Centre Street and Washington Street are both public ways in the City of Newton. At the time of the accident the weather was cloudy with light rain. The road conditions were fairly dry. I spoke to the operator of MV1 identified as Julie Lym (S16060051) who stated she was traveling northbound on Washington Street onto the Centre Street bridge. MV1 stated she was attempting to cut across lanes to merge on to the Mass Pike Westbound. MV1 stated traffic was at a standstill and she saw an opening to change lanes. MV1 stated MV2 was stopped in front of her and as she attempted to change lanes her vehicle side swiped the rear drivers side corner of the school bus. The operator of MV1 reported no injuries. MV1 sustained minor damage and was able to leave the scene. I spoke with the operator of MV2 identified as Antonio Mendes Goncalves (S54275868) who stated he was stopped at the red light in the right middle lane on the Centre Street bridge. MV2 stated MV1 attempted to change lanes and struck the rear drivers side corner of the school bus. MV2 sustained minor damage and the operator reported no injuries. MV2 is a City of Newton contracted yellow school bus that had six children present on the bus at the time of the accident. The school bus was transporting th e children to Bigelow Middle School. All children present reported no injuries and their parents were notified by the school administration. Captain Anastaisa stated that the operator of the scooter was a 12 year old male who had sustained unknown injures and had been transported to Boston Children's Hospital via ambulance. Upon my arrival at the crash scene I made the following observations, Putnam and Winthrop streets are public ways in the city of Newton that are two way single lane non divided roadways. The roadway surface was wet from rain earlier in the day. Putnam St runs north to south and Winthrop St runs east to west. There is a stop sign at the end of Winthrop St at Putnam St. I observed MA reg 54MN41 a 2005 Buick LeSabre stopped in the south bound lane of Putnam St approximately 1/2 of the way into the intersection with Winthrop St. I observed approximately three feet of skid marks from the Buick's rear tires. I also observed at the crash scene a Segway Ninebot electric scooter that was on the ground near the Buick(cid:31)s rear passenger side door with its handlebars detached. I spoke with the operator of the Buick, Robert DeSouza who stated that on 05/20/2019 at approximately 16:50 hours he was driving south bound on Putnam St at approximately 25 miles per hour. DeSouza stated that he saw a man, later identified as Jose Estabil standing on the east sidewalk of Putnam St facing Winthrop St who was yelling and waving his arms at something on Winthrop St. DeSouza stated he looked to his right towards Winthrop St and his view was obstructed by a row of hedges. DeSouza stated that as he was looking to his right he began to apply his vehicle's brakes when he saw someone coming at me \". DeSouza stated that he heard a crashing noise from the rear passenger's side of his vehicle. DeSouza stated that he stopped his vehicle after the crash and saw a boy lying on the ground at the rear passenger side of his vehicle. DeSouza stated that he was not injured in the crash. DeSouza's vehicle had minor damage to its rear passenger side door, and did not require a tow. Witness Charlotte Hart stated that at approximately 16:30 hours on 05/19/2019 she was diving south bound on Winthrop St. Hart stated that she had to stop short on Putnam St to avoid a crash \" with a boy on a scooter that was racing around on Winthrop St. \" Hart sated that she told the boy on the scooter that he should not be ridding the scooter in the street. Witness Jose Estabil stated that he was walking on the east side walk of Putnam St across from Winthrop St. Estabil stated that he saw a boy an electric scooter on Winthrop St approaching Putnam St. Estabil stated that he saw DeSouza's vehicle driving south bound on Putnam St approaching Winthrop St. Estabil stated that the boy on the scooter made no effort to stop, slow or avoid the crash with DeSouza's vehicle. Witness Laurel Fransworth stated that she was driving north on Putnam St approaching Winthrop St when she saw the crash occur. Farnsworth stated a boy on an electric scooter on Winthrop St crash into the rear passenger side door of DeSouza's vehicle. Fransworth stated that she believed that the row of hedges at the end of Winthrop St obstructed DeSouz's vehicle. Rowan Delaney ( 02/27/2007 ) stated that on 05/20/2019 at approximately 16:00 hours he and his fellow F.A. Day Middle School student Thiaugo Rubino ( 03/04/2007 ) were having a race around the area of Winthrop St, Putnam St and Shawn St. Delaney stated that he was on foot running on sidewalks while Rubino was on an electric Ninebot Segway scooter. Delaney stated that Rubion was not wearing a helmet or any other safety equipment. I spoke with Delaney(cid:31)s father Royston Delaney, who stated that the scooter was his and that he was unaware that Rubino was using his scooter, and that he has never seen him ridding it before. Royston Delaney stated that the scooter is battery powered and has a maximum speed of 19 MPH. Royston Delaney stated that his son told him that only Rubino was ridding the scooter. Rubino was transported via ambulance to Boston Children(cid:31)s Hospital. On 05/20/2019 Rubino underwent surgery for a brain bleed. I spoke with Rubion(cid:31)s mother Sonia Rubino who stated that as of 05/21/2019 her son was under observation and in addition to the brain surgery her son had a broken arm, broken leg and a broken back. Based upon witnessed statements and my observations of the