GERSHON states he was traveling Westbound on Dedham Street toward Brookline Street when he approached the driveway at 832 Dedham Street and motor vehicle #2 started to pull out in front of him. GERSHON states as he saw the vehicle pull out he swerved into oncoming traffic to avoid the collision, however motor vehicle #2 struck the passenger side of his vehicle. After the collision GERSHON attempted to pull back into his lane of travel, but lost control causing him to overcorrect and go off the road on the westbound side of the road in front of 824 Dedham Street causing some damage to the front landscaping of the yard. Secondly, I spoke with the operator, JIN Zhien, of motor vehicle #2 (EV87SA). JIN states she was attempting to pull out of the driveway of 832 Dedham Street and didn't see motor vehicle #1. JIN states she was distracted because there was a lot going on inside the car. She stated she was not on her cell phone. Finally I also spoke with a witness, CURTIS Ron, who was travelling in the opposite direction and witnessed the crash. Ron stated he saw motor vehicle #1 travelling straight in the opposite direction on Dedham Street. He saw the Tesla (MV#2) attempting to pull out of the driveway at 832 Dedham Street and drive into the side of MV#1. Ron stated he also observed MV#1 swerve into his lane of traffic trying to avoid the collision and then spinning out into the front of 824 Dedham Street. While setting up a road closure by placing traffic cones on Linden Street Officer Soloman inadvertently struck a parked motor vehicle in front of 43 Linden Street. While attempting to go around a traffic cone the passenger side fender above the wheel well of N-498 struck the drivers side tail light of the parked motor vehicle. The collision caused the tail light to crack on the parked motor vehicle and there were only minor scratches to N-498. Officer Soloman left the location to assist with the event at the church, Sgt. Dempsey was notified. At the conclusion of the event Officer Soloman went back to 43 Linden Street to attempt to speak with the owner of the motor vehicle. The owner was not home, but Officer Soloman was able to speak with her husband, DWYER Michael, and inform him of what happened. Officer Soloman gave him all the pertinent information that he would need. Conary called in the accident to Newton Police Dispatch. On arrival, I spoke to the operator of M/V# 1 identified as Suzanne Ennis (MA D/L # S80758886) who was driving a 2015 Honda CRV color red bearing MA reg.# 769YR1. Ms. Ennis stated that due to the road construction and it being blocked at Walter Street and Jackson Street everyone was being funneled down (EB ) on Marshfield Rd by the detail officers. Ennis further stated that there was construction vehicle apparatus parked along Marshfield Road in the westbound direction which made the road narrow. She then attempted to pass a parked City of Newton Toyota Rav4 (M/V # 2) on the right of her when another pick up truck suddenly started traveling westbound. She says that she tried correcting her steering but made contact with the driver's side front quarter panel area of M/V # 2. I observed a minor black scuff mark to the front passenger side quarter panel area. M/V # 2 is a 2019 Toyota Rav4 color white bearing MA Official reg. # M5181A. It is owned by Enterprise FM Trust and being leased by the City of Newton Public Works. The Rav4 was parked legally on the right side near 12 Marshfield Road with a City of Newton employee sitting in the front driver's seat. The employee was Kimberly Ritcey who works for the engineering department for the Newton Dept. of Public Works. Ritcey reported no injuries. I observed minor scrape marks to the driver's side front quarter panel area. Photos taken of the scene and submitted to the I.T. On arrival, I spoke to the operator of M/V # 1 identified as Elizabeth Langston (MA D/L # S89458234) who was operating a 2013 Nissan Rogue color black bearing MA reg. # 3BMK31. Ms. Langston states that she was parked across the street from 38 Eldredge Street. When she went to pull out in to the travel lane going southbound, she never saw another vehicle going by her and struck M/V # 2 on it's passenger side. She further stated that she believed it was a blind spot in her side view mirror. I observed damage to her driver's side door handle and driver's side bumper. As a result of the crash, the entire bumper was dislodged from the vehicle. Langston called for a private tow (Pro-Tech Waltham) to have her vehicle removed. Next, I spoke to the operator of M/V # 2 Richard Leone (MA D/L # S61672498) who works for the City of Newton Department of Public Works. At the time, he was operating a 2019 Ford 350 color white bearing MA Official reg.