Narrative:
On Monday, July 15, 2019, while assigned to Traffic unit N525, I responded to the area of Beacon Street and Paulson Road, Newton, for a report of a hit and run motor vehicle accident involving a bicyclist. The weather at the time of the accident was clear and sunny. The road surface was dry. Beacon Street and Paulson Road are both public ways maintained by the City of Newton. I spoke with the injured bicyclist in front of 165 Paulson Road, Alexander Mendonez. Mendonez stated he was traveling Westbound on Beacon Street on his bicycle near Paulson Road. Mendonez stated he observed a late model gray sedan "inch to a stop" on Beacon Street (W) at Paulson Road. Mendonez stated he did not remember if the vehicle had it's right directional on at the time. Mendonez stated as he was traveling through the intersection with the vehicle on his left, the vehicle took a right turn onto Paulson in front of him. Mendonez stated he attempted to brake and veer to the right of the vehicle, but was unable to avoid the collision. Mendonez stated his left side made contact with the rear passenger door/rear fender area of the vehicle. Mendonez fell to the roadway and the vehicle left the area Northbound on Paulson Road. Mendonez was unable to see who was operating the vehicle. Newton Medics responded and treated Mendonez for injuries to his left knee/arm area. Mendonez signed a patient refusal with Newton Medics. I observed minor damage to the left handlebar area of Mendonez's bicycle (black Trek). Mendonez was wearing a white helmet at the time of the accident with a blue shirt and white and black shorts. Pictures were taken of the area and bicycle and submitted to the IT Bureau. Mendonez was able to provide a partial Massachusetts registration of "7BS32". I attempted run this plate with multiple combinations. I searched the area for a vehicle matching the description given by Mendonez with a negative result. On July 16, 2019, I spoke with a witness to the incident Mark O'Hearne. O'Hearne stated he was traveling Westbound on Beacon Street a few car lengths behind where the accident occurred. O'Hearne stated he observed a bicyclist on the right side of the road abruptly stop and fall to the roadway. O'Hearne stated he observed a vehicle in the path of the bicycle. O'Hearne stated the vehicle did not stop after the bicyclist fell and took a right onto Paulson Road from Beacon Street. O'Hearne stated he followed the vehicle involved in the accident to Commonwealth Avenue, and while doing so took a picture of the vehicle's license plate. O'Hearne stated he did not observe who was driving the vehicle. The Massachusetts registration provided to me by O'Hearne is 7BS322. This vehicle comes back to a 2010 Volkswagon Jetta registered to Peter Giorgi (S20952090) out of Paxton, Ma. I spoke with Peter via telephone. Peter acknowledged he is the registered owner of the vehicle, but stated his daughter was using the vehicle and was in the Newton area. I spoke with Lindsey Giorgi (S35711247) via telephone. Giorgi stated she was operating MA: 7BS322 in Newton yesterday, but does not recall being in an accident. Giorgi stated she is not familiar with the area and does not know the area where the accident occurred. Giorgi stated there is no damage to her vehicle and stated she does not believe she hit anyone. Giorgi emailed me 4 photos of her vehicle where I described the damage would be. I observed a small area of minor damage to the rear passenger side door area of this vehicle. After speaking with all parties involved, I am requesting a hearing in Newton District Court for Chapter 90, Section 24 (Leaving the Scene, Personal Injury). Giorgi was advised and mailed Massachusetts Uniform Citation T1269847. All photos obtained from O'Hearne and Giorgi were submitted to the IT Bureau.

