On 01/03/19 at 07:26 hours, I responded to a two car motor vehicle accident at Boylston Street and Ellis Street with one reported minor injury (headache). Operator of MV # 1 states she was exiting the Boylston Street (RT 9EB) off ramp at Ellis Street when she states that she came to a stop for the stop sign. She then inched out and thought it was clear to proceed straight through and struck MV # 2 on both passenger side doors. Operator also stated that she did not think traffic would be allowed to come from the left of her. She was advised that there is a sign below the stop sign that states that the oncoming traffic does not stop. Operator was issued MA Uniform Citation T1441046 for Ch. 89/9 Stop Sign Violation. MV # 1 sustained front end damage to the entire front but was still driveable and the operator reported no injuries. Operator of MV # 2 states she was operating straight through the Boylston Street overpass (SB) on to Ellis Street when she states that MV # 1 never stopped for the stop sign. MV # 1 then proceeded out and struck her vehicle on the passenger side. MV # 2 sustained moderate damage to both passenger side doors and was towed by Tody's towing. The operator complained of a headache but signed a patient refusal with Cataldo Ambulance One.

On 01/04/19 I responded outside of #54 Needham St for a two vehicle crash. Veh #1 was a delivery box van who was driving due North on Needham St. The operator of veh #1 stated he was attempting to take a left into #55 Needham St. when veh #2 came from behind him on his left and he struck veh #2 as he turned. The operator of veh # 1 was taken by Ambulance #1 to Newton-Wellesley Hospital for an evaluation after complaining of pain in his chest area. The passenger of veh #1 stated everything happened "so fast" he didn't see what transpired. Moderate damage to veh #1. The operator of veh #2 stated he was traveling due North on Needham St. and was behind veh #1 for a long stretch of the road. The operator of veh # 2 stated veh #1 put his right directional on three different times but didn't turn. He stated veh #1 had his right directional on and was in the right lane when he went to pass him. Veh #1 then turned into his rear passenger side as he passed. Moderate damage to veh # 2. The operator of veh #2 stated the operator of veh #1 was walking around and yelling about the accident for a period of time and then eventually grabbed his chest and fell to the ground complaining of pain. From the result of my investigation it appears as if veh # 1 attempted to turn from the wrong lane and veh # 2 was passing in the "suicide lane", also wrong lane. There will be no citations issued at this time as both operators were given verbal warnings.

Narrative:
On the above date/time I responded to Lexington Street / Freeman Street for a two motor vehicle crash with air bag deployment. Upon arrival on scene I checked all parties for injuries. Operator of vehicle one Ms. Farnese complained of head / neck injuries and Fire and Medics responded on scene. All parties in vehicle two did not have any injuries. I spoke with the operator of vehicle one Ms. Farnese in the ambulance she stated she was slowing traveling south on Lexington Street at the intersection of Freeman Street due to the traffic signal for Lexington Street was yellow. She stated as she was slowing she felt a heavy impact from in the rear by vehicle two. I spoke to the operator of two Ms. Heimbrock, she stated she is a pastor for the Salvation Army in New York and she was transporting two children Shamah Lapaix d.o.b. 4-18-14 and Grace Lapaix d.o.b. 1-10-11 to a Christian school in Wayland. She stated that she is staying with the children at 65 Falmouth Road Newton MA with the childrens grandmother due to the fact the parents are in New York doing a continuing education program until Friday January 18, 2019. She stated she is not familiar with the area, she was traveling south on Lexington Street approaching Freeman Street when she glanced at the map on her cell phone. She stated she did not observe the color of the traffic signal and did not observe the rear brake lights in vehicle one. All parties were evaluated in vehilce two by medics with no injury. I spoke with the childrens mother Sarah Lapaix 1-203-685-2809 who confirmed Ms. Heimbrock's statement about the care of the children. I did observe an expired inspection sticker as of 12/18 on vehicle one. Therefore due to operator of vehicle two's statement I checked the rear brake lights. When the brake pedal was pressed the left brake light and top(3rd) brake light was operational but the right rear brake light was not operational. Tody's towing arrived on scene and towed both vehicles top their lot. Ms. Heimbrock made arrangements for transport of herself and the children. Ms. Farnese was transported to Newton Wellesley Hospital for non life threatening injuries. I advised all parties of the process and gave them each others information. I checked the traffic signals in the intersection and they were fully functional. Therefore with all the above mentioned I am issuing citations to both parties Operator of vehicle one citation # T1440538 for Chapter 90 Section 20 EXPIRED INSPECTION STICKER $ 55.00 Operator of vehicle two citation # T1440539 for City Ordinance 19-75 FAILURE TO USE CARE IN STOPPING $ 20.00 Both citations were filled out after investigation and will be mailed to their license address.

On 1/14/2019 at approx 1406Hrs while assigned to 497 I responded to the area of 2150 Washington St for a report of a 2 car collision. Upon arrival I met with the operators of Ma Reg 5NG581 Jeff LONDON and Ma Reg RT35K2 Lori GANS. LONDON was signing a refusal with Cataldo Ambulance and stated he had already exchanged all his information with the other operator. I spoke with GANS who stated LONDON stopped suddenly for a turkey that walked into the roadway, GANS was able to brake but lightly tapped LONDON.

On 01/22/19 I responded to a three vehicle crash on Needham St. in front on #241- Marshalls Plaza. The operator of veh #1 stated she was driving due West on Needham St. when she looked right at a car waiting to pull out of the parking lot. When she looked back to Needham St., the traffic was stopped and she hit her brakes and snow slid covered her windshield. Operator of veh #1 never saw the impact, but veh #1 struck stopped veh #2 which was pushed into stopped veh #3. Moderate damage to veh #1 and 2 but no damage at all to veh #3. Operator of veh #2 said she was going "2-3 MPH " when she was pushed into veh #3. Operator of veh #3 claimed she was dizzy from the accident and signed a patient refusal from Ambulance #1. Engine #7 was also on scene assisting. Operator of veh #1 was cited in hand Mass citation #T1441211 for Ch 90/ Sec 13- failure to remove snow from vehicle . All vehicles were driven away from the scene.

MV1 stated he was "driving to fast around the corner and hit the pole." MV1 actually hit a curb, took down a street light, went up on the island hitting another street light prior to hitting the curb. The second light he struck fell on MV2. MV1 sustained heavy front end damage and was removed from the scene by Tody's Towing. MV2 stated that MV1 "came flying across the intersection, crashed into 2 poles, one of which hit my car and he crashed over there." I then observed minor damage to MV2, however it did not require a tow. Both parties signed patient refusals with Cataldo Ambulance. Operator of MV1 was arrested and charged with the following: M.G.L. 90/24/J OUI Liquor M.G.L. 90//24/E Negligent Operation M.G.L. 89/4A Marked Lanes Photos of the scene were captured and turned over to the IT Bureau. Daigle Electric notified of the damaged lights.

Narrative:
At approximately 0110HRs on Sunday February 17, 2019, I was dispatched to the area of Dedham St. and Spiers Rd. (both public ways in the City of Newton), for a report of a motor vehicle vs pole accident with injury, airbag deployment and entrapment. Upon arrival, I exited my cruiser with my medical bag and AED and went to assist the motorist involved in the crash. MV1 (MA Passenger: 255ZA9) was completely off the roadway and on the shoulder of the road (facing Eastbound) with its nose contacting the light pole ( Verizon Pole #:103/80), which was now broken and listing to the side. Attempts to open the doors were unsuccessful and I attempted to communicate with the operator through a partially broken driver's window frame which was bent. The operator was slumped forward with his hand cradling his head and he was unable to speak, but was breathing. Newton Fire arrived and attempted to gain access to the vehicle via several manual tools with no success and instead deployed the Jaws of Life which was successful. Newton Fire also made entry into the rear passenger compartment because we viewed a child's car seat and checked with negative results for any child in the vehicle. Once the operator was cut out of his seatbelt and safely out of MV1 and on board Newton Medic 1, I entered the ambulance where he was identified as Mark Topham. It should be noted that Topham was having difficulty answering basic questions such as his name, date of birth, today's date, Etc. At one point when he was asked what today's date was, he gave his birth date of February 21, 1983 and it took him several attempts to say his last name, I had to run him over the air with a partial name to ascertain who he is. Also of note, in my presence and that of Sgt. Devine, Topham informed the medics that he had been consuming alcoholic beverages prior to the crash. Upon viewing the scene, I noted that the roadway was lit and I did not observe any skid marks on the dry, ice-free payment, indicating that there was unlikely any braking or swerving to avoid the collision. I spoke to the reporting party, Lindsay Giardina, she stated that she was traveling on Dedham St. when she heard what she believed to be a motor vehicle crash. When she came upon said crash, she attempted to assist the operator, as she was an off duty firefighter. She was unable to gain access to the inside of the vehicle, but communicated to the operator in the same manor as I did. She stated that she was able to smell the odor of an alcoholic beverage emanating from the operator. Topham was transported to Beth Israel of Boston, where he was assigned patient record number 3109921. I attempted to speak with him at the hospital, but was unable to do so because of his current state; I noted several injuries on Topham, such as a bloody lip, a wound to his lower left side and a wound to his left leg. Due to Topham's statements onboard of Medic 1 and Lindsay Giardina's observations, I will be charging Topham with one count of violating MGL Ch.90 S. 24 K OUI Liquor 2nd Offence, one count of violating MGL Ch.90 S. 24 E Negligent Operation of a Motor Vehicle and one count of violating MGL Ch. 89 S. 4A Marked Lanes Violation via MA Criminal Citations which I placed in the mail. Additionally, I will be seeking a subpoena for Topham's blood work from the hospital. Note: The crash occurred on the Newton/Boston line, Newton dispatch's GPS indicated that the crash was in Newton. I took several pictures of the scene and have forwarded them to IT to be attached to this report. I completed and filled an NPD Motor Vehicle Tow Inventory Form and Officer Boudrot stood by for the tow.

The operator of MV1 (ma con T98504) was traveling WB on Washington Street attempting to take a left into 300 Washington Street when his MV was rear ended. Operator of MV stated he was letting a vehicle exit from 300 Washington Street and had come to a complete stop when his vehicle was struck from behind. The operator of MV2 (ma con T12376) stated he was traveling WB on Washington Street and was unable to come to a complete stop before striking the rear of MV1. Air bags were deployed in MV2. The operator of MV2 stated he felt fine. Ambulance two and Ladder 3 were dispatched to the scene to evaluate the operator. Operator of MV2 signed a refusal. The other parties involved were uninjured. Tody's was also called on scene to tow MV2 as it sustained heavy front end damage and was not drive able. MV1 sustained minor damage to rear door and bumper but was able to operator without any issues.

On 3/4/19 I responded to the area of Hammond St and Chestnut Hill Rd for a report of a two car MVA. Upon arrival it was determined there were no injuries and the two drivers signed patient refusals with the ambulance. I first spoke with the operator of MV#1 who stated he was driving northbound on Hammond St near the Chestnut Hill T station where it bends and MV#2 was coming southbound and skidded on the snow and came into his lane. I then spoke with the operator of MV#2 who stated he was driving southbound on Hammond St when his vehicle lost control around the turn and drifted into the opposite lane and struck MV#1. I issued the operator of MV#2 MA Citation T1268628 for Chapter 89/4A; Marked Lanes Violation. At the time of this accident there were heavy snow conditions. Tody's Towing responded and towed both vehicles from the scene.

On 03/07/19 at 08:29 hours, I responded to a two car motor vehicle accident at Needham & Oak Streets. The operator of M/V # 1 states she blacked out upon impact of the accident. She was immediately transported to Newton Wellesley Hospital by Cataldo Ambulance for a possible head injury. After at the hospital, Operator of M/V # 1 states she was traveling straight ahead (WB) on Needham Street at Oak Street with the green light signal in front of her. As she approached the intersection, M/V # 2 suddenly attempted a left turn from the opposite side of the road and she was not able to stop in time. M/V # 1 sustained passenger front end damage and the vehicle was towed by Tody's as the operator was transported to the hospital. Operator of M/V # 2 states she was in the left turn lane on Needham Street facing eastbound attempting to take a left turn on to Oak Street. She states that she thought it was clear to proceed and M/V # 1 came out of no where and struck her on her rear passenger side. At first, the operator told me the signal light was green and then after stated that the light was changing to red when she was proceeding through. The vehicle sustained rear passenger side rear wheel and axel damage and it was towed by Tody's. Based on both operator statements, it appears that the operator of M/V # 2 did not yield the right of way and attempted to turn left when it was not clear to proceed. The operator was issued and mailed MA Uniform Citation # T1441703 for Ch. 89/8.

Page Davis states that she pulled over to the side of the road on Lowell Ave for an oncoming ambulance. Davis states that she looked in her mirror to enter the traffic lane. Davis saw vehicle #1 a distance back. Davis then went to enter the traffic lane and she was struck in the left rear by vehicle #1. Hanbo Lin was operating vehicle #1. Lin states that he saw vehicle #2 attempt to merge into traffic. Lin went to step on the brake and his vehicle slid into Davis due to the weather/road conditions. No injuries.

On 3/10/2019(cid:31) at approx 1118hrs while assigned to 497 I responded to the intersection of Chestnut St and Amherst Rd for a report of a two car crash. upon arrival both vehicles were up on the curb at the northeast corner of Chestnut St and Amherst Rd. I spoke with the operator of Ma Reg 4BC783, UNSITAHARUTAI,Saifoun who stated she was travelling EB on Chestnut St when the operator of Ma Reg 5ES474, CANJURA, Iris cut across in front of her causing collision. Saifoun stated her father UNSITAHARUTAI, Somchai was in the front passenger seat and now complaining of neck pain. Saifouns mother , UNSITAHARTAI, Saipan was in the rear passenger seat and had no injuries. Please note Saipans only DOB is the year 1952, I added January 1St for report validation purposes.I spoke with Iris who stated she was crossing Chestnut St from Tamworth St to Amherst Rd when she saw Saifoun "going really fast". Iris and Samchai were transported to NWH by Cataldo Ambulance. Todys towed both MVs.

MV1 had just picked up a student at 56 Crescent Ave(at the intersection of Throwbridge). He made the pick up just west of the stop sign. He turned off his illuminated bus stop sign, paused and then began to pull into traffic. MV2 was stopped at the stop sign on Trowbridge st at Crescent St waiting for the bus to turn off the stop sign. When the bus turned it off, it appeared to him that the bus was not pulling into traffic. MV2 began to turn left "very slowly". As he was driving next to the van, the van pulled into traffic and the 2 MVs touched mirrors. There was no damage to either MV. A BLS ambulance was called to the scene because there were three students on board. All parents showed up and signed refusals for their children. Pictures were taken of the two mirrors that had no damage. The following parents showed up on scene to sign refusals for their children: Gareth Gorman for Sophia 617-515-1576 Lori for Harry Melchionno 617-527-7751 Malagros Falu for Nathalie Cedno The students belong to the Oak Hill Middle school and they were notified.

