MV1 (MA Reg: 51JD62, 2007 green Toyota Pruis) operated by Marcia Gittes (DOB 11/29/1948) was traveling Southbound on Walnut St when it collided with a pedestrian in the crosswalk at Walnut St/Foster St. MV1 collided with a man, later identified as Jerome Shectman (DOB 10/7/1964). He had an injury to the back of his head, right hand, left shoulder and lower spine and was transported to Beth Israel Hospital. Witness, Patrick Clare-O'Brien saw the crash take place. He stated that the pedestrian, Jerome was crossing in the crosswalk traveling Westbound towards Foster St, successfully passed through the lane where vehicles were traveling Northbound on Walnut St and was then hit by the Toyota Prudish in the lane going Southbound. Jerome was already halfway through the crosswalk at this point. It was dark, but there was a streetlight directly over this crosswalk on Walnut St creating a semi-lit area for visibility. Mrs. Gittes stated that she didn't see him because he was wearing dark clothing and it was dark outside. She saw him when it was too late. There was no damage to her vehicle. Mrs. Gittes was given a monetary citation (T0646789) for 89/11 Crosswalk Violation. pictures were taken at the scene and the photo SD card was sent to IT. Traffic Bureau update (Officer Gaudet): I was asked to follow up with the injured pedestrian involved in this accident, Jerome Schectman (S77606276). Schectman stated he was attempting to cross Walnut Street east to west towards Foster Street. Schectman stated he entered the crosswalk after observing no cars traveling towards him in the Northbound lane of Walnut Street. Schectman stated he began walking across the street and stopped in the middle of Walnut Street after observing 2 vehicles traveling towards him in the Southbound lane. Schectman stated as the first vehicle went by, he stared at it as it traveled past him and down the street. Schectman stated as he looked back at the second car it was traveling right at him and he was unable to get out of the way. Schectman stated the vehicle hit him on his right side. Schectman listed his injuries as follows: fractured vertebrae, laceration to the back of his head, neck pain, and left shoulder/arm pain.

On Wednesday, January 9, 2019, while assigned to Traffic unit N525, I responded to 457 Walnut Street, Newton for a report of a past motor vehicle/pedestrian accident involving a student at Newton North High School. I met with the pedestrian involved in the accident, Ellie McBride, in the Riley House admin office. McBride is a Freshman at Newton North High School. McBride's mother, Linda Hanusaik, was also present while I spoke with her. McBride stated at approximately 0740 hours, she was attempting to cross Lowell Avenue in a marked crosswalk at Highland Street (E). McBride stated she observed a newer model gray Acura SUV traveling towards her Southbound on Lowell Avenue while she was standing in the crosswalk. McBride stated she thought the vehicle was going to slow down for her. McBride stated as the vehicle got closer it appeared to be slowing down but was unable to avoid making contact with her. The front end of MV1 made contact with McBride's left side. The impact caused McBride to fall down onto the roadway. McBride stated the vehicle pulled over and the operator exited the vehicle to check on her. McBride stated the operator was a white female with long brown hair, possibly high school aged. McBride stated after she told the operator that she wasn't hurt, the operator returned to her vehicle and left the area, possibly towards Commonwealth Avenue. McBride could not provide any additional information about the operator of the vehicle involved. McBride stated she then walked to Newton North High School. McBride stated she went to her morning class but left and texted her mother to tell her she was involved in an accident. McBride stated she was shaken up by the accident, but reported no injuries. Newton Medics evaluated McBride and obtained a patient refusal. McBride was advised that due to the reported age of operator, they may be a student at the high school. McBride was advised that if she sees the operator to obtain her information/contact NPD. I checked the area of Lowell Avenue and Highland Street for the vehicle involved/witnesses with a negative result. A portion of Newton North's athletic fields are next to this intersection. Newton North stated there are no surveillance cameras in this area. Lowell Avenue and Highland Street are both public ways maintained by the City of Newton.

MV 1 WAS UNABLE TO GET A LICENSE PLATE OR A DESCRIPTION DUE TO THE WEATHER (HEAVY SNOW) AND THE FACT THAT THEY JUST PULLED OVER TO THE SIDE AND ASSUMED MV 2 WOULD DO THE SAME. MV 2 NEVER PULLED OVER TO EXCHANGE INFORMATION AND CONTINUED GOING SOUTH ON CENTRE STREET. MV 1 SUSTAINED MODERATE REAR END DAMAGE AND NO INJURIES REPORTED. THERE WAS A PARTIAL PLATE GIVEN BY THE PEDESTRIAN CROSSING THE STREET OF 915.

On Monday, March 11, 2019 while assigned to Traffic unit N525, I responded to the area of Watertown Street and Adams Street, Newton for a report of a motor vehicle/pedestrian accident. The accident was reported to Newton Police Dispatch by Newton Police Officer Charles Guarino. Officer Guarino identified the pedestrian involved in the accident as Newton Police Officer James Selig. Watertown Street and Adams Street are both public ways maintained by the City of Newton. After completing my investigation, the operator of MV1, Colleen Butaney (S20012566) was issued Massachusetts Uniform Citation T1272995 for Chapter 90, Section 25 (Fail to Stop for a Police Officer) and Chapter 89, Section 4A (Marked Lanes Violation). Butaney was advised and the citation was placed in her property in Locker #4 in the NPD holding area prior to her release. Officer T. McCarthy completed and submitted a criminal application for Butaney for Chapter 265, Section 15b (Assault with a Dangerous Weapon, MV). Please refer to incident report #19009204 for statements from all parties involved. Photos were taken of the area/vehicle and submitted to the IT Bureau. The vehicle involved, (MA: 531PX6) was removed from the roadway by Tody's towing. Officer Marini completed a towed motor vehicle report form. Surveillance footage of the incident was recovered from a local business and was submitted to the IT Bureau/Support Services. A property and evidence form was completed and submitted to Officer Manouk.

HE STATED DUE TO THE QUICK STOP HE WAS UNABLE TO BRAKE IN TIME AND REAR ENDED MV 1. MODERATE DAMAGE SUSTAINED TO THE FRONT OF MV 2 AND NO INJURIES WERE REPORTED. THE PEDESTRIAN WHO WAS CROSSING THE STREET STAYED ON SCENE AND CONFIRMED THAT HE WAS TRYING TO CROSS THE STREET AT THE TIME OF THE ACCIDENT.

Vehicle #1 stated they were traveling northbound on Centre St. when Vehicle #2 was stoped infront of him and was attempting to take a left on Homer St. Vehicle #1 stated he attempted to pass Vehicle #2 on the right to continue going straight when Vehicle #2 cut his wheel and pulled out infront of him. Vehicle #1 stated he continued around Vehicle #2 and continued to drive. Vehicle #1 stated that Vehicle #2 started to follow him and at some point his vehicle was struck by Vehicle #2 on the side of the rear left bumper. Vehicle #2 stated he was attempting to turn left onto Homer St. and was allowing a pedestrian to cross the road infront of him. Vehicle #2 stated he saw Vehicle #1 passing him on his right and attempted to get his attention. Vehicle #2 stated that when Vehicle #1 was passing him he clipped the front right of his vehicle. Vehicle #1 had minor damage to the side of his rear left bumper and was able to be driven away. Vehicle #2 had minor damage to the front right corner of his vehicle and was able to be driven. Both operators were asked if they were injured in the accident and both stated they were uninjured. Due to many inconsistancys in the stories from both operators and the statements from witnesses I am unable to determine who is at fault in the accident. Narrative:
On Tuesday, April 16, 2019 while assigned to Traffic unit N525, I responded to the area of Plymouth Road and Cochituate Road, Newton for a report of a motor vehicle/pedestrian accident involving a City of Newton vehicle. The weather at the time of the accident was clear and sunny. The road surface was dry. Plymouth Road and Cochituate Road are both public ways maintained by the City of Newton. The injured pedestrian, Officer Steven Emmanuel, was transported to Newton Wellesley Hospital prior to my arrival on scene. I spoke with the operator of MV1, Officer Justin Lau. Lau stated he was on duty in his official capacity as a Newton Police Officer while operating a City of Newton owned 2018 Ford Fusion (MA: 9PYM80, Newton PD #1319). Lau stated he was parked on Plymouth Road (N) at Cochituate Road and was speaking with Officer Steven Emmanuel. Lau stated Emmanuel was standing next to the front driver side door area of his vehicle in the roadway. Lau stated a large delivery trucked approached their location on Plymouth Road from Woodward Street and was attempting to make a right turn onto Cochituate Road. Lau stated Emmanuel directed him to back his vehicle up so the delivery truck could get by their location. Lau stated he cut the wheel of the vehicle he was operating to the right; and very slowly began to back up from his location. Lau stated he was attempting to back the vehicle up to get closer to the curbing and out of the roadway. Lau stated as the vehicle was in motion the front driver side wheel made contact with Emmanuel's left foot. Emmanuel's left foot subsequently became lodged in the front driver side wheel well area. Emmanuel fell to the ground in obvious pain. Emmanuel directed Lau to pull the vehicle forward in an effort to release his foot. Emmanuel's foot was freed and NPD Dispatch was notified of the accident. Pictures were taken of MV1 and submitted to the IT Bureau. I observed no damage to the front driver tire area. I spoke with Officer Steve Emmanuel in the Newton Wellesley Hospital emergency room where he was being evaluated for a left foot injury. Emmanuel stated at the time of the accident he was working a paid detail for Paramount Pictures on Plymouth Road in his official capacity as a Newton Police Officer. Emmanuel stated he was speaking with Officer Lau on Plymouth Road at Cochituate Road. Emmanuel was standing in the street on his post and Lau was sitting in MV1 (parked). Emmanuel stated a Fed Ex delivery truck approached their location in the roadway and was attempting to get by them. Emmanuel stated Lau began to back his vehicle up in an effort to get out of the way of the delivery truck. Emmanuel stated the front driver side tire of MV1 ran over his left foot. After the tire ran over his foot, it then became lodged in the wheel well and he fell to the ground. Emmanuel stated his foot was freed from the vehicle and he was transported to Newton Wellesley Hospital by Newton Medics for further evaluation.

