On Wednesday, February 13, 2019 while assigned to Traffic unit N525, I responded to the 280 Newtonville Avenue, Newton for a report of a past hit and run accident. I met with Madeleine Aubourg (S67566148) who stated she is a Nursing Assistant at Cabot Park Village. Aubourg stated due to the snowfall the area had the previous day, Aubourg left her vehicle parked (S) in the rear parking lot overnight. Aubourg stated this morning when she returned to work she observed damage to the front bumper area of her 2018 Toyota Camry (MA: 6AN179). Aubourg stated she believes sometime overnight when the parking lot was being plowed a plow truck hit the front of her vehicle. I observed moderate damage to the front bumper area. I spoke with Adolfo Merida-Diaz (S44133458) on scene who stated he is employed by Marquense Landscaping and is responsible for the snow removal at 280 Newtonville Avenue. Merida-Diaz stated last evening and this morning he removed snow from the parking lot and did not make contact with any vehicles in the parking lot during his duties. I showed Merida-Diaz where the alleged accident occurred. Merida-Diaz stated he does not remember a car being parked in that particular spot, but if there was a car parked there he leaves enough room so he is not near any vehicles. I did not observe any surveillance cameras in this portion of the parking lot. There are no witnesses to the alleged accident. Aubourg was advised to speak with her insurance company.

Narrative:
On 3/1/19 while working N493, myself and N492 Officer Selig were sent to the area of 1354 Washington St for a motor vehicle accident with reported injuries. On arrival, I spoke to Matthew Digregorio DOB7/2/74 ( hereby referred to as operator #1) who was standing on the sidewalk next to MA reg 134TR9 (vehicle #1 ). Vehicle #1 had significant damage to the front and right quarter panels. It was straddled between the travel lanes and did not have the keys in the ignition. It was immediately apparent that operator #1 suffered an injury to his head, as there was a moderate amount of blood and small pieces of glass stuck in his forehead area. I observed operator #1 to be unsteady on his feet, have bloodshot eyes and slurred speech. I could detect a moderate odor of alchoholic beverage coming from operator #1 as I was approaching him, which was apparent from about an arms length away (it should be noted that medics were already en route to the scene at this time). Prior to the medics arrival, I asked operator #1 for a brief synopsis of what transpired. Operator #1 stated that he had just left Paddy's Pub and was driving westbound on Hunter St (which is approximately 1/8 mile from our location) when he collided head on with vehicle #2. Vehicle #2 was not immediately visible upon police arrival, however was pointed out as being located at the intersection of Hunter and Putnam St. I asked operator #1 where he was heading, as Hunter St is a back road not directly in the vicinity of Paddy's. Operator #1 could not answer the question and also remained silent when I asked him how much alcohol he had consumed this evening. At this time the medics arrived on scene. I asked operator #1 for the car keys to reliquish to the tow truck operator, which is standard operating practice. Operator #1 reached into his pocket and then provided me with the keys. Due to concern over operator #1's obvious head trauma, he was then transported to NWH to be evaluated while the investigation continued on scene. Two other parties approached myself and Officer Selig. One was the operator of vehicle #2, MA reg 1RD999. Operator #2 is identified as Luke Ferdinands DOB 5/11/80. The other party who approached is identified as Douglas Dasilva-Pimenta DOB 6/2/86 (Dasilva-Pimenta will now be referred to as operator #3). Operator #2 states that he was taking a right onto Hunter St from Putnam St, when he observed vehicle #1 on the wrong side of the road approaching him head on. Operator #2 states vehicle #1 then collided head on with him, took a right onto Putnam St, and continued onto the Washington St overpass near 1354 Washington St. Operator #3 states he was inside of #5 Hunter St when he heard a loud crash coming from outside. He looked out the window and saw vehicle #1 traveling at a high rate of speed on Hunter St towards Putnam St. Operator #3 observed damage to the right side of his parked vehicle (now referred to as vehicle #3) MA reg 7CAK80. He immediately got in his vehicle and proceeded to follow vehicle #1, which then crashed into vehicle #2 head on. Operator #1 did not stop until it was obvious that operator #3 was following close behind. This ultimately landed vehicle #1 at it's final location near 1354 Washington St. Vehicle #1 and vehicle #2 were not driveable and were towed to Tody's. It should be noted that there was a passenger in vehicle #2 at the time of the collision. Airbags were deployed and medics checked out both operator and passenger. Both declined transport. The passenger is identified as Elizabeth Ferdinands DOB 5/22/53.Ferdinands' version of events coincide with that of operator #2. Upon speaking with Officer Selig it was learned that operator #1 dropped his cell phone several times as he was holding it on scene. Both Officer Selig and operators #2 and #3 observed this. Operators #2 and #3 both expressed concern over the obvious odor of alcohol eminating from operator #1, and the fact that he was unsteady on his feet. I responded to NWH to follow up with operator #1 however he did not wish to speak further. He did express concern over the well being of all parties involved. Operator #1 was issued in hand the following citations: T1268426 - 90/24 OUI Alcohol, 90/24 Leaving the Scene (property damage, vehicle #2), and 90/24 Leaving the Scene (property damage, vehicle #3). T1268425 - 89/4a Marked Lanes violation. T1269216 - 90/24 Negligent Operation of a M/V (mailed after consultation with superiors) All streets mentioned are public ways in the City of Newton. 1354 Washington St will be the address used on this report and subsequent citations due to multiple locations being involved. Citations and paperwork have been placed in the prosecutor's mailbox. An immediate threat form has been filled out and faxed to Mass DOT. *Attention Police Prosecutor for blood work subpoena, if applicable*

