fall down in the hole. Terrio states that after falling down he was able to climb out of the hole without assistance. Terrio stated that at the time of impact he was wearing a white hard hat which he thinks struck the pavement on the edge of the hole. Terrio states that at the time of the crash he was working alone in the hole. Terrio states that at the time of the crash traffic cones were located near the hole. Terrio stated that as a result of the impact he sustained minor injuries to his right shoulder and back. I then observed Terrio's hard hat which appeared to have a fresh scrape mark on the top. The hard hat also had broken interior straps. Terrio stated that the straps broke when he was struck by Vehicle 1. Photos were taken of the hard hat and were submitted to the IT Bureau. After reviewing all facts of this incident, Vehicle 1 appeared to have been traveling at a slow speed prior to the crash. This was evident due to the lack of tire skid marks prior to the tire print on the edge of the hole. It also appears that Ball's view of the hole and Terrio may have been obstructed by the parked air compressor on Eastbourne Rd. The thick green bushes and a wooden fence to the right of the air compressor also added to the obstructed view. The hole was also located in close proximity to the air compressor which reduced Vehicle 1's reaction time. Jeff Oliver of OSHA was also notified of this incident. The bicyclist stated that the operator of MV1 did not come to a stop at the stop sign. The bicyclist was complaining of minor leg pain, but signed a patient refusal with Cataldo. The bicyclist was dressed in black pants, and a gray sweater, and was not wearing a helmet. The bicycle sustained damage to the handlebars. At the time of the accident the sun was setting, however the street lights had not yet come on. I then spoke with the operator of MV1 who stated she was traveling southbound on Linwood avenue, and was attempting to turn right onto Watertown street when she struck the bicyclist. The operator stated she never saw the bicyclist before the collision. The front of MV1 sustained minor damage. I was able to speak with a witness to the accident over the phone after clearing the scene. The witness stated that MV1 failed to stop at the stop sign at the intersection of Linwood and Watertown street, and that the bicyclist was already well into the crosswalk at the time of the collision. Officer Howes took pictures of the accident scene that have been submitted to the IT bureau. The driver of the motor vehicle (MA reg 93Y880) was still on scene. He is identified as Ali Alnamos DOB12/10/59. While the medics were tending to Dugas I obtained a statement from Alnamos. He stated that he was driving on Auburndale Ave towards Lexington St and went to turn right onto Newell Rd. Upon turning, he made contact with the pedestrian with what he believes to be his passenger side mirror. Alnamos was distraught while speaking with me, and told me that he did not see the man. It should be noted that there is a clearly marked pedestrian crosswalk on Newell Rd, right at the location of this accident. There are street lights in the vicinity and Dugas was wearing darker clothing. Medic 2 transported Dugas to St. Elizabeth's due to his head injuy. I responded to the St E's ER Department and spoke with Dugas shortly after he was transported. Dugas reports that he was out for a walk on Auburndale Ave and was heading towards Auburndale Square. He went to cross Newell Rd and was hit by a vehicle shortly after entering the crosswalk. Dugas is not sure what part of the vehicle made contact with him but states that he did not go over the hood. Newell Rd intersects Auburndale Ave only on the westbound side. Several pictures were taken of the scene and have been submitted to IT. I did not observe any damage to the vehicle involved, therefore a tow was not needed. Alnamos stated that he was not in need of medical attention. Halsor stated that while stopped she was struck from behind by Vehicle 2. Halsor stated that the force of the impact caused her to hit her head on the steering wheel. Fire and Medics responded to the scene and evaluated Halsor. Halsor was released with a patient refusal. The operator of Vehicle 2 identified as Christopher Benoit stated that he was traveling southbound on Parker St and struck Vehicle 1 which was stopped in traffic. Benoit stated that he tried to avoid the collision by swerving to the right but was unable to and as a result struck the passenger side rear of Vehicle 1. Benoit stated he was uninjured. No other witnesses on scene. Vehicle 1 was driven from the scene by Halsor. An RMV check of Vehicle 