Narrative:
On Sunday, May 5th, 2019 at approximately 1315 hours while working the City of Newton detail for the Walk for Hunger I was standing at my assigned post at the intersection of Centre Street and Willow Street. At the time, the road surface was dry and the weather was cloudy. Traffic was particulary heavy as there were several streets in the area still blocked off for the Walk for Hunger and there were participants still walking the route in the area. My attention was drawn to the intersection of Centre Street and Bowen Street as there was a motor vehicle travelling southbound on Centre Street with their left turn signal on attempting to take a left turn on to Gibbs Street. Gibbs Street was temporarily blocked to non-residential motorists as there were several pedestrians in the road crossing over Gibbs Street. As the motor vehicle attempted to turn, there were several pedestrians in the crosswalk crossing over Gibbs Street. The vehicle had stopped halfway into the northbound lane on Centre Street blocking on coming traffic. The operator appeared to realize Gibbs Street was blocked and attemped to turn the vehicle back into the southbound lane to continue southbound on Centre Street. As the vehicle turned back into the southbound traffic lane, the vehicles rear end collided with Officer Richard Clements, who was operating NPD motorcycle unit 533. Officer Clements was traveling southbound on Centre Street and was passing the vehicles in the southbound traffic lane which were currently all at a standstill. Officer Clements had his emergency lights activated as he was on his way to remove traffic cones from the street to open up all the traffic lanes along the event route. Officer Clements was working the City of Newton detail for the Walk for Hunger assigned to the motorcycle to assist with traffic. Officer Clements front wheel, left side of the motorcycle and left leg collided with the rear end of the motor vehicle. The impact of the crash caused him to fall off the left side of the motorcycle and land on the street face first. At this time I immediately ran from my post to Officer Clements location and radioed dispatch that a motorcycle officer was down and that I needed assistance. As I approached Officer Clements he was face down, unconcious and breathing. I was able to roll Officer Clements into the recovery position and at this time Officer Clements regained conciousness and was able to speak and stated " What happened? What was that lady doing she turned right into me". I advised Officer Clements that he had just been involved in an accident and to stay still and that help was on the way. The operator of the motor vehicle identified as Helen Leibner (S52717988) stopped her vehicle immediatley after the crash and got out of her vehicle to offer her assistance. I advised Helen and several other witnesses and bystanders who were now crowding around Officer Clements and I to back away from the scene and to not move any of the vehicles involved. Officer Selig arrived on scene and was able to help crowd control until further help arrived. Helen and all witnesses were advised to stand by for police to take their statements. While tending to Officer Clements he was disoriented and made several attempts to move his body to which I had to physically hold him still to prevent possible further injuries. While speaking with Officer Clements I noticed blood coming from the inside of his mouth. Officer Clements was in a noticeable amount of pain. He complained of head, back and left leg pain. Officer Clements was wearing a yellow ANSI certified Newton Police reflective jacket and a Newton Police issued motorcycle helmet. Once the paramedics and fire personnel arrived I was able to speak to the operator of the motor vehicle and several other witnesses. Helen stated she was traveling southbound on Centre Street operating her blue 2014 Audi A4 (MA REG 213BC9). Helen states she was attempting to take a left turn onto Gibbs Street and activated her left turn signal. Helen states she had stopped halfway into the northbound lane as several pedestrians were crossing Gibbs Street in the crosswalk at the time. Helen states after the pedestrians cleared she saw the traffic cones blocking the street and realized the street was closed. Helen states she turned her vehicle back into the southbound traffic lane and did not see Officer Clements or the motorcycle until impact. Helen was not injured and her motor vehicle sustained moderate rear end damage. Her motor vehicle was able to drive away from the scene. Witness Adron Gordon (S90357161) stated he was participating in the Walk for Hunger and had just crossed over Gibbs Street when the crash occured. He stated he witnessed the Officer on the motorcycle with the emergency lights on traveling southbound on Centre Street behind the motor vehicle. The motor vehicle stopped in traffic attempting to turn left onto Gibbs Street. He states then the vehicle made a slight turn back into the southbound traffic lane and the motorcycle collided with the rear end of the motor vehicle. He states the Officer then fell off the motorcycle landing in the middle of Centre Street. Witness Elizabeth McCarthy (S00242346) and Katherine Regan (S43486601) stated they both were in the same vehicle together stopped in traffic in the northbound lane of Centre Street just before the set of lights at Centre Street and Bowen Street. Both witnesses stated they do not remember if the driver of the motor vehicle had the turn signal on but they did see her attempt to turn onto Gibbs Street. They stated they also saw the motorcycle with emergency lights activated travel southbound on Centre Street approaching behind the vehicle. Witnesses state the motor vehicle then suddenly turned back into the southbound lane and the motorcycle collided with the passenger side tailight of the motor vehicle. Both witnesses state the motorcycle attemped to turn away from the vehicle to avoid the crash but was unable to do so. Witness Nina Wang (S39460985) stated she was parked on the southbound lane of Centre Street just prior to the crash scene. Nina states she was in her City of Newton DPW marked vehicle with the hazards on as she was working to assist with traffic safety for the Walk for Hunger. Nina states she witnessed the motorcycle travel southbound on Centre Street and pass the vehicles stopped in the traffic lane. Nina states the motorcycle passed the traffic using the left side and had the emergency lights activated. Nina states the motorcycle was just passing through the green light at Centre Street and Bowen Street when the motor vehicle that was stopped at the lights attempting to take a left turn onto Gibbs Street. Nina states the vehicle then abruptly jerked her car to the right and collided with the motorcycles left side. Nina states she heard a loud crash and witnessed the Officer fall off the motorcycle and land face first onto the street. The motorcycle's final resting place was on its left side approximately two feet away from where Officer Clements was located. The motorcycle sustained moderate damage to its left side, including the front wheel well and undercarriage. The motorcycle left scuff marks on the street which were measured and photographed. Several photographs of the scene and damage to both vehicles were taken and submitted to the IT Bureau. The motorcycle was towed by Todys. Centre Street and Bowen Street are both public ways maintained by the City of Newton. The injured motorcyclist, Officer Clements, was transported to Saint Elizabeth Hospital with fire fighters on board. I was able to follow up with Officer Clements on the phone the next day who was admitted over night at the hospital. Officer Clements stated he has no recollection of the accident and can only remember driving down Centre Street to begin to pick up cones to open up all lanes of traffic. Officer Clements stated he suffered a brain bleed, head, back, left foot and right thumb injuries. A Massachusetts Uniform Citation was issued and mailed to Helen for Chapter 89 Section 7A, failure to yield to emergency vehicle, police motorcycle.

Operator of MV1 states she was driving westbound on Woodward St. MV1 stopped for a pedestrian in the crosswalk at Plymouth Rd. MV2 was traveling directly behind MV1 and did not stop in time. MV2 collided with the rear of MV1. Operator of MV2 states MV1 stopped quickly, and she was unable to stop behind her, causing the collision. Neither party was injured. Both vehicles were towed by Todys. Operator of MV2 admitted she did not have a license. She was issued MA citation T1444158, for 90/10 unlicensed operation, and city ordinance 19/71, following too closely. Woodward St is a public way in the City of Newton.

Operator of MV1 stated he was traveling southbound on Centre Street and came to a stop to allow three pedestrians and a dog to cross at the crosswalk at Allerton Rd. Operator of MV2 stated he observed MV1 stopping to allow people to cross and he came to a complete stop as well. Operator of MV3 stated she did not see MV2 stopped and did not see his brake lights on. MV1 said that when the pedestrians were about three quarters of the way crossed, he heard a loud crashed and saw MV2 swerve into the on coming traffic lane. MV2 made slight contact with the rear of MV1 causing scratches to the rear left bumper. MV2 said MV3 struck him from behind causing him to push forward. He swerved into the on coming lane to avoid hitting MV1. He continued to turn to the left in order to avoid the pedestrians that were still crossing. No contact was made with them. Newton Fire Engine 3 and Cataldo PB3 responded. MV2 was towed by David Donahue from Todys Towing. It sustained major rear end damage. The operator of MV2 was evaluated by Cataldo PB3 and signed a patient refusal. MV3 was towed by Bobby Donahue from Todys Towing. It sustained heavy front end damage, front air bag deployment and a small spill from the engine block. Operator of MV3 was evaluated and transported to NWH by PB3 for minor injuries. The three pedestrians witnessed the accident. All three stated that MV1 stopped to allow them to cross and they saw MV2 also come to a complete stop. MV3 struck MV2 from the rear causing him to swerve into the on coming lane to avoid hitting MV1 and them.

On Friday, August 16th 2019, at approximately 6:40pm, I, Officer Brooks, responded to Dunstan street at Washington street for a MVA pedestrian. Upon my arrival I spoke with the operator of MV1(294NZ5), who stated she was traveling southbound on Dunstan street and was attempting to pull out onto Washington street, when she made contact with a bicyclist traveling westbound on Washington street. The operator stated she never saw the bicyclist, and that she was traveling less than a mile per hour when she made contact. It should be noted that the sun was setting and the operators vision would have been impaired by the sun at the location of the accident. MV1 had a minor scuff mark on the front bumper. I spoke with the bicyclist who stated he was traveling westbound on Washington street and was crossing over Dunstan street when he was struck by MV1. He stated he was knocked off the bike, scraped his arm, and had minor back pain. The mirror on the right side of his bike was broken. The bicyclist was wearing greenish gray clothing, and was not wearing protective equipment such as a helmet. The bicyclist signed a refusal from Cataldo and was given a copy of the report number. Pictures were taken of the scene and all parties were sent on their way.

On Wednesday October 23, 2019, I, Patrolman Hatfield, was assigned to marked cruiser N495 in full uniform to Division 5 for the 1530 to 2330 hour shift. At approximately 2040 hours, myself and Officer Selig were traveling northbound on Centre St (a public way) in Newton Center. We were behind MA reg 9KT873 (2004 Toyota Corolla grey). We observed the motor vehicle drive around a pedestrian in the crosswalk who was attempting to cross at Centre St and Pelham St. I activated my emergency blue lights and attempted to conduct a motor vehicle stop of the Toyota Corolla. The operator continued to drive northbound on Centre St before pulling over just before the crosswalk at Centre St and Pleasant St. The operator then continued driving forward and struck a pedestrian crossing in the crosswalk Officer Selig and I saw the pedestrian being struck before landing on top of the Toyota Corolla hood, and falling forward onto the street. Officer Selig and I spoke with the two parties involved. I spoke with the victim, who was identified as Vivian Rubinstein (Vivian). Vivian crawled towards the sidewalk of Centre St while clutching her lower back. Initially Vivian denied being injured and refused medical aid. The Toyota Corolla operator was identified as the register owner Elise Ruben (Elise). Elise stated to Officer Selig that her front windshield was foggy and when she noticed the blue lights, she attempted to pull over. Elise stated she did not see the pedestrian in the crosswalk. Elise appeared very upset and refused medical treatment. Officer Selig was able to speak to two witnesses of the accident. The witnesses were identified as Stephan Aparicio (Stephan) and Mikaela Rice (Mikaela). Stephan said he was behind the victim in the same crosswalk. Stephan stated he saw the Toyota stop in front of the crosswalk and then drove forward hitting the female. Mikaela stated she was parked in her motor vehicle on Centre St facing northbound (facing the crosswalk). Mikaela stated she saw the female walking halfway across the crosswalk and the Toyota continuing drive forward before hitting the female. Officer Siegel arrived on scene and took four photographs which was submitted with this report. Vivian was transported by Newton Medics to Faulkner Hospital for an evaluation. I issued written warning citation number T2079786 to Elise for failure to yield to a pedestrian in crosswalk (Centre St at Pleasant St). I also issued Elise citation number T2079787 for failure to yield to a pedestrian in crosswalk (Centre St at Pelham St). The vehicle was driven from the scene.

On Monday, November 4, 2019, while assigned to Traffic unit N525, I responded to the intersection of Walnut Street and Walnut Place, Newton for a report of a motor vehicle crash involving a pedestrian. The weather at the time of the accident was clear and sunny. The road surface was dry. I spoke with the injured pedestrian, Ernestine Gianelly, as Newton Medics were preparing her for transport to the hospital. Gianelly stated she was crossing Walnut Street in a marked crosswalk towards Washington Park after leaving the Newton Senior Center located at 345 Walnut Street, Newton. Gianelly stated a vehicle exited Washington Park and turned left onto Walnut Street directly at her. Gianelly stated she believes the driver did not see her. Gianelly stated the vehicle hit her while she was in the marked crosswalk on her left side. Gianelly stated she then fell to the roadway. Gianelly was taken to St. Elizabeth's hospital in Boston for injuries to her ribs, back, and sides. I spoke with the operator of MV1, Alex Cook-Williams (S13317988). Cook-Williams stated he was operating his 2009 Pontiac Vibe (MA: 222FV5) Westbound on Washington Park towards Walnut Street. Cook-Williams stated he came to stop at the intersection and observed no traffic in either direction of Walnut Street. Cook-Williams stated he made a left turn onto Walnut Street and did not see the crossing pedestrian until it was too late. Cook-Williams stated he slammed on his brakes and the pedestrian landed on his hood. Cook-Williams stated the pedestrian then fell to the roadway. Cook-Williams reported no injuries. Cook-Williams stated he did not know if the pedestrian was in the crosswalk or not at the time of the crash. I observed minor damage to the passenger side hood/bumper area. Cook-Williams stated he was not distracted at the time of the accident. After speaking with all parties involved, Cook-Williams was issued Massachusetts Uniform Citation T2016426 for Chapter 89, Section 11 (Fail to Yield, Pedestrian in Crosswalk). Walnut Street, Walnut Place, and Washington park are all public ways maintained by the City of Newton. Photos were taken and submitted to the IT Bureau.

The pedestrian was transported to the hospital by medics. Pictures were taken of his injuries to be attached to this report. MV#1 was driven off scene. Pictures were take of the damage to MV#1. A citation was issued to the operator of MV#1.

On Tuesday November 12th, 2019 at approximately 1224 hours while working in N526 I responded to the intersection of Derby Street and Waltham Street for a motor vehicle vs. pedestrian accident. At the time of the accident the weather conditions were cloudy and rainy, and the road surface was wet. Both Derby Street and Waltham Street are public ways owned and maintained by the City of Newton. Upon arrival I spoke with the pedestrian identified as Helen Makadia (S35538182) who stated she was walking in the crosswalk on Waltham Street heading towards Derby Street when she was struck by MV1. Helen stated she was able to walk to the side of the road after impact but complained of knee pain. Medic 2 responded and Helen signed a patient refusal. Sgt. Lee transported Helen to the Franklin Elementary School where she was picking up her children and then she left on her own accord. The operator of MV1 identified as James Bond (S93760526) stated he was taking a left turn from Derby Street onto Waltham Street and did not see the pedestrian in the crosswalk until he struck her with his vehicle. James was very remorseful and acknowledged he was at fault. James reported no injuries and had no damage to his vehicle. I issued James in hand a Mass Uniform Citation #T2012435 for Chapter 89 Section 11 for failing to stop for a pedestrian in the crosswalk.

On Wednesday 12/4/2019 at approx 2110hrs, while assigned to N-494, I responded with the medics to 22 Park St Apt #5 in Newton for a past MVA pedestrian. There I was met by Annie Peng who states that at approx 730pm this evening she was struck by a vehicle(mass reg 6258) at the intersection of Washington St and Park St. She states that when she was entering the crosswalk after crossing over the mass pike bridge, she was struck from the right passenger side of MV1. Peng states she fell a few feet from the car injuring her right knee and right arm. She said that the operator stopped and got out to assist and left his contact info. Peng signed a patient refusal form and pictures of her injuries were taken and submitted to IT. It should be noted that Peng believes her cell phone was broken after hitting the ground. I later spoke with Dr. Ross, operator of MV1, who stated that he had not seen Peng crossing after he came to a complete stop at the crosswalk which had a "right turn on red after stop" sign. He said he was going "one or two miles per hour" when Peng collided with his passenger side door. Ross stated he got out to help her and offered to take her to the hospital.