Narrative:
On Friday, July 19, 2019, while assigned to traffic unit N525, I responded to the area of 845 Beacon Street, Newton for a report of a motor vehicle accident involving a bicyclist. It was reported that the bicyclist sustained minor injuries as a result of the accident. The weather at the time of the accident was clear and sunny. The road surface was dry. Beacon Street is a public way maintained by the City of Newton. I spoke with the operator of MV1 while Newton Fire and Medics attended to the injured bicyclist. Andrei Jordao (S09978620) stated he was parked in his 2019 Hyundai Kona (NY: JFP5331) at a metered parking spot in front of 847 Beacon Street, Newton. Jordao stated he opened his driver door to exit his vehicle when a passing bicyclist crashed into the door. Jordao stated he did not look back at traffic prior to opening the door. Jordao stated the bicyclist fell to the roadway. I observed moderate damage to the driver side door and it was unable to close as a result of the collision. I spoke with the injured bicyclist, Leonard Engel (S53573803). Engel stated he was operating his bicycle Westbound on Beacon Street in the travel lane. Engel stated a vehicle to his right opened it's driver door into the roadway and he was unable to avoid hitting it. Engel stated he fell over the top of his handlebars and onto the roadway. Engel stated he injured his right shoulder/arm/neck area and his right ankle. Engel also had a small injury to his left knee. Engel stated he does not believe he hit his head as a result of the accident. Engel was wearing a helmet, I observed some scratch marks on it. Engel signed a patient refusal with Newton Medics. I observed damage to the rear tire area of Engel's black and green Giant bicycle. There was also damage to chain/pedal area. Engel's estimated the value of the bicycle at $4,000.00 USD. Massachusetts Uniform Citation T1271041 was mailed to Jordao for Chapter 90, Section 14 (Open car door into traffic). Tody's responded the removed MV1 from the roadway. Photos were taken of MV1 and the bicycle and submitted to the IT Bureau.

On Tuesday, July 23, 2019, while assigned to Traffic unit N525, I responded to the intersection of Beacon Street and Washington Street, Newton for a motor vehicle accident involving a bicyclist. The weather at the time of the accident was overcast. The road surface was dry. Beacon Street and Washington Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Paige Mahoney (S85200426). Mahoney stated she was stopped in traffic at a red light on Beacon Street (W) at Washington Street in her 2018 black Volkswagon Tiguan (MA: 633MV6). Mahoney stated while her vehicle was at a complete stop, she felt and heard something hit the rear of her vehicle. Mahoney exited her vehicle and saw a bicyclist on the roadway. I observed minor damage to the rear middle bumper area of MV1. There was a small amount of blood present on the damaged area. I observed the roadway where the accident occurred. There was a small pool of blood in the left lane of Beacon Street (W) where the bicyclist fell to the roadway. The area of the roadway where the accident occurred is currently undergoing restoration and the asphalt has been graded down to it's sub base in preparation to be resurfaced. The current road surface condition is bumpy and uneven. The area where the roadway goes from a smooth surface to a bumpy surface is where the accident occurred. The injured bicyclist was identified as Timothy Johnson (S29270605). I spoke with him in the Newton Wellesley Hospital emergency room. Johnson stated he was operating his bicycle Westbound on Beacon Street on the right side of the left lane. Johnson stated he was coming to a stop in traffic at a red light when his wheel abruptly turned to the left and he began to fall over. Johnson stated his head hit the back of a vehicle stopped in front of him and he landed on his right side, with his bicycle landing on top of him. As a result of the accident, Johnson suffered an injury to the right side of his head and had scrapes on his right arm. Johnson stated he did not lose consciousness as a result of the accident and he appeared to be alert and orientated while I was speaking with him. Johnson was wearing a helmet at the time of the accident. There were fresh markings on the right side of the helmet with minor black paint transfer. These markings are consistent with Johnson's statement that he fell into the back of MV1 and hit his head. Johnson's bicycle was removed from the roadway prior to my arrival and was being stored in the driveway of 2044 Beacon Street by the resident there. I observed no obvious damage to Johnson's bicycle. After speaking with all parties involved and examining the roadway where the accident occurred, it appears that the condition of the road surface contributed to Johnson losing control of his bicycle and crashing into the rear bumper area of MV1 while it was stopped in traffic. Photos were taken of the road surface, John's bicycle, and MV2 and submitted to the IT Bureau.

