Operator #1 was very concerned that there was no signage or personnel from Vona Construction directing motorist where to go and feels he is responsible for the damage to her MV as he was the one informing her she needed to leave the ""construction zone"" immediately. She further states that no one assisted her in turning around, her view was obstructed because her MV is so low to the ground and that a construction truck was blocking the nearest driveway, making it even more difficult to maneuver. As I entered Melrose St from Comm Ave when I arrived I observed no signage and MV's were having to turn around. I informed Steven Vona that if he was going to temporarily block the street to unload equipment he needed to either use cones, signs or workers to assist drivers. He states that at approximately 12:20 hours he observed MV1 exiting the parking lot of 300 Needham Street( a drive way to a building that the public has access to). There is an island in the middle that separates the entrance and exit of the lot as it goes out to Needham Street. As MV1 was exiting, he drove up on the island and pushed two large stone builders out of place. There was also damage to numerous different flowers planted in the ground. MV1 then exited the lot and went eastbound on Needham Street. Officer March then followed in his vehicle and kept beeping his horn to alert the driver to stop. The operator turned on to Industrial Place and pulled over. Ofc. March attempted to speak to the operator, Gelvin Perez-Ramirez but there was a language barrier. Next, Ofc. Calderon responded and assisted with Spanish translation. He asked the operator what occurred and he stated that he never saw the island. Due to the fact that the operator left the scene of the accident and never reported it, he was issued MA Uniform Citation # T1445351 for Ch. 90/24/C. The RP stated that he had left work (Whole Foods) at the back receiving door and was walking to his car, he bent over to take his knee pads off, while he was doing this he was struck by a delivery van that backed into him. The driver took out his headphones and said sorry before driving away. RP stated that he told the driver that he had been hit but the driver just drove away. RP went to hospital (Faulkner) on his own for lower back pain and has not been to work since. RP was able to take picture of the side of the delivery van. The van belonged to Shortstop Distribution Inc (508-655-5948). RP left a message that morning. He was texted by Gedeon (786-352-6695) who stated there was a language barrier and he didn't understand what had happened. RP advised Gedeon to talk to his lawyer or the police. Traffic Bureau Update (Officer Gaudet): On Monday, September 9, 2019 I attempted to make contact with the operator if MV1, Gedeon Duarte, with a negative result. A Hit and Run motor vehicle inquiry was mailed to Duarte. I spoke with the injured party, Kevin Coston, via telephone on September 9, 2019. Coston stated he is an employee at the Whole Foods located at 916 Walnut Street, Newton. Coston stated on August 23, 2019 a black van backed into him as he was kneeling on the ground taking off his knee pads in the loading area of the store. Coston stated he approached the driver who remained in the vehicle to speak with him after he was hit. Coston described the driver as a heavy set Spanish male. Coston stated the operator of the vehicle rolled down his window, took his headphones out of his ear, said sorry, and left the area. Coston stated he contacted the Newton Police to report the accident but was told he needed to come in person to file the report. Coston stated he was unable to come to the station to file the report until September 8, 2019. On Friday, September 13, 2019, I spoke with Gedeon Duarte at the Newton Police Department. Duarte stated he spoke Portuguese and did not speak English. With the assistance of David Sargent from the Language Line (1-800-225-5254) translating, I was to speak with Mr. Duarte in the Traffic Bureau. Duarte stated he was making a delivery at Whole Foods and was waiting for another truck to leave so he could leave the area. Duarte stated a male party (Coston) came up to his driver door and was yelling him. Duarte stated that due to language barrier he was unable to understand what the person was saying to him, but stated the male party was yelling, ""Fuck you! Fuck you!"" Duarte stated he did not know what was going on and stated he left the area to allow the male party to calm down. Duarte stated he returned a minute later the male party did not want to speak with him. Duarte stated he returned a second time later in the morning and Coston was not there. Duarte stated he received a call from his employer stating Kevin Coston had called for him and he was provided with Coston's