2 revealed that the registration was expired as of 12/31/2019. Tody's responded and removed the vehicle. A Towed MV Inventory Sheet was completed. An RMV check also revealed that Benoits MA Drivers License (MA DL# S9550481) was suspended. MV#2 had heavy front end damage. The operator of MV#2 sustained no injuries. The involved pedestrian had left the area prior to my arrival. The vehicle that was involved in crash was also not on scene. The crash occurred on 07/28/2020 at approximately 0900hrs in the driveway of 27 Oak St. Prior to the crash the involved vehicle described as a 1991 Chrysler TC Convertible color Red bearing MA Antique Reg D2935 ( Active) was located in the driveway of 23 Oak St. The vehicle was facing toward the rear of the driveway. The vehicle then rolled in reverse easterly across the common driveway and struck a pedestrian who was located in the driveway of 27 Oak St. After contact with the pedestrian the vehicle came to final rest in the driveway of 27 Oak St. As a result of the impact the pedestrian sustained a minor injury to her left knee. There were no occupants in the involved vehicle at the time of the crash. It is unknown at this time if the vehicle sustained any damage. The pedestrian left the area prior to this crash being reported to NPD. The vehicle was removed from the area prior to the crash being reported to NPD. I then spoke to the owner of the involved vehicle Marc Dumoulin who was on scene and was the reporting person. Dumoulin stated that the crash occurred today 07/28/2020 at approximately 0900hrs. Dumoulin states that the involved vehicle described as a 1991 Chrysler Convertible was having issues due to a gas tank problem and he believes it wasn't going to pass inspection. Dumoulin stated that he took his vehicle for a final test ride around the block to decide if he wanted to keep it or not. Dumoulin states that after operating the vehicle he decided to salvage the vehicle with CJ Auto in Watertown, MA. Dumoulin states that before going to CJ Auto he decided to stop back at his home first. Dumoulin states he then parked the vehicle at this driveway and got out to go in the house. Dumoulin states that he believes the vehicle was running at this time. Dumoulin states that as he was walking toward his house he observed his vehicle rolling in reverse towards his neighbor's driveway. Dumoulin states that the vehicle then rolled into his neighbor's driveway near his neighbors fence. Dumoulin states that the pedestrian was outside near the fence when his vehicle rolled into his neighbor's driveway.Dumoulin states that he did not initially report the crash because he did not believe that his vehicle had come in contact with the pedestrian. Dumoulin states that he then removed the vehicle from his neighbor's driveway and brought it to CJ Auto for salvage. Dumoulin states that when he returned to his residence he became aware that the pedestrian may have been struck by his vehicle and had a minor injury. Dumoulin states that upon hearing this he called NPD. At this time I was met by Nina Levin who is the homeowner of 27 Oak St. Levin stated that she did not observe the crash but a contractor working on her house did. Levin stated that the pedestrian involved was named Lucero Flores-Roman and that Flores-Roman was outside attending to some potted plants when she was hit by the involved vehicle. Levin stated that Flores-Roman received an injury to her left knee. Levin stated that she took photo's after the crash of the involved vehicle and of Flores-Roman's knee. Levin provided me with these photo's which I then submitted to the IT Bureau. Levin provided me with Flores-Romans contact phone number. Dumoulin also provided his insurance information to Levin so that she could relay the information to Flores-Roman. I then spoke with a witness Gleb Andreev who was a carpenter working at 27 Oak St. Andreev states that he was inside of 27 Oak St working on a first floor window facing the driveway. Andreev state he observed the involved vehicle roll into the driveway and come to rest near the pedestrian. Gleb stated he then went out side to assist the pedestrian. Gleb stated he believed the vehicle hit the pedestrian when it rolled into the driveway. At 0230 hrs I was able to speak with the involved pedestrian Lucero Flores-Roman. Flores-Roman states that around 0900hrs today she was in the driveway of 27 Oak St attending to some plants near a wooden fence. Flores-Roman stated that her back was turned towards the area of 25 Oak St, she then on a hunch turned around and observed the involved vehicle in reverse moving towards her. Flores-Roman stated that she turned her body