On Monday, July 1, 2019 while assigned to Traffic unit N525, I responded to the area of 802 Walnut Street, Newton for a report of a motor vehicle accident. The weather at the time of the accident was clear and sunny. The road surface was dry. Walnut Street is a public way maintained by the City of Newton. The operator of MV1, Dayana Martinez (S96710554), stated she was operating her 2019 Toyota Rav 4 (MA: 934RJ9), Northbound in the area of 802 Walnut Street, Newton. Martinez stated as she was coming around the bend the sensor system for her vehicle activated and she attempted to pull her vehicle away from the double yellow line. Martinez stated the vehicle locked up and she made contact with MV2. Martinez reported no injuries on scene. I observed moderate damage to the front driver side area of MV1. The operator of MV2, Gerard Kenneally (S75917793), stated he operating his 1999 Ford E150 (MA: 3AL821), Southbound in the area of 802 Walnut Street, Newton. Kenneally stated MV2 was traveling Northbound on Walnut Street and crossed over the double yellow line and side swiped the driver side of his vehicle. Kenneally reported no injuries on scene. I observed moderate damage to the driver side of MV2 from the driver door to the rear bumper area. I spoke with a witness to the accident, Bryan Stewart, via telephone. Stewart stated he was traveling Southbound on Walnut Street behind MV2 at the time of the accident. Stewart stated he observed MV1 drive over the double yellow line and into their travel lane. Stewart stated 3/4 of the vehicle was in the Southbound lane while it was traveling Northbound. Stewart stated MV1 crashed into MV2. Stewart stated if MV2 was not in front of him then MV1 would have crashed into him. After speaking with all parties involved, Martinez was mailed Massachusetts Uniform Citation T1272998 for Chapter 89, Section 4A (Marked Lanes).

The operator of MV#1 stated she was travelling southbound on Centre St in the left side travel lane and attempted to switch lanes into the right side travel lane. The operator of MV#1 stated MV#2 was in her blind spot and made MV#2 swerved into MV#3. MV#1 never made contact with MV#2. There were no reported injuries to the operator of MV#1 or its passenger. There were no damages to MV#1. The operator of MV#2 stated he was travelling southbound on Centre St in the right side travel lane when MV#1 abruptly entered his travel lane causing him to swerve into MV#3. MV#2 sustained heavy front right side damages. There were no reported injuries to the operator of MV#2. MV#3 was unoccupied and parked in front of 1211 Centre St. MV#3 sustained moderate damages to its left side. The owner of MV#3 was advised of this accident. Based on the statements made to me, I will mail citation #T1268347 to the operator of MV#1 for violations of c89 4A marked lanes violation.

OPERATOR OF MV 1 WAS TRAVELING WEST ON CRAFTS STREET WHEN HE STATED HE LOST CONTROL OF HIS VEHICLE WHICH STRUCK MV2 IN THE REAR CAUSING SIGNIFICANT DAMAGE TO THE VEHICLE. DUE TO THE IMPACT, MV 2 WAS PUSHED INTO MV 3 CAUSING MODERATE DAMAGE TO THE REAR OF MV 3. BOTH MV'S 2 AND 3 WERE LEGALLY PARKED AND UNOCCUPIED AT THE TIME OF THE ACCIDENT. WE WERE ABLE TO NOTIFY BOTH OWNERS OF THE PARKED VEHICLES WHO WERE INSIDE F.A. DAY ATTENDING THE CHINESE LANGUAGE SCHOOL. MV1 AND MV 2 WERE TOWED FROM THE SCENE BY TODYS. OPERATOR OF MV 1 WAS ISSUED IN HAND MA UNIFORM CITATION T2079841 FOR 89/4A MARKED LANES.

