Upon my arrival at the crash scene I made the following observations, Wiswall Rd is a two lane non divided public way in the city of Newton that runs north to south from a dead end to Dedham St. The posted speed limit on Wiswall Rd is 25 MPH. M Roadway is a two lane non divided public way that runs west to east from Wiswall Rd to a dead end cul-de-sac. The weather conditions at the at of the crash were cloudy, and the roadway surface was wet from rain. I observed MA commercial registration M82794 a gray 2014 Honda Accord stopped in the north bound lane of Wiswall Rd at M Roadway. The Honda is registered to Newton Driving School. I observed two smudge marks approximately four inches in length on the center portion of the front and rear passenger side doors of the Honda. I also observed a 20 inch Kent bike that had be moved from it's final point of rest prior to my arrival. The bike had damage to it's front handle bars, front tire and it's two front forks. The bike's front tire had gray scuff marks on it. At the crash scene I spoke with the operator of the Honda, David Dombrovsky. Dombrovsky stated that he was driving north bound on Wiswall Rd near M Roadway approximately 20 to 25 MPH. Dombrovsky stated that he has had his learner's permit for six months and is a student at the Newton Driving School. Dombrovsky stated that he did not see the bicyclist but heard the impact of the bicyclist stricking the passenger side of the Honda. At the crash scene I spoke with driving school instructor, Igor Drizik. Drizik stated that the Honda was driving north on Wiswall Rd near M Roadway at approximately 20 to 25 MPH . Drizik stated that he did not see the bicyclist until approximately 1 to 2 seconds before impact on the driver's side of the Honda. Drizik stated the Honda is equipped with dual brakes and that he applied the brakes at the same time as Dombrovsky. Drizik stated that he and Dombrovsky got out of the Honda to render aid to the bicyclist. There were three other driving school students in the rear of the Honda at the time of the crash, neither of them stated that they witnessed the crash. None of the occupants of the Honda stated that they were injured and the vehicle did not require a tow. The bicyclist was identified as David Kerwin-Derrick. Kerwin-Derrick was transported via EMS to Boston Children's Hospital form treatment. At the hospital I spoke with one of Kerwin-Derrick's mother's, Patricia Kerwin-Derrick, who stated "" We all know that David rode his bike into the car "" and that her son had a broken left leg. Kerwin-Derrick is a student at the Memorial Spaulding School. Based upon my observations of the crash scene and statements made to me , I believe that Kerwin-Derrick's unintentionally rode his bike into the passenger side of the Honda. Operator of MV2 pressed the gas to move up but pressed it too much which caused her to accelerated across Kenrick Street. MV2 then hit the stone wall at 337 and then MV2 collided with MV1. MV2 had heavy front end and right side damage. All operators and passengers were offered and signed patient refusals from the medics. Both motor vehicles were towed from the scene. I spoke with the injured bicyclist in front of 165 Paulson Road, Alexander Mendonez. Mendonez stated he was traveling Westbound on Beacon Street on his bicycle near Paulson Road. Mendonez stated he observed a late model gray sedan ""inch to a stop"" on Beacon Street (W) at Paulson Road. Mendonez stated he did not remember if the vehicle had it's right directional on at the time. Mendonez stated as he was traveling through the intersection with the vehicle on his left, the vehicle took a right turn onto Paulson in front of him. Mendonez stated he attempted to brake and veer to the right of the vehicle, but was unable to avoid the collision. Mendonez stated his left side made contact with the rear passenger door/rear fender area of the vehicle. Mendonez fell to the roadway and the vehicle left the area Northbound on Paulson Road. Mendonez was unable to see who was operating the vehicle. Newton Medics responded and treated Mendonez for injuries to his left knee/arm area. Mendonez signed a patient refusal with Newton Medics. I observed minor damage to the left handlebar area of Mendonez's bicycle (black Trek). Mendonez was wearing a white helmet at the time of the accident with a blue shirt and white and black shorts. Pictures were taken of the area and bicycle and submitted to the IT Bureau. Mendonez was able to provide a partial Massachusetts registration of ""7BS32"". I attempted run this plate with multiple combinations. I searched the area for a vehicle matching the description given by Mendonez with a negative result. On July 16, 2019, I spoke with a witness to the incident Mark O'Hearne. O'Hearne stated he was traveling Westbound on Beacon Street a few car lengths behind where the accident occurred. O'Hearne stated he observed a bicyclist on the right side of the road abruptly stop and fall to the roadway. O'Hearne stated he observed a vehicle in the path of the bicycle. O'Hearne stated the vehicle did not stop after the bicyclist fell and took a right onto Paulson Road from Beacon Street. O'Hearne stated he followed the vehicle involved in the accident to Commonwealth Avenue, and while doing so took a picture of the vehicle's license plate. O'Hearne stated he did not observe who was driving the vehicle. The Massachusetts registration provided to me by O'Hearne is 7BS322. This vehicle comes back to a 2010 Volkswagon Jetta registered to Peter Giorgi (S20952090) out of Paxton, Ma. I spoke with Peter via telephone. Peter acknowledged he is the registered owner of the vehicle, but stated his daughter was using the vehicle and was in the Newton area. I spoke with Lindsey Giorgi (S35711247) via telephone. Giorgi stated she was operating MA: 7BS322 in Newton yesterday, but does not recall being in an accident. Giorgi stated she is not familiar with the area and does not know the area where the accident occurred. Giorgi stated there is no damage to her vehicle and stated she does not believe she hit anyone. Giorgi emailed me 4 photos of her vehicle where I described the damage would be. I observed a small area of minor damage to the rear passenger side door area of this vehicle. After speaking with all parties involved, I am requesting a hearing in Newton District Court for Chapter 90, Section 24 (Leaving the Scene, Personal Injury). Giorgi was advised and mailed Massachusetts Uniform Citation T1269847. Jordao stated he opened his driver door to exit his vehicle when a passing bicyclist crashed into the door. Jordao stated he did not look back at traffic prior to opening the door. Jordao stated the bicyclist fell to the roadway. I observed moderate damage to the driver side door and it was unable to close as a result of the collision. I spoke with the injured bicyclist, Leonard Engel (S53573803). Engel stated he was operating his bicycle Westbound on Beacon Street in the travel lane. Engel stated a vehicle to his right opened it's driver door into the roadway and he was unable to avoid hitting it. Engel stated he fell over the top of his handlebars and onto the roadway. Engel stated he injured his right shoulder/arm/neck area and his right ankle. Engel also had a small injury to his left knee. Engel stated he does not believe he hit his head as a result of the accident. Engel was wearing a helmet, I observed some scratch marks on it. Engel signed a patient refusal with Newton Medics. I observed damage to the rear tire area of