quickly to avoid the vehicle but the vehicle's rear end passengers side made contact with her left knee. Flores-Roman stated that she sustained a minor injury to her left knee which included some bruising and swelling. Flores-Roman states that after crash she did not think she needed an ambulance but wanted to go home to rest her knee. Flores-Roman was then provided with Dumoulin's insurance information. No other injuries reported on scene. Photo's were taken on scene and were submitted to the IT Bureau. On 07/29/2020 I responded to CJ Auto's Salvage Yard located at 43 White Pond Rd Stow, MA which was the present location of the involved vehicle. Upon arrival I observed the involved vehicle which did not appear to have exterior damage. Photo's were taken of the vehicle and were submitted to the IT Bureau. An RMV check of vehicle revealed that a title was issued to Dumoulin on 03/25/2020. The vehicle has not been inspected by a MA inspection station. The vehicle title has been signed over by Dumoulin to CJ Auto for destruction. Dagostino stated that the Subaru stopped to let a pedestrian cross the street. Dagostino stated that when the Subaru stopped abruptly it caught him off guard because there was no marked crosswalk in the area. Dagostino stated when the Subaru stopped short he applied the breaks to his truck and had to turn to the left in an attempt to avoid a crash. Dagostino stated that his truck's front passenger side bumper made contact with the Subaru's rear driver's side bumper and tail light. Dagostino's truck had small scrapes to the front passenger side bumper. Nether operator stated that they were injured and the vehicles were not towed.Lev's vehicle had damage to the rear driver's side bumper and tail light . I took photo's of both vehicle and this disk was tuned over to the NPD's It bureau for downloading. Operator of vehicle two Naomi Lev stated that she was driving south bound on Walnut St when she said she was attempting to turn left into Berwick Rd and stopped to let a pedestrian across over Walnut St . It should be noted that Berwick Rd is approximately 1/2 of a mile south of where the crash occurred. The operator of MV1, Maria Dinapoli (S92626906), stated she was operating her 2018 Toyota Corolla ( MA REG: 1KNW71) heading west on Beacon Street and had the green light at the intersection of Chestnut Street. Dinapoli stated she was traveling straight through the intersection when MV2 which was traveling east on Beacon Street at the time cut infront of her vehicle to take a left turn onto Chestnut Street. Dinapoli stated she applied her brakes but was unable to stop in time and made contact with MV2. The impact of the crash caused MV1 to drive over the curb and onto the sidewalk where it made light contact with a baby stroller with a 1 year old inside. MV1 also struck and damaged a Newton Fire Department box that was located on the sidewalk. The baby stroller was being operated by the mother identified as Anna Gilman (S11328154). The pedestrians reported no injuries and signed patient refusals with Medic 2. MV1 sustained moderate front end damage and was towed from the scene by Todys. Dinapoli also reported no injuries and signed a patient refusal with Medic 2. The operator of MV2, Leena Dolabany (S12410136), stated she was operating her 2018 Jeep Grand Cherokee (MA REG: 1TCZ14) heading east on Beacon Street and had the green light at the intersection of Chestnut Street. Dolabany stated she was in a line of cars in traffic waiting to take the left turn onto Chestnut Street. Dolabany stated as the cars infront of her continued through the intersection she took a left onto Chestnut Street and as she was already into the turn she was struck by MV1. MV2 sustained moderate damage to the passenger side panel. Dolabany reported no injuries and signed a patient refusal by Medic 2. A query of all vehicles and parties involved through dispatch determined that MV2 was revoked for insurance. After speaking with the operator I was informed that MV2 had recently switched insurance agencies and Dolabany was able to provide paperwork from Geico Insurance stating the vehicle was insured. Due to the registry not displaying a valid registration, MV2 was towed from the scene by Todys. I advised Dolabany to contact her insurance company and advise them to update their information with the registry so she can retrieve the vehicle. Photographs of the scene and damage to city property were taken by Officer Wilson and submitted to the IT Bureau. On August 14th, 2020 I spoke with the operator of MV2, Leena Dolabany and her father George Dolabany in the front lobby of the police station. They provided paperwork