OPERATOR OF MV 1 STATED SHE WAS TRAVELING SOUTH ON CENTRE ST WHEN SHE STOPPED AT THE CROSSWALK AT INTERSECTION OF NEWTONVILLE AVE AND CENTRE ST FOR A PEDESTRIAN WALKING THEIR DOG. ONCE MV 1 CAME TO A COMPLETE STOP THEY WERE STRUCK IN THE REAR BY MV 2. MV 1 WAS UNABLE TO GET A LICENSE PLATE OR A DESCRIPTION DUE TO THE WEATHER (HEAVY SNOW) AND THE FACT THAT THEY JUST PULLED OVER TO THE SIDE AND ASSUMED MV 2 WOULD DO THE SAME. MV 2 NEVER PULLED OVER TO EXCHANGE INFORMATION AND CONTINUED GOING SOUTH ON CENTRE STREET. MV 1 SUSTAINED MODERATE REAR END DAMAGE AND NO INJURIES REPORTED. THERE WAS A PARTIAL PLATE GIVEN BY THE PEDESTRIAN CROSSING THE STREET OF 915.

Narrative:
On Tuesday, April 16, 2019 while assigned to Traffic unit N525, I responded to the area of Plymouth Road and Cochituate Road, Newton for a report of a motor vehicle/pedestrian accident involving a City of Newton vehicle. The weather at the time of the accident was clear and sunny. The road surface was dry. Plymouth Road and Cochituate Road are both public ways maintained by the City of Newton. The injured pedestrian, Officer Steven Emmanuel, was transported to Newton Wellesley Hospital prior to my arrival on scene. I spoke with the operator of MV1, Officer Justin Lau. Lau stated he was on duty in his official capacity as a Newton Police Officer while operating a City of Newton owned 2018 Ford Fusion (MA: 9PYM80, Newton PD #1319). Lau stated he was parked on Plymouth Road (N) at Cochituate Road and was speaking with Officer Steven Emmanuel. Lau stated Emmanuel was standing next to the front driver side door area of his vehicle in the roadway. Lau stated a large delivery trucked approached their location on Plymouth Road from Woodward Street and was attempting to make a right turn onto Cochituate Road. Lau stated Emmanuel directed him to back his vehicle up so the delivery truck could get by their location. Lau stated he cut the wheel of the vehicle he was operating to the right; and very slowly began to back up from his location. Lau stated he was attempting to back the vehicle up to get closer to the curbing and out of the roadway. Lau stated as the vehicle was in motion the front driver side wheel made contact with Emmanuel's left foot. Emmanuel's left foot subsequently became lodged in the front driver side wheel well area. Emmanuel fell to the ground in obvious pain. Emmanuel directed Lau to pull the vehicle forward in an effort to release his foot. Emmanuel's foot was freed and NPD Dispatch was notified of the accident. Pictures were taken of MV1 and submitted to the IT Bureau. I observed no damage to the front driver tire area. I spoke with Officer Steve Emmanuel in the Newton Wellesley Hospital emergency room where he was being evaluated for a left foot injury. Emmanuel stated at the time of the accident he was working a paid detail for Paramount Pictures on Plymouth Road in his official capacity as a Newton Police Officer. Emmanuel stated he was speaking with Officer Lau on Plymouth Road at Cochituate Road. Emmanuel was standing in the street on his post and Lau was sitting in MV1 (parked). Emmanuel stated a Fed Ex delivery truck approached their location in the roadway and was attempting to get by them. Emmanuel stated Lau began to back his vehicle up in an effort to get out of the way of the delivery truck. Emmanuel stated the front driver side tire of MV1 ran over his left foot. After the tire ran over his foot, it then became lodged in the wheel well and he fell to the ground. Emmanuel stated his foot was freed from the vehicle and he was transported to Newton Wellesley Hospital by Newton Medics for further evaluation.

The operator of Vehicle #1, identified as Ms.Erzsebet Piros, stated that she took a left turn from Walnut St onto Washington St prior to the colliding with Ms. Kim Nguyen. She further stated that she did not see the pedestrian prior to hearing the collision. Her passenger, identified as Ms. Amy Torres, was sitting in the front passenger seat. She stated a similar account, and did not see the pedestrian prior to the collision. Neither party complained of injury, when asked. A witness, Ms. John Angelucci, was travelling in his vehicle, in the lane next to Ms. Piros. He stated that he only heard the collision, and couldn't see it due to vehicle lights, and the falling rain. The pedestrian, Ms. Kim Nguyen, stated that she attempted to cross the street, when she did not see any cars coming. She stated that she didn't see Vehicle #1 approaching until it was too late to get out of the way. It should be noted that Ms. Nguyen was not attempting to cross inside of a crosswalk, and was wearing dark colored/Navy Blue clothing. Ms. Nguyen was transported to Beth-Israel Hospital, and was communicating effectively prior to transport. Pictures of the scene, and damage to the vehicle were taken, and sent to IT for entry.

