Narrative:
MV1 (MA Reg: 51JD62, 2007 green Toyota Pruis) operated by Marcia Gittes (DOB 11/29/1948) was traveling Southbound on Walnut St when it collided with a pedestrian in the crosswalk at Walnut St/Foster St. MV1 collided with a man, later identified as Jerome Shectman (DOB 10/7/1964). He had an injury to the back of his head, right hand, left shoulder and lower spine and was transported to Beth Israel Hospital. Witness, Patrick Clare-O'Brien saw the crash take place. He stated that the pedestrian, Jerome was crossing in the crosswalk traveling Westbound towards Foster St, successfully passed through the lane where vehicles were traveling Northbound on Walnut St and was then hit by the Toyota Prudish in the lane going Southbound. Jerome was already halfway through the crosswalk at this point. It was dark, but there was a streetlight directly over this crosswalk on Walnut St creating a semi-lit area for visibility. Mrs. Gittes stated that she didn't see him because he was wearing dark clothing and it was dark outside. She saw him when it was too late. There was no damage to her vehicle. Mrs. Gittes was given a monetary citation (T0646789) for 89/11 Crosswalk Violation. pictures were taken at the scene and the photo SD card was sent to IT. Traffic Bureau update (Officer Gaudet): I was asked to follow up with the injured pedestrian involved in this accident, Jerome Schectman (S77606276). Schectman stated he was attempting to cross Walnut Street east to west towards Foster Street. Schectman stated he entered the crosswalk after observing no cars traveling towards him in the Northbound lane of Walnut Street. Schectman stated he began walking across the street and stopped in the middle of Walnut Street after observing 2 vehicles traveling towards him in the Southbound lane. Schectman stated as the first vehicle went by, he stared at it as it traveled past him and down the street. Schectman stated as he looked back at the second car it was traveling right at him and he was unable to get out of the way. Schectman stated the vehicle hit him on his right side. Schectman listed his injuries as follows: fractured vertebrae, laceration to the back of his head, neck pain, and left shoulder/arm pain.

On 01/04/19 I responded outside of #54 Needham St for a two vehicle crash. Veh #1 was a delivery box van who was driving due North on Needham St. The operator of veh #1 stated he was attempting to take a left into #55 Needham St. when veh #2 came from behind him on his left and he struck veh #2 as he turned. The operator of veh # 1 was taken by Ambulance #1 to Newton-Wellesley Hospital for an evaluation after complaining of pain in his chest area. The passenger of veh #1 stated everything happened "so fast" he didn't see what transpired. Moderate damage to veh #1. The operator of veh #2 stated he was traveling due North on Needham St. and was behind veh #1 for a long stretch of the road. The operator of veh # 2 stated veh #1 put his right directional on three different times but didn't turn. He stated veh #1 had his right directional on and was in the right lane when he went to pass him. Veh #1 then turned into his rear passenger side as he passed. Moderate damage to veh # 2. The operator of veh #2 stated the operator of veh #1 was walking around and yelling about the accident for a period of time and then eventually grabbed his chest and fell to the ground complaining of pain. From the result of my investigation it appears as if veh # 1 attempted to turn from the wrong lane and veh # 2 was passing in the "suicide lane", also wrong lane. There will be no citations issued at this time as both operators were given verbal warnings.

Veh #1 was stopped on Needham St. at Columbia Ave red light, when veh #2 hit her from behind. Operator of veh #1 complained she hit her head on the back rest and wrist on steering wheel. She was evaluated by Amb #1 but signed a patient refusal and declined to go to the hospital. Minor damage to rear of veh #1. The operator of veh #2 stated he was stopped behind veh #1 at the red light when his foot slipped off. He then struck the gas instead of the brake. The operator was cited in hand Mass# T1441206-Failure to use care in stopping. No visible damage to veh #2.

On Saturday January 5th 2019 at 18:01, I was dispatched to Crafts St at Waltham St for a report of a 2 car accident. Operator of MV1 stated he was driving southbound on Waltham Street and approached the intersection as the traffic control changed to red. He slowed down and came to a complete stop. Approximately 4-6 seconds later, he was rear ended by MV2. MV1 sustained minor damage to the rear passenger side. MV1 had three other occupants in the vehicle at the time of the accident. The two passengers in the back seat complained of back pain and were evaluated by Cataldo Paramedic Basic 3 and both signed patient refusals. The operator of MV2 stated as he approached the intersection he "was sleeping." When I asked him to elaborate further he was unable to provide me any answers. He was evaluated by PB3 and transported to NWH. He was issued citation # T1441363 for Operating Under the Influence of Alcohol (2nd Offense) and Negligent Operation of a Motor Vehicle. See Report #19000596 for further details. MV2 was towed by Todys Towing due to the operator being transported to the hospital and the passenger stating he was too intoxicated to drive. A towed motor vehicle form was filled out.

MV1 was traveling southbound on Walnut St when the operator, Saptarshi Ganguly, stated that he began to feel fatigued, believed he blacked out and then woke up after impact with MV2. Mr. Ganguly stated that he takes Atenolol for vasovagal syncope. I know this to be a condition that makes individuals feel like they are going to faint. He stated he was diagnosed with the disorder about 10 years ago. MV1 crossed over the double yellow lines on Walnut St and collided head-on with MV2 who was traveling northbound on Walnut St. Two witnesses (Kyle Fieleke and Edward Aybar) at the scene corroborated the story and said that MV1, in a 2015 BMW X535I, MA Reg: 668BG5 veered into the opposite lane and hit MV2 head-on, a 2018 Tesla Model3, MA Reg: EV585N. MV1 operator, Saptarshi Ganguly, was issued MA Uniform Citation T1440468 for 89/4a for Marked Lane Violation. A Request for Medical Evaluation form was filled out for Saptarshi Ganguly and faxed to the MA RMV at 857-368-0018 as I am unable to determine his driving ability. Both operators were transported to Newton Wellesley Hospital to be evaluated. Both vehicles had extensive front end damage and were towed by Tody's towing.

On Saturday, January 12th 2019, at approximately 4:12pm, I, Officer Brooks, responded to a single vehicle accident in the area of Cherry street and Derby street, both of which are public ways in the city of Newton. Upon arrival in the area I observed the fire department off with MV1(MA REG 9PAK20), in front of 171 Cherry street. The vehicle had a fire hydrant lodged under the front axle, and front end damage. The fire department was attempting to wake the operator who was unresponsive. The fire department ended up administering 2 doses of Narcan to the operator before he became responsive. The operator was transported to Newton Wellesley Hospital by Cataldo for further evaluation. Based on the accident scene, it appears the operator was traveling southbound on Cherry street, crossed over the center line into oncoming traffic, striking the fire hydrant in front of 154 Cherry street, and then crossed back over into the correct lane of traffic before coming to rest in front of 171 Cherry street. The vehicle was towed by Tody's towing, and an inventory form was filled out and filed. The operator was mailed MA Uniform Citations T0648078 and T0648079 charging him with MGL 89/4A Marked Lanes violation, 90/24 OUI Drugs, 90/24(2)(A) Operating to Endanger/Negligent operation, 90/11 No License in Possession, and 90/11 No Registration in Possession. Officer Donahue took pictures of the fire hydrant and crash scene, which have been submitted to the IT Bureau. The fire department was made aware of the broken hydrant.

On 01/15/2019, at 1919 hrs, I responded to the intersection of Washington St and Centre St for a two car MVA. Upon arrival, I observed heavy damage to the front end of MV1 and moderate damage to the rear end of MV2. The operator of MV2 complained of head/neck injuries and was transported to Newton Wellesley Hospital by Cataldo for an evaluation. The operator of MV1 stated she was attempting to merge onto Washington St from Centre St when she rear ended MV2. The operator of MV2 stated when she slowed to merge onto Washington St from Centre St she was rear ended by MV1. Both vehicles were towed by Tody's. Towed MV inventory forms were filled out and filed.

On the above date/time I responded to Lexington Street / Freeman Street for a two motor vehicle crash with air bag deployment. Upon arrival on scene I checked all parties for injuries. Operator of vehicle one Ms. Farnese complained of head / neck injuries and Fire and Medics responded on scene. All parties in vehicle two did not have any injuries. I spoke with the operator of vehicle one Ms. Farnese in the ambulance she stated she was slowing traveling south on Lexington Street at the intersection of Freeman Street due to the traffic signal for Lexington Street was yellow. She stated as she was slowing she felt a heavy impact from in the rear by vehicle two. I spoke to the operator of two Ms. Heimbrock, she stated she is a pastor for the Salvation Army in New York and she was transporting two children Shamah Lapaix d.o.b. 4-18-14 and Grace Lapaix d.o.b. 1-10-11 to a Christian school in Wayland. She stated that she is staying with the children at 65 Falmouth Road Newton MA with the childrens grandmother due to the fact the parents are in New York doing a continuing education program until Friday January 18, 2019. She stated she is not familiar with the area, she was traveling south on Lexington Street approaching Freeman Street when she glanced at the map on her cell phone. She stated she did not observe the color of the traffic signal and did not observe the rear brake lights in vehicle one. All parties were evaluated in vehilce two by medics with no injury. I spoke with the childrens mother Sarah Lapaix 1-203-685-2809 who confirmed Ms. Heimbrock's statement about the care of the children. I did observe an expired inspection sticker as of 12/18 on vehicle one. Therefore due to operator of vehicle two's statement I checked the rear brake lights. When the brake pedal was pressed the left brake light and top(3rd) brake light was operational but the right rear brake light was not operational. Tody's towing arrived on scene and towed both vehicles top their lot. Ms. Heimbrock made arrangements for transport of herself and the children. Ms. Farnese was transported to Newton Wellesley Hospital for non life threatening injuries. I advised all parties of the process and gave them each others information. I checked the traffic signals in the intersection and they were fully functional. Therefore with all the above mentioned I am issuing citations to both parties Operator of vehicle one citation # T1440538 for Chapter 90 Section 20 EXPIRED INSPECTION STICKER $ 55.00 Operator of vehicle two citation # T1440539 for City Ordinance 19-75 FAILURE TO USE CARE IN STOPPING $ 20.00 Both citations were filled out after investigation and will be mailed to their license address.

On Wednesday, January 16th 2019, at approximately 3:30pm, I, Officer Brooks, responded to a single car MVA in the area of 611 Watertown street. Upon my arrival Cataldo medics were treating the operator of MV1(MA REG 159EF6) for a diabetic issue. I spoke with a witness to the accident who did not wish to leave their information. The witness stated they were traveling westbound on Watertown street behind MV1, when it suddenly left the roadway to the right, striking the curb, before returning to the roadway and stopping. The witness stated that MV1 nearly missed a fire hydrant and a utility pole on the sidewalk. MV1 had a flat front passenger side tire, and minor scrapes on the body. I spoke with the medics who were still treating the operator for her diabetic issue. I observed the operator was in and out of consciousness, and unable to speak about the accident. It took several minutes for the operator to regain her consciousness, however she was still not able to answer simple questions coherently and was transported to Newton Wellesley hospital for further evaluation. MV1 was towed from the scene by Tody's, and an inventory form was filed and submitted. The area the crash occured was a high pedestrian traffic area, and both an elementary and middle school are within walking distance of the accident. An immediate threat form was filled out and filed for the operator of MV1.

Narrative:
MA commercial reg M94754 (vehicle #1), a City of Newton pickup/sander truck, was located crashed over the curb in front of 1970 Beacon St. The vehicle was unoccupied, had the keys in the ignition, and was reported stolen just a few minutes prior to discovery. The reporting party of the stolen truck and uninvolved occupant is identified as City DPW worker George Sementelli. The witness/passerby who discovered the collision is also a DPW worker, identified as Donny Brandt. Pursuant to an investigation outlined in incident #19002213, the operator at the time of the crash was determined to be Michael Carter. It is believed that Carter stole the vehicle from 295 Auburn St, fled the area, and ultimately crashed in front of 1970 Beacon St. Corroborating facts outlined in the incident report put Carter as the operator. The vehicle itself was located partially on the sidewalk and partially on the road, therefore Carter is being cited with MGL 89/4A - Marked Lanes Violation (T1268423). Due to the fact it is believed that Carter fled the scene after the crash, MGL 90/24/C - Leaving the Scene of Property Damage was added as well as MGL 90/23/D Operating After a Suspended LIcense, and MGL 90/24/O - Reckless Operation of a Motor Vehicle. The crash occurred during busy weekday commuting about 0.7 miles from Angier Elementary School. The last 3 charges mentioned have been listed on a second citation (T1268422). Officer Brooks also issued T0648082 for OUI Drugs MGL 90/24/G. See the incident report for details about this charge. In total, there are (3) citations issued to Carter. The vehicle sustained heavy front end damage. It should be noted that the utility pole a couple of houses down from the crash site (Beacon/Varick Rd, pole #212) sustained fresh, minor superficial damage, consistent with the vehicle crashing into it before verring onto the sidewalk. Pictures have been taken and submitted to the IT bureau. Tody's responded and towed the vehicle to the police garage for processing due to the pending other criminal charges involved in this accident/incident. Michael Carter was subsequently placed under arrest and his citations have been placed into his property. Carter suffered a hand injury due to the crash an was transported to NWH Hospital for an evaluation after he was booked.

On the above date/time I responded to the area 2000 Washington Street Newton -Wellesley - Hospital for a two motor vehicle crash on the 3rd floor of the parking garage. Upon arrival I met with the operator of vehicle one, she stated she was pulling into a parking spot and applied the brakes but due to the ice on the roadway and slope of the roadway her vehicle slid into the rear of vehicle two which was parked. Vehicle two was unoccupied, and dispatch tried to get in contact with the owner to advise them. I also left a message with NWH in case the owner comes back in. No injuries and I advised of the process. Later in the day the owner vehicle two came to NPD, I gave him vehicle one inforamtion and advised him of the process.