crash area I believe that Rubion was at fault for the cause of this crash. Upon my arrival at the crash scene I made the following observations, Wiswall Rd is a two lane non divided public way in the city of Newton that runs north to south from a dead end to Dedham St. The posted speed limit on Wiswall Rd is 25 MPH. M Roadway is a two lane non divided public way that runs west to east from Wiswall Rd to a dead end cul-de-sac. The weather conditions at the at of the crash were cloudy, and the roadway surface was wet from rain. I observed MA commercial registration M82794 a gray 2014 Honda Accord stopped in the north bound lane of Wiswall Rd at M Roadway. The Honda is registered to Newton Driving School. I observed two smudge marks approximately four inches in length on the center portion of the front and rear passenger side doors of the Honda. I also observed a 20 inch Kent bike that had be moved from it's final point of rest prior to my arrival. The bike had damage to it's front handle bars, front tire and it's two front forks. The bike's front tire had gray scuff marks on it. At the crash scene I spoke with the operator of the Honda, David Dombrovsky. Dombrovsky stated that he was driving north bound on Wiswall Rd near M Roadway approximately 20 to 25 MPH. Dombrovsky stated that he has had his learner's permit for six months and is a student at the Newton Driving School. Dombrovsky stated that he did not see the bicyclist but heard the impact of the bicyclist stricking the passenger side of the Honda. At the crash scene I spoke with driving school instructor, Igor Drizik. Drizik stated that the Honda was driving north on Wiswall Rd near M Roadway at approximately 20 to 25 MPH . Drizik stated that he did not see the bicyclist until approximately 1 to 2 seconds before impact on the driver's side of the Honda. Drizik stated the Honda is equipped with dual brakes and that he applied the brakes at the same time as Dombrovsky. Drizik stated that he and Dombrovsky got out of the Honda to render aid to the bicyclist. There were three other driving school students in the rear of the Honda at the time of the crash, neither of them stated that they witnessed the crash. None of the occupants of the Honda stated that they were injured and the vehicle did not require a tow. The bicyclist was identified as David Kerwin-Derrick. Kerwin-Derrick was transported via EMS to Boston Children's Hospital form treatment. At the hospital I spoke with one of Kerwin-Derrick's mother's, Patricia Kerwin-Derrick, who stated \" We all know that David rode his bike into the car \" and that her son had a broken left leg. Kerwin-Derrick is a student at the Memorial Spaulding School. Based upon my observations of the crash scene and statements made to me , I believe that Kerwin-Derrick's unintentionally rode his bike into the passenger side of the Honda. As motor vehicle 1 proceeded into the intersection a bicycle came out of no where and the operator of motor vehicle 1 struck the bicycle at a low speed with the front of motor vehicle 1. The cyclist states he was traveling east on Woodland Rd. when he proceeded into the intersection he was struck on his right side by motor vehicle 1. The crash was at a low speed and the bicycle tipped over to the left side, causing an injury to his left arm. The cyclist states it was hard to see due to the rain. When the cyclist was asked if he had stopped at the intersection he stated he was not sure if he stopped or just slowed down. When asked if he came to a complete stop and placed a foot onto the ground, the cyclist stated no. The cyclist stated normally when he stops he just balances in place and doe not take his foot off the pedals. When I asked the cyclist if he passed other vehicles on the right to get up to the intersection he stated yes, he normally does so. It should be noted there is no dedicated bike lane and both streets are narrow at this intersection. MED2 transported the cyclist to NWH for his arm injury. I took pictures of the roadway as well and the bicycle and motor vehicle 1. Both Derby Street and Waltham Street are public ways owned and maintained by the City of Newton. Upon arrival I spoke with the pedestrian identified as Helen Makadia (S35538182) who stated she was walking in the crosswalk on Waltham Street heading towards Derby Street when she was struck by MV1. Helen stated she was able to walk to the side of the road after impact but complained of knee pain. Medic 2 responded and Helen signed a patient refusal. Sgt. Lee transported Helen to the Franklin Elementary School where she was picking up her children and then she left on her own accord. The operator of MV1 identified as James Bond (S93760526) stated he was taking a left turn from Derby Street onto Waltham Street and did not see the pedestrian in the crosswalk until he struck her with his vehicle. James was very remorseful and acknowledged he was at fault. James reported no injuries and had no damage to his vehicle. I spoke with the operator of MV1, Corey Remblad (S29346684). Remblad stated he was operating his 2007 Ford Ecoline (CT: 53CC04) Southbound on Chestnut Street towards Avalon Road. Remblad stated there was construction ahead of him on Chestnut Street and there was a police officer working a detail that was waving him on to continue down Chestnut Street. Remblad stated MV2 exited Avalon Road and it's front driver side crashed into the driver side of his vehicle. I observed moderate damage to the middle driver side of MV1. Remblad and his passenger Thomas Solecki report no injuries. I spoke with the operator of MV2, Richard Yunker (S70658898). Yunker stated he was operating 2019 Ford F150 (MA AMN: 5921) Westbound on Avalon Road towards