Narrative:
On Friday March 15th 2019 at approximately 0730 hours I responded to the intersection of Beacon Street and Herrick Road for a report of a hit and run involving a bicyclist. The weather at the time of the accident was cloudy and the road conditions were dry. Both streets are public ways in the City of Newton. Upon arrival I observed the victim identified as Glenn Butcher (MA OLN S36552335), inside the ambulance getting medical attention. Butcher was getting a bandage applied to his left leg and complained of leg, back and neck pain. Butcher appeared visibly shaken and in pain. Butcher stated he had the green traffic light and was travelling eastbound on Beacon Street crossing Centre Street and then continuing straight crossing Herrick Road. Butcher stated MV1 was travelling westbound on Beacon Street and took a left turn onto Herrick Road and collided into his bicycle. Butcher states upon impact he flipped over his bicycle and landed on the hood of MV1, before rolling off and landing on the ground. Butcher states he was wearing his helmet which was present. Butcher states his bicycle ended up partially under MV1. Butcher states the operator of MV1 pulled his vehicle to the side of the road and got out of his vehicle and spoke to several witnesses briefly. Butcher states the operator then left the scene without properly exchanging information and did not wait for the police to arrive. Butcher described the vehicle as a dark gray Honda, and described the operator as an older white male, 5'10 approximately 80 years old with white hair. Butcher was also able to provide an email address for another bicyclist who witnessed the accident. The witness left his information with Butcher prior to my arrival. Fire fighters on scene were able to get the registration number of the vehicle from the witness (MA REG 4CX148) and gave it to Officers on scene. Butcher was transported by Medic 1 to NWH with minor injuries. His bicycle had visible damage to the frame area and skid marks were present on both tires. 19 photographs of the scene and the bicycle were taken and sent to the IT dept. email. Officer Gabriel transported the bicycle to the station where it was logged into Property & Evidence for safekeeping. Dispatch was able to query the registration which came back to a gray, 2010 Honda Accord registered to a Matthew Sugarman (MA OLN S38601397), out of W. Roxbury. Dispatch contacted the Boston Police Dept. and had them send an Officer to the address to try to make contact with Sugarman. Sugarman was advised to contact the Newton Police Dept. and I was able to speak with him on the telephone. Sugarman states he was driving the vehicle today and was involved in an accident with a bicycle. Sugarman states he was travelling westbound on Beacon Street and was taking a left onto Centre Street not Herrick Road. While speaking with Sugarman he seemed confused as to his location during the accident and was adamant that he was turning left onto Centre Street and not Herrick Road. I advised Sugarman that I was on scene with the first responding Officers and the accident clearly occurred at the intersection of Beacon Street and Herrick Road based upon the final resting place of the bicycle. Sugarman went on to state that his vehicle was already turning when the bicycle struck his vehicle and he believed it was the bicyclists fault. I advised Sugarman it appears the bicyclist had the right of way since it was traveling straight and that because his vehicle was taking a left turn, he failed to yield for on coming traffic at an intersection. When asked why he did not stay at the scene of the accident Sugarman stated he got out of his vehicle and spoke to the bicyclist and he "seemed okay". Sugarman states he then left the scene while the victim was still sitting on the ground. I asked Sugarman if he had ever been involved in accident before and he replied "no." I advised Sugarman that I am currently looking at his drivers history and see nine accidents that he was involved in. Sugarman stated "he has never been in accident like this before." I then asked Sugarman what the law states when you are involved in an accident and he was not able to provide me with an answer. I advised him that the law states you must stop and exchange information before leaving the scene of an accident. Again he stated the bicyclist seemed okay and "he had somewhere to be so he left." Sugarman has an extensive drivers history including nine surchargeable accidents, reckless operation, two different charges of leaving the scene property damage and two immediate threat affidavits filed against him. I advised Sugarman that I will be mailing him a citation for Ch89 s8 Fail to yield to oncoming traffic, and Ch90 s24 Leaving the scene of personal injury. I also filed an immediate threat form with the registry. I emailed the witness using the information he provided to the Newton Fire Dept that was on scene and received a phone call back from the witness identified as Bruce Adams. See witness report for his statements. I contacted the Bank of America located at 808 Beacon Street in Newton, as they are the closest business to that intersection with video surveillance. I spoke with George Walsh (781-834-8275) who stated they do not have any working cameras on that side of the building to the bank. For this report the bicyclist is entered as a non-motorist for validation purposes. Witness Bruce Adams (MA OLN S96398108) stated that he was riding his bicycle travelling behind the victim about 100 feet away. Adams states he was watching the victim and had a clear view of him as he travelled behind him, through the green traffic light heading eastbound on Beacon Street. Adams stated he witnessed MV1 travelling westbound on Beacon Street take a sharp left turn onto Herrick Road which turns into Union Street. Adams stated that the vehicle turned left colliding into the bicycle and there was no possible way the bicyclist had time to stop to avoid the collision. Adams stated the victim flew over his handle bars and fell on top of MV1's hood and then landed on the ground. Adams stated the victim's bicycle was stuck under MV1's front bumper. Adams stated the operator of MV1 backed his vehicle up with the bicycle still attached to his vehicle bumper and pulled MV1 over to the side of the road. The operator then got out of his vehicle and walked up to the victim who was laying on the ground visibly in pain. Adams stated the operator asked the victim if he was okay to which the victim did not immediatley reply as he was visibly shaken up. Adams stated the operator then walked back to his vehicle and attempted to leave the scene and that is when Adams stood infront of MV1 to stop him from leaving the scene. Adams stated he then removed the bicycle from underneath the bumper of MV1 and placed it on the side of the road. Adams stated the operator got out of his vehicle again and walked up to the victim and asked him "what do you want to do?". Adams stated the victim did not respond and that is when the operator got back into his vehicle and drove away, leaving the scene before any emergency response arrived. Adams stated he was able to memorize MV1's registration and stayed with the victim until police, fire and medics arrived. He stated he gave the fire dept the registration and his contact information prior to leaving the scene.

BURNELL cited for violation MGL90/13 distracted Operation , GUIDRY transported to NWH by Cataldo Ambulance for neck and head pain. GUIDRY and BURN ELLS vehicles towed by Todys. NFD responded and cleared roadway or debris and fluids.

The operator of MV1(ma reg 773KV5) was traveling WB on River Street through the intersection of Cherry St when her vehicle was struck by a motor vehicle traveling on Cherry St. The operator of MV1 stated she had a green light and MV2 went through a red light striking her driver's side door. The operator of MV2 (MA reg 5CG678) stated she was traveling NB on Cherry St approaching the intersection of River St when she struck MV1. Operator of MV2 admitted she ran the red light and stated she zoned out for a minute. Operator of MV2 stated she was unsure if she wanted to turn onto River or continue straight onto Cherry and she ended up driving through the red light. Operator of MV1 was complaining of possibly head injury so I called for an ambulance. ALS 28 arrived on scene to evaluate and ended up transporting Operator of MV1 to NWH. Operator of MV2 stated she was not injured and did not require medical evaluation. Both vehicles sustained heavy damage and required tow's. Tody's arrived on scene on towed both vehicles. After MV1 was struck the operator ended up crashing into the retaining wall of the West Parrish Burial Ground. There was significant damage to the fence and wall. I had dispatch call for a traffic car to respond to the accident to take pictures since the Burial Ground is City Property. Traffic Officer Gaudet responded and took pictures of the vehicles and damage to the wall. The operator of MV2 was cited for CH 89-9 Fail to stop for a red light. On Tuesday May 7th, 2019 at approximately 13:15 hours I responded to the area of 30 Langley Road for an auto vs. pedestrian accident. At the time of the accident the weather was sunny and the road conditions were dry. Langley Road is a public way maintained by the City of Newton. Upon arrival I first spoke to the pedestrian who was inside the ambulance getting medical attention. The pedestrian identified as Donna Kalikow (S24151638) stated she was standing in an open parking space for a few seconds, attempting to walk across the street to enter J.P. Licks. Donna stated she was standing in the marked parking space waiting for traffic to stop to safely cross the street. Donna states the cars stopped to let her cross and she proceeded into the roadway. She states MV1 was attempting to back into the parking space that she was standing in and struck her right side and knocked her to the ground. Donna states the operator of MV1 stopped the vehicle when he realized he had struck her and got out to contact 911. Donna appeared to have minor injuries and complained of head pain. Medics transported Donna to NWH to be further evaluated. The operator of MV1 identified as Christopher Moos (S24090966) stated he was attempting to parallel park into an empty parking space and never saw the pedestrian standing in the space. Christopher stated as he was backing up into the space he was notified by a bystander that he just struck a pedestrian. Christopher stated he immediately stopped the vehicle and got out to assist the pedestrian and contact 911. Christopher stated he was not travelling no more than 5mph at the time of the accident. MV1 did not have any damage to the vehicle and was able to leave the scene. Christopher reported no injuries. Several photographs were taken of the scene and submitted to the IT Bureau. I mailed the operator a Massachussetts Uniform Citation for a City of Newton Ordinance violation for Section 19-75 Failure to use care when backing.

UPON MY ARRIVAL, I OBSERVED A SILVER HONDA CIVIC WITH HEAVY FRONT END DAMAGE. THE VEHICLE DISPLAYED MASSACHUSETTS REGISTRATION 7ZF784. TWO PEOPLE WERE STANDING BESIDE THE VEHICLE. A MAN AND A WOMEN SAID THEY HAD BEEN IN THE CAR. THE MAN, LATER IDENTIFIED AS BENJAMIN SMALL STATED HE HAD BEEN OPERATING THE VEHICLE. THE WOMAN, LATER IDENTIFIED AS KIMBERLY OAKES, STATED SHE WAS A PASSENGER IN THE VEHICLE. I ASKED THEM IF THEY WERE OK OR NEEDED MEDICAL HELP AND THEY SAID THEY WERE NOT INJURED. THE MEDICS CHECKED OUT MR SMALL ( MEDICS ELISE GADANSKY AND ROBERT ANDERSON) WHICH INCLUDED CHECKING FOR LOW BLOOD SUGAR, DUE TO HIS INABILITY TO SPEAK CLEARLY AND LEGIBLY. HIS BLOOD SUGAR CHECKED OUT FINE. I THEN ASKED MR SMALL WHAT HAD HAPPENED. HE STATED THAT HE WAS TRAVELING WESTBOUND ON DEDHAM ST WHEN ALL OF A SUDDEN A WHITE MINI VAN CROSSED OVER THE DOUBLE YELLOW LINE AND WAS HEADING TOWARDS HIM. HE STATED THAT IN ORDER TO AVOID A HEAD ON COLLISION, HE SWERVED RIGHT, OFF THE ROAD AND STRUCK A TELEPHONE POLE (LATER DETERMINED TO BE UTILITY POLE #60 LOCATED IN FRONT OF 556 DEDHAM STREET). HE STATED THAT HE PULLED OVER ONTO MEADOWBROOK RD. BOTH DEDHAM STREET AND MEADOWBROOK RD ARE PUBLIC WAYS IN THE CITY OF NEWTON. AS I WAS TALKING TO MR SMALL HE APPEARED TO SPEAK VERY SLOWLY, HE APPEARED TO BE LETHARGIC, BUT I COULD NOT DETECT ANY ODOR OF AN ALCOHOLIC BEVERAGE ON HIS BREATH. NEXT I SPOKE TO MS OAKES WHO STATED SHE IS MR SMALL'S GIRLFRIEND. SHE STATED SHE WAS A PASSENGER IN THE FRONT SEAT OF THE CAR. SHE ALSO STATED THAT MR SMALL WAS OPERATING THE VEHICLE WHEN A VEHICLE HAD CUT THEM OFF FORCING THEM OFF THE ROAD INTO THE TELEPHONE POLE. DUE TO THE FACT THAT WE COULD NOT SMELL ANY ALCOHOLIC BEVERAGE ON HIS BREATH, CAPTAIN DOWLING REQUESTED THAT A DRUG RECOGNITION EXPERT (DRE) BE CALLED TO THE SCENE. DISPATCH NOTIFIED SURROUNDING CITIES AND TOWNS OF OUR NEED FOR A DRE. NOBODY WAS ABLE TO RESPOND. TRAFFIC OFFICER WADE RESPONDED TO THE SCENE AND PERFORMED A ROADSIDE ASSESSMENT ON MR SMALL. SEE HIS SUPPLEMENTAL REPORT. BASED ON OFFICER WADES ROADSIDE ASSESSMENT AND MY ON-SCENE OBSERVATIONS, I PLACED MR SMALL UNDER ARREST FOR OUI DRUGS, MARKED LANES, AND NEGLIGENT OPERATION OF A MV. MR SMALL WAS HANDCUFFED AND SEARCHED BY OFFICER WADE. PRIOR TO TRANSPORT, CRUISER 499 WAS SEARCHED BY OFFICER WADE FOR CONTRABAND WITH NEGATIVE RESULTS. OFFICER WADE THEN PLACED MR SMALL INTO CRUISER 499 AND SEAT BELTED HIM. WHILE OFFICER WADE DID THIS, OFFICER WILSON AND I DID AN INVENTORY OF THE VEHICLE. DURING THE INVENTORY, 9 CVS PAPER PRESCRIPTION PRINTOUTS WERE FOUND. THEY WERE ALL IN MR SMALL'S NAME FOR THE DRUG "ADDERALL" (8) OR "KLONOPIN" (1). ALSO FOUND WAS A SMALL YELLOW PLASTIC PRESCRIPTION TYPE BOTTLE CONTAINING AN UNKNOWN LIQUID. OFFICER WILSON PLACED THE BOTTLE OF UNKNOWN LIQUID INTO A BAG AND HAD IT LATER EXAMINED AT THE NPD STATION BY DET. ROBINSON OF THE DRUG UNIT (HE DETERMINED IT TO BE NOT SUSPICIOUS AND IT WAS DISPOSED OF). THE VEHICLE WAS THEN TOWED BY TODY'S TOWING. THE CVS PAPER PRESCRIPTION PRINTOUTS WERE REMOVED AND PLACED INTO PROPERTY AND EVIDENCE. TOWED MV AND PROPERTY AND EVIDENCE FORMS WERE FILLED OUT. PICTURES OF THE VEHICLE AND DAMAGED TELEPHONE POLE WERE TAKEN BY OFFICER WILSON. OFFICER WILSON TURNED THE DISC OVER TO DIRECTOR SMITH, WHO DOWNLOADED THEM. AFTER THE MV INVENTORY, I TRANSPORTED MR SMALL TO NEWTON POLICE FOR BOOKING. AT THE STATION MR SMALL WAS REMOVED FROM MY CRUISER AND THE CRUISER WAS AGAIN SEARCHED AND I FOUND NO CONTRABAND OR WEAPONS. HE WAS THEN PROCESSED BY OFFICER JASON SCHLEGEL, BOOKED BY SGT O'CONNELL, THEN PLACED INTO CELL #3. MR SMALL WAS ISSUED CITATION NUMBER T0645459, IN HAND FOR 1.) OUI DRUGS CH90 SEC24, 2.) MARKED LANES VIOLATION CH90 SEC4A, 3.) NEGLIGENT OPERATION CH90 SEC24E. AN IMMEDIATE THREAT FORM WAS FILLED OUT BY MYSELF AND A COPY OF THE REPORT ALONG WITH THE MOTOR VEHICLE CITATION WERE FAXED OVER TO THE MASSACHUSETTS REGISTRY OF MOTOR VEHICLES.

I responded to the area of Commonwealth Ave@Lexington st at approx 1610 hrs on 05/09/2019 for a report of a H&R/MVA. I arrived in the area and located Sarah Hamilton. Sarah informed me that she was on Comm. Ave (westbound) stopped attempting to turn left into the Dunkin Donuts parking lot. Sarah stated she was rear ended by a silver sedan operated by a female operator. Sarah spoke with the unidentified woman, who refused to exchange information. The woman returned to her vehicle and left the area. Sarah could not get the license plate, vehicle make /model. Sarah Hamilton complained of neck pain. EMS responded to medically evauate her. Sarah did not want to be transported to the hospital and signed a refusal/waiver with EMS. The only damage I observed to V1 was paint scratches along the rear bumper. The rear bumper was intact free of any dents/creases.