At approximately 1615HRs. on Thursday, January 24, 2019, I was dispatched to the intersection of Elliot St. and Boylston St. for a report of an MVA. Upon arrival, I located the operator of MV1 (MA Pass: 1NB459) who had pulled into the BP gas station. He stated that he was traveling Northbound on Elliot St. when his traffic signal turned red and he brought his vehicle to a complete stop at the intersection. He stated that at this time, he was rear ended by MV2. He and the operator of MV2 then got out of their respective vehicles and spoke about the collision, after a few moments, the operator of MV2 got in her vehicle and left. Using the picture of MV2's license plate (MA Pass: 3EY477) which he provided me, I was able to contact the operator of MV2 at her residence. She stated that she was traveling Northbound on Elliot St. and observed MV1 come to a stop and she applied her brakes and came to a complete stop aswell, without making any contact to MV1. She further stated that the operator of MV1 became agitated and started to yell at her. She then left because she asserts that there was no collision and she was concerned by the operator of MV1's behavior. I observed no damage to MV1's rear bumper area, with the exception of an old dent, approx. the size of a quarter, which was highlighted with some type of permanent marker. I observed no damage to MV2's front bumper area and I noted large, pronounced license plate bolts affixing MV2's license plate to its bumper. The operator of MV1 stated that he was suffering from back pain due to the collision and elected to drive himself to Carney Hospital. Due to there being no damage to either vehicle and the large plate bolts on MV2, which would have likely caused notable damage to MV1's bumper, I will not be charging the operator of MV2 with leaving the scene of an accident at this time. Both parties have been advised to contact their insurance companies and I cleared without incident.

Operator of MV1 (MA reg. 328XVF) states he was driving eastbound on Church Street and stopped at a red light. He realized he was in the left turn only lane and began turning into the right lane to proceed straight through the intersection. Operator of MV1 does not believe there was any contact between the two vehicles. Operator of MV2 (MA taxi reg. TA477C) stated he was in his lane when MV2 turned into him. I did not see any new damage to either vehicle. Operator of MV2 requested to be evaluated by paramedics. Cataldo paramedics responded and transported operator 2 to Saint Elizabeth's Hospital. MV2 was parked in Eaton Mac Kay Funeral Home parking lot and Veterans Taxi was notified. Veterans Taxi was unable to verify weather the damage on MV2 was new or old. They do not have a log of damage to the vehicle.

On Tuesday, January 29, 2019, while assigned to Traffic unit N525, I responded to the intersection of Cherry Street and Webster Street, Newton for a report of a motor vehicle accident involving a City of Newton owned vehicle. Cherry Street and Webster Street are both public ways maintained by the City of Newton. The weather at the time of the accident was overcast. The road surface was dry. The operator of MV1, John Bryant III (MA: S61611545), stated he was operating a City of Newton owned Volvo BL70 (MA MVN: M84236) Eastbound on Webster Street past Cherry Street. Bryant stated as he came to a stop in traffic, MV2 crashed into the rear of the vehicle he was operating. I observed minor damage to the rear bucket area of MV1. Bryant reported no injuries on scene and signed a patient refusal with Newton Medics. Bryant works for the Utilities Department with the DPW. The operator of MV2, Andrew Bell (NJ: B23900426706004), stated he was operating his 2013 Volkswagon (NJ: C54KKJ) Eastbound on Webster Street past Cherry Street. Bell stated he was following MV1 a little too close while they were traveling down Webster Street. Bell stated while traveling down Webster Street he looked down quickly but does not remember why, and when he looked up MV1 had come to a stop. Bell stated he could not avoid crashing into the rear of MV1. I observed significant damage to the front hood/windshield area of MV1. Bell was transported to Newton Wellesley Hospital with a minor injury. Bell was provided with Massachusetts Uniform Citation T1272991 in hand for Newton City Ordinance Chapter 19 Section 71 (Following Too Closely) . Pictures were taken of both vehicles and submitted to the IT Bureau.

On 02/07/2019, while assigned to N494, I, Officer Conary, responded to a MVA at Franklin Street and Waverly Ave. I met with the Operator of MV1 who stated that he was driving Northbound on Waverly Ave when MV2 came into his lane from Franklin Street and hitting him on the left side. Operator of MV2 stated that he was stopped at the stop sign at Franklin Street and proceeded to take a left turn onto Waverly Ave. At this time, MV2 thought MV1 had a stop sign and was going to stop. MV2 hit MV1. There is no stop sign on Waverly Ave at Franklin Street. Operators of each vehicle were offered and declined medical attention. Operator of MV2 was a Lyft driver and was driving three others in the vehicle. Two occupants were offered and accepted medical attention. Both were transported to Newton Wellesley hospital. The other occupant (Paige) declined medical attention. She had a air cast on from a previous injury. MV1 could not be driven from scene. It was parked legally and safely on the side of the road. Operator of MV1 will get a tow later on. MV2 was able to be driven from scene. Operator of MV2 continued to drive Paige home. No further incident to report.

MV#1 Stated while traveling westbound down Commonwealth ave he struck a patch of ice. The ice caused his vehicle to rotate 360 degrees and proceeded to slide on the roadside shoulder striking a verizon poll ( 102/285). MV#1 traveled approximately 12ft from the road before striking the poll. MV#1 sustained heavy front end damage. MV#1 had all airbags deployed and had a small fire under the front end. I observed multiple other vehicles passing having difficulties and vehicles sliding due to significant ice conditions. Driver of MV#1 had injuries to his left arm, possible broken forearm/wrist. Passenger of MV#1 stated she had chest pains. Medics transported both parties to Newton Wellesley Hospital for further evaluation. Tody's Towed the vehicle due to heavy front end damage.

Opr of V2 stated he was behind V1 on Centre Street. Opr states both vehicles were waiting to turn right onto Washington Street. Opr states he was looking left waiting for an opening and did not look to see if V1 was moving. At this time, Opr of V2 started to travel forward and made contact with the rear of V1. Opr of V1 was not on scene due being pregnant. Her father Tom Sharpe was on scene and stated his daughter was waiting to turn right and was struck from behind. Sharpe stated his daughter had some pain to her neck and stomach region and his wife took her to the hospital. Both vehicles suffered minor damage and were not towed. Opr of V1 sustained minor injuries and went to the hospital with her mother. I was unable to make contact with Opr of V1, but Opr of V2 stated he knew he was at fault.

At approximately 0110HRs on Sunday February 17, 2019, I was dispatched to the area of Dedham St. and Spiers Rd. (both public ways in the City of Newton), for a report of a motor vehicle vs pole accident with injury, airbag deployment and entrapment. Upon arrival, I exited my cruiser with my medical bag and AED and went to assist the motorist involved in the crash. MV1 (MA Passenger: 255ZA9) was completely off the roadway and on the shoulder of the road (facing Eastbound) with its nose contacting the light pole ( Verizon Pole #:103/80), which was now broken and listing to the side. Attempts to open the doors were unsuccessful and I attempted to communicate with the operator through a partially broken driver's window frame which was bent. The operator was slumped forward with his hand cradling his head and he was unable to speak, but was breathing. Newton Fire arrived and attempted to gain access to the vehicle via several manual tools with no success and instead deployed the Jaws of Life which was successful. Newton Fire also made entry into the rear passenger compartment because we viewed a child's car seat and checked with negative results for any child in the vehicle. Once the operator was cut out of his seatbelt and safely out of MV1 and on board Newton Medic 1, I entered the ambulance where he was identified as Mark Topham. It should be noted that Topham was having difficulty answering basic questions such as his name, date of birth, today's date, Etc. At one point when he was asked what today's date was, he gave his birth date of February 21, 1983 and it took him several attempts to say his last name, I had to run him over the air with a partial name to ascertain who he is. Also of note, in my presence and that of Sgt. Devine, Topham informed the medics that he had been consuming alcoholic beverages prior to the crash. Upon viewing the scene, I noted that the roadway was lit and I did not observe any skid marks on the dry, ice-free payment, indicating that there was unlikely any braking or swerving to avoid the collision. I spoke to the reporting party, Lindsay Giardina, she stated that she was traveling on Dedham St. when she heard what she believed to be a motor vehicle crash. When she came upon said crash, she attempted to assist the operator, as she was an off duty firefighter. She was unable to gain access to the inside of the vehicle, but communicated to the operator in the same manor as I did. She stated that she was able to smell the odor of an alcoholic beverage emanating from the operator. Topham was transported to Beth Israel of Boston, where he was assigned patient record number 3109921. I attempted to speak with him at the hospital, but was unable to do so because of his current state; I noted several injuries on Topham, such as a bloody lip, a wound to his lower left side and a wound to his left leg. Due to Topham's statements onboard of Medic 1 and Lindsay Giardina's observations, I will be charging Topham with one count of violating MGL Ch.90 S. 24 K OUI Liquor 2nd Offence, one count of violating MGL Ch.90 S. 24 E Negligent Operation of a Motor Vehicle and one count of violating MGL Ch. 89 S. 4A Marked Lanes Violation via MA Criminal Citations which I placed in the mail. Additionally, I will be seeking a subpoena for Topham's blood work from the hospital. Note: The crash occurred on the Newton/Boston line, Newton dispatch's GPS indicated that the crash was in Newton. I took several pictures of the scene and have forwarded them to IT to be attached to this report. I completed and filled an NPD Motor Vehicle Tow Inventory Form and Officer Boudrot stood by for the tow.

On 03/07/19 at 08:29 hours, I responded to a two car motor vehicle accident at Needham & Oak Streets. The operator of M/V # 1 states she blacked out upon impact of the accident. She was immediately transported to Newton Wellesley Hospital by Cataldo Ambulance for a possible head injury. After at the hospital, Operator of M/V # 1 states she was traveling straight ahead (WB) on Needham Street at Oak Street with the green light signal in front of her. As she approached the intersection, M/V # 2 suddenly attempted a left turn from the opposite side of the road and she was not able to stop in time. M/V # 1 sustained passenger front end damage and the vehicle was towed by Tody's as the operator was transported to the hospital. Operator of M/V # 2 states she was in the left turn lane on Needham Street facing eastbound attempting to take a left turn on to Oak Street. She states that she thought it was clear to proceed and M/V # 1 came out of no where and struck her on her rear passenger side. At first, the operator told me the signal light was green and then after stated that the light was changing to red when she was proceeding through. The vehicle sustained rear passenger side rear wheel and axel damage and it was towed by Tody's. Based on both operator statements, it appears that the operator of M/V # 2 did not yield the right of way and attempted to turn left when it was not clear to proceed. The operator was issued and mailed MA Uniform Citation # T1441703 for Ch. 89/8.

As she was pulling up to stop for the Valet, her leg hit the gas pedal instead of the brakes. On the above date/time I responded to the area of Cherry Street and Webster Street for a three motor vehicle crash with injuries. Upon arrival along with Sgt. Dempsey, Fire/medics. I spoke with the operator of vehicle one. He stated he was stopped on Webster Street facing westbound a the red traffic signal. He further stated the traffic signal on Webster Street turned green, he accelerated forward. He stated vehicle two traveled north on Cherry Street at a high rate of speed through the red traffic signal. He stated he had no reaction time due to the speed of vehicle two and had impact. I spoke to the operator of vehicle two. He stated he was traveling north on Cherry Street going too fast, he stated he thought it was a school zone so he slowed down and he did not observe the color of the traffic signal. He stated he observed vehicle one come out of the Webster Street at the last second at impact. I spoke with the operator of vehicle three. She stated only remembered being stopped on Cherry Street facing south. She stated she did not remember what color the traffic signal was, just knew she was stopped when she felt heavy impact from vehicle two. Injuries: Oper of V1 none at this time- patient refusal Oper of V2 none at this time - patient refusal Oper of V3 Head laceration and head trauma, transported to Newton- Wellesley Hospital Tody's towing arrived on scene and towed vehicles two, three to their tow lot. All proper paper work was done for a towed vehicle(s). All parties advised of the process. After the vehicles were towed, and the scene was cleared I watched the cycling of the traffic signals in the intersection and observed they were functioning properly. It appears a this time based on statements and physical characteristics of the impact area on the roadway, that vehicle two went through the red light on Cherry Street, which caused the crash.

The operator of vehicle 1 stated that with a green left turn arrow showing, and her left directional on she went to turn onto Waltham Street from Crafts Street when all of the sudden she hit a bicyclist. She stated she did not see the bicyclist at all prior to him hitting her car. The bicyclist stated does not remember anything from the accident at this time. The bicyclist was traveling southbound on Crafts Street and appears to have entered the intersection of Crafts and Waltham Street without stopping and while a red light was showing. He was wearing a helmet at the time of the crash, he was not wearing any reflective clothing(dark green jacket), and the bike did not have any lights. The bike was taken to support services for safe keeping by Ofc. J.March. Vehicle#1 was towed away by Tody's towing due to extensive damage. Bicyclist was transported to Beth Israel hospital for several trauma injuries. Pictures of scene was taken by me and sent to IT Bureau. Both witness's statements were the same. They stated that they were behind vehicle 1 in traffic and saw that she had on her left dirrectional signal and had a green left arrow signal when vehicle 1 went to turn left onto Waltham Street.

On 04/08/2019, at 1620 hrs, I responded to the area of 2040 Commonwealth Ave for a three car MVA with injuries. Upon arrival, I observed all three vehicles facing westbound on Commonwealth Ave. MV1 had heavy front end damage and airbag deployment. MV2 also had heavy front end damage and airbag deployment. MV3 had minor rear end damage. The operator of MV1 was brought to Newton Wellesley Hospital by Cataldo medics. The operator of MV2 stated she was on Pamela Ct attempting to take a left onto Commonwealth Ave. There was heavy traffic headed westbound and a vehicle stopped to let MV2 go. As MV2 was taking a left onto Commonwealth Ave, MV1 was traveling westbound in the eastbound lane around traffic and struck MV2. MV2 then in turn struck MV3s rear end. The operator of MV3 stated that he wasn't sure what occurred because the accident was behind him. The operator of MV1 stated she was traveling westbound on Commonwealth Ave and was planning on taking a left into the Star Market parking lot which was approximately 250 feet down the street. She stated she thought there were two lanes in the westbound direction at that point in the roadway. MV2 then pulled out in front of her and they collided. Two witnesses who were traveling westbound in traffic a few vehicles behind MV3 both stated that MV1 drove erratically into the oncoming lane and around traffic heading westbound. One witness stated "the car was almost completely in the opposite lane" and the other witness agreed. A moment later they stated they heard the crash but did not see it. They also stated that she almost crashed into a car turning eastbound out of the Star Market exit prior to the accident. MV1 and MV2 were towed from the scene by Tody's. The operator of MV2 was brought to Newton Wellesley Hospital by her mother. The operator of MV1 was cited for C90 S23 operating after revoked license, C90 S23 operating after revoked registration, C90 S24 operating to endanger, and C89 S4a marked lanes violation. All aforementioned streets are public ways maintained by the City of Newton.