# M3106A. He stated that he was traveling straight ahead (SB) on Eldredge Street when M/V # 1 pulled out and struck him on the passenger side. I observed scrapes to the passenger side door that extend down to the wheel well of the cab to the truck. I also observed a dent on the truck between the passenger side door and bed of the truck. Claflin was working a paid detail for Feeney Brothers at the intersection of Lowell Avenue and Otis Street. While monitoring the traffic in the area, Detective Sgt. Claflin heard what he believed to be a vehicle crash in his vicinity. Detective Sgt. Claflin looked across the intersection and observed a 2020 Honda Civic (MA: 7MR818) leaving the scene down Lowell Avenue (S) towards Commonwealth Avenue. This vehicle had damage to it's passenger side door area. Detective Sgt. Claflin also observed fresh damage to the rear driver side bumper area of a 2021 Dodge Ram (MA: 5CFR30) that was parked in front of 296 Lowell Avenue (S). Detective Sgt. Claflin then entered his personal vehicle and attempted to catch up to the Honda Civic that left the scene to check on their well-being. Detective Sgt. Claflin stated as the vehicle approached the intersection of Lowell Avenue (S) and Commonwealth Avenue, it proceeded through the intersection on to Homer Street with out stopping at the red light activated at this intersection. Detective Sgt. Claflin was finally able to stop the vehicle on Homer Street just after Commonwealth Avenue. I arrived on scene and spoke with the operator, Ms. Ludmila Gelman (S30392030). I asked Ms. Gelman about the events that took place prior to Detective Sgt. Claflin stopping her. Ms. Gelman stated she did not know what happened. I observed moderate damage to the front passenger side door area of her vehicle. The front passenger door mirror was damaged and folded in. The glass window from the front passenger door was shattered and missing. There was glass from the middle covering the entire front passenger seat/floor area inside the vehicle. I showed Ms. Gelman the glass inside her vehicle and the damage to her door and asked her if she knew what caused it. Ms. Gelman stated she did not know and that something must have hit her. I explained to Ms. Gelman the events that has just transpired as conveyed to me by Detective Sgt. Claflin. Ms. Gelman seemed to be confused and did not understand what happened. Ms. Gelman called her son Steven and asked me to speak with him. I explained to Steven the events leading up to me speaking with him. I explained to Steven I did not feel comfortable allowing Ms. Gelman to drive away from the scene. At Steven's request, I moved Ms. Gelman's car away from the intersection and parked it in front of 1103 Commonwealth Avenue for him to pick it up. Ms. Gelman reported no injuries and was transported to her residence by myself in unit N492. Ms. Gelman was given Massachusetts Uniform Citation 487210AB in hand for Chapter 90, Section 24 (Leaving The Scene Of Property Damage), Chapter 89, Section 9 (Fail To Yield, Red Light), and Newton City Ordinance Chapter 19, Section 75 (Fail To Use Care). Ms. Gelman was also advised I would be filing an Immediate Threat with the Registry of Motor Vehicles. A Request for Immediate Threat License Suspension/Revocation was completed and submitted tot he Registry of Motor Vehicles with supporting documentation via e-mail, DCUImmediateThreat@massmail.state.ma.us. I returned to the area of the crash and observed damage to the rear driver side bumper area of the involved Dodge Ram. The vehicle was unoccupied at the time of the crash. The registered owner, Mr. Zachary Maclaughlin, was advised. A copy of the issued Criminal Application was submitted to the Court Prosecutor with supporting documentation. Mr. Holmes stated he was transporting a portable restroom in the front bucket to another location on their job site. Mr. Holmes stated a vehicle was traveling towards him on Lowell Avenue (N) and he moved over to the right side of the road to create more room on the roadway for both vehicles. Mr. Holmes stated at this time the front passenger side of the backhoe's bucket area crashed into the rear of an unoccupied vehicle parked in front of 297 Lowell Avenue (S). I observed minor damage to the bucket area of the backhoe. No injuries were reported by Mr. Holmes. The owner of MV2, Mr. Michael Fedas (S87986062), was advised that his 2019 Kia Forte (MA: 3ZDV69) was involved in the crash. I observed moderate damage to the rear driver side area of MV2. Upon speaking with the operator of MV2 (MA Pass:2HXE78), she stated that she was attempting to park MV2. To this end, she was driving westbound through empty parking stalls and as she entered the travel section, struck MV1. The operator of MV2 could not offer an explanation as to why she did not properly yield the right of way to MV1. I noted damage to MV1's passenger side. The front passenger side door had a dent and scrapes and the right rear passenger side door had the door skin cut and dislodged, leaving a section approx. 