On 05/20/2018 at 17:30 hours I was notified by Captain Anastasia of a motor vehicle crash involving car, and an electric scooter. Captain Anastaisa stated that the operator of the scooter was a 12 year old male who had sustained unknown injures and had been transported to Boston Children's Hospital via ambulance. Upon my arrival at the crash scene I made the following observations, Putnam and Winthrop streets are public ways in the city of Newton that are two way single lane non divided roadways. The roadway surface was wet from rain earlier in the day. Putnam St runs north to south and Winthrop St runs east to west. There is a stop sign at the end of Winthrop St at Putnam St. I observed MA reg 54MN41 a 2005 Buick LeSabre stopped in the south bound lane of Putnam St approximately 1/2 of the way into the intersection with Winthrop St. I observed approximately three feet of skid marks from the Buick's rear tires. I also observed at the crash scene a Segway Ninebot electric scooter that was on the ground near the Buick(cid:31)s rear passenger side door with its handlebars detached. I spoke with the operator of the Buick, Robert DeSouza who stated that on 05/20/2019 at approximately 16:50 hours he was driving south bound on Putnam St at approximately 25 miles per hour. DeSouza stated that he saw a man, later identified as Jose Estabil standing on the east sidewalk of Putnam St facing Winthrop St who was yelling and waving his arms at something on Winthrop St. DeSouza stated he looked to his right towards Winthrop St and his view was obstructed by a row of hedges. DeSouza stated that as he was looking to his right he began to apply his vehicle's brakes when he saw someone coming at me ". DeSouza stated that he heard a crashing noise from the rear passenger's side of his vehicle. DeSouza stated that he stopped his vehicle after the crash and saw a boy lying on the ground at the rear passenger side of his vehicle. DeSouza stated that he was not injured in the crash. DeSouza's vehicle had minor damage to its rear passenger side door, and did not require a tow. Witness Charlotte Hart stated that at approximately 16:30 hours on 05/19/2019 she was diving south bound on Winthrop St. Hart stated that she had to stop short on Putnam St to avoid a crash " with a boy on a scooter that was racing around on Winthrop St. " Hart sated that she told the boy on the scooter that he should not be ridding the scooter in the street. Witness Jose Estabil stated that he was walking on the east side walk of Putnam St across from Winthrop St. Estabil stated that he saw a boy an electric scooter on Winthrop St approaching Putnam St. Estabil stated that he saw DeSouza's vehicle driving south bound on Putnam St approaching Winthrop St. Estabil stated that the boy on the scooter made no effort to stop, slow or avoid the crash with DeSouza's vehicle. Witness Laurel Fransworth stated that she was driving north on Putnam St approaching Winthrop St when she saw the crash occur. Farnsworth stated a boy on an electric scooter on Winthrop St crash into the rear passenger side door of DeSouza's vehicle. Fransworth stated that she believed that the row of hedges at the end of Winthrop St obstructed DeSouz's vehicle. Rowan Delaney ( 02/27/2007 ) stated that on 05/20/2019 at approximately 16:00 hours he and his fellow F.A. Day Middle School student Thiaugo Rubino ( 03/04/2007 ) were having a race around the area of Winthrop St, Putnam St and Shawn St. Delaney stated that he was on foot running on sidewalks while Rubino was on an electric Ninebot Segway scooter. Delaney stated that Rubion was not wearing a helmet or any other safety equipment. I spoke with Delaney(cid:31)s father Royston Delaney, who stated that the scooter was his and that he was unaware that Rubino was using his scooter, and that he has never seen him ridding it before. Royston Delaney stated that the scooter is battery powered and has a maximum speed of 19 MPH. Royston Delaney stated that his son told him that only Rubino was ridding the scooter. Rubino was transported via ambulance to Boston Children(cid:31)s Hospital. On 05/20/2019 Rubino underwent surgery for a brain bleed. I spoke with Rubion(cid:31)s mother Sonia Rubino who stated that as of 05/21/2019 her son was under observation and in addition to the brain surgery her son had a broken arm, broken leg and a broken back. Based upon witnessed statements and my observations of the crash area I believe that Rubion was at fault for the cause of this crash. Myself and Officer Helms took photos of the crash area and the disks were turned over to the NPD(cid:31)s IT bureau for downloading.

Tipruthai Thangthong stated that on 05/21/2019 at approximately 16:36 hours she was pulling into the driveway of her sisters home at 53 Rangeley Rd while operating her vehicle MA reg 2LVL61 a 2018 Honda Accord. Thangthong stated that her three old son Mighty Mettanant was a passenger in her vehicle. Thangthong stated that she was driving approximately 5 MPH as she drove into the driveway. The driveway runs east to west and Thangthong's vehicle was heading west into the driveway as the sun was in the Western sky creating a glare. Thangthong stated that she did no see anything in the driveway prior to her pulling into it. Thangthong stated that she felt the front of her vehicle strike what she described as " something " and stopped her vehicle. Thangthong stated that she put her vehicle in reverse and then into park and exited her vehicle to see what she had struck. Thangthong stated that she saw her two nieces, Kalla Mongkhonlertsirkul age three and Kelley Mongkhonlertsirkul age seven laying in the driveway in front of her vehicle. Thangthong stated that she then realized that her vehicle had stuck her two nieces as they were in the driveway. Both of the Mongkhonlertsirkul sisters were conscious and alert and were able to walk to an ambulance for transport to Newton Wellesley Hospital for treatment. Thangthong stated that she and her son were not injured in the crash. I observed no damage to Thangthong's vehicle. I responded to the Newton Wellesley Hospital and spoke with the Mongkhonlertsirkul sisters and their mother Piyada Kellum. Kellum stated that her oldest daughter Kelly is a student at the Franklin Elementary School . Kellum stated that her daughters told her that they were playing in their driveway when their aunt's vehicle entered the driveway and did not stop. I spoke with both of the Mongkhonlertsirkul sisters who told me that they tried to get out of the way of their aunt's vehicle but could not in time. The Mongkhonlertsirkul sisters stated that they were both struck in the back and fell to the ground between the two front tires of their aunt's vehicle. Kalla Mongkhonlertsirkul had scrapes to her right knuckles. Kelly Mongkhonlertsirkul had lacerations to her lower left arm and the left side of her face near her eye. I spoke with hospital staff who stated that there did not appear to be any broken bones or other internal injures. I took photos of the crash area and forwarded the disk to the NPD's IT bureau for downloading.

MA OLN #S43050796 operating MA Reg. 4RT219; 2003 BMW/X5 color black. V2 Operator; Whalen, Holly J. MA OLN#S25300910 operating MA Reg. 23XR36; 2008 Chev/Suburb color blue. Both vehicles were traveling westbound on Washington St. V2 slowed/stopped for a line of traffic in front of her. V1 ,as stated by the operator, was changing lanes when V2 came to a stop and collided into the rear of V2. Neither operator was injured as a result of the collision. V1 did have airbag deployment. V1 operator declined EMS. V1 required towing service. Tody's responded to provide service. V1 sustained front end damage. V2 sustained minor damage to the rear bumper/body. On 06/08/2019 at 0150 hours I received a call from Sgt Lee in regard to a head on motor vehicle crash with entrapment that had occurred on Center St at the four way intersection with Cabot St and Sergeant St. Upon my arrival at the crash scene I was advised by Sgt Lee that all occupants of the involved vehicles had been transported to hospitals for treatment. I made the following observations of the crash scene , Center St is a two lane public way in the city of Newton that runs north to south. I observed a city of Newton contracted Cataldo ambulance stopped in the south bound lane of Center St at Cabot St. The ambulance was MA AMN registration AMB 370 a 2017 Ford Econo Line that had heavy damage to the front end and driver's side fender. I observed that the front tire of the ambulance was snapped off and was pushed back towards the driver's side door. I further observed that both of the front and side air bags of the ambulance were deployed. The front of the ambulance's final point of rest was 8'8" from a fixed overhead light pole on the northeast corner of Center St at Cabot St. The ambulance's front passenger side tire was 4'3" front the curb on the Cabot St side. The ambulance's rear passenger side tire was 2'3" from the Cabot St side curb. The ambulance's rear driver side tire was 5'1" from the double yellow line on Center St. The ambulance's front driver side tire was 6'3"from the Center St double yellow line. The width of Center St from the double yellow line to the Center St curb is 15'' and 16'" to the Sergeant St side. I observed a 2011 Mazda 3 with MA PAN registration 6KJ783 facing south bound in the north bound lane. The Mazda had heavy damage to it's front end, and I observed that it's front tires had snapped off. The Mazda's roof had been removed by Newton Fire to extract the occupant. The front of the Mazda's final point of rest was 40'3" from a fixed overhead light pole on the northeast corner of Center St and Sergeant St. The Mazda's front passenger tire was 4'6" from the double yellow line on Center St. The Mazda's rear passenger side tire was 7'6" from the Center St double yellow line. The Mazda's rear passenger side tire was 1'2" from the Center St double yellow line. The Mazda's front driver's side tire was on the curb on the Sergeant St side of Center St. There were no skid marks from the Mazda which indicates that no braking occurred. At the time of the crash, the Cataldo Ambulance was being operated by Paramedic Corey Bohan and Paramedic Tom White was in the front passenger seat. Bohan stated that he was operating his vehicle southbound on Center St towards Cabot St after clearing a medical call. There were no patients in the ambulance at the time of the crash, and Bohan estimated he was travelling 25 MPH . Bohan stated within less than two seconds he observed a vehicle traveling towards him northbound on Center St in the southbound lane and estimated it's speed to be approximately 80 to 100 MPH.Bohan stated he was able to slow to a near stop and had moved his vehicle towards the right shoulder on Center St before the Mazda struck his vehicle head on. Bohan stated that after forcing his way out of the driver's seat of his vehicle, he rendered medical aid to the operator and only occupant of the Mazda, Jessica Pondish. Bohan stated that Pondish speech was slurred and he detected an odor of an alcoholic beverage emanating from her breath and person. Bohan was later transported to Newton Wellesley Hospital for evaluation. The passenger in the ambulance, Tom White stated to officers that he was working on the ambulance's laptop computer and did not see anything leading up to the impact from the crash. White stated that he was able to force himself free of the passenger side of the ambulance, and rendered medical aid to Pondish. White stated that Pondish was " in and out of it " and did not appear coherent.White stated that he asked Pondish if she had consumed any alcoholic beverage and she nodded in the affirmative. White Stated that he was unsure if Pondish understood his questions. White stated that he did not detect any odor of an alcohol beverage emanating from Pondish's breath or person. White was transported to Newton Wellesley Hospital for evaluation. Pondish was freed from her vehicle after approximately 22 minutes by Newton Fire Department units by utilizing special extraction tools. Pondish was transported by Newton Medic Unit Two to the Brigham and Women's Hospital in Boston for treatment. From 06/08/2019 to 06/10/2019 Pondish had two surgeries and was unable to speak due to her condition. On 06/10/2019 myself and Officer Gaudet were able to speak with Pondish in her hospital ICU room at the Brigham and Women's Hospital. Pondish's parents Lorena and John Pondish were present while we spoke with her. Officer Gaudet asked Pondish about the events that led up to the crash. Pondish stated that on 06/07/2019 she was at a friend's residence in Norton, MA. Pondish stated that while at her friend's residence she consumed a bottle and a half of Riesling wine. After Pondish's admission myself and Officer Gaudet stopped our conversation with her. I read Pondish her rights directly from a Miranda card and explained them in full before allowing her to continue speaking with myself and Officer Gaudet about the events of that led to the crash. Pondish stated that she understood her rights. Officer Gaudet asked Pondish if she had consumed any alcoholic beverages prior to driving home to her residence in Newton. Pondish stated that she drank a bottle and a half of Riesling wine by herself between the hours of 1700 and 0000 hours on 06/08/2019. Officer Gaudet asked Pondish how large the bottles of wine was that she drank, and she stated that they were average size. Officer Gaudet asked Pondish how she perceived her state of being was after consuming a bottle and a half of wine. Pondish stated that she felt " buzzed " . Pondish stated that she left her friend's residence in Norton at approximately 0100 hours on 06/08/2019 to return to her residence in Newton. Pondish stated that she does recall the events leading up to the crash, except that she tried to make a phone call but the person did not pick up. Pondish stated that her seat belt was on and that she was not texting while operating her vehicle. Pondish stated that her injuries consisted of a broken left elbow and internal injures to her intestines. On 06/09/2019 I spoke to Cataldo Paramedic Robert Canning and Stephen Heirholcer who were the medic unit that transported Pondish to the Brigham and Women's Hospital. Canning stated that he rendered medical aid to Pondish for approximately 20 minutes while Fire units worked to free her. Canning stated that Pondish's legs were pinned under her vehicle's dashboard. Canning stated that during the approximately 20 minutes that he was in close proximity to Pondish he could detect a strong odor of an alcoholic beverage that was emanating from her breath and person. Canning stated that once Pondish was freed he continued to treat and monitor her during the transport to the Brigham and Women's Hospital. Canning stated that when he asked Pondish if she had consumed any alcoholic beverage she stated that she had. Paramedic Heirholcer stated that he did not detect any odor of an alcoholic beverage emanating from Pondish's breath or person. Based upon the physical evidence at the crash scene, and statements made to officers by all of the above mentioned persons, Pondish is being charged with violation of MGLs 90/24j OUI liquor, 90/24e negligent operation of a motor vehicle, 89/4a failure to stay within marks lanes, and 90/17 speeding. On 06/12/2019 at the conclusion of the crash investigation I issued MA Criminal Application T 1269996 in hand to Pondish at her hospital room and explained to her what action she needed to take with court. On 06/11/2019 a letter of preservation was sent to Brigham and Women's Hospital requesting that a sample of Pondish's blood, urine and medical records be saved. On 06/12/2019 Brigham and Women's Hospital confirmed that a sample of Pondish's blood had been preserved. As of 06/12/2019 a search warrant for Pondish's blood sample was pending. Photos of the involved vehicles and of the crash scene were taken and downloaded by the NPD's IT Bureau. Both involved vehicles were towed from the crash scene and towed motor vehicle forms were filled out. An Iphone and backpack belonging to Pondish were taken from her vehicle for safekeeping and returned to her on 06/11/2019. A copy of this report was faxed to the MA RMV Driver Control Unit to request an immediate threat suspension.

Operator of vehicle one, Benjamin Beaver stated that while driving south bound near 321 Walnut St his vehicle ( MA reg 551DK8 2014 Lexus ) made contact with a pedestrian in a marked crosswalk. Walnut St is a public way in the city of Newton. Beaver stated that he did not see the pedestrian prior to the crash and that his vehicle was travailing approximately 5 to 10 MPH. Beaver stated that the pedestrian was knocked to the ground but got up and walked around. The pedestrian, NNHS student Benjamin Donovan stated that he was crossing east to west in the marked crosswalk in front of 321 Walnut St. Donovan stated that he saw Beaver's vehicle approaching him at approximately 5 to 10 MPH. Believing that Beaver was stopping to let him cross , Donovan stated that he held up his left hand to signal to Beaver that he was going to cross. Donovan stated that Beaver's vehicle struck him on his left side and knocked him to the ground. Donovan stated that he had minor scrapes on his right side as a result of falling to the ground. Donovan stated that he did not lose consciousness and was transported via EMS to Newton Wellesley Hospital for treatment. I took photos of Beaver's vehicle and forward the disk to NPD IT Bureau. I issued Beaver MA Citation T 1269995 and cited him for a violation of MGL Ch 89 C 11, failure to yield to a pedestrian in a crosswalk. On 06/12/2019 I was forwarded an E-mail from Capt Anastasia of a video of the crash that was taken from a camera that was mounted on the roof of 321 Walnut St. The video shows Donovan walking into the marked crosswalk from the east side of Walnut St and hold up his left had to Beaver's on oncoming vehicle. Beaver vehicle appears to be travailing faster than the 5 to 10 MPH that Beaver believed that he was travailing. The video shows that Beaver did not brake until Donovan was struck and landed on his vehicles hood. Donovan was thrown approximately 10 feet from Beaver's vehicle and landed on his right side on the roadway. The video shows Beaver stopping and pulling to the side of the roadway after the crash.