On Tuesday, April 16, 2019 while assigned to Traffic unit N525, I responded to the area of Plymouth Road and Cochituate Road, Newton for a report of a motor vehicle/pedestrian accident involving a City of Newton vehicle. The weather at the time of the accident was clear and sunny. The road surface was dry. Plymouth Road and Cochituate Road are both public ways maintained by the City of Newton. The injured pedestrian, Officer Steven Emmanuel, was transported to Newton Wellesley Hospital prior to my arrival on scene. I spoke with the operator of MV1, Officer Justin Lau. Lau stated he was on duty in his official capacity as a Newton Police Officer while operating a City of Newton owned 2018 Ford Fusion (MA: 9PYM80, Newton PD #1319). Lau stated he was parked on Plymouth Road (N) at Cochituate Road and was speaking with Officer Steven Emmanuel. Lau stated Emmanuel was standing next to the front driver side door area of his vehicle in the roadway. Lau stated a large delivery trucked approached their location on Plymouth Road from Woodward Street and was attempting to make a right turn onto Cochituate Road. Lau stated Emmanuel directed him to back his vehicle up so the delivery truck could get by their location. Lau stated he cut the wheel of the vehicle he was operating to the right; and very slowly began to back up from his location. Lau stated he was attempting to back the vehicle up to get closer to the curbing and out of the roadway. Lau stated as the vehicle was in motion the front driver side wheel made contact with Emmanuel's left foot. Emmanuel's left foot subsequently became lodged in the front driver side wheel well area. Emmanuel fell to the ground in obvious pain. Emmanuel directed Lau to pull the vehicle forward in an effort to release his foot. Emmanuel's foot was freed and NPD Dispatch was notified of the accident. Pictures were taken of MV1 and submitted to the IT Bureau. I observed no damage to the front driver tire area. I spoke with Officer Steve Emmanuel in the Newton Wellesley Hospital emergency room where he was being evaluated for a left foot injury. Emmanuel stated at the time of the accident he was working a paid detail for Paramount Pictures on Plymouth Road in his official capacity as a Newton Police Officer. Emmanuel stated he was speaking with Officer Lau on Plymouth Road at Cochituate Road. Emmanuel was standing in the street on his post and Lau was sitting in MV1 (parked). Emmanuel stated a Fed Ex delivery truck approached their location in the roadway and was attempting to get by them. Emmanuel stated Lau began to back his vehicle up in an effort to get out of the way of the delivery truck. Emmanuel stated the front driver side tire of MV1 ran over his left foot. After the tire ran over his foot, it then became lodged in the wheel well and he fell to the ground. Emmanuel stated his foot was freed from the vehicle and he was transported to Newton Wellesley Hospital by Newton Medics for further evaluation.

The operator of Vehicle #1, identified as Ms.Erzsebet Piros, stated that she took a left turn from Walnut St onto Washington St prior to the colliding with Ms. Kim Nguyen. She further stated that she did not see the pedestrian prior to hearing the collision. Her passenger, identified as Ms. Amy Torres, was sitting in the front passenger seat. She stated a similar account, and did not see the pedestrian prior to the collision. Neither party complained of injury, when asked. A witness, Ms. John Angelucci, was travelling in his vehicle, in the lane next to Ms. Piros. He stated that he only heard the collision, and couldn't see it due to vehicle lights, and the falling rain. The pedestrian, Ms. Kim Nguyen, stated that she attempted to cross the street, when she did not see any cars coming. She stated that she didn't see Vehicle #1 approaching until it was too late to get out of the way. It should be noted that Ms. Nguyen was not attempting to cross inside of a crosswalk, and was wearing dark colored/Navy Blue clothing. Ms. Nguyen was transported to Beth-Israel Hospital, and was communicating effectively prior to transport. Pictures of the scene, and damage to the vehicle were taken, and sent to IT for entry.

I then cleared without further incident. The main crash factor was due to the weather being a heavy rain storm at night. It should be noted there is a yield sign facing MV1s incoming direction.

Vehicle 1 was parked unoccupied in the employee parking lot of Newton Wellesley Hospital when it was hit by Vehicle 2. The operator of vehicle 2 stated she was correcting her parking job and tried to back up, but the car was actually in drive and not reverse. the car drove forward hitting vehicle 1 going over a curb and hit a tree a few feet past the curb. This caused minor damage to Vehicle 1 and major front end damage to Vehicle 2 as well as front air bag deployment. Since this occurred on hospital grounds the operator of vehicle 2 walked herself to the ER for precautionary reasons and was cleared. Vehicle 2 remained in the parking area for a private tow company.

On Sunday, May 5th, 2019 at approximately 1315 hours while working the City of Newton detail for the Walk for Hunger I was standing at my assigned post at the intersection of Centre Street and Willow Street. At the time, the road surface was dry and the weather was cloudy. Traffic was particulary heavy as there were several streets in the area still blocked off for the Walk for Hunger and there were participants still walking the route in the area. My attention was drawn to the intersection of Centre Street and Bowen Street as there was a motor vehicle travelling southbound on Centre Street with their left turn signal on attempting to take a left turn on to Gibbs Street. Gibbs Street was temporarily blocked to non-residential motorists as there were several pedestrians in the road crossing over Gibbs Street. As the motor vehicle attempted to turn, there were several pedestrians in the crosswalk crossing over Gibbs Street. The vehicle had stopped halfway into the northbound lane on Centre Street blocking on coming traffic. The operator appeared to realize Gibbs Street was blocked and attemped to turn the vehicle back into the southbound lane to continue southbound on Centre Street. As the vehicle turned back into the southbound traffic lane, the vehicles rear end collided with Officer Richard Clements, who was operating NPD motorcycle unit 533. Officer Clements was traveling southbound on Centre Street and was passing the vehicles in the southbound traffic lane which were currently all at a standstill. Officer Clements had his emergency lights activated as he was on his way to remove traffic cones from the street to open up all the traffic lanes along the event route. Officer Clements was working the City of Newton detail for the Walk for Hunger assigned to the motorcycle to assist with traffic. Officer Clements front wheel, left side of the motorcycle and left leg collided with the rear end of the motor vehicle. The impact of the crash caused him to fall off the left side of the motorcycle and land on the street face first. At this time I immediately ran from my post to Officer Clements location and radioed dispatch that a motorcycle officer was down and that I needed assistance. As I approached Officer Clements he was face down, unconcious and breathing. I was able to roll Officer Clements into the recovery position and at this time Officer Clements regained conciousness and was able to speak and stated " What happened? What was that lady doing she turned right into me". I advised Officer Clements that he had just been involved in an accident and to stay still and that help was on the way. The operator of the motor vehicle identified as Helen Leibner (S52717988) stopped her vehicle immediatley after the crash and got out of her vehicle to offer her assistance. I advised Helen and several other witnesses and bystanders who were now crowding around Officer Clements and I to back away from the scene and to not move any of the vehicles involved. Officer Selig arrived on scene and was able to help crowd control until further help arrived. Helen and all witnesses were advised to stand by for police to take their statements. While tending to Officer Clements he was disoriented and made several attempts to move his body to which I had to physically hold him still to prevent possible further injuries. While speaking with Officer Clements I noticed blood coming from the inside of his mouth. Officer Clements was in a noticeable amount of pain. He complained of head, back and left leg pain. Officer Clements was wearing a yellow ANSI certified Newton Police reflective jacket and a Newton Police issued motorcycle helmet. Once the paramedics and fire personnel arrived I was able to speak to the operator of the motor vehicle and several other witnesses. Helen stated she was traveling southbound on Centre Street operating her blue 2014 Audi A4 (MA REG 213BC9). Helen states she was attempting to take a left turn onto Gibbs Street and activated her left turn signal. Helen states she had stopped halfway into the northbound lane as several pedestrians were crossing Gibbs Street in the crosswalk at the time. Helen states after the pedestrians cleared she saw the traffic cones blocking the street and realized the street was closed. Helen states she turned her vehicle back into the southbound traffic lane and did not see Officer Clements or the motorcycle until impact. Helen was not injured and her motor vehicle sustained moderate rear end damage. Her motor vehicle was able to drive away from the scene. Witness Adron Gordon (S90357161) stated he was participating in the Walk for Hunger and had just crossed over Gibbs Street when the crash occured. He stated he witnessed the Officer on the motorcycle with the emergency lights on traveling southbound on Centre Street behind the motor vehicle. The motor vehicle stopped in traffic attempting to turn left onto Gibbs Street. He states then the vehicle made a slight turn back into the southbound traffic lane and the motorcycle collided with the rear end of the motor vehicle. He states the Officer then fell off the motorcycle landing in the middle of Centre Street. Witness Elizabeth McCarthy (S00242346) and Katherine Regan (S43486601) stated they both were in the same vehicle together stopped in traffic in the northbound lane of Centre Street just before the set of lights at Centre Street and Bowen Street. Both witnesses stated they do not remember if the driver of the motor vehicle had the turn signal on but they did see her attempt to turn onto Gibbs Street. They stated they also saw the motorcycle with emergency lights activated travel southbound on Centre Street approaching behind the vehicle. Witnesses state the motor vehicle then suddenly turned back into the southbound lane and the motorcycle collided with the passenger side tailight of the motor vehicle. Both witnesses state the motorcycle attemped to turn away from the vehicle to avoid the crash but was unable to do so. Witness Nina Wang (S39460985) stated she was parked on the southbound lane of Centre Street just prior to the crash scene. Nina states she was in her City of Newton DPW marked vehicle with the hazards on as she was working to assist with traffic safety for the Walk for Hunger. Nina states she witnessed the motorcycle travel southbound on Centre Street and pass the vehicles stopped in the traffic lane. Nina states the motorcycle passed the traffic using the left side and had the emergency lights activated. Nina states the motorcycle was just passing through the green light at Centre Street and Bowen Street when the motor vehicle that was stopped at the lights attempting to take a left turn onto Gibbs Street. Nina states the vehicle then abruptly jerked her car to the right and collided with the motorcycles left side. Nina states she heard a loud crash and witnessed the Officer fall off the motorcycle and land face first onto the street. The motorcycle's final resting place was on its left side approximately two feet away from where Officer Clements was located. The motorcycle sustained moderate damage to its left side, including the front wheel well and undercarriage. The motorcycle left scuff marks on the street which were measured and photographed. Several photographs of the scene and damage to both vehicles were taken and submitted to the IT Bureau. The motorcycle was towed by Todys. Centre Street and Bowen Street are both public ways maintained by the City of Newton. The injured motorcyclist, Officer Clements, was transported to Saint Elizabeth Hospital with fire fighters on board. I was able to follow up with Officer Clements on the phone the next day who was admitted over night at the hospital. Officer Clements stated he has no recollection of the accident and can only remember driving down Centre Street to begin to pick up cones to open up all lanes of traffic. Officer Clements stated he suffered a brain bleed, head, back, left foot and right thumb injuries. A Massachusetts Uniform Citation was issued and mailed to Helen for Chapter 89 Section 7A, failure to yield to emergency vehicle, police motorcycle.

I responded to the area of Commonwealth Ave@Lexington st at approx 1610 hrs on 05/09/2019 for a report of a H&R/MVA. I arrived in the area and located Sarah Hamilton. Sarah informed me that she was on Comm. Ave (westbound) stopped attempting to turn left into the Dunkin Donuts parking lot. Sarah stated she was rear ended by a silver sedan operated by a female operator. Sarah spoke with the unidentified woman, who refused to exchange information. The woman returned to her vehicle and left the area. Sarah could not get the license plate, vehicle make /model. Sarah Hamilton complained of neck pain. EMS responded to medically evauate her. Sarah did not want to be transported to the hospital and signed a refusal/waiver with EMS. The only damage I observed to V1 was paint scratches along the rear bumper. The rear bumper was intact free of any dents/creases.

Emery Mays states that he took his fathers vehicle Ma. Reg 8BL949, this morning. Emery states that he got lost and ended up in the parking lot at 333 Nahanton St which is only accessible by the Jewish Community Center's access road and Nahanton Street (public way in the City of Newton). Emery then proceeded to do "doughnuts" in the muddied lot. Emery then lost control of the vehicle and struck a parked storage container causing minor damage. Both airbags were deployed. Emery does not have a license and was transported to NWH (as he is a juvenile and a parent could not sign a refusal in a reasonable time period ). He attends the Fusion Academy in Newton. I spoke with Emery's father Randolph Mays. I told Randolph of the accident. Randolph stated that he did not give Emery permission to take his vehicle. Randolph stated that he would meet Emery at NWH. I told Randolph that Emery was going to be charged wit Ch.90 Sec.10 unlicensed operation of a m/v, citation # T1272114 (in the mail due to his being at the hospital). I also advised that he could take out his own charges against Emery for using without authority if he chooses to do so. Todys towed the vehicle. JCC staff were notified of the incident.

