Upon arrival on scene I checked all parties for injuries. Operator of vehicle one Ms. Farnese complained of head / neck injuries and Fire and Medics responded on scene. All parties in vehicle two did not have any injuries. I spoke with the operator of vehicle one Ms. Farnese in the ambulance she stated she was slowing traveling south on Lexington Street at the intersection of Freeman Street due to the traffic signal for Lexington Street was yellow. She stated as she was slowing she felt a heavy impact from in the rear by vehicle two. I spoke to the operator of two Ms. Heimbrock, she stated she is a pastor for the Salvation Army in New York and she was transporting two children Shamah Lapaix d.o.b. 4-18-14 and Grace Lapaix d.o.b. 1-10-11 to a Christian school in Wayland. She stated that she is staying with the children at 65 Falmouth Road Newton MA with the childrens grandmother due to the fact the parents are in New York doing a continuing education program until Friday January 18, 2019. She stated she is not familiar with the area, she was traveling south on Lexington Street approaching Freeman Street when she glanced at the map on her cell phone. She stated she did not observe the color of the traffic signal and did not observe the rear brake lights in vehicle one. All parties were evaluated in vehilce two by medics with no injury. I spoke with the childrens mother Sarah Lapaix 1-203-685-2809 who confirmed Ms. Heimbrock's statement about the care of the children. I did observe an expired inspection sticker as of 12/18 on vehicle one. Therefore due to operator of vehicle two's statement I checked the rear brake lights. When the brake pedal was pressed the left brake light and top(3rd) brake light was operational but the right rear brake light was not operational. Tody's towing arrived on scene and towed both vehicles top their lot. Ms. Heimbrock made arrangements for transport of herself and the children. Ms. Farnese was transported to Newton Wellesley Hospital for non life threatening injuries. I advised all parties of the process and gave them each others information. I checked the traffic signals in the intersection and they were fully functional. Operator of M/V # 1 (Quinn) states that she was stopped at the intersection of the above mentioned intersection going (EB) on Elliot Street. Once she received the green light signal she proceeded straight through and was struck by M/V # 2 on her passenger side. The vehicle sustained heavy damage to the passenger side front quarter panel area and it was towed by Tody's towing. Operator of M/V # 2 (Sanaguaray) states that he was operating straight ahead (NB) on Chestnut Street. He states that he thought the signal light was yellow when he proceeded through and does not recall what happened next. The vehicle sustained heavy front end damage and it was towed by Tody's towing. There were two witnesses to the accident. The first one, Karen Cherson, stated that she was traveling behind M/V # 2 when she observed him speeding and run through the red light striking M/V # 1. She said that the light was red by at least two seconds when M/V # 2 went through it. The second witness, John Quackenbush, states he was operating behind M/V # 1 when he observed their travel lane receive the green light signal. M/V # 1 then attempted to proceed through the intersection when it was struck on the passenger side by M/V # 2. Based on the two witness statements, it appears that Sanaguaray (M/V # 2) proceeded straight through the above mentioned intersection against the red light signal and struck M/V # 1. Sanaguaray was also operating a motor vehicle without a license and was issued a MA Uniform Citation # T1441052 for Ch. 89/9 and Ch. 90/10/A. Cherry Street and Webster Street are both public ways maintained by the City of Newton. The weather at the time of the accident was overcast. The road surface was dry. The operator of MV1, John Bryant III (MA: S61611545), stated he was operating a City of Newton owned Volvo BL70 (MA MVN: M84236) Eastbound on Webster Street past Cherry Street. Bryant stated as he came to a stop in traffic, MV2 crashed into the rear of the vehicle he was operating. I observed minor damage to the rear bucket area of MV1. Bryant reported no injuries on scene and signed a patient refusal with Newton Medics. Bryant works for the Utilities Department with the DPW. The operator of MV2, Andrew Bell (NJ: B23900426706004), stated he was operating his 2013 Volkswagon (NJ: C54KKJ) Eastbound on Webster Street past Cherry Street. Bell stated he was following MV1 a little too close while they were traveling down Webster Street. Bell stated while traveling down Webster Street he looked down quickly but does not remember why, and when he looked up MV1 had come to a stop. Bell stated he could not avoid crashing into the rear of MV1. I observed significant damage to the front hood/windshield area of MV1. Bell was transported to Newton Wellesley Hospital with a minor injury. Bell was provided with Massachusetts Uniform Citation T1272991 in hand for Newton City Ordinance Chapter 19 Section 71 (Following Too Closely) . He then stated he pulled onto Dedham St and was struck by vehicle 1. A witness, Regina King was traveling westbound on Dedham St two car lengths behind vehicle 1 and saw vehicle 2 pull quickly out of Rachel Rd cutting off vehicle 1. King states that she did not see any other vehicle wave vehicle 2 onto Dedham St. I issued the operator of vehicle 2 MA Uniform Citation #T1272285 for 89/9 failure to comply with a stop sign. Vehicle 1 was towed by todys and operator of vehicle 1 was seen by the medics and signed a patient refusal. The parking lot is accessible to the public and designed for vehicles to travel to and from the JCC. Owner of M/V 1 states she was parked on the side of the handicapped parking stall thinking it was ok to park there. She then ran in to the JCC for approximately one minute and when she returned she observed her driver's side front door was struck. I observed significant damage to the door frame and the door would not close. The owner called for a private tow to remove the vehicle. The staff at the JCC stated that a Martha Bixby gave her number and stated that she observed a black colored car with MA reg. # 934HH4 strike M/V 1. I attempted to call the number and left a message. The listing for that plate comes back to a 2010 Lexus ES350 color gray. I was then showed the video surveillance from the JCC's cameras and it shows an older white female exiting the lobby wearing a winter hat and carrying a bag with purple flower designs on it. She then walks through