Operator of MV1 stated he was traveling southbound on Centre Street and came to a stop to allow three pedestrians and a dog to cross at the crosswalk at Allerton Rd. Operator of MV2 stated he observed MV1 stopping to allow people to cross and he came to a complete stop as well. Operator of MV3 stated she did not see MV2 stopped and did not see his brake lights on. MV1 said that when the pedestrians were about three quarters of the way crossed, he heard a loud crashed and saw MV2 swerve into the on coming traffic lane. MV2 made slight contact with the rear of MV1 causing scratches to the rear left bumper. MV2 said MV3 struck him from behind causing him to push forward. He swerved into the on coming lane to avoid hitting MV1. He continued to turn to the left in order to avoid the pedestrians that were still crossing. No contact was made with them. Newton Fire Engine 3 and Cataldo PB3 responded. MV2 was towed by David Donahue from Todys Towing. It sustained major rear end damage. The operator of MV2 was evaluated by Cataldo PB3 and signed a patient refusal. MV3 was towed by Bobby Donahue from Todys Towing. It sustained heavy front end damage, front air bag deployment and a small spill from the engine block. Operator of MV3 was evaluated and transported to NWH by PB3 for minor injuries. The three pedestrians witnessed the accident. All three stated that MV1 stopped to allow them to cross and they saw MV2 also come to a complete stop. MV3 struck MV2 from the rear causing him to swerve into the on coming lane to avoid hitting MV1 and them.

THE FORCE OF THE IMPACT ALSO CAUSED DAMAGE TO OTHER AREAS OF HER VEHICLE, CRACKED, BUMPER ALONG WITH HER DRIVERS SIDE MIRROR. IT WAS LATER DETERMINED THAT JUST PRIOR TO VEHICLE #1 PASSING THE SCENE A POSTAL EMPLOYEE HAD JUST STARTED TO ATTEMPT TO TIE OFF THE WIRE TO A FENCE AT THE SAME TIME CAUSING THE ACCIDENT . VERIZON WAS CONTACTED EARLIER DUE TO A COMPLAINT OF A WIRE DOWN. PRIOR TO THE POSTAL WORKER ATTEMPTING TO PUT THE WIRE UP THERE WAS NO IMMEDIATE HAZARD IN THE ROAD. HOWEVER THE WIRE WAS BLOCKING THE SIDEWALK AND APPARENTLY THE POSTAL EMPLOYEE WAS CONCERNED THAT A PEDESTRIAN MIGHT TRIP ON IT.

THE OPERATOR WAS UNINJURED AND THE VEHICLE HAD LITTLE TO NO DAMAGE TO THE FRONT RIGHT PASSENGERS SIDE. THE PEDESTRIAN, MICHAEL MCKEAN, STATED HE RAN OUT TO CROSS THE STREET AND DIDN'T SEE MV1. HE SUFFERED A MINOR RIGHT FOOT INJURY AND WAS TRANSPORTED TO ST. ELIZABETHS. BY MEDIC 1. ALL PASSENGERS OF MV1 REPORTED THAT THE OPERATOR WAS NOT SPEEDING AND THE PEDESTRIAN DARTED INTO THE STREET. THE OPERATOR HAD DASH CAM FOOTAGE OF THE ACCIDENT, AND IT SHOWED MV1 TRAVELING WESTBOUND ON BEACON ST APPROACHING THE VEHICLE PULLED TO THE SIDE OF THE ROAD. IT THEN SHOWED THE PEDESTRIAN RUN INTO THE STREET WITHOUT LOOKING, GETTING STRUCK BY THE FRONT PASSENGER SIDE OF MV1 AND FALLING TO THE GROUND. THE OPERATOR WILL BE E-MAILING THE FOOTAGE TO BE ATTACHED TO THIS REPORT. 1 PHOTO WAS TAKEN OF THE VEHICLE AND SUBMITTED TO THE IT BUREAU.

Operator of MV1 stated he was traveling Eastbound on Beacon St. and stopped for a pedestrian in the crosswalk located in front of 281 Beacon St. The operator of MV1 further stated as he came to a complete stop at the crosswalk MV2 rear ended him. Operator of MV2 stated she was traveling Eastbound on Beacon St. when she stopped behind MV1 in traffic. Operator of MV2 further stated as she was stopped in traffic MV3 rear ended her with enough force resulting in her vehicle colliding with MV1. The operator of MV3 stated she was traveling Eastbound on Beacon St. when she observed MV2 stopped in traffic, however she attempted to stop to avoid a collision but rear ended MV2. It should be noted the operator of MV3 attempted to turn her vehicle away from MV2 but she stated it was too late. No injuries. All involved parties signed patient refusals. MV1 sustained minor rear end damage. MV2 sustained moderate front and rear end damage. MV3 sustained heavy front end damage. Tody's responded and towed MV3. A towed motor vehicle form was filled out and placed on file.