Chestnut Street. Yunker was operating the vehicle in his capacity as a Field Supervisor Paramedic for Cataldo Ambulance. Yunker stated he approached the intersection and came to a stop before taking a right turn onto Chestnut Street. Yunker stated as he made his right turn his front driver side crashed into the driver side of MV1. I observed moderate damage to the front driver side of MV2. Edelson stated she was stopped in traffic while operating her 2012 Toyota Camry (MA: 81ZH83) Northbound on Walnut Street at Lincoln Street at a red light. Edelson stated the light turned green and she had a green left turn only arrow. Edelson stated she turned left into Lincoln Street from Walnut Street when the front passenger side of her vehicle crashed into a pedestrian in the roadway. Edelson stated she did not see the pedestrian prior to the impact. I observed damage to the lower portion of the passenger side windshield. Edelson reported no injuries. I spoke with the injured pedestrian, Lawrence Murren, at Brigham and Women's Hospital. Murren stated he had entered the crosswalk on Lincoln Street at Walnut Street and does not remember if he had the pedestrian signal. Murren believes MV1 did have the green light. Murren stated after he entered the crosswalk he looked back towards the \"59 Bus\". Murren stated he then looked forward and saw MV1 was in front of him. Murren stated he was unable to avoid the vehicle. Murren stated he has an injury to his hip and had a head laceration. I spoke with a witness to the accident, Edward Austin. Austin stated he was in the vehicle behind MV1 at the traffic light on Walnut street. Austin stated the traffic light turned green and MV1 had a green left turn arrow. Austin stated MV1 started to go and make their left turn. Austin stated he observed an older gentleman starting to walk out into the street. Austin stated the pedestrian had his head down and had an umbrella due to the rain. Austin stated the pedestrian also had a do no walk sign. Austin stated MV1 hit the crossing pedestrian in the crosswalk. Austin stated he does not believe either saw each other. I spoke with the operator of MV1, Kevin Gilmore (S27275907). Gilmore stated he was operating his 2015 Volkswagon Golf (MA: 1EHH93) Westbound on California Street towards Crafts Street. Gilmore stated he came to a stop at the stop sign on California Street. Gilmore stated he looked to his right, and then to his left. Gilmore stated he began to make his right turn onto Crafts Street when his vehicle made contact with a pedestrian in the roadway. Gilmore stated he did not see the pedestrian until contact was made. I observed no damage to the right passenger side of MV1 where the contact occurred. Gilmore reported no injuries. The injured pedestrian, Charles Doris-Pierce (S68331436), was transported to Brigham and Women's Hospital in Boston for his injuries. I followed up with him in the Emergency Department. Doris-Pierce stated MV1 was stopped at the stop sign on California Street. Doris-Pierce stated he entered the marked crosswalk and began to cross California Street at Crafts Street. Doris-Pierce stated MV1's right passenger side tire ran over his foot. Doris-Pierce stated he then slammed on the hood of MV1. Doris-Pierce stated MV1 continued and he was knocked to the ground. Doris-Pierce reported injuries to his foot, thigh, and back. After speaking with all parties involved, the operator of MV1 was issued Massachusetts Uniform Citation T2016430 for Chapter 89, Section 11 (Failure to Yield to a Pedestrian in a Crosswalk). Upon arrival, I observed MV1 (MA Pass:13LM32) to be at rest on the side of the road with it's front end contacting a tree, aproximaytely 150 feet south of the above address at a bend in the road. It should be noted that it had been raining for hours prior to this accident and that the road surface was wet; additionally the tree did not appear to be damaged. Upon speaking to the operator of MV1, he stated that he was traveling Southbound on Melrose St. when he navigated around a parked car in front of the above address and as he did so, may have overcorrected or due to the current road surface condition, accidently struck the tree. The front seat passenger of MV1 concurred with the operator's statement. Both parties stated they were not injured. MV1 sustained damage to its front end. As MV1 was not impeding traffic, AAA contacted and towed MV1 at the behest of the operator. I then spoke with the operator of V2, Ms. Nunnally stated that a vehicle had abruptly pulled out of the driveway of 717 Centre St. She stated she applied her brakes immediately to avoid contact and pulled to the right. She stated when she stopped she felt rear impact from V2. Both parties had no injuries at this time. V2 was towed by Todys towing to 1354 Washington Street Newton. Fleming stated he was traveling on Franklin Street (N) at the intersection of Shornecliff Road. Fleming stated he went to back his vehicle up and did not see any vehicles behind him. Fleming stated the real of his vehicle crashed into the front of MV2. I observed damage to the sand dispensing attachment on the rear of MV1. Fleming reported no injuries. I spoke with the operator of MV2, Lisa Perry (S21890600). Perry stated she was operating her 2016 Honda Pilot (MA: 5WP321) on Franklin Street (N) towards Shornecliff Road. Perry stated she was stopped behind MV1 when it backed up and crashed into the front of her vehicle. I observed damage to the front bumper/light area of MV2. Perry reported no injuries. A query of Perry's registration status through Newton Dispatched stated it was expired. As a result of the impact Vehicle 1 sustained major damage to the roof of the cargo area. The