MV1 (MA Reg: 63EP17, a 2000 Acura 32TL; operator: Carlos Standford) was traveling NORTH on Cherry St when a vehicle swirved into his lane head-on. In order to avoid MV3 he swirved into the other lane and side-swiped MV2. MV2 (MA Reg: 9JX388, a 2019 Subaru Outback; operator: James Cant) was traveling SOUTH on Cherry St when he had come to a complete stop, put his left turn signal on to show him turning left into his driveway at 176 Cherry St. He was waiting to make his turn until MV1 had driven past so it was safe to do so. As he was at a complete stop, MV1 collided with his rear driver side bumper in an effort to avoid a head on collision with MV3. MV3 (MA Reg: 93YE85; a 1997 Toyota Camry; operator Matthew Kuniholm) was traveling SOUTH on Cherry St when he had seen MV2 at a complete stop with a turn signal. He didn't give himself enough time to stop, began to slide as he was braking and went over the marked lanes into oncoming traffic in an effort to not collide with MV2. MV3 operator, Matthew Kuniholm, was issued in hand MA Uniform Citation T1440470 for Marked Lane Violation 89/9a. All vehicles were still in driveable condition. MV1 had damage to the front driveside wheel fender and driver door. MV2 had slight damage to rear driver side bumper. MV3 did not have damage to his vehicle. Weather was icy and there was an active snow fall during the time of the accident, which was 1815hrs.

Narrative:
On Wednesday, April 10, 2019 while assigned to Traffic unit N525, I responded to the intersection of Centre Street and Wesley Street, Newton for a report of a motor vehicle accident involving a bicycle. It was also reported that the parties involved were arguing with each other. The weather at the time of the accident was cloudy and the road surface was dry. Centre Street and Wesley Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Abdulaziz Stewart (S04075169). Stewart stated he was operating his 2017 Toyota Camry (MA: 669FM3) at the time of the accident. Stewart stated he came to a stop on Wesley Street (E) at Centre Street and was attempting to take a left turn onto Centre Street. Stewart stated there were no vehicles in the Southbound lane of Centre Street and there was a vehicle stopped in the Northbound lane of Centre Street motioning to him to take his left turn. Stewart stated as he began to start his left turn, a bicyclist crashed into the front passenger area of his vehicle. Stewart stated the bicycle had been traveling Northbound on Centre Street in the Southbound Lane. Stewart stated after the collision the bicyclist was yelling at him and called him a "Nigger". Stewart and his occupant, Miriam Stewart, reported no injuries. Miriam is a student at Bigelow Middle School. I observed minor damage to the front passenger quarter panel area of MV1. I spoke with the bicyclist involved in the accident, Timothy Murtagh (S49233464). Murtagh stated he was traveling Northbound on Centre Street on his Cannondale bicycle in the Southbound lane. Murtagh was not wearing any safety equipment while operating his bicycle (helmet) and was wearing a dark red jacket. Murtagh stated as he approached Wesley Street, MV1 "jammed on the gas" and hit him in the roadway. Murtagh stated he then fell to the ground and landed in the middle of the street. While speaking with Murtagh I told him it was reported to me by the operator of MV1 that he used a racial slur during their interaction. Murtagh acknowledged that he did and stated, "I called him a nigger". I observed moderate damage to the front wheel/rim of Murtagh's bicycle. Murtagh reported no injuries. Murtagh was advised and issued Massachusetts Uniform Citation T1443441 for Chapter 85, Section 11B (Fail to ride on the correct side of the roadway). Photos were taken at the scene and submitted to the IT Bureau. Due to the language used by Murtagh during his exchange with Stewart, Officer Rosenbaum of the Community Services Bureau was made aware of the incident for follow up.