On 11/6/19 at approximately 0610 hrs I responded to 15 Needham St., the National Lumber for a MVA involving a pedestrian. Upon arrival I spoke to the pedestrian who was lying on the street who stated he landed on his back and couldn't feel if anything was hurting. I advised him to stay put until the medics responded. The pedestrian was wearing brown pants and a black jacket and stated he was listening to his head phones when he attempted to cross the street. Where he attempted to cross was down Needham St from the main intersection and there was no crosswalk. He attempted to cross from the National Lumber side crossing the S/SW travel lane first. I then talked to the operator of MV#1 who stated he turned right onto Needham St from Winchester St and didn't see anybody attempting to cross until the last second. At this time he stated he jammed on his brakes and saw pedestrian on the hood of his Pickup before he fell to the ground. There was minor damage to the hood of the vehicle on the passenger side. The pedestrian was evaluated by the Medics and transported to NWH for further evaluation. Pictures were taken on scene and turned over to the IT bureau.

Narrative:
On Monday, December 9, 2019, while assigned to Traffic unit N525, I responded to the intersection of Lincoln Street and Walnut Street, Newton for a report of a motor vehicle crash involving a pedestrian. The weather at the time of the crash was rain. The road surface was wet. Lincoln Street and Walnut Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Jill Edelson (S99137352). Edelson stated she was stopped in traffic while operating her 2012 Toyota Camry (MA: 81ZH83) Northbound on Walnut Street at Lincoln Street at a red light. Edelson stated the light turned green and she had a green left turn only arrow. Edelson stated she turned left into Lincoln Street from Walnut Street when the front passenger side of her vehicle crashed into a pedestrian in the roadway. Edelson stated she did not see the pedestrian prior to the impact. I observed damage to the lower portion of the passenger side windshield. Edelson reported no injuries. I spoke with the injured pedestrian, Lawrence Murren, at Brigham and Women's Hospital. Murren stated he had entered the crosswalk on Lincoln Street at Walnut Street and does not remember if he had the pedestrian signal. Murren believes MV1 did have the green light. Murren stated after he entered the crosswalk he looked back towards the "59 Bus". Murren stated he then looked forward and saw MV1 was in front of him. Murren stated he was unable to avoid the vehicle. Murren stated he has an injury to his hip and had a head laceration. I spoke with a witness to the accident, Edward Austin. Austin stated he was in the vehicle behind MV1 at the traffic light on Walnut street. Austin stated the traffic light turned green and MV1 had a green left turn arrow. Austin stated MV1 started to go and make their left turn. Austin stated he observed an older gentleman starting to walk out into the street. Austin stated the pedestrian had his head down and had an umbrella due to the rain. Austin stated the pedestrian also had a do no walk sign. Austin stated MV1 hit the crossing pedestrian in the crosswalk. Austin stated he does not believe either saw each other. Photos were taken of the area and submitted to the IT Bureau.

On 12/23/19, at 1919 hours, I responded to the area of 807 Washington St. for pedestrian struck by a motor vehicle. Upon arrival with Cataldo Medics and Newton Fire, I observed Catherine Chapman being treated in the westbound lane a few feet in front of a 2010 Hyundai Elantra (MA Reg. 4KH 743). The vehicle had a shattered windshield. Ms. Chapman appeared to be wearing a dark colored jacket and dark pants. The operator of the motor vehicle, Emily Shuman, stated she was traveling westbound in the outside lane when Ms. Chapman stepped in front of her car from the eastbound lane. I also spoke with a witness, Malcolm Robinson, who stated Ms. Chapman was crossing the street from the eastbound lanes with two other people. The other two people stopped in the middle of the street but Ms. Chapman kept walking and was struck. The other two people were Victor Polk and Halimah Polk, both of which confirmed the witness statement. Ms. Chapman was transported by Cataldo to Brigham & Womens Hospital with non-life threatening injuries. Todys towed the vehicle and pictures of the scene were submitted to IT.