On 05/20/2018 at 17:30 hours I was notified by Captain Anastasia of a motor vehicle crash involving car, and an electric scooter. Captain Anastaisa stated that the operator of the scooter was a 12 year old male who had sustained unknown injures and had been transported to Boston Children's Hospital via ambulance. Upon my arrival at the crash scene I made the following observations, Putnam and Winthrop streets are public ways in the city of Newton that are two way single lane non divided roadways. The roadway surface was wet from rain earlier in the day. Putnam St runs north to south and Winthrop St runs east to west. There is a stop sign at the end of Winthrop St at Putnam St. I observed MA reg 54MN41 a 2005 Buick LeSabre stopped in the south bound lane of Putnam St approximately 1/2 of the way into the intersection with Winthrop St. I observed approximately three feet of skid marks from the Buick's rear tires. I also observed at the crash scene a Segway Ninebot electric scooter that was on the ground near the Buick(cid:31)s rear passenger side door with its handlebars detached. I spoke with the operator of the Buick, Robert DeSouza who stated that on 05/20/2019 at approximately 16:50 hours he was driving south bound on Putnam St at approximately 25 miles per hour. DeSouza stated that he saw a man, later identified as Jose Estabil standing on the east sidewalk of Putnam St facing Winthrop St who was yelling and waving his arms at something on Winthrop St. DeSouza stated he looked to his right towards Winthrop St and his view was obstructed by a row of hedges. DeSouza stated that as he was looking to his right he began to apply his vehicle's brakes when he saw someone coming at me ". DeSouza stated that he heard a crashing noise from the rear passenger's side of his vehicle. DeSouza stated that he stopped his vehicle after the crash and saw a boy lying on the ground at the rear passenger side of his vehicle. DeSouza stated that he was not injured in the crash. DeSouza's vehicle had minor damage to its rear passenger side door, and did not require a tow. Witness Charlotte Hart stated that at approximately 16:30 hours on 05/19/2019 she was diving south bound on Winthrop St. Hart stated that she had to stop short on Putnam St to avoid a crash " with a boy on a scooter that was racing around on Winthrop St. " Hart sated that she told the boy on the scooter that he should not be ridding the scooter in the street. Witness Jose Estabil stated that he was walking on the east side walk of Putnam St across from Winthrop St. Estabil stated that he saw a boy an electric scooter on Winthrop St approaching Putnam St. Estabil stated that he saw DeSouza's vehicle driving south bound on Putnam St approaching Winthrop St. Estabil stated that the boy on the scooter made no effort to stop, slow or avoid the crash with DeSouza's vehicle. Witness Laurel Fransworth stated that she was driving north on Putnam St approaching Winthrop St when she saw the crash occur. Farnsworth stated a boy on an electric scooter on Winthrop St crash into the rear passenger side door of DeSouza's vehicle. Fransworth stated that she believed that the row of hedges at the end of Winthrop St obstructed DeSouz's vehicle. Rowan Delaney ( 02/27/2007 ) stated that on 05/20/2019 at approximately 16:00 hours he and his fellow F.A. Day Middle School student Thiaugo Rubino ( 03/04/2007 ) were having a race around the area of Winthrop St, Putnam St and Shawn St. Delaney stated that he was on foot running on sidewalks while Rubino was on an electric Ninebot Segway scooter. Delaney stated that Rubion was not wearing a helmet or any other safety equipment. I spoke with Delaney(cid:31)s father Royston Delaney, who stated that the scooter was his and that he was unaware that Rubino was using his scooter, and that he has never seen him ridding it before. Royston Delaney stated that the scooter is battery powered and has a maximum speed of 19 MPH. Royston Delaney stated that his son told him that only Rubino was ridding the scooter. Rubino was transported via ambulance to Boston Children(cid:31)s Hospital. On 05/20/2019 Rubino underwent surgery for a brain bleed. I spoke with Rubion(cid:31)s mother Sonia Rubino who stated that as of 05/21/2019 her son was under observation and in addition to the brain surgery her son had a broken arm, broken leg and a broken back. Based upon witnessed statements and my observations of the crash area I believe that Rubion was at fault for the cause of this crash. Myself and Officer Helms took photos of the crash area and the disks were turned over to the NPD(cid:31)s IT bureau for downloading.

Thangthong stated that she did no see anything in the driveway prior to her pulling into it. Thangthong stated that she felt the front of her vehicle strike what she described as " something " and stopped her vehicle. Thangthong stated that she put her vehicle in reverse and then into park and exited her vehicle to see what she had struck. Thangthong stated that she saw her two nieces, Kalla Mongkhonlertsirkul age three and Kelley Mongkhonlertsirkul age seven laying in the driveway in front of her vehicle. Thangthong stated that she then realized that her vehicle had stuck her two nieces as they were in the driveway. Both of the Mongkhonlertsirkul sisters were conscious and alert and were able to walk to an ambulance for transport to Newton Wellesley Hospital for treatment. Thangthong stated that she and her son were not injured in the crash. I observed no damage to Thangthong's vehicle. I responded to the Newton Wellesley Hospital and spoke with the Mongkhonlertsirkul sisters and their mother Piyada Kellum. Kellum stated that her oldest daughter Kelly is a student at the Franklin Elementary School . Kellum stated that her daughters told her that they were playing in their driveway when their aunt's vehicle entered the driveway and did not stop. I spoke with both of the Mongkhonlertsirkul sisters who told me that they tried to get out of the way of their aunt's vehicle but could not in time. The Mongkhonlertsirkul sisters stated that they were both struck in the back and fell to the ground between the two front tires of their aunt's vehicle. Kalla Mongkhonlertsirkul had scrapes to her right knuckles. Kelly Mongkhonlertsirkul had lacerations to her lower left arm and the left side of her face near her eye. I spoke with hospital staff who stated that there did not appear to be any broken bones or other internal injures. I took photos of the crash area and forwarded the disk to the NPD's IT bureau for downloading.

I spoke with Alicia LOWE who was operating FL Reg BWDG86 who stated she was travelling eastbound turning right into the parking lot when she collided with Helen COOK operating Ma Reg 3AT486 who was turning left into the parking lot from the west bound lane of Washington St. Both LOWE and COOK were complaining of pain but both signed refusals with Cataldo. Todys Tow responded and took both vehicles.

On 06/08/2019 at 0150 hours I received a call from Sgt Lee in regard to a head on motor vehicle crash with entrapment that had occurred on Center St at the four way intersection with Cabot St and Sergeant St. Upon my arrival at the crash scene I was advised by Sgt Lee that all occupants of the involved vehicles had been transported to hospitals for treatment. I made the following observations of the crash scene , Center St is a two lane public way in the city of Newton that runs north to south. I observed a city of Newton contracted Cataldo ambulance stopped in the south bound lane of Center St at Cabot St. The ambulance was MA AMN registration AMB 370 a 2017 Ford Econo Line that had heavy damage to the front end and driver's side fender. I observed that the front tire of the ambulance was snapped off and was pushed back towards the driver's side door. I further observed that both of the front and side air bags of the ambulance were deployed. The front of the ambulance's final point of rest was 8'8" from a fixed overhead light pole on the northeast corner of Center St at Cabot St. The ambulance's front passenger side tire was 4'3" front the curb on the Cabot St side. The ambulance's rear passenger side tire was 2'3" from the Cabot St side curb. The ambulance's rear driver side tire was 5'1" from the double yellow line on Center St. The ambulance's front driver side tire was 6'3"from the Center St double yellow line. The width of Center St from the double yellow line to the Center St curb is 15'' and 16'" to the Sergeant St side. I observed a 2011 Mazda 3 with MA PAN registration 6KJ783 facing south bound in the north bound lane. The Mazda had heavy damage to it's front end, and I observed that it's front tires had snapped off. The Mazda's roof had been removed by Newton Fire to extract the occupant. The front of the Mazda's final point of rest was 40'3" from a fixed overhead light pole on the northeast corner of Center St and Sergeant St. The Mazda's front passenger tire was 4'6" from the double yellow line on Center St. The Mazda's rear passenger side tire was 7'6" from the Center St double yellow line. The Mazda's rear passenger side tire was 1'2" from the Center St double yellow line. The Mazda's front driver's side tire was on the curb on the Sergeant St side of Center St. There were no skid marks from the Mazda which indicates that no braking occurred. At the time of the crash, the Cataldo Ambulance was being operated by Paramedic Corey Bohan and Paramedic Tom White was in the front passenger seat. Bohan stated that he was operating his vehicle southbound on Center St towards Cabot St after clearing a medical call. There were no patients in the ambulance at the time of the crash, and Bohan estimated he was travelling 25 MPH . Bohan stated within less than two seconds he observed a vehicle traveling towards him northbound on Center St in the southbound lane and estimated it's speed to be approximately 80 to 100 MPH.Bohan stated he was able to slow to a near stop and had moved his vehicle towards the right shoulder on Center St before the Mazda struck his vehicle head on. Bohan stated that after forcing his way out of the driver's seat of his vehicle, he rendered medical aid to the operator and only occupant of the Mazda, Jessica Pondish. Bohan stated that Pondish speech was slurred and he detected an odor of an alcoholic beverage emanating from her breath and person. Bohan was later transported to Newton Wellesley Hospital for evaluation. The passenger in the ambulance, Tom White stated to officers that he was working on the ambulance's laptop computer and did not see anything leading up to the impact from the crash. White stated that he was able to force himself free of the passenger side of the ambulance, and rendered medical aid to Pondish. White stated that Pondish was " in and out of it " and did not appear coherent.White stated that he asked Pondish if she had consumed any alcoholic beverage and she nodded in the affirmative. White Stated that he was unsure if Pondish understood his questions. White stated that he did not detect any odor of an alcohol beverage emanating from Pondish's breath or person. White was transported to Newton Wellesley Hospital for evaluation. Pondish was freed from her vehicle after approximately 22 minutes by Newton Fire Department units by utilizing special extraction tools. Pondish was transported by Newton Medic Unit Two to the Brigham and Women's Hospital in Boston for treatment. From 06/08/2019 to 06/10/2019 Pondish had two surgeries and was unable to speak due to her condition. On 06/10/2019 myself and Officer Gaudet were able to speak with Pondish in her hospital ICU room at the Brigham and Women's Hospital. Pondish's parents Lorena and John Pondish were present while we spoke with her. Officer Gaudet asked Pondish about the events that led up to the crash. Pondish stated that on 06/07/2019 she was at a friend's residence in Norton, MA. Pondish stated that while at her friend's residence she consumed a bottle and a half of Riesling wine. After Pondish's admission myself and Officer Gaudet stopped our conversation with her. I read Pondish her rights directly from a Miranda card and explained them in full before allowing her to continue speaking with myself and Officer Gaudet about the events of that led to the crash. Pondish stated that she understood her rights. Officer Gaudet asked Pondish if she had consumed any alcoholic beverages prior to driving home to her residence in Newton. Pondish stated that she drank a bottle and a half of Riesling wine by herself between the hours of 1700 and 0000 hours on 06/08/2019. Officer Gaudet asked Pondish how large the bottles of wine was that she drank, and she stated that they were average size. Officer Gaudet asked Pondish how she perceived her state of being was after consuming a bottle and a half of wine. Pondish stated that she felt " buzzed " . Pondish stated that she left her friend's residence in Norton at approximately 0100 hours on 06/08/2019 to return to her residence in Newton. Pondish stated that she does recall the events leading up to the crash, except that she tried to make a phone call but the person did not pick up. Pondish stated that her seat belt was on and that she was not texting while operating her vehicle. Pondish stated that her injuries consisted of a broken left elbow and internal injures to her intestines. On 06/09/2019 I spoke to Cataldo Paramedic Robert Canning and Stephen Heirholcer who were the medic unit that transported Pondish to the Brigham and Women's Hospital. Canning stated that he rendered medical aid to Pondish for approximately 20 minutes while Fire units worked to free her. Canning stated that Pondish's legs were pinned under her vehicle's dashboard. Canning stated that during the approximately 20 minutes that he was in close proximity to Pondish he could detect a strong odor of an alcoholic beverage that was emanating from her breath and person. Canning stated that once Pondish was freed he continued to treat and monitor her during the transport to the Brigham and Women's Hospital. Canning stated that when he asked Pondish if she had consumed any alcoholic beverage she stated that she had. Paramedic Heirholcer stated that he did not detect any odor of an alcoholic beverage emanating from Pondish's breath or person. Based upon the physical evidence at the crash scene, and statements made to officers by all of the above mentioned persons, Pondish is being charged with violation of MGLs 90/24j OUI liquor, 90/24e negligent operation of a motor vehicle, 89/4a failure to stay within marks lanes, and 90/17 speeding. On 06/12/2019 at the conclusion of the crash investigation I issued MA Criminal Application T 1269996 in hand to Pondish at her hospital room and explained to her what action she needed to take with court. On 06/11/2019 a letter of preservation was sent to Brigham and Women's Hospital requesting that a sample of Pondish's blood, urine and medical records be saved. On 06/12/2019 Brigham and Women's Hospital confirmed that a sample of Pondish's blood had been preserved. As of 06/12/2019 a search warrant for Pondish's blood sample was pending. Photos of the involved vehicles and of the crash scene were taken and downloaded by the NPD's IT Bureau. Both involved vehicles were towed from the crash scene and towed motor vehicle forms were filled out. An Iphone and backpack belonging to Pondish were taken from her vehicle for safekeeping and returned to her on 06/11/2019. A copy of this report was faxed to the MA RMV Driver Control Unit to request an immediate threat suspension.

Operator of vehicle one, Benjamin Beaver stated that while driving south bound near 321 Walnut St his vehicle ( MA reg 551DK8 2014 Lexus ) made contact with a pedestrian in a marked crosswalk. Walnut St is a public way in the city of Newton. Beaver stated that he did not see the pedestrian prior to the crash and that his vehicle was travailing approximately 5 to 10 MPH. Beaver stated that the pedestrian was knocked to the ground but got up and walked around. The pedestrian, NNHS student Benjamin Donovan stated that he was crossing east to west in the marked crosswalk in front of 321 Walnut St. Donovan stated that he saw Beaver's vehicle approaching him at approximately 5 to 10 MPH. Believing that Beaver was stopping to let him cross , Donovan stated that he held up his left hand to signal to Beaver that he was going to cross. Donovan stated that Beaver's vehicle struck him on his left side and knocked him to the ground. Donovan stated that he had minor scrapes on his right side as a result of falling to the ground. Donovan stated that he did not lose consciousness and was transported via EMS to Newton Wellesley Hospital for treatment. I took photos of Beaver's vehicle and forward the disk to NPD IT Bureau. I issued Beaver MA Citation T 1269995 and cited him for a violation of MGL Ch 89 C 11, failure to yield to a pedestrian in a crosswalk. On 06/12/2019 I was forwarded an E-mail from Capt Anastasia of a video of the crash that was taken from a camera that was mounted on the roof of 321 Walnut St. The video shows Donovan walking into the marked crosswalk from the east side of Walnut St and hold up his left had to Beaver's on oncoming vehicle. Beaver vehicle appears to be travailing faster than the 5 to 10 MPH that Beaver believed that he was travailing. The video shows that Beaver did not brake until Donovan was struck and landed on his vehicles hood. Donovan was thrown approximately 10 feet from Beaver's vehicle and landed on his right side on the roadway. The video shows Beaver stopping and pulling to the side of the roadway after the crash.

Operator #2 states she was rear ended by vehicle #1 while stopped at the light as well. Vehicle #1 did not sustain any damage and operator #2 states there is minor rear bumper damage to vehicle #2 however this was not visible to me upon superficial outside inspection. Neither vehicle needed to be towed and both parties declined medical transport. It should be noted that operator #2 kept referencing past unrelated injuries and was uncooperatice at times, but vehemently denied police/fire dept suggestions to go to the hospital.

