The operator of vehicle 1 stated that with a green left turn arrow showing, and her left directional on she went to turn onto Waltham Street from Crafts Street when all of the sudden she hit a bicyclist. She stated she did not see the bicyclist at all prior to him hitting her car. The bicyclist stated does not remember anything from the accident at this time. The bicyclist was traveling southbound on Crafts Street and appears to have entered the intersection of Crafts and Waltham Street without stopping and while a red light was showing. He was wearing a helmet at the time of the crash, he was not wearing any reflective clothing(dark green jacket), and the bike did not have any lights. The bike was taken to support services for safe keeping by Ofc. J.March. Vehicle#1 was towed away by Tody's towing due to extensive damage. Bicyclist was transported to Beth Israel hospital for several trauma injuries. Pictures of scene was taken by me and sent to IT Bureau. Both witness's statements were the same. They stated that they were behind vehicle 1 in traffic and saw that she had on her left dirrectional signal and had a green left arrow signal when vehicle 1 went to turn left onto Waltham Street.

Narrative:
Bike One was travelling Eastbound on Auburndale Ave when it appeared the operators front tire came in contact with a slightly raised manhole cover causing the operator to fall off his bike and impact the roadway. The cyclist was wearing a safety helmet but received a laceration around his eye and several lacerations to his arms and legs. He was transported to Beth Israel Boston. I spoke to the bicyclist who was unsure of how the crash occurred. I contacted his brother, Paul Colangelo (603 434-1251) who was advised of the incident. Photos were taken of the crash scene and emailed to the IT Bureau. I placed his bike into support services for safekeeping.

Bicyclist, Tasker Howell, was traveling SOUTH on Watertown St, entering the lane of traffic when MV1 collided with her handlebars and front tire. MV1 (MA Reg: 8SP529, 2018 Ford SUV) was traveling WEST on Watertown St when she collided with the Tasker on the bicycle. MV1 operator, Maria Forgione, stated that while she was traveling on Watertown St, she had a passed a large landscaping truck parked at 857 Watertown St which hindered her seeing Tasker pulling out into traffic on the bicycle. Tasker stated the same, that she saw traffic clear and believed it would be safe to pull out into traffic but the landscaping truck created a blindspot. Tasker was not wearing a helmet. There was damage to MV1 on the passenger front end. Tasker was transported to Newton Wellesley Hospital. Tasker's bicycle was left in her possession at her residence at 871 Watertown St. Pictures were sumbitted to IT.

On Tuesday, July 23, 2019, while assigned to Traffic unit N525, I responded to the intersection of Beacon Street and Washington Street, Newton for a motor vehicle accident involving a bicyclist. The weather at the time of the accident was overcast. The road surface was dry. Beacon Street and Washington Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Paige Mahoney (S85200426). Mahoney stated she was stopped in traffic at a red light on Beacon Street (W) at Washington Street in her 2018 black Volkswagon Tiguan (MA: 633MV6). Mahoney stated while her vehicle was at a complete stop, she felt and heard something hit the rear of her vehicle. Mahoney exited her vehicle and saw a bicyclist on the roadway. I observed minor damage to the rear middle bumper area of MV1. There was a small amount of blood present on the damaged area. I observed the roadway where the accident occurred. There was a small pool of blood in the left lane of Beacon Street (W) where the bicyclist fell to the roadway. The area of the roadway where the accident occurred is currently undergoing restoration and the asphalt has been graded down to it's sub base in preparation to be resurfaced. The current road surface condition is bumpy and uneven. The area where the roadway goes from a smooth surface to a bumpy surface is where the accident occurred. The injured bicyclist was identified as Timothy Johnson (S29270605). I spoke with him in the Newton Wellesley Hospital emergency room. Johnson stated he was operating his bicycle Westbound on Beacon Street on the right side of the left lane. Johnson stated he was coming to a stop in traffic at a red light when his wheel abruptly turned to the left and he began to fall over. Johnson stated his head hit the back of a vehicle stopped in front of him and he landed on his right side, with his bicycle landing on top of him. As a result of the accident, Johnson suffered an injury to the right side of his head and had scrapes on his right arm. Johnson stated he did not lose consciousness as a result of the accident and he appeared to be alert and orientated while I was speaking with him. Johnson was wearing a helmet at the time of the accident. There were fresh markings on the right side of the helmet with minor black paint transfer. These markings are consistent with Johnson's statement that he fell into the back of MV1 and hit his head. Johnson's bicycle was removed from the roadway prior to my arrival and was being stored in the driveway of 2044 Beacon Street by the resident there. I observed no obvious damage to Johnson's bicycle. After speaking with all parties involved and examining the roadway where the accident occurred, it appears that the condition of the road surface contributed to Johnson losing control of his bicycle and crashing into the rear bumper area of MV1 while it was stopped in traffic. Photos were taken of the road surface, John's bicycle, and MV2 and submitted to the IT Bureau.