from Geico Insurance that stated the vehicle was infact insured at the time of the accident and that there was an error made by the Registry of Motor Vehicles. Sgt. Devine and I advised them that we have to use the Registry's database for our investigation and because it still states the vehicle is revoked for insurance we can not release the license plates. Both Commonwealth Ave and Lexington St are owned and maintained by the City of Newton. Upon arrival I spoke with the parent of the pedestrian identified as Tamika Olszewski. Tamika stated her daughter, Morgan Olszewsk, her twin brother Dean Olszewski and several friends took their bikes and went to Dunkin Donuts in Auburndale. Tamika stated when the group returned from Dunkin Donuts her daughter Morgan told her that she was hit by a car while crossing Commonwealth Ave. I spoke with Morgan and she stated she was in front of Dunkin Donuts and pressed the crosswalk button on the traffic light to cross over Commonwealth Ave. Morgan stated she crossed the street inside the crosswalk and noticed the crosswalk light signal was counting down. Morgan stated she heard a shrieking noise from a car slamming on the brakes and stuck hand out and touched a white car to keep her balance. Morgan stated she did not fall down or sustain any injuries. Morgan stated she continued across the street towards the picnic benches that are located in front of Starbucks. Morgan stated she then walked home and told her mother what happened. Morgan's only description of the vehicle involved was white car. Dean Olszewski and Ryan Poras stated they were at the picnic benches and left their bikes there and walked in the crosswalk to Dunkin Donuts to get some food. Dean and Ryan stated they then left the store and crossed back to the picnic benches where Deans sister Morgan was waiting. Dean gave Morgan some money so she could go to Dunkin Donuts and Morgan went and crossed the street alone and the next thing they saw was Morgan in front of Dunkin Donuts with an unknown woman with her arms around Morgan. Dean and Ryan stated Morgan crossed back to the picnic benches and when they asked Morgan what had happened she stated ""nothing"". Later Morgan then told Dean she was hit by a car. I spoke with an employee of Dunkin Donuts who stated he witnessed the entire incident. Kelvin Matovu stated he had groups of kids coming inside to get donuts around 12:25pm. Kelvin stated he witnessed Morgan with other children at the picnic benches in front of Starbucks. Kelvin stated he saw Morgan attempting to cross Commonwealth Ave with her helmet on and no bicycle with her. Kelvin stated Morgan pressed the crosswalk button on the traffic light at the intersection but stated she did not cross in the crosswalk and crossed directly in front of the stores windows which are not in line with the crosswalk. Kelvin stated he did not notice if she had the walk sign or not. Kelving stated as Morgan crossed into traffic she was rushing and stopped in the middle of the road where the two yellow medium stripes are and looked confused. Kelvin stated it seemed she was confused because cars were going past her in both directions and so she stopped in the middle of the road. Kelvin stated a female customer who was inside the store went out and made contact with Morgan when she finally crossed the street and made it to the front door of Dunkin Donuts. Kelvin stated he did not see a car make contact with Morgan or hear anything related to a crash. Kelving stated Morgan seemed confused and did not appear injured. Kelvin stated the female customer put her arms around Morgan to make sure she was okay. After the incident, Kelvin stated Morgan did not enter the store and went back to the picnic benches where the other children were located and they left northbound on Lexington Street. Kelvin stated the female customer came into the store and Kelvin gave the woman a free coffee for assisting Morgan. The unidentified female customer then left the area. Dunkin Donuts has no cameras that face the street. Officer G. Claflin spoke with the employees at Keys Drugstore and they stated they did have cameras facing the street and will contact the store manager who will contact the Traffic Bureau if the incident was caught on the camera. I advised Tamika that a report will be filed and if there is any development regarding the possible car involved I will contact her. Medic 2 was on scene and Tamika signed a patient refusal for Morgan. Morgan is a student at Burr Elementary School. The parking lot is a thru way that the public use to enter/exit the lot or park there. On arrival at the same time with the Fire and Medics, I observed a female laying in the middle of the lot facing down on her back. A small red and gray CVS like type shopping carriage was knocked over and resting on it's side in front of the victim's head. The carriage was moved to the side in order to tend to the victim I also observed a black Honda Civic bearing MA reg.