On 06/30/2019 at 15:30 hours I was notified by Sgt Lee that a crash involving a motor vehicle and a bicyclist had occurred on Wiswall Rd at M Roadway. Upon my arrival at the crash scene I made the following observations, Wiswall Rd is a two lane non divided public way in the city of Newton that runs north to south from a dead end to Dedham St. The posted speed limit on Wiswall Rd is 25 MPH. M Roadway is a two lane non divided public way that runs west to east from Wiswall Rd to a dead end cul-de-sac. The weather conditions at the at of the crash were cloudy, and the roadway surface was wet from rain. I observed MA commercial registration M82794 a gray 2014 Honda Accord stopped in the north bound lane of Wiswall Rd at M Roadway. The Honda is registered to Newton Driving School. I observed two smudge marks approximately four inches in length on the center portion of the front and rear passenger side doors of the Honda. I also observed a 20 inch Kent bike that had be moved from it's final point of rest prior to my arrival. The bike had damage to it's front handle bars, front tire and it's two front forks. The bike's front tire had gray scuff marks on it. At the crash scene I spoke with the operator of the Honda, David Dombrovsky. Dombrovsky stated that he was driving north bound on Wiswall Rd near M Roadway approximately 20 to 25 MPH. Dombrovsky stated that he has had his learner's permit for six months and is a student at the Newton Driving School. Dombrovsky stated that he did not see the bicyclist but heard the impact of the bicyclist stricking the passenger side of the Honda. At the crash scene I spoke with driving school instructor, Igor Drizik. Drizik stated that the Honda was driving north on Wiswall Rd near M Roadway at approximately 20 to 25 MPH . Drizik stated that he did not see the bicyclist until approximately 1 to 2 seconds before impact on the driver's side of the Honda. Drizik stated the Honda is equipped with dual brakes and that he applied the brakes at the same time as Dombrovsky. Drizik stated that he and Dombrovsky got out of the Honda to render aid to the bicyclist. There were three other driving school students in the rear of the Honda at the time of the crash, neither of them stated that they witnessed the crash. None of the occupants of the Honda stated that they were injured and the vehicle did not require a tow. The bicyclist was identified as David Kerwin-Derrick. Kerwin-Derrick was transported via EMS to Boston Children's Hospital form treatment. At the hospital I spoke with one of Kerwin-Derrick's mother's, Patricia Kerwin-Derrick, who stated " We all know that David rode his bike into the car " and that her son had a broken left leg. Kerwin-Derrick is a student at the Memorial Spaulding School. Based upon my observations of the crash scene and statements made to me , I believe that Kerwin-Derrick's unintentionally rode his bike into the passenger side of the Honda. Photos were taken of the Honda, bike and crash scene and the disk was down loaded by the NPD's IT Bureau.

MV2 was heading southbound on Chestnut St. Operator of MV1 states MV2 did not yield, and turned in front of her. She did not have time to stop and the two vehicles collided. Operator of MV2 states he was heading southbound on Chestnut St, turning left onto Elliot St. He states he did not see MV1, and turned left. While turning, MV2 collided with MV1. Witness states she was behind MV2 at the light. She states MV1 continued into the intersection when the light turned green. She states MV2 turned into MV1 without yielding. Operator of MV2 was issued citation #T1444579, for 89/8, fail to yield while turning left. MV1 had airbag deployment. Operator of MV1 was transported to Newton Wellesley hospital with apparent minor injured. Operator of MV2 signed a patient refusal, as did the passenger of MV1. Both vehicles were towed by Todys.

On Friday, July 5th 2019, at approximately 23:30pm, I, Officer Brooks, responded to Pearl street at Emerson street, for a 2 car MVA. Upon my arrival the medics were treating the operator of MV1(MA REG 8MD241). The operator was complaining of leg pain. According to the operator of MV1 she was traveling Northbound on Pearl street, and looked out the window at something, at which point she struck MV2(MA REG 1EHV54), which was parked legally on Pearl street at the corner of Emerson. MV1 had heavy front end damage, and MV2 had damage to the rear drivers side wheel well area and rear bumper. MV1 was towed by Tody's and the operator was transported to Newton Wellesley hospital. I left a note on MV2 letting the owner know a report was on file.

On 07/16/19 at approximately 09:38 I responded to a two vehicle crash on Needham St. outside of #141. The Operator of Veh #1 stated she was turning left on Needham St when the South bound traffic stopped to left her turn. As she turned, Veh#2 drove South down the multi-turn lane and they collided nearly head on. Heavy damage and air bag deployment to Veh #1. The operator was checked out by Medics and signed a patient refusal. The Operator of Veh #2 stated she was driving down the multi-turn lane South on Needham St.. She was preparing to take a left onto Jaconnet St when Veh #1 pulled out of parking lot and collided with her vehicle. I observed moderate to heavy damage to Veh #2 and noted that the vehicle didn't have its directional on. The operator of Veh #2 complained to left leg pain and was transported to Newton-Wellesley Hospital By Ambulance #1. Both vehicles were towed by Tody's Towing. At the conclusion of my investigation it appears as if both vehicles were at fault during this crash; Veh#1 for not yielding to right of way and Veh #2 for traveling too soon in a turn lane, no directional and driving too fast for the heavy traffic conditions. Both operators were given verbal warnings and there will be no citations issued at this time.

On 7/20/19 at 23:24 hrs I responded to the area of 552 Commonwealth Avenue for a report of a MVA. Upon arrival it was determined MV#1 had struck two unoccupied parked vehicles in the eastbound parking shoulder. The operator of MV#1 stated he was on his phone while driving and when he picked his head up another vehicle coming westbound was in his lane so he swerved to avoid collision and struck the parked vehicles. On Tuesday, July 23, 2019, while assigned to Traffic unit N525, I responded to the intersection of Beacon Street and Washington Street, Newton for a motor vehicle accident involving a bicyclist. The weather at the time of the accident was overcast. The road surface was dry. Beacon Street and Washington Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Paige Mahoney (S85200426). Mahoney stated she was stopped in traffic at a red light on Beacon Street (W) at Washington Street in her 2018 black Volkswagon Tiguan (MA: 633MV6). Mahoney stated while her vehicle was at a complete stop, she felt and heard something hit the rear of her vehicle. Mahoney exited her vehicle and saw a bicyclist on the roadway. I observed minor damage to the rear middle bumper area of MV1. There was a small amount of blood present on the damaged area. I observed the roadway where the accident occurred. There was a small pool of blood in the left lane of Beacon Street (W) where the bicyclist fell to the roadway. The area of the roadway where the accident occurred is currently undergoing restoration and the asphalt has been graded down to it's sub base in preparation to be resurfaced. The current road surface condition is bumpy and uneven. The area where the roadway goes from a smooth surface to a bumpy surface is where the accident occurred. The injured bicyclist was identified as Timothy Johnson (S29270605). I spoke with him in the Newton Wellesley Hospital emergency room. Johnson stated he was operating his bicycle Westbound on Beacon Street on the right side of the left lane. Johnson stated he was coming to a stop in traffic at a red light when his wheel abruptly turned to the left and he began to fall over. Johnson stated his head hit the back of a vehicle stopped in front of him and he landed on his right side, with his bicycle landing on top of him. As a result of the accident, Johnson suffered an injury to the right side of his head and had scrapes on his right arm. Johnson stated he did not lose consciousness as a result of the accident and he appeared to be alert and orientated while I was speaking with him. Johnson was wearing a helmet at the time of the accident. There were fresh markings on the right side of the helmet with minor black paint transfer. These markings are consistent with Johnson's statement that he fell into the back of MV1 and hit his head. Johnson's bicycle was removed from the roadway prior to my arrival and was being stored in the driveway of 2044 Beacon Street by the resident there. I observed no obvious damage to Johnson's bicycle. After speaking with all parties involved and examining the roadway where the accident occurred, it appears that the condition of the road surface contributed to Johnson losing control of his bicycle and crashing into the rear bumper area of MV1 while it was stopped in traffic. Photos were taken of the road surface, John's bicycle, and MV2 and submitted to the IT Bureau.

At approximately 1825HRs on August 06, 2019, I was dispatched to 785 Centre St. (Newton Country Day School) in reference to a motor vehicle vs bicycle crash. Upon arrival, I located both parties on the sidewalk adjacent to the intersection of Centre St. and Colby Rd. The operator of the bicycle was complaining of feeling dizzy, although she stated she did not hit her head, and suffered several abrasions on her left leg and hands; the operator of MV1 stated she was uninjured. The operator of MV1 stated that as she was traveling northbound on Centre St., she attempted to give the operator of the bicycle room, but the bicyclist made an abrupt left hand turn and struck MV1. The operator of the bicycle stated she was traveling northbound on Centre St. in the Bicycle Lane. She then signaled a left hand turn and entered the Motor Vehicle Travel Lane to make a second left hand turn to travel eastbound on Colby Rd. Once she exited the northbound Motor Vehicle Travel Lane on Centre St. and began to cross over the southbound lane, MV 1 crossed over the solid yellow lines onto the southbound side of Centre St. and struck her bicycle. MV1 sustained damage to its right front bumper and I noted red paint transfer of the left side of the front bumper, which the operator of MV1 states was old damage. MV1 also sustained a flat left front tire after contacting the curb. The bicycle sustained damage to both tires and where the rear tire attaches to the frame appeared to be warped. I took several photos of the damage and have submitted them to be attached to this report. The operator of the bicycle was transported to the hospital by Newton Medics and the operator of MV1 signed a patient refusal. Todys Services arrived and took custody of MV1, for which I completed and filled an NPD Towed Motor Vehicle Form. All streets mentioned are public ways in the City of Newton. Due to the potential danger of serious bodily injury caused by the operator of MV1's reckless driving behavior (crossing the solid yellow road divider line and driving on the wrong side of the road against traffic), the actual damage caused (striking and causing the bicycle operator to be transported to the hospital and damage to the bicycle) and that the bicycle operator was clearly visible/in clear contrast with the road (riding a red bicycle and wearing a red shirt) I issued the operator of MV1 MA Criminal citation T1445010, in hand, for violating one count of MGL Ch.90 S. 24 (Operating To Endanger) I cleared without incident. Note: I logged the bicycle into property/evidence for safekeeping, as it could not be taken on the ambulance.

On Thursday, August 8, 2019, while assigned to Traffic unit N525, I responded to the area of Centre Street and Mt. Ida Street for a report of a 3 car motor vehicle crash with entrapment. The weather at the time of the crash was clear and sunny. The road surface was dry. Centre Street and Mt. Ida Street are both public ways maintained by the City of Newton. On arrival, I was updated by Sgt. Chisholm that one of the vehicles (MV3) had a female operator that was entrapped as a result of the collision. She was freed from the vehicle by the Newton Fire Department and transported to Beth Israel Hospital. Another operator (MV2) was transported to Newton Wellesley Hospital with minor injuries. A third operator (MV1) remained on scene with no injuries. With the assistance of Officer Wade we conducted a survey of the crash scene. We observed a large debris field at the intersection of Centre Street and Mt. Ida Street with debris from all three vehicles. The point of impact was observed to be on Centre Street (N) before Mt. Ida Street. There were fresh scrapes in the pavement as a result of the colission. We also observed skid marks from MV1 measuring 57 feet 8 inches from the start of it's skid to the vehicles final rest MV1 crashed into the rear of MV2. The impact caused MV2 to enter the Southbound travel lane of Centre Street and crash into MV3 as it was passing by. The impact from MV2's front end crashing into MV3's driver side resulted in the operator of MV3 becoming entrapped. MV2 and MV3 came to final rest on Wesley Street (W) at Centre Street (S). The driver door of MV3 was inaccessible. The collsion resulted in air bag deployment for MV2 and MV3. I observed moderate damage to MV1's front grill/bumper area. I observed substantial damage to the front and rear of MV2 and substantial damage to the front and driver side of MV3. Tody's responded and removed MV2 and MV3 from the roadway. Photos were taken of the scene and submitted to the IT Bureau. Officer Martin of the Watertown Police Department was requested by Sgt. Lee to respond to the scene and assist with a commercial truck inspection of MV1. Officer Martin contacted Trooper Grey of the Massachusetts State Police Truck Team who also responded to assist with the truck inspection. Sgt. Lee remained with Officer Martin and Trooper Grey during the inspection. MV1 was relocated to Richardson Street for the inspection. Trooper Grey determined the truck was in compliance with all required paperwork and it passed it's mechanical inspection. MV1 was removed from the roadway by a state tow. I spoke with the operator of MV1, William Tisbert (S24792655). Tisbert stated he was operating a 2006 KW W900 Semi Truck (NH SEMI: AP2638) Northbound on Centre Street. Tisbert stated as he was approaching Mt. Ida Street, a vehicle came out of no where and he hit it. Tisbert stated there was no one in front of him and then a vehicle came off of a side street (Mt. Ida Street) and attempted to turn left in front of him to return to the side street. Tisbert stated he could not avoid hitting the vehicle. Tisbert crashed into the rear of MV2. MV2 then crossed into the opposite lane and crashed into another vehicle. Tisbert remained on scene and reported no injuries. Tisbert stated he was wearing his seatbelt at the time of the accident and was not distracted. Tisbert later admitted to crashing into the rear of MV2. I spoke with the operator of MV2, Janet Vanbuskirk (S59829146), at Newton Wellesley Hospital. Vanbuskirk stated while operating her 2004 Toyota Highlander (MA: RS 529Y), she was stopped on Centre Street (N) at Mt. Ida Street. Vanbuskirk had her left directional on and was waiting for traffic in the Southbound lane to clear to take a left turn onto Mt. Ida Street. Vanbuskirk stated MV1 crashed into the rear of her vehicle. As a result of the impact, Vanbuskirk's vehicle traveled into the opposite lane and crashed into the driver side of MV3. Vanbuskirk reported minor injuries to her neck, left arm, and right hand. I spoke with the operator of MV3, Madeleine Karolian (S23979811), at Beth Israel Deaconess Medical Center in Boston. Karolian stated she was operating her 2016 Toyota Prius (MA: EV5746) Southbound on Centre Street. Karolian stated MV1 crashed into MV2, and MV2 crashed into her vehicle. Karolian stated she did not have time to avoid the collision. Karolian stated she had minor injuries to her neck and chest. Karolian's vehicle had a dash cam recording at the time of the accident. I viewed the footage with her through an app on a cell phone. The footage shows MV3 traveling Southbound on Centre Street on August 8, 2019 at 1308 hours. Ahead of MV3 in the Northbound lane, MV2 is seen stopped on Centre Street before Mt. Ida Street with it's left directional activated. I observed MV1 travel Northbound on Centre Street and crash into the rear of MV2. The impact caused MV2 to enter the Southbound travel lane and crashed into the driver side of MV3. The footage then ends. A copy of the footage was emailed to my work email. The footage was then forwarded to IT Director Steve Smith to be added to the media for this report. As a result of my investigation, the operator of MV1, William Tisbert, will be cited for Newton City Ordinance Chapter 19, Section 71 (Following too closely). Massachusetts Uniform Citation T1270942 was completed and mailed to Tisbert's residence.