Opr of V1 stated she was in the right turn lane on California Street waiting to turn right onto Bridge Street. Opr stated the green arrow signal came on and she started to turn. At this time, B1 cut in front of her to beat the light and made contact with the vehicle. V1 sustained light damage to the front right. V1 was not towed. Opr of B1 stated he was on California Street waiting to turn left onto Bridge Street. At this time, he stated he saw no cars moving, rode across the street, and tried to beat the light. B1 made contact with V1. Opr of B1 suffered minor injuries and was transported to NWH. Bike was put in the property room for safekeeping. I was unable to secure bike, but helmet, bike pump, and mirror were placed in locker number 8.

On 12/19/2019 at 14:43 hours Newton Police dispatch received numerous phone calls about a white male whose face was covered in blood and was riding on an electric motorized scooter south bound on Walnut St near number 100. Walnut St is a public way in the city of Newton. Approximately two tenths of a mile south 100 Walnut St, Ofc Garcia stopped the male on the scooter. Ofc Garcia stated that the male on the scooter was evasive when answering his questions and claimed that he did not realize that his face was covered in blood. The male on the scooter was identified as Gregory David Brown. Brown was transported to Newton Wellesley Hospital for treatment. Prior to Brown being transported I was dispatched to the area of 100 Walnut St for a report of a male on an scooter who had crashed into a south bound vehicle in traffic on Walnut St and another vehicle that was parked in front of number 73. Upon my arrival I spoke with Penni Rochwerger and Nikita Espinal. Rochwerger stated that she was driving south bound on Walnut St across from 100 when she activated her vehicle's four way flasher and stopped her vehicle to let Espinal who was the front seat passenger out. Rochwerger stated that south bound traffic stopped behind her vehicle after she came to a stop adjacent to Espinal vehicle that was parked facing south in front of 73 Walnut St. Espinal stated that she checked over her right should to see if it was clear to open her door and it was . Espinal stated that as she opened her door to exit a male on scooter crashed into the door and fell to the ground. Both Rochwerger and Espinal stated that the male on the scooter did not provide his name or address and continued south bound on Walnut St with his face coved in blood. Rochwerger's vehicle sustained damage to the front passenger side door that would not closed all the way. Espinal vehicle also had damage to it, the rear driver's side lower quarter panel was struck. I responded to Newton Wellesley Hospital to speak with Brown. When I arrived and spoke with Brown he was evasive with his answers . When I asked Brown what had happened he gave conflicting answers and contradicted himself. Brown stated that he was riding his scooter on the roadway south bound on Walnut St be could not recall any other details. When I asked Brown if he was wearing a helmet as required by MGL 90/1E he stated he couldn't recall. Rochwerger, Espinal and Ofc Garcia all stated to me that they did not see Brown wearing a hamlet. There was an unconfirmed post by a person named Tricia Marucci to the Facebook group Newton Parents stating that at 14:45 hours on 12/19/2019 saw Brown hitting a defect in the roadway in the area of Crafts St by California St that caused him to loses control of his scooter and fall face first onto the pavement. In her post Marucci stated that Brown was cover in blood from facial lacerations, and that he refused medical aid and continued to ride his scooter south bound towards the entrance to Walnut St. I left a message for Marucci to contact me and as of the writing of this report she has yet to do so. While at the hospital I ran Brown's name and date of birth via the MA RMV data base in order to issue him a citation for not wearing a helmet. The query of Brown via the MA RMV data base reviled that Brown's MA driver's license statutes was suspended. On 07/11/2018 admitted to a finding of sufficient facts to one count of MGL 90/24 OUI liquor. Brown received a Continued With Out Finding for 18 months. In addition Brown pleaded guilty to an additional count of MGL 90/24V Child Endangerment While OUI. Brown received a 90 day sentence in the Middlesex House of Correction which was suspended for 18 months. Brown also received a one year loss of his driver's license. Brown is on active probation out of Newton District Court until 07/21/2020. Biased upon the statements made to me I issued Brown MA Criminal Application T 2012526 for violations of MGL 90/24(2) Leaving The Scene Of An Accident Property Damage , MGL 90/1E Operation Of A Motorized Scooter Without A Valid License and MGL 90/1E Operation Of A Motorized Scooter With Out A Helmet. As of 12/20/2019 Brown was discharged from Newton Wellesley Hospital.

On Wednesday 6/17/2020 at approx 2116hrs, while assigned to N-494, I responded to the intersection of Walnut St and Comm Ave for MVA involving a bicyclist. The bicyclist, Aziz Boltayev, said he was traveling NB on Walnut St and attempted to cross Comm Ave. He stated that he was in the middle of the intersection when Comm Ave' light signal turned green. Contact was made to MV1s driver side front panel. Boltayev was transported to Beth Israel with serious injuries to his legs. Boltayev was not wearing a helmet nor wearing reflective clothing. His bicycle, a blue Schwinn, had no front head lamp attached in violation of MGL c85 s11B. A citation was issued and mailed to Boltayev. He was wearing a light colored shirt and shorts. Operator of MV1 states that he was on Comm Ave heading WB and stopped at a red light at the intersection of Walnut St. He states that he had a green signal when attempting to cross the intersection and did not see the bicyclist prior to the accident. Pictures were taken and submitted to IT. The Schwinn bike was placed in property and evidence for safekeeping.