# 3741TW that was involved in the accident. The Honda was out of the parking spot resting approximately two feet away from the pedestrian's legs. I then spoke to the pedestrian identified as Darla Gipson in the rear of the ambulance. She sustained an abrasion to her front left shoulder and arm area which I observed. She also complained of left knee and elbow pain. She stated that she walking through the middle of the parking lot pushing the carriage by the door entrance in a westerly direction towards Chestnut Street. She states that she never saw a vehicle backing up and then she was suddenly struck and believes she was pushed underneath the vehicle. She was then transported to Newton Wellesley Hospital by Cataldo Ambulance. I then spoke to the operator of the Honda Civic identified as Linda Burke (MA S70320414). Ms. Burke was parked in the first spot to the right of the walkway that leads to the entrance/exit doorway. I asked her what occurred and she stated that she was backing her vehicle up to exit the parking lot when she looked behind her not seeing anything in sight. She then started backing up and struck the pedestrian without realizing it. She says the driver of a green cab and his female customer who were no longer on scene were yelling at her to stop her vehicle because the pedestrian was underneath it. She then stopped her vehicle. I observed minor scrapes to the entire rear bumper of the vehicle so it is unknown where it actually struck the pedestrian/carriage. I observed no obvious signs of damage to the carriage. It should be noted that Ms. Burke's Honda does not have a back up camera or back up sensors. There are no surveillance cameras to the apartment complex and no witnesses came forward for the accident. At approximately 19:45hrs Sgt. Devine, Ofc Wilson and I (Ofc Schlegel) from the NPD Traffic Bureau responded to the scene to investigate. Upon arrival to the scene I was met by Ofc Kane of the NPD Patrol Bureau. Ofc Kane stated that the crash was located in the driveway of 74 Eddy St and that it involved a Ford F350 pickup striking two parked cars. Ofc Kane stated that the operator identified as Kyle Butler had already been taken to Newton Wellesley Hospital by Cataldo EMS for injuries. . Upon approaching the crash scene I observed the following: The crash occurred at night time hours at approximately 19:32EST near the intersection of Washington St and Eddy St. Both Washington St and Eddy St are public ways in the City of Newton. The weather conditions at the time of the crash were a dark and clear with a temperature of approximately 60 degrees F. Washington St is a four lane undivided roadway (2 westbound travel lanes and 2 eastbound travel lanes). Washington St lighted roadway which has concrete light poles on both the westbound and eastbound sides. Washington St was under construction at the time and had a base coat of asphalt applied. At the time of the crash Washington St did not have any painted lane markings due to ongoing construction. Washington St is separated from the road sides on both the eastbound edge and the westbound edge with fixed granite curbing. The roadway also had several orange traffic barrels and traffic cones located edges of the eastbound and westbound lanes. Affixed to the light poles and the traffic barrels were temporary no parking signs for the ongoing road construction. At the time of the crash no road construction activities were taking place. No major debris or other obstructions were observed in the roadway. Washington St is a major roadway in the City of Newton and travels west to East across the entire City of Newton. This area of Washington St where the crash occurred is in between West Newton Square and Newtonville Square, this area has a posted 35 MPH speed limit. Both West Newton Square and Newtonville Square are densely populated with several businesses and residential areas. The section of Washington St where the crash occurred is also traveled frequently by pedestrian, bicycle and motor vehicle traffic. At the time the crash occurred 19:32hrs This area of Washington St is still a heavily travelled roadway. I observed Vehicle 1 described as a 2003 Ford F350 color white (MA Reg 5DT664) located in the driveway of 74 Eddy St. 74 Eddy St is a multi-family dwelling house located on the corner of Washington St and Eddy St. The