phone number. Duarte stated he texted Coston to find out what happened that morning. Duarte showed me a text message exchange from August 23, 2019 at 9:03 A.M. between himself and a party listed as ""Kevin Whole"". In the text messages, Duarte stated he is the driver of the van and that his supervisor called him. The other party responded and stated ""Talk to the police and my lawyer"". Duarte stated that he did not understand what happened and that he returned to whole foods. Duarte ended the text exchange with ""927535425 my number of policy..."" Duarte stated he had no idea he made contact with Coston and stated at the time of the alleged accident he did not hear/see/feel anything otherwise he would have stopped. Duarte's information has been updated in this report to reflect him as the operator/vehicle involved. Operator of MV # 2 states she was also operating straight ahead eastbound on Brandeis Road awaiting the backed up traffic in front. She states that once there was an opening in the roadway ahead of her, she signaled her left directional and started to pass traffic on the left. Mr. Quiles states he was operating eastbound attempting to exit the parking lot of 1220 Chestnut Street and turn left on to Oak Street. While attempting to exit the lot, he states that he stopped for a pedestrian crossing the street. At this point, he heard glass shatter but did not realize his truck was ever struck. He then got out and observed that MV# 2 backed in to the rear passenger side of his truck. There was no apparent visible damage to the city vehicle as a result of the accident. I then spoke to the operator of MV# 2 identified as John Deming who was operating a 2017 Honda CRV color green bearing MA reg.# RWCF30 at the time. He states he was parked in the last spot in the parking lot across from the All Star Liquors near the Oak Street entrance/exit. He then attempted to back up his CRV attempting to exit the lot. He says that he observed MV # 1 in the rear of him but thought he had enough room to back up around the truck. He says that he was using his back up camera and misjudged the distance and struck the passenger rear end area of MV# 1. The owner of MV 1, Tetianna Shvets was shopping at Baza grocery market while her vehicle, MV 1, was parked in the parking lot. When Tetianna returned to her vehicle there was a note on her windshield stating MV 2 struck her vehicle ""possibly"" on the right rear side and left the scene. The plate of the vehicle was left on the note as well. There was no contact information of the witness left on the note or any manner of collision. There was minimal damage (a few scratches) on MV 1. Andrew provided photos of the damage to the vehicle and the note left on the windshield.The photos of the damage and note are attached to this report. The plate came back to 79 Wheeler Rd in Newton. I went to the address to follow up with the operator of MV 2. I spoke with the owner and operator of MV 2, Mrs. Lyuba Regelman. Lyuba admitted to shopping at Baza grocery market today. Lyuba denied hitting MV1 and there was no damage to her vehicle I could see that matched the damage from the incident. Mr. Drukman stated his vehicle was parked unoccupied in the parking lot and was struck by another vehicle. Mr. Drukman stated his 2017 Subaru Forester (MA: WA1/UIY) had damage to the driver side rear fender. Mr. Drukman stated a passersby forwarded pictures of the other vehicle involved in the crash. The other vehicle is a 2016 BMW 5 series (MA: 1691DR) registered to Mr. Richard Parker (S75189008). Mr. Drukman forwarded me the pictures he received and there is damage to the front passenger side bumper/fender area of this vehicle. These photos were submitted to the IT Bureau to be added to this report. I spoke with Mr. Parker via telephone. Mr. Parker stated he was operating his vehicle in the parking lot of the JCC at the time and date of the crash. Mr. Parker acknowledged his vehicle made contact with another vehicle while he was attempting to park. Mr Parker stated after making contact with the other vehicle, he exited that parking spot because it was too tight and parked in another parking spot. Mr. Parker stated there is no new damage to his vehicle and the damage I described in the pictures Mr. Drukman forwarded to me was old. I advised Mr. Parker that I was citing him for leaving the scene of property damage. Mr. Parker admitted to crashing into MV1 as he was attempting to park in the JCC parking lot. Mr. Parker knowingly made contact with another vehicle and made no effort to exchange information with the owner of the vehicle he crashed into. The pictures submitted by Mr. Drukman of his vehicle show obvious fresh damage as a result of a crash. Nkuba states that around 1500 hrs today, she was shopping