Narrative:
The operator of MV#1 stated he was travelling northbound on Walnut St when the top portion of his vehicle caught some low hanging wires and took down 2 utility poles and damaged a third utility pole. There were no reported injuries to the operator of MV#1 and no visible damages to MV#1. The operator of MV#1 is a delivery driver that is familiar with the area and frequents the same route. There were several live primary wires down on Floral St and Walnut St. Unit N-498 Officer Raymond blocked off Walnut St at Centre St, Unit N-502 Officer Nardelli blocked off eastbound Floral St and I blocked off Walnut St at Lincoln St. The surrounding pedestrian sidewalks were all taped off with Police caution tape. MV#1 struck the low hanging wires on Walnut St at the intersection of Floral St. Utility pole #A (47/12 ) located on Walnut St directly in front of the parking of the "Orchid Dry Cleaners" at 1175 Walnut St was cracked at the base. Utility pole #B was located on the westbound side of Floral St was split at the base and was dangling over the parking lot at 1175 Walnut St. Utility pole #C was located on the eastbound side of Floral St and was completely removed from its foundation and was now leaning on the building at 1182 Walnut St. The street/ stop sign of Floral St was damaged with the "Stop" sign and the "Floral St" sign completely removed from the pole (Located on the eastbound side of Floral St). A city tree limb that was damaged and landed on top of parked Vehicle #2 (Parked on the eastbound side of Floral St across from 49 Floral St. Wisconsin registration 850TGM). The owner of vehicle #2 was informed of the damage. Traffic Officer Gaudet took digital photographs of the damaged street/ stop sign and the damaged city tree. The witness Pat O'Hara of 1185 Walnut St stated MV#1 did not cause the accident but a previous bigger truck did. All he could provide was that the vehicle was a big truck travelling northbound on Walnut St. The witness Edna Jacquet stated she was parked on Walnut St (Parked between 09:00 to 09:15) at the MBTA bridge facing southbound when she observed the accident. Edna stated she observed the operator make eye contact with her and she proceeded to honk her horn in attempts to stop him. Edna stated the vehicle that caused the accident was a white colored 18 wheeler type of truck with the markings of "3 letters" all in different colors. Edna have a company video camera that faces forward attached to her vehicle that may have captured the accident. I spoke to her company manager Lisa Sanella at "TransAction Corporate Shuttles" located at 5 Wheeling Ave in Woburn MA and she will notify me if she is able to view video footages. The building owner of 1170- 1176 Walnut St Stas Gavronsky have a surveillance camera that faces Walnut St southbound towards Floral St. He will review the video footages once power have been restored that the area and notify me. On 01/07/2020 Lisa Sanella contacted me stating that they were able to review video footages from the front facing camera of Edna's shuttle bus. She stated that the involved vehicle was described as a big white colored 18 wheeler type of truck and did not have a front registration plate but did display the commercial company name of "GHG Logistics". Lisa stated the accident was time recorded at 09:13. Lisa made a copy of the video footage and will attempt to email it or deliver a flashdrive to me. An internet search of GHG Logistics showed that it is a distribution company out of 6390 Hedgewood Dr suite #300 out of Allentown PA. This company distributes wholesale sushi to the northeast area and their delivery trucks are equipped with "Rydsmart" GPS tracking devices enabling them to know their locations at all times. I spoke to Joanna Gerwig who is the store support team leader of the "Wholefoods" located at 916 Walnut St inquiring about a possible sushi delivery and she confirmed that GHG Logistics does regular deliveries and did deliver items yesterday morning between 08:00 -09:00. She stated that the truck displayed trailer #250634-481801 and that the driver was described as a big sized white male by the name of "Will" with a contact number of (570) 350-3453. She also have video footages of the truck making the delivery and provided me with their contact number of (800) 668-7700 and their corporate number of (484) 223-4502 (Confirmed to be the same company as my internet search). I viewed the video footage from Transaction Corporate Shuttles and it showed the 18 wheeler truck was travelling northbound on Walnut, catching the utility wires above and causing an electrical spark on the eastbound side of Floral St. It showed the truck slowed down and then continued to travel northbound. I spoke to Will at (570) 350-3453 and he confirmed he was making deliveries to the Wholefoods and was on Walnut St at approximately 09:00. Will stated the top corner portion of his truck did catch the above wires and heard a "twang". Will stated he briefly stopped and did not observed any damages so he continued to make his deliveries. Will stated he have been making the same delivery route for 2 years and never had an issue with low hanging wires. Will's full name is William L. Gray and have a Pennsylvania driver's license # 24551299. The truck's registration is apportioned Indiana 2917618. I have forwarded the video footage to the I.T bureau and it was attached to this report.

Narrative:
On 01/09/20 at approximately 13:30 hours, a pedestrian Scott Lorenz came in to the lobby of Newton Police Headquarters to report that he was struck by a motorist while crossing the intersection of Cherry & Webster Streets. This accident took place at approximately 13:00 hours on this date. Mr. Lorenz further stated that he was walking on foot and attempting to cross Cherry Street going eastbound at Webster Street. He says that he did not activate the cross walk signal but thought it was clear to proceed as Webster Street had a red light signal. While attempting to cross, he says that the westbound lane of Webster Street received a green light and MV1 proceeded to turn left on to Cherry Street from Webster Street. He then looked at the motorist and thought that she saw him. Once she kept approaching and realizing that he was not seen, he started to back track but was struck by the front end of MV1. Lorenz then tumbled back and fell down to the ground. He says that he got up feeling fine and alerted the motorist that he was struck. The two of them exchanged information and then left the scene with out notifying 911 of the accident. After, Lorenz then came in to Newton Police Headquarters to report it. I observed a small round swollen red mark to the inside of his right knee area and a red mark to the back left side of his neck. Digital photos were taken of his injuries. Mr. Lorenz declined medical attention and wanted this incident documented in case his possible injuries worsened. I then spoke to the operator of MV1, Sharon Pywell (MA S23277423), on the phone after. Pywell stated that she was operating her Toyota Prius bearing MA reg. # 2197RW on Webster Street facing westbound at Cherry Street waiting for the green signal to turn left on to Cherry Street. Once the light changed, she attempted to turn and never saw a pedestrian trying to cross Cherry Street. I asked her if she ever felt contact to which she replied that she was not aware that she ever struck someone. She further says that once she did see him, she believed that he never lost his balance or ever fell down. She says that he retrieved his backpack from the ground and approached her driver's side opening her door stating that he was struck by her.