MV#1 was traveling south on Walnut St, and attempting to take a right turn onto Floral St. The pedestrian was crossing Floral St, south bound, in a cross walk. MV#1 hit the pedestrian with his passenger side mirror causing him to fall to the ground. I first spoke with the operator of MV#1. The operator stated he was making a right turn onto Floral St from Walnut St, and due to the heavy traffic he was moving at a slow pace. The operator stated that as he was making the right turn, he did not see the pedestrian in the cross walk. Operator stated that as soon as he heard his mirror hit something, he immediately came to a stop and went to go and check what he hit, and found that it was a pedestrian. I next spoke with a witness. The witness stated that he was walking behind the pedestrian. The witness stated that he observed the pedestrian begin to cross at the cross walk, and the truck make the turn. The witness stated that the truck was moving slowly as he made the turn. The witness stated that as he was making the turn, he observed the side mirror hit the pedestrian, knocking him over. I finally spoke with the pedestrian. He stated that he does not remember getting hit by the mirror of the truck. Multiple pictures were taken of the scene. MV#1 had no visible damage to the vehicle, but the passenger side mirror was pushed back against the door. The pedestrian was transported to Brighams by medics with apparent minor injuries. Due to the poor lighting conditions, the statments made that the vehicle was traveling slowly, and that the pedestrian was dressed in dark clothing, no citation was issued at this time.

I spoke with the operator of MV1, Jill Edelson (S99137352). Edelson stated she was stopped in traffic while operating her 2012 Toyota Camry (MA: 81ZH83) Northbound on Walnut Street at Lincoln Street at a red light. Edelson stated the light turned green and she had a green left turn only arrow. Edelson stated she turned left into Lincoln Street from Walnut Street when the front passenger side of her vehicle crashed into a pedestrian in the roadway. Edelson stated she did not see the pedestrian prior to the impact. I observed damage to the lower portion of the passenger side windshield. Edelson reported no injuries. I spoke with the injured pedestrian, Lawrence Murren, at Brigham and Women's Hospital. Murren stated he had entered the crosswalk on Lincoln Street at Walnut Street and does not remember if he had the pedestrian signal. Murren believes MV1 did have the green light. Murren stated after he entered the crosswalk he looked back towards the "59 Bus". Murren stated he then looked forward and saw MV1 was in front of him. Murren stated he was unable to avoid the vehicle. Murren stated he has an injury to his hip and had a head laceration. I spoke with a witness to the accident, Edward Austin. Austin stated he was in the vehicle behind MV1 at the traffic light on Walnut street. Austin stated the traffic light turned green and MV1 had a green left turn arrow. Austin stated MV1 started to go and make their left turn. Austin stated he observed an older gentleman starting to walk out into the street. Austin stated the pedestrian had his head down and had an umbrella due to the rain. Austin stated the pedestrian also had a do no walk sign. Austin stated MV1 hit the crossing pedestrian in the crosswalk. Austin stated he does not believe either saw each other. Photos were taken of the area and submitted to the IT Bureau.

I observed no damage to the right passenger side of MV1 where the contact occurred. Gilmore reported no injuries. The injured pedestrian, Charles Doris-Pierce (S68331436), was transported to Brigham and Women's Hospital in Boston for his injuries. I followed up with him in the Emergency Department. Doris-Pierce stated MV1 was stopped at the stop sign on California Street. Doris-Pierce stated he entered the marked crosswalk and began to cross California Street at Crafts Street. Doris-Pierce stated MV1's right passenger side tire ran over his foot. Doris-Pierce stated he then slammed on the hood of MV1. Doris-Pierce stated MV1 continued and he was knocked to the ground. Doris-Pierce reported injuries to his foot, thigh, and back. After speaking with all parties involved, the operator of MV1 was issued Massachusetts Uniform Citation T2016430 for Chapter 89, Section 11 (Failure to Yield to a Pedestrian in a Crosswalk). The operator of MV#1 stated he was travelling northbound on Walnut St when the top portion of his vehicle caught some low hanging wires and took down 2 utility poles and damaged a third utility pole. There were no reported injuries to the operator of MV#1 and no visible damages to MV#1. The operator of MV#1 is a delivery driver that is familiar with the area and frequents the same route. There were several live primary wires down on Floral St and Walnut St. Unit N-498 Officer Raymond blocked off Walnut St at Centre St, Unit N-502 Officer Nardelli blocked off eastbound Floral St and I blocked off Walnut St at Lincoln St. The surrounding pedestrian sidewalks were all taped off with Police caution tape. MV#1 struck the low hanging wires on Walnut St at the intersection of Floral St. Utility pole #A (47/12 ) located on Walnut St directly in front of the parking of the "Orchid Dry Cleaners" at 1175 Walnut St was cracked at the base. Utility pole #B was located on the westbound side of Floral St was split at the base and was dangling over the parking lot at 1175 Walnut St. Utility pole #C was located on the eastbound side of Floral St and was completely removed from its foundation and was now leaning on the building at 1182 Walnut St. The street/ stop sign of Floral St was damaged with the "Stop" sign and the "Floral St" sign completely removed from the pole (Located on the eastbound side of Floral St). A city tree limb that was damaged and landed on top of parked Vehicle #2 (Parked on the eastbound side of Floral St across from 49 Floral St. Wisconsin registration 850TGM). The owner of vehicle #2 was informed of the damage. Traffic Officer Gaudet took digital photographs of the damaged street/ stop sign and the damaged city tree. The witness Pat O'Hara of 1185 Walnut St stated MV#1 did not cause the accident but a previous bigger truck did. All he could provide was that the vehicle was a big truck travelling northbound on Walnut St. The witness Edna Jacquet stated she was parked on Walnut St (Parked between 09:00 to 09:15) at the MBTA bridge facing southbound when she observed the accident. Edna stated she observed the operator make eye contact with her and she proceeded to honk her horn in attempts to stop him. Edna stated the vehicle that caused the accident was a white colored 18 wheeler type of truck with the markings of "3 letters" all in different colors. Edna have a company video camera that faces forward attached to her vehicle that may have captured the accident. I spoke to her company manager Lisa Sanella at "TransAction Corporate Shuttles" located at 5 Wheeling Ave in Woburn MA and she will notify me if she is able to view video footages. The building owner of 1170- 1176 Walnut St Stas Gavronsky have a surveillance camera that faces Walnut St southbound towards Floral St. He will review the video footages once power have been restored that the area and notify me. On 01/07/2020 Lisa Sanella contacted me stating that they were able to review video footages from the front facing camera of Edna's shuttle bus. She stated that the involved vehicle was described as a big white colored 18 wheeler type of truck and did not have a front registration plate but did display the commercial company name of "GHG Logistics". Lisa stated the accident was time recorded at 09:13. Lisa made a copy of the video footage and will attempt to email it or deliver a flashdrive to me. An internet search of GHG Logistics showed that it is a distribution company out of 6390 Hedgewood Dr suite #300 out of Allentown PA. This company distributes wholesale sushi to the northeast area and their delivery trucks are equipped with "Rydsmart" GPS tracking devices enabling them to know their locations at all times. I spoke to Joanna Gerwig who is the store support team leader of the "Wholefoods" located at 916 Walnut St inquiring about a possible sushi delivery and she confirmed that GHG Logistics does regular deliveries and did deliver items yesterday morning between 08:00 -09:00. She stated that the truck displayed trailer #250634-481801 and that the driver was described as a big sized white male by the name of "Will" with a contact number of (570) 350-3453. She also have video footages of the truck making the delivery and provided me with their contact number of (800) 668-7700 and their corporate number of (484) 223-4502 (Confirmed to be the same company as my internet search). I viewed the video footage from Transaction Corporate Shuttles and it showed the 18 wheeler truck was travelling northbound on Walnut, catching the utility wires above and causing an electrical spark on the eastbound side of Floral St. It showed the truck slowed down and then continued to travel northbound. I spoke to Will at (570) 350-3453 and he confirmed he was making deliveries to the Wholefoods and was on Walnut St at approximately 09:00. Will stated the top corner portion of his truck did catch the above wires and heard a "twang". Will stated he briefly stopped and did not observed any damages so he continued to make his deliveries. Will stated he have been making the same delivery route for 2 years and never had an issue with low hanging wires. Will's full name is William L. Gray and have a Pennsylvania driver's license # 24551299. The truck's registration is apportioned Indiana 2917618. I have forwarded the video footage to the I.T bureau and it was attached to this report.

On 01/09/20 at approximately 13:30 hours, a pedestrian Scott Lorenz came in to the lobby of Newton Police Headquarters to report that he was struck by a motorist while crossing the intersection of Cherry & Webster Streets. This accident took place at approximately 13:00 hours on this date. Mr. Lorenz further stated that he was walking on foot and attempting to cross Cherry Street going eastbound at Webster Street. He says that he did not activate the cross walk signal but thought it was clear to proceed as Webster Street had a red light signal. While attempting to cross, he says that the westbound lane of Webster Street received a green light and MV1 proceeded to turn left on to Cherry Street from Webster Street. He then looked at the motorist and thought that she saw him. Once she kept approaching and realizing that he was not seen, he started to back track but was struck by the front end of MV1. Lorenz then tumbled back and fell down to the ground. He says that he got up feeling fine and alerted the motorist that he was struck. The two of them exchanged information and then left the scene with out notifying 911 of the accident. After, Lorenz then came in to Newton Police Headquarters to report it. I observed a small round swollen red mark to the inside of his right knee area and a red mark to the back left side of his neck. Digital photos were taken of his injuries. Mr. Lorenz declined medical attention and wanted this incident documented in case his possible injuries worsened. I then spoke to the operator of MV1, Sharon Pywell (MA S23277423), on the phone after. Pywell stated that she was operating her Toyota Prius bearing MA reg. # 2197RW on Webster Street facing westbound at Cherry Street waiting for the green signal to turn left on to Cherry Street. Once the light changed, she attempted to turn and never saw a pedestrian trying to cross Cherry Street. I asked her if she ever felt contact to which she replied that she was not aware that she ever struck someone. She further says that once she did see him, she believed that he never lost his balance or ever fell down. She says that he retrieved his backpack from the ground and approached her driver's side opening her door stating that he was struck by her.

Operator of MV1 stated while traveling Northbound on Walnut Street MV2 was traveling close to his vehicle. Operator of MV1 stated as he approached the crosswalk to let a pedestrian cross, MV2 was in the left turn only lane onto Austin Street. Operator of MV1 stated MV2 then passed him on the left, striking the driver side of his vehicle and continued on Walnut Street toward Washington Street. Operator of MV1 stated as MV2 passed he was able to get a License Number of that vehicle. After speaking with the Operator of MV1, I contacted the Operator of MV2. The Operator of MV2 stated while traveling Northbound on Walnut Street, MV1 was attempting to look for a parking spot by stopping at times and turning his turn signal on and off. Operator of MV2 stated as MV1 turned his turn signal on and stopped after multiple times of breaking, he went around MV1. Operator of MV2 stated he did not know he struck the other vehicle and that is why he continued on Walnut Street. MV1 had moderate damage to the driver side of the vehicle. MV2 had moderate scratches to the passenger side of his vehicle.

On Monday January 13th 2020 at 1830, CHAN, Alyssa came into the front desk to report a past MVA vs pedestrian. At 1300, she was walking on Herrick Rd when she crossed by an entrance to a driveway by 17 Herrick Rd, when a vehicle pulled out and struck her. She states she was hit on her left side of her body and used her hand to brace herself against the car. The operator of MV1 asked her if she was ok, which she said she was, and then drove off. CHAN was later evaluated by her primary care physician, which advised her to monitor her wrist for any development of injury in the coming days. I spoke to the owner of MV1, who stated his son was driving the car today. Operator of MV1 stated he was pulling out of a driveway next to 17 Herrick Rd and looked both ways before pulling out, but did not see the pedestrian walking in front of his car. He states he got out and asked if she was ok, and she continued to walk away without talking. I did not observe any injuries on CHAN while speaking with her and she denied any further medical attention. No damage was reported on MV1.

On January 16, 2020 Officer Bergdorf, Sergeant M Wade and I, Officer Guarino responded to Union St @ Langley Rd for a report of a motor vehicle crash into a bicyclist. Upon arrival, both the operator of MV1 and the bicyclist were inside of 45 Union St, "Baramor" to get out of the cold. I spoke with the bicyclist who was complaining of left wrist and left hip/ tailbone pain. The bicyclist was driving Southbound on Langley Rd on the sidewalk on his black bicycle with no lights. He said that as he was traveling on the sidewalk on Langley Rd, crossing the intersection of Union St (just outside of the crosswalk), he was struck on his right front of the bicycle causing him to fall on his left side. The bicyclist was not wearing a helmet and did not have any lights on his bicycle. He was wearing a blue jacket and dark pants on a black bike. The operator of MV1 spoke with Sergeant M. Wade and Officer Bergdorf. MV1 said that he was traveling East on Union St and stopped at the stop sign and did not see any pedestrians or traffic coming. He proceeded across Langley Rd and struck the bicyclist with the front driver's side of his vehicle. Officer Bergdorf took photos at the scene, which were submitted to IT to be attached to this report. The bicyclist was transported to Newton-Wellesley for medical treatment. His bicycle was transported to his house and secured by Officer Larson.