in Star Market at 1 Boyston St. When she exited the store and returned to her vehicle in the lot (MA reg 7CNJ50), there were security workers cleaning debris from around her car. Immediately apparent was damage to the rear left tail light/bumper area. The security workers then directed Nkuba to witness Kate Sweeney, who was able to provide a picture of MA reg 4AX435, a black Chevrolet Suburban. Sweeney told Nkuba that the Suburban had hit her car and left the scene. I called Sweeney and spoke with her directly. She relayed that she was in a nearby store and heard a loud crash. Her attention was directed outside to a black Suburban slowly driving with obvious front passenger side damage. The vehicle then stopped in a parking space, and a heavy set woman exited from the driver's seat to inspect the damage on the front right side. The woman then got back into the vehicle and drove away in an unknown direction. 4AX435 comes back active on a 2012 Chevrolet Suburban color black to Maria Dasilva Alves out of West Roxbury. I requested Boston PD E-5 try and raise Alves and have her contact me. It should be noted that Alves has an expired/non renewable license and appears from her license photo to be heavy set. Charges pending. *Update, 8/28/21- Boston PD had negative results locating Alves or the vehicle. I spoke to the resident at 8 Burrage Rd. The resident stated a visitor in his house, Jonathan Kaplan, witnessed the accident. The resident stated Kaplan told him he observed a white sedan bearing MA Reg CIAF31 (Mv#2) attempting to parallel park between #1 and another Mv. During the attempt, #2 was observed sideswiping #1. Kaplan further stated a male operator got out of #2, left a note on #1 and drove away. Mv#1 owner/operator Ms Joan Beer stated no note was ever found. Later from HQ, I called the witness phone number provided (617-455-2557) by the resident of 8 Burrage Rd. I called that number, received VM and left a message. A query of #2 registration comes back on a '18 white Lexus G350 to a Mr Barry Benjamin of 79 Florence St #510S Newton. I received information Mr Benjamin's phone number was 339-223-0079. This number when called was not Mr Benjamin's. Later from HQ, I spoke to Ms Beer and provided her with the witness plate number observed as the paint color is a match to the damage sustained on her Mv. She was advised insurance company will investigate further based on current information received. Later, the witness Mr Kaplan returned my phone call and provided the following statement: Kaplan stated he was in his driveway outside directly across the street from where the accident was taking place. Kaplan stated the accident was very obvious as damage was unfolding while Mr Benjamin was attempting to squeeze between Mv#1 and another vehicle. Kaplan stated after realizing he (Mr Benjamin) could not fit he started to drive away. Kaplan stated it drew the attention of another witness (unknown) standing on the street when both walked up to Mr Benjamin's vehicle and asked him if he was going to leave a note for the damaged vehicles. Benjamin refused. Kaplan described Benjamin's overall demeanor as ""rude."" Kaplan stated he told Benjamin he has cameras capturing the incident. Not until then, Benjamin got out of his car and left a note on only the other vehicle reported to be minor license plate damage. Kaplan stated Benjamin never left a note on Mv#1, the vehicle with obvious moderate damage. Kaplan stated he actually viewed the note left on the other vehicle and said it was illegible. Kaplan told Benjamin this and Benjamin yelled to him ""mind your own business"" and drove away. Kaplan stated his ring doorbell camera was not positioned to capture any of the incident. Traffic Bureau update (Officer Gaudet): On September 8, 2021 I was able to make contact with the operator of MV2, Mr. Barry Benjamin (S42076881). Mr. Benjamin stated he was operating his 2018 Lexus G350 (MA: CIAF31) at the time of the crash. Mr. Benjamin stated he was backing his vehicle into a parking spot and the space ended up being too small. Mr. Benjamin stated the rear of his vehicle crashed into the front bumper area of MV1, knocking off it's license plate. Mr. Benjamin stated he got out of his vehicle and put the plate back on MV1. Mr. Benjamin stated he left a note in the vehicle with his contact information and left the area. I asked Mr. Benjamin if he was aware of making contact with another vehicle in the area. Mr. Benjamin stated he did not make contact with any other vehicle. Mr. Benjamin stated there was no damage to his vehicle and stated he would e-mail me pictures of his vehicle and pictures of MV1 that he took on scene. Those pictures were forwarded to the IT Bureau to be added to this report. Mr. Benjamin also stated in his e-mail, ""My