the lot and enters a gray Lexus ES350. The Lexus then starts backing out of the spot. The Lexus then continues backwards in to the other side of the parking stalls and strikes M/V 1 on the driver's side front door. The Lexus then pulls forward and leaves the scene without stopping or providing her information. As the Lexus is leaving, you can see there is a dent to the driver's side rear bumper. The video is not clear enough to see the plate on the Lexus or clearly see the operator's face. After, I located a number for the owner of the Lexus M/V 2 (Tania Lefman). I spoke to Lefman on the phone and she stated that she was backing out of the JCC parking lot at that time and felt a tiny bump to her rear end. She says that she could not stop in time due to the icy parking lot and then left the area thinking that nothing was wrong, it was only minor. I advised her there was significant damage to the other car. The weather at the time of the accident was cloudy and the road conditions were dry. Both streets are public ways in the City of Newton. Upon arrival I observed the victim identified as Glenn Butcher (MA OLN S36552335), inside the ambulance getting medical attention. Butcher was getting a bandage applied to his left leg and complained of leg, back and neck pain. Butcher appeared visibly shaken and in pain. Butcher stated he had the green traffic light and was travelling eastbound on Beacon Street crossing Centre Street and then continuing straight crossing Herrick Road. Butcher stated MV1 was travelling westbound on Beacon Street and took a left turn onto Herrick Road and collided into his bicycle. Butcher states upon impact he flipped over his bicycle and landed on the hood of MV1, before rolling off and landing on the ground. Butcher states he was wearing his helmet which was present. Butcher states his bicycle ended up partially under MV1. Butcher states the operator of MV1 pulled his vehicle to the side of the road and got out of his vehicle and spoke to several witnesses briefly. Butcher states the operator then left the scene without properly exchanging information and did not wait for the police to arrive. Butcher described the vehicle as a dark gray Honda, and described the operator as an older white male, 5'10 approximately 80 years old with white hair. Butcher was also able to provide an email address for another bicyclist who witnessed the accident. The witness left his information with Butcher prior to my arrival. Fire fighters on scene were able to get the registration number of the vehicle from the witness (MA REG 4CX148) and gave it to Officers on scene. Butcher was transported by Medic 1 to NWH with minor injuries. His bicycle had visible damage to the frame area and skid marks were present on both tires. 19 photographs of the scene and the bicycle were taken and sent to the IT dept. email. Officer Gabriel transported the bicycle to the station where it was logged into Property & Evidence for safekeeping. Dispatch was able to query the registration which came back to a gray, 2010 Honda Accord registered to a Matthew Sugarman (MA OLN S38601397), out of W. Roxbury. Dispatch contacted the Boston Police Dept. and had them send an Officer to the address to try to make contact with Sugarman. Sugarman was advised to contact the Newton Police Dept. and I was able to speak with him on the telephone. Sugarman states he was driving the vehicle today and was involved in an accident with a bicycle. Sugarman states he was travelling westbound on Beacon Street and was taking a left onto Centre Street not Herrick Road. While speaking with Sugarman he seemed confused as to his location during the accident and was adamant that he was turning left onto Centre Street and not Herrick Road. I advised Sugarman that I was on scene with the first responding Officers and the accident clearly occurred at the intersection of Beacon Street and Herrick Road based upon the final resting place of the bicycle. Sugarman went on to state that his vehicle was already turning when the bicycle struck his vehicle and he believed it was the bicyclists fault. I advised Sugarman it appears the bicyclist had the right of way since it was traveling straight and that because his vehicle was taking a left turn, he failed to yield for on coming traffic at an intersection. When asked why he did not stay at the scene of the accident Sugarman stated he got out of his vehicle and spoke to the bicyclist and he \"seemed okay\". Sugarman states he then left the scene while the victim was still sitting on the ground. I asked Sugarman if he had ever been involved in accident before and he replied \"no.\" I advised Sugarman that I am currently looking at his drivers history and see nine accidents that he was involved in. Sugarman stated \"he has never been in accident like this before.\" I then asked Sugarman what the law states when you are involved in an accident and he was not able to provide me with an answer. I advised him that the law states you must stop and exchange information before leaving the scene of an accident. Again he stated the bicyclist seemed okay and \"he had somewhere to be so he left.\" Sugarman has an extensive drivers history including nine surchargeable accidents, reckless operation, two different charges of leaving the scene property damage and two immediate threat affidavits filed against him. I advised Sugarman that I will be mailing him a citation for Ch89 s8 Fail to yield to oncoming traffic, and Ch90 s24 Leaving the scene of personal injury. I also filed an immediate threat form with the registry. I emailed the witness using the information he provided to the Newton Fire Dept that was on scene and received a phone call back from the witness identified as Bruce Adams. See witness report for his statements. I contacted the Bank of America located at 808 Beacon Street in Newton, as they are the closest business to that intersection with video surveillance. I spoke with George Walsh (781-834-8275) who stated they do not have any working cameras on that side of the building to the bank. For this report the bicyclist is entered as a non-motorist for validation purposes. Witness Bruce Adams (MA OLN S96398108) stated that he was riding his bicycle travelling behind the victim about 100 feet away. Adams states he was watching the victim and had a clear view of him as he travelled behind him, through the green traffic light heading eastbound on Beacon Street. Adams stated he witnessed MV1 travelling westbound on Beacon Street take a sharp left turn onto Herrick Road which turns into Union Street. Adams stated that the vehicle