Zhang stated that at 0630hrs, he was bicycling to work northbound on Centre St just before Cabot St. Zhang stated that an unidentified vehicle struck him with the passengers side mirror and continued driving northbound on Centre St. Zhang stated that he was very confused because he did not feel the vehicle hit him or his bicycle, but observed the mirror fall off. Zhang stated he was not injured and his bicycle was not damaged. The only description of the vehicle is a black small car. Zhang could not give any information on the driver.

On 12/3/2020 at 1400hrs I investigated a past motor vehicle crash involving a pedestrian. The crash occurred on 12/03/2020 at approximately 1240hrs. The crash was located in the area of 483 Centre St. Centre St is a public way in the city of Newton. Vehicle 1 was traveling southbound on Centre St near the area of 483 Centre St. Pedestrian 1 was located on the southbound side of Centre St near 483 Centre St. Pedestrian entered the southbound lane of Centre St and was struck by Vehicle 1. As a result of the impact Pedestrian 1 sustained a minor injury to his left leg. Vehicle 1 had no known damage. No parties were transported. No tow was required. It should be noted that the crash was reported by the Operator of Vehicle 1 Daniel Zandman at approximately 1400hrs. Zandman states that he was operating his Vehicle southbound on Centre St just after the intersection at Church St. Zandman states that Pedestrian 1 unexpectedly ran in front of his vehicle. Zandman stated that he did not have enough reaction time to come to a complete stop and his front bumper made contact with Pedestrian 1. Zandman stated that after impact he immediately got out of his vehicle and checked on Pedestrian 1. Zandman described pedestrian on as a 10 year old white male identified as Dexter Jagoditish. Zandman stated that while on scene Dexter called his mother Jess Jagoditish who immediately responded to the scene. Zandman stated that he exchanged information with Jess Jagoditish who then took Dexter home. Zandman states that a witness Mia Martin was also on scene. At approximately 1425hrs I called and spoke to Dexter and his mother Jess Jagoditish. Dexter states that he was walking on the sidewalk near 483 Centre St. Dexter states that he wanted to cross Centre St and thought there were no cars coming. Dexter stated that he entered the southbound lane of Centre St and a car came out of no where and hit him. I then spoke to Jess Jagoditish who is Dexter's mother. Jess stated that she received a call from Dexter around 1240hrs stating he was just hit by a car. Jess stated that when she arrived on scene Dexter was with Zandman and a witness Mia Martin. Jess stated that both Zandman and Martin explained them what had happened. Jess stated that Dexter appeared to be ok so she decided to take him home. Jess states that at this time Dexter has a bruise on his left calf but otherwise appears to be ok. At 1551hrs I spoke with the witness Mia Martin. Martin states that just prior to the crash she was walking her dog behind Dexter. Martin states that "out of nowhere" Dexter sprinted into the southbound lane of Centre St. Mia states that she then observed Vehicle 1 attempt to slow down and swerve to the lest to avoid Dexter. Mia states that the passenger side front bumper then made contact with Dexter. Mia states at impact Vehicle 1 was traveling at a very slow speed. Mia states that Dexter was then knocked on to the ground but then immediately jumped up and started to run away. Mia states that both she and Zandman were able to get Dexter to comeback so that they could check to see if he was ok. Mia states that Dexter was then able to contact his mom who responded on scene. Due to this crash being reported after the fact, Fire, EMS or Police where not initially notified and did not respond to the scene. Pictures were also not taken of the crash scene. At this time this report is for documentation purposes. After speaking with all the parties involved it appears that the crash was caused by Pedestrian 1 entering the roadway in a manner which gave Vehicle 1 little or no time to react.

On 2/8/21 I was working N491 when I responded to an MVA PED on Washington St. at Crafts St.. Upon arrival I spoke with Dennis Delicata who stated that he was traveling southbound on Crafts St. when he turned left onto Washington St. during a green light a pedestrian later identified as Jamie Correia ran out in front of his truck and he struck him. Delicata stated the Jamie was traveling in the travel lane of Washington St. going Eastbound across the intersection not in the crosswalk and he did not see him in time. Delicata stated he slammed on his brakes however could not stop in time. Delicata stated he got out of his truck and rendered aid to Correia who was complaining of pain in his back and shoulder. Delicata stated that Correia said to him "I thought I could make it". I spoke with Jamie Correia who was being evaluated by the medics. Correia said he was running across the intersection headed Eastbound and thought he could make it across. Medics transported Correia to NWH. Delicata's vehicle suffered minor damage and was driven away from the scene. Pictures were taken and submitted to IT.