Engel's black and green Giant bicycle. There was also damage to chain/pedal area. Engel's estimated the value of the bicycle at $4,000.00 USD. Massachusetts Uniform Citation T1271041 was mailed to Jordao for Chapter 90, Section 14 (Open car door into traffic). Tody's responded the removed MV1 from the roadway. I spoke with the operator of MV1, Paige Mahoney (S85200426). Mahoney stated she was stopped in traffic at a red light on Beacon Street (W) at Washington Street in her 2018 black Volkswagon Tiguan (MA: 633MV6). Mahoney stated while her vehicle was at a complete stop, she felt and heard something hit the rear of her vehicle. Mahoney exited her vehicle and saw a bicyclist on the roadway. I observed minor damage to the rear middle bumper area of MV1. There was a small amount of blood present on the damaged area. I observed the roadway where the accident occurred. There was a small pool of blood in the left lane of Beacon Street (W) where the bicyclist fell to the roadway. The area of the roadway where the accident occurred is currently undergoing restoration and the asphalt has been graded down to it's sub base in preparation to be resurfaced. The current road surface condition is bumpy and uneven. The area where the roadway goes from a smooth surface to a bumpy surface is where the accident occurred. The injured bicyclist was identified as Timothy Johnson (S29270605). I spoke with him in the Newton Wellesley Hospital emergency room. Johnson stated he was operating his bicycle Westbound on Beacon Street on the right side of the left lane. Johnson stated he was coming to a stop in traffic at a red light when his wheel abruptly turned to the left and he began to fall over. Johnson stated his head hit the back of a vehicle stopped in front of him and he landed on his right side, with his bicycle landing on top of him. As a result of the accident, Johnson suffered an injury to the right side of his head and had scrapes on his right arm. Johnson stated he did not lose consciousness as a result of the accident and he appeared to be alert and orientated while I was speaking with him. Johnson was wearing a helmet at the time of the accident. There were fresh markings on the right side of the helmet with minor black paint transfer. These markings are consistent with Johnson's statement that he fell into the back of MV1 and hit his head. Johnson's bicycle was removed from the roadway prior to my arrival and was being stored in the driveway of 2044 Beacon Street by the resident there. I observed no obvious damage to Johnson's bicycle. After speaking with all parties involved and examining the roadway where the accident occurred, it appears that the condition of the road surface contributed to Johnson losing control of his bicycle and crashing into the rear bumper area of MV1 while it was stopped in traffic. Additionally, I noted MV1 struck MV2 (MA Pass: 5CN826), which was parked on the road in front of the tree/aforementioned address. MV1 sustained damage to its front clip and was leaking fluids. MV2 sustained damage to its right rear bumper/quarter panel area. Upon speaking with the operator of MV1, an employee of Tony's Auto Services, he stated that he was test riding the vehicle after they made repairs to its power steering system. He stated that as he traveled eastbound on Watertown St. at approx 30MPH, the vehicle's brakes failed and he guided MV1 towards the tree in an attempt to stop it without injuring anyone. Todys Services took custody of MV1. Newton Fire cleaned up the leaking fluids and the operator of MV1 signed a patient refusal with Newton Medics. Newton Dispatch notified the city to see if they wished to inspect the tree which was still freestanding and appeared to only suffer minor damage. Tony's Auto Services notified the owner of MV1 and I notified the owner of MV2 of the crash. I submitted a picture of the tree to IT to be attached to this report. Operator MV2 stated that she stopped at the stop sign and began inching forward past the crosswalk to see southbound on Walnut St so she could safely turn right(north) onto Walnut St. She did not see MV1 turning onto Dexter Rd. I asked her if she was injured and she stated she was shaken up and she has a past spinal/disk injury. I requested a BLS to evaluate her at the scene(signed refusal) I spoke with witness Gabrielle Wachman 857-204-4144. He was stopped southbound on Walnut St at Dexter St due to traffic. He observed the City truck which was behind him turn left onto Dexter and strike MV2. . He did not see if MV2 stopped at the stop sign. He only saw that she was moving forward past the crosswalk at the time of the MVA. Ida Street for a report of a 3 car motor vehicle crash with entrapment. The weather at the time of the crash was clear and sunny. The road surface was dry. Centre Street and Mt. Ida Street are both public ways maintained by the City of Newton. On arrival, I was updated by Sgt. Chisholm that one of the vehicles (MV3) had a female operator that was entrapped as a result of the collision. She was freed from the vehicle by the Newton Fire Department and transported to Beth Israel Hospital. Another operator (MV2) was transported to Newton Wellesley Hospital with minor injuries. A third operator (MV1) remained on scene with no injuries. With the assistance of Officer Wade we conducted a survey of the crash scene. We observed a large debris field at the intersection of Centre Street and Mt. Ida Street with debris from all three vehicles. The point of impact was observed to be on Centre Street (N) before Mt. Ida Street. There were fresh scrapes in the pavement as a result of the colission. We also observed skid marks from MV1 measuring 57 feet 8 inches from the start of it's skid to the vehicles final rest MV1 crashed into the rear of MV2. The impact caused MV2 to enter the Southbound travel lane of Centre Street and crash into MV3 as it was passing by. The impact from MV2's front end crashing into MV3's driver side resulted in the operator of MV3 becoming entrapped. MV2 and MV3 came to final rest on Wesley Street (W) at Centre Street (S). The driver door of MV3 was inaccessible. The collsion resulted in air bag deployment for MV2 and MV3. I observed moderate damage to MV1's front grill/bumper area. I observed substantial damage to the front and rear of MV2 and substantial damage to the front and driver side of MV3. Tody's responded and removed MV2 and MV3 from the roadway. Photos were taken of the scene and submitted to the IT Bureau. Officer Martin of the Watertown Police Department was requested by Sgt. Lee to respond to the scene and assist with a commercial truck inspection of MV1. Officer Martin contacted Trooper Grey of the Massachusetts State Police Truck Team who also responded to assist with the truck inspection. Sgt. Lee remained with Officer Martin and Trooper Grey during the inspection. MV1 was relocated to Richardson Street for the inspection. Trooper Grey determined the truck was in compliance with all required paperwork and it passed it's mechanical inspection. MV1 was removed from the roadway by a state tow. I spoke with the operator of MV1, William Tisbert (S24792655). Tisbert stated he was operating a 2006 KW W900 Semi Truck (NH SEMI: AP2638) Northbound on Centre Street. Tisbert stated as he was approaching Mt. Ida Street, a vehicle came out of no where and he hit it. Tisbert stated there was no one in front of him and then a vehicle came off of a side street (Mt. Ida Street) and attempted to turn left in front of him to return to the side