1.5-2 feet long and the same wide, bent out and approx. 6 inches away from the body of MV1. I noted damage to the front left bumper cover and driving light of MV2. Due to safety concerns and to prevent further damage, the operator of MV1 began the process of securing a private tow for the vehicle. MV2 was able to continue to operate under its own power. The weather at the time of this crash was clear and sunny. The road surface in the area of the crash was dry. Langley Road and Hamlet Street are both public ways maintained by the City of Newton. I approached the area of the crash coming from Boylston Street and when I arrived my attention was drawn to two locations on Langley Road. I observed a female party laying prone on the sidewalk area of Langley Road (E) at the Hamlet Street intersection. This female party, later identified as Ms. Melinda Conroy, was being attended to by passerby's in the area. My attention was then drawn to an overturned vehicle resting half in the roadway/half on the sidewalk (W) in front of 323 Langley Road. As I began to run over to the vehicle, I observed a woman standing next to the vehicle screaming frantically. This party identified herself as the driver of the lone vehicle involved, Ms. Natalya Kabanovsky (S65512051). There were parties at the back of the vehicle yelling to me that there was a woman trapped under the vehicle and that they were holding the vehicle up to get her out. I ran over to the rear of the vehicle and observed a female party, later identified as Ms. Annette Sooper, lying underneath the vehicle in the roadway. There was a large pool of blood on the roadway as the result of a laceration to what appeared to be her head/face area. Due to the unknown stability of the vehicle resting on its roof, and due to the passerby's stating they were holding the vehicle up so it did not roll over onto Ms. Sooper, I reached under the vehicle from the rear, grabbed Ms. Sooper's person, and dragged her away from the vehicle to a safe location on the sidewalk. At this time, I observed a large laceration to Ms. Sooper's head and she stated she had suffered a leg injury. Newton Fire and Medics along with additional Police units arrived on scene and took over rendering aid to the victims. I then started to conduct my investigation into the crash. I spoke with the operator of the vehicle, Ms. Kabanovsky. Ms. Kabanovsky stated she was operating her 2005 Lexus ES330 (MA: 293TAB) on Hamlet Street (W) towards Langley Road. Ms. Kabanovsky stated as she approached the intersection, a female party (Ms. Conroy) ahead of her was running across Langley Road (S) at Hamlet Street. Ms. Kabanovsky stated she attempted to hit her brakes, but instead hit her gas pedal. Ms. Kabanovsky's vehicle crashed into Ms. Conroy and then she panicked. Ms. Kabanovsky stated her car then accelerated across the street and crashed. Ms. Kabanovsky stated she was not wearing a seatbelt at the time of the crash and extricated herself from her vehicle after it rolled over onto its roof. I requested Ms. Kabonovsky's license while speaking to her, but she was too upset to located it. I queried Ms. Kabanovsky's license and registration status through Newton Dispatch. Ms. Kabanovsky's license stated is expired as of 12/18/2016. Ms. Kabanovsky registration is active. I observed substantial damage to the entire front end, driver, and passenger side of Ms. Kabanovsky vehicle. Ms. Kabanovsky was evaluated by Newton Medics and complained of right arm pain. Ms. Kabanovsky was also visibly distraught and expressed concern over the two pedestrians involved in the crash. Ms. Kabanovsky was transported to Brigham and Women's Hospital for treatment. I briefly spoke with Ms. Melinda Conroy as she was being attended to by Newton Medics and Fire. Ms. Conroy stated she was running on Langley Road (S) and observed MV1 traveling on Hamlet Street (W) towards Langley Road. Ms. Conroy stated she believed MV1 was slowing down and coming to a stop. Ms. Conroy stated she waved at the vehicle and as she crossed the intersection, MV1 accelerated and crashed into her left side. Ms. Conroy stated she flipped over the vehicle and landed on the roadway. Ms. Conroy was conscious and alert when speaking to Newton Medics and was transported to Beth Israel Deaconess Hospital