On 3/16/20 I was dispatched to 127 Commonwealth Ave for a report of a MV(#1) crash into a fire hydrant. The operator left the scene and was shortly after identified as Mr Bai Lin Wu. Wu called NPD to report the crash once he arrived home. Ofc Ferguson took photos of the knocked over hydrant. City Water Dept was notified of the damage. I responded to Wu's residence. Wu stated he was travelling on the Commonwealth Ave W/B carriage road. Wu stated an unknown MV travelling behind him was trying to pass him on the left. Wu stated he turned to the right to allow the unknown MV to pass. Wu ran off the road to the right and struck the hydrant in front of #127 Comm Ave. Wu further stated he left because he was trying to get medication home as soon as possible to his ill wife. Wu's vehicle sustained moderate damage to the passenger side front end. Wu issued citation for CO Ch19/Sec75 failure to use care turning (went off road).

The owner of MV#1 had parked his vehicle at 10:03 in front of 1269 Centre St and returned to his vehicle at 12:00 to discover that it had been struck. Attached to the windshield of MV#1 was a handwritten note from a party that witnessed the accident. MV #1 sustained moderate damages to its front driver's side bumper. I spoke to the witness via telephone and he stated he was travelling southbound on Centre St directly behind MV#2 when he observed MV#2 sideswiped MV#1. The witness then observed the operator of MV#2 got out of his vehicle, looked at the damages to MV#1, retrieved a can of paint from a party standing on the sidewalk, got back into MV#2 and drove away. The witness stated MV#2 was a black colored "Dodge Ram" pick up truck bearing MA REG 2HLR81. The damages to MV#2 should be to its rear passenger side bumper. The witness described the operator of MV#2 as a white male in his 50's, 6' in height with a muscular build. A query of MV#2 showed that it is registered to a female party out of Weymouth MA. I attempted to contact the owner of MV#2 at phone #781 974-0307 and left a voicemail. I spoke to the Weymouth Police Dept and they will attempt to make contact with the owner of MV#2. I was able to speak to the owner of MV#2 and she stated her ex-boyfriend Richard Woodard has possession of MV#2 but does not speak to him often. She does not know Richard's personal information and provided me with his contact number of 617 631-0596. I spoke to Richard and he stated he was contacted by the owner of MV#2 and was already enroute to Police Headquarters. Richard arrived shortly after and he confirmed that he is the operator of MV#2 and was on Centre St retrieving paint earlier. Richard stated he was not aware he struck any other vehicles. I inspected MV#2 and did not observed any damages to its entire right side. I observed some minor scraping marks on the rear passenger side tire of MV#2. The rear passenger tire of MV#2 would be the most likely part of the vehicle that made contact with MV#1 and also consistent with the witness's statements. Based on the statements made to me by Richard and the fact that there were no visible damages to MV#2 besides its rear tire, it is possible that Richard was not aware he made contact with MV#1. All parties involved were provided with this accident report and advised to contact their insurance providers. There were no reported injuries to all parties involved. I will not pursue this matter further.

On Wednesday, August 4, 2021, while assigned to marked unit N493, I responded to the area 2115 Commonwealth Avenue, Newton with several other units for a report of a motor vehicle crash with entrapment. Commonwealth Avenue is a public way maintained by the City of Newton. The weather at the time of the crash was clear and sunny, The road surface was dry. On arrival, I spoke with the operator of MV1, Mr. Robert Bemis (S57110680). Mr. Bemis stated he was operating his 2019 Nissan Murano (MA: 1WHT71) on Commonwealth Avenue (W) towards Melrose Street. Mr. Bemis stated a red SUV traveling on Commonwealth Avenue (E) entered his travel lane and he had to swerve to avoid crashing head on. The front driver side of MV2 crashed into the driver side of MV1. I observed moderate damage to the entire length of MV1's driver side. Mr. Bemis reported no injuries and signed a patient refusal with Fallon Medics. Mr. Bemis was able to operate his vehicle away from the area. I spoke with the operator of MV2, Mr. Robert Shea (S86188377). Mr. Shea stated he was operating his 2011 Chrysler Town and Country (MA: 2LYT84) on Commonwealth Avenue (E) towards Lexington Street. Mr. Shea stated he was attempting to make left turn towards Lexington Street when MV1 hit him. Mr. Shea was transported to Newton Wellesely Hospital for evaluation. I observed signifcant damage to the front driver side of MV2. MV2 was removed from the roadway by Tody's Towing. The point of impact of the crash occured in the Westbound lane of Commonwealth Avenue. While traveling Eastbound on Commonwealth Avenue, MV2 crossed the double yellow unprotected median on the roadway and entered the Westbound travel lane. MV2 applied his brakes leaving skid marks to the point of impact and crashed into the driver side of MV1. The operator of MV2 will be cited with Massachusetts Uniform Citation 090421AB for Chapter 89, Section 4a (Marked Lanes Violation).