On Friday, August 16th 2019, at approximately 6:40pm, I, Officer Brooks, responded to Dunstan street at Washington street for a MVA pedestrian. Upon my arrival I spoke with the operator of MV1(294NZ5), who stated she was traveling southbound on Dunstan street and was attempting to pull out onto Washington street, when she made contact with a bicyclist traveling westbound on Washington street. The operator stated she never saw the bicyclist, and that she was traveling less than a mile per hour when she made contact. It should be noted that the sun was setting and the operators vision would have been impaired by the sun at the location of the accident. MV1 had a minor scuff mark on the front bumper. I spoke with the bicyclist who stated he was traveling westbound on Washington street and was crossing over Dunstan street when he was struck by MV1. He stated he was knocked off the bike, scraped his arm, and had minor back pain. The mirror on the right side of his bike was broken. The bicyclist was wearing greenish gray clothing, and was not wearing protective equipment such as a helmet. The bicyclist signed a refusal from Cataldo and was given a copy of the report number. Pictures were taken of the scene and all parties were sent on their way.

MV1 jumped a curb and collided with a parked vehicle MV2 (a 2004 GMC Yukon, MA Reg: 8EC792) in front of 185 Waltham St. MV1 operator, Angel Gonzales, was unconscious on scene in the driveway of 185 Waltham St. Waltham St is a public way that is owned and maintained by the City of Newton. A passerby, Joseph Anderson saw the aftermath of the crash and called 911. MV2 had damage to its drivers side door and rear side. MV1 was heavily damaged, on its side, and keys were in the ignition. MV1 was towed by towed by Tody's. Gonzales was transported to Beth Isreal in critical condition. When Gonazales was in the back of the ambulance, myself and medics smelled an odor of an alcoholic beverage emanating from Gonzales. All first responders thoroughly checked the surrounding area for a helmet but one could not be located. Due to Gonzales' critical condition and urgency to get to the hospital, and ID was not thoroughly looked for on his person. Ofc. Guarino, N491, retrieved an ID from Gonzales upon arrival at Beth Isreal Hospital. Ofc. Stake filled out a towed inventory form. Pictures taken and sent to IT. Sgt. Lee was notified and will be following up with this incident. MV1 operator, Angel Gonzales is being charged with the following (MA Uniform Citations T1442823 & T1442824): 90/24J - OUI Liquor (public way) 90/24E - Negligent Operation of a MV (operating recklessly at a high rate of speed) 89/4A - Marked Lanes 90/23 - Attaching Registration Plates (attaching registration plates to motorcycle to conceal the fact that it was unregistered. Registration plate on the motorcycle came back to a 2002 Honda VT750 motorcycle, MA Reg: 1T3988; VIN on the motorcycle came back to a 2005 Suzuki GSXR60, MA Reg: 1L4389) 90/9B - Unregistered MV (motorcycle 2005 Suzuki MA Reg: 1T3988 was confirmed unregistered by RMV) 90/23D - Operating MV with a Suspended License (RMV confirmed that Gonzales' license was suspended S94722414) (see Incident #19039806 for more details). For QED purposes, the charge 266/139 - Stolen Registration was added to this report because 90/23 - Attaching Registration Plates was not an option. Due to Gonzales' hospitalization, the citations will be mailed to his last known address. Officers were able to rise a Harold Curtis, the father of Anthony Curtis (owner of MV2, the GMC Yukon) at 185 Waltham St. He was notified of the incident and advised to call their insurance company. Curtis mentioned that he has cameras facing the street where the incident took place and will see if he can retrieve the footage for us. Police prosecutor to subpoena blood.

Opr of V1 stated she was in the right turn lane on California Street waiting to turn right onto Bridge Street. Opr stated the green arrow signal came on and she started to turn. At this time, B1 cut in front of her to beat the light and made contact with the vehicle. V1 sustained light damage to the front right. V1 was not towed. Opr of B1 stated he was on California Street waiting to turn left onto Bridge Street. At this time, he stated he saw no cars moving, rode across the street, and tried to beat the light. B1 made contact with V1. Opr of B1 suffered minor injuries and was transported to NWH. Bike was put in the property room for safekeeping. I was unable to secure bike, but helmet, bike pump, and mirror were placed in locker number 8.