driveway of 74 Eddy St is on the Washington St side. Vehicle was faced easterly across the driveway. I observed Vehicle 1to have extensive damage to the entire vehicle including but not limited to the enclosed cab area, cab roof and all windows, front end, rear end, along with both driver and passenger side. I also observed city of Newton owned concrete traffic light resting on top of the cab area of Vehicle 1. Upon further observation of Vehicle 1 it appears that both front tires and rims were flat, heavily damaged and had little to no tread left. Both front tires were worn down to the interior steel belt. I also observed that Vehicle 1 did not have a valid inspection sticker. Located to the immediate front of Vehicle 1 and resting on the front end was a white fence which had damage consistent with the impact of a motor vehicle. Immediately to the driver's side of Vehicle 1 was Vehicle 2 described as a 2007 gray Subaru Forester (MA Reg 45D610. Vehicle 2 was facing westerly across the driveway. Vehicle 2 had extensive damage to the driver's side front end, rear end, in addition to the entire driver and passenger sides. At this time Vehicle 2's drivers door was in contact with Vehicle 1's drivers door. Both drivers doors could not be opened.The damage to Vehicle 2 appeared to be consistent with impact from another motor vehicle. To immediate passenger side of the Vehicle 2 I observed Vehicle 3 described as a 2011 Toyota Rav4 color black (MA Reg 47XB99). Vehicle was facing in an easterly direction across the driveway. I observed the Vehicle 3 to have extensive damage to driver's side rear quarter panel, passenger side front quarter panel and front end. Also observed was damage to south east corner of the dwelling of 74 Eddy St. This area of the dwelling is located adjacent to the drive way. The damage appeared consistent with the impact caused by a motor vehicle. Also observed were large amounts of debris located in the area of the crash which included the sidewalk, yard and the driveway of 74 Eddy St. The debris included pieces of concrete which appeared to have been dislodged from the concrete light pole. A city of Newton no parking sign was lying in the yard of 74 Eddy St. This parking sign would have been attached to the concrete light pole due to ongoing road construction on Washington St. I also observed two tire marks on a curb stone located next the westbound lane of Washington St. These tire marks were in front of the residence of 74 Eddy St and were to the immediate left of a storm drain. The tire marks were consistent with being struck by a motor vehicle. In between the tire marks and just after the curb there was a hole in the ground with wires sticking out of it. This hole appears to be the location the concrete light pole was located prior to impact. Tire marks were located on Washington St traveling from the east bound lane easterly across the westbound lane and ending at the tire marks on the curb. The total length of the tire marks was approximately 190 feet. After conducting an on scene investigation it appears that Vehicle 1 from the start of the tire mark in eastbound travel lane of Washington St traveled 190 feet in the easterly direct across the westbound lane of Washington St and impacted the curb in front of 74 Eddy St. The tire marks had lateral striations almost the entire length indicating that the front tires were rolling and sliding with little to no braking prior to impact with the curb. After impact with the curb Vehicle 1 exited the roadway, struck a concrete light pole. Vehicle 1 then traveled over a sidewalk, across the yard of 74 Eddy St and into the driveway of 74 Eddy St. Located in the driveway of 74 Eddy St were Vehicle 2 and Vehicle 3. Vehicle 2 was parked facing toward the rear of 74 Eddy St. Vehicle 3 located to the passenger side of Vehicle 2 and was parked facing towards Washington St. When Vehicle 1 entered the driveway it struck Vehicle 2. The force of the impact of Vehicle 1 striking Vehicle 2 caused Vehicle 2 to strike Vehicle 3. The force of the impact of Vehicle 2 striking Vehicle 3 caused Vehicle 3 to strike the southeast corner of the dwelling located at 74 Elliot St. Vehicle 1 continued across the drive way and struck a white fence before coming to final rest. Vehicle traveled a approximately 55 feet from when it initially struck to the curb till final rest. No other injuries were reported on scene. All involved vehicles were towed from the scene by Tody's Towing. Tova stated MV1 was turning left onto the road that leads to the exit and when she realized the operator was not stopping she put out both her hands and made contact with the hood of