On 06/30/2019 at 15:30 hours I was notified by Sgt Lee that a crash involving a motor vehicle and a bicyclist had occurred on Wiswall Rd at M Roadway. Upon my arrival at the crash scene I made the following observations, Wiswall Rd is a two lane non divided public way in the city of Newton that runs north to south from a dead end to Dedham St. The posted speed limit on Wiswall Rd is 25 MPH. M Roadway is a two lane non divided public way that runs west to east from Wiswall Rd to a dead end cul-de-sac. The weather conditions at the at of the crash were cloudy, and the roadway surface was wet from rain. I observed MA commercial registration M82794 a gray 2014 Honda Accord stopped in the north bound lane of Wiswall Rd at M Roadway. The Honda is registered to Newton Driving School. I observed two smudge marks approximately four inches in length on the center portion of the front and rear passenger side doors of the Honda. I also observed a 20 inch Kent bike that had be moved from it's final point of rest prior to my arrival. The bike had damage to it's front handle bars, front tire and it's two front forks. The bike's front tire had gray scuff marks on it. At the crash scene I spoke with the operator of the Honda, David Dombrovsky. Dombrovsky stated that he was driving north bound on Wiswall Rd near M Roadway approximately 20 to 25 MPH. Dombrovsky stated that he has had his learner's permit for six months and is a student at the Newton Driving School. Dombrovsky stated that he did not see the bicyclist but heard the impact of the bicyclist stricking the passenger side of the Honda. At the crash scene I spoke with driving school instructor, Igor Drizik. Drizik stated that the Honda was driving north on Wiswall Rd near M Roadway at approximately 20 to 25 MPH . Drizik stated that he did not see the bicyclist until approximately 1 to 2 seconds before impact on the driver's side of the Honda. Drizik stated the Honda is equipped with dual brakes and that he applied the brakes at the same time as Dombrovsky. Drizik stated that he and Dombrovsky got out of the Honda to render aid to the bicyclist. There were three other driving school students in the rear of the Honda at the time of the crash, neither of them stated that they witnessed the crash. None of the occupants of the Honda stated that they were injured and the vehicle did not require a tow. The bicyclist was identified as David Kerwin-Derrick. Kerwin-Derrick was transported via EMS to Boston Children's Hospital form treatment. At the hospital I spoke with one of Kerwin-Derrick's mother's, Patricia Kerwin-Derrick, who stated " We all know that David rode his bike into the car " and that her son had a broken left leg. Kerwin-Derrick is a student at the Memorial Spaulding School. Based upon my observations of the crash scene and statements made to me , I believe that Kerwin-Derrick's unintentionally rode his bike into the passenger side of the Honda. Photos were taken of the Honda, bike and crash scene and the disk was down loaded by the NPD's IT Bureau.

OPMV#1 Was traveling Southbound on Chestnut St when she saw an object in the middle of the road and swerved into the Northbound lane of Chestnut St. OPMV#1 Drove up over the curb and onto the sidewalk colliding with a stone wall at 542 Chestnut St and a Utility pole. The vehicle then traveled Southbound on the sidewalk and stopped at the intersection of Chestnut St and Roslyn Rd. I observed major damage to front of the vehicle along with left and right side damage. Airbags were deployed on all sides. OPMV#1 Was evaluated by EMS and she signed a medical refusal. Vehicle was towed by Tody's Towing. OPMV#1 is charged with the following: M.G.L. C.89 S.4A Marked Lanes, M.G.L. C.90 S.24 Negligent Operation, M.G.L. C.90 S.24 OUI Alcohol. On 07/16/19 at approximately 09:38 I responded to a two vehicle crash on Needham St. outside of #141. The Operator of Veh #1 stated she was turning left on Needham St when the South bound traffic stopped to left her turn. As she turned, Veh#2 drove South down the multi-turn lane and they collided nearly head on. Heavy damage and air bag deployment to Veh #1. The operator was checked out by Medics and signed a patient refusal. The Operator of Veh #2 stated she was driving down the multi-turn lane South on Needham St.. She was preparing to take a left onto Jaconnet St when Veh #1 pulled out of parking lot and collided with her vehicle. I observed moderate to heavy damage to Veh #2 and noted that the vehicle didn't have its directional on. The operator of Veh #2 complained to left leg pain and was transported to Newton-Wellesley Hospital By Ambulance #1. Both vehicles were towed by Tody's Towing. At the conclusion of my investigation it appears as if both vehicles were at fault during this crash; Veh#1 for not yielding to right of way and Veh #2 for traveling too soon in a turn lane, no directional and driving too fast for the heavy traffic conditions. Both operators were given verbal warnings and there will be no citations issued at this time.

Operator of MV1(Ma reg 866MF0) stated he was traveling EB on Washington St when his vehicle was struck in the rear. Operator of MV1 stated he was stopped at the red light at the intersection of Jackson Rd. Operator of MV2(AMB1406) stated he was traveling EB on Washington St when he struck the rear of MV1. Operator of MV2 stated he observed a vehicle coming down from Lewis Terrace and was concerned they were not gonna stop at the intersection. This distraction caused MV2 to strike MV1 at a slow rate of speed. Both vehicles sustained minor damage and did not require a tow. The passenger and driver of MV1 were observed by the medics. The passenger was transported in the ambulance for undisclosed minor injury. The driver refused to sign the medical release. 5 Photos were taken of both vehicles showing the damage. I put the memory card in an envelope and left it for the I.T. Bureau.

On 07/29/19 at 11:13 hours, I responded to the Dunkin Donuts parking lot located at 138 Needham Street for a three car motor vehicle accident. Operator of MV1 stated at first she could not recall what occurred during the accident due to lightheadedness at the time. After, she then stated after pulling in to the Dunkin Donuts lot she was attempting to back in to a parking spot in the back of the lot. While backing up, she attempted to hit the brake pedal but must have pushed the gas pedal instead. The vehicle then struck parked/unoccupied MV2 and MV2 was then pushed in to parked/unoccupied MV3. The operator was checked out by Cataldo Ambulance and signed a patient refusal. MV1 sustained moderate driver's side rear bumper area damage but it was still driveable. MV2 sustained damage along both sides of the vehicle and a rear broken axle and it was towed by Tody's. MV3 sustained scrapes and dents to the entire driver's side but the vehicle was driveable.

MV#2 was traveling south on Waverly Avenue when it was struck from Franklin Street by MV#1. -Operator of MV#1 stated she was traveling east on Franklin Street and that she stopped at the intersection. She stated as she was about to enter Waverly Avenue from Franklin Street and after checking to ensure she was clear to enter, she collided into MV#2. She stated he was flying up the road. -Operator of MV#2 stated he was traveling south on Waverly Ave when he was struck by MV#1. Operator of MV#2 stated the collision spun his vehicle 180 degrees. He stated he was facing the direction he was just comming from. He stated he didn't think she (Operator of MV#1) stopped. - I observed the front of MV#1 sustained heavy damage. The hood was bent in, the bumper was cracked and hanging, and fluids were leaking from the vehicle's engine. I next observed the damage to the doors on the right side of MV#2. I observed the base of the doors were pressed in, those doors would not open and the tires were grinding against the flared edges of the wheelwells. - There were no injuries reported at the scene, however, both operators were checked by Ambulance 1. Newton Fire responded to scene to contain the Hazmat spill from MV#1. MV#1 was towed from the scene. OpMV#1 was cited (T2015541) for Failure to come to a Complete stop at stop sign. I transported Operator of MV#1 to Tody's towing from the scene.

Narrative:
At approximately 1825HRs on August 06, 2019, I was dispatched to 785 Centre St. (Newton Country Day School) in reference to a motor vehicle vs bicycle crash. Upon arrival, I located both parties on the sidewalk adjacent to the intersection of Centre St. and Colby Rd. The operator of the bicycle was complaining of feeling dizzy, although she stated she did not hit her head, and suffered several abrasions on her left leg and hands; the operator of MV1 stated she was uninjured. The operator of MV1 stated that as she was traveling northbound on Centre St., she attempted to give the operator of the bicycle room, but the bicyclist made an abrupt left hand turn and struck MV1. The operator of the bicycle stated she was traveling northbound on Centre St. in the Bicycle Lane. She then signaled a left hand turn and entered the Motor Vehicle Travel Lane to make a second left hand turn to travel eastbound on Colby Rd. Once she exited the northbound Motor Vehicle Travel Lane on Centre St. and began to cross over the southbound lane, MV 1 crossed over the solid yellow lines onto the southbound side of Centre St. and struck her bicycle. MV1 sustained damage to its right front bumper and I noted red paint transfer of the left side of the front bumper, which the operator of MV1 states was old damage. MV1 also sustained a flat left front tire after contacting the curb. The bicycle sustained damage to both tires and where the rear tire attaches to the frame appeared to be warped. I took several photos of the damage and have submitted them to be attached to this report. The operator of the bicycle was transported to the hospital by Newton Medics and the operator of MV1 signed a patient refusal. Todys Services arrived and took custody of MV1, for which I completed and filled an NPD Towed Motor Vehicle Form. All streets mentioned are public ways in the City of Newton. Due to the potential danger of serious bodily injury caused by the operator of MV1's reckless driving behavior (crossing the solid yellow road divider line and driving on the wrong side of the road against traffic), the actual damage caused (striking and causing the bicycle operator to be transported to the hospital and damage to the bicycle) and that the bicycle operator was clearly visible/in clear contrast with the road (riding a red bicycle and wearing a red shirt) I issued the operator of MV1 MA Criminal citation T1445010, in hand, for violating one count of MGL Ch.90 S. 24 (Operating To Endanger) I cleared without incident. Note: I logged the bicycle into property/evidence for safekeeping, as it could not be taken on the ambulance.

MV1 jumped a curb and collided with a parked vehicle MV2 (a 2004 GMC Yukon, MA Reg: 8EC792) in front of 185 Waltham St. MV1 operator, Angel Gonzales, was unconscious on scene in the driveway of 185 Waltham St. Waltham St is a public way that is owned and maintained by the City of Newton. A passerby, Joseph Anderson saw the aftermath of the crash and called 911. MV2 had damage to its drivers side door and rear side. MV1 was heavily damaged, on its side, and keys were in the ignition. MV1 was towed by towed by Tody's. Gonzales was transported to Beth Isreal in critical condition. When Gonazales was in the back of the ambulance, myself and medics smelled an odor of an alcoholic beverage emanating from Gonzales. All first responders thoroughly checked the surrounding area for a helmet but one could not be located. Due to Gonzales' critical condition and urgency to get to the hospital, and ID was not thoroughly looked for on his person. Ofc. Guarino, N491, retrieved an ID from Gonzales upon arrival at Beth Isreal Hospital. Ofc. Stake filled out a towed inventory form. Pictures taken and sent to IT. Sgt. Lee was notified and will be following up with this incident. MV1 operator, Angel Gonzales is being charged with the following (MA Uniform Citations T1442823 & T1442824): 90/24J - OUI Liquor (public way) 90/24E - Negligent Operation of a MV (operating recklessly at a high rate of speed) 89/4A - Marked Lanes 90/23 - Attaching Registration Plates (attaching registration plates to motorcycle to conceal the fact that it was unregistered. Registration plate on the motorcycle came back to a 2002 Honda VT750 motorcycle, MA Reg: 1T3988; VIN on the motorcycle came back to a 2005 Suzuki GSXR60, MA Reg: 1L4389) 90/9B - Unregistered MV (motorcycle 2005 Suzuki MA Reg: 1T3988 was confirmed unregistered by RMV) 90/23D - Operating MV with a Suspended License (RMV confirmed that Gonzales' license was suspended S94722414) (see Incident #19039806 for more details). For QED purposes, the charge 266/139 - Stolen Registration was added to this report because 90/23 - Attaching Registration Plates was not an option. Due to Gonzales' hospitalization, the citations will be mailed to his last known address. Officers were able to rise a Harold Curtis, the father of Anthony Curtis (owner of MV2, the GMC Yukon) at 185 Waltham St. He was notified of the incident and advised to call their insurance company. Curtis mentioned that he has cameras facing the street where the incident took place and will see if he can retrieve the footage for us. Police prosecutor to subpoena blood.

On 09/04/19 at 08:22 hours, I responded to 1052 Chestnut Street for a three car motor vehicle accident with minor injuries. All four parties involved were shaken up as a result of the accident but signed patient refusals with Cataldo Ambulance One. Operator of MV1 states she was traveling straight ahead (SB) by 1052 Chestnut Street when she observed several vehicles ahead start to proceed through the light. She then heard her phone ring and went to retrieve it by looking down for a second. When looking back up, the traffic directly in front of her did not move yet and she could not stop in time striking MV2 in the rear end. MV2 was then pushed in to MV3. Both MV2 and MV3 were stopped in traffic at the time awaiting to travel through Chestnut Street at Elliot Street. MV1 sustained moderate front end damage to the bumper and grille areas. MV2 sustained heavy rear end bumper and hatch area damage. MV3 sustained minor scratches to the rear bumper. All vehicles were still driveable.

On Tuesday, September 10, 2019 while assigned to Traffic unit N525, I responded to the area of Beacon Street and Roslyn Road, Newton for a report of a motor vehicle/bicycle crash. The weather at the time of the crash was overcast. The road surface was dry. Beacon Street and Roslyn Road are both public ways maintained by the City of Newton. I spoke with the bicyclist involved in the crash, Steven Greenzang (S96615185). Greenzang stated he was traveling Westbound on Beacon Street in the shoulder lane on his black Specialized bicycle. Greenzang had a yellow reflective vest on and was wearing a helmet at this time. Greenzang stated a vehicle in the travel lane to his left drove by him and hit the mirror located on his left handlebar. I observed damage to the mirror. Greenzang report no injuries. I spoke with the operator of MV1, Sarah Bonfanti (S66811372). Bonfanti stated she was parked in front of 1411 Beacon Street waiting to pick up a co-worker that resides at that address. Bonfanti stated a bicycle traveling on the sidewalk to her right crashed into the passenger side door mirror of her 2008 Toyota Scion (MA: 681YH1). Bonfanti stated the bicyclist was acting "crazy" during her interaction with him and he was trying to take her picture. Bonfanti stated she got back into her vehicle and moved up the roadway to wait for police to arrive on scene. I canvassed the area where the accident occurred with Sgt. Dempsey. There was glass from the passenger side mirror of MV1 and Greenzang's bicycle in the main travel lane of the roadway and the shoulder lane where Greenzang stated he was traveling. We also observed a large tree and a telephone pole on the sidewalk next to the roadway where the accident is alleged to have occurred. After speaking with all parties involved, observing the location of the glass in the roadway from the crash, and the location of the tree and telephone pole on the sidewalk where he accident occurred; Greenzang would not have been able to operate his bicycle on the sidewalk and be close enough to the roadway to make contact with MV1. Prior to clearing the accident, I asked Bonfanti if she had any questions and if she wanted to report any injuries. Bonfanti stated she was hit by the bicyclist during her exchange with him and began grabbing her left leg. I asked Bonfanti why she did not inform the officers on scene that she was assaulted. Bonfanti stated she said something to our Dispatch when she called. I asked Bonfanti if her leg was injured. Bonfanti stated I was putting words in her mouth and that she was just scratching her leg. Bonfanti then stated she was hit in the right shoulder. I asked Bonfanti if she would like an ambulance to respond and evaluate her. Bonfanti declined and stated she was more concerned about her mirror. I advised Bonfanti if she wanted to pursue charges against Greenzang she could do so in Newton District Court. I listened to the 9-1-1 recording Bonfanti made in regards to this incident. Bonfanti stated a pedestrian busted out her window. Bonfanti then stated to our dispatcher that the bicyclist lost control of his bicycle and smashed into her car. During her exchange with the our dispatcher, I did not hear Bonfanti say she was physically assaulted by Greenzang.