turned left colliding into the bicycle and there was no possible way the bicyclist had time to stop to avoid the collision. Adams stated the victim flew over his handle bars and fell on top of MV1's hood and then landed on the ground. Adams stated the victim's bicycle was stuck under MV1's front bumper. Adams stated the operator of MV1 backed his vehicle up with the bicycle still attached to his vehicle bumper and pulled MV1 over to the side of the road. The operator then got out of his vehicle and walked up to the victim who was laying on the ground visibly in pain. Adams stated the operator asked the victim if he was okay to which the victim did not immediatley reply as he was visibly shaken up. Adams stated the operator then walked back to his vehicle and attempted to leave the scene and that is when Adams stood infront of MV1 to stop him from leaving the scene. Adams stated he then removed the bicycle from underneath the bumper of MV1 and placed it on the side of the road. Adams stated the operator got out of his vehicle again and walked up to the victim and asked him \"what do you want to do?\". Adams stated the victim did not respond and that is when the operator got back into his vehicle and drove away, leaving the scene before any emergency response arrived. Adams stated he was able to memorize MV1's registration and stayed with the victim until police, fire and medics arrived. The first witness, Aaron Creecit, was making deliveries for UPS when he saw MV2, which was a motor cycle with a side car attached to it, take a left from Proctor Street onto Walker Street and struck MV1 with the side car portion of the motor cycle and left the scene. The second witness, Jeanette Even, who lives at 30 Walker Street witnessed the hit and run and stated she saw MV2 take a left from Proctor Street onto Walker Street and struck MV1 and left the scene. The first and second witness took down the registration plate (MA Reg: 2H7713) which came back to 27 Brooks Ave. I responded and found the motor cycle in the driveway covered by a blue tarp. I lifted the tarp and found damage on the right side portion of the side car, which would be consistent with the hit and run. I spoke with the operator of MV2, who states the motorcycle is new and she didn't realize she hit MV1. Officer Selig tracked down the owner of MA Registration 3EF576 at 20 Hale Street and the operator of MV2 admitted to being in the parking lot but denied striking MV1. It should be noted that while at Mr. Wendt's residence both Officer Selig and I observed MA reg 3EF576 parked in driveway of 20 Hale Street with damage to the left rear bumper consistent with how the witnesses stated MV2 struck MV1. Based on the 2 witness statements that express that the operator of the Nissan Pickup knew he struck another vehicle and still left the scene I issued the operator of MV2, Mr. Spencer Wendt, Massachusetts Uniform Citation T1443928, a criminal application to appear in Newton District Court for 90-24 Leaving the Scene of Property Damage. At the time, the road surface was dry and the weather was cloudy. Traffic was particulary heavy as there were several streets in the area still blocked off for the Walk for Hunger and there were participants still walking the route in the area. My attention was drawn to the intersection of Centre Street and Bowen Street as there was a motor vehicle travelling southbound on Centre Street with their left turn signal on attempting to take a left turn on to Gibbs Street. Gibbs Street was temporarily blocked to non-residential motorists as there were several pedestrians in the road crossing over Gibbs Street. As the motor vehicle attempted to turn, there were several pedestrians in the crosswalk crossing over Gibbs Street. The vehicle had stopped halfway into the northbound lane on Centre Street blocking on coming traffic. The operator appeared to realize Gibbs Street was blocked and attemped to turn the vehicle back into the southbound lane to continue southbound on Centre Street. As the vehicle turned back into the southbound traffic lane, the vehicles rear end collided with Officer Richard Clements, who was operating NPD motorcycle unit 533. Officer Clements was traveling southbound on Centre Street and was passing the vehicles in the southbound traffic lane which were currently all at a standstill. Officer Clements had his emergency lights activated as he was on his way to remove traffic cones from the street to open up all the traffic lanes along the event route. Officer Clements was working the City of Newton detail for the Walk for Hunger assigned to the motorcycle to assist with traffic. Officer Clements front wheel, left side of the motorcycle and left leg collided with the rear end of the motor vehicle. The impact of the crash caused him to fall off the left side of the motorcycle and land on the street face first. At this time I immediately ran from my post to Officer Clements location and radioed dispatch that a motorcycle officer was down and that I needed assistance. As I approached Officer Clements he was face down, unconcious and breathing. I was able to roll Officer Clements into the recovery position and at this time Officer Clements regained conciousness and was able to speak and stated \" What happened? What was that lady doing she turned right into me\". I advised Officer Clements that he had just been involved in an accident and to stay still and that help was on the way. The operator of the motor vehicle identified as Helen Leibner (S52717988) stopped her vehicle immediatley after the crash and got out of her vehicle to offer her assistance. I advised Helen and several other witnesses and bystanders who were now crowding around Officer Clements and I to back away from the scene and to not move any of the vehicles involved. Officer Selig arrived on scene and was able to help crowd control until further help arrived. Helen and all witnesses were advised to stand by for police to take their statements. While tending to Officer Clements he was disoriented and made several attempts to move his body to which I had to physically hold him still to prevent possible further injuries. While speaking with Officer Clements I noticed blood coming from the inside of his mouth. Officer Clements was in a noticeable amount of pain. He complained of head, back and left leg pain. Officer Clements was wearing a yellow ANSI certified Newton Police reflective jacket and a Newton Police issued motorcycle helmet. Once the paramedics and fire personnel arrived I was able to speak to the operator of the motor vehicle and several other witnesses. Helen