MV1. Tova stated the impact caused her to fall to the ground and roll into a grassy area next to the road. Tova had minor scrapes from the accident and signed a patient refusal. The operator of MV1 identified as Antonio Domenico Ricci was on scene and his primary language was Italian. I was able to contact his daughter, Daniela Boccia who arrived on scene and translated Antonio's statements. Antonio stated he was turning left onto the main road that leads to the exit of the cemetery and had his left signal activated. Antonio states the sun was glaring into his eyes and made it hard for him to see. Antonio stated he took the left turn and never saw the pedestrian. Antonio states he heard a thud on his hood and stopped the vehicle and that is when he realized he had struck a pedestrian. Antonio was not injured and there was no damage to his vehicle. Le stated that he was unsure if the yellow flashing crosswalk lights were activated. Le stated that he rode his bike off of the side walk at the northeast corner of Walnut St at Linwood Ave. Le stated that he did not ride his bike in the marked crosswalk that run from east to west over Walnut St at Linwood Ave. Le stated he rode his bike diagonally into the intersection towards the south west corner of the intersection. Le stated that he did not see Techler's vehicle prior to entering the intersection. It should be noted that at the time of the crash Le was wearing earphones and stated the he was listening to music. Le stated that he was not injured in the crash and signed a patient refusal from in the presence of his father Thanh Le who responded to the crash scene. Le's bike had damage to the front tire and front breaks. It should be noted that the crash was reported by the Operator of Vehicle 1 Daniel Zandman at approximately 1400hrs. Zandman states that he was operating his Vehicle southbound on Centre St just after the intersection at Church St. Zandman states that Pedestrian 1 unexpectedly ran in front of his vehicle. Zandman stated that he did not have enough reaction time to come to a complete stop and his front bumper made contact with Pedestrian 1. Zandman stated that after impact he immediately got out of his vehicle and checked on Pedestrian 1. Zandman described pedestrian on as a 10 year old white male identified as Dexter Jagoditish. Zandman stated that while on scene Dexter called his mother Jess Jagoditish who immediately responded to the scene. Zandman stated that he exchanged information with Jess Jagoditish who then took Dexter home. Zandman states that a witness Mia Martin was also on scene. At approximately 1425hrs I called and spoke to Dexter and his mother Jess Jagoditish. Dexter states that he was walking on the sidewalk near 483 Centre St. Dexter states that he wanted to cross Centre St and thought there were no cars coming. Dexter stated that he entered the southbound lane of Centre St and a car came out of no where and hit him. I then spoke to Jess Jagoditish who is Dexter's mother. Jess stated that she received a call from Dexter around 1240hrs stating he was just hit by a car. Jess stated that when she arrived on scene Dexter was with Zandman and a witness Mia Martin. Jess stated that both Zandman and Martin explained them what had happened. Jess stated that Dexter appeared to be ok so she decided to take him home. Jess states that at this time Dexter has a bruise on his left calf but otherwise appears to be ok. At 1551hrs I spoke with the witness Mia Martin. Martin states that just prior to the crash she was walking her dog behind Dexter. Martin states that ""out of nowhere"" Dexter sprinted into the southbound lane of Centre St. Mia states that she then observed Vehicle 1 attempt to slow down and swerve to the lest to avoid Dexter. Mia states that the passenger side front bumper then made contact with Dexter. Mia states at impact Vehicle 1 was traveling at a very slow speed. Mia states that Dexter was then knocked on to the ground but then immediately jumped up and started to run away. Mia states that both she and Zandman were able to get Dexter to comeback so that they could check to see if he was ok. Mia states that Dexter was then able to contact his mom who responded on scene. Due to this crash being reported after the fact, Fire, EMS or Police where not initially notified and did not respond to the scene. Pictures were also not taken of the crash scene. At this time this report is for documentation purposes. Correia said he was running across the intersection headed Eastbound and thought he could make it across. Medics transported Correia to NWH. Delicata's vehicle suffered minor damage and was driven away from the scene.