Vehicle 1 was travelling northbound, behind vehicle 2 on Centre St. Vehicle 2 went around vehicle 1, in order to get into the left hand lane, which started up ahead. Vehicle 2 changed into the left hand lane with no blinker, while vehicle 1 was already in it. I observed moderate damage to the front drivers side of vehicle 2, and minor damage to the passenger side of vehicle 1. Newton medics evaluated all parties, and cleared with refusals. Todys towed vehicle 1 because of the fact that it was unregistered. A Massachusetts uniform citation (T2080110), was issued in hand to the operator of vehicle 1. See incident report #21039072, for criminal charges. Witness 1 was travelling behind vehicle 2, and has the accident on video. He was advised to email this to me, which I will have attached to the accident report.

On Monday, May 9, 2022, while assigned to Traffic unit N525, I responded to the area of 25 Berkshire Road, Newton, for a report of an MVA involving a City of Newton owned street sweeper and a City of Newton contracted school bus. The weather at the time of the crash was clear and sunny. The road surface was dry. Berkshire Road is a public way maintained by the City of Newton. The operator of MV1, Mr. Norman Fryar (S20854611), stated he was operating a City of Newton owned 2017 Elgn Pelican street sweeper (MA: MVN M96170) on Berkshire Road. Mr. Fryar stated as he was sweeping the street he was in the Eastbound lane traveling North. Mr. Fryar stated there was a vehicle parked ahead of him and to avoid it he began to change lanes to his left to go around it. Mr. Fryar stated as he was chaning lanes his phone was ringing and as he reached for the phone the driver side of his sweeper crashed into the front passenger side of a passing school bus. Mr. Fryar reported no injuries. I observed damage to the driver side of the sweeper. I spoke with the operator of MV2, Ms. Ana Mendes (S72311538). Ms. Mendes stated she was operating a City of Newton contracted school bus (MA: BU44536) on Berkshire Road with 25 students on board with a final destination of Bigelow Middle School. Ms. Mendes stated she was traveling North on Berkshire Road when she observed a street sweeper in front of her. Ms. Mendes stated she entered the Westbound land of Berkshire Road to go around the street sweeper. Ms. Mendes stated as she was passing the street sweeper, it made an abrupt left turn and it's driver side crashed into the front passenger side door/mirror of the school bus. Ms. Mendes reported no injuries. I observed moderate damage to the passegner side of MV2. After the initial crash, it was reported by both parties that MV1 attempted to back up to allow students to exit the bus through the passenger side door. As MV1 was backing up, it crashed into the middle passenger side of the school bus. There were 25 Bigelow Middle School students on the bus at the time of the crash. Ms. Mendes state she contacted her dispatch for further instructions on what to do with the students. Ms. Mendes stated to Sgt. Wade that the Eastern Bus Company dispatch instructed her to keep the students on the bus and wait for Police and EMS to arrive. Ms. Mendes stated after speaking with her dispatch, another school bus arrived at the scene. The decision was made by Ms. Mendes to have the students exit her school bus and be transported to Bigelow Middle School prior to my arrival. Ms. Mendes was advised in the future to follow the policy set forth by her Eastern Bus Company, the City of Newton, and the Newton Police Department. After clearing Berkshire Road, myself and Sgt. M. Wade responded to the Bigelow Middle School to check on the welfare of the students that were on the bus at the time of the crash. We were greeted by the school's Asssitant Principle Mr. Lucas Mogensen. Mr. Mogensen stated all of the students that were on the bus at the time of the crash were staged on the bus when it arrived at the school. Mr. Mogensen stated the school nurse Ms. Shannon Loughnane evaluated each student as they exited the bus and there were no injuries reported at this time.

On Friday, June 24, 2022, while assigned to unit N492, I responded to the area of Lowell Avenue and Otis Street for a report of a MVA involving a Feeney construction vehicle. The weather at the time of the crash was clear and sunny. The road surface was dry. Lowell Avenue and Otis Street are both public ways maintained by the City of Newton. The operator of MV1, Mr. Richard Holmes (S34147311), stated he was operating a 2021 CAT 420 Backhoe (MA CON: W35648) is the area of 297 Lowell Avenue (S). Mr. Holmes stated he was transporting a portable restroom in the front bucket to another location on their job site. Mr. Holmes stated a vehicle was traveling towards him on Lowell Avenue (N) and he moved over to the right side of the road to create more room on the roadway for both vehicles. Mr. Holmes stated at this time the front passenger side of the backhoe's bucket area crashed into the rear of an unoccupied vehicle parked in front of 297 Lowell Avenue (S). I observed minor damage to the bucket area of the backhoe. No injuries were reported by Mr. Holmes. The owner of MV2, Mr. Michael Fedas (S87986062), was advised that his 2019 Kia Forte (MA: 3ZDV69) was involved in the crash. I observed moderate damage to the rear driver side area of MV2. Mr. Fedas was working in the area in his official capacity as a letter carrier for the United States Postal Service.