On Thurs 7/9/20 at approximately 1911 hrs I responded to 111 Dedham St for a report of an accident involving a bicyclist. Upon arrival I observed the MV and the bicycle on the EB travel lane side of Dedham St with the bicycle on the sidewalk/driveway and the MV facing the driveway at 111 Dedham St. I spoke with the operator of MV#1 who stated that he was traveling EB on Dedham St and then turning right into his driveway when he collided with the bicyclist. He stated that he never saw her until the last second as the bike was in his blind spot. When contact was made he immediately got out of his car to see if the bicyclist was okay. The passenger in the vehicle stated that the bicyclist was traveling Eastbound on Dedham St on the sidewalk when MV#1 struck her. The bicyclist was riding a turquoise and black Bianchi Aria racing bike with black leggings and a white and blue tank top. The bicyclist was wearing a helmet which had little to no damage on it. Before being transported to BI by the medics, Ms. Loomis stated she was traveling EB on Dedham St in the shoulder/bike lane when she was struck by MV#1 who was attempting to turn into the driveway. Pictures were taken of the scene and the SIM card was turned over to the IT bureau to be uploaded into this report. The bike was turned over to the bicyclist's friend, Christine Long.

On Tuesday, September 1, 2020, while assigned to marked unit N496, I responded to the area of 780 Beacon Street, Newton for a report of a motor vehicle crash involving a bicyclist. The weather at the time of the crash was clear and sunny. The road surface was dry. Beacon Street is a public way maintained by the City of Newton. I spoke with the operator of the vehicle involved in the crash, Dina Hudson (S33833807). Ms. Hudson stated she was sitting in her 2015 white Jeep Grand Cherokee (MA: 727SZ7) that was parked (E) in a metered parking spot in front of 780 Beacon Street. Ms. Hudson stated traffic in the Eastbound lane of Beacon Street to her left was stopped. There was a red light ahead at the intersection and traffic had built up past where her vehicle was parked. Ms. Hudson stated she opened her driver side door while she was looking for her debit card to go to the bank. Ms. Hudson stated at this time a bicyclist was traveling at a high rate of speed around the stopped traffic towards the intersection and crashed into her driver side door. Ms. Hudson stated the operator of the bicycle then traveled further up the roadway and crashed behind a vehicle stopped in traffic. Ms. Hudson stated she was unsure if the bicyclist crashed into the stopped vehicle or if it had landed on the roadway just before it. Ms. Hudson stated the bicyclist then got up from the roadway and began yelling at her that the crash was her fault. I observed a few small fresh scrapes on the outside of the driver side door area. When I initially arrived at the crash location, I observed Officer Lazarakis checking on his well-being of the injured bicyclist, Marc Lind. Lind was observed laying on the sidewalk in front of 780 Beacon Street. After being evaluated by Newton Medics, I spoke with Mr. Lind. Mr. Lind stated he was traveling on his Trek bicycle Eastbound on Beacon Street towards Langley Road. Mr. Lind stated while traveling through the area at this time, traffic in the Eastbound Lane was stopped and there was a red light ahead of him at the intersection. Mr. Lind estimated his speed at this time to be 10-12 miles per hour. Mr. Lind stated as he travelled past the Santander Bank at 780 Beacon Street, the operator of a parked white Jeep to his right abruptly opened their door into traffic. Mr. Lind stated he attempted to avoid the vehicles door and veered to the left. Mr. Lind stated the right end of his handlebar made contact with the door and as he traveled forward and applied his brakes his right side crashed into the rear of a vehicle stopped in traffic ahead of him. Mr. Lind stated he crashed to the roadway on his right side. Mr. Lind was able to move to the side of the roadway and wait for Newton PD, Fire, and Medics to respond. Mr. Lind reported injuries to his right arm, side, and leg area. Mr. Lind signed a patient refusal with Newton Medics and was transported away from the area by his wife with his bicycle. I observed no substantial damage to his Trek bicycle. At the time of the crash, Mr. Lind was wearing a white t-shirt, black shorts, black, shoes, and a gray helmet with sunglasses. I spoke with a witness to the crash, Steve Worthington. Mr. Worthington stated he was stopped in traffic on Beacon Street about 4 vehicles back from the red light. Mr. Worthington stated he looked out of his passenger door mirror and observed a bicyclist "whipping" down Beacon Street in between vehicles parked on the side of the road and vehicles stopped in traffic at the red light. Mr. Worthington estimated the speed of the bicycle to be approximately 20 miles per hour. Mr. Worthington stated the bicyclist had to "lean" by his vehicle to get by. Mr. Worthington stated a vehicle just ahead of him that was parked opened their door and the bicyclist made contact with the door. Mr. Worthington stated the bicyclist then went down in front of the car that was in front of him. Mr. Worthington stated the bicyclist was rolling around on the ground and screaming "It's your fault" at the woman that opened her door Photos were taken of the bicycle and the vehicle involved and submitted to the IT Bureau.

