OPERATOR #1 STATED SHE WAS GOING E/B ON NEWTONVILLE AVE WHEN ANOTHER VEHICLE COMING FROM THE OPPOSITE DIRECTION(W/B) AT A HIGH RATE OF SPEED FORCED HER TO SWERVE TO HER RIGHT CAUSING HER TO COLLIDE WITH TWO PARKED VEHICLES IN FRONT OF #390 NEWTONVILLE AVE. OPERATOR#1 FURTHER STATED DUE TO CARS PARKED ON THE E/B SIDE OF NEWTONVILLE AVE IT FORCES EASTBOUND TRAFFIC ONTO THE WRONG SIDE OF THE ROAD TO GET BY. SHE REPORTS THAT SHE WAS HAD NOWHERE TO GO WHEN VEHICLE #2 WAS COMING AT HERE. VEHICLE #2 COULD HAVE YIELDED TO HER VEHICLE. I OBSERVED NUMEROUS LEGALLY PARKED CARS ON THE EAST SIDE OF NEWTONVILLE AVE. HOWEVER FOR TRAFFIC TO DRIVE ON THE EAST SIDE OF NEWTONVILLE AVE THEY HAVE TO DRIVE ON WRONG SIDE TO GET BY. DUE TO NEWTONVILLE AVE BEING A NARROW RD WHEN CARS PARK ON THE EAST SIDE WHICH IS LEGAL THEY(PARKED CARS ) TAKE UP THE WHOLE EAST SIDE OF THE ROAD. BASED ON MS ROSENSWEIG STATEMENT I FEEL SHE HAD THE RIGHT OF WAY. VEHICLE #2 SHOULD HAVE YIELDED SEEING THAT VEHICLE #1 HAD NOWHERE TO GO. THERE WAS NO DESCRIPTION TO THE VEHICLE THAT CAUSED THIS CRASH.

On 7/15/19, I responded to the West Newton commuter lot to speak with a party who had her vehicle struck in front of 305 Centre St. The operator of MV1 (MA Reg:4YK555) stated that she was travelling southbound on Centre St when a white Mercedes SUV came into her lane and collided with her drivers side. The Mercedes appeared to acknowledge it made contact with the car, but did not pull over. The Mercedes travelled onto the Mass Pike westbound. The operator of MV1 observed a partial registration of Mass Reg "35M." MV1 stated that she did not see the remaining letters/numbers of the registration, however she believes it was an Asian female driver in her 30's. I had dispatch attempt to run the partial plate several ways with negative results. I observed minor damage to the drivers side of MV1. I advised MV1 to contact her insurance. State PD informed of the accident

Narrative:
On 09/27/19 at 08:41 hours while assigned to Traffic Unit 523, I responded to a motor vehicle/bicyclist accident at 1330 Centre Street. The weather at the time was clear and sunny. The road surface was dry and Centre Street is a public way maintained by the City of Newton. Traffic conditions were at a heavy volume and Centre Street was congested at the time. There is no dedicated bicycle lane in this area due to the road being too narrow. I spoke to the bicyclist involved (Unit 2), Michael Hnatko (S10432772). Mr. Hnatko stated he was traveling northbound on Centre Street on the right side of the road on his 20 inch gray Trek bicycle. He further says that he was peddling very fast at the time and must have not been paying attention to MV1 turning right in to parking lot of 1330 Centre Street as he was approaching from behind. As MV1 was turning right, he then struck the passenger side rear quarter panel of the vehicle and fell forward off of his bicycle. He sustained minor injuries such as scrapes to his knuckles on both hands and a small cut to the bridge of his nose. He signed a patient refusal with Cataldo Ambulance. It appeared that the front alignment was now off on his Trek bicycle. I then spoke to the operator of MV1, Lonnie McGinnis (S66044083). He states that he was inching along in heavy traffic waiting to turn right in to the lot of 1330 Centre Street with his right turn directional signal on. As he was turning right, the bicyclist struck his vehicle on his passenger side rear quarter panel area. McGinnis thought it was clear to turn right at the time and never saw the bicyclist approaching from behind. No injuries reported by McGinnis and I observed minor dents and scratches to the passenger rear quarter panel area. Digital photos taken by Ofc. Gaudet.