street. Tisbert stated he could not avoid hitting the vehicle. Tisbert crashed into the rear of MV2. MV2 then crossed into the opposite lane and crashed into another vehicle. Tisbert remained on scene and reported no injuries. Tisbert stated he was wearing his seatbelt at the time of the accident and was not distracted. Tisbert later admitted to crashing into the rear of MV2. I spoke with the operator of MV2, Janet Vanbuskirk (S59829146), at Newton Wellesley Hospital. Vanbuskirk stated while operating her 2004 Toyota Highlander (MA: RS 529Y), she was stopped on Centre Street (N) at Mt. Ida Street. Vanbuskirk had her left directional on and was waiting for traffic in the Southbound lane to clear to take a left turn onto Mt. Ida Street. Vanbuskirk stated MV1 crashed into the rear of her vehicle. As a result of the impact, Vanbuskirk's vehicle traveled into the opposite lane and crashed into the driver side of MV3. Vanbuskirk reported minor injuries to her neck, left arm, and right hand. I spoke with the operator of MV3, Madeleine Karolian (S23979811), at Beth Israel Deaconess Medical Center in Boston. Karolian stated she was operating her 2016 Toyota Prius (MA: EV5746) Southbound on Centre Street. Karolian stated MV1 crashed into MV2, and MV2 crashed into her vehicle. Karolian stated she did not have time to avoid the collision. Karolian stated she had minor injuries to her neck and chest. Karolian's vehicle had a dash cam recording at the time of the accident. I viewed the footage with her through an app on a cell phone. The footage shows MV3 traveling Southbound on Centre Street on August 8, 2019 at 1308 hours. Ahead of MV3 in the Northbound lane, MV2 is seen stopped on Centre Street before Mt. Ida Street with it's left directional activated. I observed MV1 travel Northbound on Centre Street and crash into the rear of MV2. The impact caused MV2 to enter the Southbound travel lane and crashed into the driver side of MV3. The footage then ends. A copy of the footage was emailed to my work email. The footage was then forwarded to IT Director Steve Smith to be added to the media for this report. She took a photo of MV2 which was a black Toyota Highlander bearing MA reg.# R85045. She described the operator as a white female in her forties with possibly dark curly hair. I observed minor paint damage and scratches to the driver's side rear quarter panel area. The operator is unsure if that damage is from the accident. The owner of MV2, Steven Masterson has a residential address of 40 Wild Acres Rd in North Attleboro, MA and a mailing address of 34 Central Street Foxborough, MA. A telephone search revealed a phone number of (269)857-7814 for him out of Aiken, SC and the Foxborough address but the number is not in service. UPDATE: I was provided a phone number for Masterson from N. Attleboro PD. On 08/16/19 at 12:45 hours, I spoke to Sheila Masterson who stated she was driving MV2 at the time of the reported accident. She stated that she was unaware that she struck MV1 and saw the other operator looking at her but thought nothing of it. Due to the accident being very minor or possibly no damage at all, no further action will be taken. I spoke with the bicyclist who stated he was traveling westbound on Washington street and was crossing over Dunstan street when he was struck by MV1. He stated he was knocked off the bike, scraped his arm, and had minor back pain. The mirror on the right side of his bike was broken. The bicyclist was wearing greenish gray clothing, and was not wearing protective equipment such as a helmet. The bicyclist signed a refusal from Cataldo and was given a copy of the report number. MV1 was towed by towed by Tody's. Gonzales was transported to Beth Isreal in critical condition. When Gonazales was in the back of the ambulance, myself and medics smelled an odor of an alcoholic beverage emanating from Gonzales. All first responders thoroughly checked the surrounding area for a helmet but one could not be located. Due to Gonzales' critical condition and urgency to get to the hospital, and ID was not thoroughly looked for on his person. Ofc. Guarino, N491, retrieved an ID from Gonzales upon arrival at Beth Isreal Hospital. Ofc. Stake filled out a towed inventory form. Pictures taken and sent to IT. Sgt. Lee was notified and will be following up with this incident. Due to Gonzales' hospitalization, the citations will be mailed to his last known address. The driver took out his headphones and said sorry before driving away. RP stated that he told the driver that he had been hit but the driver just drove away. RP went to hospital (Faulkner) on his own for lower back pain and has not been to work since. RP was able to take picture of the side of the delivery van. The van belonged to Shortstop Distribution Inc (508-655-5948). RP left a message that morning. He was texted by Gedeon (786-352-6695) who stated there was a language barrier and he didn't understand what had happened. RP advised Gedeon to talk to his lawyer or the police. Traffic Bureau Update (Officer Gaudet): On Monday, September 9, 2019 I attempted to make contact with the operator if MV1, Gedeon Duarte, with a negative result. A Hit and Run motor vehicle inquiry was mailed to Duarte. I spoke with the injured party, Kevin Coston, via telephone on September 9, 2019. Coston stated he is an employee at the Whole Foods located at 916 Walnut Street, Newton. Coston stated on August 23, 2019 a black van backed into him as he was kneeling on the ground taking off his knee pads in the loading area of the store. Coston stated he approached the driver who remained in the vehicle to speak with him after he was hit. Coston described the driver as a heavy set Spanish male. Coston stated the operator of the vehicle rolled down his window, took his headphones out of his ear, said sorry, and left the area. Coston stated he contacted the Newton Police to report the accident but was told he needed to come in person to file the report. Coston stated he was unable to come to the station to file the report until September 8, 2019. On Friday, September 13, 2019, I spoke with Gedeon Duarte at the Newton Police Department. Duarte stated he spoke Portuguese and did not speak English. With the assistance of David Sargent from the Language Line (1-800-225-5254) translating, I was to speak with Mr. Duarte in the Traffic Bureau. Duarte stated he was making a delivery at Whole Foods and was waiting for another truck to leave so he could leave the area. Duarte stated a male party (Coston) came up to his driver door and was yelling him. Duarte stated that due to language barrier he was unable to understand what the person was saying to him, but stated the male party was yelling, ""Fuck you! Fuck you!"" Duarte stated he did not know what was going on and stated he left the area to allow the male party to calm down. Duarte stated he returned a minute later the male party did not want to speak with him. Duarte stated he returned a second time later in the morning and Coston was not there. Duarte stated he received a call from his employer stating Kevin Coston had called for him and he was provided with Coston's phone number. Duarte stated he texted Coston to find out what happened that morning. Duarte showed me a text message exchange from August 23, 2019 at 9:03 A.M. between himself and a party listed as ""Kevin Whole"". In the text messages, Duarte stated he is the driver of the van and that his supervisor called him. The other party responded and stated ""Talk to the police and my lawyer"". Duarte