Operator of vehicle one Peter Bradley stated that on 09/18/2020 at 08:39 hours he was driving his 2014 Land rover ( MA reg 1EV437 ) south bound on Cherry St near Adams Ave. Cherry St. is a public way in the City of Newton. Bradley stated that as his vehicle was approaching Adams Ave he saw a vehicle stopped facing east bound that was about to turn into the south lane of Cherry St. Bradley stated he also saw a bicyclist riding south bound on Cherry St. Bradley stated that as the bicyclist passed by the vehicle that was stopped at Adams Ave. it suddenly swerved to the left and into the path of travel of his vehicle. Bradley stated that the passenger side mirror of his vehicle struck the bicyclist causing him to fall off his bike. The bicyclist Tameon Dames, a 10th grader at NNHS ( DOB 02/16/2005 ) stated that he was riding his bike south bound on Cherry St. near Adams Ave. when he saw a vehicle stopped on Adams Ave about to turn south bound on Cherry St. Dames stated that he steered his bike to the left to create space between himself and the stopped vehicle. Dames stated that when his bike moved to the left he came in contact with the Landrover's passenger side mirror causing him to fall from his bike. Dames stated that he did not lose consciousness after the crash and was not wearing a helmet . Dames had cuts to his left hand and was transported to Children's Hospital in Boston via EMS from treatment. The operator of the vehicle that was stopped on Adams Ave was Pin Cao. Cao stated that he saw Dames "swerve" his bike into Bradley's vehicle as passed his. At the time of the crash Dames was wearing ear pods. Bradley's vehicle had minor scuff marks on it's passenger side mirror case. I took photos of Bradley's vehicle and of Dames bike and had the photo disk downloaded by the NPD's IT Bureau. While taking photos of Dames bike I observed that both of it's tires had very little tread left leaving them almost completely bladed. I further observed the bike was missing left pedal. Officers searched the crash area for the bike's pedal with negative results, it appeared that the pedal was missing prior to the crash. I further observed that only the front breaks of Dames bike where in working order. Dames bike was transported to the station and I filled out a property form ( see report 20042471 )

Narrative:
Bicyclist Michael Foley stated that on 05/11/2021 at approximately 22:00 hours he was riding his Blanch mountain bike west bound near 2401 Commonwealth Ave when he was struck from behind by an unknown vehicle. Commonwealth Ave is a public way in the City of Newton. Foley stated that he was thrown from his bike and onto the roadway. It should be noted that the section of Commonwealth Ave were the crash occurred is not lit. At the time of the crash Foley was wearing dark non reflective clothing. Foley was not wearing a helmet or any other safety equipment at the time of the crash. Foley stated that he did not see what type of vehicle struck him from behind and could not offer any other description. Foley was discovered laying in the roadway by a Good Samaritan at 22:08 hours. Upon inspection of Foley's bike I observed that the rear tire and rear fender was bent inward to the left side. I further observed that Foley's bike had no reflective materials affixed to it. Foley stated he did not lose consciousness as a result of the crash. Foley was transported via EMS to the Beth Israel Hospital in Boston for treatment. I respond to the Beth Israel Hospital and Foley again reiterated what he had stated at the crash site, about not having any description of the vehicle that struck him. The staff I spoke with at the hospital stated that Foley had a possible broken shoulder and/or collarbone and abrasions to his hands and legs. Foley's bike and a bag of his possessions were secured at Support Services at the station and Ofc Fay filled out a property form. During a canvass of the crash site no physical evidence from a vehicle was observed. I also observed no skid marks on the roadway. There were no cameras in the area. Due to the lack of physical evidence ,and no witness to this crash I believe that the operator of the vehicle that struck Foley may not of even been aware that a crash occurred. It should be noted that over the past 18 years I have had numerous interactions with Foley, and I know that he is homeless and has resisted any aid from social service agencies. Foley is know to camp in the Town of Weston in woods adjacent to the Massachusetts Turnpike. From pass reports Foley has used Harris Cycles at 1351 Washington St Newton, and the law firm of Jason and Fisher at 47 Winter St Boston as contact locations.