Upon arrival, I spoke with MV1 operator who stated he was travelling Westbound on Auburn St when his vehicles front axle suddenly broke causing the vehicle's front right wheel to turn outboard thus causing the MV to drive right. MV1 then collided with MV2 which was parked outside of 574 Auburn St. MV1 was towed by AAA. No injuries reported. Around 2130 hours, Mike Woods called the police station to receive information regarding the crash and MV2. He was updated and informed me that he would also be calling AAA for his vehicle.

On 11/6/19 at approximately 0610 hrs I responded to 15 Needham St., the National Lumber for a MVA involving a pedestrian. Upon arrival I spoke to the pedestrian who was lying on the street who stated he landed on his back and couldn't feel if anything was hurting. I advised him to stay put until the medics responded. The pedestrian was wearing brown pants and a black jacket and stated he was listening to his head phones when he attempted to cross the street. Where he attempted to cross was down Needham St from the main intersection and there was no crosswalk. He attempted to cross from the National Lumber side crossing the S/SW travel lane first. I then talked to the operator of MV#1 who stated he turned right onto Needham St from Winchester St and didn't see anybody attempting to cross until the last second. At this time he stated he jammed on his brakes and saw pedestrian on the hood of his Pickup before he fell to the ground. There was minor damage to the hood of the vehicle on the passenger side. The pedestrian was evaluated by the Medics and transported to NWH for further evaluation. Pictures were taken on scene and turned over to the IT bureau.

On Wednesday, November 20, 2019, I met with Officer Lazarakis at 25 Chestnut Street, Newton for a report of damage to Newton Police unmarked cruiser 1325. Officer Lazarakis stated she was retrieving an item out of the front passenger side door of the 2017 Ford Fusion (MA: 7HD877) when she observed a medium size dent near the door. Officer Lazarakis stated she does not know when or where the damage occurred. The vehicle has been moved several times in the last few days. The vehicle is typically parked in the rear parking lot of 25 Chestnut Street. It appears the dent was caused by a vehicle backing into the side of the vehicle. I observed no paint transfer or any other physical evidence left by the unknown vehicle. Pictures were taken to document the damage to the front passenger side door and submitted to the IT Bureau. IT was asked to check the surveillance cameras at 25 Chestnut Street to see if the incident was captured. I checked the area for vehicles for damage consistent to the damage on 1325 with a negative result.

The operator of MV#1, identified as Frank Vanmierlo states that he parked his MV in the Marriott parking area at approx. 7:45AM on 12/9/19. When he returned to his unoccupied MV he found MV#2 making contact with the rear of his MV and his MV was now moved slightly from its original parking spot. MV#2 was unoccupied when Mr. Vanmierlo returned to his MV and we could not locate the registered owner on the Marriott property. I then spoke with the operator of MV#2 by telephone, identified as Jonathan Lang. Mr. Lang stated that he parked MV#2 in the Marriott parking area at approx. 7:45AM and was not involved in a crash with any other MV while in the parking area. Mr. Lang states that there was another MV parked and unoccupied in the parking space in front of him when he turned left into his parking spot. Marriott security states that there are no cameras video taping the exterior of the Marriott including the parking area. Interior videotape provided by the Marriott confirms that Mr. Lang entered the front lobby before Mr. Vanmierlo. Upon further investigation it was determined that an unknown person had informed Mr. Vanmierlo that a Red Acura had struck his MV while parked in the parking area. Mr. Vanmierlo also confirmed that there was new damage to the front of his MV. No other information available at this time. It would appear at this time that unknown MV#3 backed into the front of MV#1, pushing MV#1 into the front of MV#2.