stated that he did not understand what happened and that he returned to whole foods. Duarte ended the text exchange with ""927535425 my number of policy..."" Duarte stated he had no idea he made contact with Coston and stated at the time of the alleged accident he did not hear/see/feel anything otherwise he would have stopped. Duarte's information has been updated in this report to reflect him as the operator/vehicle involved. I spoke with the bicyclist involved in the crash, Steven Greenzang (S96615185). Greenzang stated he was traveling Westbound on Beacon Street in the shoulder lane on his black Specialized bicycle. Greenzang had a yellow reflective vest on and was wearing a helmet at this time. Greenzang stated a vehicle in the travel lane to his left drove by him and hit the mirror located on his left handlebar. I observed damage to the mirror. Greenzang report no injuries. I spoke with the operator of MV1, Sarah Bonfanti (S66811372). Bonfanti stated she was parked in front of 1411 Beacon Street waiting to pick up a co-worker that resides at that address. Bonfanti stated a bicycle traveling on the sidewalk to her right crashed into the passenger side door mirror of her 2008 Toyota Scion (MA: 681YH1). Bonfanti stated the bicyclist was acting ""crazy"" during her interaction with him and he was trying to take her picture. Bonfanti stated she got back into her vehicle and moved up the roadway to wait for police to arrive on scene. I canvassed the area where the accident occurred with Sgt. Dempsey. There was glass from the passenger side mirror of MV1 and Greenzang's bicycle in the main travel lane of the roadway and the shoulder lane where Greenzang stated he was traveling. We also observed a large tree and a telephone pole on the sidewalk next to the roadway where the accident is alleged to have occurred. After speaking with all parties involved, observing the location of the glass in the roadway from the crash, and the location of the tree and telephone pole on the sidewalk where he accident occurred; Greenzang would not have been able to operate his bicycle on the sidewalk and be close enough to the roadway to make contact with MV1. Prior to clearing the accident, I asked Bonfanti if she had any questions and if she wanted to report any injuries. Bonfanti stated she was hit by the bicyclist during her exchange with him and began grabbing her left leg. I asked Bonfanti why she did not inform the officers on scene that she was assaulted. Bonfanti stated she said something to our Dispatch when she called. I asked Bonfanti if her leg was injured. Bonfanti stated I was putting words in her mouth and that she was just scratching her leg. Bonfanti then stated she was hit in the right shoulder. I asked Bonfanti if she would like an ambulance to respond and evaluate her. Bonfanti declined and stated she was more concerned about her mirror. I advised Bonfanti if she wanted to pursue charges against Greenzang she could do so in Newton District Court. I listened to the 9-1-1 recording Bonfanti made in regards to this incident. Bonfanti stated a pedestrian busted out her window. Bonfanti then stated to our dispatcher that the bicyclist lost control of his bicycle and smashed into her car. Ross stated that she did not see Baron in the marked crosswalk. Charles Hannum was a front seat passenger in vehicle one and stated that he did not see Baron in front of the vehicle until the crash occurred. Upon arrival I observed a City of Newton public works truck MA REG: M68227 front end crashed into a utility pole and small tree. The truck also had a trailer attached MA REG: M67846. The operator of the city vehicle identified as Rodolfo Marquez (S77096565) stated the vehicle was parked on the corner of Fairfield Street at Bolton Road with its hand break activated and a chock block under the rear right tire. Rodolfo stated he was attempting to load a bobcat onto the trailer when the truck must have released from the hand brake and crashed head on into a utility pole and small tree. The area in which the truck was parked on and point of impact are both on a downward hill. The impact from the truck into the utility pole caused a cable wire that was afixed to 36 Fairfield Street to be ripped from the house causing minor damage to the home. The city tree and utility pole also had minor damage. I spoke to the homeowner of 36 Fairfield Street identified as Nicholas Morgan. Nicholas was made aware of the damage to his house and damage to the front lawn from the vehicles tires. No injuries were reported and several photographs were taken of the vehicle and the damage to the house, lawn, city tree and utility pole. Verizon was notified to respond for a down cable wire. MV#1 sustained heavy driver's side front end damages. Both front airbags were deployed. The operator of MV#1 stated he was not injured. The front passenger of MV#1 was not injured and had already left the scene to attend school. The driver's side rear passenger sustained a bleeding nose from this accident. She was unsure what caused her injuries because it happened too quickly. She was evluated by Newton Paramedics and signed a patient refusal of treatment. The initial point of impact for both vehicles was in the middle intersection of Commonwealth Ave at Morton St. There were broken vehicle parts and tire skid marks starting from the point of impact and onto the berm on Commonwealth Ave on the carriage lane side. MV#2's final resting spot was directly accross from 808 Commonwealth Ave. MV#2 sustained heavy front end damages to its driver's side wheel (Broken axle) and flat front right side tire. MV#2's driver's side airbag was deployed. The operator of MV#2 was transported by Newton Paramedics to the Boston Medical Center. I spoke to the operator of MV#2 via telephone and she stated she was travelling westbound on Commonwealth Ave when she was struck by MV#1 and caused her swerve onto the carriage lane berm. The operator of MV#1 is 6.5 months into her pregnancy and sustained neck, back, bruises and left hand injuries. She was transported to Boston Medical Center and was later discharged the same day. She was provided with this accident report number and was advised to contact her insurance provider. I spoke to the witness who was at the intersection of Cedar St and Commonwealth Ave. The witness stated MV#1 was travelling eastbound on Commonwealth Ave and had stopped, attempting to make a left turn onto Morton St. The witness stated she then observed MV#2 travelling westbound on Commonwealth Ave and struck MV#1. The witness stated she believed MV#2 was travelling at a high rate of speed because it continued to travel onto the berm after striking MV#1. I took digital photographs of the damaged berm on Commonwealth Ave. Based on the statements made to me, I issued in hand to the operator of MV#1 citation #T1268357 for violation of c89 s8 failure to yield when turning left. I spoke to the bicyclist involved (Unit 2), Michael Hnatko (S10432772). Mr. Hnatko stated he was traveling northbound on Centre Street on the right side of the road on his 20 inch gray Trek bicycle. He further says that he was peddling very fast at the time and must have not been paying attention to MV1 turning right in to parking lot of 1330 Centre Street as he was approaching from behind. As MV1 was turning right, he then struck the passenger side rear quarter panel of the vehicle and fell forward off of his bicycle. He sustained minor injuries such as scrapes to his knuckles on both hands and a small cut to the bridge of