Narrative:
On Thursday, January 23, 2020 while assigned to Traffic unit N525, I responded to the intersection of Brookline Street and Hartman Road, Newton for a report of a motor vehicle/pedestrian crash involving a City of Newton Crossing Guard. The weather at the time of the crash was overcast. The road surface where the crash took place was dry. Brookline Street and Hartman Road are both public ways maintained by the City of Newton. On arrival, the injured pedestrian was in the process of being transported to Newton Wellesley Hospital with minor injuries. I spoke with the operator of the vehicle involved in the crash, Menachem Uminer (S43996134). Uminer stated he was operating his vehicle on Brookline Street (S) towards Hartman Road. Uminer stated he was stopped in traffic on Brookline Street prior to the crash. Uminer stated the vehicle in front of him proceeded to travel straight from it's stopped position and he then began to follow the traffic on Brookline Street. Uminer stated he did not see anyone in the vicinity of his vehicle as he began to travel straight from his stopped position. Uminer stated as he was traveling by Hartman Road, the front passenger side area of his vehicle made contact with a pedestrian on the right side of Brookline Street at Hartman Road. Uminer stated he did not see this party until after they were struck and he then proceeded to pull his vehicle over. Uminer stated he was operating his vehicle at a very low speed at the time the collision took place. After speaking with Uminer, I observed the white 2017 GMC Yukon (MA: 9NX525) involved in the crash parked on Brookline Street (S) just past Hartman Road. Uminer stated the vehicle had been moved after the collision took place. I observed no obvious damage to the body of the vehicle on the front passenger side area where the collision took place. The front passenger door mirror was folded inward towards the door. Uminer stated he believes the front passenger door mirror was the point of contact between his vehicle and the pedestrian. I spoke with a witness to the crash, Ashley Garcia (S94193596). Garcia stated she was attempting to cross Brookline Street at Spaulding Lane. Garcia stated she entered the marked crosswalk and was a few steps into Brookline Street when a black colored vehicle traveling on Brookline Street (N) slammed on its brakes near the crosswalk. Garcia stated she looked to her left at the vehicle and then heard a thud to the right from the area where the crossing guard was standing near Hartman Road. Garcia stated she looked over and saw a crossing guard on the roadway on Brookline Street (S) at Hartman Road. The injured pedestrian involved in the crash is Cassandra Alexander (S23636307). Alexander is a crossing guard for the City of Newton and is assigned to the intersection of Brookline Street and Hartman Road for the Memorial Spaulding school crossings. This crash occurred while Alexander was performing her official duties. Alexander was wearing her department issued yellow reflective jacket at the time of the crash. I spoke with Alexander at Newton Wellesley Hospital where she was being treated for her injuries. Alexander stated she was performing her duties as a crossing guard at the intersection of Brookline Street and Hartman Road. Alexander stated she had just finished crossing two pedestrians in the marked crosswalk on Hartman Road when observed a pedestrian enter the crosswalk on Brookline Street at Spaulding Lane. Alexander stated she began to enter the intersection of Brookline Street at Hartman Road with her hands up and her department issued yellow reflective jacket on in an effort to stop traffic in the area to allow the pedestrian in the marked crosswalk safely cross. Alexander stated she was struck on her left side by a passing vehicle. Alexander stated she did not see the vehicle and fell to the roadway. Alexander stated as she was falling to the roadway she extended her right arm in an effort to brace her fall. Alexander stated she had injuries to her arms and legs and was sore from the collision. I spoke with a second witness to the crash via telephone, Anand Vaidya (S43996134). Vaidya stated he was stopped in traffic behind MV1 on Brookline Street (Southbound). Vaidya stated he observed the vehicle in front of MV1 proceed straight on Brookline Street after being stopped in traffic. Vaidya stated he then observed MV1 proceed straight on Brookline Street at Hartman Road at a low rate of speed. Vaidya estimated the speed of MV1 at this time to be 5 miles per hour. Vaidya stated a crossing guard was on the right side of the roadway on Brookline Street at Hartman Road wearing a yellow and black reflective jacket and snow pants. Vaidya stated the crossing guard had her back towards him and MV1, and extended her arm out to stop traffic. Vaidya stated at this time MV1 rolled by the crossing guard at a low rate of speed and the front right fender area of the vehicle hit the left rear leg/lower back area of the crossing guard. Vaidya stated the crossing guard bounced off of the car and fell to the roadway. Vaidya stated he believes MV1 was unaware he hit the crossing guard and observed the vehicle travel another 10 feet until it came to stop on Brookline Street. Vaidya stated the crossing guard was not in a marked crosswalk at the time of the crash. After speaking with all parties involved, Uminer will be cited with Massachusetts Uniform Citation T0115905 for Chapter 90, Section 14 (Failure to slow for a pedestrian in the roadway). Photos were taken of the vehicle and scene and submitted to the IT Bureau.

On 02/26/2020 I responded to the area of Eastbourne Rd and Ireland Rd for a motor vehicle crash involving a pedestrian. Eastbourne RD is a public way which runs from Ward St north bound intersecting with Ireland Rd on the far north end. Ireland RD is a public way which runs west to east. Both the east end and the west end of Ireland Rd are dead ends. The crash occured on Ireland Rd's east end near the intersection of Eastbourne Rd. The crash involved Vehicle 1 described as a 2016 Acura SUV color grey bearing MA passenger registration 3RB127. Vehicle 1 had a valid inspection sticker which expires on 08/30/2020. Vehicle 1 was operated by its owner identified as Barbara Ball. Ball has an active MA Operators License (S18727836). The involved pedestrian was identified as Bruce Terrio. Terrio is an employee of Feeney Brothers Utility Services. Feeney Brothers Utility Services is a contractor of National Grid Gas Company. Upon arrival I observed the following: The crash occurred in the daylight hours around 10:30am on Ireland Rd near the intersection of Eastbourne Rd. At the time of the crash the weather conditions were clear, 48 degrees Fahrenheit and overcast skies (weather.gov). The area where the crash occurred was an active construction site for Feeney Brothers Utility Services. The area of the crash is a dead end. The area is accessed from Ward St from either Eastbourne Rd or Coolidge Rd. The entrances of both Eastbourne Rd and Coolidge Rd had construction signs indicating utility work in the area. At the time of the crash, all roadways were open to vehicle traffic. On the eastbound side of Eastbourne Rd just prior to the intersection of Ireland Rd, I observed a large air compressor which was parked in the roadway facing south bound. No traffic cones were located near the air compressor. To the right of the air compressor were thick green bushes. A wooden fence was located to the right side of the green bushes. On the east side of Ireland Rd I observed a large excavated hole on the right side of the roadway. The hole was near the intersection of Eastbourne Rd and was located approximately three feet from the curb. I observed four traffic cones, two on the front side and two on the left side of the hole. Located on the front edge of the hole was a tire print. Vehicle 1 was located on the west end of Ireland Rd. The front passenger tire of Vehicle 1 had fresh dirt located on the sidewalls and the tire tread. Vehicle 1 appeared to have no visible damage. The pedestrian (Terrio) was being treated by EMS and Fire for injuries. Terrio was wearing brown pants and a green reflective safety vest. I spoke with the operator of Vehicle 1 Barbara Ball. Ball stated that she was operating Vehicle 1 northbound on Eastbourne Rd near the intersection of Ireland Rd. Ball stated that she made a right turn onto Ireland Rd and drove on to the edge of the excavated hole. Ball stated that her vehicle then made impact with Terrio who was in the hole. Ball stated that she immediately stopped, backed out of the hole and called 911. Ball stated that prior to making a right turn onto Ireland Rd, there were no traffic cones in the roadway or next to the hole. Ball stated that as she made the right turn onto Ireland Rd she did not observe Terrio or the hole until it was too late. Ball states that she resides at 80 Eastbourne Rd which is the residence located to the immediate right of the crash location. Ball states that she had been recently parking on Ireland Rd due to ongoing construction at her residence. Ball states that she was traveling at a slow speed prior to impact. At the time of the crash there were three other Feeney Brothers employees working at the site. These workers were identified as Steven Gamble, Mike Cabrinma and Gerard McComaskey. At the time of the crash all three workers were located further up Eastbourne Rd near the intersection of Coolidge Rd and did not observe the crash. At the time of the crash, Newton Police Sergeant Glenn Chisholm was working a paid detail for Feeney Brothers. Sergeant Chisholm stated that he did not observe the crash.Terrio was transported by Cataldo EMS for minor injuries. Several photos were taken of the scene. Photos were taken of the hole with traffic cones and without traffic cones. All photo's were submitted to the IT Bureau. After clearing the scene, I responded to St Elizabeth's Hospital in Brighton, MA to interview Terrio. Terrio stated that at the time of the crash he was standing in the hole on Ireland Rd performing gas utility work. Terrio stated that the front passenger side bumper of Vehicle 1 struck him in the right shoulder. Terrio stated that the impact caused him to lose his balance and fall down in the hole. Terrio states that after falling down he was able to climb out of the hole without assistance. Terrio stated that at the time of impact he was wearing a white hard hat which he thinks struck the pavement on the edge of the hole. Terrio states that at the time of the crash he was working alone in the hole. Terrio states that at the time of the crash traffic cones were located near the hole. Terrio stated that as a result of the impact he sustained minor injuries to his right shoulder and back. I then observed Terrio's hard hat which appeared to have a fresh scrape mark on the top. The hard hat also had broken interior straps. Terrio stated that the straps broke when he was struck by Vehicle 1. Photos were taken of the hard hat and were submitted to the IT Bureau. After reviewing all facts of this incident, Vehicle 1 appeared to have been traveling at a slow speed prior to the crash. This was evident due to the lack of tire skid marks prior to the tire print on the edge of the hole. It also appears that Ball's view of the hole and Terrio may have been obstructed by the parked air compressor on Eastbourne Rd. The thick green bushes and a wooden fence to the right of the air compressor also added to the obstructed view. The hole was also located in close proximity to the air compressor which reduced Vehicle 1's reaction time. Jeff Oliver of OSHA was also notified of this incident. On Sunday, March 1st 2020, at approximately 5:38pm, I, Officer Brooks, was dispatched to the intersection of Linwood avenue and Watertown street for a bicyclist struck by a MV. Upon my arrival I spoke with the bicyclist who stated she was traveling westbound on Watertown street, and was in the crosswalk at the intersection of Linwood avenue, when she was struck by MV1(MA REG67FD40), which had been traveling southbound on Linwood avenue. The bicyclist stated that the operator of MV1 did not come to a stop at the stop sign. The bicyclist was complaining of minor leg pain, but signed a patient refusal with Cataldo. The bicyclist was dressed in black pants, and a gray sweater, and was not wearing a helmet. The bicycle sustained damage to the handlebars. At the time of the accident the sun was setting, however the street lights had not yet come on. I then spoke with the operator of MV1 who stated she was traveling southbound on Linwood avenue, and was attempting to turn right onto Watertown street when she struck the bicyclist. The operator stated she never saw the bicyclist before the collision. The front of MV1 sustained minor damage. I was able to speak with a witness to the accident over the phone after clearing the scene. The witness stated that MV1 failed to stop at the stop sign at the intersection of Linwood and Watertown street, and that the bicyclist was already well into the crosswalk at the time of the collision. Officer Howes took pictures of the accident scene that have been submitted to the IT bureau. Based of the witness statements MA Uniform citation T2080576 has been mailed to the operator of MV1 for MGL C.89 S.11 Failing to yield for a pedestrian in a cross walk.

Operator of MV1 stated he was traveling Westbound on Washington St. attempting to merge Northbound on Washington St. and as he approached the intersection, he didn't see MV2 and collided with MV2. Operator of MV2 stated he was traveling Eastbound on Washington St. attempting to merge Northbound onto Washington St. into the center lane to travel over the bridge and through the intersection, however didn't see MV1 and collided with MV1. It should be noted MV2 had a yield sign when merging. M1 had a turning vehicles yield to pedestrian sign before entering the bridge. MV1 sustained moderate left front end damage. MV2 sustained heavy passenger side damage. Passenger in MV2 was transported to Newton Wellesley Hospital for shoulder pain. Tody's responded on scene and towed MV2. A towed motor vehicle form was filled out and placed on file.

On 3/17/20 while working N493, I responded to the intersection of Auburndale Ave and Newell Rd for an MVA car vs pedestrian. On arrival I located pedestrian Stephen Dugas DOB 8/25/50 sitting in the middle of Newell Rd bleeding profusely from the top of his head, but otherwise consious/alert. The driver of the motor vehicle (MA reg 93Y880) was still on scene. He is identified as Ali Alnamos DOB12/10/59. While the medics were tending to Dugas I obtained a statement from Alnamos. He stated that he was driving on Auburndale Ave towards Lexington St and went to turn right onto Newell Rd. Upon turning, he made contact with the pedestrian with what he believes to be his passenger side mirror. Alnamos was distraught while speaking with me, and told me that he did not see the man. It should be noted that there is a clearly marked pedestrian crosswalk on Newell Rd, right at the location of this accident. There are street lights in the vicinity and Dugas was wearing darker clothing. Medic 2 transported Dugas to St. Elizabeth's due to his head injuy. I responded to the St E's ER Department and spoke with Dugas shortly after he was transported. Dugas reports that he was out for a walk on Auburndale Ave and was heading towards Auburndale Square. He went to cross Newell Rd and was hit by a vehicle shortly after entering the crosswalk. Dugas is not sure what part of the vehicle made contact with him but states that he did not go over the hood. Newell Rd intersects Auburndale Ave only on the westbound side. Several pictures were taken of the scene and have been submitted to IT. I did not observe any damage to the vehicle involved, therefore a tow was not needed. Alnamos stated that he was not in need of medical attention. Due to Dugas' statement at the hospital, I am mailing Alnamos MA citation T2079194 for 89/11 Fail to Yield to Pedestrian in Crosswalk.