On Tuesday, September 10, 2019 while assigned to Traffic unit N525, I responded to the area of Beacon Street and Roslyn Road, Newton for a report of a motor vehicle/bicycle crash. The weather at the time of the crash was overcast. The road surface was dry. Beacon Street and Roslyn Road are both public ways maintained by the City of Newton. I spoke with the bicyclist involved in the crash, Steven Greenzang (S96615185). Greenzang stated he was traveling Westbound on Beacon Street in the shoulder lane on his black Specialized bicycle. Greenzang had a yellow reflective vest on and was wearing a helmet at this time. Greenzang stated a vehicle in the travel lane to his left drove by him and hit the mirror located on his left handlebar. I observed damage to the mirror. Greenzang report no injuries. I spoke with the operator of MV1, Sarah Bonfanti (S66811372). Bonfanti stated she was parked in front of 1411 Beacon Street waiting to pick up a co-worker that resides at that address. Bonfanti stated a bicycle traveling on the sidewalk to her right crashed into the passenger side door mirror of her 2008 Toyota Scion (MA: 681YH1). Bonfanti stated the bicyclist was acting "crazy" during her interaction with him and he was trying to take her picture. Bonfanti stated she got back into her vehicle and moved up the roadway to wait for police to arrive on scene. I canvassed the area where the accident occurred with Sgt. Dempsey. There was glass from the passenger side mirror of MV1 and Greenzang's bicycle in the main travel lane of the roadway and the shoulder lane where Greenzang stated he was traveling. We also observed a large tree and a telephone pole on the sidewalk next to the roadway where the accident is alleged to have occurred. After speaking with all parties involved, observing the location of the glass in the roadway from the crash, and the location of the tree and telephone pole on the sidewalk where he accident occurred; Greenzang would not have been able to operate his bicycle on the sidewalk and be close enough to the roadway to make contact with MV1. Prior to clearing the accident, I asked Bonfanti if she had any questions and if she wanted to report any injuries. Bonfanti stated she was hit by the bicyclist during her exchange with him and began grabbing her left leg. I asked Bonfanti why she did not inform the officers on scene that she was assaulted. Bonfanti stated she said something to our Dispatch when she called. I asked Bonfanti if her leg was injured. Bonfanti stated I was putting words in her mouth and that she was just scratching her leg. Bonfanti then stated she was hit in the right shoulder. I asked Bonfanti if she would like an ambulance to respond and evaluate her. Bonfanti declined and stated she was more concerned about her mirror. I advised Bonfanti if she wanted to pursue charges against Greenzang she could do so in Newton District Court. I listened to the 9-1-1 recording Bonfanti made in regards to this incident. Bonfanti stated a pedestrian busted out her window. Bonfanti then stated to our dispatcher that the bicyclist lost control of his bicycle and smashed into her car. During her exchange with the our dispatcher, I did not hear Bonfanti say she was physically assaulted by Greenzang.