On Friday, April 23rd 2021, at approximately 6:55am, I, Officer Brooks, responded to Chestnut street at Prince street, for an MVA pedestrian. Upon my arrival I spoke with an adult female who stated she was walking eastbound on Prince street and was attempting to cross Chestnut street. She stated she looked northbound and did not see anyone coming so she attempted to run across the street and was struck by a vehicle coming from her left. The pedestrian stated she was not in the cross walk, and that she was struck in the area of her left hip and thrown to the ground. She was not complaining of any injuries and refused to be evaluated by EMS. I noted the pedestrian was wearing a full body length purple coat and a winter hat. The operator of MV1(MA REG 9JYJ50) stopped to check on the pedestrian and left her phone number before leaving the scene. I was able to speak with the operator who stated she was traveling northbound on Chestnut street, and as she approached Prince street a female party ran out in front of her vehicle causing her to slam on the breaks. The operator stated she did not believe that she made contact with the pedestrian but that she did observe her fall to the ground. She stopped to check on the pedestrian who stated they were ok, and she provided her phone number to her. I explained in the future she would need to contact us immediately or she could be charged with leaving the scene of an accident, and she was unaware of all the information she needed to provide to the other party. The operator and the pedestrian were both provided the report number. Due to MV1 leaving the scene before my arrival photographs could not be taken.

On Monday, July 19, 2021, while assigned to Traffic unit N525, I responded to the area of Commonwealth Avenue and Lowell Avenue, Newton for a report of a MVA/Pedestrian crash. Commonwealth Avenue and Lowell Avenue are both public ways maintained by the City of Newton. The weather at the time of the crash was overcast with light rain. The road surface at the time of the crash was wet. Feeney Brothers Utilities has been performing gas repair services at this intersection for the past month and they have had a paid Newton Police Detail with them during their service. The detail presented itself as follows on my arrival. There was service being conducted in the northbound lane of Lowell Avenue in-between the Commonwealth Avenue carriage roads. A large trench was present in the northbound lane that made the roadway impassible. Traffic was permitted to travel down the southbound lane of Lowell Avenue towards Commonwealth Avenue for the detail. Access to Lowell Avenue from Commonwealth Avenue was prohibited. The northbound lane was blocked by orange construction cones and road closed signs. There was also no access to the Commonwealth Avenue carriage roads at this location. Both of these roadways were closed with orange construction cones and caution tape. There was also caution tape and orange construction cones restricting access to a walkway that traveled from Commonwealth Avenue to its carriage road just after Lowell Avenue (E). I also observed a "Sidewalk Closed" sign posted on the walkway. I spoke with Officer Gabriel of the Newton Police Department. Officer Gabriel stated he was working a paid detail for Feeney Brothers at this location. Officer Gabriel stated he had just assisted two female parties cross Commonwealth Avenue (E) at Lowell Avenue. Officer Gabriel stated a short time later, he heard a scream and observed two female parties laying on the roadway on the opposite side of Commonwealth Avenue in the carriage road. Officer Gabriel immediately contacted Newton Police Dispatch via his portable radio and requested aid for the injured parties. Prior to my arrival, Officer Gabriel stated one of the pedestrians was transported to Newton Wellesley Hospital with a head injury. I spoke with one of the pedestrians involved in the crash, Ms. April Stein. Ms. Stein stated she was walking in the carriage road of Commonwealth Avenue (E) towards Lowell Avenue with her friend Sarah Kish. Ms. Stein stated when they got to Lowell Avenue there was work being done in the roadway, and a Police Officer assisted them with crossing the area. Ms. Stein stated they then re-entered the carriage road when they crossed Lowell Avenue. Ms. Stein stated they were walking along the edge of the roadway when they were hit by a front loader. Ms. Stein stated they fell to the roadway due to the collision. Ms. Stein stated she did not hear or see the front loader backing up towards them and did not notice it because