OPERATOR OF MV 1 ALSO STATED HE HAD SLOWED DOWN DUE TO A PEDESTRIAN WHO WAS CROSSING THE STREET ON ELM ST. OPERATOR OF MV 2 STATED THAT SHE WAS TRAVELING ON RIVER STREET AND TURNED LEFT TRYING TO GO SOUTH ON ELM ST AND MV 1 CAME OUT OF NOWHERE AND STRUCK HER PASSENGER SIDE. OPERATOR OF MV2 STATED SHE BELIEVED MV 1 WAS SPEEDING. MODERATE DAMAGE SUSTAINED TO THE PASSENGER SIDE, THE VEHICLE WAS TOWED BY AAA AND NO INJURIES REPORTED. MV#2 was traveling East on Commonwealth Ave, and did not stop in time crashing into MV#1. Operator of MV#1 stated that he was stopped, allowing the pedestrian to cross when he was rear ended by MV#2. Operator of MV#2 stated that she attempted to stop, and that she was having trouble with her breaks. Operator of MV#2 stated that this is the reason that she crashed into MV#1. Operator of MV1 stated she was traveling Westbound on Tremont Street and could not see well due to a sun glare. Operator of MV1 further stated when she approached the intersection of Tremont Street at Hibbard Road she struck a pedestrian riding a bicycle. I was able to speak with two witnesses on scene who were friends with Ms. Shokri. Both were approximately 10 feet behind her in the crosswalk before she was struck by MV1. Witness statements are documented in this report. Both parents responded on scene and were entered into this report as non-motorists. Both followed medics to Newton Wellesley Hospital. MV1 sustained moderate front end damage. Pedestrian involved suffered minor injuries and was transported to Newton Wellesley Hospital. Operator of MV1 was evaluated on scene and signed a patient refusal. Due to the bicycle being moved prior to my arrival, pictures were not taken on scene. The bicycle was left off the roadway for her friends to pick up. Ms. Skokri was wearing a pink shirt, black shorts and was riding a black bicycle. Ms. Shokri was not wearing any protective equipment.

Vehicle 1 described as a 2019 Nissan Rogues color gray bearing MA Pan Reg 2SNN41 was stopped in traffic southbound on Parker St near the intersecting way of Hagen Rd. Both Parker St and Hagen Rd are public ways in the City of Newton. Vehicle 1 was then rear ended by Vehicle 2 described as a 2018 Ford Van color white bearing MA Con Reg S35168 which was traveling southbound on Parker St. As a result of the impact Vehicle 1 sustained damage to the passenger side rear bumper and quarter panel. Vehicle 2 sustained damage to the drivers side front bumper and fender. The operator of Vehicle 1 identified as Chelsea Halsor stated that she was stopped on Parker St due to another uninvolved vehicle which was stopped in front of her vehicle due to a pedestrian crossing Parker St in a crosswalk. Halsor stated that while stopped she was struck from behind by Vehicle 2. Halsor stated that the force of the impact caused her to hit her head on the steering wheel. Fire and Medics responded to the scene and evaluated Halsor. Halsor was released with a patient refusal. The operator of Vehicle 2 identified as Christopher Benoit stated that he was traveling southbound on Parker St and struck Vehicle 1 which was stopped in traffic. Benoit stated that he tried to avoid the collision by swerving to the right but was unable to and as a result struck the passenger side rear of Vehicle 1. Benoit stated he was uninjured. No other witnesses on scene. Vehicle 1 was driven from the scene by Halsor. An RMV check of Vehicle 2 revealed that the registration was expired as of 12/31/2019. Tody's responded and removed the vehicle. A Towed MV Inventory Sheet was completed. An RMV check also revealed that Benoits MA Drivers License (MA DL# S9550481) was suspended. As a result Benoit was issued in hand MA Uniform Citation T1268483 and cited for Mgl 90/23 Operation of a Motor Vehicle After License Suspension, Mgl 90/9 Operating an Unregistered Motor Vehicle on a Public Way and City Ordinance Violation 19-71 Following to Close.

On 6/27/20 at approx 1719 I responded to the area of Brookline ST and Hartman Rd for a report of a MVA with no injuries. Upon arrival I spoke with both operators involved in the accident. Operator of MV#1 stated she was traveling SB on Brookline St when she came to a stop to let a vehicle turn out of Spaulding Ln and then a pedestrian cross the crosswalk when she was rear ended by MV#2. Operator of MV#1 sustained no injuries and MV#1 had moderate rear end damage. I then spoke to operator of MV#2 who stated she was also driving SB on Brookline St when MV#1 suddenly stopped in front of her and she couldn't stop in time. She rear ended MV#1. MV#2 had heavy front end damage. The operator of MV#2 sustained no injuries. Bother operators signed patient refusals with the medics and both vehicles were able to be driven away.

On August 13th, 2020, while working in marked unit N526, I responded to a 2 car MVA involving pedestrians at the intersection of Beacon Street and Chestnut Street, Newton. The weather at the time of the crash was clear and sunny. The road surface was dry. Beacon Street and Chestnut Street are both public ways maintained by the City of Newton. The operator of MV1, Maria Dinapoli (S92626906), stated she was operating her 2018 Toyota Corolla ( MA REG: 1KNW71) heading west on Beacon Street and had the green light at the intersection of Chestnut Street. Dinapoli stated she was traveling straight through the intersection when MV2 which was traveling east on Beacon Street at the time cut infront of her vehicle to take a left turn onto Chestnut Street. Dinapoli stated she applied her brakes but was unable to stop in time and made contact with MV2. The impact of the crash caused MV1 to drive over the curb and onto the sidewalk where it made light contact with a baby stroller with a 1 year old inside. MV1 also struck and damaged a Newton Fire Department box that was located on the sidewalk. The baby stroller was being operated by the mother identified as Anna Gilman (S11328154). The pedestrians reported no injuries and signed patient refusals with Medic 2. MV1 sustained moderate front end damage and was towed from the scene by Todys. Dinapoli also reported no injuries and signed a patient refusal with Medic 2. The operator of MV2, Leena Dolabany (S12410136), stated she was operating her 2018 Jeep Grand Cherokee (MA REG: 1TCZ14) heading east on Beacon Street and had the green light at the intersection of Chestnut Street. Dolabany stated she was in a line of cars in traffic waiting to take the left turn onto Chestnut Street. Dolabany stated as the cars infront of her continued through the intersection she took a left onto Chestnut Street and as she was already into the turn she was struck by MV1. MV2 sustained moderate damage to the passenger side panel. Dolabany reported no injuries and signed a patient refusal by Medic 2. A query of all vehicles and parties involved through dispatch determined that MV2 was revoked for insurance. After speaking with the operator I was informed that MV2 had recently switched insurance agencies and Dolabany was able to provide paperwork from Geico Insurance stating the vehicle was insured. Due to the registry not displaying a valid registration, MV2 was towed from the scene by Todys. I advised Dolabany to contact her insurance company and advise them to update their information with the registry so she can retrieve the vehicle. Photographs of the scene and damage to city property were taken by Officer Wilson and submitted to the IT Bureau. On August 14th, 2020 I spoke with the operator of MV2, Leena Dolabany and her father George Dolabany in the front lobby of the police station. They provided paperwork from Geico Insurance that stated the vehicle was infact insured at the time of the accident and that there was an error made by the Registry of Motor Vehicles. Sgt. Devine and I advised them that we have to use the Registry's database for our investigation and because it still states the vehicle is revoked for insurance we can not release the license plates. Sgt. Devine advised them they could get another tow company to come and take custody of the vehicle but the plates will be seized until the registry shows an active status on the registration. I issued Mass uniform citation T2017328 in hand to Leena and advised her she will be summoned for a hearing for the following violations; Ch 90 section 34J Operating MV without insurance and Ch 90 section 9 Unregistered MV.

Narrative:
On Wednesday September 2nd, 2020 I responded to 341 Lexington Street for a report of a past motor vehicle accident involving a pedestrian that reportedly occurred around 12:25pm at the intersection of Commonwealth Ave and Lexington St. At the time of the reported incident the weather was cloudy/rainy and the road surface was wet. Both Commonwealth Ave and Lexington St are owned and maintained by the City of Newton. Upon arrival I spoke with the parent of the pedestrian identified as Tamika Olszewski. Tamika stated her daughter, Morgan Olszewsk, her twin brother Dean Olszewski and several friends took their bikes and went to Dunkin Donuts in Auburndale. Tamika stated when the group returned from Dunkin Donuts her daughter Morgan told her that she was hit by a car while crossing Commonwealth Ave. I spoke with Morgan and she stated she was in front of Dunkin Donuts and pressed the crosswalk button on the traffic light to cross over Commonwealth Ave. Morgan stated she crossed the street inside the crosswalk and noticed the crosswalk light signal was counting down. Morgan stated she heard a shrieking noise from a car slamming on the brakes and stuck hand out and touched a white car to keep her balance. Morgan stated she did not fall down or sustain any injuries. Morgan stated she continued across the street towards the picnic benches that are located in front of Starbucks. Morgan stated she then walked home and told her mother what happened. Morgan's only description of the vehicle involved was white car. Dean Olszewski and Ryan Poras stated they were at the picnic benches and left their bikes there and walked in the crosswalk to Dunkin Donuts to get some food. Dean and Ryan stated they then left the store and crossed back to the picnic benches where Deans sister Morgan was waiting. Dean gave Morgan some money so she could go to Dunkin Donuts and Morgan went and crossed the street alone and the next thing they saw was Morgan in front of Dunkin Donuts with an unknown woman with her arms around Morgan. Dean and Ryan stated Morgan crossed back to the picnic benches and when they asked Morgan what had happened she stated "nothing". Later Morgan then told Dean she was hit by a car. I spoke with an employee of Dunkin Donuts who stated he witnessed the entire incident. Kelvin Matovu stated he had groups of kids coming inside to get donuts around 12:25pm. Kelvin stated he witnessed Morgan with other children at the picnic benches in front of Starbucks. Kelvin stated he saw Morgan attempting to cross Commonwealth Ave with her helmet on and no bicycle with her. Kelvin stated Morgan pressed the crosswalk button on the traffic light at the intersection but stated she did not cross in the crosswalk and crossed directly in front of the stores windows which are not in line with the crosswalk. Kelvin stated he did not notice if she had the walk sign or not. Kelving stated as Morgan crossed into traffic she was rushing and stopped in the middle of the road where the two yellow medium stripes are and looked confused. Kelvin stated it seemed she was confused because cars were going past her in both directions and so she stopped in the middle of the road. Kelvin stated a female customer who was inside the store went out and made contact with Morgan when she finally crossed the street and made it to the front door of Dunkin Donuts. Kelvin stated he did not see a car make contact with Morgan or hear anything related to a crash. Kelving stated Morgan seemed confused and did not appear injured. Kelvin stated the female customer put her arms around Morgan to make sure she was okay. After the incident, Kelvin stated Morgan did not enter the store and went back to the picnic benches where the other children were located and they left northbound on Lexington Street. Kelvin stated the female customer came into the store and Kelvin gave the woman a free coffee for assisting Morgan. The unidentified female customer then left the area. Dunkin Donuts has no cameras that face the street. Officer G. Claflin spoke with the employees at Keys Drugstore and they stated they did have cameras facing the street and will contact the store manager who will contact the Traffic Bureau if the incident was caught on the camera. I advised Tamika that a report will be filed and if there is any development regarding the possible car involved I will contact her. Medic 2 was on scene and Tamika signed a patient refusal for Morgan. Morgan is a student at Burr Elementary School. While writing this report Tamika called and stated that Morgan remembered that the woman who assisted her after the collision walked her inside Dunkin Donuts.

VICTIM DID NOT GET A PLATE NOR REMEMBER THE COLOR OF THE VEHICLE. VICTIM STATES HE GOT TO HIS FEET AND WALKED HOME. AT HOME HE TOLD HIS FATHER WHAT HAD HAPPENED. FIRE AND MEDICS RESPONDED TO 608 WATERTOWN AND TRANSPORTED THE VICTIM TO NEWTON WELLESLEY HOSPITAL FOR TREATMENT. VICTIM HAD CUTS ON BRUISES ON HIS LEFT SIDE. VICTIM STATE THE HIT AND RUN OCCURRED AROUND 1130HRS. DESPITE THE TIME DELAY, I CANVASSED THE AREA FOR A VEHICLE OR POSSIBLE WITNESSES WITH NEGATIVE RESULTS. VICTIM WAS TRANSPORTED BY MEDIC2. Zhang stated that at 0630hrs, he was bicycling to work northbound on Centre St just before Cabot St. Zhang stated that an unidentified vehicle struck him with the passengers side mirror and continued driving northbound on Centre St. Zhang stated that he was very confused because he did not feel the vehicle hit him or his bicycle, but observed the mirror fall off. Zhang stated he was not injured and his bicycle was not damaged. The only description of the vehicle is a black small car. Zhang could not give any information on the driver.