his nose. He signed a patient refusal with Cataldo Ambulance. It appeared that the front alignment was now off on his Trek bicycle. I then spoke to the operator of MV1, Lonnie McGinnis (S66044083). He states that he was inching along in heavy traffic waiting to turn right in to the lot of 1330 Centre Street with his right turn directional signal on. As he was turning right, the bicyclist struck his vehicle on his passenger side rear quarter panel area. McGinnis thought it was clear to turn right at the time and never saw the bicyclist approaching from behind. Crafts Street and Albemarle Road are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Jussara Pontes (S92930243). Pontes stated she was operating a 2017 Toyota Sienna (MA: 4GX777) at the time of the crash. Pontes stated she was traveling North on Albemarle Road and came to a stop at the stop sign located at the Crafts Street intersection. Pontes stated she looked both ways and began to inch out into the roadway. Pontes stated she stopped the vehicle again and was assisting a child sitting in the 2nd row of the vehicle. Pontes stated she then turned her attention back to the roadway. Pontes stated she looked to her right and left again and did not see any vehicles in either direction. Pontes stated she proceeded to cross the intersection to continue North on Albemarle Road. Pontes stated the front bumper area of MV1 crashed into the left side of a passing motorcycle. Pontes stated the motorcycle and it's operator fell to the roadway and slid across the street to the side of the road. Pontes stated she pulled her vehicle over onto Albemarle Road. Pontes stated she did not see the motorcycle prior to the crash and was not distracted. The operator of the motorcycle (MV2), Irene Pistoftzian (S06099449) was transported to Brigham and Women's Hospital with a serious left leg injury prior to my arrival. I observed a red 1990 Kawasaki ZR550 (MA MCN: 1V1063) resting on it's right side on the NE sidewalk area of Albemarle Road at Crafts Street with it's front wheel/handlebar facing Crafts Street. The motorcycle had moderate damage to it's left side from the impact of MV1 crashing into it. The right side of the motorcycle had damage from sliding on the roadway and the crashing into a fence on the sidewalk on Crafts Street (W) at Albemarle Road. There was also damamge to the front headlight/right handlebar area. The motorcycle and Toyota Sienna were towed from the scene by Tody's towing at Sgt. Lee's request. Pictures were taken of the scene and submitted to the IT Bureau. I spoke with Pistoftzian at Brigham and Women's Hospital in Boston on Monday, September 30, 2019. Pistoftzian stated she was operating her motorcycle on Crafts Street (W). Pistoftzian stated as she approached the intersection of Crafts Street and Albemarle Road, she observed a mini van to her left out of her peripheral. Pistoftzian stated she remembers being hit on her left side and then laying on the roadway looking up at the sky on the sidewalk with her head facing Albemarle Field. Pistoftzian stated as a result of the crash she has a significant injury to her left leg and also has an injury to her left wrist/arm. Pistoftzian stated she was wearing a helmet at the time of the crash. I spoke with Kymberley Mitchell via telephone who stated she witnessed the crash. Mitchell stated she was traveling behind the motorcycle involved in the crash on Craft Street (W) at North Street. Mitchell stated they were stopped at a red light at this time. Mitchell stated there were no vehicles in front of the motorcycle at the light. Mitchell stated the light turned green and they continued on Crafts Street at a low rate of speed. Mitchell stated she could see ahead at the intersection of Albemarle Street and Crafts Street, traffic was stopped on Crafts Street (E) letting traffic exit Albemarle Road (N). Mitchell stated vehicles were taking left and right turns out of Albemarle Road before the motorcycle reached the intersection. Mitchell stated a mini van was crossing past the double yellow line of Crafts Street to continue straight when it crashed into the left side of the motorcycle. I spoke with Cheryl Wermer via telephone who stated she witnessed the crash. Wermer stated she was traveling on Crafts Street (E) towards Albemarle Road. Wermer stated traffic ahead of her was stopped to allow vehicles to turn off of Albemarle Road. Wermer stated she observed a motorcycle traveling towards her on Crafts Street (W). Wermer stated she then saw a vehicle travel straight from Albemarle Road across Crafts Street and crash into the motorcycle. Wermer stated the operator of the motorcycle flew off the bike. Wermer stated the car then came to a stop and the driver got out and stated ""Oh my god! I didn't see you!"" Wermer stated both vehicles were traveling at a low rate of speed prior to the crash. I spoke with Bill Frabizio via telephone who stated he witnessed the crash. Frabizio stated he was behind the mini van (MV1) on Albemarle Road prior to the crash. Frabizio stated the vehicle in front of him began to cross the intersection as he was monitoring the traffic on to take a right turn onto Crafts Street. Frabizio stated he heard a loud ""Boom"" and saw a motorcycle slide across the street with its operator. Frabizio stated the motorcycle crashed into a fence post and the operator came off the motorcycle. Frabizio stated he pulled over and assisted operator of the motorcycle. OPERATOR OF VEHICLE #2 WAS GIVEN MOTOR VEHICLE CITATION ( T1445177, 89/9, FAILURE TO YIELD AT INTERSECTION ). OPERATOR SERVED CITATION IN HAND. I SPOKE TO A WITNESS ( TIMOTHY CHANGOGARRETT ). HE STATED HE WAS TRAVELING E-BOUND BEHIND THE MOTORCYCLE. HE SAW VEHICLE #2 ENTER THE TRAFFIC LANE AND VEHICLE #1 HIT HER VEHICLE. HE STATES THE OPERATOR OF VEHICLE #1 WENT OVER HIS HANDLE BARS UPON COLLISION. LANDED ON THE HOOD OF VEHICLE #2 AND THEN FELL TO THE GROUND. AT THIS POINT HE CALLED 911. HE STATES HE TOOK HIS SON'S MOTORCYCLE WITH THE INTENTION OF SEEING IF THERE WERE ANY REPAIRS NECESSARY BECAUSE HIS SON IS TRYING TO SELL IT. WHILE TRAVELING HE APPROACHED THE INTERSECTION. HE SAW VEHICLE #2 ENTER ONTO CRAFT ST. HE STATES HE COULD NOT DIVERT AND HE WAS UNABLE TO AVOID HITTING HER VEHICLE. OPERATOR HAS BROKEN BONES IN HIS LEFT ARM. When the cyclist was asked if he had stopped at the intersection he stated he was not sure if he stopped or just slowed down. When asked if he came to a complete stop and placed a foot onto the ground, the cyclist stated no. The cyclist stated normally when he stops he just balances in place and doe not take his foot off the pedals. When I asked the cyclist if he passed other vehicles on the right to get up to the intersection he stated yes, he normally does so. It should be noted there is no dedicated bike lane and both streets are narrow at this intersection. MED2 transported the cyclist to NWH for his arm injury. I took pictures of the roadway as well and the bicycle and motor vehicle 1. There is no dedicated bicycle lane in this area but there are bicycle indicators painted on the roadway to make drivers aware of bicyclists traveling. I spoke to the bicyclist involved (Unit 2), Marvin Goldman (S67373495). Goldman was wearing a helmet, gray sweatshirt, gray shorts, and black/orange reflective sneakers. Mr. Goldman stated that he was traveling southbound on Centre Street on the right side of the road on his black Fuji Sagres bicycle. He further says that he was peddling fast at the time while crossing over Nathan Road and that is when