stated she was traveling southbound on Centre Street operating her blue 2014 Audi A4 (MA REG 213BC9). Helen states she was attempting to take a left turn onto Gibbs Street and activated her left turn signal. Helen states she had stopped halfway into the northbound lane as several pedestrians were crossing Gibbs Street in the crosswalk at the time. Helen states after the pedestrians cleared she saw the traffic cones blocking the street and realized the street was closed. Helen states she turned her vehicle back into the southbound traffic lane and did not see Officer Clements or the motorcycle until impact. Helen was not injured and her motor vehicle sustained moderate rear end damage. Her motor vehicle was able to drive away from the scene. Witness Adron Gordon (S90357161) stated he was participating in the Walk for Hunger and had just crossed over Gibbs Street when the crash occured. He stated he witnessed the Officer on the motorcycle with the emergency lights on traveling southbound on Centre Street behind the motor vehicle. The motor vehicle stopped in traffic attempting to turn left onto Gibbs Street. He states then the vehicle made a slight turn back into the southbound traffic lane and the motorcycle collided with the rear end of the motor vehicle. He states the Officer then fell off the motorcycle landing in the middle of Centre Street. Witness Elizabeth McCarthy (S00242346) and Katherine Regan (S43486601) stated they both were in the same vehicle together stopped in traffic in the northbound lane of Centre Street just before the set of lights at Centre Street and Bowen Street. Both witnesses stated they do not remember if the driver of the motor vehicle had the turn signal on but they did see her attempt to turn onto Gibbs Street. They stated they also saw the motorcycle with emergency lights activated travel southbound on Centre Street approaching behind the vehicle. Witnesses state the motor vehicle then suddenly turned back into the southbound lane and the motorcycle collided with the passenger side tailight of the motor vehicle. Both witnesses state the motorcycle attemped to turn away from the vehicle to avoid the crash but was unable to do so. Witness Nina Wang (S39460985) stated she was parked on the southbound lane of Centre Street just prior to the crash scene. Nina states she was in her City of Newton DPW marked vehicle with the hazards on as she was working to assist with traffic safety for the Walk for Hunger. Nina states she witnessed the motorcycle travel southbound on Centre Street and pass the vehicles stopped in the traffic lane. Nina states the motorcycle passed the traffic using the left side and had the emergency lights activated. Nina states the motorcycle was just passing through the green light at Centre Street and Bowen Street when the motor vehicle that was stopped at the lights attempting to take a left turn onto Gibbs Street. Nina states the vehicle then abruptly jerked her car to the right and collided with the motorcycles left side. Nina states she heard a loud crash and witnessed the Officer fall off the motorcycle and land face first onto the street. The motorcycle's final resting place was on its left side approximately two feet away from where Officer Clements was located. The motorcycle sustained moderate damage to its left side, including the front wheel well and undercarriage. The motorcycle left scuff marks on the street which were measured and photographed. Several photographs of the scene and damage to both vehicles were taken and submitted to the IT Bureau. The motorcycle was towed by Todys. Centre Street and Bowen Street are both public ways maintained by the City of Newton. The injured motorcyclist, Officer Clements, was transported to Saint Elizabeth Hospital with fire fighters on board. I was able to follow up with Officer Clements on the phone the next day who was admitted over night at the hospital. Officer Clements stated he has no recollection of the accident and can only remember driving down Centre Street to begin to pick up cones to open up all lanes of traffic. Donna stated she was standing in the marked parking space waiting for traffic to stop to safely cross the street. Donna states the cars stopped to let her cross and she proceeded into the roadway. She states MV1 was attempting to back into the parking space that she was standing in and struck her right side and knocked her to the ground. Donna states the operator of MV1 stopped the vehicle when he realized he had struck her and got out to contact 911. Donna appeared to have minor injuries and complained of head pain. Medics transported Donna to NWH to be further evaluated. The operator of MV1 identified as Christopher Moos (S24090966) stated he was attempting to parallel park into an empty parking space and never saw the pedestrian standing in the space. Christopher stated as he was backing up into the space he was notified by a bystander that he just struck a pedestrian. Christopher stated he immediately stopped the vehicle and got out to assist the pedestrian and contact 911. Christopher stated he was not travelling no more than 5mph at the time of the accident. Believing that Beaver was stopping to let him cross , Donovan stated that he held up his left hand to signal to Beaver that he was going to cross. Donovan stated that Beaver's vehicle struck him on his left side and knocked him to the ground. Donovan stated that he had minor scrapes on his right side as a result of falling to the ground. On 06/12/2019 I was forwarded an E-mail from Capt Anastasia of a video of the crash that was taken from a camera that was mounted on the roof of 321 Walnut St. The video shows Donovan walking into the marked crosswalk from the east side of Walnut St and hold up his left had to Beaver's on oncoming vehicle. Beaver vehicle appears to be travailing faster than the 5 to 10 MPH that Beaver believed that he was travailing. The video shows that Beaver did not brake until Donovan was struck and landed on his vehicles hood. Donovan was thrown approximately 10 feet from Beaver's vehicle and landed on his right side on the roadway. I spoke with the injured bicyclist in front of 165 Paulson Road, Alexander Mendonez. Mendonez stated he was traveling Westbound on Beacon Street on his bicycle near Paulson Road. Mendonez stated he observed a late model gray sedan \"inch to a stop\" on Beacon Street (W) at Paulson Road. Mendonez stated he did not remember if the vehicle had it's right directional on at the time. Mendonez stated as he was traveling through the intersection with the vehicle on his left, the vehicle