On Wednesday, April 24, 2019 while assigned to unit N525, I responded to the area of Centre Street and Richmond Street, Newton for a 3 car motor vehicle accident. The weather at the time of the accident was clear. The road surface was dry. Centre Street and Richmond Street are both public ways maintained by the City of Newton. The operator of MV1, Irina Gorolevici (S18897891) stated she was stopped in traffic on Centre Street (N) at a red light while operating her 2017 Toyota Highlander (MA: 8JY370). Gorolevici stated while stopped in traffic MV2 crashed into the rear of her vehicle. I observed damage to the rear bumper area of MV1. Gorolevici reported no injuries and signed a patient refusal with Newton Medics. The operator of MV2, Wiranya Thatwisai Partosan (S27096641) stated she was stopped in traffic on Centre Street (N) at a red light while operating her 2016 Honda Civic (MA: 5VA815). Thatwisai Partosan stated while stopped in traffic MV3 crashed into the rear of her vehicle. The force from MV3 crashing into the rear of her vehicle caused MV2's front bumper area to crash into the rear bumper area of MV1. I observed moderate to the front and rear bumper areas of MV2. The vehicle was removed from the roadway by Tody's towing. Thatwisai Partosan reported no injuries and signed a patient refusal with Newton Medics. The operator of MV3, Sofija Garcevic (S74039706) stated she was traveling North on Centre Street towards Cabot Street. Garcevic stated she looked up and observed MV2 in front of her. Garcevic stated she did not have time to stop and crashed into the rear of MV2. I observed moderate to the front bumper area of MV3. The vehicle was removed from the roadway by Tody's towing. Garcevic reported no injuries and signed a patient refusal with Newton Medics. As a result of the accident, Garcevic was provided with Massachusetts Uniform Citation T1443443 in hand for Newton City Ordinance Chapter 19, Section 75 (Fail to use care, stopping).

Operator 1 of MV 1 was stopped on Brookline St (E/B) to take a turn onto Ober Rd. A vehicle had let Operator 1 turn onto Ober Rd and while turning a Bicycle struck the passenger side of her vehicle causing minor damage. No injuries to Operator 1 or Passenger of the vehicle. No tow needed and no citation issued. The operator of the bicycle was traveling (w/b) on Brookline st passing the cars on the right side. The bicycle did not see that there was a vehicle stopped in traffic allowing MV 1 to turn onto Ober Rd. Minor injuries to the operator of the bicycle on hands and his right knee. Medics responded and got a signed patient refusal. Pictures were taken of the vehicle, operator of the bicycle and turned into IT for attachment to the report.

The operator of MV#1 stated he was stationary on Centre St northbound when he was struck from behind by MV#2. MV#1 sustained moderate damages to its rear bumper. There were no reported injuries to the operator of MV#1. The operator of MV#2 stated he was stationary on Centre St northbound when he was struck from behind by MV#3 which in turn pushed him into MV#1. MV#2 sustained moderate damages to its rear and front end. The operator of MV#2 reported non-incapacitating injuries to his back and right shoulder area. He was evaluated by Newton Paramedics and refused medical attention. The operator of MV#3 stated he was travelling northbound on Centre St when he looked to his right at a dump truck and took his vision off the street for a second when he struck MV#2 which in turn pushed MV#2 into MV#1. MV#3 sustained heavy front end damages and had both front airbags deployed. The operator of MV#3 stated both of his thumbs were hurting from the airbag deployment. He was evaluated by Newton Paramedics and refused medical attention. The operator of MV#2 does not have a driver's license and only provided a Brazilian passport. He was issued in hand MA uniform citation #T1268350 for violation of c90 s10 unlicensed operation. A licensed operator (MA license #S48386590) took possession of MV#2 and transported the operator of MV#2 back to his home. Based on the statements made to me I issued in hand to the operator of MV#3 MA uniform citation #T1268351 for violation of C.O 19-71 following too closely. MV#3 was towed by AAA towing and the operator of MV#3 was transported home by his parents.