he suddenly struck Unit 1 on it's passenger side front quarter panel/door area. He does not recall any other details of the incident along with Unit 1 attempting to turn left towards him. Goldman sustained scraped up knees and a small laceration below his left eye. He refused medical attention signing a patient refusal with Cataldo Medic One. I observed that his front wheel was bent as a result of the accident. The rest of the bicycle appeared to be intact. I then spoke to the operator of Unit 1, Darlene Martins (S27966454). Ms. Martins spoke with the assistance of Ofc. Calderon who was translating for her. She says that she was traveling northbound on Centre Street and was attempting to turn left on to Nathan Road in order to turn around and travel the other way on Centre Street. She says that a vehicle in the southbound travel lane left space for her to make her left turn. She then proceeded to turn thinking it was clear and that is when the bicyclist suddenly approached and struck her on her passenger side. She also stated that it was hard to see past the congestion of vehicles waiting in the southbound travel lane. I observed scratch marks and a dent to her passenger side front quarter panel area along with minor scuff marks to her front passenger door. The scuff marks appear to be from the bicyclist rubbing against the vehicle. I also observed a dent on the top of the passenger door frame. It is unknown if the damage is the result of the accident or old damage Ofc. Calderon spoke to Rosangela Dias (Passenger in Unit 1), who stated that everything happened so quick but she never saw the bicyclist approaching when Martins attempted to turn left. I then spoke to a witness on scene identified as Matthew Miner. He says that he was two vehicles behind an unknown vehicle in the southbound travel lane of Centre Street. He says that the unknown vehicle left space for Unit 1 to turn left and waved Unit 1 on to turn left. He does not recall what transpired with the bicyclist. As a result of the accident, it was determined that Martins did not yield the right of way to the bicyclist while she was turning left. She also does not have a license to operate in Massachusetts or any other state. She was issued MA Uniform Citation # T2012393 for Ch. 89/8 Failure to yield and Ch. 90/10 Unlicensed Operation of a Motor Vehicle. Iliades stated that the she observed the Subaru's front drivers side strike several orange plastic three foot poles that are affixed to the roadway around the crosswalk. Iliades stated that after the Subaru struck the poles at the crosswalk it veered towards her. Iliades stated that she leaned back into the back seat of her vehicle and pulled the door towards herself as the Subaru's passenger side mirror made conact with her vehicle. Iliades stated that the Subaru continued north bound on Walnut St without stopping or slowing. Iliades complained of lower leg pain and refused medical aid or transport to a hospital at the crash scene. I observed no damage or markings on Iliades vehicle. MA reg 8EP212 is registered to Harilaos Papadogiannis ( DOB 01/02/1941 ) of 134 Apt 4 North St , Newton. I went to 134 North St and found MA reg 8EP212 a 2014 Subaru parked in the lot of 134 North St. I observed that the Subaru's passenger side mirror was lose from it's mounting and was turned down and was facing the wrong way. I further observed that the out side casing of the Subaru's mirror had scuff marks consistent with it forcefully making contact with an other object. I spoke with Papadogiannis who stated that he was driving his Subaru north bound on Walnut St at 11:56 hours on 10/23/2019. Papadogiannis stated that he could only recall striking the plastic poles near the crosswalk and nothing else regarding the crash. I as spoke with Papadogiannis he was confused and I had to repeat myself and my questions to him several times. I instructed Papadogiannis what steps he needs to take regarding filing out an operator crash report and contacting his insurance provider , but I believe that he did not fully comprehend what I was conveying to him. Based upon my observations at the crash seen and my conversations with Iliades and Papadogiannis , I believe that Papadogiannis was at fault for the crash. We observed the motor vehicle drive around a pedestrian in the crosswalk who was attempting to cross at Centre St and Pelham St. I activated my emergency blue lights and attempted to conduct a motor vehicle stop of the Toyota Corolla. The operator continued to drive northbound on Centre St before pulling over just before the crosswalk at Centre St and Pleasant St. The operator then continued driving forward and struck a pedestrian crossing in the crosswalk Officer Selig and I saw the pedestrian being struck before landing on top of the Toyota Corolla hood, and falling forward onto the street. Officer Selig and I spoke with the two parties involved. I spoke with the victim, who was identified as Vivian Rubinstein (Vivian). Vivian crawled towards the sidewalk of Centre St while clutching her lower back. Initially Vivian denied being injured and refused medical aid. The Toyota Corolla operator was identified as the register owner Elise Ruben (Elise). Elise stated to Officer Selig that her front windshield was foggy and when she noticed the blue lights, she attempted to pull over. Elise stated she did not see the pedestrian in the crosswalk. Elise appeared very upset and refused medical treatment. Officer Selig was able to speak to two witnesses of the accident. The witnesses were identified as Stephan Aparicio (Stephan) and Mikaela Rice (Mikaela). Stephan said he was behind the victim in the same crosswalk. Stephan stated he saw the Toyota stop in front of the crosswalk and then drove forward hitting the female. Mikaela stated she was parked in her motor vehicle on Centre St facing northbound (facing the crosswalk). Mikaela stated she saw the female walking halfway across the crosswalk and the Toyota continuing drive forward before hitting the female. The operator of the bicycle, Ezra Robison (S83132607), was transported to Newton Wellesley Hospital with a leg injury prior to my arrival. I observed damage to the front and rear wheels on the Robison's bicycle on scene. Robison's bicycle was transported to the Newton Police Station for safe keeping. I went to Newton Wellesley Hospital to obtain a statement from Robison but he was discharged prior to my arrival. I spoke with Robison at his residence later in the day. Robison stated he was operating his bicycle on the Commonwealth Avenue carriage road (E) towards Cedar Street. The Pedestrian appeared to suffer an injury to his arm and his body and was transported to Beth Israel by Cataldo. The Witness stated he did not see the crash, but just prior to it he saw an unknown vehicle driving at a high rate of speed northbound on Parker St. and the vehicle may have beeped at the pedestrian in the crosswalk causing him to step back into the southbound travel lane where the crash happened. The parking lot is a public/thru way that motorists use to access the Star Market along with other businesses. The weather at the time was cloudy and rainy and the parking lot was saturated. Prior to my arrival, the pedestrian involved left the scene and did not want to speak to the officer nor wanted medical attention. Ofc. Claflin then cancelled Cataldo Ambulance. The pedestrian, Mary Alexander, left her information with a store employee prior to leaving. I spoke to the operator of MV # 1 (Joshua Randel MD Lic.