Narrative:
On Saturday, September 28, 2019, I responded to the intersection of Crafts Street and Albemarle Road, Newton with Sgt. Lee for a report of a motor vehicle crash involving a motorcycle with serious injury to it's operator. The weather at the time of the crash was clear and sunny. The road surface was dry. Crafts Street and Albemarle Road are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Jussara Pontes (S92930243). Pontes stated she was operating a 2017 Toyota Sienna (MA: 4GX777) at the time of the crash. Pontes stated she was traveling North on Albemarle Road and came to a stop at the stop sign located at the Crafts Street intersection. Pontes stated she looked both ways and began to inch out into the roadway. Pontes stated she stopped the vehicle again and was assisting a child sitting in the 2nd row of the vehicle. Pontes stated she then turned her attention back to the roadway. Pontes stated she looked to her right and left again and did not see any vehicles in either direction. Pontes stated she proceeded to cross the intersection to continue North on Albemarle Road. Pontes stated the front bumper area of MV1 crashed into the left side of a passing motorcycle. Pontes stated the motorcycle and it's operator fell to the roadway and slid across the street to the side of the road. Pontes stated she pulled her vehicle over onto Albemarle Road. Pontes stated she did not see the motorcycle prior to the crash and was not distracted. The operator of the motorcycle (MV2), Irene Pistoftzian (S06099449) was transported to Brigham and Women's Hospital with a serious left leg injury prior to my arrival. I observed a red 1990 Kawasaki ZR550 (MA MCN: 1V1063) resting on it's right side on the NE sidewalk area of Albemarle Road at Crafts Street with it's front wheel/handlebar facing Crafts Street. The motorcycle had moderate damage to it's left side from the impact of MV1 crashing into it. The right side of the motorcycle had damage from sliding on the roadway and the crashing into a fence on the sidewalk on Crafts Street (W) at Albemarle Road. There was also damamge to the front headlight/right handlebar area. The motorcycle and Toyota Sienna were towed from the scene by Tody's towing at Sgt. Lee's request. Pictures were taken of the scene and submitted to the IT Bureau. I spoke with Pistoftzian at Brigham and Women's Hospital in Boston on Monday, September 30, 2019. Pistoftzian stated she was operating her motorcycle on Crafts Street (W). Pistoftzian stated as she approached the intersection of Crafts Street and Albemarle Road, she observed a mini van to her left out of her peripheral. Pistoftzian stated she remembers being hit on her left side and then laying on the roadway looking up at the sky on the sidewalk with her head facing Albemarle Field. Pistoftzian stated as a result of the crash she has a significant injury to her left leg and also has an injury to her left wrist/arm. Pistoftzian stated she was wearing a helmet at the time of the crash. I spoke with Kymberley Mitchell via telephone who stated she witnessed the crash. Mitchell stated she was traveling behind the motorcycle involved in the crash on Craft Street (W) at North Street. Mitchell stated they were stopped at a red light at this time. Mitchell stated there were no vehicles in front of the motorcycle at the light. Mitchell stated the light turned green and they continued on Crafts Street at a low rate of speed. Mitchell stated she could see ahead at the intersection of Albemarle Street and Crafts Street, traffic was stopped on Crafts Street (E) letting traffic exit Albemarle Road (N). Mitchell stated vehicles were taking left and right turns out of Albemarle Road before the motorcycle reached the intersection. Mitchell stated a mini van was crossing past the double yellow line of Crafts Street to continue straight when it crashed into the left side of the motorcycle. I spoke with Cheryl Wermer via telephone who stated she witnessed the crash. Wermer stated she was traveling on Crafts Street (E) towards Albemarle Road. Wermer stated traffic ahead of her was stopped to allow vehicles to turn off of Albemarle Road. Wermer stated she observed a motorcycle traveling towards her on Crafts Street (W). Wermer stated she then saw a vehicle travel straight from Albemarle Road across Crafts Street and crash into the motorcycle. Wermer stated the operator of the motorcycle flew off the bike. Wermer stated the car then came to a stop and the driver got out and stated "Oh my god! I didn't see you!" Wermer stated both vehicles were traveling at a low rate of speed prior to the crash. I spoke with Bill Frabizio via telephone who stated he witnessed the crash. Frabizio stated he was behind the mini van (MV1) on Albemarle Road prior to the crash. Frabizio stated the vehicle in front of him began to cross the intersection as he was monitoring the traffic on to take a right turn onto Crafts Street. Frabizio stated he heard a loud "Boom" and saw a motorcycle slide across the street with its operator. Frabizio stated the motorcycle crashed into a fence post and the operator came off the motorcycle. Frabizio stated he pulled over and assisted operator of the motorcycle. After concluding my investigation, the operator of MV1, Jussara Pontes, was mailed Massachusetts Uniform Citation T2016424 for Newton City Ordinance Chapter 19, Section 75 (Failure To Use Care).