Valentine Baron stated on she was bicycling in the marked crosswalk at Center Ave at Center St from the north side walk to the south side walk. Baron stated that she activated the crosswalk light and had entered the crosswalk when the light was activated. Baron stated that while she was in the marked crosswalk vehicle one began to make a right turn on red . Baron stated that vehicle one struck her on her left side , knocking her off her bike . Baron stated that she had a helmutt but was not wearing it the time of the crash. Baron stated that she did not lose consciousness as result of the crash. Baron was transported via EMS to Mt Auburn Hospital for treatment for possible internal injuries. Operator of vehicle one Sara Ross stated that she was stopped at a red light on Center Ave at Center St. Ross stated that she was waiting to turn right on a red light and look to her left and then her right and drove forward. Ross stated that she did not see Baron in the marked crosswalk. Charles Hannum was a front seat passenger in vehicle one and stated that he did not see Baron in front of the vehicle until the crash occurred. I took photos of vehicle one and forwarded to the NPD IT bureau. I issued Ross M Citation T21065501 and cited her for a violation of CO 19/74 , failure to use care while turning.

On Friday, September 13, 2019 at approximately 16:19 hours, while assigned to N496, I responded to 162 Warren St. for a report that two boys were hit by a car earlier in the day. Once on scene I spoke with Wes Moore and Luca Toro (both attend Oak Hill Middle School), as well as their mothers Jamie Moore and Alyssa Toro. Wes and Luca explained that at about 15:15 hours, they were crossing at the crosswalk adjacent to the Bank of America in Newton Centre (808 Beacon Street), heading towards the Newton Centre municipal parking lot. The boys stated that as they crossed a large van, which was traveling westbound on Beacon Street in the left turn lane, stopped to let them cross. Wes and Luca stated that they did not realize that there was another westbound travel lane, and after passing the truck they were both hit by an unknown sedan. Wes and Luca stated that the driver, who they described as an approximately 50 year old white female, got out of her car and started yelling at them to be careful. Wes and Luca stated that the unknown female operator checked to see if they were hurt and then left the area heading westbound on Beacon Street. Wes and Luca stated that they both fell to the ground as a result of being hit by the unknown motor vehicle, but only sustained minor injuries. I offered to have an ambulance respond to evaluate Wes and Luca, however, Mrs. Moore and Mrs. Toro declined. I advised the boys and their mothers that I would be documenting this incident with a crash report, and that I would head to the area to see if Bank of America had and cameras facing the crosswalk, so that we could hopefully identify the operator of the unknown motor vehicle. I then responded to the Bank of America, however, the bank was closed for the day. Supplement by Officer Ferguson: On Monday 09/16/2019 at approximately 0900 hours I responded to the Bank of America and spoke with the employees who stated they do not have any cameras that record the street or sidewalk areas. The camera they have only records the front door and lobby area.

On 09/27/19 at 08:41 hours while assigned to Traffic Unit 523, I responded to a motor vehicle/bicyclist accident at 1330 Centre Street. The weather at the time was clear and sunny. The road surface was dry and Centre Street is a public way maintained by the City of Newton. Traffic conditions were at a heavy volume and Centre Street was congested at the time. There is no dedicated bicycle lane in this area due to the road being too narrow. I spoke to the bicyclist involved (Unit 2), Michael Hnatko (S10432772). Mr. Hnatko stated he was traveling northbound on Centre Street on the right side of the road on his 20 inch gray Trek bicycle. He further says that he was peddling very fast at the time and must have not been paying attention to MV1 turning right in to parking lot of 1330 Centre Street as he was approaching from behind. As MV1 was turning right, he then struck the passenger side rear quarter panel of the vehicle and fell forward off of his bicycle. He sustained minor injuries such as scrapes to his knuckles on both hands and a small cut to the bridge of his nose. He signed a patient refusal with Cataldo Ambulance. It appeared that the front alignment was now off on his Trek bicycle. I then spoke to the operator of MV1, Lonnie McGinnis (S66044083). He states that he was inching along in heavy traffic waiting to turn right in to the lot of 1330 Centre Street with his right turn directional signal on. As he was turning right, the bicyclist struck his vehicle on his passenger side rear quarter panel area. McGinnis thought it was clear to turn right at the time and never saw the bicyclist approaching from behind. No injuries reported by McGinnis and I observed minor dents and scratches to the passenger rear quarter panel area. Digital photos taken by Ofc. Gaudet.

MV #1 was traveling soutbound on Centre St. at the intersection of Langley Rd. MV #2 was positioned northbound on Centre. St and was attempting to turn westbound onto Pleasant st. The operator of MV#2 indicated that there was a significant gap in traffic as he was attempting to turn westbound when the operator of MV #1 collided into his vehicle. Damage was observed to both MV#1 and MV#2's front bumpers. The operator of MV#1 stated she could not see MV#2 due to the lighting prior to her colliding into vehicle. Both parties were treated on scene by Cataldo EMS but declined transport to a hospital. Both vehicles were able to be driven away from the scene.

Narrative:
On 11/12/2019 at 12:26 hours, I responded to the Star Market parking lot located at 2040 Commonwealth Avenue for a motor vehicle pedestrian accident. The parking lot is a public/thru way that motorists use to access the Star Market along with other businesses. The weather at the time was cloudy and rainy and the parking lot was saturated. Prior to my arrival, the pedestrian involved left the scene and did not want to speak to the officer nor wanted medical attention. Ofc. Claflin then cancelled Cataldo Ambulance. The pedestrian, Mary Alexander, left her information with a store employee prior to leaving. I spoke to the operator of MV # 1 (Joshua Randel MD Lic.# R534440603244) who stated that he was travelling through the third row of the Star Market parking lot at an appropriate speed. He was then attempting to make a left turn near the entrance/exit of the store. He says that there was a large white van parked in the end handicapped spot towards the left of him. He says the van was sticking out in the spot limiting his visibility. As he was half way through his left turn and coming around the corner, he was not able to see a pedestrian pushing a shopping carriage. He then struck the carriage that was being pushed by Mary Alexander. He further says that the cart jolted Ms. Alexander and she fell down to the ground. At the time, Alexander was walking through the lot near the store entrance heading back towards the parked cars. She was not in the crosswalk at the time which was approximately ten feet down from her location. After, I attempted to go to Ms. Alexander's residence to follow up. I spoke to her friend who was bringing up Alexander's groceries and she stated that she decided to go to Newton Wellesley Hospital for treatment. I then spoke to Ms. Alexander in the lobby of the hospital. She stated that she was exiting the store through the lot with her shopping carriage. She believes she was approximately eight feet away from the door when all of a sudden she only saw red coming at her. She believes MV # 1 was speeding at the time. I asked her if she was struck by the vehicle or was the shopping carriage only struck. She replied that she did not know and only remembers falling to the ground after. She sustained a large bruise to the inside palm area of her right hand and her left knee was swollen. Digital photos of the scene were taken and pictures of Ms. Alexander's injuries were taken at the hospital. As far as possible video surveillance, I was told that the Loss Prevention Department has to access the video. On 11/13/19 at approximately 14:20 hours, I went in to the Star Market and spoke to the manager, Nidal Rajeh, inquiring about possible video surveillance. He said there is coverage in the parking lot and he was able to show me the video. A copy of the video would have to be done by Loss Prevention which I requested. I observed at the 12:12pm mark in the video, MV # 1 was parked five spots up from the third row of the lot that he was exiting. I also observed a white transport van parked in the end handicapped spot mentioned by the operator but it was parked correctly and not limiting visibility. Next, MV # 1 backs out of the spot and drives forward going at a reasonable speed. The pedestrian (Alexander) has already exited the store with her carriage and is walking at an angle toward the same third row of parked cars. As the pedestrian is walking towards the direction of MV # 1, it appears that the pedestrian should be visible to him. MV # 1 then starts to take the left turn around the corner without slowing or stopping and strikes the carriage head on. Due to the impact, Alexander then loses grasp of the carriage and it goes past her twisting her body around. She then hits and rolls up on the hood of the vehicle on her left side. MV # 1 then suddenly stops and immediately gets out and provides assistance to the pedestrian. Due to the video surveillance, Mr. Randel will be issued/mailed MA Uniform Citation # T2012347 for Ch. 90/14/A Failure to slow for a pedestrian.

I, Officer Sullivan, spoke with Margaret Wilkens MA OLN#S33922902 at Newton PD Headquarters at approximately 1745hrs. 11/14/2019. M. Wilkens was involved in an MVA in the area of Chestnut St.@Elliot St. (Newton) . M. Wilkens appeared upset as crying. I asked if she were injured. She stated her neck was sore but she'd be ok. I asked if she had hit her head or if there were airbag deployment to which she answered "no". I asked her if she wanted EMS to medically evaluate her to which she also stated "no". M. Wilkens stated she was reared ended by another woman who refused to give her any information. M. Wilkens stated after being rear ended she and the other woman were outside of their vehicles checking for visible damage. M. Wilkens stated it was dark and difficult to see. The other woman stated their was no damage to M. Wilkens car. M. Wilkens told her the vehicle (V1) she was driving was not hers and is in fact a rental. V1; MA Reg. 8ZA768, 2019 Lexus/NX300H color gray. M. Wilkens stated the other woman returned to her vehicle and drove away. M. Wilkens thought she was going to her vehicle to get her license and vehicle information. M. Wilkens also had recorded with her cell phone the brief interaction with the other operator. M. Wilkens described the other woman as in her mid 20's average build approx. 5'5'' with brown hair (in a pony tail), M. On Wednesday, November 20, 2019, while assigned to Traffic unit N525, I responded to the area of Chestnut Street and Avalon Road, Newton for a report of a motor vehicle crash involving a Cataldo ambulance. Chestnut Street and Avalon Road are both public ways maintained by the City of Newton. The weather at the time of the accident was light rain. The road surface was wet. I spoke with the operator of MV1, Corey Remblad (S29346684). Remblad stated he was operating his 2007 Ford Ecoline (CT: 53CC04) Southbound on Chestnut Street towards Avalon Road. Remblad stated there was construction ahead of him on Chestnut Street and there was a police officer working a detail that was waving him on to continue down Chestnut Street. Remblad stated MV2 exited Avalon Road and it's front driver side crashed into the driver side of his vehicle. I observed moderate damage to the middle driver side of MV1. Remblad and his passenger Thomas Solecki report no injuries. I spoke with the operator of MV2, Richard Yunker (S70658898). Yunker stated he was operating 2019 Ford F150 (MA AMN: 5921) Westbound on Avalon Road towards Chestnut Street. Yunker was operating the vehicle in his capacity as a Field Supervisor Paramedic for Cataldo Ambulance. Yunker stated he approached the intersection and came to a stop before taking a right turn onto Chestnut Street. Yunker stated as he made his right turn his front driver side crashed into the driver side of MV1. I observed moderate damage to the front driver side of MV2. Photos were taken of both vehicles and submitted to the IT Bureau.

On 11/27/19 at 12:43 hours, I responded to the Petsmart located at 215 Needham Street for a motor vehicle bicyclist accident. The weather at the time was approximately 50 degrees, cloudy and the road conditions were dry. No injuries reported. Operator of MV # 1 (Barbara Cooper) states she was facing eastbound on Needham Street waiting in the center turn lanes to take a left turn in to the garage of 215 Needham Street. Next, she states that a large truck going westbound stopped for her and waved her on to turn. She then proceeded in to the garage and parked and that is when she was confronted by the bicyclist saying that she was struck with her vehicle. The operator was unaware of an accident occurring and was not able to visibly see past the truck while turning. I observed a minor scratch to the passenger rear quarter panel area of the vehicle. Operator of the bicyclist (Merissa Brousseau) states she traveling westbound in the bicycle lane on the right side near 215 Needham Street when she observed the large truck mentioned above suddenly stop. She states that she was also visibly blocked from seeing ahead due to the truck. She then kept peddling straight through and struck MV # 1 in the passenger side rear end as it was making its left turn. The operator was evaluated by Cataldo Ambulance but refused medical attention. I observed no apparent damage to the bicycle. Ms. Brousseau was wearing a bicycle helmet, black and red Boston University bicycle suit, and red BU sock covers over her shoes. Based on observations and statements made, the following occurred. M/V#1 was parked facing south on Chestnut St. awaiting to pull a M/V from an unrelated accident scene, with his yellow hazard light bar activated. A Verizon truck was parked facing north in the northbound lane of Chestnut St. and through traffic was being routed up the westbound side of Amherst St. M/V#2 approached traveling south on Chestnut St., and stopped approx. 100 feet away from M/V#1. It then began to slowly drive up to M/V#1 and attempt to pass between the two parked trucks, at a slow speed, when the right fender of M/V#2 struck the towing rig of M/V#1. The right fender of M/V#2 had damage along the right front wheel well. I was unable to see the extent of the damage to the tow rig. I went to speak to the operator of the M+#2 (who was standing outside to the right of his car) and as I approached him, I observed that he was swaying while standing. I asked the operator (later identified as David Taube-Perrotta) if he was ok, and he only said yeah. I then asked him what had happened, and he just motioned to his car with his right hand. As I stood next to him, I observed his eyes to be glassy and bloodshot. I asked him for his license and registration, and he kept staring towards the car without saying anything. I had to request his license and registration three times before he produced his license from a hip pocket. I then asked again for his registration, and he took approx. five unsteady steps to his passenger side door, opened the door, and almost fell into his car as he bent from the waist. He then stood up, closed the door, and started to return to me, until I told him I needed his registration again. He returned to his door, and again, almost fell into the car as he bent over to open the glove box. As he returned to me he appeared unsteady on his feet. He handed me the registration in a plastic sleeve, and I asked him to remove it from the sleeve. He appeared to have trouble removing the registration. I asked him where he was coming from, he stated that he was coming from Cambridge. I asked where in Cambridge, and he did not reply. I asked him if he had any alcoholic beverages during the evening, he shook his head in an exaggerated manner and stated that he didn't drink tonight. As I spoke more with him, I observed that his speech was slurred. I held my pen up and asked him if he could focus on the tip of pen. Instead of answering he tried to reach out and touch it. I advised him, I just wanted to know if he could focus on it, he stated yes, then raised his finger in an attempt to touch his nose, but instead, touched between his upper lip and nose, then tried to touch the tip of the pen again. I asked him to keep his down, and without moving his head, follow the tip of the pen. As I moved the pen from left to right, he turned his head to follow the pen. I had to remind him several times, to keep his head still, and follow only with his eyes. I asked him if he would be willing to take a field sobriety test, and he declined. I had also observed a small scratch on his forehead, and requested medics to evaluate him. As I took digital pictures of the accident, Taube-Perrotta was seen in the back of a Cataldo Ambulance, while Sgt. Devine observed. When I entered the ambulance, Sgt. Devine informed me that Taube-Perrotta stated that he was at "The Lizzard Lounge" in Cambridge earlier in the evening, and admitted that he had a few drinks. In my presence Taube-Perotta stated that he had two drinks, much earlier in the evening. While in the ambulance, Taube-Perrotta had trouble answering common questions by the medics, such as what his middle name was and where he lived. The operator of M/V#2 was placed under arrest for OUI. (See NPD Incident Report # 19053361)

Operator of vehicle one, Christopher Sermak, stated that while turning north bound in the parking lot of 175 Boylston St he was blinded by solar glare. Sermak stated that the diver's side visor was down and the he was not wearing sun glasses. Sermak stated that he heard a loud bang coming from the front driver's side of his vehicle and realized that his vehicle had stuck something. Sermak stated that he stopped his vehicle and saw a male identified as John Baker laying on his back on the ground. Baker stated that he had step off the side walk in front of 175 Boylston St and was walking to his car when he saw Sermak's vehicle approaching him and realized it was not slowing, Baker sated that the front driver's side of Sermak's vehicle struck his right arm and shoulder causing him to be knocked to the ground on his back. Baker stated that his head struck the ground but he did not lose consciousness. Baker was transported to Newton Wellesley Hospital via EMS for treatment. While on scene I observed that the rear passenger side brake light of Sermak's vehicle was out. I issued Sermak MA Citation T 2012527 and cited him for violations of City of Newton City Ordnance 19-75, failure to use care while tuning , and MGL 90/7 , defective lights.