# R534440603244) who stated that he was travelling through the third row of the Star Market parking lot at an appropriate speed. He was then attempting to make a left turn near the entrance/exit of the store. He says that there was a large white van parked in the end handicapped spot towards the left of him. He says the van was sticking out in the spot limiting his visibility. As he was half way through his left turn and coming around the corner, he was not able to see a pedestrian pushing a shopping carriage. He then struck the carriage that was being pushed by Mary Alexander. He further says that the cart jolted Ms. Alexander and she fell down to the ground. At the time, Alexander was walking through the lot near the store entrance heading back towards the parked cars. She was not in the crosswalk at the time which was approximately ten feet down from her location. After, I attempted to go to Ms. Alexander's residence to follow up. I spoke to her friend who was bringing up Alexander's groceries and she stated that she decided to go to Newton Wellesley Hospital for treatment. I then spoke to Ms. Alexander in the lobby of the hospital. She stated that she was exiting the store through the lot with her shopping carriage. She believes she was approximately eight feet away from the door when all of a sudden she only saw red coming at her. She believes MV # 1 was speeding at the time. I asked her if she was struck by the vehicle or was the shopping carriage only struck. She replied that she did not know and only remembers falling to the ground after. She sustained a large bruise to the inside palm area of her right hand and her left knee was swollen. Digital photos of the scene were taken and pictures of Ms. Alexander's injuries were taken at the hospital. As far as possible video surveillance, I was told that the Loss Prevention Department has to access the video. On 11/13/19 at approximately 14:20 hours, I went in to the Star Market and spoke to the manager, Nidal Rajeh, inquiring about possible video surveillance. He said there is coverage in the parking lot and he was able to show me the video. A copy of the video would have to be done by Loss Prevention which I requested. I observed at the 12:12pm mark in the video, MV # 1 was parked five spots up from the third row of the lot that he was exiting. I also observed a white transport van parked in the end handicapped spot mentioned by the operator but it was parked correctly and not limiting visibility. Next, MV # 1 backs out of the spot and drives forward going at a reasonable speed. The pedestrian (Alexander) has already exited the store with her carriage and is walking at an angle toward the same third row of parked cars. As the pedestrian is walking towards the direction of MV # 1, it appears that the pedestrian should be visible to him. MV # 1 then starts to take the left turn around the corner without slowing or stopping and strikes the carriage head on. Due to the impact, Alexander then loses grasp of the carriage and it goes past her twisting her body around. She then hits and rolls up on the hood of the vehicle on her left side. MV # 1 then suddenly stops and immediately gets out and provides assistance to the pedestrian. I asked Elmer what happened, and he stated that he and the other man with him, identified as Ricardo Deras, were in the rear seat with another male party, and that there were two other parties in the front seat, one of them was driving, he was not able to provide me with a name of who was driving. I asked him where everyone else was, and Elmer stated that after the crash, the got out of the car and ran away. At this point, medics arrived on scene and began to tend to Ricardo. I next spoke with the owner of MV#2, Jim Silva. Jim stated that he was in his home when he heard a loud crash. Jim stated that he came out of the house in time to witness the two males I was speaking with looking at the car, and he also stated that he observed three parties walk away from the scene, two heading east on California St, and one heading north on Fair Oaks Ave. MV#1 and MV#2 were towed off scene by Todys. Due to the scene, and the location of the cars in a busy street, I was not able to do a MV inventory of MV#1 until after it was towed by Todys. The inventory was done at Todys Service station, and a MV inventory sheet was filled out and placed the in appropriate box. I took three pictures of the damaged tree and submitted them to IT to be attached to this report. While I was taking the pictures of the tree, two males were walking past the scene. I stopped both parties and questioned them about the incident. They stated that they had been in the car, but had not been driving. I asked them if the knew who the driver was, and they told me that they did not know the name of the driver. Due to no witnesses observing the driver and all parties stating that it was someone else, I was not able to determine a driver of the vehicle. Units checked the area for the fifth party in the vehicle with negative results. Ricardo was transported to NWH hospital by medics. All other parties were sent on their way. All units cleared without further incident. **UPDATE** On Nov 25, 2019 at approximately 1621 hrs, I contacted Westborough Police Department in an attempt to get a hold of Dora. While doing so, he states that MV # 2 came up and passed him on the left to go around the traffic. MV # 2 then clipped his vehicle on the driver's side front quarter panel while passing him. I observed no visible damage to the quarter panel area and scuff marks to the left front rim which possibly were from the accident. Operator of MV # 2 states she was also operating straight ahead eastbound on Brandeis Road awaiting the backed up traffic in front. She states that once there was an opening in the roadway ahead of her, she signaled her left directional and started to pass traffic on the left. While doing so, she says that MV # 1 suddenly pulled out to the left without signaling and struck her vehicle on the front passenger side. I observed minor scuff marks to the front passenger quarter panel area and slight damage to the metal grate footstep on the passenger side. The operator was also transporting two students for the City of Newton through JSC Transportation Services at the time. Both students attend Newton South High School. Operator of the bicyclist (Merissa Brousseau) states she traveling westbound in the bicycle lane on the right side near 215 Needham Street when she observed the large truck mentioned above suddenly stop. She states that she was also visibly blocked from seeing ahead due to the truck. She then kept peddling straight through and struck MV # 1 in the passenger side rear end as it was making its left turn. The operator was evaluated by Cataldo Ambulance but refused medical attention. I observed no apparent damage to the bicycle. Ms. Brousseau was wearing a bicycle helmet, black and red Boston University bicycle suit, and red BU sock covers over her shoes. The witness stated that the truck was moving slowly as he made the turn. The witness stated that as he was making the turn, he observed the side mirror hit the pedestrian, knocking him over. I finally spoke with the pedestrian. He stated that he does not remember getting hit by the mirror of the truck. Multiple pictures were taken of the scene. MV#1 had no visible damage to the vehicle, but the passenger side mirror was pushed back against the door. The pedestrian was transported to Brighams by medics with apparent minor injuries. A Verizon truck was parked facing north in the northbound lane of Chestnut St. and through traffic was being routed up the westbound side of Amherst St. M/V#2 approached traveling south on Chestnut St., and stopped approx. 