The operator of MV1 stated that he was traveling southbound on Chestnut Street, stopped at the stop sign, and then continued straight on Chestnut Street towards Needham. He then stated that MV2 came off the off ramp of Boylston Street and did not stop completely at the stop sign. MV1 subsequently t boned MV2. The operator of MV2 stated that he was exiting Boylston Street in the Eastbound off ramp. He stated that he came to a complete stop at the stop sign and began inching out when he was struck by MV1. He also stated that he observed MV1 stop at the first stop sign but believed MV1 was going to stop at another stop sign under the bridge which is why he inched out so far. Both operators were uninjured and signed patient refusals but the passenger of MV1 complained of arm and neck pain and was transported to Newton Wellesley Hospital by Cataldo. Todys arrived on scene and towed MV1 as both headlights were disabled and the operator accompanied his wife to the hospital. Overall, MV1 sustained moderate damage to the front end and was towed while MV2 sustained moderate damage to the left drivers side but was able to be driven from the scene.

MV1 jumped a curb and collided with a parked vehicle MV2 (a 2004 GMC Yukon, MA Reg: 8EC792) in front of 185 Waltham St. MV1 operator, Angel Gonzales, was unconscious on scene in the driveway of 185 Waltham St. Waltham St is a public way that is owned and maintained by the City of Newton. A passerby, Joseph Anderson saw the aftermath of the crash and called 911. MV2 had damage to its drivers side door and rear side. MV1 was heavily damaged, on its side, and keys were in the ignition. MV1 was towed by towed by Tody's. Gonzales was transported to Beth Isreal in critical condition. When Gonazales was in the back of the ambulance, myself and medics smelled an odor of an alcoholic beverage emanating from Gonzales. All first responders thoroughly checked the surrounding area for a helmet but one could not be located. Due to Gonzales' critical condition and urgency to get to the hospital, and ID was not thoroughly looked for on his person. Ofc. Guarino, N491, retrieved an ID from Gonzales upon arrival at Beth Isreal Hospital. Ofc. Stake filled out a towed inventory form. Pictures taken and sent to IT. Sgt. Lee was notified and will be following up with this incident. MV1 operator, Angel Gonzales is being charged with the following (MA Uniform Citations T1442823 & T1442824): 90/24J - OUI Liquor (public way) 90/24E - Negligent Operation of a MV (operating recklessly at a high rate of speed) 89/4A - Marked Lanes 90/23 - Attaching Registration Plates (attaching registration plates to motorcycle to conceal the fact that it was unregistered. Registration plate on the motorcycle came back to a 2002 Honda VT750 motorcycle, MA Reg: 1T3988; VIN on the motorcycle came back to a 2005 Suzuki GSXR60, MA Reg: 1L4389) 90/9B - Unregistered MV (motorcycle 2005 Suzuki MA Reg: 1T3988 was confirmed unregistered by RMV) 90/23D - Operating MV with a Suspended License (RMV confirmed that Gonzales' license was suspended S94722414) (see Incident #19039806 for more details). For QED purposes, the charge 266/139 - Stolen Registration was added to this report because 90/23 - Attaching Registration Plates was not an option. Due to Gonzales' hospitalization, the citations will be mailed to his last known address. Officers were able to rise a Harold Curtis, the father of Anthony Curtis (owner of MV2, the GMC Yukon) at 185 Waltham St. He was notified of the incident and advised to call their insurance company. Curtis mentioned that he has cameras facing the street where the incident took place and will see if he can retrieve the footage for us. Police prosecutor to subpoena blood.

On 8/28/2019 at approx 1058hrs while assigned to 497 I responded to the area of 2014 Washington St for a report of a 2 car crash w/o injuries. Upon arrival I observed the vehicles on opposite sides of Washington St with NFD Lt Bourgeois standing by with his emergency lights activated, Lt Bourgeois stated both operators were shaken up but not injured. I spoke with the operator of Ma Reg 1XM680 Elizabeth CHISOLM who stated she was attempting to take a left onto Washington St, a vehicle in the right hand eastbound lane was turning right into the parking lot, CHISOLM stated she did not see Ma Reg EV3452 being operated by Julien GRANT in the left eastbound travel lane until it was too late colliding with him. I spoke with GRANT who stated he was traveling EB in the left travel lane of Washington St when struck by CHISOLM exiting the hospital.

On 9/08/19 Kevin Coston came into NPD Headquarters to report a MV/Ped with Injury that had occurred on 8/23/19 at about 06:15 in the parking lot of Whole Foods (916 Walnut Street). The RP stated that he had left work (Whole Foods) at the back receiving door and was walking to his car, he bent over to take his knee pads off, while he was doing this he was struck by a delivery van that backed into him. The driver took out his headphones and said sorry before driving away. RP stated that he told the driver that he had been hit but the driver just drove away. RP went to hospital (Faulkner) on his own for lower back pain and has not been to work since. RP was able to take picture of the side of the delivery van. The van belonged to Shortstop Distribution Inc (508-655-5948). RP left a message that morning. He was texted by Gedeon (786-352-6695) who stated there was a language barrier and he didn't understand what had happened. RP advised Gedeon to talk to his lawyer or the police. Exact location of accident unknown. Diagram is a estimate. Report printed out and placed in traffic box for follow up. Traffic Bureau Update (Officer Gaudet): On Monday, September 9, 2019 I attempted to make contact with the operator if MV1, Gedeon Duarte, with a negative result. A Hit and Run motor vehicle inquiry was mailed to Duarte. I spoke with the injured party, Kevin Coston, via telephone on September 9, 2019. Coston stated he is an employee at the Whole Foods located at 916 Walnut Street, Newton. Coston stated on August 23, 2019 a black van backed into him as he was kneeling on the ground taking off his knee pads in the loading area of the store. Coston stated he approached the driver who remained in the vehicle to speak with him after he was hit. Coston described the driver as a heavy set Spanish male. Coston stated the operator of the vehicle rolled down his window, took his headphones out of his ear, said sorry, and left the area. Coston stated he contacted the Newton Police to report the accident but was told he needed to come in person to file the report. Coston stated he was unable to come to the station to file the report until September 8, 2019. On Friday, September 13, 2019, I spoke with Gedeon Duarte at the Newton Police Department. Duarte stated he spoke Portuguese and did not speak English. With the assistance of David Sargent from the Language Line (1-800-225-5254) translating, I was to speak with Mr. Duarte in the Traffic Bureau. Duarte stated he was making a delivery at Whole Foods and was waiting for another truck to leave so he could leave the area. Duarte stated a male party (Coston) came up to his driver door and was yelling him. Duarte stated that due to language barrier he was unable to understand what the person was saying to him, but stated the male party was yelling, "Fuck you! Fuck you!" Duarte stated he did not know what was going on and stated he left the area to allow the male party to calm down. Duarte stated he returned a minute later the male party did not want to speak with him. Duarte stated he returned a second time later in the morning and Coston was not there. Duarte stated he received a call from his employer stating Kevin Coston had called for him and he was provided with Coston's phone number. Duarte stated he texted Coston to find out what happened that morning. Duarte showed me a text message exchange from August 23, 2019 at 9:03 A.M. between himself and a party listed as "Kevin Whole". In the text messages, Duarte stated he is the driver of the van and that his supervisor called him. The other party responded and stated "Talk to the police and my lawyer". Duarte stated that he did not understand what happened and that he returned to whole foods. Duarte ended the text exchange with "927535425 my number of policy..." Duarte stated he had no idea he made contact with Coston and stated at the time of the alleged accident he did not hear/see/feel anything otherwise he would have stopped. Duarte's information has been updated in this report to reflect him as the operator/vehicle involved. Duarte also submitted pictures of the rear of his vehicle, a 2008 black Ford E350 (MA: 8NY171), from the day of the accident. Photos were submitted to the IT Bureau. Officer Wade went to the Whole Foods located at 916 Walnut Street, Newton in an attempt to view surveillance footage of the accident. Officer Wade stated the surveillance camera did not capture the incident and the van not viewed at all.

Valentine Baron stated on she was bicycling in the marked crosswalk at Center Ave at Center St from the north side walk to the south side walk. Baron stated that she activated the crosswalk light and had entered the crosswalk when the light was activated. Baron stated that while she was in the marked crosswalk vehicle one began to make a right turn on red . Baron stated that vehicle one struck her on her left side , knocking her off her bike . Baron stated that she had a helmutt but was not wearing it the time of the crash. Baron stated that she did not lose consciousness as result of the crash. Baron was transported via EMS to Mt Auburn Hospital for treatment for possible internal injuries. Operator of vehicle one Sara Ross stated that she was stopped at a red light on Center Ave at Center St. Ross stated that she was waiting to turn right on a red light and look to her left and then her right and drove forward. Ross stated that she did not see Baron in the marked crosswalk. Charles Hannum was a front seat passenger in vehicle one and stated that he did not see Baron in front of the vehicle until the crash occurred. I took photos of vehicle one and forwarded to the NPD IT bureau. I issued Ross M Citation T21065501 and cited her for a violation of CO 19/74 , failure to use care while turning.

On September 16, 2019 at approximately 17:50 hours I, Officer Guarino, responded to the area of 749 Beacon St. for a report of a motor vehicle crash involving a bicycle. Upon arrival with other units, we determined that MV 1 was parked in front of 749 Beacon St.The operator of MV1 opened the door to her vehicle to exit and her door struck a passing bicyclist. Traffic on Beacon St. westbound was stopped, the bicyclist fell off of the bicycle and sustained injuries and was transported to Newton-Wellesley Hospital for further evaluation.As the bicyclist was falling, he struck the rear of MV2, which did not appear to have any damage. The operator of MV1 said she did not see the bicyclist, as she went to exit her vehicle. Witness 1, who was stopped in traffic said that the bicyclist was traveling at a high speed and understood how MV1 did not see the bicycle coming. Officer D. Siegal transported the bicycle to the Newton Police Department and secured it in support services.

I ESCORTED MARTIN EPSTEIN JUNIOR TO THE REAR OF THE STATION WHERE I RETURNED THE FRONT PLATE THAT WAS FOUND AT THE SCENE. HE INFORMED ME THAT SINCE HIS MOTHER DOES NOT RECALL THE ACCIDENT HE HAS TAKEN HER KEYS AWAY AND REVOKED HER DRIVING PRIVILEGES FOR THE SAFETY OF ALL PARTIES INVOLVED. HE STATES HE HAS SIBLINGS AS WELL AS FRIENDS OF THE FAMILY WHO LIVE IN THE AREA AND STATED THEY WOULD DRIVE HER WHENEVER NECESSARY. On Saturday, September 28, 2019, I responded to the intersection of Crafts Street and Albemarle Road, Newton with Sgt. Lee for a report of a motor vehicle crash involving a motorcycle with serious injury to it's operator. The weather at the time of the crash was clear and sunny. The road surface was dry. Crafts Street and Albemarle Road are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Jussara Pontes (S92930243). Pontes stated she was operating a 2017 Toyota Sienna (MA: 4GX777) at the time of the crash. Pontes stated she was traveling North on Albemarle Road and came to a stop at the stop sign located at the Crafts Street intersection. Pontes stated she looked both ways and began to inch out into the roadway. Pontes stated she stopped the vehicle again and was assisting a child sitting in the 2nd row of the vehicle. Pontes stated she then turned her attention back to the roadway. Pontes stated she looked to her right and left again and did not see any vehicles in either direction. Pontes stated she proceeded to cross the intersection to continue North on Albemarle Road. Pontes stated the front bumper area of MV1 crashed into the left side of a passing motorcycle. Pontes stated the motorcycle and it's operator fell to the roadway and slid across the street to the side of the road. Pontes stated she pulled her vehicle over onto Albemarle Road. Pontes stated she did not see the motorcycle prior to the crash and was not distracted. The operator of the motorcycle (MV2), Irene Pistoftzian (S06099449) was transported to Brigham and Women's Hospital with a serious left leg injury prior to my arrival. I observed a red 1990 Kawasaki ZR550 (MA MCN: 1V1063) resting on it's right side on the NE sidewalk area of Albemarle Road at Crafts Street with it's front wheel/handlebar facing Crafts Street. The motorcycle had moderate damage to it's left side from the impact of MV1 crashing into it. The right side of the motorcycle had damage from sliding on the roadway and the crashing into a fence on the sidewalk on Crafts Street (W) at Albemarle Road. There was also damamge to the front headlight/right handlebar area. The motorcycle and Toyota Sienna were towed from the scene by Tody's towing at Sgt. Lee's request. Pictures were taken of the scene and submitted to the IT Bureau. I spoke with Pistoftzian at Brigham and Women's Hospital in Boston on Monday, September 30, 2019. Pistoftzian stated she was operating her motorcycle on Crafts Street (W). Pistoftzian stated as she approached the intersection of Crafts Street and Albemarle Road, she observed a mini van to her left out of her peripheral. Pistoftzian stated she remembers being hit on her left side and then laying on the roadway looking up at the sky on the sidewalk with her head facing Albemarle Field. Pistoftzian stated as a result of the crash she has a significant injury to her left leg and also has an injury to her left wrist/arm. Pistoftzian stated she was wearing a helmet at the time of the crash. I spoke with Kymberley Mitchell via telephone who stated she witnessed the crash. Mitchell stated she was traveling behind the motorcycle involved in the crash on Craft Street (W) at North Street. Mitchell stated they were stopped at a red light at this time. Mitchell stated there were no vehicles in front of the motorcycle at the light. Mitchell stated the light turned green and they continued on Crafts Street at a low rate of speed. Mitchell stated she could see ahead at the intersection of Albemarle Street and Crafts Street, traffic was stopped on Crafts Street (E) letting traffic exit Albemarle Road (N). Mitchell stated vehicles were taking left and right turns out of Albemarle Road before the motorcycle reached the intersection. Mitchell stated a mini van was crossing past the double yellow line of Crafts Street to continue straight when it crashed into the left side of the motorcycle. I spoke with Cheryl Wermer via telephone who stated she witnessed the crash. Wermer stated she was traveling on Crafts Street (E) towards Albemarle Road. Wermer stated traffic ahead of her was stopped to allow vehicles to turn off of Albemarle Road. Wermer stated she observed a motorcycle traveling towards her on Crafts Street (W). Wermer stated she then saw a vehicle travel straight from Albemarle Road across Crafts Street and crash into the motorcycle. Wermer stated the operator of the motorcycle flew off the bike. Wermer stated the car then came to a stop and the driver got out and stated "Oh my god! I didn't see you!" Wermer stated both vehicles were traveling at a low rate of speed prior to the crash. I spoke with Bill Frabizio via telephone who stated he witnessed the crash. Frabizio stated he was behind the mini van (MV1) on Albemarle Road prior to the crash. Frabizio stated the vehicle in front of him began to cross the intersection as he was monitoring the traffic on to take a right turn onto Crafts Street. Frabizio stated he heard a loud "Boom" and saw a motorcycle slide across the street with its operator. Frabizio stated the motorcycle crashed into a fence post and the operator came off the motorcycle. Frabizio stated he pulled over and assisted operator of the motorcycle. After concluding my investigation, the operator of MV1, Jussara Pontes, was mailed Massachusetts Uniform Citation T2016424 for Newton City Ordinance Chapter 19, Section 75 (Failure To Use Care).