Narrative:
On 10/04/19 at 11:49 hours while assigned to Traffic Unit 523, I responded to a motor vehicle/bicyclist accident at Centre Street and Nathan Road. The weather at the time was cloudy. The road surface was dry and Centre Street and Nathan Road are public ways maintained by the City of Newton. Traffic conditions were heavy and Centre Street was congested with vehicles at the time. There is no dedicated bicycle lane in this area but there are bicycle indicators painted on the roadway to make drivers aware of bicyclists traveling. I spoke to the bicyclist involved (Unit 2), Marvin Goldman (S67373495). Goldman was wearing a helmet, gray sweatshirt, gray shorts, and black/orange reflective sneakers. Mr. Goldman stated that he was traveling southbound on Centre Street on the right side of the road on his black Fuji Sagres bicycle. He further says that he was peddling fast at the time while crossing over Nathan Road and that is when he suddenly struck Unit 1 on it's passenger side front quarter panel/door area. He does not recall any other details of the incident along with Unit 1 attempting to turn left towards him. Goldman sustained scraped up knees and a small laceration below his left eye. He refused medical attention signing a patient refusal with Cataldo Medic One. I observed that his front wheel was bent as a result of the accident. The rest of the bicycle appeared to be intact. I then spoke to the operator of Unit 1, Darlene Martins (S27966454). Ms. Martins spoke with the assistance of Ofc. Calderon who was translating for her. She says that she was traveling northbound on Centre Street and was attempting to turn left on to Nathan Road in order to turn around and travel the other way on Centre Street. She says that a vehicle in the southbound travel lane left space for her to make her left turn. She then proceeded to turn thinking it was clear and that is when the bicyclist suddenly approached and struck her on her passenger side. She also stated that it was hard to see past the congestion of vehicles waiting in the southbound travel lane. I observed scratch marks and a dent to her passenger side front quarter panel area along with minor scuff marks to her front passenger door. The scuff marks appear to be from the bicyclist rubbing against the vehicle. I also observed a dent on the top of the passenger door frame. It is unknown if the damage is the result of the accident or old damage Ofc. Calderon spoke to Rosangela Dias (Passenger in Unit 1), who stated that everything happened so quick but she never saw the bicyclist approaching when Martins attempted to turn left. I then spoke to a witness on scene identified as Matthew Miner. He says that he was two vehicles behind an unknown vehicle in the southbound travel lane of Centre Street. He says that the unknown vehicle left space for Unit 1 to turn left and waved Unit 1 on to turn left. He does not recall what transpired with the bicyclist. As a result of the accident, it was determined that Martins did not yield the right of way to the bicyclist while she was turning left. She also does not have a license to operate in Massachusetts or any other state. She was issued MA Uniform Citation # T2012393 for Ch. 89/8 Failure to yield and Ch. 90/10 Unlicensed Operation of a Motor Vehicle. Digital photos taken by me of the scene.