Operator of MV1 (ma reg 3279DC) stated he was traveling NB from Lewis Terr through the intersection of Washington Street when his vehicle was struck on the rear passenger side. Operator of MV1 stated he had a green light and was traveling NB onto Adams street when MV2 hit his vehicle in the middle of the intersection. Operator of MV2 (ma reg 8ZF792) was traveling WB on Washington street and ended up on the EB lane approaching the intersection. Operator of MV2 failed to stop at the red light and was also going the wrong direction. Operator of MV2 hit MV1 in the middle of the intersection causing damage to the front bumper. A pedestrian waiting at the intersection witnessed the accident. MV1 sustained heavy damage and required a tow. MV2 had some minor damage to front end. Both parties stated they were fine and refused any medical treatment at the scene. Based on my observations of the accident scene, the witness statement and where the vehicles final resting spot I cited the operator of MV2. Operator of MV2 was cited (T2080369) for 89/9 Fail to stop at red light, 89/4a Marked Lanes and 90/16 Wrong Way. Tody's arrived on scene and towed MV1. MV2 was able to drive away from the scene safely. I handed the operator of MV2 the citation.

DRIVER STATES HE WAS TRAVELING E-BOUND ON COMM AVE. HE STATES VEHICLE #2 STOPPED ABRUPTLY AND HE WAS UNABLE TO AVOID HITTING HIM. VEHICLE #2 STATES HE WAS TRAVELING E-BOUND ON COMM. HE STOPPED BEHIND A MOTORCYCLE THAT STOPPED TO LET PEDESTRIANS CROSS THE STREET. VEHICLE #1 HAD EXTENSIVE FRONT END DAMAGE AND WAS TOWED BY TODYS. VEHICLE #2 HAD REAR END DAMAGE AND HAD TO REMOVE HIS BUMPER. BOTH PARTIES REPORTED NO INJURIES. BOTH PARTIES ADVISED TO CONTACT THEIR INSURANCE COMPANIES. CLEARED WITHOUT FURTHER INCIDENT.

On 09/30/2020 at approximately 19:32hrs members of the Newton Police Patrol Bureau responded to a motor vehicle crash near the intersection of Washington St and Eddy St. After an initial investigation of the crash the Patrol Bureau secured the crash scene and called in the Newton Police Traffic Bureau to investigate. At approximately 19:45hrs Sgt. Devine, Ofc Wilson and I (Ofc Schlegel) from the NPD Traffic Bureau responded to the scene to investigate. Upon arrival to the scene I was met by Ofc Kane of the NPD Patrol Bureau. Ofc Kane stated that the crash was located in the driveway of 74 Eddy St and that it involved a Ford F350 pickup striking two parked cars. Ofc Kane stated that the operator identified as Kyle Butler had already been taken to Newton Wellesley Hospital by Cataldo EMS for injuries. . Upon approaching the crash scene I observed the following: The crash occurred at night time hours at approximately 19:32EST near the intersection of Washington St and Eddy St. Both Washington St and Eddy St are public ways in the City of Newton. The weather conditions at the time of the crash were a dark and clear with a temperature of approximately 60 degrees F. Washington St is a four lane undivided roadway (2 westbound travel lanes and 2 eastbound travel lanes). Washington St lighted roadway which has concrete light poles on both the westbound and eastbound sides. Washington St was under construction at the time and had a base coat of asphalt applied. At the time of the crash Washington St did not have any painted lane markings due to ongoing construction. Washington St is separated from the road sides on both the eastbound edge and the westbound edge with fixed granite curbing. The roadway also had several orange traffic barrels and traffic cones located edges of the eastbound and westbound lanes. Affixed to the light poles and the traffic barrels were temporary no parking signs for the ongoing road construction. At the time of the crash no road construction activities were taking place. No major debris or other obstructions were observed in the roadway. Washington St is a major roadway in the City of Newton and travels west to East across the entire City of Newton. This area of Washington St where the crash occurred is in between West Newton Square and Newtonville Square, this area has a posted 35 MPH speed limit. Both West Newton Square and Newtonville Square are densely populated with several businesses and residential areas. The section of Washington St where the crash occurred is also traveled frequently by pedestrian, bicycle and motor vehicle traffic. At the time the crash occurred 19:32hrs This area of Washington St is still a heavily travelled roadway. I observed Vehicle 1 described as a 2003 Ford F350 color white (MA Reg 5DT664) located in the driveway of 74 Eddy St. 74 Eddy St is a multi-family dwelling house located on the corner of Washington St and Eddy St. The driveway of 74 Eddy St is on the Washington St side. Vehicle was faced easterly across the driveway. I observed Vehicle 1to have extensive damage to the entire vehicle including but not limited to the enclosed cab area, cab roof and all windows, front end, rear end, along with both driver and passenger side. I also observed city of Newton owned concrete traffic light resting on top of the cab area of Vehicle 1. Upon further observation of Vehicle 1 it appears that both front tires and rims were flat, heavily damaged and had little to no tread left. Both front tires were worn down to the interior steel belt. I also observed that Vehicle 1 did not have a valid inspection sticker. Located to the immediate front of Vehicle 1 and resting on the front end was a white fence which had damage consistent with the impact of a motor vehicle. Immediately to the driver's side of Vehicle 1 was Vehicle 2 described as a 2007 gray Subaru Forester (MA Reg 45D610. Vehicle 2 was facing westerly across the driveway. Vehicle 2 had extensive damage to the driver's side front end, rear end, in addition to the entire driver and passenger sides. At this time Vehicle 2's drivers door was in contact with Vehicle 1's drivers door. Both drivers doors could not be opened.The damage to Vehicle 2 appeared to be consistent with impact from another motor vehicle. To immediate passenger side of the Vehicle 2 I observed Vehicle 3 described as a 2011 Toyota Rav4 color black (MA Reg 47XB99). Vehicle was facing in an easterly direction across the driveway. I observed the Vehicle 3 to have extensive damage to driver's side rear quarter panel, passenger side front quarter panel and front end. Also observed was damage to south east corner of the dwelling of 74 Eddy St. This area of the dwelling is located adjacent to the drive way. The damage appeared consistent with the impact caused by a motor vehicle. Also observed were large amounts of debris located in the area of the crash which included the sidewalk, yard and the driveway of 74 Eddy St. The debris included pieces of concrete which appeared to have been dislodged from the concrete light pole. A city of Newton no parking sign was lying in the yard of 74 Eddy St. This parking sign would have been attached to the concrete light pole due to ongoing road construction on Washington St. I also observed two tire marks on a curb stone located next the westbound lane of Washington St. These tire marks were in front of the residence of 74 Eddy St and were to the immediate left of a storm drain. The tire marks were consistent with being struck by a motor vehicle. In between the tire marks and just after the curb there was a hole in the ground with wires sticking out of it. This hole appears to be the location the concrete light pole was located prior to impact. Tire marks were located on Washington St traveling from the east bound lane easterly across the westbound lane and ending at the tire marks on the curb. The total length of the tire marks was approximately 190 feet. After conducting an on scene investigation it appears that Vehicle 1 from the start of the tire mark in eastbound travel lane of Washington St traveled 190 feet in the easterly direct across the westbound lane of Washington St and impacted the curb in front of 74 Eddy St. The tire marks had lateral striations almost the entire length indicating that the front tires were rolling and sliding with little to no braking prior to impact with the curb. After impact with the curb Vehicle 1 exited the roadway, struck a concrete light pole. Vehicle 1 then traveled over a sidewalk, across the yard of 74 Eddy St and into the driveway of 74 Eddy St. Located in the driveway of 74 Eddy St were Vehicle 2 and Vehicle 3. Vehicle 2 was parked facing toward the rear of 74 Eddy St. Vehicle 3 located to the passenger side of Vehicle 2 and was parked facing towards Washington St. When Vehicle 1 entered the driveway it struck Vehicle 2. The force of the impact of Vehicle 1 striking Vehicle 2 caused Vehicle 2 to strike Vehicle 3. The force of the impact of Vehicle 2 striking Vehicle 3 caused Vehicle 3 to strike the southeast corner of the dwelling located at 74 Elliot St. Vehicle 1 continued across the drive way and struck a white fence before coming to final rest. Vehicle traveled a approximately 55 feet from when it initially struck to the curb till final rest. No other injuries were reported on scene. All involved vehicles were towed from the scene by Tody's Towing. After the investigation the operator of Vehicle 1 Kyle Butler was issued Citations T2015882 and T2015883 for: Mgl 90/24/O Recklass Operation of a Motor Vehicle Mgl 89/4B/A Failure to Operate in the Right Lane Mgl 90/20 Failure to Submit a Motor Vehicle for Inspection Mgl 90/7 Defective Equipment (worn front tire treads) Mgl 90/13A Failure to wear a seatbelt An immediate threat form was also filed with the MA RMV. MV1 stated she was turning left onto JFK Cir and "did not see" the 2 pedestrians subsequently striking them. I observed MV1 to be about 2-3 feet from the sidewalk on the left which showed she was driving on the wrong side of the road. When I brought this to the operators attention she stated "no one was coming." Operator reported no injuries or damage to the vehicle. Citation # T2012942 issued for marked lanes. The pedestrians, Luda & Andrei Manea stated they were crossing JFK Cir when they were struck by MV1. Luda sustained a laceration to her face and was transported to Newton Wellesley Hospital for a further evaluation. Andrei complained of pain to his left side, declined to be evaluated on scene, however was transported to NWH with his wife via Cataldo Ambulance. Digital images of the scene, (after MV1 had to move out of the way) were captured and turned over to the IT Bureau. It should be noted that this intersection is rather dark & Luda was wearing a dark blue shirt & Andrei was wearing a white shirt.

At this time, #1 struck Mv#2 that was travelling straight ahead on Centre St N/B. #1 sustained heavy driver's side front end damage with airbag deployment. #1 was not injured. #2 operator stated she was travelling on Centre St N/B in the right lane going straight through the Beacon St intersection on a green light. #2 stated she was struck on her driver's broadside by #1 that turned left into her. #2 sustained heavy driver's broadside and front end damage with airbag deployment. #2 was very shaken up and transported by medics to NWH for evaluation. The scene remained active for a period time as the collision occured near the middle of the intersection during heavy traffic. Officers were required to safely direct traffic and pedestrians to avoid further accidents. As a result, no citation was written on scene. #1 was advised he would receive a citation in the mail. Both MVs towed by Tody's. Court/RMV citation processing note: #1 operator student/temporary residence was added to the bottom of the citation.

On 11/19/2020 at approximately 11:47hrs I responded to a motor vehicle crash involving a City of Newton vehicle. The crash occurred on Westland Ave near the intersecting way of Cherry St. Both Cherry St and Westland Ave are public ways in the City of Newton. Vehicle 1 was stopped in traffic in the eastbound lane of Westland Ave at the intersecting way of Cherry St. Vehicle 2 (City MV) was stopped in traffic on Westland Ave behind Vehicle 1. Vehicle 1 then backed up and struck Vehicle 2. As a result of the impact Vehicle 1 sustained minor damage to the driver's side rear bumper. Vehicle 2 sustained minor damage to the passenger side front bumper. No injuries were reported. No tows were required. Photos were taken and submitted to the IT Bureau. The operator of Vehicle 1 stated upon approaching the intersection of Cherry St, his visibility of on coming traffic on Cherry St was obstructed due to hedges located on the property of 271 Cherry St. The operator of Vehicle 1 stated that he then pulled forward and observed a pedestrian jogging southbound on Cherry St and a vehicle traveling southbound on Cherry St. The operator of Vehicle 1 stated that upon observing the pedestrian and vehicle he backed up and struck Vehicle 2.

Techler stated that he was not injured and his vehicle did not require a tow. Le stated that he is a student at Newton North High School and was riding his bike a Giant mountain bike to school. Le stated that he was stopped on his bike on the northeast corner of the intersection of Linwood Ave and Walnut St. Le stated that he saw a pedestrian latter identified as Jason Kaufman walking west bound in the crosswalk from the east side of Walnut St to the west side of Walnut St. Le stated that as Kaufman was crossing over Walnut St he assumed that it was clear to cross over Walnut St while riding his bike. Le stated that he was unsure if the yellow flashing crosswalk lights were activated. Le stated that he rode his bike off of the side walk at the northeast corner of Walnut St at Linwood Ave. Le stated that he did not ride his bike in the marked crosswalk that run from east to west over Walnut St at Linwood Ave. Le stated he rode his bike diagonally into the intersection towards the south west corner of the intersection. Le stated that he did not see Techler's vehicle prior to entering the intersection. It should be noted that at the time of the crash Le was wearing earphones and stated the he was listening to music. Le stated that he was not injured in the crash and signed a patient refusal from in the presence of his father Thanh Le who responded to the crash scene. Le's bike had damage to the front tire and front breaks. Based upon statments made to me by Le, Techler and my observations of the crash area, I believe that they both bear responsibility for the cause of the crash. Le was not in a marked crosswalk and was not sure if the flashing yellow crosswalk lights were activated. Le also was listening to earphones while crossing diagonally into the intersection. I issued Techler MA Unifrom Citation T2015904 and cited him for a violation of MGL 90/14 , failure to yield to a bicyclist while turing left.