in Boston. I later spoke with Ms. Conroy after her release from the hospital. Ms. Conroy stated she suffered some bumps and bruises had no major injuries. Officer Pohlman spoke with Ms. Sooper prior to her transport to Beth Israel Deaconess Hospital in Boston by Newton Medics. Ms. Sooper stated she was walking on the sidewalk in front of 323 Langley Road after returning from Newton Centre. Ms. Sooper stated as she was walking, she observed MV1 hit Ms. Conroy and then travel across the street in front of her into a tree. Ms. Sooper stated she does not remember what happened after that. I spoke with Ms. Sooper's son at NPD HQ and was advised Ms. Sooper was admitted to the hospital and suffered a fracture of her left hip and required 6 staples to close a laceration on her head. Tody's Towing responded to the scene and removed MV1 from the roadway. Traffic Officer Wilson took pictures of the scene and submitted them to the IT Bureau. After speaking with all parties involved, Ms. Kabanovsky will be cited with Massachusetts Uniform Citation 494688AB in hand at her residence for Chapter 90, Section 10 (Unlicensed Operation), Chapter 90, Section 24 (Operate To Endanger), and Newton City Ordinance Chapter 19, Section 75 (Fail To Use Care). Ms Kabanovsky was also cited with Massachusetts Uniform Citation 494800AB in hand at her residence for Chapter 90, Section 13A (Fail To Wear A Seat Belt). I spoke with the operator of MV1, Ms. Rui Zhang (SA4940828). Ms. Zhang stated she was operating her 2016 Subaru Outback (1WRP35) on Commonwealth Avenue (W) towards Temple Street. Ms. Zhang stated she activated her right turn directional and was slowing down to take a right turn onto Temple Street. Ms. Zhang stated she began to take her right turn, a vehicle appeared on her right side and crashed into the front passenger side of her vehicle. Ms. Zhang her and her son Kenneth reported no injuries as a result of the crash. I observed damage to the front passenger side bumper/tire/fender area of MV1. Tody's responded and removed the vehicle from the roadway. I spoke with the operator of MV2, Mr. Thomas Conneely (S30459555) as he was being treated by Newton Medics. Mr. Conneely stated he was operating his 2019 Honda CRV (MA: 58252) on Commonwealth Avenue (W) towards Temple Street. Mr. Conneely stated he was traveling behind MV1 for some time and the vehicle was slowing down and speeding up down the length of Commonwealth Avenue. Mr. Conneely stated as they approached the Temple Street intersection, MV1 had stopped in the middle of the road and he believed it was taking a left turn on to Temple Street. Mr. Conneely stated he went to around the right side of the vehicle when it suddenly took a right turn into his vehicle as it was passing. Mr. Conneely said his vehicle then went airborne twice and he ended up in the yard of 1633 Commonwealth Avenue. Mr. Conneely and his passenger, Ms. Susan Conneely were transported to Newton Wellesley Hospital by Newton Medics for evaluation. Tody's towing reponded and removed MV2 from the property of 1633 Commonwealth Avenue. Ms. Nancy Ghabi stated she was operating her vehicle on Commonwealth Avenue (W) behind MV1 and MV2 at the time of the crash. Ms. Ghabi stated she observed MV2 to be traveling at a high rate of speed and observed it travel to the right of MV1 and try to go around it. Ms. Ghabi stated she two vehicles then crashed and MV2 ended up in the lawn of 1633 Commonwealth Avenue. Ms. Ghabi described the actions of MV2 to be ""erratic"". Mr. John Carey stated he witness the crashed as he was standing on the sidewalk in the area of 1633 Commonwealth Avenue. Mr. Carey stated MV1 was slowed down in the intersection and MV2 tried to go around MV1's passenger side. The vehicles then crashed and Mr. Carey believes MV2 did not attempt to brake post collision and MV2 ended up on the lawn of 1633 Commonwealth Avenue. Mr. Conneely will be cited with Massachusetts Uniform Citation 510670AB for Chapter 89, Section 4A (Unsafe Lane Change) and Newton City Ordinance Chapter 19, Section 75 (Fail To Use Care). SUN states he was taking a left from Mildred Rd. onto Elinor Rd. and did not see MV#1 coming until it was to late and struck the vehicle. The lone occupant of the vehicle, Ms. Tiffany Wu, was out of the vehicle when I arrived and reported no injuries. Ms. Wu stated she was operating her vehicle on Boylston Street (W) towards Dudley Road and attempted to take a right turn on to Dudley Road. Ms. Wu stated she took the turn too fast and crashed into the wall. Tody's responded and removed the vehicle from the roadway. The owner of 25 Dudley Road was present on scene and was advised about the damage to his retaining wall.