MV#1 was traveling west on Mandalay Road when it struck MV#2 which was parked in front of 20 Mandalay Road. -OpMV#1 stated she was traveling on Mandalay Road when a squirrel ran out on to the road in front of MV#1 startling her. OpMV#1 swerved to avoid the squirrel striking MV#2. OpMV#1 knocked on the door of 20 Mandalay in attempt to find the owner of MV#2. She then contacted police to report the incident. -OwMV#2 stated was contacted and informed of the collision. -I observed damage the right front bumper and head light of MV#1. I next observed the damage to the left rear bumper of MV#2. -Neither vehicle was towed from the scene. There were no injuries report at the time of this report. No citations were issued.

The operator of MV#1 stated she was stationary at the red light on Centre St attempting to make a left turn onto Church St when both MV#2 and MV#1 struck her vehicle. MV#1 sustained minor damages to its front driver's side bumper. There were no reported injuries to the operator of MV#1. The witness stated she was stationary directly behind MV#1 and observed MV#2 and MV#3 struck MV#1. The witness stated she was unsure who had the right away/ green light. The operator of MV#2 stated he had the green light and was travelling eastbound on Church St when he was struck by MV#3 which in turn pushed him into MV#1. MV#2 sustained heavy front end damages. There were no reported injuries to the operator of MV#2. The operator of MV#3 stated he was travelling southbound on Centre St and was unsure if he had the green or red light when he was struck by MV#2 which in turn pushed him into MV#1. MV#3 sustained moderate damages to its right side front bumper. The operator of MV#3 stated he has a bad back and was complaining of a slight back pain. He refused medical attention at that time. Based on the statements made to me, I issued in hand to the operator of MV#3 MA uniform citation #T2079223 for violation of c89 s9 failure to comply red light. Both MV#2 and MV#3 were moved off the street and arranged for their own tows.

On 12/19/2019 at 14:43 hours Newton Police dispatch received numerous phone calls about a white male whose face was covered in blood and was riding on an electric motorized scooter south bound on Walnut St near number 100. Walnut St is a public way in the city of Newton. Approximately two tenths of a mile south 100 Walnut St, Ofc Garcia stopped the male on the scooter. Ofc Garcia stated that the male on the scooter was evasive when answering his questions and claimed that he did not realize that his face was covered in blood. The male on the scooter was identified as Gregory David Brown. Brown was transported to Newton Wellesley Hospital for treatment. Prior to Brown being transported I was dispatched to the area of 100 Walnut St for a report of a male on an scooter who had crashed into a south bound vehicle in traffic on Walnut St and another vehicle that was parked in front of number 73. Upon my arrival I spoke with Penni Rochwerger and Nikita Espinal. Rochwerger stated that she was driving south bound on Walnut St across from 100 when she activated her vehicle's four way flasher and stopped her vehicle to let Espinal who was the front seat passenger out. Rochwerger stated that south bound traffic stopped behind her vehicle after she came to a stop adjacent to Espinal vehicle that was parked facing south in front of 73 Walnut St. Espinal stated that she checked over her right should to see if it was clear to open her door and it was . Espinal stated that as she opened her door to exit a male on scooter crashed into the door and fell to the ground. Both Rochwerger and Espinal stated that the male on the scooter did not provide his name or address and continued south bound on Walnut St with his face coved in blood. Rochwerger's vehicle sustained damage to the front passenger side door that would not closed all the way. Espinal vehicle also had damage to it, the rear driver's side lower quarter panel was struck. I responded to Newton Wellesley Hospital to speak with Brown. When I arrived and spoke with Brown he was evasive with his answers . When I asked Brown what had happened he gave conflicting answers and contradicted himself. Brown stated that he was riding his scooter on the roadway south bound on Walnut St be could not recall any other details. When I asked Brown if he was wearing a helmet as required by MGL 90/1E he stated he couldn't recall. Rochwerger, Espinal and Ofc Garcia all stated to me that they did not see Brown wearing a hamlet. There was an unconfirmed post by a person named Tricia Marucci to the Facebook group Newton Parents stating that at 14:45 hours on 12/19/2019 saw Brown hitting a defect in the roadway in the area of Crafts St by California St that caused him to loses control of his scooter and fall face first onto the pavement. In her post Marucci stated that Brown was cover in blood from facial lacerations, and that he refused medical aid and continued to ride his scooter south bound towards the entrance to Walnut St. I left a message for Marucci to contact me and as of the writing of this report she has yet to do so. While at the hospital I ran Brown's name and date of birth via the MA RMV data base in order to issue him a citation for not wearing a helmet. The query of Brown via the MA RMV data base reviled that Brown's MA driver's license statutes was suspended. On 07/11/2018 admitted to a finding of sufficient facts to one count of MGL 90/24 OUI liquor. Brown received a Continued With Out Finding for 18 months. In addition Brown pleaded guilty to an additional count of MGL 90/24V Child Endangerment While OUI. Brown received a 90 day sentence in the Middlesex House of Correction which was suspended for 18 months. Brown also received a one year loss of his driver's license. Brown is on active probation out of Newton District Court until 07/21/2020. Biased upon the statements made to me I issued Brown MA Criminal Application T 2012526 for violations of MGL 90/24(2) Leaving The Scene Of An Accident Property Damage , MGL 90/1E Operation Of A Motorized Scooter Without A Valid License and MGL 90/1E Operation Of A Motorized Scooter With Out A Helmet. As of 12/20/2019 Brown was discharged from Newton Wellesley Hospital.