force of the impact caused the utility pole #44 to break in half. It should be noted that at the time of the crash the weather was steady rain with high winds. No injuries were reported on scene. The operator of Vehicle 1 stated that he was traveling southbound on Waverly Ave and did not see the power lines until it was too late. After further investigation it was determined that a tree(private) located on Brackett Rd had come down due to the high winds and landed on power lines. These power lines were also attached to utility pole #44. The force caused the power lines from utility pole #44 to sag over Waverley Ave. As result Vehicle 1 did not have enough clearance under the power lines. She stated while traveling a red truck with a red trailer was on her right side traveling along side her, and while traveling the trailer had \"swung\" into her passenger side of her vehicle. She stated the truck/trailer kept traveling and she followed the trailer and took pictures while driving. She then went home and called her insurance company with the picture of the registration plate and they gave her the information which brought them at Anthony Rd at Anthony Cir, where the registered owner lived. The truck / trailer was not at the location. The trailer is MA trailer reg # C39390 a 2013 Brav trailer color red registered to CIRO CARBONE AND SONS INC 12 ANTHONY CIR NEWTON MA. Her vehicle is a 2020 Kia utility color white MA reg. 6ZG351. I observed some red transferred paint on her passenger side from the rear door to the front door. I advised them of process and I would look into the trailer. I was able to find the truck/trailer on California St at Dalby Street. I looked around the trailer and observed a minor scratch on the driver side of the trailer near the front of the trailer. I contacted the owner who due to the heavy rain all day sent home his employees. I will update oper 2 statement when I talk to him. At this time it appears with the trailer scratch being minor a reasonable person would have not known. Update: Monday October 19, 2020 I spoke with the oper of v2 via phone, he stated he was on Washington Street near Whole Foods traveling westbound with the truck/trailer. Brentwood Ave is a two way non divided public way in the City of Newton that runs east to west from Greenlawn Ave to Walnut St. Brentwood Ave is a thickly settled residential area with a 25 MPH speed limit. The roadway conditions at the time of the crash were wet due to rain. I observed MA reg 111ZS1 a 2020 Honda Civic parked on the side of Brentwood Ave just passed the intersection of Judith Rd facing westbound. I observed that the Honda had damage to it's front driver's side bumper. When I inspected the Honda I observed that the driver's side headlight casing was cracked and a piece of it was missing. I further observed an approximately six inch in diameter spider web like crack in the lower driver's side windshield. The windshield crack was inward , indicating that an external object had caused the damage. There was another single crack onn the driver's side windshield that extended from the hood to the roof. The operator of the Honda , Lisabeth Ioannilli stated that on 04/29/2021 at 15:20 hours she was driving westbound on Brentwood Ave near the intersection of Judith Rd. Ioannilli stated that she estimated that the speed of her vehicle was approximately 25 to 30 MPH. Ioannilli stated that she did not see a bicyclist in her path of travel until the point of impact when her vehicle was aproximately 3/4 of the way passed the intersection of Judith Rd. Ioannilli stated that her vehicle's front driver's side bumper made contact with the bicyclist. Ioannilli stated that the bicyclist was tossed off of her bike and onto the hood and windshield of her vehicle before rolling onto the ground. Ioannilli stated that she pulled her vehicle to the side of the road and went to check on the bicyclist. Judith Rd is a public way in the City of Newton that runs east and then turns south from Walnut St to Brentwood Ave. There are no traffic control devices at the intersection of Judith Rd and Brentwood Ave. Ioannilli stated that she was not injured in the crash and her vehicle did not require a tow. At the crash scene, the bicyclist , Lucia Campbell, a student a FA Day Middle School ( DOB 11/08/2006 ) was being treated in an ambulance and was transported to Boston Children's Hospital for treatment. Campbell was conscious and was able to answer questions from EMS members. Campbell stated that she was wearing a helmet at the time of the crash and that she rode her bike south on Judith Rd and was turning eastbound onto Brentwood Ave when the crash occurred. I spoke with Campbell's parents Adam Campbell and Iris Delasota who stated that their daughter was under going x rays and other tests to determine if she has internal injuries. I took photo's of the bike, Honda and crash scene and the disk was downloaded by the NPD's IT Bureau. Based upon my investigation of this crash I concluded that Ioannilli was at fault for it. I issued via US mail Ioannilli MA Uniform Citation T1446633 and cited her for a violation of MGL 90/14 failure to use care while approaching a bicyclist. I spoke with the operator of MV2 who said she was traveling Eastbound on Washington Street traveling approximately 20mph. Operator of MV2 said she began pressing down on her breaks due to the red light but said her car continued to slide and would not stop. Operator of MV2 said it was at this point her car collided with MV1. It should be noted it was raining throughout the day and it drizzling at the time of the accident causing the roadways to be wet and slippery. Both MV1 and MV2 were towed away from the scene