100 feet away from M/V#1. It then began to slowly drive up to M/V#1 and attempt to pass between the two parked trucks, at a slow speed, when the right fender of M/V#2 struck the towing rig of M/V#1. The right fender of M/V#2 had damage along the right front wheel well. I was unable to see the extent of the damage to the tow rig. I went to speak to the operator of the M+#2 (who was standing outside to the right of his car) and as I approached him, I observed that he was swaying while standing. I asked the operator (later identified as David Taube-Perrotta) if he was ok, and he only said yeah. I then asked him what had happened, and he just motioned to his car with his right hand. As I stood next to him, I observed his eyes to be glassy and bloodshot. I asked him for his license and registration, and he kept staring towards the car without saying anything. I had to request his license and registration three times before he produced his license from a hip pocket. I then asked again for his registration, and he took approx. five unsteady steps to his passenger side door, opened the door, and almost fell into his car as he bent from the waist. He then stood up, closed the door, and started to return to me, until I told him I needed his registration again. He returned to his door, and again, almost fell into the car as he bent over to open the glove box. As he returned to me he appeared unsteady on his feet. He handed me the registration in a plastic sleeve, and I asked him to remove it from the sleeve. He appeared to have trouble removing the registration. I asked him where he was coming from, he stated that he was coming from Cambridge. I asked where in Cambridge, and he did not reply. I asked him if he had any alcoholic beverages during the evening, he shook his head in an exaggerated manner and stated that he didn't drink tonight. As I spoke more with him, I observed that his speech was slurred. I held my pen up and asked him if he could focus on the tip of pen. Instead of answering he tried to reach out and touch it. I advised him, I just wanted to know if he could focus on it, he stated yes, then raised his finger in an attempt to touch his nose, but instead, touched between his upper lip and nose, then tried to touch the tip of the pen again. I asked him to keep his down, and without moving his head, follow the tip of the pen. As I moved the pen from left to right, he turned his head to follow the pen. I had to remind him several times, to keep his head still, and follow only with his eyes. I asked him if he would be willing to take a field sobriety test, and he declined. I had also observed a small scratch on his forehead, and requested medics to evaluate him. As I took digital pictures of the accident, Taube-Perrotta was seen in the back of a Cataldo Ambulance, while Sgt. Devine observed. When I entered the ambulance, Sgt. Devine informed me that Taube-Perrotta stated that he was at ""The Lizzard Lounge"" in Cambridge earlier in the evening, and admitted that he had a few drinks. In my presence Taube-Perotta stated that he had two drinks, much earlier in the evening. While in the ambulance, Taube-Perrotta had trouble answering common questions by the medics, such as what his middle name was and where he lived. I spoke with the injured pedestrian, Lawrence Murren, at Brigham and Women's Hospital. Murren stated he had entered the crosswalk on Lincoln Street at Walnut Street and does not remember if he had the pedestrian signal. Murren believes MV1 did have the green light. Murren stated after he entered the crosswalk he looked back towards the ""59 Bus"". Murren stated he then looked forward and saw MV1 was in front of him. Murren stated he was unable to avoid the vehicle. Murren stated he has an injury to his hip and had a head laceration. I spoke with a witness to the accident, Edward Austin. Austin stated he was in the vehicle behind MV1 at the traffic light on Walnut street. Austin stated the traffic light turned green and MV1 had a green left turn arrow. Austin stated MV1 started to go and make their left turn. Austin stated he observed an older gentleman starting to walk out into the street. Austin stated the pedestrian had his head down and had an umbrella due to the rain. Austin stated the pedestrian also had a do no walk sign. Austin stated MV1 hit the crossing pedestrian in the crosswalk. Austin stated he does not believe either saw each other. The injured pedestrian, Charles Doris-Pierce (S68331436), was transported to Brigham and Women's Hospital in Boston for his injuries. I followed up with him in the Emergency Department. Doris-Pierce stated MV1 was stopped at the stop sign on California Street. Doris-Pierce stated he entered the marked crosswalk and began to cross California Street at Crafts Street. Doris-Pierce stated MV1's right passenger side tire ran over his foot. Doris-Pierce stated he then slammed on the hood of MV1. Doris-Pierce stated MV1 continued and he was knocked to the ground. I spoke with the operator of MV2, Bryan Izaguirre (S64158637). Izaguirre stated he was operating a 2016 Honda Civic (MA: 8ZP172) Southbound in the area of 1141 Walnut Street, Newton. Izaguirre stated the front bumper of his vehicle crashed into the rear of MV2 at a low speed while they were in traffic. No injuries were reported. Pictures were taken and submitted to the IT Bureau. Kappius Path is a walking path not intended for vehicle traffic. While traveling on Kappius Path the operator struck a tree with the driver's side front of the vehicle. The vehicle then rolled onto the passenger side. In order to extract both occupants of the vehicle, Newton Firefighters used the Jaws of Life to remove the roof of the vehicle. Firefighters also had to remove several sections of a chain link fence belonging to the property owner of 19 Kappius Path. Newton Medics obtained patient refusals from both occupants. No injuries were reported. The vehicle was towed from the scene by Todys and an inventory sheet was completed by Officer Emmanuel. Five photographs of the scene were submitted to the IT Bureau. Upon our arrival we observed MV1 (MA REG 1GHG66) facing westbound on the sidewalk of Saint James street. The vehicle had heavy damage to the front drivers side door, broken axles, and all of the vehicles airbags had deployed. The operator of the vehicle was sitting outside of the vehicle speaking with MA State Trooper Newman who was on scene prior to my arrival, and had witnessed the accident. Trooper Newman stated MV1 was traveling westbound on Washington street, drove over a traffic island on Saint James street, hit a light post on the sidewalk, and spun sideways off the fence that separates Saint James street from the MA Turnpike. The vehicle then struck a tree and came to rest facing westbound on Saint James street. The vehicle was only occupied by the operator. Medics were called to evaluate the operator and a patient refusal was signed. After being cleared from the medics, Officer Donovan initiated an investigation into the circumstances of the accident, and subsequently placed the operator under arrest for operating a MV under the influence of alcohol. Tody's towing was notified to remove the vehicle due to its inoperability on the sidewalk. Officer Helms took photos of the accident scene which were submitted to the IT bureau.