MV1 was operating eastbound on Commonwealth Ave (public way), and MV2, MV3, and MV4 were all operating westbound on Commonwealth Ave by Ash St. MV3 was stopped with her left blinker on waiting to turn into her driveway and MV2 was stopped behind MV3. MV4 attempted to stop but due to the weather conditions and slippery road conditions he was unable to and slid out. While sliding out MV4 struck MV2 in the left rear bumper, struck MV3 in the front left bumper and wheel well, and then struck MV1 in the front left bumper. MV1, MV2 and MV3 sustained sever damage. MV3 was able to park in her driveway but both MV1 and MV3 were towed by Todys. No injuries reported. MV4 operator was issued MA Uniform Citation # T2080303 C.O. 19-71 Following Too Closely (local).

On 2/12/2020 at approx 0725hrs while assigned to 497 I responded to the area of 57 Metacomet Rd for a report of a mv crash without injuries. upon arrival i met with the operator of Ma Reg V36615, Riberioa DASILVA who stated while traveling EB on Beacon St he suddenly lost his brakes , swerved to the left causing tracks through the wet dirt on the berm , travelling across the front lawn of 57 Metacomet leaving no damage coming to a stop on Metacomet Rd. DASILVA arranged for Nicks Towing to take his car. Mass Uniform Citation T2015309 issued to DASILVA for violation MGL 90/26A Failure to Notify RMV of Address Change. Photos of damage taken and submitted to IT.

Operator 1 stated he was drivin westbound on Watertown St taking a left turn on Pearl St. Due to pulling a trailer he had to make a wide turn. Operator 1 stated that the tree located in front of 268 Pearl St was severly leaning towards the roadway and he clipped it with the corner of the trailer knocking it over. I as well as fightfighters on scene can confirm the tree has been leaning over in the roadway prior to accident and due to this the operator was not cited. On Wednesday 6/17/2020 at approx 2116hrs, while assigned to N-494, I responded to the intersection of Walnut St and Comm Ave for MVA involving a bicyclist. The bicyclist, Aziz Boltayev, said he was traveling NB on Walnut St and attempted to cross Comm Ave. He stated that he was in the middle of the intersection when Comm Ave' light signal turned green. Contact was made to MV1s driver side front panel. Boltayev was transported to Beth Israel with serious injuries to his legs. Boltayev was not wearing a helmet nor wearing reflective clothing. His bicycle, a blue Schwinn, had no front head lamp attached in violation of MGL c85 s11B. A citation was issued and mailed to Boltayev. He was wearing a light colored shirt and shorts. Operator of MV1 states that he was on Comm Ave heading WB and stopped at a red light at the intersection of Walnut St. He states that he had a green signal when attempting to cross the intersection and did not see the bicyclist prior to the accident. Pictures were taken and submitted to IT. The Schwinn bike was placed in property and evidence for safekeeping.