by Tody's. Both of the operators retrieved their valuables from their vehicles prior to the vehicles being towed away. Both of the operators did not sustain any injuries. Park Street supports two way travel (N, S) with no marked divider to indicate travel lanes. I spoke with the operator of the 2013 Nissan Juke (MA: 137LX7) involved in the crash, Ms. Cynthia Cowan (S59504510). Ms. Cowan stated she was traveling on Park Street (N) towards Alba Circle. Ms. Cowan stated ahead of her there was a large landscaping truck (MA CON: X1515, 2001 Ford DRWSUP) parked on the right side of the roadway and blocking her lane of travel. Ms. Cowan stated she looked ahead of the landscaping truck and did not see any traffic coming towards her in the opposite lane. Ms. Cowan stated she entered the opposite lane of travel (S) to pass the parked landscaping truck and continue down Park Street. Ms. Cowan stated as she was traveling past the front of the landscaping truck, she crashed into a standing mower that had entered the roadway. Ms. Cowan stated the mower entered the roadway from in front of the parked landscaping truck. Ms. Cowan stated because of her obstructed view from the landscaping truck, she did not see the mower until it was too late. Ms. Cowan stated she stopped her vehicle and observed the operator of the mower on the sidewalk in front of 248 Park Street. I observed damage to the front passenger fender/bumper/wheel area with airbag deployment from the driver seat. I also observed yellow paint transfer on the front bumper area consistant with the color of the mower involved. MV1 was removed from the roadway by Tody's Towing. Ms. Cowan signed a patient refusal with Newton Medics and walked home from the crash site. The other party involved in the crash is a landscaper for 4 Seasons Services. I observed a yellow Wright Standing Mower 52\" resting on the side of the roadway in the Northbound lane. The mower has significant damage to its front portion. 4 Seasons Services removed the mower from the roadway. A worker on scene estimated the value of the mower to be $11,000.00. Photos were taken of the mower, MV1, and the roadway and submited to the IT Bureau. The injured party, Mr. Louis Padilla-Gonzalez (S32927586), was transported to Newton Wellesley Hospital for a left shoulder injury and an injury to the left side of his face. I spoke with Mr. Padilla-Gonzalez in the emergency room with the assitance of a language translation service set up by the nursing staff there. Mr. Padilla-Gonzalez stated he was operating the standing mower and left the sidewalk into the road. Mr. Padilla-Gonzalez stated he drove by the front of the parked landscaping truck and when he got into the street he saw a car coming towards him fast. Mr. Padilla-Gonzalez stated he tried to reverse the mower and get out of the way, but he could not because of the wet roadway. Mr. Padilla-Gonzalez stated he was hit by MV1 and thrown from the mower to the street. After speaking with Ms. Cowan and Mr. Padilla-Gonzalez, it appears both parties had their view of the roadway obstructed due to where the 4 Seasons Services landscaping truck (MA CON: X1515) was parked. I did not observe any posted parking restrictions where the vehicle was parked, but due to the size of the vehicle it did take up the entire Northbound travel lane in front of 248 Park Street. The location of the parked landscaping truck and the wet road surface contributed to the crash. She was going to attempt to contact the person who rented the vehicle and get back to me. The person that rented the vehicle was a woman out of Brockton. KYLAS Auto was going to contact her to identify the person who she allowed to drive the vehicle this morning. The woman identified by KYLA'S Auto body as the person who rented the involved vehicle was a Maria Amado, 234 Green St, Brockton Ma. 02301. Commonwealth Avenue and Lowell Avenue are both public ways maintained by the City of Newton. The weather at the time of the crash was overcast with light rain. The road surface at the time of the crash was wet. Feeney Brothers Utilities has been performing gas repair services at this intersection for the past month and they have had a paid Newton Police Detail with them during their service. The detail presented itself as follows on my arrival. There was service being conducted in the northbound lane of Lowell Avenue in-between the Commonwealth Avenue carriage roads. A large trench was present in the northbound lane that made the roadway impassible. Traffic was permitted to travel down the southbound lane of Lowell Avenue towards Commonwealth Avenue for the detail. Access to Lowell Avenue from Commonwealth Avenue was prohibited. The northbound lane was blocked by orange construction cones and road closed signs. There was also no access to the Commonwealth Avenue carriage roads at this location. Both of these roadways were closed with orange construction cones and caution tape. There was also caution tape and orange construction cones restricting access to a walkway that traveled from Commonwealth Avenue to its carriage road just after Lowell Avenue (E). I also observed a \"Sidewalk Closed\" sign posted on the walkway. I spoke with Officer Gabriel of the Newton Police Department. Officer Gabriel stated he was working a paid detail for Feeney Brothers at this location. Officer Gabriel stated he had just assisted two female parties cross Commonwealth Avenue (E) at Lowell Avenue. Officer Gabriel stated a short time later, he heard a scream and observed two female parties laying on the roadway on the opposite side of Commonwealth Avenue in the carriage road. Officer Gabriel immediately contacted Newton Police Dispatch via his portable