took a right turn onto Paulson in front of him. Mendonez stated he attempted to brake and veer to the right of the vehicle, but was unable to avoid the collision. Mendonez stated his left side made contact with the rear passenger door/rear fender area of the vehicle. Mendonez fell to the roadway and the vehicle left the area Northbound on Paulson Road. Mendonez was unable to see who was operating the vehicle. Newton Medics responded and treated Mendonez for injuries to his left knee/arm area. Mendonez signed a patient refusal with Newton Medics. I observed minor damage to the left handlebar area of Mendonez's bicycle (black Trek). Mendonez was wearing a white helmet at the time of the accident with a blue shirt and white and black shorts. Pictures were taken of the area and bicycle and submitted to the IT Bureau. Mendonez was able to provide a partial Massachusetts registration of \"7BS32\". I attempted run this plate with multiple combinations. I searched the area for a vehicle matching the description given by Mendonez with a negative result. On July 16, 2019, I spoke with a witness to the incident Mark O'Hearne. O'Hearne stated he was traveling Westbound on Beacon Street a few car lengths behind where the accident occurred. O'Hearne stated he observed a bicyclist on the right side of the road abruptly stop and fall to the roadway. O'Hearne stated he observed a vehicle in the path of the bicycle. O'Hearne stated the vehicle did not stop after the bicyclist fell and took a right onto Paulson Road from Beacon Street. O'Hearne stated he followed the vehicle involved in the accident to Commonwealth Avenue, and while doing so took a picture of the vehicle's license plate. O'Hearne stated he did not observe who was driving the vehicle. The Massachusetts registration provided to me by O'Hearne is 7BS322. This vehicle comes back to a 2010 Volkswagon Jetta registered to Peter Giorgi (S20952090) out of Paxton, Ma. I spoke with Peter via telephone. Peter acknowledged he is the registered owner of the vehicle, but stated his daughter was using the vehicle and was in the Newton area. I spoke with Lindsey Giorgi (S35711247) via telephone. Giorgi stated she was operating MA: 7BS322 in Newton yesterday, but does not recall being in an accident. Giorgi stated she is not familiar with the area and does not know the area where the accident occurred. Giorgi stated there is no damage to her vehicle and stated she does not believe she hit anyone. Giorgi emailed me 4 photos of her vehicle where I described the damage would be. I observed a small area of minor damage to the rear passenger side door area of this vehicle. After speaking with all parties involved, I am requesting a hearing in Newton District Court for Chapter 90, Section 24 (Leaving the Scene, Personal Injury). Giorgi was advised and mailed Massachusetts Uniform Citation T1269847. Jordao stated he opened his driver door to exit his vehicle when a passing bicyclist crashed into the door. Jordao stated he did not look back at traffic prior to opening the door. Jordao stated the bicyclist fell to the roadway. I observed moderate damage to the driver side door and it was unable to close as a result of the collision. I spoke with the injured bicyclist, Leonard Engel (S53573803). Engel stated he was operating his bicycle Westbound on Beacon Street in the travel lane. Engel stated a vehicle to his right opened it's driver door into the roadway and he was unable to avoid hitting it. Engel stated he fell over the top of his handlebars and onto the roadway. Engel stated he injured his right shoulder/arm/neck area and his right ankle. Engel also had a small injury to his left knee. Engel stated he does not believe he hit his head as a result of the accident. Engel was wearing a helmet, I observed some scratch marks on it. Engel signed a patient refusal with Newton Medics. I ran the license plate that was given for the other vehicle and it came back to a 2013 black Kia Rio sedan owned by a Dan Kuksin of 24 Bryon Rd apt 2 in Boston. I was unable to get a phone number for Kuksin. Dispatch requested Boston send a unit by to try and make contact and as of finishing this report I have not heard back. Traffic Bureau Update (Officer Gaudet): On Tuesday, July 6, 2019, I attempted to make contact with the registered owner of MV2, Daniel Kuksin (S61105670), with a negative result. A Hit and Run inquiry was mailed to the Kuksin. On 08/07/2019 the owner of MA reg#149DE7 came into headquarters to discuss what happened. With him was his father, Arkady Kuksin who was operating the vehicle at the time of the incident. Ida Street are both public ways maintained by the City of Newton. On arrival, I was updated by Sgt. Chisholm that one of the vehicles (MV3) had a female operator that was entrapped as a result of the collision. She was freed from the vehicle by the Newton Fire Department and transported to Beth Israel Hospital. Another operator (MV2) was transported to Newton Wellesley Hospital with minor injuries. A third operator (MV1) remained on scene with no injuries. With the assistance of Officer Wade we conducted a survey of the crash scene. We observed a large debris field at the intersection of Centre Street and Mt. Ida Street with debris from all three vehicles. The point of impact was observed to be on Centre Street (N) before Mt. Ida Street. There were fresh scrapes in the pavement as a result of the colission. We also observed skid marks from MV1 measuring 57 feet 8 inches from the start of it's skid to the vehicles final rest MV1 crashed into the rear of MV2. The impact caused MV2 to enter the Southbound travel lane of Centre Street and crash into MV3 as it was passing by. The impact from MV2's front end crashing into MV3's driver side resulted in the operator of MV3 becoming entrapped. MV2 and MV3 came to final rest on Wesley Street (W) at Centre Street (S). The driver door of MV3 was inaccessible. The collsion resulted in air bag deployment for MV2 and MV3. I observed moderate damage to MV1's front grill/bumper area. I observed substantial damage to the front and rear of MV2 and substantial damage to the front and driver side of MV3. Tody's responded and removed MV2 and MV3 from the roadway. Photos were taken of the scene and submitted to the IT Bureau. Officer Martin of the Watertown Police Department was requested by Sgt. Lee to respond to the scene and assist with a commercial truck inspection of MV1. Officer Martin contacted Trooper Grey of the Massachusetts State Police Truck Team who also responded to assist with the truck inspection. Sgt. Lee remained with Officer Martin and