On 02/07/2019, while assigned to N494, I, Officer Conary, responded to a MVA at Franklin Street and Waverly Ave. I met with the Operator of MV1 who stated that he was driving Northbound on Waverly Ave when MV2 came into his lane from Franklin Street and hitting him on the left side. Operator of MV2 stated that he was stopped at the stop sign at Franklin Street and proceeded to take a left turn onto Waverly Ave. At this time, MV2 thought MV1 had a stop sign and was going to stop. MV2 hit MV1. There is no stop sign on Waverly Ave at Franklin Street. Operators of each vehicle were offered and declined medical attention. Operator of MV2 was a Lyft driver and was driving three others in the vehicle. Two occupants were offered and accepted medical attention. Both were transported to Newton Wellesley hospital. The other occupant (Paige) declined medical attention. She had a air cast on from a previous injury. MV1 could not be driven from scene. It was parked legally and safely on the side of the road. Operator of MV1 will get a tow later on. MV2 was able to be driven from scene. Operator of MV2 continued to drive Paige home. No further incident to report.

Operator of MV1 (Mass reg. 8928AN) states he was traveling south bound on Waverly Ave when MV2 went through the stop sign and entered the intersection causing him to collide with MV2. Operator of MV2 (Mass reg. 7SH894) states she does not have much recollection from the accident. She states she had glare in her eyes when she was traveling east bound on Franklin Street and stopped at the intersection with Waverly Ave and proceeded through the intersection and collided with MV1. All parties were evaluated by Cataldo paramedics, operator of MV2 was transported to Saint Elizabeth's Hospital with minor injuries. Tody's towed both motor vehicles.

The operator of MV1 (Apportioned IN Reg 2789617, Central Transport LLC, US DOT 661173, height 13' 6") stated he was traveling Northbound on Waverley Ave at the intersection of Franklin St when the top of the truck got caught on a bundle of low wires and took them down, creating a loud bang. The wires were hanging diagonally across the intersection from pole 9/24 (NE corner) to pole 9/22 (SW corner), approximately 2 feet off of the ground. Eversource, Verizon and Comcast responded to assess the scene and they were determined to be Verizon wires. MV1 didn't appear to have any immediate damage however I was unable to see the top of the truck, and the operator was uninjured. The height of truck is 13'6". Verizon responded to the area to reattach downed wires.

Operator of MV2 stated she was traveling northbound on Waverly Ave when she was struck from behind by MV3 pushing her into MV1. Operator of MV4 stated he was traveling to close to MV3 and had no time to stop and struck the vehicle causing the accident. Operator of MV4 was determined to be operating under the influence of alcohol and was placed under arrest for 90/24 OUI (See incident #19021959). No operators reported any injuries. MV3 and MV4 were towed by Todys due to damage.

Narrative:
On Thursday, June 6, 2019 while assigned to Traffic unit N525, I responded to the intersection of Waverly Avenue and Franklin Street for a report of an accident involving a City of Newton school bus. The weather at the time of the accident was clear and sunny. The road surface was dry. Waverly Avenue and Franklin Street are both public ways maintained by the City of Newton. The operator of MV1, Dorothy Wensink (S40227061), stated she was operating her 2010 Toyota Prius (MA: 538EV6) Eastbound on Franklin Street towards Waverly Avenue. Wensink stated she came to a stop at the stop sign on Franklin Street (E) at Waverly Avenue. Wensink stated as she began to travel through the intersection, a school bus traveling on Waverly Avenue (S) crashed into the rear driver side door area of her vehicle. Wensink reported no injuries on scene. I observed moderate damage to the rear driver side area of MV1. Wensink was able to driver her vehicle away from the scene. MV2 was a City of Newton contracted yellow school bus (MA BUN: 39173) transporting students attending the Ward Elementary School. The bus was returning to the Ward School from a field trip. The operator of MV2, Antonio Goncalves (S54275856), stated he was operating the school bus Southbound on Waverly Avenue towards Franklin Street. Goncalves stated MV1 abruptly accelerated across the intersection from Franklin Street. Goncalves stated he was unable to avoid making contact with MV1 and crashed into the rear driver side of the vehicle. I observed minor damage to the front middle and passenger side bumper area of MV2. The following Ward Elementary School student, teachers, and parents were traveling on the school bus at the time of the accident and reported no injuries. Students: Avishai Arbili, Eleanor Chen, Maeve Donovan, Esat Efendigil, Mark Elentuck, Julian Ismay, Rhea Khanna, Griffin Kirby, Ori Layani, Priscilla Le-Ngo, Callum McLaughlin, Carolina Muniz, Emily Ney, Hrithik Ponduru, Levi Rosenberg Van Gameren, Zachary Schwarzberg, Ava Smoller, Matthew Somers, Lillian Welford, William Balerna, Alexandra Bogdanova, Randi Green, Christopher Iatrou Johnson, Charlotte Nichols, Henry Pozen, Sofia Shadah Alcalde, and Zoey Steinberg. Teachers: Katherine Goldman and Lauren Ludman. Parents: Enrique Shadah, Brian Rosenberg and Xinxin Wang. The Principal of the Ward Elementary School, Becca Brogadir, responded to the crash scene and signed a patient refusal for all of the students with Newton Medics. The students, teachers, and parents, then walked back to the Ward Elementary School with Principal Brogadir. The school bus was able to drive away from the scene. Once the students arrived at the Ward Elementary School, the nursing staff there evaluated each child before they could return to class. The school staff stated they would make notifications to the parents of the children involved in the accident. After speaking with all parties involved, the operator of MV1 was cited in hand for Newton City Ordinance Chapter 19, Section 75 (Failure to Use Care). Pictures were taken of both vehicles and submitted to the IT Bureau.