SHE STATES SHE NEVER SAW THE MOTORCYCLE UNTIL IT WAS HITTING HER VEHICLE. OPERATOR OF VEHICLE #1 WAS BEING ATTENDED TO BY THE FIRE AND MEDICS. OPERATOR OF VEHICLE #2 WAS GIVEN MOTOR VEHICLE CITATION ( T1445177, 89/9, FAILURE TO YIELD AT INTERSECTION ). OPERATOR SERVED CITATION IN HAND. I SPOKE TO A WITNESS ( TIMOTHY CHANGOGARRETT ). HE STATED HE WAS TRAVELING E-BOUND BEHIND THE MOTORCYCLE. HE SAW VEHICLE #2 ENTER THE TRAFFIC LANE AND VEHICLE #1 HIT HER VEHICLE. HE STATES THE OPERATOR OF VEHICLE #1 WENT OVER HIS HANDLE BARS UPON COLLISION. LANDED ON THE HOOD OF VEHICLE #2 AND THEN FELL TO THE GROUND. AT THIS POINT HE CALLED 911. OPERATOR OF VEHICLE #1 WAS TRANSPORTED TO BRIGHAM AND WOMEN'S HOSPITAL BY MEDIC2 FOR FURTHER TREATMENT. I WENT TO THE HOSPITAL AND SPOKE TO THE OPERATOR IN HIS ROOM. HE STATES HE WAS TRAVELING E-BOUND ON CRAFT INTENDING TO GO TO THE POST 440 ON CALIFORNIA ST. TO ATTEND AN AA ( ALCOHOLICS ANONYMOUS ) MEETING. HE STATES HE TOOK HIS SON'S MOTORCYCLE WITH THE INTENTION OF SEEING IF THERE WERE ANY REPAIRS NECESSARY BECAUSE HIS SON IS TRYING TO SELL IT. WHILE TRAVELING HE APPROACHED THE INTERSECTION. HE SAW VEHICLE #2 ENTER ONTO CRAFT ST. HE STATES HE COULD NOT DIVERT AND HE WAS UNABLE TO AVOID HITTING HER VEHICLE. OPERATOR HAS BROKEN BONES IN HIS LEFT ARM. CUTS ALONG HIS FACE AND NECK AS WELL AS LOWER BODY PAIN. HE STATED THE HOSPITAL INTENDS ON KEEPING HIM OVER NIGHT FOR OBSERVATION. I ASKED THE DRIVER IF HE WAS AWARE THAT HIS LICENSE TO OPERATE A MOTOR VEHICLE WAS REVOKED. HE STATED HE HAD A CHANCE TO BE REINSTATED BUT CHOSE NOT TO. DRIVER WAS ISSUED MOTOR VEHICLE CITATION ( T1445178, 90/23/C, LICENSE REVOKED AS HTO ). I INFORMED THE OPERATOR THAT I WOULD MAIL HIM THE CRIMINAL APPLICATION. ALL OTHER PARTIES REPORTED NO INJURIES. BOTH VEHICLES WERE TOWED BY TODYS. VEHICLE #1 HAD FRONT END DAMAGE AND FRAME DAMAGE. VEHICLE #2 HAD LEFT SIDE DAMAGE AND A BROKEN AXLE. WEST NEWTON SQUARE ( OFF L. MIKOLEIT ) ARRIVED ON SCENE AND TOOK 10 PICTURES. PICTURES PLACED IN I.T. BOX. I CLEARED THE AREA WITHOUT FURTHER INCIDENT.

The operator of MV1 states that she was traveling northbound on Needham Street with flow of traffic when she struck a pedestrian with the right front corner of her vehicle. The operator of MV1 stated that she did not see the pedestrian in the cross walk until after she hit her and that there was poor lighting in the area. Through the help of coworker from Anthony's Coal Fired Pizza, the victim stated that she was crossing Needham Street in the crosswalk and was almost on the side walk when she was struck by MV1 from behind. MV1 sustained minor front end damage while the victim sustained noticeable injuries and was transported to Newton Wellesley Hospital by Cataldo. Photographs of the scene were taken and submitted to IT to be attached to the report. The operator of MV1 was issued a Massachusetts Uniform Citation (T2079284) for 89-11, failure to yield to a pedestrian in a crosswalk.

The OP. of MV#1 states he was in a parking space and trying to correct his position within the lines. He pulled out and then when he was about to drive forward, MV#2 suddenly reversed into him. The OP. of MV#2 states she was exiting the parking lot due to it being full. As she was driving forward, MV#1 pulled out of a spot and collided into her. There is supposedly a witness by the name of Jean Charles working for VPNE Valet that observed the accident. He has left for the day and does not have a cell phone or a house phone. Manager on duty states only corporate headquarters 617-451-1393 has information on him. I checked with hospital security for surveillance footage and observed MV#2 passing MV#1. MV#1 then started backing out of his space but MV#2 started reversing. Both vehicles ended up colliding with each other at an angle. On Wednesday, October 16, 2019, I, Patrolman Hatfield, was assigned to marked cruiser N 495 to Division 5 for the 1530 to 2330 hour shift. At approximately 1742 hours, FTO Guarino and I were dispatched to Commonwealth Ave at Cedar St for a motor vehicle accident with minor injuries. FTO Guarino and I arrived on scene and noticed two MVs with damage. I spoke with the RO/operator of MV2, Janet Haines (Janet). Janet stated she was not suffering from injuries. Janet said she was operating southbound on Cedar St crossing Commonwealth Ave when she had a collision with MV2. Janet stated prior to crossing Commonwealth Ave, an unknown MV stopped at the intersection to allow her to cross. Janet then stated she proceeded accross when she crashed into MV1, who drove around the stopped MV. Janet said her brakes did not work and she continued to drive forward and ended on top of the curb of Commonwealth Ave facing eastbound. MV2 suffered damage to the whole front bumper and wheel wells. FTO Guarino spoke with the operator of MV1, Madeleine Richard (Madeleine). Be advised both front and side driver airbags were deployed, and the front driver's side door was unable to be opened. I then spoke with Madeleine. Madeleine stated she was operating eastbound on Commonwealth Ave before being involved in the collision. Madeleine stated she drove around the MV infront of her that was attempting to take a left from Commonwealth Ave onto Cedar St, and she did not see MV2 prior to the accident. MV1 was struck on the driver's side by MV2, and ended facing westbound in the middle of Commonwealth Ave. EMTs and fire arrived on scene. Janet stated she did not need to be transported. Madeleine was transported to Newton Wellesley Hospital for an evaluation. Both MVs were towed by Todys.

Katerina Iliades stated that on 10/23/2019 at 11:56 hours she was standing in front of the rear driver's side door of her vehicle MA reg 7BM656 2019 Land Rover while it was parked facing north in front of 316 Walnut St. Walnut St is a public way in the city of Newton. Iliades stated that she was placing her daughter Melina Bichelen in her car seat and when she observed MA reg 8EP212 a white Subaru Outback driving north bound on Walnut St near the marked crosswalk at 312 Walnut St. Iliades stated that she observed the Subaru was being operated by an elderly white male. Iliades stated that the she observed the Subaru's front drivers side strike several orange plastic three foot poles that are affixed to the roadway around the crosswalk. Iliades stated that after the Subaru struck the poles at the crosswalk it veered towards her. Iliades stated that she leaned back into the back seat of her vehicle and pulled the door towards herself as the Subaru's passenger side mirror made conact with her vehicle. Iliades stated that the Subaru continued north bound on Walnut St without stopping or slowing. Iliades complained of lower leg pain and refused medical aid or transport to a hospital at the crash scene. I observed no damage or markings on Iliades vehicle. MA reg 8EP212 is registered to Harilaos Papadogiannis ( DOB 01/02/1941 ) of 134 Apt 4 North St , Newton. I went to 134 North St and found MA reg 8EP212 a 2014 Subaru parked in the lot of 134 North St. I observed that the Subaru's passenger side mirror was lose from it's mounting and was turned down and was facing the wrong way. I further observed that the out side casing of the Subaru's mirror had scuff marks consistent with it forcefully making contact with an other object. I spoke with Papadogiannis who stated that he was driving his Subaru north bound on Walnut St at 11:56 hours on 10/23/2019. Papadogiannis stated that he could only recall striking the plastic poles near the crosswalk and nothing else regarding the crash. I as spoke with Papadogiannis he was confused and I had to repeat myself and my questions to him several times. I instructed Papadogiannis what steps he needs to take regarding filing out an operator crash report and contacting his insurance provider , but I believe that he did not fully comprehend what I was conveying to him. Based upon my observations at the crash seen and my conversations with Iliades and Papadogiannis , I believe that Papadogiannis was at fault for the crash. Based upon my observations of Papadogiannis I filed an Immediate Threat Request form and faxed it to the MA RMV Driver Control Unit. Photos of both vehicles were taken and downloaded by the NPD's IT Bureau.

On Wednesday October 23, 2019, I, Patrolman Hatfield, was assigned to marked cruiser N495 in full uniform to Division 5 for the 1530 to 2330 hour shift. At approximately 2040 hours, myself and Officer Selig were traveling northbound on Centre St (a public way) in Newton Center. We were behind MA reg 9KT873 (2004 Toyota Corolla grey). We observed the motor vehicle drive around a pedestrian in the crosswalk who was attempting to cross at Centre St and Pelham St. I activated my emergency blue lights and attempted to conduct a motor vehicle stop of the Toyota Corolla. The operator continued to drive northbound on Centre St before pulling over just before the crosswalk at Centre St and Pleasant St. The operator then continued driving forward and struck a pedestrian crossing in the crosswalk Officer Selig and I saw the pedestrian being struck before landing on top of the Toyota Corolla hood, and falling forward onto the street. Officer Selig and I spoke with the two parties involved. I spoke with the victim, who was identified as Vivian Rubinstein (Vivian). Vivian crawled towards the sidewalk of Centre St while clutching her lower back. Initially Vivian denied being injured and refused medical aid. The Toyota Corolla operator was identified as the register owner Elise Ruben (Elise). Elise stated to Officer Selig that her front windshield was foggy and when she noticed the blue lights, she attempted to pull over. Elise stated she did not see the pedestrian in the crosswalk. Elise appeared very upset and refused medical treatment. Officer Selig was able to speak to two witnesses of the accident. The witnesses were identified as Stephan Aparicio (Stephan) and Mikaela Rice (Mikaela). Stephan said he was behind the victim in the same crosswalk. Stephan stated he saw the Toyota stop in front of the crosswalk and then drove forward hitting the female. Mikaela stated she was parked in her motor vehicle on Centre St facing northbound (facing the crosswalk). Mikaela stated she saw the female walking halfway across the crosswalk and the Toyota continuing drive forward before hitting the female. Officer Siegel arrived on scene and took four photographs which was submitted with this report. Vivian was transported by Newton Medics to Faulkner Hospital for an evaluation. I issued written warning citation number T2079786 to Elise for failure to yield to a pedestrian in crosswalk (Centre St at Pleasant St). I also issued Elise citation number T2079787 for failure to yield to a pedestrian in crosswalk (Centre St at Pelham St). The vehicle was driven from the scene.

On Thursday, October 24, 2019, while assigned to Traffic unit N525, I responded to the intersection of Commonwealth Avenue and Cedar Street, Newton for a report of a motor vehicle crash involving a bicyclist. The weather at the time of the crash was clear and sunny. The road surface was dry. Commonwealth Avenue and Cedar Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Samuel Ntonme (S52001288). Samuel Ntonme stated he was operating his 2009 Nissan Murano (MA: 192VH6) Northbound on Cedar Street at Commonwealth Avenue. Ntonme stated he crossed Commonwealth Avenue and entered the carriage road area of Commonwealth Avenue to continue onto Cedar Street when a bicyclist crashed into the front driver side bumper/fender area of his vehicle. Ntonme stated there was a delivery truck partially blocking the intersection of Cedar Street (S ) at the Commonwealth Avenue carriage road. Ntonme stated he did not see the bicyclist until it crashed into his vehicle and stated the vehicle was traveling Eastbound on the roadway in the Westbound lane. I observed minor damage to the front driver side bumper/fender area of MV1. Ntonme reported no injuries. The operator of the bicycle, Ezra Robison (S83132607), was transported to Newton Wellesley Hospital with a leg injury prior to my arrival. I observed damage to the front and rear wheels on the Robison's bicycle on scene. Robison's bicycle was transported to the Newton Police Station for safe keeping. I went to Newton Wellesley Hospital to obtain a statement from Robison but he was discharged prior to my arrival. I spoke with Robison at his residence later in the day. Robison stated he was operating his bicycle on the Commonwealth Avenue carriage road (E) towards Cedar Street. Robison stated there was a delivery truck stationary on Cedar Street partially in the carriage lane. Robison stated he went around the delivery truck and didn't see MV1 until impact. Robison stated he crashed into the front driver side wheel area. Robison stated the front wheel of his bicycle went under the front driver tire of MV1 and he fell to the roadway with his bicycle. Robison stated he has minor injuries as a result of the crash. Pictures were taken of the crash scene and submitted to the IT Bureau.