Trooper Grey during the inspection. MV1 was relocated to Richardson Street for the inspection. Trooper Grey determined the truck was in compliance with all required paperwork and it passed it's mechanical inspection. MV1 was removed from the roadway by a state tow. I spoke with the operator of MV1, William Tisbert (S24792655). Tisbert stated he was operating a 2006 KW W900 Semi Truck (NH SEMI: AP2638) Northbound on Centre Street. Tisbert stated as he was approaching Mt. Ida Street, a vehicle came out of no where and he hit it. Tisbert stated there was no one in front of him and then a vehicle came off of a side street (Mt. Ida Street) and attempted to turn left in front of him to return to the side street. Tisbert stated he could not avoid hitting the vehicle. Tisbert crashed into the rear of MV2. MV2 then crossed into the opposite lane and crashed into another vehicle. Tisbert remained on scene and reported no injuries. Tisbert stated he was wearing his seatbelt at the time of the accident and was not distracted. Tisbert later admitted to crashing into the rear of MV2. I spoke with the operator of MV2, Janet Vanbuskirk (S59829146), at Newton Wellesley Hospital. Vanbuskirk stated while operating her 2004 Toyota Highlander (MA: RS 529Y), she was stopped on Centre Street (N) at Mt. Ida Street. Vanbuskirk had her left directional on and was waiting for traffic in the Southbound lane to clear to take a left turn onto Mt. Ida Street. Vanbuskirk stated MV1 crashed into the rear of her vehicle. As a result of the impact, Vanbuskirk's vehicle traveled into the opposite lane and crashed into the driver side of MV3. Vanbuskirk reported minor injuries to her neck, left arm, and right hand. I spoke with the operator of MV3, Madeleine Karolian (S23979811), at Beth Israel Deaconess Medical Center in Boston. Karolian stated she was operating her 2016 Toyota Prius (MA: EV5746) Southbound on Centre Street. Karolian stated MV1 crashed into MV2, and MV2 crashed into her vehicle. Karolian stated she did not have time to avoid the collision. Karolian stated she had minor injuries to her neck and chest. Karolian's vehicle had a dash cam recording at the time of the accident. I viewed the footage with her through an app on a cell phone. The footage shows MV3 traveling Southbound on Centre Street on August 8, 2019 at 1308 hours. Ahead of MV3 in the Northbound lane, MV2 is seen stopped on Centre Street before Mt. Ida Street with it's left directional activated. I observed MV1 travel Northbound on Centre Street and crash into the rear of MV2. The impact caused MV2 to enter the Southbound travel lane and crashed into the driver side of MV3. The footage then ends. A copy of the footage was emailed to my work email. The footage was then forwarded to IT Director Steve Smith to be added to the media for this report. MV2 was occupied by 6, MV1 was occupied by 1. MV2 is owned by Clearway School and was being driven by a teacher, and passengers were students. No injuries and all adults signed refusals with the medics. Five of the passengers in MV2 were minors. The Director of Clearway School arrived on scene and signed refusals on behalf of all the minors. The Director, Peter Rosen, called to notify all parents before his arrival. He gathered all students and drove them back to Clearway School for parents to pick up from there. The operator continued to drive northbound on Centre St before pulling over just before the crosswalk at Centre St and Pleasant St. The operator then continued driving forward and struck a pedestrian crossing in the crosswalk Officer Selig and I saw the pedestrian being struck before landing on top of the Toyota Corolla hood, and falling forward onto the street. Officer Selig and I spoke with the two parties involved. I spoke with the victim, who was identified as Vivian Rubinstein (Vivian). Vivian crawled towards the sidewalk of Centre St while clutching her lower back. Initially Vivian denied being injured and refused medical aid. The Toyota Corolla operator was identified as the register owner Elise Ruben (Elise). Elise stated to Officer Selig that her front windshield was foggy and when she noticed the blue lights, she attempted to pull over. Elise stated she did not see the pedestrian in the crosswalk. Elise appeared very upset and refused medical treatment. Officer Selig was able to speak to two witnesses of the accident. The witnesses were identified as Stephan Aparicio (Stephan) and Mikaela Rice (Mikaela). Stephan said he was behind the victim in the same crosswalk. Stephan stated he saw the Toyota stop in front of the crosswalk and then drove forward hitting the female. Cook-Williams stated he came to stop at the intersection and observed no traffic in either direction of Walnut Street. Cook-Williams stated he made a left turn onto Walnut Street and did not see the crossing pedestrian until it was too late. Cook-Williams stated he slammed on his brakes and the pedestrian landed on his hood. Cook-Williams stated the pedestrian then fell to the roadway. Cook-Williams reported no injuries. As he was half way through his left turn and coming around the corner, he was not able to see a pedestrian pushing a shopping carriage. He then struck the carriage that was being pushed by Mary Alexander. He further says that the cart jolted Ms. Alexander and she fell down to the ground. At the time, Alexander was walking through the lot near the store entrance heading back towards the parked cars. She was not in the crosswalk at the time which was approximately ten feet down from her location. After, I attempted to go to Ms. Alexander's residence to follow up. I spoke to her friend who was bringing up Alexander's groceries and she stated that she decided to go to Newton Wellesley Hospital for treatment. I then spoke to Ms. Alexander in the lobby of the hospital. She stated that she was exiting the store through the lot with her shopping carriage. She believes she was approximately eight feet away from the door when all of a sudden she only saw red coming at her. She believes MV # 1 was speeding at the time. I asked her if she was struck by the vehicle or was the shopping carriage only struck. She replied that she did not know and only remembers falling to the ground after. She sustained a large bruise to the inside palm area of her right hand and her left knee was swollen. Digital photos of the scene were taken and pictures of Ms. Alexander's injuries were taken at the hospital. As far as possible video surveillance, I was told that the Loss Prevention Department has to access the video. On 11/13/19 at approximately 14:20 hours, I