Vehicle One stated he was travelling Northbound on Waverley Ave when he collided with Vehicle Two. Vehicle One stated he did not know where Vehicle Two came from nor did he observe it prior to the collision. The operator of Vehicle One appeared shaken up due to airbag deployment but did not complain of any injuries. He was evaluated by Ambulance One and signed a patient refusal. Vehicle Two stated she was also driving Northbound on Waverley Ave when Vehicle One attempted to cross Waverley Ave from Franklin St causing the collision. The damage to both vehicles (Vehicle One drivers side damage and Vehicle Two front end damage) was consistent with Vehicle Two's version of the crash. Both vehicles were towed by AAA. The operator of Vehicle One was issued Mass Uniform Citation T1444379 for 89/9 Fail to Yield.

Vehicle #1 was traveling South on Waverly Ave. Vehicle # 2 was attempting to enter the Southbound lane of travel on Waverly Ave from Franklin St. Vehicle #2 pulled out into the lane that Vehicle #1 was already established in. MV#2 was traveling south on Waverly Avenue when it was struck from Franklin Street by MV#1. -Operator of MV#1 stated she was traveling east on Franklin Street and that she stopped at the intersection. She stated as she was about to enter Waverly Avenue from Franklin Street and after checking to ensure she was clear to enter, she collided into MV#2. She stated he was flying up the road. -Operator of MV#2 stated he was traveling south on Waverly Ave when he was struck by MV#1. Operator of MV#2 stated the collision spun his vehicle 180 degrees. He stated he was facing the direction he was just comming from. He stated he didn't think she (Operator of MV#1) stopped. - I observed the front of MV#1 sustained heavy damage. The hood was bent in, the bumper was cracked and hanging, and fluids were leaking from the vehicle's engine. I next observed the damage to the doors on the right side of MV#2. I observed the base of the doors were pressed in, those doors would not open and the tires were grinding against the flared edges of the wheelwells. - There were no injuries reported at the scene, however, both operators were checked by Ambulance 1. Newton Fire responded to scene to contain the Hazmat spill from MV#1. MV#1 was towed from the scene. OpMV#1 was cited (T2015541) for Failure to come to a Complete stop at stop sign. I transported Operator of MV#1 to Tody's towing from the scene.

The operator of vehicle 1 stated she was travelling southbound on Waverley Ave, when vehicle 2 went through the stop sign, and struck her vehicle on the rear passenger side. The operator of vehicle 2 stated that she was already out in the intersection trying to take a right hand turn. Operator 2 states that vehicle 1 was travelling at a high rate of speed, and that is why they crashed. I observed heavy damage to the front of vehicle 2, and heavy damage to the passenger side of vehicle 1. No one was injured. Tody's towed both vehicles to their lot.