On 2/8/21 I was working N491 when I responded to an MVA PED on Washington St. at Crafts St.. Upon arrival I spoke with Dennis Delicata who stated that he was traveling southbound on Crafts St. when he turned left onto Washington St. during a green light a pedestrian later identified as Jamie Correia ran out in front of his truck and he struck him. Delicata stated the Jamie was traveling in the travel lane of Washington St. going Eastbound across the intersection not in the crosswalk and he did not see him in time. Delicata stated he slammed on his brakes however could not stop in time. Delicata stated he got out of his truck and rendered aid to Correia who was complaining of pain in his back and shoulder. Delicata stated that Correia said to him "I thought I could make it". I spoke with Jamie Correia who was being evaluated by the medics. Correia said he was running across the intersection headed Eastbound and thought he could make it across. Medics transported Correia to NWH. Delicata's vehicle suffered minor damage and was driven away from the scene. Pictures were taken and submitted to IT.

On Monday, March 8th 2021, at approximately 4:51pm, I, Officer Brooks, responded to the intersection of Washington street and Adams street for an auto pedestrian accident. The vehicle involved was described as a 4 door blue sedan and had fled the scene northbound on Adams street. The injured party was not able to provide any further description of the vehicle or operator, and no witnesses were present. I spoke with Traivon King who was the party that had been struck by the vehicle. He stated he was walking eastbound on Washington street, and had the cross walk signal to cross over Adams street. The blue sedan was traveling westbound on Washington street and turned northbound on Adams street ignoring the crosswalk signal. King stated he was struck on the right side of his body and knocked to the ground. The operator of the car stopped briefly and stated the sun had been in his eyes before driving away. King complained of pain to his right arm, and was transported by Fallon ambulance services to NWH. It should be noted it was day light, the weather was clear, and King was wearing a green plaid jacket, a plaid hat, and blue jeans. Due to the fact the vehicle had fled the scene and the victim was aready being tended to by the medics photos were not taken.

On my arrival with the NFD I located both vehicles. First was a 2013 Subaru station wagon impreza, ma reg 5LMZ60 with heavy front end damage. The operator was identified as Ann Maria Harle. She reported going S/B on Centre St by Newtonville Ave when vehicle #2 suddenly stopped in front of her. She attempted to stop before crashing into the rear of vehicle#2. Vehicle #2 was a 2020 Jeep Cherokee, MI reg. EHJ9616 with rear end damage. Operator was identified as Lauren Duche. She reported going S/B on Centre St when a vehicle in front of he suddenly stopped due to a pedestrian crossing the street. She was then rear ended by vehicle #1.(cid:31)Vehicle #2 never made contact with the vehicle in front of her after being rear ended. Vehicle #1 was towed by Todys Garage Vehicle #2 was able to drive away. Fallon Ambulance check out all parties from both vehicles but all adults signed patient refusals.

On Friday, April 23rd 2021, at approximately 6:55am, I, Officer Brooks, responded to Chestnut street at Prince street, for an MVA pedestrian. Upon my arrival I spoke with an adult female who stated she was walking eastbound on Prince street and was attempting to cross Chestnut street. She stated she looked northbound and did not see anyone coming so she attempted to run across the street and was struck by a vehicle coming from her left. The pedestrian stated she was not in the cross walk, and that she was struck in the area of her left hip and thrown to the ground. She was not complaining of any injuries and refused to be evaluated by EMS. I noted the pedestrian was wearing a full body length purple coat and a winter hat. The operator of MV1(MA REG 9JYJ50) stopped to check on the pedestrian and left her phone number before leaving the scene. I was able to speak with the operator who stated she was traveling northbound on Chestnut street, and as she approached Prince street a female party ran out in front of her vehicle causing her to slam on the breaks. The operator stated she did not believe that she made contact with the pedestrian but that she did observe her fall to the ground. She stopped to check on the pedestrian who stated they were ok, and she provided her phone number to her. I explained in the future she would need to contact us immediately or she could be charged with leaving the scene of an accident, and she was unaware of all the information she needed to provide to the other party. The operator and the pedestrian were both provided the report number. Due to MV1 leaving the scene before my arrival photographs could not be taken.

Vehicle 1 was taking a left hand turn onto Elm St, from Webster St. The operator of vehicle 1 stated that the sun was in his eyes, and he could not see well. He decided to take the turn very slow. Vehicle 1 struck a pedestrian, who was already out in the crosswalk with the front of his vehicle. The pedestrian was complaining about pain in her left leg. She was evaluated by Medic 2, and transported to NWH. I observed no damage to vehicle 1.

On Thursday May 6th, 2021 at approximately 10:27am I responded to the intersection of Beacon Street and Hammond Pond Parkway for a minor motor vehicle accident involving a pedestrian. At the time of the accident the weather was sunny and the road surface was dry. Beacon Street is a public way owned and maintained by the City of Newton and Hammond Pond Parkway is owned by the State Police. Upon arrival I spoke with the pedestrian who was being treated by medics on scene. She was identified as Erinn McGahan. Erinn stated she was jogging on Beacon Street heading westbound and was approaching the intersection of Hammond Pond Parkway. Erinn stated she thought she made eye contact with the vehicle that was stopped at the stop sign as she continued to jog across the crosswalk. As she started to enter the crosswalk, the vehicle started to take the right turn onto Beacon Street and struck her right knee, causing her to fall on top of the hood of the vehicle and roll off onto the street. Erinn stated she had minor injuries and was transported by Fallon to Newton Wellesley Hospital. I spoke with the operator of the vehicle, identified as Delia Duart. Delia stated she was stopped at the stop sign on Hammond Pond Parkway and did not see the pedestrian entering the crosswalk. Delia stated she started to turn right onto Beacon Street and struck the pedestrian causing her to roll off the hood of her car and land on the street. Delia reported no injuries and signed a patient refusal. Delia reported no damage to her vehicle and was able to leave the scene. Mass Uniform Citation #992938AA was issued and mailed to Delia Duart for Chapter 89 Section 11 Crosswalk Violation.

Narrative:
On Monday May 10th, 2021 at approximately 0825 hours, dispatch sent units to the intersection of Eldredge Street and Vernon Street for a report of a road rage incident involving a crossing guard and a motor vehicle. When units arrived it was determined that the crossing guard who was performing her duties at the time of the incident, was struck by a motor vehicle that left the scene without stopping. I responded to the scene of the accident to conduct an investigation. At the time of the incident the weather was cloudy and the road surface was dry. Eldredge Street and Vernon Street are both public ways owned and maintained by the City of Newton. Upon arrival I spoke with the injured crossing guard inside the ambulance identified as, Margaret Monbouquette. Margaret was being treated by Fallon Medic 3 for leg pain. Margaret stated she was in the middle of the intersection holding her stop sign up as children and adults were actively crossing to get to the Underwood School. Margaret stated she had all three streets stopped when her attention was brought to the vehicle at the stop sign on Eldredge Street on the one way side. Margaret stated it kept inching forward into the intersection attempting to turn left. Margaret stated she still had people crossing at that intersection so she stepped in front of the vehicle and held up the stop sign directly in front of the vehicle and the female driver. Margaret stated she looked at the female driver and stated "No, stop" and that is when the driver started to yell back at her inside her vehicle but she could not make out what she was saying as her window was rolled up. Margaret stated the driver then tried to drive around her and struck her with the front passenger side bumper of the vehicle. She stated she was struck in her hip area which caused her to fall onto the street. Margaret stated the vehicle never stopped and sped up Vernon Street. Margaret described the driver as a slight female with dark hair driving a dark colored SUV. Margaret was able to provide a license plate of MA REG: 1XCS97. A query of the license plate through dispatch was able to provide an address of 74 Charlesbank Rd, Newton. Officers checked this address but got no response at the door and the vehicle was not located. A witness to the incident identified as Alicia Matos left her phone number and I was able to make contact with her over the phone. She stated she was in her motor vehicle stopped at the stop sign on Eldredge St, directly across from the vehicle involved. Alicia stated she was stopped because the crossing guard was in the intersection holding up her stop sign and was actively crossing children and adults. Alicia states she noticed the vehicle across from her kept creeping out into the intersection trying to take the left turn up Vernon Street. She states the crossing guard walked over to that vehicle and told her to stop and saw the female driver start yelling and pointing her hands at her inside the vehicle. Alicia states the crossing guard then backed up and was looking down at the drivers license plate when the driver drove at the crossing guard and struck her with her front passenger side and knocked the crossing guard to the ground. Alicia states the vehicle clearly made contact and did not stop and left the scene turning onto Vernon Street at a high rate of speed. Alicia states several people in the area came to the crossing guards aid and police and medics arrived shortly. Alicia described the driver of the motor vehicle to be a female with dark hair. The principal of the Underwood School, Suzie Talukdar was present after the accident and stated the secretary of the school received a phone call shortly after the incident from a grandparent of the school. The grandparent was identified as Dawn Coleman. Dawn stated her daughter was driving the vehicle involved and was having anxiety over the incident and didn't know what to do. Dawn identified the driver as Chelsey Sullivan (S83874401). I attempted to make contact with Chelsey at her residence of 74 Charlesbank Rd with negative results. The secretary was able to provide phone numbers for Dawn and Chelsey and I responded to the police station to attempt to make contact. While at the police station, I was notified that Chelsey Sullivan was downstairs in the lobby. I met with Chelsey and she stated the following: She was driving MA REG 1XCS97 a black Toyota Rav4 and was stopped at the stop sign on Eldredge Street the one way side. She noticed the crossing guard in the intersection holding up the stop sign but stated there was no one crossing at the time. Chelsey stated she started to inch forward and wanted to turn left onto Vernon Street as she was in a rush. Chelsey stated the crossing guard came right up to her vehicle and started shouting and holding up the stop sign in her hand telling her to stop. Chelsey stated she was yelling back at her stating that the cars behind her were going so she wanted to go too. Chelsey stated when the crossing guard started to walk away from her, she got very anxious and decided to take the left onto Vernon Street. She stated she saw the crossing guard stumble and fall to the ground but at no time did she think she made contact with the crossing guard. Chelsey stated she drove home and called her mother to tell her about the incident. Chelsey stated she wrote an apology letter to the crossing guard and has really bad anxiety and wasn't sure what to do. I advised Chelsey she needs to follow the crossing guards instructions when they are performing their duties no matter if she thinks the road is clear for her to enter/pass. Chelsey stated she understood and was also advised she will be getting a citation and summons in the mail. Chelsey took me to her vehicle where I took several photographs and submitted them to the IT Bureau. No damage was reported or observed. Massachusetts Uniform Citation 997066AA and criminal application was issued and mailed to Chelsey for Chapter 90 section 24 Operating to Endanger and Chapter 90 section 14 Failure to slow near pedestrian.

Operator of vehicle one Sara Kolaczyk stated that while turning right from Albemarle Rd onto Crafts St her vehicle's front drive's side quarter panel struck pedestrian Mariana Pishtikova in the marked crosswalk. Kolaczyk stated that she was looking to her left at on coming traffic on Crafts St and had began to turn right when crash occurred. Kolaczyk stated that she did not see Pishtikova before the crash. Pishitkova stated that she entered the marked crosswalk at Crafts St and Albemarle Rd after she saw that Kolaczyk vehicle had stopped. Pishtikova stated that she walked around the front of Kolaczyk's vehicle and it then turned into her at a very low speed. Pishtikova stated that the front drivers side quarter panel of Kolaczyk's vehicle struck her right side. Pishtikova stated that her right ankle was sore but refused medical treatment. Pishtikova signed a patient refusal form provided to her by Newton Medic Unit Three. I took photos of Kolaczyk's vehicle and the disk was downloaded by the NPD's IT bureau. Kolaczyk's vehicle had no damage and did not require a tow. Kolaczyk stated that she was not injured in the crash. I issued Kolaczyk MA Uniform Citation T2016945 and cited her for a violation of MGL 89/11 , failure to yield to a pedestrian in a crosswalk. Crafts St and Albemarle Rd are public ways in the City of Newton.

The pedestrian, identified as Yuanhua Wei stated that she was walking west on Derby St and attempting to cross Parmenter Rd in the cross walk when she was struck by MV#1. The operator of MV#1 stated that she was traveling east on Derby St and began turning left onto Parmenter Rd because in her words, she didn't observe the pedestrian. The operator stated as she turned through the intersection, she observed the front of her MV strike the pedestrian, the pedestrian dropped to the ground and the MV#1 pulled over to the right side of Parmenter Rd. When asked, the operator stated she were not distracted while operating her MV. When I arrived Mrs. Wei was sitting in the cross walk directly next to the north west corner of that intersection. When asked about her injuries, she stated her hip hurt, she showed me an abrasion on her right elbow/forearm and her lower body was sore. I also observed one of Mrs. Wei's sneakers was on the ground next to her. Mrs. Wei was sitting the entire tire time, did not appear to have any serious injuries and attempted to get up shortly after I arrived, but advised her to remain sitting. Paramedics evaluated Mrs. Wei for minor injuries at the scene and she chose not to be transported to a local hospital for her injuries. I did not observe any damage to MV#1, which the operator confirmed. I informed both parties that I was filing a crash report with charges pending.