Operator of vehicle one ( MA reg 1HK920 2010 Toyota Tacoma ) Brian Robidoux stated that on 11/06/2020 at 14:49 hours he was driving west bound on Auburndale Ave near Lexington St. Both Auburndale Ave and Lexington St are public ways in the City of Newton. Robidoux stated that west bound traffic had a green light at the intersection of Lexington St, and that north and south bound traffic on Lexington St had a red light. Robidoux stated that as he turned his vehicle left into the north bound lane of Lexington St was hit on the front driver's side quarter panel by motorized bicycle that did not stop for the red light. Robidoux stated that he was not injured in the crash and his vehicle did not required a tow. The operator of the motorized bicycle Arif Ahmed stated that he was riding north bound on Lexington St on a Lectric XP motorized bicycle. The vehicle that Ahmed was riding on meets the definition of a moped set forth by MGL 90/1, specifically that it's top seed was not in excess of 30 MPH. According to the owners manual that I found on line the top speed for the Lectric XP is 20 MPH. Ahmed stated that he believed that north bound traffic on Lexington St had a green light but he could not be sure. Ahmed also stated that he was unfamiliar with the area and it traffic patterns. Ahmed stated that he saw Robidoux vehicle and thought it would stop. Ahmed stated that at the time of crash be estimated that he was travailing approximately 12 MPH. Ahmed was transported via EMS to Newton Wellesley Hospital form treatment of lacerations to his hands, legs and possible internal injuries. During the investigation of this crash I discovered via the MA RMV data base that Ahmed's driver's licenses was suspend on 10/05/2020 as a part of a CWOF for 90/24 OUI . Ahmed is on active probation of out Natick Distinct Court until 09/24/2021. Under Comm v. Lopez 91 Mass App. Ct. 485 ( 2017 ) the charge for operating a moped with a suspended license should be charged as 90/10 , operating with out a license as opposed to 90/23 operating with a suspended licenses. Under MGL 90/1d moped must have one number plate issued by the MA RMV , and Ahmed's moped did not. I took photos of Robidoux's vehicle and of Ahmed moped and the disk was downloaded by the NPD's IT Bureau. Based upon statements made to me as well as information from the MA RMV data base I issued Ahmed MA Criminal Application T2015903 and cited him for MGL 90/10, operating with out a license, 89/9 failure to stop for a red light and 90/1d, unregistered moped.

On March 19th, 2021 at approximately 09:11 hours while working N491 I responded to a report of a truck that struck some utility wires. The vehicle was entering #197 California St, McDonalds restaurant when it struck the wires. Captain Dowling arrived first on scene and quickly assessed the situation.He requested several addition units due to the accident scene being unsafe with a utility pole splintered and several high tension wires hanging dangerously low between the parking lot and the street. Dispatch notified all affected utility companies. Additionally the city DPW was contacted to bring out some barricades for the affected area of California St that had to be closed off and traffic detoured around other side streets. McDonalds restaurant also had to be temporarily closed until the scene was deemed safe by Eversource. The operator of the truck was later identified as Richard Cruz, DOB 08/10/1972. He was operating the 2014 Volvo tractor trailer, INDIANA apportioned plate 2802069, owned by the Martin Brewer Company. According to Mr Cruz he was entering the NW side to McDonalds when the cab of his truck caught some low hanging wires from a utility pole that was on the property of #197 California St (McDonalds) As a result the pole had been compromised and the power lines were left hanging dangerously low. The police had the entire area cordoned off with police caution tape. Eversource was responding with two crews to replace the damaged pole. Two police details were hired to free up all police units that had responded to this accident. Officer Marini had also responded at the request of Captain Dowling and performed a level one inspection on the involved truck. Officer Marini later issued a MV citation for minor offenses unrelated to the cause of the accident.