radio and requested aid for the injured parties. Prior to my arrival, Officer Gabriel stated one of the pedestrians was transported to Newton Wellesley Hospital with a head injury. I spoke with one of the pedestrians involved in the crash, Ms. April Stein. Ms. Stein stated she was walking in the carriage road of Commonwealth Avenue (E) towards Lowell Avenue with her friend Sarah Kish. Ms. Stein stated when they got to Lowell Avenue there was work being done in the roadway, and a Police Officer assisted them with crossing the area. Ms. Stein stated they then re-entered the carriage road when they crossed Lowell Avenue. Ms. Stein stated they were walking along the edge of the roadway when they were hit by a front loader. Ms. Stein stated they fell to the roadway due to the collision. Ms. Stein stated she did not hear or see the front loader backing up towards them and did not notice it because they were having an \"intense conversation\". Ms. Stein reported no injuries and signed a patient refusal with Fallon Medics. I asked Ms. Stein if she had transportation to her residence. Ms. Stein stated she would walk home. I spoke with the operator of the front loader involved in the crash, Mr. Mark Mannion (S91049325). Mr. Mannion is an employee of Feeney Brothers Utilities and stated he was operating a 2015 Case Loader (MA CON: R99118) at the time of the crash. Mr. Mannion stated he was backing up the loader down the Commonwealth Avenue carriage road (E) from Lowell Avenue. Mr. Mannion stated he was going to get a load of fill from a pile of dirt on the side of the road inside the marked off work area. Mr. Mannion stated as he was backing up, he was looking over his right should behind him to make sure there were no obstacles in his way. Mr. Mannion stated his emergency backing alarm was activated while he was backing up. Mr. Mannion stated he noticed something enter the roadway to his right side and immediately slammed on his brake. Mr. Mannion stated then heard a scream and saw 2 female parties on the ground. Mr. Mannion stated he exited the loader and checked on the welfare of the two women. Mr. Mannion's CDL License, Vehicle Registration, and Hoisting License are all active. I asked Mr. Mannion to put the vehicle in reverse to assess if the emergency backing alarm was functioning properly. Mr. Mannion was cooperative and while reversing the vehicle the emergency backing alarm was functioning properly in my presence. I asked Mr. Mannion if the loader had moved since it was brought to a stop due to the crash. Mr. Mannions stated it had not moved. I observed this vehicle to be within the parameters of the work zone that was taped off. The vehicle at this time was released back to Feeney Brothers. Photos were taken of the work site and loader and submitted to the IT Bureau. I responded to Newton Wellesley Hospital and spoke with Ms. Sarah Kish (S85088490) in the Emergency Room. Ms. Kish stated she was walking down the Commonwealth Avenue carriage road (E) towards Lowell Avenue with her friend April Stein. Ms. Kish stated a Police Officer assisted them with crossing Lowell Avenue via the crosswalk located on Commonwealth Avenue. Ms. Kish stated after they crossed Lowell Avenue, they walked to the carriage road. Ms. Kish stated as they were walking, she was hit from behind by a front loader in the roadway. Ms. Kish stated she did not hear or see the front loader and believes the bucket hit her in the head. Ms. Kish stated she fell to the roadway. Ms. Kish was transported to Newton Wellesley Hospital for her injuries. Ms. Kish stated at this moment, she had some lacerations to her back and head, and her left shoulder/neck/back area was sore. I asked Ms. Kish how often she walks that particular route. Ms. Kish stated 5 times a week. Ms. Kish stated there was nothing in place to restrict her access down to the carriage road after she crossed Lowell Avenue. I spoke with a witness to the crash via telephone, Ms. Megan Boitano. Ms. Boitano stated she was traveling on Lowell Avenue (N) towards Commonwealth Avenue. Ms. Boitano stated she was stopped at the light right next to the trench that was in the northbound lane of Lowell Avenue. Ms. Boitano stated she observed two women crossing Lowell Avenue at Commonwealth Avenue in front of her. Ms. Boitano stated she then observed a heavy piece of construction equipment approaching the trench to her left at a high rate of speed. Ms. Boitano stated it startled her as the front loader dumped dirt into the trench. Ms. Boitano stated she then observed the front loader back down the carriage road at a high rate of speed towards a dirt pile. Ms. Boitano stated she observed the two women that just crossed Lowell Avenue in the roadway behind the front loader. Ms. Boitano stated she lost sight of the women, and then observed the front portion of the front loader aggressively shake. Ms. Boitano stated she then observed one of the women walk around from the side of the front loader holding her head. As presented while investigating this crash, the Feeny Brothers work site appeared to be properly set up to mitigate a potential safety incident with ample cones, barriers, caution tape, and signage. There was also a police detail present to assist with pedestrian travel. The area of the work zone where the pedestrans entered from Commonwealth Avenue after crossing Lowell Avenue was taped off with caution tape and a sidewalk closed sign was present. M. Wade of the Newton Police Traffic Bureau at 0032 hours. Sgt. Wade stated a serious motor vehicle crash occurred on Washington Street in Newton and it involved a City of Newton marked police cruiser (N494). Sgt. Wade stated Officer Katelyn Pohlman and the operator of