Operator of MV1 states she was traveling eastbound on Canterbury Rd approaching the intersection at Waldorf Rd when a bicyclist appeared out of nowhere traveling from Waldorf Rd northbound, didn't attempt to stop at the intersection and struck MV1 in the front right fender and windshield. Operator of MV1 remained on scene until emergency personnel arrived. The juvenile bicyclist, Daniel Yeo, states he was riding his bicycle with a helmet on northbound on Waldorf Rd approaching the intersection at Canterbury Rd when he saw MV1 enter the intersection and struck MV1 with his bicycle in the front right fender where he went over the bicycles handlebars landing on the roadway. Daniel states he attempted to apply the brakes, but realized it was too late and made contact with MV1. Medics evaluated Daniel for injuries where he complained of head and stomach pain. On Tuesday, September 21, 2021, I received a call from Sgt. Mike Wade of the Newton Police Traffic Bureau. Sgt. Wade stated a serious MVA/Bicycle crash had just occurred at the intersection of Cherry Street and Derby Street in Newton and the bicyclist was a 10-year-old boy with a possible head injury. Sgt. Wade stated the Traffic Bureau was requested to respond by the Shift Commander and asked if I could respond to investigate the crash. On arrival, Officers reported to me that the cyclist involved, Benjamin Lavoie, was transported to Children's Hospital in Boston with a possible head injury. It was reported to them that Benjamin was traveling Southbound on Cherry Street towards Derby Street on his bicycle. Benjamin entered the intersection of Derby Street and crashed into the front passenger side area of a passing motorist that had a green light. Officers on the scene also reported that the motor vehicle and the bicycle involved had been moved from their original rest location. Cherry Street is a public roadway maintained by the City of Newton. It supports two way travel (N and S) from Washington Street (S) to Waltham Street (N). The travel lanes are divided by an unprotected double yellow line median. The posted speed limit for this street is 25 miles per hour. Derby Street is a public roadway maintained by the City of Newton. It supports two way travel (E and W) from Waltham Street (E) to Lexington Street (W). The travel lanes are divided by an unprotected double yellow line median. The posted speed limit for this street is 25 miles per hour. The weather at the time of the crash was clear and sunny. The road surface in the immediate area of the crash was dry. I spoke with the operator of MV1, Ms. Erica Pusateri (S61409866). Ms. Pusateri stated he was operating her 2021 Kia Seltos (MA: 8HC743) Westbound on Derby Street towards Cherry Street. Ms. Pusateri stated that she had a green light at the intersection and proceeded to cross Cherry Street to continue onto Derby Street. Ms. Pusateri stated halfway through the intersection she heard a noise and saw a bicyclist hit the front passenger side door area of her vehicle. The collision caused the glass window from the front driver-side door to shatter. Ms. Pusateri's vehicle controlled her vehicle to a stop and she observed a young boy lying on the roadway in the intersection behind her. Ms. Pusateri exited her vehicle, ran over to the injured bicyclist, and rendered aid to him by stabilizing his neck. Ms. Pusateri remained on scene and cooperated fully with Officers. I asked Ms. Pusateri if she was distracted at all while operating her vehicle prior to the collison. Ms. Pusateri stated she was not. I asked Ms. Pusateri if she could recall where in the intersection the bicyclist crashed into her vehicle. Ms. Pusateri stated the bicyclist crashed into her vehicle in the Northwest side of Derby Street just outside of the marked crosswalk in the intersection. Ms. Pusateri stated she knows it was in the street in the intersection because she observed a woman with a stroller on the sidewalk on the corner of Cherry Street at Derby Street on the Franklin Elementary School side and she had already travelled through the intersection passed the East side of Cherry Street. Due to the unknown injury status of the bicyclist, Ms. Pusateri's vehicle was towed to the Newton Police Station and secured in the garage area as evidence. Ms. Pusateri reported a small laceration on her right hand with no other injuries. I observed damage to the front passenger side fender/door area. There was no airbag deployment as a result of the crash. I observed glass through out the front passenger side compartment area of the vehicle from the window breaking. I contacted Benjamin' s parents, Cheryl and John, to check on the status of their son. Cheryl stated Benjamin did not suffer any life-threatening injuries and appears to have bumps, bruises, and a cut on his head. I asked if I could speak with Benjamin for his account of what happened at the crash. Benjamin stated he was riding his bicycle on Cherry Street (Southbound) on the sidewalk on the East side of Cherry Street. Benjamin stated he left the sidewalk and entered the intersection to cross Derby Street and continue on Cherry Street. Benjamin acknowledged that at this time Cherry Street had a red light and Derby Street had a green light. Benjamin stated he then crashed into a passing car in the roadway. Benjamin was wearing a helmet at the time of the crash. The helmet had significant damage to it as a result of the collision. I told Benjamin his bicycle was being held at the Newton Police Department for safekeeping and we will arrange to get it back to him. Benjamin is a student at the Franklin Elementary School. I make contact with a witness to the crash, Mr. Benjamin Crosby. Mr. Crosby stated he did not witness the actual crash, just the aftermath. I was able to reviewthe 9-1-1 call Mr. Crosby made regarding the crash in Newton Disptach. Mr. Crosby stated a boy on a bicycle was in a crash with a motor vehicle. Mr. Crosby is heard saying "he went through the light" to the Dispatcher taking the call. After completing my investigation, I have summized the following. The bicyclist (Benjamin Lavoie) traveled down Cherry Street (S) and went through a red light to cross the intersection at Derby Street (W). As a result of traveling through the red light and entering the intersection, he crashed into the front passenger side door area of a passing motorist that had a green light (Erica Pusateri). No citation will be issued as a result of this crash.