Operator of vehicle one Cataldo Medic Elisle Gedansky stated on 12/24/2019 at 12:55 hours she was driving MA reg AMN 369 a 2016 Ford Ambulance east bound on Myrtle St with it's emergency lights and siren activated responding to a medical call at 52 Myrtle St. Gedansky stated the Newton Fire Eng 2 was parked in front of 52 Myrtle St and that vehicle two Ma reg 9940RB a 2000 VW was parked unoccupied across from 52 Myrtle St. Gedansky stated that she believed that there was enough room to drive between the fire truck and vehicle two. Gedansky stated that the front passenger side of vehicle one struck the front driver's side of vehicle two. Vehicle one had no damage and Gedansky was not injured. Vehicle two had damage to it's driver's side mirror and driver's side front bumper. I took photos of vehicle two and forwarded the disk to the NPD's IT bureau. Owner of vehicle two Aline Elliot of 46 Myrtle St was advised of this incident.

On Friday December 27th, 2019, at approximately 1348hrs, while assigned to N508 to assist with a funeral escort, I was notified by Dispatch that "MC1" was involved in a crash at the Whole Foods parking lot on Washington Street. Upon arrival I found that Newton Police Motorcycle #1 was involved in a crash while helping to assist a funeral that had just left the Our Lady Church property. Police MC #1 is MA MMC7219, a 2016 Harley Davidson motorcycle. The motorcycle was operated by Officer Rocco Marini. MV #2 was also located on scene and parked in the Whole Food parking lot. This vehicle is MA Reg. 7VN155 a 2017 Lexus ES350. This vehicle was operated by Diana Simkin. Officer Marini reported that he was traveling westbound on Washington Street when he was hit by MV #2 that was making a left (opposite direction) into the Whole Foods parking lot. Officer Marini was in the right hand lane escorting the long line of cars that was part of a funeral procession. These vehicles were in left westbound lane. Officer Marini reported he was in the right hand lane and had his emergency lights on when the collision occurred. Officer Marini did not see MV #2 prior to collision. Officer Marini reported that the front of his motorcycle hit the rear passenger side tire of MV #2. Officer Marini was taken from the scene by Ambulance to Newton Wellesley Hospital. I spoke to the operator of MV #2 Diana Simkin. Simkin reported she was traveling east on Washington Street and wanted to make a left into Whole Foods parking lot when the crash occurred. Simkin reported she was waved into the lot by an unknown motor vehicle headed in the opposite direction. Simkin was not sure which lane this person waved from. Simkin made the left into the lot and was not aware of the crash or did she see MC 1 until she was stuck in traffic in the parking lot and some woman knocked on her window. Simkin reported that she never saw an police emergency flashing lights either. There was minimal damage to Simkin's vehicle. There was scuff marks on the passenger rear tire. Simkin also did not report any injuries. MC #1 sustained some front damage to the wheel fender fairing. The motorcycle was taken from the scene by Tody's. Pictures were taken on scene by Officer McSweeney and given to IT for downloading purposes. While on scene Officer McSweeney and myself went to New England Diamond and Jewelry at 660 Washington Street. We met the owners Dave and Robert Alpert (617-243-0099) who reported that they have video of the collision. In the video I observed at 1346hrs the funeral begin to pass the Whole Foods entrance. At 1348hrs the video shows MV #2 come up in the easttbound lane and stop. The vehicle stops and waits until an unknown white SUV stops to allow MV #2 to make a left turn into the lot. Once this unknown SUV stops, the video shows that MV #2 makes the left and hits MC #1 as he is traveling straight ahead with his emergency lights on. It appears from the video that MC #1 had no warning and could not brake his motorcycle. The video shows a long line of cars in this funeral procession with their emergency flashing lights on. Due to the angle of the video and vehicles I am unable to tell if this SUV had their flashing lights on. The video was sent to Director Smith in IT for downloading purposes. I went to Newton Wellesley Hospital and spoke with Officer Marini. He was reporting soreness to his left elbow. Based on the facts of the investigation, I have issued MA Uniform Citation T0340444 to Diana Simkin for violating 89/8: failure to yield the right of way and for violating 89/7A: interference with an emergency vehicle. Simkin was notified of this citation via telephone at 1730hrs on this day and this citation was mailed to her address. Washington Street is a public way in the City of Newton.

On 12/30/19 I responded to a single vehicle crash on Dedham St. outside of #268. The operator stated she was traveling due North on Dedham St at 25mph when she lost control of her vehicle due to icy conditions. Tracing back the vehicles tires marks in the slush, the car appeared to cross the double yellow lines near Brush Hill Rd and then back to the correct lane sideways before striking the curb, then a city tree in front of #268 Dedham St. There were multiple air bag deployments in the vehicle. Ambulance #1 arrived on scene and transported the operator due to a complaint of right chest pain from the seatbelt. N523 Traffic Officer Wilson arrived on scene and took pictures of the damage to the city tree. The vehicle was towed by Tody's Towing and the operator was mailed Mass. citation # T2013422 for Ch90/sec17-Speeding (too fast for conditions).

Operator of vehicle one , Allan Wint stated on 01/27/2019 at 09:40 hours he was driving his employer's pick up truck south bound on Lexington St near number 227. Lexington St is a public way in the city of Newton. Wint is a driver for Auto Zone auto parts located at 140 Lexington St , Waltham, MA ( 781 894-0656 ) . Wint was driving a 2018 Chevrolet Colorado pick up tuck ( MA reg 8CA823 ) that Auto Zone leases from Lease Plan USA Ltd. Wint stated that he was headed to Webster St in Newton to pick up a delivery. Wint stated that as he approached the area of 277 Lexington St he believed that the traffic light that is at the marked crosswalk was green for south and north bound traffic. Wint stated that he did not see any pedestrians in the crosswalk, until he heard the sound of an object impacting into the front driver's side of his vehicle. Wint stated that he stopped his vehicle approximately ten yards past the crosswalk and got out. Wint stated it was then he realized that his vehicle had stuck a female and a dog. Wint stated that he was not operating any electronic devices at the time of the crash, and I observed none in his vehicle. Wint stated he was not injured in crash. Wint's vehicle had damage to the driver's side mirror and lower molding of the driver's side front door. Wint's vehicle did not require a tow. Witness Bessy Shanks stated that she was driving in her vehicle behind Wint's vehicle south bound on Lexington St. Shanks stated that Wint's vehicle was driving slow and swerving approximately two blocks prior to the crash. Shanks stated that she believed that Wint may of been distracted. Shanks stated that south and north bound traffic was stopped because that cross walk light was red and that a female and a dog were crossing from the east to west in the marked crosswalk in font 227 of Lexington St. Shanks stated that the front driver's side of Wint's vehicle srtuck the female and the dog as they were approximately halfway into the crosswalk. Shanks stated that the female and dog both fell to the ground after the crash. Witness Elizabeth Keegan stated that she was driving in her vehicle south bound on Lexington St two vehicle behind Wint's vehicle. Keegan stated that she was not sure what color the traffic light was at the time of the crash, but traffic was stopped both not and south bound traffic was stopped. Keegan also stated that Wint's vehicle " didn't even slow down ". Keegan stated that Wint's vehicle struck the female pedestrian and the dog as they were in the marked crosswalk in front of 277 Lexington St. Witness Henry Taylor stated that his vehicle was the first one stopped at the red crosswalk light at 227 Lexington St in the north bound lane. Taylor stated that north and south bound traffic was stopped and that Wint's vehicle did not stop and stuck a female pedestrian and a dog in the crosswalk. Witness Jacqueline Deos stated that her vehicle was stopped behind Taylor's north bound on Lexington St. Deos stated that north and south bound traffic was stopped for the red light . Deos stated that Wint's vehicle did not stop and that it struck a female pedestrian and a dog in the marked crosswalk. The pedestrian in the crosswalk was identified as Xiaoping Sun. Sun stated that she and her dog stopped on the south bound side of the marked crosswalk across from 227 Lexington St. Sun stated that she activated the crosswalk light and waited until the light was red for north and south bound traffic, and that the walk single was activated. Sun stated that she looked to her left and saw traffic north bound traffic was stopping. Sun stated that she turned to her right and entered the marked crosswalk. Sun stated that she and her dog had crossed over the north bound side of Lexington St and she then looked to her right and saw Wint's vehicle not stopping and " going very fast ". Sun stated that the front driver's side mirror of Wint's vehicle stuck her in the face . Sun stated that as she fell to the ground she was struck on the left leg by Wint's driver's side. Sun stated that she did not lose consciousness after she had fallen to the ground. Sun was transported via EMS to The Brigham and Women's Hospital for treatment for head and neck injuries and abrasions to her legs. Sun's dog died as a result of being struck by Wint's vehicle. Photo's of the crash site and of Wint's vehicle were taken and the disc was downloaded by the NPD's IT Bureau. Before leaving the crash site, I tested the crosswalk lights and they were in working order. Based upon my observations of the crash site, Wint's vehicle, and the statements made to me, I concluded that Wint was at fault for this crash. I issued Wint MA Citation T 2013958 and cited him for a violation of MGL 89/11 , failure to yield to a pedestrian in a crosswalk.

On 02/26/2020 I responded to the area of Eastbourne Rd and Ireland Rd for a motor vehicle crash involving a pedestrian. Eastbourne RD is a public way which runs from Ward St north bound intersecting with Ireland Rd on the far north end. Ireland RD is a public way which runs west to east. Both the east end and the west end of Ireland Rd are dead ends. The crash occured on Ireland Rd's east end near the intersection of Eastbourne Rd. The crash involved Vehicle 1 described as a 2016 Acura SUV color grey bearing MA passenger registration 3RB127. Vehicle 1 had a valid inspection sticker which expires on 08/30/2020. Vehicle 1 was operated by its owner identified as Barbara Ball. Ball has an active MA Operators License (S18727836). The involved pedestrian was identified as Bruce Terrio. Terrio is an employee of Feeney Brothers Utility Services. Feeney Brothers Utility Services is a contractor of National Grid Gas Company. Upon arrival I observed the following: The crash occurred in the daylight hours around 10:30am on Ireland Rd near the intersection of Eastbourne Rd. At the time of the crash the weather conditions were clear, 48 degrees Fahrenheit and overcast skies (weather.gov). The area where the crash occurred was an active construction site for Feeney Brothers Utility Services. The area of the crash is a dead end. The area is accessed from Ward St from either Eastbourne Rd or Coolidge Rd. The entrances of both Eastbourne Rd and Coolidge Rd had construction signs indicating utility work in the area. At the time of the crash, all roadways were open to vehicle traffic. On the eastbound side of Eastbourne Rd just prior to the intersection of Ireland Rd, I observed a large air compressor which was parked in the roadway facing south bound. No traffic cones were located near the air compressor. To the right of the air compressor were thick green bushes. A wooden fence was located to the right side of the green bushes. On the east side of Ireland Rd I observed a large excavated hole on the right side of the roadway. The hole was near the intersection of Eastbourne Rd and was located approximately three feet from the curb. I observed four traffic cones, two on the front side and two on the left side of the hole. Located on the front edge of the hole was a tire print. Vehicle 1 was located on the west end of Ireland Rd. The front passenger tire of Vehicle 1 had fresh dirt located on the sidewalls and the tire tread. Vehicle 1 appeared to have no visible damage. The pedestrian (Terrio) was being treated by EMS and Fire for injuries. Terrio was wearing brown pants and a green reflective safety vest. I spoke with the operator of Vehicle 1 Barbara Ball. Ball stated that she was operating Vehicle 1 northbound on Eastbourne Rd near the intersection of Ireland Rd. Ball stated that she made a right turn onto Ireland Rd and drove on to the edge of the excavated hole. Ball stated that her vehicle then made impact with Terrio who was in the hole. Ball stated that she immediately stopped, backed out of the hole and called 911. Ball stated that prior to making a right turn onto Ireland Rd, there were no traffic cones in the roadway or next to the hole. Ball stated that as she made the right turn onto Ireland Rd she did not observe Terrio or the hole until it was too late. Ball states that she resides at 80 Eastbourne Rd which is the residence located to the immediate right of the crash location. Ball states that she had been recently parking on Ireland Rd due to ongoing construction at her residence. Ball states that she was traveling at a slow speed prior to impact. At the time of the crash there were three other Feeney Brothers employees working at the site. These workers were identified as Steven Gamble, Mike Cabrinma and Gerard McComaskey. At the time of the crash all three workers were located further up Eastbourne Rd near the intersection of Coolidge Rd and did not observe the crash. At the time of the crash, Newton Police Sergeant Glenn Chisholm was working a paid detail for Feeney Brothers. Sergeant Chisholm stated that he did not observe the crash.Terrio was transported by Cataldo EMS for minor injuries. Several photos were taken of the scene. Photos were taken of the hole with traffic cones and without traffic cones. All photo's were submitted to the IT Bureau. After clearing the scene, I responded to St Elizabeth's Hospital in Brighton, MA to interview Terrio. Terrio stated that at the time of the crash he was standing in the hole on Ireland Rd performing gas utility work. Terrio stated that the front passenger side bumper of Vehicle 1 struck him in the right shoulder. Terrio stated that the impact caused him to lose his balance and fall down in the hole. Terrio states that after falling down he was able to climb out of the hole without assistance. Terrio stated that at the time of impact he was wearing a white hard hat which he thinks struck the pavement on the edge of the hole. Terrio states that at the time of the crash he was working alone in the hole. Terrio states that at the time of the crash traffic cones were located near the hole. Terrio stated that as a result of the impact he sustained minor injuries to his right shoulder and back. I then observed Terrio's hard hat which appeared to have a fresh scrape mark on the top. The hard hat also had broken interior straps. Terrio stated that the straps broke when he was struck by Vehicle 1. Photos were taken of the hard hat and were submitted to the IT Bureau. After reviewing all facts of this incident, Vehicle 1 appeared to have been traveling at a slow speed prior to the crash. This was evident due to the lack of tire skid marks prior to the tire print on the edge of the hole. It also appears that Ball's view of the hole and Terrio may have been obstructed by the parked air compressor on Eastbourne Rd. The thick green bushes and a wooden fence to the right of the air compressor also added to the obstructed view. The hole was also located in close proximity to the air compressor which reduced Vehicle 1's reaction time. Jeff Oliver of OSHA was also notified of this incident. On May 17th, 2020 at approximately 14:26 hours while working N491 I responded along with NFD and Medic One to a mv crash at the intersection of Watertown St @ CRAFT St. On my arrival both the Fire Dept. and Medics were assessing the operators of the two involved vehicles. Operator from vehicle #1 a 2014 black Jeep identified as Mark Mccullough was transported from the scene by ambulance to Newton Wellesley due to his injuries. He did give a statement prior to being transported.. He stated he was going N/B on Craft St when vehicle#2 suddenly made a left turn in the intersection towards Watertown St causing the crash. Operator of vehicle #2 reported going S/B on Craft St and was attempting to turn left onto Watertown St when vehicle #1 crashed into him in the intersection. Witness id as Eamen Keane stated he was behind vehicle #1 on Craft St when he observed vehicle #2 turn left in front of vehicle #1 causing the crash. I cited operator #2 for failing to yield at an intersection C89/S8.additionally charged him with operating his mv without a valid license C90/S10. He did possess a Guatemalan license. His vehicle was registered to him with an address of #59 Chester Ave Waltham Ma. e . He was additionally charged with operating his vehicle on a public way without being properly licensed.C90s10.Citation #T2014121. Both vehicles were towed by todys. Both drivers sustained injuries but only operator #1 went to the hospital. Operator #2 refused. All above mentioned streets are public ways and maintained by the city of Newton DPW.