MV1 stated they were facing southbound on Centre St. sitting at a red light at the intersection of Commonwealth Ave. when they felt their vehicle was hit lightly from the rear by MV2. MV1 sustained no injuries or damage to their vehicle. MV2 stated they were stopped at a red light facing southbound on Centre St. at the intersection of Commonwealth Ave. MV3 hit the rear of MV2 and the vehicle went forward and lightly tapped MV1. MV2 had no injuries and minor damage to the rear end of the vehicle. MV3 stated they were stopped at a red light facing southbound on Centre St. at the intersection of Commonwealth Ave. when MV4 crashed into the rear of their vehicle. MV3 sustained heavy rear end damage, minor front end damage and was towed by Tody's. In the vehicle was a sick cat, which was transported to the Vet by Newton Police Animal Control. Passenger in MV3 was taken to Newton-Wellesley Hospital for minor injuries. A towed MV form was completed, MV3 took all valuables prior to tow. MV4 stated they were traveling southbound on Centre St. towards the set of lights at Commonwealth Ave. MV4 stated they attempted to hit the breaks for the red light and rear ended MV3. MV4 sustained minor front end damage. MV4 was issued MA Citation #T2014419 MGL Ch.90 s11 License not in Possession. Photos were taken of the scene and sent to IT.

The operator of MV3 stated he was stopped at the traffic light Westbound on Nahanton St. at the intersection of Winchester St. He stated he took his foot off the break to proceed straight, and due to the glare of the sun impairing his vision, he rear ended MV2. MV3 sustained minor front end damage and the operator was able to drive away from the scene. As a result of being rear ended by MV3, MV2 then rear ended MV1. The operator of MV1 left prior to my arrival after exchanging information. MV2 sustained minor damage to the front and rear end. The operator and passenger of MV2 reported no injuries. The operator of MV2 was given Massachusetts Uniform Citation # T2012850 in hand for Ch. 90 Sec. 10 Unlicensed Operation. MV2 was driven from the scene by a licensed operator. On the above date and time while on Patrol in N496 I responded to 314 Hammond St (Boston College) to assist BCPD with damage to a wall. On arrivial I spoke to BCPD who stated they were alerted by an employee (Luckny Capre) that NP landscaping pulled onto the property to turn around and while pulling back onto Hammond St struck the stone wall ripping it apart. While speaking to BCPD thier dispatch was able to locate the landscaper by phone who stated they were in Newton Corner area and would come back. The landscaper returned and was identified as Luis Chingo-Calel and stated he knew he struck the wall but did not know what to do. I issued Chingo-Calel MA Uniforn Citation #T1447323 for 90/24 leaving the scene with property damage. See also incident report #21040232