On 10/13/21 at 08:50 hours, I responded to Washington Street & Brookside Avenue for a motor vehicle accident involving a bicyclist. The weather at the time was clear and sunny (70 degrees) and the road conditions were dry. The accident location is a t type intersection with Brookside Avenue having a stop sign in order to turn onto Washington Street. Washington Street is a four lane road with a painted divider. There is no crosswalk at the intersection as it appears it was recently paved. On arrival, the accident scene was already clear as the bicyclist and his bicycle were waiting on the sidewalk. The motor vehicle involved was parked further back on Brookside Avenue away from the intersection. I spoke to the operator of the motor vehicle identified as Balarama Thavanati. He was operating a 2012 Toyota Camry color white bearing MA reg. # 44VN32. He states that he was operating southbound on Brookside Avenue and stopped at the stop sign at Washington Street. He was attempting to make a left turn onto Washington Street. He states that he inched out after because you can not see the vehicles approaching you. Next, a vehicle stopped on Washington Street to let him out and he thought it was clear never seeing the bicyclist on the right of him. He says the bicyclist approached him very fast and it appeared that he never stopped the bicycle prior to entering the street from the sidewalk. Once he attempted to pull out for the turn he then made contact with the bicycle on the left side. Thavanati pointed to the approximate location where the bicycle came to rest and it appears he was pushed forward approximately three feet from the impact. I observed black scrape marks on the right side of the front bumper which appear to be from the bicycle tires. At this time, the bicyclist, Jacob Harrison, was being tended to by Fallon Medics and Jacob's mother (Juliet Harrison) was already on scene. Jacob stated he was fine but since he was not wearing a helmet and hit his head on the pavement his mother had him transported to Newton Wellesley Hospital by Fallon Ambulance. After, I spoke to Jacob in the emergency room along with his parents. He sustained whiplash to his neck and a scrape to his right inner thigh area. I then asked him what had occurred during the collision. He states he was bicycling on the sidewalk eastbound on Washington Street. He says he stopped at Brookside Avenue and saw the Toyota Camry which was also stopped. He thought it was clear to proceed as if the vehicle was going to stay stopped. He then pedaled into the street and was struck by the Camry on the left side of his body. He fell down and he does not recall what else occurred as the incident happened so fast. The bicycle sustained damage to the front tire rim as it became bent. No other visible damage. At the time, Jacob was wearing black shorts and a white t-shirt with a red picture on it. He was not wearing a helmet and was going against the traffic on Washington Street. On scene there were three witnesses who were walking southbound on Brookside Avenue near Washington Street at the time of the crash. There names were Christine Butera, Marlene Austen, and Marta Travers. All three of them stated that the operator of the Toyota Camry was stopped on Brookside Avenue waiting to make the left turn. He then pulled out and in a split second the bicycle entered the intersection and was struck. They did not have the vantage point to see if the bicyclist ever stopped first before entering the roadway from the sidewalk. Digital photos were taken of the scene.

On 10/13/2021 at 18:33 hours I responded to 30 Myrtle St for a report of a single vehicle crash involving a motorcycle that had a driver and a passenger. Myrtle St is a public way in the City of Newton. Upon my arrival I spoke with Roberto Ventura who stated that he and his passenger Melissa Mendoza were ridding westbound on Myrtle St on his 2009 Yamaha Raider motorcycle. Ventura and Mendoza were both wearing DOT approved helmets at the time of the crash. Ventura stated that as he approached 30 Myrtle St he drove over a patch of compacted dirt and gravel that was approximately three feet wide and four feet long. The patch was not coved by asphalt and was dug out and filled by the City of Newton Utilities Department. The patch of dirt and gravel was not marked by any cones, barrels or barricades. There were no street lights in the area so the roadway was not lit. There was a similar patch approximately 10 feet east that had four cones around it. Ventura stated that he did not see the dirt patch until he drove over it. Ventura stated that after driving over the dirt patch that he did not see at approximately 20 MPH he lost control of the motorcycle. Both Ventura and Mendoza stated that he were then thrown from the motorcycle and landed on the roadway. Ventura complained about pain in his left shoulder and knee, and had road rash abrasions to his left leg and arm. Mendoza stated that she had road rash abrasions to her left arm and leg. Both Ventura and Mendoza declined medical treatment at the crash scene and singed patient refusal forms provided to them by Fallon medic. Ventura's motorcycle had damage to it's left side tail light, and handlebar, as well as scrapes on the left side. Ventura's motorcycle did not require a tow. I placed reflective cones around the dirt and gravel patch and had dispatch leave a message for Newton Utilities to pave over both patches.