went in to the Star Market and spoke to the manager, Nidal Rajeh, inquiring about possible video surveillance. He said there is coverage in the parking lot and he was able to show me the video. A copy of the video would have to be done by Loss Prevention which I requested. I observed at the 12:12pm mark in the video, MV # 1 was parked five spots up from the third row of the lot that he was exiting. I also observed a white transport van parked in the end handicapped spot mentioned by the operator but it was parked correctly and not limiting visibility. Next, MV # 1 backs out of the spot and drives forward going at a reasonable speed. The pedestrian (Alexander) has already exited the store with her carriage and is walking at an angle toward the same third row of parked cars. As the pedestrian is walking towards the direction of MV # 1, it appears that the pedestrian should be visible to him. MV # 1 then starts to take the left turn around the corner without slowing or stopping and strikes the carriage head on. Due to the impact, Alexander then loses grasp of the carriage and it goes past her twisting her body around. She then hits and rolls up on the hood of the vehicle on her left side. Uminer stated he did not see anyone in the vicinity of his vehicle as he began to travel straight from his stopped position. Uminer stated as he was traveling by Hartman Road, the front passenger side area of his vehicle made contact with a pedestrian on the right side of Brookline Street at Hartman Road. Uminer stated he did not see this party until after they were struck and he then proceeded to pull his vehicle over. Uminer stated he was operating his vehicle at a very low speed at the time the collision took place. After speaking with Uminer, I observed the white 2017 GMC Yukon (MA: 9NX525) involved in the crash parked on Brookline Street (S) just past Hartman Road. Uminer stated the vehicle had been moved after the collision took place. I observed no obvious damage to the body of the vehicle on the front passenger side area where the collision took place. The front passenger door mirror was folded inward towards the door. Uminer stated he believes the front passenger door mirror was the point of contact between his vehicle and the pedestrian. I spoke with a witness to the crash, Ashley Garcia (S94193596). Garcia stated she was attempting to cross Brookline Street at Spaulding Lane. Garcia stated she entered the marked crosswalk and was a few steps into Brookline Street when a black colored vehicle traveling on Brookline Street (N) slammed on its brakes near the crosswalk. Garcia stated she looked to her left at the vehicle and then heard a thud to the right from the area where the crossing guard was standing near Hartman Road. Garcia stated she looked over and saw a crossing guard on the roadway on Brookline Street (S) at Hartman Road. The injured pedestrian involved in the crash is Cassandra Alexander (S23636307). Alexander is a crossing guard for the City of Newton and is assigned to the intersection of Brookline Street and Hartman Road for the Memorial Spaulding school crossings. This crash occurred while Alexander was performing her official duties. Alexander was wearing her department issued yellow reflective jacket at the time of the crash. I spoke with Alexander at Newton Wellesley Hospital where she was being treated for her injuries. Alexander stated she was performing her duties as a crossing guard at the intersection of Brookline Street and Hartman Road. Alexander stated she had just finished crossing two pedestrians in the marked crosswalk on Hartman Road when observed a pedestrian enter the crosswalk on Brookline Street at Spaulding Lane. Alexander stated she began to enter the intersection of Brookline Street at Hartman Road with her hands up and her department issued yellow reflective jacket on in an effort to stop traffic in the area to allow the pedestrian in the marked crosswalk safely cross. Alexander stated she was struck on her left side by a passing vehicle. Alexander stated she did not see the vehicle and fell to the roadway. Alexander stated as she was falling to the roadway she extended her right arm in an effort to brace her fall. Alexander stated she had injuries to her arms and legs and was sore from the collision. I spoke with a second witness to the crash via telephone, Anand Vaidya (S43996134). Vaidya stated he was stopped in traffic behind MV1 on Brookline Street (Southbound). Vaidya stated he observed the vehicle in front of MV1 proceed straight on Brookline Street after being stopped in traffic. Vaidya stated he then observed MV1 proceed straight on Brookline Street at Hartman Road at a low rate of speed. Vaidya estimated the speed of MV1 at this time to be 5 miles per hour. Vaidya stated a crossing guard was on the right side of the roadway on Brookline Street at Hartman Road wearing a yellow and black reflective jacket and snow pants. Vaidya stated the crossing guard had her back towards him and MV1, and extended her arm out to stop traffic. Vaidya stated at this time MV1 rolled by the crossing guard at a low rate of speed and the front right fender area of the vehicle hit the left rear leg/lower back area of the crossing guard. Vaidya stated the crossing guard bounced off of the car and fell to the roadway. Wint stated that as he approached the area of 277 Lexington St he believed that the traffic light that is at the marked crosswalk was green for south and north bound traffic. Wint stated that he did not see any pedestrians in the crosswalk, until he heard the sound of an object impacting into the front driver's side of his vehicle. Wint stated that he stopped his vehicle approximately ten yards past the crosswalk and got out. Wint stated it was then he realized that his vehicle had stuck a female and a dog. Wint stated that he was not operating any electronic devices at the time of the crash, and I observed none in his vehicle. Wint stated he was not injured in crash. Keegan stated that Wint's vehicle struck the female pedestrian and the dog as they were in the marked crosswalk in front of 277 Lexington St. Witness Henry Taylor stated that his vehicle was the first one stopped at the red crosswalk light at 227 Lexington St in the north bound lane. Taylor stated that north and south bound traffic was stopped and that Wint's vehicle did not stop and stuck a female pedestrian and a dog in the crosswalk. Witness Jacqueline Deos stated that her vehicle was stopped behind Taylor's north bound on Lexington St. Deos stated that north and south bound traffic was stopped for the red light . Deos