the other vehicle involved were transported to the hospital with potential serious injuries. I was requested by Sgt. Wade to respond to the scene from my residence and investigate the crash further. On arrival at the scene, I observed the two vehicles involved in the crash to be a 2015 Ford Explorer (MA: 586RT7) and Newton Police marked unit N494 (MA MVN: MP494B). These vehicles were observed disabled on the roadway in front of 612 Washington Street, Newton. There was a large debris field comprised of various parts from both vehicles on the roadway and in the parking lot of 612 Washington Street. The road surface at the time of my arrival was wet and there was light rain falling. Sgt. Wade reported that at the time of the crash the road was completely dry and it had not started to rain yet. Washington Street is a public way maintained by the City of Newton. The portion of Washington Street where the crash took place supports two- way travel, Eastbound and Westbound. There are two travel lanes in both directions. Travel direction is divided by a double yellow line in the middle of the roadway. The area is well lit and features numerous light poles illuminating the roadway. The closest intersection to this location is Crafts Street just west of the crash location. MV1 (MA: 586RT7) had substantial front-end damage, especially to its front passenger side and was inoperable. I observed this vehicle at its final rest on the roadway with its front end facing Northbound on Washington Street just over the double yellow line in the middle of the roadway. The front and side impact airbags had deployed inside the vehicle as a result of the collision. I did not observe anything hanging inside the vehicle that would have obstructed the view of the operator prior to the collision. MV1 was removed from the roadway by Tody's Towing. MV2 (MA MVN: MP494B) had substantial front end damage and was inoperable. The impact from the collision caused the vehicle to spin uncontrolled and the final rest, with the front end of the vehicle facing the front entrance to the 7-11 (S). The vehicle's final rest was on the sidewalk in front of 612 Washington Street. The front and side impact airbags had deployed inside the vehicle as a result of the collision. I did not observe anything hanging inside the vehicle that would have obstructed the view of the operator prior to the collision. MV2 was removed from the roadway by Tody's Towing. The Officer involved in the crash is Officer Katelyn Pohlman. Officer Pohlman stated she was operating Newton Police marked unit N494 on Washington Street (E) past Crafts Street. Officer Pohlman stated as she was operating her vehicle past 612 Washington Street (7-11), a vehicle in the westbound lane of Washington Street abruptly crossed the double yellow line in the roadway and entered her travel lane head-on. Officer Pohlman stated she did not have an opportunity to react to the vehicle in front of her and the front passenger side of MV1 crashed into the front end of her vehicle (MV2). Officer Pohlman sustained injuries to her left forehead area and both of her arms. Officer Pohlman was later transported to Brigham and Women's Hospital for evaluation and was released a short time later. It was reported to me by numerous Officers on scene that Officer Pohlman exited her cruiser after the crash and rather than tend to her own injuries, she focused her efforts on rendering aid to the operator of the other vehicle involved. Officer Pohlman found the operator of the other vehicle lying on the floor of the front passenger seat under the dash. Officer Pohlman rendered aid to the operator while waiting for Newton Medics to arrive. Officer Pohlman was also assisted in rendering aid to the other operator by Officer Conary and Officer Larson. Officer Larson reported that while interacting with the operator of MV1, the operator repeated numerous times, \"Is she ok? Is she ok?\". Officer Larson also stated the operator said to him \"I feel bad because I was texting on my phone\". Officer Larson stated the operator of MV1 works for the Department of Corrections Special Operations Unit and has Department issues equipment inside the vehicle. The following items were placed into Support Services, locker 9 for safekeeping by Officer Larson: 1 Gray Pelican Gun Case, 1 Black Gun Belt, 1 Taser, 1 Can OC Spray, 15 (50) Round Cases Of Ammunition. The operator of MV1 (MA: 586RT7) was identified as Mr. David Cafarelli (S16965940). Mr. Cafarelli was transported to Newton Wellesley Hospital for a potential head injury before my arrival. I spoke with Mr. Cafarelli at Newton Wellesley Hospital in the Emergency Room with Sgt. Wade. Mr. Cafarelli's mother and father were present when we spoke with him. Mr. Cafarelli stated he was out with friends before the crash and was driving to the 7-11 on Washington Street. Mr. Cafarelli admitted that before the crash, he had his cell phone in his hand while he was operating his vehicle. Mr. Cafarelli stated he does not remember if he was texting or changing the music on his phone at the time of the crash. Mr. Cafarelli stated he looked up and was unable to avoid the vehicle (N494) directly in front of him. Mr. Cafarelli stated he also does not believe he applied his brakes before the collision. When we spoke with Mr. Cafarelli in the Emergency Room, he was still waiting for test results to determine the severity of his injuries. On Monday, August 23, 2021, Sgt. Wade responded to 612 Washington Street, Newton to retrieve surveillance footage from the 7-11 of the crash. 