On 11/27/19 at 12:43 hours, I responded to the Petsmart located at 215 Needham Street for a motor vehicle bicyclist accident. The weather at the time was approximately 50 degrees, cloudy and the road conditions were dry. No injuries reported. Operator of MV # 1 (Barbara Cooper) states she was facing eastbound on Needham Street waiting in the center turn lanes to take a left turn in to the garage of 215 Needham Street. Next, she states that a large truck going westbound stopped for her and waved her on to turn. She then proceeded in to the garage and parked and that is when she was confronted by the bicyclist saying that she was struck with her vehicle. The operator was unaware of an accident occurring and was not able to visibly see past the truck while turning. I observed a minor scratch to the passenger rear quarter panel area of the vehicle. Operator of the bicyclist (Merissa Brousseau) states she traveling westbound in the bicycle lane on the right side near 215 Needham Street when she observed the large truck mentioned above suddenly stop. She states that she was also visibly blocked from seeing ahead due to the truck. She then kept peddling straight through and struck MV # 1 in the passenger side rear end as it was making its left turn. The operator was evaluated by Cataldo Ambulance but refused medical attention. I observed no apparent damage to the bicycle. Ms. Brousseau was wearing a bicycle helmet, black and red Boston University bicycle suit, and red BU sock covers over her shoes. Narrative:
On 12/19/2019 at 14:43 hours Newton Police dispatch received numerous phone calls about a white male whose face was covered in blood and was riding on an electric motorized scooter south bound on Walnut St near number 100. Walnut St is a public way in the city of Newton. Approximately two tenths of a mile south 100 Walnut St, Ofc Garcia stopped the male on the scooter. Ofc Garcia stated that the male on the scooter was evasive when answering his questions and claimed that he did not realize that his face was covered in blood. The male on the scooter was identified as Gregory David Brown. Brown was transported to Newton Wellesley Hospital for treatment. Prior to Brown being transported I was dispatched to the area of 100 Walnut St for a report of a male on an scooter who had crashed into a south bound vehicle in traffic on Walnut St and another vehicle that was parked in front of number 73. Upon my arrival I spoke with Penni Rochwerger and Nikita Espinal. Rochwerger stated that she was driving south bound on Walnut St across from 100 when she activated her vehicle's four way flasher and stopped her vehicle to let Espinal who was the front seat passenger out. Rochwerger stated that south bound traffic stopped behind her vehicle after she came to a stop adjacent to Espinal vehicle that was parked facing south in front of 73 Walnut St. Espinal stated that she checked over her right should to see if it was clear to open her door and it was . Espinal stated that as she opened her door to exit a male on scooter crashed into the door and fell to the ground. Both Rochwerger and Espinal stated that the male on the scooter did not provide his name or address and continued south bound on Walnut St with his face coved in blood. Rochwerger's vehicle sustained damage to the front passenger side door that would not closed all the way. Espinal vehicle also had damage to it, the rear driver's side lower quarter panel was struck. I responded to Newton Wellesley Hospital to speak with Brown. When I arrived and spoke with Brown he was evasive with his answers . When I asked Brown what had happened he gave conflicting answers and contradicted himself. Brown stated that he was riding his scooter on the roadway south bound on Walnut St be could not recall any other details. When I asked Brown if he was wearing a helmet as required by MGL 90/1E he stated he couldn't recall. Rochwerger, Espinal and Ofc Garcia all stated to me that they did not see Brown wearing a hamlet. There was an unconfirmed post by a person named Tricia Marucci to the Facebook group Newton Parents stating that at 14:45 hours on 12/19/2019 saw Brown hitting a defect in the roadway in the area of Crafts St by California St that caused him to loses control of his scooter and fall face first onto the pavement. In her post Marucci stated that Brown was cover in blood from facial lacerations, and that he refused medical aid and continued to ride his scooter south bound towards the entrance to Walnut St. I left a message for Marucci to contact me and as of the writing of this report she has yet to do so. While at the hospital I ran Brown's name and date of birth via the MA RMV data base in order to issue him a citation for not wearing a helmet. The query of Brown via the MA RMV data base reviled that Brown's MA driver's license statutes was suspended. On 07/11/2018 admitted to a finding of sufficient facts to one count of MGL 90/24 OUI liquor. Brown received a Continued With Out Finding for 18 months. In addition Brown pleaded guilty to an additional count of MGL 90/24V Child Endangerment While OUI. Brown received a 90 day sentence in the Middlesex House of Correction which was suspended for 18 months. Brown also received a one year loss of his driver's license. Brown is on active probation out of Newton District Court until 07/21/2020. Biased upon the statements made to me I issued Brown MA Criminal Application T 2012526 for violations of MGL 90/24(2) Leaving The Scene Of An Accident Property Damage , MGL 90/1E Operation Of A Motorized Scooter Without A Valid License and MGL 90/1E Operation Of A Motorized Scooter With Out A Helmet. As of 12/20/2019 Brown was discharged from Newton Wellesley Hospital.