On 6/26/2020 at approx 1214hrs while assigned to 497 I responded to the area of Washington St at Quinobequin Rd for a report of a 2 car crash with air bag deployment. Upon arrival I observed Ma Reg 579AM3 a gray Toyt Rav 4 and Ma Reg 219w70 a red Toyota Corolla in the middle of the EB lanes of Washington St both with significant damage, front and side airbag deployment and fluids leaking. I ascertained the operators were not hurt and called for two tows and NFD for speedy dry. I spoke with the operator of the red Toyt Brendan OCONNOR who stated he was travelling EB on Washington St, had the green light, was proceeding through the intersection when he was struck by the operator of the Toyt Rav 4,Gabriella NUGENT. I spoke with NUGENT who stated she was attempting to take the left onto Quinobequin Rd from the WB lane of Washington St when she collided with OCONNOR. NUGENT acknowledged that although the light was green WB she did not have the left arrow to turn. Both cars towed by Todys, both Nugent and OCONNOR signed patient refusals with Cataldo ambulance.

On Wednesday, 7/1/2020, at 2230hrs, I was dispatched to the area of 856 Watertown St for a report of a possible car crash. Watertown St is a public way as it is owned and maintained by the City of Newton. Upon arrival, I met with operator, Henok Kiflit, who was out of the vehicle and very disorientated. I observed a gash on his head right above his eye and noticed all airbags had been deployed in his vehicle. I asked him to sit down and I radioed for an ambulance. Kiflit stated that he was driving EAST on Watertown St when he collided with a unoccupied parked car (a red 2015 Jeep Wrangler, MA Con R22519) which was parked on the street outside of 856 Watetown St. Kiflit was driving his girlfriend's car (a gray 2020 Nissan Sentra, MA Reg 1ANN57) and was on his way home in Watertown. When I asked for Kiflit's license, he told me that he only has a permit and has yet to take the test. He apologized repeatedly. Kiflit did not have any passengers in his vehicle. Kiflit said the roadway was so dark and he didn't see the parked Jeep. He claimed he was not speeding. There was minimal damage done to the drivers side rear bumper of the Jeep. The Nissan had extensive front end damage and was subsequently towed by Tody's Towing. Towed motor vehicle form filled out and filed, copy made for police prosecutor. Owner of the Jeep came out and took possession of the vehicle. Kiflit was taken to NWH for evaluation of his injuries. Kiflit's driver history shows that he had an surchargable accident recently 05/30/2020. Massachusetts Uniform Citation T2080927 was filled out and prepared to be mailed to Kiflit at his Watertown address. Henok Kiflit is being cited for: 90/10 - Operating without a License (Learner's Permit violation; Kiflit, operator, was not accompanied by any motorist)

On 07/28/2020 at 1221hrs I responded to the area of 23 Oak St for a motor vehicle crash involving a pedestrian. The involved pedestrian had left the area prior to my arrival. The vehicle that was involved in crash was also not on scene. The crash occurred on 07/28/2020 at approximately 0900hrs in the driveway of 27 Oak St. Prior to the crash the involved vehicle described as a 1991 Chrysler TC Convertible color Red bearing MA Antique Reg D2935 ( Active) was located in the driveway of 23 Oak St. The vehicle was facing toward the rear of the driveway. The vehicle then rolled in reverse easterly across the common driveway and struck a pedestrian who was located in the driveway of 27 Oak St. After contact with the pedestrian the vehicle came to final rest in the driveway of 27 Oak St. As a result of the impact the pedestrian sustained a minor injury to her left knee. There were no occupants in the involved vehicle at the time of the crash. It is unknown at this time if the vehicle sustained any damage. The pedestrian left the area prior to this crash being reported to NPD. The vehicle was removed from the area prior to the crash being reported to NPD. I then spoke to the owner of the involved vehicle Marc Dumoulin who was on scene and was the reporting person. Dumoulin stated that the crash occurred today 07/28/2020 at approximately 0900hrs. Dumoulin states that the involved vehicle described as a 1991 Chrysler Convertible was having issues due to a gas tank problem and he believes it wasn't going to pass inspection. Dumoulin stated that he took his vehicle for a final test ride around the block to decide if he wanted to keep it or not. Dumoulin states that after operating the vehicle he decided to salvage the vehicle with CJ Auto in Watertown, MA. Dumoulin states that before going to CJ Auto he decided to stop back at his home first. Dumoulin states he then parked the vehicle at this driveway and got out to go in the house. Dumoulin states that he believes the vehicle was running at this time. Dumoulin states that as he was walking toward his house he observed his vehicle rolling in reverse towards his neighbor's driveway. Dumoulin states that the vehicle then rolled into his neighbor's driveway near his neighbors fence. Dumoulin states that the pedestrian was outside near the fence when his vehicle rolled into his neighbor's driveway.Dumoulin states that he did not initially report the crash because he did not believe that his vehicle had come in contact with the pedestrian. Dumoulin states that he then removed the vehicle from his neighbor's driveway and brought it to CJ Auto for salvage. Dumoulin states that when he returned to his residence he became aware that the pedestrian may have been struck by his vehicle and had a minor injury. Dumoulin states that upon hearing this he called NPD. At this time I was met by Nina Levin who is the homeowner of 27 Oak St. Levin stated that she did not observe the crash but a contractor working on her house did. Levin stated that the pedestrian involved was named Lucero Flores-Roman and that Flores-Roman was outside attending to some potted plants when she was hit by the involved vehicle. Levin stated that Flores-Roman received an injury to her left knee. Levin stated that she took photo's after the crash of the involved vehicle and of Flores-Roman's knee. Levin provided me with these photo's which I then submitted to the IT Bureau. Levin provided me with Flores-Romans contact phone number. Dumoulin also provided his insurance information to Levin so that she could relay the information to Flores-Roman. I then spoke with a witness Gleb Andreev who was a carpenter working at 27 Oak St. Andreev states that he was inside of 27 Oak St working on a first floor window facing the driveway. Andreev state he observed the involved vehicle roll into the driveway and come to rest near the pedestrian. Gleb stated he then went out side to assist the pedestrian. Gleb stated he believed the vehicle hit the pedestrian when it rolled into the driveway. At 0230 hrs I was able to speak with the involved pedestrian Lucero Flores-Roman. Flores-Roman states that around 0900hrs today she was in the driveway of 27 Oak St attending to some plants near a wooden fence. Flores-Roman stated that her back was turned towards the area of 25 Oak St, she then on a hunch turned around and observed the involved vehicle in reverse moving towards her. Flores-Roman stated that she turned her body quickly to avoid the vehicle but the vehicle's rear end passengers side made contact with her left knee. Flores-Roman stated that she sustained a minor injury to her left knee which included some bruising and swelling. Flores-Roman states that after crash she did not think she needed an ambulance but wanted to go home to rest her knee. Flores-Roman was then provided with Dumoulin's insurance information. No other injuries reported on scene. Photo's were taken on scene and were submitted to the IT Bureau. On 07/29/2020 I responded to CJ Auto's Salvage Yard located at 43 White Pond Rd Stow, MA which was the present location of the involved vehicle. Upon arrival I observed the involved vehicle which did not appear to have exterior damage. Photo's were taken of the vehicle and were submitted to the IT Bureau. An RMV check of vehicle revealed that a title was issued to Dumoulin on 03/25/2020. The vehicle has not been inspected by a MA inspection station. The vehicle title has been signed over by Dumoulin to CJ Auto for destruction. At this time it is unknown if the crash was caused by mechanical failure with the vehicle or human error.

I responded to 1641 Beacon St. for a report of an MVA/Hit &Run. I arrived on location and spoke with Alicia Ianiere MA OLN#S84312664. Alicia's vehicle was parked when the car was hit by a passing vehicle. Alicia was inside a restaurant picking up food. The vehicle was occupied by her daughter Katherine Cullen 23 Y.O., who was seated in the front passenger seat, at the time of the collision. Katherine stated she had some stiffness in her neck. EMS responded to the scene to evaluate her. There was no airbag deployment. Katherine was cleared by EMS, she was not transported. The vehicle that was hit was MA Reg. 1JXF31; 2018 Toyt/Camry sedan color brown. The vehicle was hit by an unidentified vehicle. RP Alicia Ianiere stated the vehicle struck the rear of her vehicle as it was parked in front of 1641 Beacon St. The vehicle continued Westbound failing to stop. Ianiere's Vehicle sustained damage to the rear driver's side. There were several people seated at an outside area of a nearby restaurant. Those I spoke with heard the crash but did not actually observe the collision. There was one witness identified who stated he observed the collision. witness was identified as Dylan Shuler 24 Y.O.. Mr. Shuler described the other vehicle as a "silver2 door Honda Civic. He stated the plate was either MA Reg. 6EJZ30 or 6ZJZ30. A query of the possible plates came back not matching the vehicle description. The other witnesses also described a silver 2 door Honda. Nobody else observed a plate number. Alicia Ianiere was advised to notify her Ins. company and that I would document the accident as a MVA Hit&Run.

On Saturday, August 1, 2020 at approximately 1810 hours I responded to a single motor vehicle crash. Upon arrival I saw the vehicle completely off the roadway and in the middle of a grassed area next to a large tree. The operator of MV1 stated he was driving westbound on Kenrick St and attempted to take a left turn on Waverly Ave when he lost control of his car and drove over the curb and hit part of the tree. EMS arrived on scene and operator of MV1 signed a refusal. There was major damage to the front of the car making it inoperable. The vehicle was towed by Todys. Todys had to cut branches of the city tree to get the vehicle out. Pictures of the vehicle and tree have been submitted to IT.

On Monday, August 10th 2020 at 0459 hours, I responded to the intersection of Brookline St at Vine St for a one vehicle accident into a City Of Newton Tree. The vehicle was a Black Honda Accord Mass Reg # 7DZ958. Upon arrival, Samuel Perez was outside the vehicle and no operation of the vehicle was witnessed. There was no drugs or alcohol inside the vehicle. The vehicle appeared to have been operated heading west on Vine St. The vehicle continued through the stop sign at Vine St straight into Brookline St where the vehicle collided into a City of Newton Tree. Pictures were taken and submitted to IT. The airbag was deployed. Perez complained of chest and head pain. Perez was taken by Ambulance to Newton Wellesley Hospital. There was extensive damage to the front of the vehicle. Tody's Towed the vehicle. A Towed Motor Vehicle Inventory form was completed. Perez was mailed Mass Uniform Citation #T1273442 in the amount of $ 105 for M.G.L Ch. 89/9 Failure to Stop at Stop Sign.

On August 19th, 2020, while working in marked unit N526, I responded to a MVA vs. bicyclist in the area of the intersection of Crafts Street and Watertown Street, Newton. The weather at the time of the crash was clear and cloudy. The road surface was dry. Crafts Street and Watertown Street are both public ways maintained by the City of Newton. The operator of MV1, Cody Hjelm (NHL19517660), stated he was traveling westbound on Watertown Street and had just crossed over Crafts Street when he saw a bicyclist traveling in the same direction on Watertown Street. As MV1 approached the bicyclist he moved over to the left towards the double yellow lines to give the bicyclist room. MV1 states the bicyclist was no longer in front of his vehicle when he heard a thud type noise come from the side of his van. MV1 stated he pulled over and saw the bicyclist on the ground with a head injury. MV1 sustained moderate damage to the right passenger side of the vehicle. The operator of MV1 reported no injuries and signed a patient refusal. MV1 was able to leave the scene of the accident. The bicyclist identified as Harriet Fell (S04980771) was being treated by medics on scene at the time of my arrival. I spoke with her briefly inside the ambulance as she was being treated for a head injury. Harriet stated she has no recollection of the accident and does not remember what happened before or after the crash. Medics advised she was being taken to NWH for treatment. I spoke with Harriet on the telephone around 1630 hours. She stated she still does not remember what happened but stated she was just finishing her forty mile bike ride and was heading home. Harriet stated she has a hematoma on her head and recieved three stiches. Harriet also stated she has small abrasions on both hands. Harriet stated she was being released from the hospital shortly and will pick up her bicycle tomorrow. The bicycle was transported to the police station by Newton DPW and was secured for safekeeping inside Support Services by Officer Manouk. A property form was completed and submitted along with an Incident report # 20039014. I took photographs of the accident scene and submitted them to the IT Bureau. Update by Ofc. Geagan: On 08/20/2020 Ms. Fell came to the Support Serices Bureau to retrive her bicycle. See attached Evidence/ Property Form and Return of Property Sheet

Upon arrival I found both cars in the parking lot of 2101 Washington St. I spoke with the operator of Ma reg 3CXA91, Emma Lorden who stated she was taking a left out of 2150 Washington St, thought the way was clear when at what she perceived at a high speed she was struck by the operator of Ma reg 122CF6 Patricia Christina . I spoke with Patricia who stated she was travelling Eastbound on Washington St when the other vehicle pulled out across her traffic lane. Patricia had a passport only and admitted she had no license in the U.S. or in Brazil. Patricia issued criminal application citation for violation of MGL 90/10 Unlicensed Operation , her car was towed by Todys Towing. Emma stated she had struck her head but signed a refusal with Cataldo Ambulance.

Operator of vehicle one Peter Bradley stated that on 09/18/2020 at 08:39 hours he was driving his 2014 Land rover ( MA reg 1EV437 ) south bound on Cherry St near Adams Ave. Cherry St. is a public way in the City of Newton. Bradley stated that as his vehicle was approaching Adams Ave he saw a vehicle stopped facing east bound that was about to turn into the south lane of Cherry St. Bradley stated he also saw a bicyclist riding south bound on Cherry St. Bradley stated that as the bicyclist passed by the vehicle that was stopped at Adams Ave. it suddenly swerved to the left and into the path of travel of his vehicle. Bradley stated that the passenger side mirror of his vehicle struck the bicyclist causing him to fall off his bike. The bicyclist Tameon Dames, a 10th grader at NNHS ( DOB 02/16/2005 ) stated that he was riding his bike south bound on Cherry St. near Adams Ave. when he saw a vehicle stopped on Adams Ave about to turn south bound on Cherry St. Dames stated that he steered his bike to the left to create space between himself and the stopped vehicle. Dames stated that when his bike moved to the left he came in contact with the Landrover's passenger side mirror causing him to fall from his bike. Dames stated that he did not lose consciousness after the crash and was not wearing a helmet . Dames had cuts to his left hand and was transported to Children's Hospital in Boston via EMS from treatment. The operator of the vehicle that was stopped on Adams Ave was Pin Cao. Cao stated that he saw Dames "swerve" his bike into Bradley's vehicle as passed his. At the time of the crash Dames was wearing ear pods. Bradley's vehicle had minor scuff marks on it's passenger side mirror case. I took photos of Bradley's vehicle and of Dames bike and had the photo disk downloaded by the NPD's IT Bureau. While taking photos of Dames bike I observed that both of it's tires had very little tread left leaving them almost completely bladed. I further observed the bike was missing left pedal. Officers searched the crash area for the bike's pedal with negative results, it appeared that the pedal was missing prior to the crash. I further observed that only the front breaks of Dames bike where in working order. Dames bike was transported to the station and I filled out a property form ( see report 20042471 )

On 09/21/20 at 14:46 hours, I (Traffic Unit # 523) responded to the parking lot of 88 Chestnut Street for a motor vehicle accident involving a pedestrian. The weather at the time was 60 degrees ( localconditions.com) and the sky was clear and sunny. The road surface was dry. The parking lot is a thru way that the public use to enter/exit the lot or park there. On arrival at the same time with the Fire and Medics, I observed a female laying in the middle of the lot facing down on her back. A small red and gray CVS like type shopping carriage was knocked over and resting on it's side in front of the victim's head. The carriage was moved to the side in order to tend to the victim I also observed a black Honda Civic bearing MA reg.# 3741TW that was involved in the accident. The Honda was out of the parking spot resting approximately two feet away from the pedestrian's legs. I then spoke to the pedestrian identified as Darla Gipson in the rear of the ambulance. She sustained an abrasion to her front left shoulder and arm area which I observed. She also complained of left knee and elbow pain. She stated that she walking through the middle of the parking lot pushing the carriage by the door entrance in a westerly direction towards Chestnut Street. She states that she never saw a vehicle backing up and then she was suddenly struck and believes she was pushed underneath the vehicle. She was then transported to Newton Wellesley Hospital by Cataldo Ambulance. I then spoke to the operator of the Honda Civic identified as Linda Burke (MA S70320414). Ms. Burke was parked in the first spot to the right of the walkway that leads to the entrance/exit doorway. I asked her what occurred and she stated that she was backing her vehicle up to exit the parking lot when she looked behind her not seeing anything in sight. She then started backing up and struck the pedestrian without realizing it. She says the driver of a green cab and his female customer who were no longer on scene were yelling at her to stop her vehicle because the pedestrian was underneath it. She then stopped her vehicle. I observed minor scrapes to the entire rear bumper of the vehicle so it is unknown where it actually struck the pedestrian/carriage. I observed no obvious signs of damage to the carriage. It should be noted that Ms. Burke's Honda does not have a back up camera or back up sensors. There are no surveillance cameras to the apartment complex and no witnesses came forward for the accident. As a result of the investigation, Ms. Burke will be issued Uniform Citation # T1271069 for Newton City Ordinance 19-75 Failure To Use Care in Backing. Digital photos were taken by me of the scene.