SHE STATES VEHICLE #1 ENTERED THE TRAFFIC LANE AND SHE WAS UNABLE TO AVOID HITTING HIM. VEHICLE #1 HAD LEFT REAR SIDE DAMAGE AND AIRBAG DEPLOYMENT. VEHICLE #1 WAS TOWED BY TODYS. OPERATOR OF MV 2 ACKNOWLEDGED THE ACCIDENT WAS HIS FAULT AND WAS ISSUED MA UNIFORM CITATION T2079858 FOR C.O. 19/75 FAILURE TO USE CARE WHILE TURNING. Operator 1 stated he was driving northbound in the southbound lane on Waverly Ave due to construction in the northbound lane. Operator 1 stated as he approached the intersection of Franklin St he was confused on which side of the cones he should be on and crossed over the marked lanes and past the cones and subsequently drove into a 2ft X 2Ft X 8 inch deep construction hole. Operator 1 stated he sustained no injuries and was checked out by medic 3 in which he signed a patient refusal. MV1 sustained minor damage, scuffs, to the right side leather saddle bag. The northbound lane was coned off for more than a block due to a Feeney Brothers construction detail with Officer Edrehi manning the post. A backhoe, a bobcat and a generator all occupied the northbound lane that was clearly blocked off. Officer Edrehi stated that due to Feeney Brother construction detail Waverly Ave was diverted to 1 way traffic travelling northbound in the southbound lane. Officer Edrehi stated he observed Operator 1 following multiple vehicle and as he approached the intersection of Franklin St Operator 1 crossed over the marked lanes and past the cones and at a low speed fell into the construction hole. Due to the statements provided I issued Operator 1 MA Uniform Citation T1269531 for C89 S4A Marked Lanes violation (warning). Operator 1 was assisted in lifitng his motorcycle and drove off without further issues.

MV1 described as dark gray pick up truck was traveling Eastbound on Franklin St. MV2 (MA Reg: 1XEF21) was traveling Northbound on Waverley Ave. MV1 crashed into MV2 driver side back passenger door, causing MV2 to spin 90 degrees and crash into a traffic light at the Northeast corner of Waverley Ave and Franklin St causing damage to the trunk and damage to the Traffic light owned by the City of Newton (5 photos taken, placed in IT). MV1 did not stop and continued to Eastbound on Franklin St. The operator of MV2 (Jessica CARNEY) and her passenger ( Madeline KLIMM) both signed patient refusals with Fallon ambulance. MV2 was towed by Tody's towing. There was a plate baring MA Registration : 3PMK11 left behind on scene which comes back to 2005 Ford Explorer, registered to a Berhe DANIEL. Berhe DANIEL is being issued a criminal complaint (Citation# T1445433) for MGL Ch. 90 s.24- Leaving the scene- property damage. Contacted Malden PD to check for vehicle. No car was at the house that the plate was registered. A witness ( Kathleen MORRISON), who was no longer on scene stated the plate of the vehicle that took off was MA Registration: 3PMK11. A Ford symbol and a Chevy hub cap were found at scene of accident. Due to this and witness description it is unclear if Plate of vehicle number 1 was attached to the registered car.

On July 18th, 2021 at approximately 13:47 hours while working N491 I responded along with NFD and Fallon ambulance for a report of a MV crash at the intersection of Waverly Ave at Franklin St. On my arrival to the scene I located both involved vehicles that had both sustained heavy damage. The first vehicle was a white Tesla V SUV, Ma reg. 2NJJ97 operated by Raul Uppot. He reported first being stopped E/B on Franklin St at the intersection of Waverly Ave. He then proceeded to cross Waverly Ave to get to the other side of Franklin St when he was struck in the intersection by vehicle #2. Operator further stated he never saw vehicle #2 coming S/B on Waverly Ave. The second involved vehicle was a 2017 black subaru impreza, ma reg.7dt861, operated by a Isabel Hanna Wilker. She reported going S/B on Waverly Ave when vehicle #1 came out from Franklin St causing her to crash into that vehicle. Both vehicles were towed by Todys. All parties involved in this crash were evaluated by Fallon paramedics but all declined to be transported.

It also should be noted that there are many motor vehicle accidents at this intersection based on there being no traffic signal making it difficult to cross. MV#1 had major Passenger side damage with airbag deployment. MV#2 had front end damage. The operators signed medical refusal's and Tody's towed MV#1.

MV1 was traveling southbound on Waverly Ave a public way in the city of Newton, and MV2 was stopped at the stop sign on Franklin st also a public way in the city of Newton. MV1 was driving through the intersection of Waverly and Franklin when MV2 pulled out and hit the side of MV1. Operator of MV2 sated there was a blind spot and she could not see MV1.