On Monday November 1st 2021, I responded the intersection of Cherry Street and Webster Street with several other units, for a report of a motor vehicle accident involving a bicyclist. At the time of the accident the weather was sunny and the road surface was dry. Both Cherry Street and Webster Street are owned and maintained by the City of Newton. While in route to the scene, units updated dispatch that the party was unconscious and not responding. Upon arrival I observed the bicyclist laying in the middle of the intersection being tended to by the medics. Medics on scene updated that the bicyclist was now conscious but was not alert and not responding to questions. Medics were able to locate a wallet and cell phone in his pocket and I was able to identify the bicyclist by his Mass License as Thanh Nguyen (S84815152). My first observations of the scene was that Mr. Nguyen was wearing a helmet at the time of the accident. I also observed his bicycle to be completely intact and the brakes functioning properly. The bicycle is a red Fifiel folding bicycle with a basket attached to the front. Inside the basket was a plastic bag containing recyclable cans. Also inside the basket was a bike lock and cable charger. Fastened on the handlebars of the bicycle with tape was a King meter reader. While the medics were preparing Mr. Nguyen for transport I spoke with the operator of the motor vehicle involved, identified by a Mass License as Jeffrey Carter (S21903831). Mr. Carter was visibly shaken up and very concerned about the bicyclist. Mr. Carter stated he was travelling eastbound on Webster Street and had the green light to cross over Cherry Street. He stated as he proceeded through, the bicyclist appeared out of nowhere very fast in the wrong lane and struck the front of his Ford F150 truck. Mr. Carter stated he immediately pulled over and tried to assist the bicyclist but he was not responsive. Mr. Carter stated he moved the bicycle to the side of the road to get it out of the way and waited for help to arrive. Mr. Carter stated his vehicle struck the bicyclist on his right side which caused him to fall to the ground and slide several feet. Mr. Carter stated the bicyclist did not come up onto the roof of his vehicle. He reported minor damage to the front grill and bumper of his truck. Mr. Carter stated he was not injured and signed a patient refusal on scene. His Ford F150 had minor front damage and was able to leave the scene. Sgt. Wade was on scene and speaking with a witness who was in the area walking her dog at the time of the accident. Kara Brewton stated she was walking on the sidewalk of Cherry Street, approaching Webster Street when she heard a loud pop sound. As she looked towards the sound she saw the bicycle and truck make contact and she remembers the red light was facing her on Cherry Street. Kara stated the truck had the green light and the bicycle had the red light at the time she heard and saw the crash. She stated she ran over to assist and dialed 911. She stated she observed the bicyclist with a helmet on at the time of the accident and he was not responsive. Several photos of the scene were taken and submitted to the IT Bureau. The bicycle was taken over to support services were it was logged into evidence for safe keeping. Property and evidence form was completed and submitted by Officer Gaudet. I responded to 223 River Street the residential address listed for Mr. Nguyen to notify his family of the accident but got no response. I was able to locate a phone number for his place of work who was able to provide me with his emergency contact information. I was able to leave several messages with his wife, daughter and sister. His daughter identified as Quynh-Chi Nguyen returned my phone call and was notified of the accident and that her father was transported to the Beth Israel Hospital in Boston. I provided her with my direct line and advised her to contact me with any questions. Later in the day, she contacted me back to state that her father was in stable condition and was going through a number of tests by hospital staff. I will be following up with Mr. Nguyen tomorrow after all his tests are completed. On Tuesday November 2nd, 2021 I was able to make contact with Mr. Nguyen's wife, Cindy Chau. Cindy stated her husband was ok and she was on her way to pick him up from the hospital. She stated she will have him contact me when he arrives home. I asked about his injuries and she stated he did not have any broken bones but wasn't sure and will contact me when they get home. Later that afternoon I attempted to make contact with Mr. Nguyen and was only able to leave a message. I am still waiting to hear back. On Friday 11/05/2021 I returned a phone call to Mr. Nguyen's daughter, Quynch-Chi who left me a voicemail. She stated Mr. Nguyen was home and all his test results came back negative. She stated she provided him with my contact number and he will contact me when he is feeling up to it. She also stated she believes Mr. Nguyen suffered some kind of head injury as he has wound on his head and does not remember anything about the accident. Quynch-Chi asked that I refrain from contacting her mother as she does not feel comfortable speaking to me since she does not speak English well. She asked that all communication go through her. She also asked for a copy of the report and I advised Quynch-Chi that I am still waiting to hear from her father so I can complete the report. I received a call from Mr. Nguyen a few minutes later. He was able to state that he doesn't remember anything from the accident except that he thinks when he went through the intersection the light changed from green to red. Mr. Nguyen also stated that the only other thing he remembers is waking up in the hospital. When asked about his injuries Mr. Nguyen stated he has a hard time breathing and his head, neck and legs are sore. I advised Mr. Nguyen that I will be adding his statements to the report and to have his daughter contact me if he needs anything further. Mr. Nguyen called me again to state that the accident happened because he was turning left and the driver was turning right. I informed Mr. Nguyen that based on the evidence and witness statements it appears that both him and the driver of the motor vehicle were travelling straight at the time of the accident and neither party were attempting to turn. Mr. Nguyen remained silent and just kept stating he was turning left and they were turning right. I advised Mr. Nguyen I will add his statements to my report to which he was satisfied.

On 12/01/2021 while assigned to unit 524 I responded to the area of Walnut St and Cabot St for a report of a bicyclist that had possibly been struck by a vehicle. The incident was reported by two passerbys that stated they saw a young white male on a blue bike wearing black pants, red shoes and a black helmet get struck by a gray Honda CRV. Units checked the area and could not find the bicyclist or the vehicle. Shortly after clearing the initial call the operator of the vehicle called to report the accident. I spoke to Jean Ferreira who stated she was traveling southbound on Walnut St and noticed a young male about 13 yoa riding a bicycle along side her on her right side. As they approached the intersection of Cabot St Ferreira felt a thud along her passenger side. She looked in her rearview and saw the male down on the ground. She immediately stopped and exited her vehicle to check on him. As she approached the male party he apologized for hitting her car and said it was his fault. Ferreira did everything she could to help the male but he kept saying he was uninjured and he was sorry and that he only lived down the road (pointing down Cabot St). Ferreira offered to call the males parents or the police and medics but he refused and got back on his bike and left down Cabot St. (cid:31)I advised Ferreira that we had received a call on the incident but was unable to find the bicyclist. I told her I would document the incident for now with a report and if any one reaches out to us we will add to the report.