On Tuesday, September 21, 2021, I received a call from Sgt. Mike Wade of the Newton Police Traffic Bureau. Sgt. Wade stated a serious MVA/Bicycle crash had just occurred at the intersection of Cherry Street and Derby Street in Newton and the bicyclist was a 10-year-old boy with a possible head injury. Sgt. Wade stated the Traffic Bureau was requested to respond by the Shift Commander and asked if I could respond to investigate the crash. On arrival, Officers reported to me that the cyclist involved, Benjamin Lavoie, was transported to Children's Hospital in Boston with a possible head injury. It was reported to them that Benjamin was traveling Southbound on Cherry Street towards Derby Street on his bicycle. Benjamin entered the intersection of Derby Street and crashed into the front passenger side area of a passing motorist that had a green light. Officers on the scene also reported that the motor vehicle and the bicycle involved had been moved from their original rest location. Cherry Street is a public roadway maintained by the City of Newton. It supports two way travel (N and S) from Washington Street (S) to Waltham Street (N). The travel lanes are divided by an unprotected double yellow line median. The posted speed limit for this street is 25 miles per hour. Derby Street is a public roadway maintained by the City of Newton. It supports two way travel (E and W) from Waltham Street (E) to Lexington Street (W). The travel lanes are divided by an unprotected double yellow line median. The posted speed limit for this street is 25 miles per hour. The weather at the time of the crash was clear and sunny. The road surface in the immediate area of the crash was dry. I spoke with the operator of MV1, Ms. Erica Pusateri (S61409866). Ms. Pusateri stated he was operating her 2021 Kia Seltos (MA: 8HC743) Westbound on Derby Street towards Cherry Street. Ms. Pusateri stated that she had a green light at the intersection and proceeded to cross Cherry Street to continue onto Derby Street. Ms. Pusateri stated halfway through the intersection she heard a noise and saw a bicyclist hit the front passenger side door area of her vehicle. The collision caused the glass window from the front driver-side door to shatter. Ms. Pusateri's vehicle controlled her vehicle to a stop and she observed a young boy lying on the roadway in the intersection behind her. Ms. Pusateri exited her vehicle, ran over to the injured bicyclist, and rendered aid to him by stabilizing his neck. Ms. Pusateri remained on scene and cooperated fully with Officers. I asked Ms. Pusateri if she was distracted at all while operating her vehicle prior to the collison. Ms. Pusateri stated she was not. I asked Ms. Pusateri if she could recall where in the intersection the bicyclist crashed into her vehicle. Ms. Pusateri stated the bicyclist crashed into her vehicle in the Northwest side of Derby Street just outside of the marked crosswalk in the intersection. Ms. Pusateri stated she knows it was in the street in the intersection because she observed a woman with a stroller on the sidewalk on the corner of Cherry Street at Derby Street on the Franklin Elementary School side and she had already travelled through the intersection passed the East side of Cherry Street. Due to the unknown injury status of the bicyclist, Ms. Pusateri's vehicle was towed to the Newton Police Station and secured in the garage area as evidence. Ms. Pusateri reported a small laceration on her right hand with no other injuries. I observed damage to the front passenger side fender/door area. There was no airbag deployment as a result of the crash. I observed glass through out the front passenger side compartment area of the vehicle from the window breaking. I contacted Benjamin' s parents, Cheryl and John, to check on the status of their son. Cheryl stated Benjamin did not suffer any life-threatening injuries and appears to have bumps, bruises, and a cut on his head. I asked if I could speak with Benjamin for his account of what happened at the crash. Benjamin stated he was riding his bicycle on Cherry Street (Southbound) on the sidewalk on the East side of Cherry Street. Benjamin stated he left the sidewalk and entered the intersection to cross Derby Street and continue on Cherry Street. Benjamin acknowledged that at this time Cherry Street had a red light and Derby Street had a green light. Benjamin stated he then crashed into a passing car in the roadway. Benjamin was wearing a helmet at the time of the crash. The helmet had significant damage to it as a result of the collision. I told Benjamin his bicycle was being held at the Newton Police Department for safekeeping and we will arrange to get it back to him. Benjamin is a student at the Franklin Elementary School. I make contact with a witness to the crash, Mr. Benjamin Crosby. Mr. Crosby stated he did not witness the actual crash, just the aftermath. I was able to reviewthe 9-1-1 call Mr. Crosby made regarding the crash in Newton Disptach. Mr. Crosby stated a boy on a bicycle was in a crash with a motor vehicle. Mr. Crosby is heard saying "he went through the light" to the Dispatcher taking the call. After completing my investigation, I have summized the following. The bicyclist (Benjamin Lavoie) traveled down Cherry Street (S) and went through a red light to cross the intersection at Derby Street (W). As a result of traveling through the red light and entering the intersection, he crashed into the front passenger side door area of a passing motorist that had a green light (Erica Pusateri). No citation will be issued as a result of this crash.

The OP. of MV#1 doesn't speak English and had to have a coworker help translate. The OP of MV#1 stated he was travelling on St. James Street northbound slowly because of the snowstorm. He made a slow right turn onto Charlesbank Road but his vehicle slid and crashed into the median in the roadway. The OP. of MV#1 stated he was the vehicle owner and didn't have a valid U.S. driver's license. He couldn't provide any identification and only a picture of his passport on his phone. Due to the narrow roadway and traffic getting backed up from two accidents, the OP. of MV#1 was sent on his way (coworkers picked him up) and advised he will be mailed a citation for being unclicensed.