Upon arrival, I observed MV1 (MA Pass:13LM32) to be at rest on the side of the road with it's front end contacting a tree, aproximaytely 150 feet south of the above address at a bend in the road. It should be noted that it had been raining for hours prior to this accident and that the road surface was wet; additionally the tree did not appear to be damaged. Upon speaking to the operator of MV1, he stated that he was traveling Southbound on Melrose St. when he navigated around a parked car in front of the above address and as he did so, may have overcorrected or due to the current road surface condition, accidently struck the tree. The front seat passenger of MV1 concurred with the operator's statement. Both parties stated they were not injured. MV1 sustained damage to its front end. As MV1 was not impeding traffic, AAA contacted and towed MV1 at the behest of the operator. I cleared without incident.

Brown stated that he was riding his scooter on the roadway south bound on Walnut St be could not recall any other details. When I asked Brown if he was wearing a helmet as required by MGL 90/1E he stated he couldn't recall. Rochwerger, Espinal and Ofc Garcia all stated to me that they did not see Brown wearing a hamlet. There was an unconfirmed post by a person named Tricia Marucci to the Facebook group Newton Parents stating that at 14:45 hours on 12/19/2019 saw Brown hitting a defect in the roadway in the area of Crafts St by California St that caused him to loses control of his scooter and fall face first onto the pavement. In her post Marucci stated that Brown was cover in blood from facial lacerations, and that he refused medical aid and continued to ride his scooter south bound towards the entrance to Walnut St. I left a message for Marucci to contact me and as of the writing of this report she has yet to do so. While at the hospital I ran Brown's name and date of birth via the MA RMV data base in order to issue him a citation for not wearing a helmet. The query of Brown via the MA RMV data base reviled that Brown's MA driver's license statutes was suspended. On 07/11/2018 admitted to a finding of sufficient facts to one count of MGL 90/24 OUI liquor. Brown received a Continued With Out Finding for 18 months. In addition Brown pleaded guilty to an additional count of MGL 90/24V Child Endangerment While OUI. Brown received a 90 day sentence in the Middlesex House of Correction which was suspended for 18 months. Brown also received a one year loss of his driver's license. Brown is on active probation out of Newton District Court until 07/21/2020. Biased upon the statements made to me I issued Brown MA Criminal Application T 2012526 for violations of MGL 90/24(2) Leaving The Scene Of An Accident Property Damage , MGL 90/1E Operation Of A Motorized Scooter Without A Valid License and MGL 90/1E Operation Of A Motorized Scooter With Out A Helmet. As of 12/20/2019 Brown was discharged from Newton Wellesley Hospital.

Narrative:
On 12/23/19, at 1919 hours, I responded to the area of 807 Washington St. for pedestrian struck by a motor vehicle. Upon arrival with Cataldo Medics and Newton Fire, I observed Catherine Chapman being treated in the westbound lane a few feet in front of a 2010 Hyundai Elantra (MA Reg. 4KH 743). The vehicle had a shattered windshield. Ms. Chapman appeared to be wearing a dark colored jacket and dark pants. The operator of the motor vehicle, Emily Shuman, stated she was traveling westbound in the outside lane when Ms. Chapman stepped in front of her car from the eastbound lane. I also spoke with a witness, Malcolm Robinson, who stated Ms. Chapman was crossing the street from the eastbound lanes with two other people. The other two people stopped in the middle of the street but Ms. Chapman kept walking and was struck. The other two people were Victor Polk and Halimah Polk, both of which confirmed the witness statement. Ms. Chapman was transported by Cataldo to Brigham & Womens Hospital with non-life threatening injuries. Todys towed the vehicle and pictures of the scene were submitted to IT.

Narrative:
Witness said between 0930 to 1430 hours this date she was out of the hotel running errands. Witness stated her husband's MV (MV1) was parked unoccupied within the lines of 2345 Commonwealth Ave (Marriott Hotel) between those hours. Witness stated when she came back at 1430 hours she observed new damage done to MV1. Witness said during that time period an unknown MV sideswiped MV1 and left the scene without giving information. Witness believes the unknown MV must have scratched their car while attempting to back up from their space. Witness said the minor damage (scratch to the rear passenger side) was not there before today. Witness does not know who may have caused the damage. No injuries reported, no tow required, and no security camera recordings. Witness was advised for the registered owner to contact their insurance.