7-11 stated their outside surveillance system was not operating correctly, but they were able to capture some of the incident from a camera inside the store. I observed this footage. MV1 is observed traveling on Washington Street (W) in the westbound travel lane in front of the storefront. MV1's driver side is then observed traveling over the double yellow line in the middle of the roadway and into the eastbound lane of Washington Street. A head on collision ensues and MV1 can be seen rotating counterclockwise in the roadway backwards to its final rest location on Washington Street. MV2 is then observed at its final rest position on the sidewalk facing southbound in front of the 7-11 storefront. After completing my investigation, I have surmised the following. Mr. Cafarelli was operating his 2015 Ford Explorer (MA: 586RT7) in the area of 612 Washington Street, Newton. Mr. Cafarelli was holding his cell phone in his hand while operating his vehicle. Mr. Cafarelli became distracted while he was operating his vehicle due to his attention being focused on his cell phone. Mr. Cafarelli traveled over the double yellow line from the westbound lane of Washington Street and entered the eastbound lane of Washington Street. Newton Police marked unit N494 was traveling on Washington Street (E) in the area of 612 Washington Street at this time. Mr. Cafarelli's vehicle crashed into the front end of Newton Police marked unit N494. Mr. Cafarelli was not wearing a seatbelt and as a result of the impact from the crash, he was ejected from the driver seat and his final rest inside the vehicle was in the flood of the front passenger seat. As a result of my investigation, Mr. Cafarelli was issued Massachusetts Uniform Citation for Chapter 90, Section 13B (Hands-Free Violation), Chapter 89, Section 4a (Marked Lanes Violation), and Chapter 90, Section 13a (Seat Belt Violation). The operator of MV1, Fanes Nerestant (S47503048) stated he was operating a City of Boston owned 2012 Chevrolet School Bus (MA SBN: SB37810) west on Washington Street towards the Learning Prep. Mr. Nerestant stated he slowed his vehicle down and put on his right direction to take a right turn into the parking lot at 1488 Washington Street to pick up students at the Learning Prep School. Mr. Nerestant stated he then felt impact from the back of the bus and heard a \"boom\". Mr. Nerestant was transported to Newton Wellesley Hospital for neck and back pain. I observed minor damage to the rear driver side bumper/fender area. There were no other occupants on the bus at the time of the crash. The operator of MV2, Mr. Allen Simon (S44212695) stated he was operating his 2018 Nissan Altima (MA: CS12BM) west on Washington Street near 1488 Washington Street. Mr. Simon stated the school bus in front of him in his travel lane abruptly stopped to make a turn and he was unable to avoid crashing into the vehicle. MV2's front passenger side front end sustained heavy damage as a result of the collison. Mr. Simon reported no injuries. MV2 was removed from the roadway by Tody's towing. MV1 operator stated after MV2 stopped in the middle of the intersection, it reversed backwards and struck his MV. MV1 sustained extensive front end damage and was towed by Todys. Mr. Ghera stated he is a driver for JSC Transportation (contracted by the City of Newton) and was picking up a student to transport them to Newton South High School. Mr. Ghera stated his vehicle, a 2019 Ford Transit Van (MA SPN: 109403 ), was parked in front of Beacon Street (E) with it's red flashing lights activated while Ms. Ella Glennon was entering the vehicle for transport. At this time, MV2 (2020 Lincoln Aviator (MA: 3AB494) travelled past MV1 Eastbound on Beacon Street and disregarded the flashing lights that were activated on the van. MV2's front passenger side door mirror made contact with MV1's front driver side door mirror. I observed very minor damage to the mirrors on both vehicles. No injuries were reported. I spoke with the pedestrian involved in the crash, Ms. Sharon Sabin. Ms. Sabin stated she entered the roadway to cross near 281 Beacon Street (S to N). Ms. Sabin stated she believes she was in the marked crosswalk at this time. Ms. Sabin stated she observed a vehicle to her left stop to let her cross. Ms Sabin stated a the second vehicle (MV1) did not stop and made contact with the tips of her boots. Ms. Sabin was evaluated by Fallon Medics and signed a patient refusal. Ms. Sabin report no injuries. I observed no damage to the boots Ms. Sabin was wearing at the time of the crash. I spoke with the operator of MV1, Ms. Hallie Geller. Ms. Geller stated she was operating her 2014 Toyota Prius (MA: 2AS375) in the area of 281 Beacon Street when a police vehicle with it's emergency lights and siren approached her from behind. Ms. Geller stated as she attempted to pull over to the right side of the road so the cruiser could pass, Ms. Sabin stepped into the crosswalk. Based on my observations, it is unclear if MV1 made contact with Ms. Sabin's toes. Witness said MV1 crossed into the northbound lane, and operated through the driveway entrance and into the stone wall belonging to Glen Ave Association. Witness stated there were no other MVs on the road at this time and they were unsure if MV1 operator was on their cellphone while driving. Witness stated MV1 operator crawled out from the vehicle and there were no one else involved or in the car. MV1 sustained heavy and extensive front end damage, and was towed by Todys. MV1 operator stated they only had chest pains, and was not suffering from any head or neck injury at this time. Due to the nature of the incident and quick response by Newton Medics, I was unable to speak to MV1 operator, who was transported to Newton-Wellesley Hospital. I was able to speak to an employee of Glen Ave Association and advised them of the incident.