On Wednesday, February 16, 2022, while assigned to Traffic unit N525, I responded to the intersection of Cabot Street and East Side Parkway for a report of a motor vehicle/bicycle crash. The weather at the time of the crash was clear and sunny. The road surface was dry. Cabot Street and East Side Parkway are both public ways maintained by the City of Newton. I spoke with the operator of MV1 (2016 Mazda CX3, NY: JNB6711), Mr. Tushar Singhal (NY: 287647610). Mr. Singhal stated he was operating his vehicle on Cabot Street (E) towards the East Side Parkway intersection. Mr. Singhal stated he came to a complete stop at the stop sign on Cabot Street. Mr. Singhal stated he did not see any vehicles or pedestrians in the area at this time. Mr. Singhal stated he proceeded to travel through the intersection from his stopped positon and take a left turn onto East Side Parkway. Mr. Singhal stated at this time a bicyclist crashed into the passenger side of his vehicle. Mr. Singhal stated the bicyclist then fell over his hood and onto the roadway. Mr. Singhal reported no injuries from the crash. I observed damage to the front passenger side door, mirror, fender, and hood. Sgt. M. Wade spoke with the injured bicyclist, Keiji Imai, while he was being evaluted by Newton Medics. Mr. Imai stated he was operating his Trek bicycle on Cabot Street (W) towards the East Side Parkway intersection. Mr. Imai stated he was on the sidewalk and entered the intersection with out stopping. Mr. Imai stated he crashed into the side of MV1 and fell to the roadway. Mr. Imai was transported to Newton Wellesley Hospital with minor injuries to his left wrist and rear. Keiji was wearing a helmet at the time of the crash. I observed the helmet to have no fresh damage or defects. Photos were taken of the helmet to document it's condition. Keiji's father, Koguke Imai, was made aware of the crash involving his son and stated he would respond to the hospital. I observed no substantial damage to the Trek bicycle. I transported Keiji's blackTrek bicycle to Keiji's residence. I spoke with a witness to the crash, Ms. Madison Albano. Ms Albano stated she was walking her dog on Cabot Street (E) on the Northbound sidewalk at the East Side Parkway intersection. Ms. Madison Albano stated she observed MV1 approach the intersection to her right side on Cabot Street (E) and come to a stop at the stop sign. Ms. Albano stated she then observed MV1 make a left turn onto East Side Parkway and she heard a crash. Ms. Albano stated she observed a bicyclist crash into the passenger side of MV1 and then fall to the roadway. Ms. Albano stated she did not see the bicyclist prior to the crash and does not know if he came off of the sidewalk or was in the roadway. After speaking with all involved parties, I have summized the following. As MV1 was completing his left turn onto East Side Parkway (N) from Cabot Street (E), the involved bicylist failed to yield at the stop sign while traveling on Cabot Street (W) across the intersection. The bicyclist entered the intersection with out yielding and crashed into the passenger side of MV1. MV1 had the right of way. No citations will be issued as a result of this crash. Photos were taken of the scene and submitted to the IT Bureau. Keiji is a student at Newton North High School.

On 4/22/22 I responded to 101 Charlemont St. for a past MVA that occurred on 4/21/22 at 0700. Operator of MV1 stated they were backing out of their driveway and onto Charlemont St. when MV2 was traveling Eastbound and struck the back of their vehicle. MV1 sustained damage to the rear end. Operator of MV2 stated they were traveling Eastbound on Charlemont when they didn't notice MV1 backing out of their driveway. The front of MV2 hit the rear of MV1. MV1 sustained damage to the front end. MV2 was issued MA Uniform Citation #T1447649 for Ch. 90 Sec. 9 Unregistered Motor Vehicle (Straight Expiration). It should be noted MV2 was down at an auto body shop in Scituate at the time I took the report. As of 4/28/22 the vehicle's registration is now active.