stated that Wint's vehicle did not stop and that it struck a female pedestrian and a dog in the marked crosswalk. The pedestrian in the crosswalk was identified as Xiaoping Sun. Sun stated that she and her dog stopped on the south bound side of the marked crosswalk across from 227 Lexington St. Sun stated that she activated the crosswalk light and waited until the light was red for north and south bound traffic, and that the walk single was activated. Sun stated that she looked to her left and saw traffic north bound traffic was stopping. Sun stated that she turned to her right and entered the marked crosswalk. Sun stated that she and her dog had crossed over the north bound side of Lexington St and she then looked to her right and saw Wint's vehicle not stopping and \" going very fast \". Sun stated that the front driver's side mirror of Wint's vehicle stuck her in the face . Sun stated that as she fell to the ground she was struck on the left leg by Wint's driver's side. Sun stated that she did not lose consciousness after she had fallen to the ground. The bicyclist was dressed in black pants, and a gray sweater, and was not wearing a helmet. The bicycle sustained damage to the handlebars. At the time of the accident the sun was setting, however the street lights had not yet come on. I then spoke with the operator of MV1 who stated she was traveling southbound on Linwood avenue, and was attempting to turn right onto Watertown street when she struck the bicyclist. The operator stated she never saw the bicyclist before the collision. The front of MV1 sustained minor damage. I was able to speak with a witness to the accident over the phone after clearing the scene. The witness stated that MV1 failed to stop at the stop sign at the intersection of Linwood and Watertown street, and that the bicyclist was already well into the crosswalk at the time of the collision. Shortly after I responded on scene the vehicle involved was located nearby by N-494 at the intersection of Washington St. at Adams St. The vehicle was registered to a Evgenii Shatokhin with heavy right front end damage along with the left front, and both rear tires deflated. Mr. Shatokhin stated he was the operator of the vehicle and I asked what happened back at 320 Washington St. He stated he was driving Westbound on Washington St. when he swerved to avoid something and hit the curb. Once he hit the curb, he stated he then hit the sign, light pole and MWRA vent. Based on the statements made to me, I have issued MA uniform citation #T2080057 for violation of c90 s10 unlicensed operation of a motor vehicle. A licensed operator ( MA OLN SA2360612) took possession of MV#1. The operator of MV#2 stated he was travelling eastbound on Commonwealth Ave directly behind MV#1 when he struck it. MV#2 sustained heavy front end damages and was eventually towed by Tody's Towing. There were no reported injuries to the operator of MV#2. MV#2 had an active registration and insurance. The operator of MV#2 did not have a driver's license on his person and was never issued a MA license. The operator of MV#2 stated he is from Azerbhijan and have a license from that country but did not have it on his person. I observed a gash on his head right above his eye and noticed all airbags had been deployed in his vehicle. I asked him to sit down and I radioed for an ambulance. Kiflit stated that he was driving EAST on Watertown St when he collided with a unoccupied parked car (a red 2015 Jeep Wrangler, MA Con R22519) which was parked on the street outside of 856 Watetown St. Kiflit was driving his girlfriend's car (a gray 2020 Nissan Sentra, MA Reg 1ANN57) and was on his way home in Watertown. When I asked for Kiflit's license, he told me that he only has a permit and has yet to take the test. He apologized repeatedly. Kiflit did not have any passengers in his vehicle. Kiflit said the roadway was so dark and he didn't see the parked Jeep. He claimed he was not speeding. There was minimal damage done to the drivers side rear bumper of the Jeep. On arrival at the same time with the Fire and Medics, I observed a female laying in the middle of the lot facing down on her back. A small red and gray CVS like type shopping carriage was knocked over and resting on it's side in front of the victim's head. The carriage was moved to the side in order to tend to the victim I also observed a black Honda Civic bearing MA reg.# 3741TW that was involved in the accident. The Honda was out of the parking spot resting approximately two feet away from the pedestrian's legs. I then spoke to the pedestrian identified as Darla Gipson in the rear of the ambulance. She sustained an abrasion to her front left shoulder and arm area which I observed. She also complained of left knee and elbow pain. She stated that she walking through the middle of the parking lot pushing the carriage by the door entrance in a westerly direction towards Chestnut Street. She states that she never saw a vehicle backing up and then she was suddenly struck and believes she was pushed underneath the vehicle. She was then transported to Newton Wellesley Hospital by Cataldo Ambulance. I then spoke to the operator of the Honda Civic identified as Linda Burke (MA S70320414). Ms. Burke was parked in the first spot to the right of the walkway that leads to the entrance/exit doorway. I asked her what occurred and she stated that she was backing her vehicle up to exit the parking lot when she looked behind her not seeing anything in sight. She then started backing up and struck the pedestrian without realizing it. She says the driver of a green cab and his female customer who were no longer on scene were yelling at her to stop her vehicle because the pedestrian was underneath it. She then stopped her vehicle. I observed minor scrapes to the entire rear bumper of the vehicle so it is unknown where it actually struck the pedestrian/carriage. I observed no obvious signs of damage to the carriage. Mcneill stated he was on his phone texting and lost sight of the road. Mcneill's vehicle veered off the side of the road and side swiped a City of Newton Tree causing heavy right side damage and loss of the front right tire. Mcneill's wife came to the scene to pick him up and drive him home. The set of golf clubs in the trunk of the vehicle was documented in the MV Inventory Crash Form. Mcneill suffered no injuries and signed a patient refusal with the medics. Tody's towed the vehicle. Mcneill was given MA Uniform Citation # T2013042 for the amount of $ 210 for M.G.L Ch 89/S4A Marked Lanes Violation and M.G.L Ch. 90/S13B Texting While Driving Violation.