On Monday September 21st, 2020 while in N526 I responded to Newton Fire Station #2 located at 1750 Commonwealth Ave for a past accident involving Newton Fire Ladder #1 and a Cataldo Ambulance. The accident is reported to have occurred on Thursday September 17th 2020 at 10:00am. At the time of the accident the weather was partly cloudy and the road surface was dry. Captain Roche stated he was working at the station that day when a Cataldo Ambulance truck MA AMR:AMB41 slowly backed up and struck the top of the ladder on the Ladder Truck#1 MA MVN: MF463. Ladder #1 was parked and unoccupied at the time in front of the Fire Station. At the time no damage was reported on either apparatus. Today damage was noticed on the top part of the ladder. Pictures were taken of a crack and some damage to the ladder. I spoke with the operator of the ambulance identified as EMT James Perry (S14785886 ) who stated on Thursday at around 10:00am he was delivering spare parts to another ambulance and was slowly backing up in front of the Fire Station. James stated he was going about 2MPH when he bumped into the front of Ladder #1. James stated there was no damage reported to either apparatus at the time. This minor accident occurred on City of Newton Property in the driveway of Fire Station #2. No injuries were reported. Pictures of Ladder #1 were submitted to the IT Bureau.

On 09/30/2020 at approximately 19:32hrs members of the Newton Police Patrol Bureau responded to a motor vehicle crash near the intersection of Washington St and Eddy St. After an initial investigation of the crash the Patrol Bureau secured the crash scene and called in the Newton Police Traffic Bureau to investigate. At approximately 19:45hrs Sgt. Devine, Ofc Wilson and I (Ofc Schlegel) from the NPD Traffic Bureau responded to the scene to investigate. Upon arrival to the scene I was met by Ofc Kane of the NPD Patrol Bureau. Ofc Kane stated that the crash was located in the driveway of 74 Eddy St and that it involved a Ford F350 pickup striking two parked cars. Ofc Kane stated that the operator identified as Kyle Butler had already been taken to Newton Wellesley Hospital by Cataldo EMS for injuries. . Upon approaching the crash scene I observed the following: The crash occurred at night time hours at approximately 19:32EST near the intersection of Washington St and Eddy St. Both Washington St and Eddy St are public ways in the City of Newton. The weather conditions at the time of the crash were a dark and clear with a temperature of approximately 60 degrees F. Washington St is a four lane undivided roadway (2 westbound travel lanes and 2 eastbound travel lanes). Washington St lighted roadway which has concrete light poles on both the westbound and eastbound sides. Washington St was under construction at the time and had a base coat of asphalt applied. At the time of the crash Washington St did not have any painted lane markings due to ongoing construction. Washington St is separated from the road sides on both the eastbound edge and the westbound edge with fixed granite curbing. The roadway also had several orange traffic barrels and traffic cones located edges of the eastbound and westbound lanes. Affixed to the light poles and the traffic barrels were temporary no parking signs for the ongoing road construction. At the time of the crash no road construction activities were taking place. No major debris or other obstructions were observed in the roadway. Washington St is a major roadway in the City of Newton and travels west to East across the entire City of Newton. This area of Washington St where the crash occurred is in between West Newton Square and Newtonville Square, this area has a posted 35 MPH speed limit. Both West Newton Square and Newtonville Square are densely populated with several businesses and residential areas. The section of Washington St where the crash occurred is also traveled frequently by pedestrian, bicycle and motor vehicle traffic. At the time the crash occurred 19:32hrs This area of Washington St is still a heavily travelled roadway. I observed Vehicle 1 described as a 2003 Ford F350 color white (MA Reg 5DT664) located in the driveway of 74 Eddy St. 74 Eddy St is a multi-family dwelling house located on the corner of Washington St and Eddy St. The driveway of 74 Eddy St is on the Washington St side. Vehicle was faced easterly across the driveway. I observed Vehicle 1to have extensive damage to the entire vehicle including but not limited to the enclosed cab area, cab roof and all windows, front end, rear end, along with both driver and passenger side. I also observed city of Newton owned concrete traffic light resting on top of the cab area of Vehicle 1. Upon further observation of Vehicle 1 it appears that both front tires and rims were flat, heavily damaged and had little to no tread left. Both front tires were worn down to the interior steel belt. I also observed that Vehicle 1 did not have a valid inspection sticker. Located to the immediate front of Vehicle 1 and resting on the front end was a white fence which had damage consistent with the impact of a motor vehicle. Immediately to the driver's side of Vehicle 1 was Vehicle 2 described as a 2007 gray Subaru Forester (MA Reg 45D610. Vehicle 2 was facing westerly across the driveway. Vehicle 2 had extensive damage to the driver's side front end, rear end, in addition to the entire driver and passenger sides. At this time Vehicle 2's drivers door was in contact with Vehicle 1's drivers door. Both drivers doors could not be opened.The damage to Vehicle 2 appeared to be consistent with impact from another motor vehicle. To immediate passenger side of the Vehicle 2 I observed Vehicle 3 described as a 2011 Toyota Rav4 color black (MA Reg 47XB99). Vehicle was facing in an easterly direction across the driveway. I observed the Vehicle 3 to have extensive damage to driver's side rear quarter panel, passenger side front quarter panel and front end. Also observed was damage to south east corner of the dwelling of 74 Eddy St. This area of the dwelling is located adjacent to the drive way. The damage appeared consistent with the impact caused by a motor vehicle. Also observed were large amounts of debris located in the area of the crash which included the sidewalk, yard and the driveway of 74 Eddy St. The debris included pieces of concrete which appeared to have been dislodged from the concrete light pole. A city of Newton no parking sign was lying in the yard of 74 Eddy St. This parking sign would have been attached to the concrete light pole due to ongoing road construction on Washington St. I also observed two tire marks on a curb stone located next the westbound lane of Washington St. These tire marks were in front of the residence of 74 Eddy St and were to the immediate left of a storm drain. The tire marks were consistent with being struck by a motor vehicle. In between the tire marks and just after the curb there was a hole in the ground with wires sticking out of it. This hole appears to be the location the concrete light pole was located prior to impact. Tire marks were located on Washington St traveling from the east bound lane easterly across the westbound lane and ending at the tire marks on the curb. The total length of the tire marks was approximately 190 feet. After conducting an on scene investigation it appears that Vehicle 1 from the start of the tire mark in eastbound travel lane of Washington St traveled 190 feet in the easterly direct across the westbound lane of Washington St and impacted the curb in front of 74 Eddy St. The tire marks had lateral striations almost the entire length indicating that the front tires were rolling and sliding with little to no braking prior to impact with the curb. After impact with the curb Vehicle 1 exited the roadway, struck a concrete light pole. Vehicle 1 then traveled over a sidewalk, across the yard of 74 Eddy St and into the driveway of 74 Eddy St. Located in the driveway of 74 Eddy St were Vehicle 2 and Vehicle 3. Vehicle 2 was parked facing toward the rear of 74 Eddy St. Vehicle 3 located to the passenger side of Vehicle 2 and was parked facing towards Washington St. When Vehicle 1 entered the driveway it struck Vehicle 2. The force of the impact of Vehicle 1 striking Vehicle 2 caused Vehicle 2 to strike Vehicle 3. The force of the impact of Vehicle 2 striking Vehicle 3 caused Vehicle 3 to strike the southeast corner of the dwelling located at 74 Elliot St. Vehicle 1 continued across the drive way and struck a white fence before coming to final rest. Vehicle traveled a approximately 55 feet from when it initially struck to the curb till final rest. No other injuries were reported on scene. All involved vehicles were towed from the scene by Tody's Towing. After the investigation the operator of Vehicle 1 Kyle Butler was issued Citations T2015882 and T2015883 for: Mgl 90/24/O Recklass Operation of a Motor Vehicle Mgl 89/4B/A Failure to Operate in the Right Lane Mgl 90/20 Failure to Submit a Motor Vehicle for Inspection Mgl 90/7 Defective Equipment (worn front tire treads) Mgl 90/13A Failure to wear a seatbelt An immediate threat form was also filed with the MA RMV. On Wednesday, October 21st 2020 at 0341 hours, Myself N-499 and Ofc Crowe N498 responded to 524 Parker St for a single vehicle accident into a city tree. Upon arrival, I identified Mass Vet #VT36122, 2016 Dodge Sedan, Color Black had crashed into Verizon Pole number 340/50A. The airbags had been deployed. The operator was no longer in the vehicle. The operator was sitting down on the ground nearby . He was identified as Joshua Stomberg. Stomberg admitted he had operated the vehicle. Stomberg stated he was driving south on Parker St toward the VA Hospital for his work shift. Stomberg stated he was tired and did not feel alert. Stomberg also stated there was a heavy fog that made the road difficult to see. Stomberg's vehicle veered off the side of the road and collided with the pole causing heavy front end damage. Stomberg did not show any signs of being impaired by alcohol. An inventory of Stomberg's vehicle showed no discovery of any alcohol. It should be noted that on my way to the accident scene, I observed a very heavy fog on Parker St that made it difficult to see the road in front of me. Stomberg suffered an injury to his back and was transported to the VA Hospital by Cataldo Ambulance. Tody's towed the vehicle. Stomberg was mailed MA Uniform Citation # T2013041 for the amount of $ 105 for M.G.L Ch 89/S4A Marked Lanes Violation. Pictures were taken of the accident and submitted to Newton IT Bureau.

On 10/25/2020 at approximately 0330 hours, I responded to 173 Grant Ave for a report of a vehicle into the residence. Upon arrival, the operator of the vehicle was out of her vehicle and speaking with the medics. She stated is that she was driving southbound on Grant Ave when a car swerved at her causing her to swerve. As I was speaking with her, I smelt a strong odor of alcohol and she was slurring her speech. She was brought into the ambulance due to her possible head injuries. She was transported to Newton Wellesley for an evaluation. The residence had structural damage to front window and the door frame. The vehicle was removed and towed by Todys and a towed motor vehicle form was filled out and filed.

I did not speak with the operator because she was immediately put into the ambulance when I arrived. The operator did not appear to have any serious injuries and walked to the ambulance from her MV. Appears that MV#1 was traveling north on Seminary Ave when it veered to the left and struck the curb and then a light pole on the side of the roadway. MV was parked in a safe spot on Lasell property as it had only minor damage.

MV1, operator:Oscar Benavidez was driving Eastbound on Beacon St and was attempting to turn right on to Chestnut St when he struck a bicyclist. MV1 stated "He was moving to the right side of the roadway to go around a vehicle that was making a left turn at Beacon and Chestnut. He didn't see a bicylist and heard something hit his car and that's when he stopped and observed a bicyclist on the ground". The bicyclist Jeffery Glassman complained about his right side being sore, but had no other visible injuries. He stated "he was riding his bike on Beacon St and about to be entering the intersection at Beacon and Chestnut when a vehicle pulled to the right and hit him" He signed the refusal on scene with EMS. No damage was done to MV1. Corrina Mieth witnessed the accident and stated "She observed the vehicle move over to the right side of the road and that's when the vehicle collided with the bicyclist". Pictures were taken of the scene.

Operator of vehicle one ( MA reg 1HK920 2010 Toyota Tacoma ) Brian Robidoux stated that on 11/06/2020 at 14:49 hours he was driving west bound on Auburndale Ave near Lexington St. Both Auburndale Ave and Lexington St are public ways in the City of Newton. Robidoux stated that west bound traffic had a green light at the intersection of Lexington St, and that north and south bound traffic on Lexington St had a red light. Robidoux stated that as he turned his vehicle left into the north bound lane of Lexington St was hit on the front driver's side quarter panel by motorized bicycle that did not stop for the red light. Robidoux stated that he was not injured in the crash and his vehicle did not required a tow. The operator of the motorized bicycle Arif Ahmed stated that he was riding north bound on Lexington St on a Lectric XP motorized bicycle. The vehicle that Ahmed was riding on meets the definition of a moped set forth by MGL 90/1, specifically that it's top seed was not in excess of 30 MPH. According to the owners manual that I found on line the top speed for the Lectric XP is 20 MPH. Ahmed stated that he believed that north bound traffic on Lexington St had a green light but he could not be sure. Ahmed also stated that he was unfamiliar with the area and it traffic patterns. Ahmed stated that he saw Robidoux vehicle and thought it would stop. Ahmed stated that at the time of crash be estimated that he was travailing approximately 12 MPH. Ahmed was transported via EMS to Newton Wellesley Hospital form treatment of lacerations to his hands, legs and possible internal injuries. During the investigation of this crash I discovered via the MA RMV data base that Ahmed's driver's licenses was suspend on 10/05/2020 as a part of a CWOF for 90/24 OUI . Ahmed is on active probation of out Natick Distinct Court until 09/24/2021. Under Comm v. Lopez 91 Mass App. Ct. 485 ( 2017 ) the charge for operating a moped with a suspended license should be charged as 90/10 , operating with out a license as opposed to 90/23 operating with a suspended licenses. Under MGL 90/1d moped must have one number plate issued by the MA RMV , and Ahmed's moped did not. I took photos of Robidoux's vehicle and of Ahmed moped and the disk was downloaded by the NPD's IT Bureau. Based upon statements made to me as well as information from the MA RMV data base I issued Ahmed MA Criminal Application T2015903 and cited him for MGL 90/10, operating with out a license, 89/9 failure to stop for a red light and 90/1d, unregistered moped.

MV1 stated she was turning left onto JFK Cir and "did not see" the 2 pedestrians subsequently striking them. I observed MV1 to be about 2-3 feet from the sidewalk on the left which showed she was driving on the wrong side of the road. When I brought this to the operators attention she stated "no one was coming." Operator reported no injuries or damage to the vehicle. Citation # T2012942 issued for marked lanes. The pedestrians, Luda & Andrei Manea stated they were crossing JFK Cir when they were struck by MV1. Luda sustained a laceration to her face and was transported to Newton Wellesley Hospital for a further evaluation. Andrei complained of pain to his left side, declined to be evaluated on scene, however was transported to NWH with his wife via Cataldo Ambulance. Digital images of the scene, (after MV1 had to move out of the way) were captured and turned over to the IT Bureau. It should be noted that this intersection is rather dark & Luda was wearing a dark blue shirt & Andrei was wearing a white shirt.