wife informed me that the homeowner who contacted the police called my wifes attention to a car up the street. The car was on the opposite side near a dirt road that had been side swiped earlier. My wife said, ""That has nothing to do with us"" and the homeowner agreed that that situation did not involve our car."" She stated that the vehicle parked next to her, MA reg 298MS7, had damage to the front left side and was parked at an angle that may suggest an improper turn into the parking spot (see diagram). Movitz was able to show me two pictures of minor damage to both vehicles, however I am not able to confirm that the damage is related to each other via the photographs. A white male with spiky hair in his 40's drove off in the vehicle, according to Movitz, but there was no interaction between the two. I was able to make contact with the owner of the vehicle in question, who told me that his son Daniel Suleski III DOB 4/10/92 was operating his car today. Suleski was able to be reached by phone and was adament that he did not hit another vehicle. Suleski did state he was parked in the Newton Centre Lot around the time in question. Officer Marini checked the area for any cameras that may record the area with negative results. Based on the totality of the facts presented, I am unable to reach a definitive conclusion at this time. It was reported that she made contact with the rear of vehicle #1 and immediately left the scene. I spoke to Mccourt on the phone, who informed me that the woman was a white female between 60-70 yrs old. She appeared to be making a 3-point turn in the lot, hit a bush, then the rear bumper of vehicle #1. I asked Mccourt if there was any indication that the woman knew she hit vehicle #1, to which he stated ""it certainly seemed so, because she motioned for me to move out of her way after she hit it"". The vehicle was described by Mccourt as a blue sedan. MA reg 2EE316 comes back active on a 2011 blue Toyota Camry to Sergey Klepikov out of 1156 Chestnut St in Newton. QED shows a Vera Klepikov residing at that same address with a DOB of 12/22/52. I have left a message with the number on file for the Klepikov residence for Vera to contact me. Damage to vehicle #1 appears to be minor-moderate scraping from the picture I was shown by Goud. No injuries were reported. On arrival, I spoke to the operator of the semi-trailer truck which is a 2006 Peterbilt Model 327 with MA APP Reg. # 3827B. The operator was identified as Robert Lawton (MA D/L # S92175566). Mr. Lawton works for Commonwealth Construction and Utilities which is owned by the Distefano Corporation in Watertown, MA. They are contracted with the City of Newton to remove debris such as concrete from the city yard. At the time, Mr. Lawton was standing on a ladder attached to the trailer overseeing it being loaded up by a city backhoe. The truck was parked and facing in a westerly direction. During the loading process, the backhoe was pulling forward towards the truck in a westerly direction. The front left side wheel of the backhoe struck the truck's driver's side rear mud flap area denting it. The mud flap is made of metal and covers the four rear tires from front to back. Both Mr. Lawton or the operator of the backhoe never realized the truck had been struck until another worker from Commonwealth Construction noticed it. The backhoe is a yellow 2014 JCB 3CX14 with MA Apportioned Reg. # M88532. The operator of the backhoe Michael Daniele (MA D/L # S43438211) works for the City of Newton Dept. of Public Works out of 74 Elliot Street. There was no damage to the backhoe. The crash occurred at a y type walkway/driveway near the Shaw Building dining hall. The weather at the time was clear and approximately 50 degrees and the road conditions were dry. On arrival, I spoke to the operator of the DPW vehicle identified as William Bertrand (MA D/L # S24973075 ). Bertrand was operating a 2016 Ford Escape color black bearing MA Municipal registration # M2534A at the time of the crash. He states that he was at the Shaw campus building to conduct an inspection and was parked at a y type walkway/driveway outside of the building. When leaving, he attempted to make a three point turn to exit the driveway. While backing, he states that his foot slipped transitioning from the gas to the brake and he struck a light pole near the edge of the driveway. He says the back up sensors never alerted him of the pole either. The Ford Escape sustained minor scrape marks to the driver's side rear bumper area. As a result of the impact, the light pole cracked at the base and was knocked over on to the ground. Campus Security was on scene and will notify school administration regarding the damage to the pole. I took digital photos of the scene and submitted them to the I.T.