On Wednesday, February 16, 2022, while assigned to Traffic unit N525, I responded to the intersection of Cabot Street and East Side Parkway for a report of a motor vehicle/bicycle crash. The weather at the time of the crash was clear and sunny. The road surface was dry. Cabot Street and East Side Parkway are both public ways maintained by the City of Newton. I spoke with the operator of MV1 (2016 Mazda CX3, NY: JNB6711), Mr. Tushar Singhal (NY: 287647610). Mr. Singhal stated he was operating his vehicle on Cabot Street (E) towards the East Side Parkway intersection. Mr. Singhal stated he came to a complete stop at the stop sign on Cabot Street. Mr. Singhal stated he did not see any vehicles or pedestrians in the area at this time. Mr. Singhal stated he proceeded to travel through the intersection from his stopped positon and take a left turn onto East Side Parkway. Mr. Singhal stated at this time a bicyclist crashed into the passenger side of his vehicle. Mr. Singhal stated the bicyclist then fell over his hood and onto the roadway. Mr. Singhal reported no injuries from the crash. I observed damage to the front passenger side door, mirror, fender, and hood. Sgt. M. Wade spoke with the injured bicyclist, Keiji Imai, while he was being evaluted by Newton Medics. Mr. Imai stated he was operating his Trek bicycle on Cabot Street (W) towards the East Side Parkway intersection. Mr. Imai stated he was on the sidewalk and entered the intersection with out stopping. Mr. Imai stated he crashed into the side of MV1 and fell to the roadway. Mr. Imai was transported to Newton Wellesley Hospital with minor injuries to his left wrist and rear. Keiji was wearing a helmet at the time of the crash. I observed the helmet to have no fresh damage or defects. Photos were taken of the helmet to document it's condition. Keiji's father, Koguke Imai, was made aware of the crash involving his son and stated he would respond to the hospital. I observed no substantial damage to the Trek bicycle. I transported Keiji's blackTrek bicycle to Keiji's residence. I spoke with a witness to the crash, Ms. Madison Albano. Ms Albano stated she was walking her dog on Cabot Street (E) on the Northbound sidewalk at the East Side Parkway intersection. Ms. Madison Albano stated she observed MV1 approach the intersection to her right side on Cabot Street (E) and come to a stop at the stop sign. Ms. Albano stated she then observed MV1 make a left turn onto East Side Parkway and she heard a crash. Ms. Albano stated she observed a bicyclist crash into the passenger side of MV1 and then fall to the roadway. Ms. Albano stated she did not see the bicyclist prior to the crash and does not know if he came off of the sidewalk or was in the roadway. After speaking with all involved parties, I have summized the following. As MV1 was completing his left turn onto East Side Parkway (N) from Cabot Street (E), the involved bicylist failed to yield at the stop sign while traveling on Cabot Street (W) across the intersection. The bicyclist entered the intersection with out yielding and crashed into the passenger side of MV1. MV1 had the right of way. No citations will be issued as a result of this crash. Photos were taken of the scene and submitted to the IT Bureau. Keiji is a student at Newton North High School.

On Tuesday May 31, 2022 at approx. 1744 hours Sgt. P. Wade, Officer R. Cheu and I responded to Beacon Street at Garland Road for a report of a motor vehicle crash involving a cyclist. Upon arrival I observed the crash occurred during the evening hours, Beacon Street and Garland Road are both public ways in the City of Newton, which are also maintained by the City. The roadway appeared to have no defects on it. Traffic volume on Beacon Street was heavy congested in east/west directions. I observed the cyclist later identified as Clair-Solene Beck d.o.b. 4-13-99 of 1870 Beacon Street Brookline MA sitting on the curb on Garland Road with an apparent left shoulder injury. Medics arrived on scene and rendered aid to the cyclist. I observed MA registration 93N560 a white Nissan Altima registered to the operator Joan- Antointte - Adija -Seidu d.o.b. 9-11-93 100 Tremont Street # 19 Brighton MA 02135 that had some damage to the right rear passenger door. The cyclist, Ms. Beck stated she was traveling west on Beacon Street, wearing her helmet on her Trek cycle, color blue, on the right side of traffic, approaching Garland Road. She stated while traveling west, vehicle one traveled north onto Garland Road and she had little reaction time to stop. She applied the brakes and had contact with vehicle one on the rear right side passenger door. She stated her vision was obstructed of the intersection of Garland Road due to the size of the vehicles in the heavy traffic volume. The operator of V1 Ms. Seidu stated she was traveling east on Beacon Street stopped at the intersection of Garland Road, applied her left turn signal. She stated a vehicle stopped on the westbound travel lane of Beacon Street just prior to the intersection of Garland Road and motioned her hand for her to make her turn. Ms. Seidu stated she accelerated forward turned left (north) onto Garland Road when she felt an impact on her right rear passenger door. She stated she immediately stopped observed the cyclist and rendered aid. Ms. Beck was transported by Medics to Newton-Wellesley Hospital for a left shoulder injury at this time and Medics also placed the cycle in their ambulance with the cyclist. I took pictures of the crash site area that will be down loaded at the I.T. Bureau. All parties advised of the process and we cleared the scene.