they were having an "intense conversation". Ms. Stein reported no injuries and signed a patient refusal with Fallon Medics. I asked Ms. Stein if she had transportation to her residence. Ms. Stein stated she would walk home. I spoke with the operator of the front loader involved in the crash, Mr. Mark Mannion (S91049325). Mr. Mannion is an employee of Feeney Brothers Utilities and stated he was operating a 2015 Case Loader (MA CON: R99118) at the time of the crash. Mr. Mannion stated he was backing up the loader down the Commonwealth Avenue carriage road (E) from Lowell Avenue. Mr. Mannion stated he was going to get a load of fill from a pile of dirt on the side of the road inside the marked off work area. Mr. Mannion stated as he was backing up, he was looking over his right should behind him to make sure there were no obstacles in his way. Mr. Mannion stated his emergency backing alarm was activated while he was backing up. Mr. Mannion stated he noticed something enter the roadway to his right side and immediately slammed on his brake. Mr. Mannion stated then heard a scream and saw 2 female parties on the ground. Mr. Mannion stated he exited the loader and checked on the welfare of the two women. Mr. Mannion's CDL License, Vehicle Registration, and Hoisting License are all active. I asked Mr. Mannion to put the vehicle in reverse to assess if the emergency backing alarm was functioning properly. Mr. Mannion was cooperative and while reversing the vehicle the emergency backing alarm was functioning properly in my presence. I asked Mr. Mannion if the loader had moved since it was brought to a stop due to the crash. Mr. Mannions stated it had not moved. I observed this vehicle to be within the parameters of the work zone that was taped off. The vehicle at this time was released back to Feeney Brothers. Photos were taken of the work site and loader and submitted to the IT Bureau. I responded to Newton Wellesley Hospital and spoke with Ms. Sarah Kish (S85088490) in the Emergency Room. Ms. Kish stated she was walking down the Commonwealth Avenue carriage road (E) towards Lowell Avenue with her friend April Stein. Ms. Kish stated a Police Officer assisted them with crossing Lowell Avenue via the crosswalk located on Commonwealth Avenue. Ms. Kish stated after they crossed Lowell Avenue, they walked to the carriage road. Ms. Kish stated as they were walking, she was hit from behind by a front loader in the roadway. Ms. Kish stated she did not hear or see the front loader and believes the bucket hit her in the head. Ms. Kish stated she fell to the roadway. Ms. Kish was transported to Newton Wellesley Hospital for her injuries. Ms. Kish stated at this moment, she had some lacerations to her back and head, and her left shoulder/neck/back area was sore. I asked Ms. Kish how often she walks that particular route. Ms. Kish stated 5 times a week. Ms. Kish stated there was nothing in place to restrict her access down to the carriage road after she crossed Lowell Avenue. I spoke with a witness to the crash via telephone, Ms. Megan Boitano. Ms. Boitano stated she was traveling on Lowell Avenue (N) towards Commonwealth Avenue. Ms. Boitano stated she was stopped at the light right next to the trench that was in the northbound lane of Lowell Avenue. Ms. Boitano stated she observed two women crossing Lowell Avenue at Commonwealth Avenue in front of her. Ms. Boitano stated she then observed a heavy piece of construction equipment approaching the trench to her left at a high rate of speed. Ms. Boitano stated it startled her as the front loader dumped dirt into the trench. Ms. Boitano stated she then observed the front loader back down the carriage road at a high rate of speed towards a dirt pile. Ms. Boitano stated she observed the two women that just crossed Lowell Avenue in the roadway behind the front loader. Ms. Boitano stated she lost sight of the women, and then observed the front portion of the front loader aggressively shake. Ms. Boitano stated she then observed one of the women walk around from the side of the front loader holding her head. As presented while investigating this crash, the Feeny Brothers work site appeared to be properly set up to mitigate a potential safety incident with ample cones, barriers, caution tape, and signage. There was also a police detail present to assist with pedestrian travel. The area of the work zone where the pedestrans entered from Commonwealth Avenue after crossing Lowell Avenue was taped off with caution tape and a sidewalk closed sign was present. The crash happened inside the work zone parameters.