I was dispatched to 854 Beacon St, Newton, MA for an overturned motor vehicle accident. I arrived on scene and saw Vehicle #1 (MA reg 9AS213) overturned on its driver's side with the female operator/registered owner trapped inside. Newton Fire arrived on scene and mechanically removed the operator out of the motor vehicle. Prior to where Vehicle #1 was overturned I observed Vehicle #2 (MA reg 615FF6) with rear bumper damage and a snapped rear axle. Vehicle #2 was unoccupied. Operator of Vehicle #1 was transported to Newton-Wellesley Hospital for treatment by Newton Medics. Both motor vehicles were towed by Tody's and inventory sheets were completed and filed. I spoke with the Operator of Vehicle #1 at Newton-Wellesley Hospital. Operator stated that she does not remember what happened before the crash and that she only remembers waking up in her car. I told her that her car was towed and a report is on file. Ofc Selig spoke with the registered owner of Vehicle #2 and notified her of the incident. Based on my investigation it appears that Vehicle #1 struck the rear of Vehicle #2 and the operator over steered causing the vehicle to overturn onto the driver's side.

MV 1 was traveling northbound on Walnut street and struck MV 2 traveling in the opposite direction. MV 2 was traveling southbound on Walnut Street and was struck by MV 1 traveling in the opposite direction. The accident was reported at Walnut St and Beacon St. MV 1 reportedly crossed the double yellow lines into MV 2's lane. There was a BOLO announced over the air for MV 1 because it was reported as leaving the scene. MV 1 was found and stopped at Walnut St at Homer St. It was determined that the operator of MV 1 was under the influence. The operator was placed under arrest. There were no injuries to either party. The children were in MV1. The children were transported to Newton Wellesley Hospital and assessed for possible injuries. Both vehicles were towed by Tody's. MV1 sustained significant damage and was not able to be driven away. The operator would have been aware of the accident based on the level of damage.

On Monday, November 4, 2019, while assigned to Traffic unit N525, I responded to the intersection of Walnut Street and Walnut Place, Newton for a report of a motor vehicle crash involving a pedestrian. The weather at the time of the accident was clear and sunny. The road surface was dry. I spoke with the injured pedestrian, Ernestine Gianelly, as Newton Medics were preparing her for transport to the hospital. Gianelly stated she was crossing Walnut Street in a marked crosswalk towards Washington Park after leaving the Newton Senior Center located at 345 Walnut Street, Newton. Gianelly stated a vehicle exited Washington Park and turned left onto Walnut Street directly at her. Gianelly stated she believes the driver did not see her. Gianelly stated the vehicle hit her while she was in the marked crosswalk on her left side. Gianelly stated she then fell to the roadway. Gianelly was taken to St. Elizabeth's hospital in Boston for injuries to her ribs, back, and sides. I spoke with the operator of MV1, Alex Cook-Williams (S13317988). Cook-Williams stated he was operating his 2009 Pontiac Vibe (MA: 222FV5) Westbound on Washington Park towards Walnut Street. Cook-Williams stated he came to stop at the intersection and observed no traffic in either direction of Walnut Street. Cook-Williams stated he made a left turn onto Walnut Street and did not see the crossing pedestrian until it was too late. Cook-Williams stated he slammed on his brakes and the pedestrian landed on his hood. Cook-Williams stated the pedestrian then fell to the roadway. Cook-Williams reported no injuries. Cook-Williams stated he did not know if the pedestrian was in the crosswalk or not at the time of the crash. I observed minor damage to the passenger side hood/bumper area. Cook-Williams stated he was not distracted at the time of the accident. After speaking with all parties involved, Cook-Williams was issued Massachusetts Uniform Citation T2016426 for Chapter 89, Section 11 (Fail to Yield, Pedestrian in Crosswalk). Walnut Street, Walnut Place, and Washington park are all public ways maintained by the City of Newton. Photos were taken and submitted to the IT Bureau.

The operator of MV#2 indicated that there was a significant gap in traffic as he was attempting to turn westbound when the operator of MV #1 collided into his vehicle. MV#1 was traveling east on Commonwealth Ave. Pedestrian was crossing the cross walk at Cedar St from the north side of Commonwealth ave to the south side. The pedestrian stated that he was more than half way across the cross walk when he was struck by a vehicle. The pedestrian stated that he did not see the vehicle until it was to late. Operator of MV#1 stated that she did not see the pedestrian crossing the cross walk until right before she struck him. Operator of MV#1 stated that as soon as she saw him she attempted to stop, but was not able to do so until after she struck the pedestrian. A witness at the scene stated that he was stopped in the west bound side of Commonwealth Ave allowing the pedestrian to cross. He stated that he saw MV#1 approaching the crosswalk and not stopping. He stated that he was not able to signal the pedestrian or operator of MV#1. The witness stated that he observed the pedestrian struck, and immediately got out of his vehicle to help. The pedestrian was transported to the hospital by medics. Pictures were taken of his injuries to be attached to this report. MV#1 was driven off scene. Pictures were take of the damage to MV#1. A citation was issued to the operator of MV#1.

Narrative:
On 11/12/2019 at 12:26 hours, I responded to the Star Market parking lot located at 2040 Commonwealth Avenue for a motor vehicle pedestrian accident. The parking lot is a public/thru way that motorists use to access the Star Market along with other businesses. The weather at the time was cloudy and rainy and the parking lot was saturated. Prior to my arrival, the pedestrian involved left the scene and did not want to speak to the officer nor wanted medical attention. Ofc. Claflin then cancelled Cataldo Ambulance. The pedestrian, Mary Alexander, left her information with a store employee prior to leaving. I spoke to the operator of MV # 1 (Joshua Randel MD Lic.# R534440603244) who stated that he was travelling through the third row of the Star Market parking lot at an appropriate speed. He was then attempting to make a left turn near the entrance/exit of the store. He says that there was a large white van parked in the end handicapped spot towards the left of him. He says the van was sticking out in the spot limiting his visibility. As he was half way through his left turn and coming around the corner, he was not able to see a pedestrian pushing a shopping carriage. He then struck the carriage that was being pushed by Mary Alexander. He further says that the cart jolted Ms. Alexander and she fell down to the ground. At the time, Alexander was walking through the lot near the store entrance heading back towards the parked cars. She was not in the crosswalk at the time which was approximately ten feet down from her location. After, I attempted to go to Ms. Alexander's residence to follow up. I spoke to her friend who was bringing up Alexander's groceries and she stated that she decided to go to Newton Wellesley Hospital for treatment. I then spoke to Ms. Alexander in the lobby of the hospital. She stated that she was exiting the store through the lot with her shopping carriage. She believes she was approximately eight feet away from the door when all of a sudden she only saw red coming at her. She believes MV # 1 was speeding at the time. I asked her if she was struck by the vehicle or was the shopping carriage only struck. She replied that she did not know and only remembers falling to the ground after. She sustained a large bruise to the inside palm area of her right hand and her left knee was swollen. Digital photos of the scene were taken and pictures of Ms. Alexander's injuries were taken at the hospital. As far as possible video surveillance, I was told that the Loss Prevention Department has to access the video. On 11/13/19 at approximately 14:20 hours, I went in to the Star Market and spoke to the manager, Nidal Rajeh, inquiring about possible video surveillance. He said there is coverage in the parking lot and he was able to show me the video. A copy of the video would have to be done by Loss Prevention which I requested. I observed at the 12:12pm mark in the video, MV # 1 was parked five spots up from the third row of the lot that he was exiting. I also observed a white transport van parked in the end handicapped spot mentioned by the operator but it was parked correctly and not limiting visibility. Next, MV # 1 backs out of the spot and drives forward going at a reasonable speed. The pedestrian (Alexander) has already exited the store with her carriage and is walking at an angle toward the same third row of parked cars. As the pedestrian is walking towards the direction of MV # 1, it appears that the pedestrian should be visible to him. MV # 1 then starts to take the left turn around the corner without slowing or stopping and strikes the carriage head on. Due to the impact, Alexander then loses grasp of the carriage and it goes past her twisting her body around. She then hits and rolls up on the hood of the vehicle on her left side. MV # 1 then suddenly stops and immediately gets out and provides assistance to the pedestrian. Due to the video surveillance, Mr. Randel will be issued/mailed MA Uniform Citation # T2012347 for Ch. 90/14/A Failure to slow for a pedestrian.

MV#1 was traveling North on Fair Oaks Ave, and attempted to make a right turn onto California St. MV#2 was parked in front of 589 California St facing West. MV#1 appeared to have run over the curb at the intersection, hit a city tree in front of 55 Fair Oaks Ave (California St side), and then crashed into MV#2. When I arrived on scene I observed a male party with blood on his head, and another male party standing next to him, later identified as Elmer Lopez.. I asked Elmer which car he was driving, and he stated that he was in MV#1. I asked Elmer what happened, and he stated that he and the other man with him, identified as Ricardo Deras, were in the rear seat with another male party, and that there were two other parties in the front seat, one of them was driving, he was not able to provide me with a name of who was driving. I asked him where everyone else was, and Elmer stated that after the crash, the got out of the car and ran away. At this point, medics arrived on scene and began to tend to Ricardo. I next spoke with the owner of MV#2, Jim Silva. Jim stated that he was in his home when he heard a loud crash. Jim stated that he came out of the house in time to witness the two males I was speaking with looking at the car, and he also stated that he observed three parties walk away from the scene, two heading east on California St, and one heading north on Fair Oaks Ave. MV#1 and MV#2 were towed off scene by Todys. Due to the scene, and the location of the cars in a busy street, I was not able to do a MV inventory of MV#1 until after it was towed by Todys. The inventory was done at Todys Service station, and a MV inventory sheet was filled out and placed the in appropriate box. I took three pictures of the damaged tree and submitted them to IT to be attached to this report. While I was taking the pictures of the tree, two males were walking past the scene. I stopped both parties and questioned them about the incident. They stated that they had been in the car, but had not been driving. I asked them if the knew who the driver was, and they told me that they did not know the name of the driver. Due to no witnesses observing the driver and all parties stating that it was someone else, I was not able to determine a driver of the vehicle. Units checked the area for the fifth party in the vehicle with negative results. Ricardo was transported to NWH hospital by medics. All other parties were sent on their way. All units cleared without further incident. **UPDATE** On Nov 25, 2019 at approximately 1621 hrs, I contacted Westborough Police Department in an attempt to get a hold of Dora. Westborough informed me that they made an attempt to contact her with negative results. Westborough PD left my contact information for her to call me back.

MV1 operator was driving westbound on Beacon St when they stopped for a pedestrian to cross in a crosswalk. MV1 operator stated they were then struck from behind. MV1 sustained total rear end damage and was towed by Todys. MV1 operator and passenger said they have unknown injuries and were transported by Newton Medics to Newton Wellesley Hospital for an evaluation. MV2 operator was driving behind MV1 on Beacon St westbound. MV2 operator said MV1 stopped suddenly. MV2 sustained total front end damage and was towed by Todys. MV2 operator said they were not injured. Due to the nature of the crash and statements, I have reason to believe MV2 operator was at fault for inattention and following MV1 too closely. No citation issued.

On 11/30/2019, while assigned to N494, I, Officer Conary, and other units, responded to Charlesbank Road at Nonantum Road for a single motor vehicle crash into a tree. Upon arrival, I observed a white mini van MA registration 5DV184 with heavy front end damage into a tree on Charlesbank Road, a public way in Newton. The operator of the motor vehicle, CORDERO, Ericka, was sitting in the back seat of the vehicle and was talking on the phone. CORDERO's primary language was Spanish. I asked CORDERO if she was okay and she said yes and I asked CORDERO if she was driving the car and she said yes. CORDERO also told me that she did not have a license. MA State Police were on scene and were able to asist with translating. Medics arrived and CORDERO was transported to Saint Elizabeth's Hospital. CORDERO's son and husband arrived on scene and I was able to confirm her information. Both stated that CORDERO did not have an active license. Newton Dispatch ran all information for CORDERO and confirmed she was unlicensed. CORDERO will be charged with MGL Ch.90/10 Unlicensed Operation of a Motor Vehicle and 89/4A Marked Lanes Violation, Uniform MA Citation T2079476. Due to CORDERO being transported to the hospital, the citation will be mailed to her active address. Pictures of the incident were taken and uploaded to IT accordingly. No further incident to report.

MV#1 was traveling north on Hammond Street as it crossed the intersection with Commonwealth Ave when it collided with MV#2. -OpMV#1 stated she was traveling North on Hammond Street. She arrived at the intersection, observed the flashing red light, stopped and as she proceeded MV#1 came out of nowhere and she collide with MV#2. -OpMV#2 stated she was traveling west on Commonwealth Ave when MV#1 was struck by MV#2. OpMV#2 stated she crossed the intersection she felt the strike to the MV#1. She stated the collision was a surprise because she did not see where the strike came from until after the collision. -I next interviewed the passengers of MV#2, in Spanish, at the scene and their statements coincided with those made by OpMV#2. They added that they did not see OpMV#1 slowdown at all as it came at them. - Both vehicles were towed from the scene and one party was transported to Newton Wellesley Hospital for further care. No citations were issued at the time of this investigation.

On Wednesday 12/4/2019 at approx 2110hrs, while assigned to N-494, I responded with the medics to 22 Park St Apt #5 in Newton for a past MVA pedestrian. There I was met by Annie Peng who states that at approx 730pm this evening she was struck by a vehicle(mass reg 6258) at the intersection of Washington St and Park St. She states that when she was entering the crosswalk after crossing over the mass pike bridge, she was struck from the right passenger side of MV1. Peng states she fell a few feet from the car injuring her right knee and right arm. She said that the operator stopped and got out to assist and left his contact info. Peng signed a patient refusal form and pictures of her injuries were taken and submitted to IT. It should be noted that Peng believes her cell phone was broken after hitting the ground. I later spoke with Dr. Ross, operator of MV1, who stated that he had not seen Peng crossing after he came to a complete stop at the crosswalk which had a "right turn on red after stop" sign. He said he was going "one or two miles per hour" when Peng collided with his passenger side door. Ross stated he got out to help her and offered to take her to the hospital.