The weather at the time of the crash was overcast. The road surface was dry. Parker Street and Boylston Street are both public ways in the City of Newton. The operator of the vehicle involved was identified as Mr. Viktor Gyuris (S12195708). Mr. Gyuris stated he was operating his 2012 Honda Odyssey (MA: 231EG9) on Parker Street (S). Mr. Gyuris stated he had a green light and proceeded to make a left turn on to Boylston Street (W) when a pedestrian walked into the front driver side fender area of his vehicle. Mr. Gyuris stated he observed the pedestrian at the last second and stated she was not in the crosswalk and was talking on her phone. I observed very minor damage to the front driver side fender/hood area above the front driver side tire. Mr. Gyuris reported no injuries. I spoke with the injured pedestrian, Ms. Marine Manukian (S20246517). Ms. Manukian stated she was crossing Boylston Street (W) at Parker Road (N) when she was hit by the front driver side of MV1. Ms. Manukian stated she was on her phone at the time of the crash and does not recall if she had the pedestrian signal to cross. Ms. Manukian reported injuries to her right hand, elbow, and both knees. Ms. Manukian signed a patient refusal with Fallon Medics and was provided a ride away from the area by the operator of MV1.

Oppenheim stated that she did not see the pedestrian due to low light conditions. Oppenheim estimated that her vehicle's speed at the time of the crash to be 10 to 15 MPH due to heavy traffic. Oppenheim stated that the pedestrian latter identified as Joseph Colucci stepped off the sidewalk and into her path of travel in the roadway. Oppenheim stated Colucci was not in a marked crosswalk. Oppenheim stated that she stopped her vehicle to check on Colucci who told her that he was not injured and did not want medical aid. Colucci stated that he was struck on his right side and fell to the ground. Colucci signed a patient refusal form provided to him by medics. Colucci stated that he did step off the side walk in front of 392 Watertown St to cross the street. Colucci acknowledged that he was not in a marked crosswalk at the time of the crash. On Wednesday, February 16, 2022, while assigned to Traffic unit N525, I responded to the intersection of Cabot Street and East Side Parkway for a report of a motor vehicle/bicycle crash. The weather at the time of the crash was clear and sunny. The road surface was dry. Cabot Street and East Side Parkway are both public ways maintained by the City of Newton. I spoke with the operator of MV1 (2016 Mazda CX3, NY: JNB6711), Mr. Tushar Singhal (NY: 287647610). Mr. Singhal stated he was operating his vehicle on Cabot Street (E) towards the East Side Parkway intersection. Mr. Singhal stated he came to a complete stop at the stop sign on Cabot Street. Mr. Singhal stated he did not see any vehicles or pedestrians in the area at this time. Mr. Singhal stated he proceeded to travel through the intersection from his stopped positon and take a left turn onto East Side Parkway. Mr. Singhal stated at this time a bicyclist crashed into the passenger side of his vehicle. Mr. Singhal stated the bicyclist then fell over his hood and onto the roadway. Mr. Singhal reported no injuries from the crash. I observed damage to the front passenger side door, mirror, fender, and hood. Sgt. M. Wade spoke with the injured bicyclist, Keiji Imai, while he was being evaluted by Newton Medics. Mr. Imai stated he was operating his Trek bicycle on Cabot Street (W) towards the East Side Parkway intersection. Mr. Imai stated he was on the sidewalk and entered the intersection with out stopping. Mr. Imai stated he crashed into the side of MV1 and fell to the roadway. Mr. Imai was transported to Newton Wellesley Hospital with minor injuries to his left wrist and rear. Keiji was wearing a helmet at the time of the crash. I observed the helmet to have no fresh damage or defects. Photos were taken of the helmet to document it's condition. Keiji's father, Koguke Imai, was made aware of the crash involving his son and stated he would respond to the hospital. I observed no substantial damage to the Trek bicycle. I transported Keiji's blackTrek bicycle to Keiji's residence. I spoke with a witness to the crash, Ms. Madison Albano. Ms Albano stated she was walking her dog on Cabot Street (E) on the Northbound sidewalk at the East Side Parkway intersection. Ms. Madison Albano stated she observed MV1 approach the intersection to her right side on Cabot Street (E) and come to a stop at the stop sign. Ms. Albano stated she then observed MV1 make a left turn onto East Side Parkway and she heard a crash. Ms. Albano stated she observed a bicyclist crash into the passenger side of MV1 and then fall to the roadway. Ms. Albano stated she did not see the bicyclist prior to the crash and does not know if he came off of the sidewalk or was in the roadway. After speaking with all involved parties, I have summized the following. As MV1 was completing his left turn onto East Side Parkway (N) from Cabot Street (E), the involved bicylist failed to yield at the stop sign while traveling on Cabot Street (W) across the intersection. The bicyclist entered the intersection with out yielding and crashed into the passenger side of MV1. MV1 had the right of way. No citations will be issued as a result of this crash. Photos were taken of the scene and submitted to the IT Bureau. Keiji is a student at Newton North High School.

On 4/29/22 while working N496, I responded to the area of 287 Jackson St for a pedestrian crosswalk signal that was knocked over due to a possible past hit & run. On arrival I located the signal, along with a small blue advertisement sign for Newton-Wellesley Hospital, laying on the sidewalk on Parker St northbound by Rt 9 westbound. OPMV#1 Stated she was stopped to let a pedestrian go that was in the crosswalk. MV#2 Was stopped at the intersection of Walnut & Lakewood behind MV#1 when he was struck from behind by MV#3. MV#2 then collided into MV#1. OPMV#2 Stated he was stopped behind a vehicle waiting for a person to cross the street when he was struck from behind causing him to hit the car in front of him. MV#3 Was traveling Northbound on Walnut St when he collided with MV#2 that was stopped in traffic. OPMV#3 Stated he was traveling on Walnut St when he didn't notice a vehicle in front of him was stopped in traffic. OPMV#3 Stated he tried to stop but couldn't in time before he collided with the vehicle in front of him. MV#2 & MV#3 Was towed by Tody's Towing. All parties signed patient refusals.

On Wednesday, 6/29/2022, at approximately 1630 hours, I, Ofc Murphy was dispatched to the intersection of Craft St and Washington St for a MVA involving a pedestrian. Upon arrival, I spoke with a witness, Ms. Tunde Kovacs. Tunde stated she observed MV 1 taking a right turn from Craft St onto Washington St. Tunde stated she also observed an unknown pedestrian attempt to cross the cross walk on Washington St at this intersection without the cross walk light. When MV 1 took the turn he struck the unknown pedestrian. Tunde further stated the pedestrian got into MV 1 with the Operator. Tunde provided the plate of the vehicle, MA reg 387RK5. Tunde also stated the pedestrian was wearing tan pants with a gray short sleeve t shirt. I was able to make contact with the driver of MV 1 via telephone. I spoke with Mr. Santos Hernandez. Santos stated he took the right hand turn from Craft St onto Washington St and did not know anyone was in the cross walk because the cross walk light was not on. Santos struck the unknown pedestrian while making this turn. Santos further stated the pedestrian was ok and just wanted a ride home. Santos stated he brought him home to his address in Belmont. Santos was able to provide a phone number for the unknown pedestrian. There was no damage to MV 1. I spoke with the pedestrian, Mr. Ashley Jeremy. Jeremy stated he was attempting to cross Washington St at the intersection of Washington and Craft St in the cross walk southbound when he was struck by MV 1. Jeremy stated he didn't believe he was badly hurt on scene and just wanted a ride home from MV 1. Jeremy further stated he is unsure if he used the cross walk light but he thinks he "probably didn't." Jeremy stated he has a small cut on his back and his right leg is a little sore. Jeremy further stated he might go to the doctor on his own accord to get evaluated.