On 09/19/2021 at 19:24 hours I responded to the area of 215 Needham St for a report of a motor vehicle crash involving a pedestrian. Needham St is a public way in the City Newton. Upon my arrival I spoke with Elemar Bayramov who stated that he and his aunt Sevda Nasirova were walking in the marked crosswalk in front of 215 Needham St . Baryamov stated that he and Nasirova were crossing from the west side of Needham St to the east side when Nasirova was struck by a car. Baryamov stated that Nasirova was struck on the right side and the impact caused her to land approximately 15 feet from the point of impact. EMS on scene stated that Nasirova had a broken right arm and had no recollection of the crash. Nasirova was transported via ambulance to the Beth Israel Hospital in Boston. Gulnar Shukurova stated that she was in the crosswalk with Nasirova and Baryamov and she saw a gray car " driving fast " hit Nasirova. I spoke with the operator of MA reg 6MT891 a 2017 Toyota Rav 4, Vladimir Beyninson ( DOB 01/22/1937 ). Bannon stated that he was driving north bound on Needham St when his vehicle stuck Nasirova. Bannon stated that he did not see anyone in the crosswalk. Beyninson stated that he was injured and his vehicle did not require a tow. Beyninson's vehicle had damage to the driver's side door, bumper and mirror. I took photo's of Beyninson's vehicle and forwarded the disk to the NPD IT Bureau. I also took a statement from witness William Rosensweig who stated that he was driving behind Beyninson and did not see him apply the breaks until the point of impact. Based upon statements made to me , I issued Beyninson MA Uniform Citation T2016956 and cited him for a violation of MGL Ch 89 Sec 11, failure to yield to pedestrian in a crosswalk. I also filed a request for immediate threat license suspension with the MA RMV.

On Tuesday, September 28, 2021 while assigned to Traffic unit N525, I responded to the area of Parker Street and Boylston Street for a report of a motor vehicle crash involving a pedestrian. The weather at the time of the crash was overcast. The road surface was dry. Parker Street and Boylston Street are both public ways in the City of Newton. The operator of the vehicle involved was identified as Mr. Viktor Gyuris (S12195708). Mr. Gyuris stated he was operating his 2012 Honda Odyssey (MA: 231EG9) on Parker Street (S). Mr. Gyuris stated he had a green light and proceeded to make a left turn on to Boylston Street (W) when a pedestrian walked into the front driver side fender area of his vehicle. Mr. Gyuris stated he observed the pedestrian at the last second and stated she was not in the crosswalk and was talking on her phone. I observed very minor damage to the front driver side fender/hood area above the front driver side tire. Mr. Gyuris reported no injuries. I spoke with the injured pedestrian, Ms. Marine Manukian (S20246517). Ms. Manukian stated she was crossing Boylston Street (W) at Parker Road (N) when she was hit by the front driver side of MV1. Ms. Manukian stated she was on her phone at the time of the crash and does not recall if she had the pedestrian signal to cross. Ms. Manukian reported injuries to her right hand, elbow, and both knees. Ms. Manukian signed a patient refusal with Fallon Medics and was provided a ride away from the area by the operator of MV1.

On Tuesday October 12th at approximately 1252 hours I responded to the intersection of Rowe Street and Wolcott Street for a city vehicle accident involving a pedestrian. At the time of the accident the weather was sunny and the road conditions were dry. Rowe Street and Wolcott Street are both owned and maintained by the City of Newton. Upon arrival I spoke with the operator of the vehicle involved, identified as Parks and Recreation worker John Siratos (S50488498). John stated he was traveling southbound on Rowe Street and was stopped at the stop sign at the intersection of Wolcott Street. John stated he was looking straight ahead towards the direction he was attempting to travel and proceeded into the intersection to cross over Wolcott Street when he struck the pedestrian with his front bumper causing him to fall on the ground. John stated he was only traveling a couple miles per hour as he just accelerated from a stop. John stated he did not see the pedestrian because of the suns glare. I was able to speak to the pedestrian inside the ambulance receiving medical treatment. He was identified as Justin Anderson (S27026247). Justin stated he was jogging westbound on Webster Street and was crossing the intersection of Wolcott Street and Rowe Street, attempting to head westbound on Wolcott Street. Justin stated he was jogging on the sidewalk and entered the crosswalk to cross the street and was struck by the city vehicle in the right leg causing him to fall to the ground. Justin reported a minor thumb injury and a small scrape on his head. Justin stated his temperature was high and he was being transported to NWH by Medics as a precaution. Pictures of the city vehicle and the scene were taken and submitted to the IT Bureau. No damage to the city vehicle was observed or reported.

Operator of MV1 states he was traveling northbound on Walnut Street and entered the left turn only lane at the intersection of Walnut Street and Beacon Street. Operator of MV1 states while entering the left turn only lane, a pedestrian appeared from behind a car that was in the straight only lane and he struck her at a very low rate of speed with the front end of MV1. Operator of MV1 states the pedestrian said she was fine and kept walking across the street. Operator of MV1 states he pulled into the parking lot of the Walgreen's, got out of his vehicle and attempted to speak with the pedestrian again, which she waved him off stating she was fine and walked away from him. Operator of MV1 at this time left the scene believing the pedestrian was not injured. No damage to MV1. The pedestrian, Elizabeth Kennedy, states she was walking across Walnut Street (not in the crosswalk) when she entered the left turn only lane on Walnut Street and was struck by MV1. Ms. Kennedy states she hit the ground, but got back up and told the operator of MV1 she was fine and he left the scene. Ms. Kennedy complained of knee and elbow pain. Fallon Medics evaluated Ms. Kennedy and she signed a patient refusal, but stated she will have someone transport her to Tuft's medical center.

On Tuesday, November 23, 2021, while assigned to Traffic unit N525, I was asked to investigate a past hit and run crash involving a City of Newton School Traffic Supervisor. Mr. Mark Dumoulin reported to the Newton Police Traffic Bureau that sometime during his assigned school crossing post on the morning of November 23, 2021, a passing vehicle made contact with his left leg while he was crossing children on Ward Street. I responded to Newton Wellesley Hospital to speak with Mr. Dumoulin. Mr. Dumoulin stated this morning, he was at his assigned school crossing post of Ward Street and Waverly Avenue in his official capacity as a City of Newton School Traffic Supervisor. Mr. Dumoulin stated he was wearing his department issued yellow reflective jacket and his department issued yellow hi-vis gloves. Mr. Dumoulin stated he also had his department issued stop sign with him while performing his duties. Mr. Dumoulin stated at some point during his post (0745-0830 hours), he was attempting to cross two children on Ward Street (S to N). Mr. Dumoulin stated he entered the crosswalk of Ward Street on the NE corner of Ward Street at Waverly Avenue. Mr. Dumoulin stated the pedestrian signal was activated at this time and the intersection traffic signals were all red. Mr. Dumoulin stated while entering the crosswalk, he observed a black Honda sedan traveling on Stuart Road (E) towards the intersection of Ward Street and Waverly Avenue. Mr. Dumoulin stated the license plate had 3 characters on it and believes the first letter may have been "E". Mr. Dumoulin stated the operator was a heavy set female with blonde hair in her 30's or 40's. Mr. Dumoulin stated the operator appeared to speed up towards his location to beat the light turning red. Mr. Dumoulin stated the vehicle then continued through the intersection onto Hammond Street (E), but it did not keep right with the normal flow of traffic and entered the Westbound lane of Hammond Street. Mr. Dumoulin stated he attempted to get the operators attention to stop her from continuing in the wrong lane of Hammond Street. Mr. Dumoulin stated at this time, the vehicle made contact with his left knee area and continued traveling down Hammond Street with out stopping. Mr. Dumoulin stated the children he was crossing were not near the vehicle and they did not see the contact. I asked Mr. Dumoulin if there were any other witnesses in the area. Mr. Dumoulin stated he does not believe there were. Mr. Dumoulin reported this collision to the Newton Police Traffic Bureau at approximately 1030 hours. I asked Mr. Dumoulin why he did not contact us when the incident first took place. Mr. Dumoulin stated he thought his injury was superficial and that he knew we were busy. At this time, Mr. Dumoulin is reporting a left knee injury as a result of the crash. Mr. Dumoulin stated vehicles travel on the wrong side of the medium on Hammond Street all the time and estimates it happens 3 times every school post. Mr. Dumoulin also stated the keep right sign on Hammond Street near the crash site needs to be addressed because some of the letters are peeling. I canvassed the area where the crash occurred for the fleeing vehicle with a negative result. I also covered the afternoon school post (1450-1535 hours) to ask passing students if they witnessed the crash with a negative result. I observed the "Keep Right" sign Mr. Dumoulin made mention of at this location. The sign appears to be in working condition and visible from Stuart Road. I took photos of the intersection where the crash happened and submitted them to the IT Bureau. On November 24, 2021, I covered Mr. Duboulin's school crossing post again for the morning post. While canvassing the area I observed a dark colored Mercedez sedan with a 3 character registration parked on Exmoor Street that resembled the vehicle Mr. Duboulin described as the fleeing vehicle. I attempted to contact the registered owner of this vehicle, Ms. Judtich Zukor. Ms. Zukor stated she could not speak at this moment and asked me to call her back. I will follow up with Ms. Zukor.

On Monday, November 29, 2021 at approximately 1733hrs, MV1 was travelling Eastbound on Beacon St. when he had struck a pedestrian (James Bird) and his dog, who had been crossing Beacon St. Operator of MV1 stated he did not see the pedestrian crossing the street and had stopped when he noticed Mr. Bird and his dog roll off the front driver side, hood of the vehicle. Bird stated that when he was crossing Beacon St. in the crosswalk with his dog he had been struck by a vehicle. I asked if he would like to be evaluated by paramedics, which he replied, "yes." Mr. Bird informed me that he was sore and had lost consciousness when he had been struck. Fallon Paramedics arrived on scene to evaluate Mr. Bird and decided to transport him to Newton Wellesley Hospital for further evaluation. The operator of MV1 has a license restriction requiring him to wear corrective lenses (Restriction B). I asked the operator of MV1 if he had been wearing his glasses like his license said, which he replied, "no." A witness, Stephanie Meyer, who had been driving behind MV1 stated that MV1 had pulled out of Hancock Ave onto Beacon St., cutting her off and causing her to slam on her breaks. As she traveled behind him heading Eastbound she witnessed him drive all over the road, crossing the yellow solid line and stated that when she saw the vehicle stop she noticed Bird and his dog laying in the middle of the road on the crosswalk. The vehicle of MV1 was towed by Tody's Towing, due to no one being able to pick up his vehicle. The operator of MV1 was issued in hand Citation #T2014398 and was informed that he was going to summonsed into court for the following violations: MGL Chapter 89/11 (Failure to yield for a pedestrian on the crosswalk) MGL Chapter 90/10 (Unlicensed Operation (License Restrictions B. for not wearing corrective lenses)) The operator of MV1 was informed that an Immediate Threat was going to be processed with the Registry of Motor Vehicles and that his licensed was to be suspended. The operator of MV1 stated to me that he understood that he was no longer allowed to drive. Photographs of the scene and the vehicle and have been sent to the IT Bureau to be attached to this report. It should be noted that Newbury St. and Beacon St. are public ways within the City of Newton. An incident report (#21049761) was also generated in regards to the incident. An Immediate Threat Form was filled and faxed over to the Registry Motor Vehicle in regards to the incident.

On Tuesday November 30, 2021 at approx. 0857 hours I responded to the area of Chestnut Street and Ellis Street for a report of a two motor vehicle crash with unknown injuries. Upon arrival on scene Medics and Fire personnel were rendering aid to all operators / occupants, due to the location of the crash additional units were requested on scene to divert traffic. Operator of vehicle one Ms. Kim, stated she stopped at the stop sign. She stated her vision was obstructed with a truck that was parked on the northeast corner of Chestnut Street / Winter Street.. She stated she accelerated forward looking south and north. She stated she was going through the intersection when vehicle two traveling southbound had struck her vehicle. Operator of vehicle two Mr. Lafaiete-Gheringer stated he was traveling south on Chestnut Street when vehicle one traveled west from Winter Street through the intersection and struck his vehicle. After Medic evaluations on Ms. Kim and her child Ariela Seok, she signed patient refusal's with no reported injuries at this time. Mr. Lafaiete-Gheringer was transported to Newton Wellesley Hospital for a minor laceration on his head due to impact, non life threatening. Todys towing of 1354 Washington Street arrived on scene and towed both vehicles to their tow lot. Towed inventory sheets were completed. All parties advised of the process and I advised them my contact information. After reviewing the crash site area, possible obstructions and a safer way for vehicular and pedestrian traffic, I am recommending a stop sign be placed on the southbound lane Chestnut Street just prior to Ellis Street. In addition Mr. Lafaiete-Gheringer has an active registration without a Massachusetts license with an effective date of August 16, 2021. He currently has an active California License, with an California address. Therefore I am issuing and mailing Mr. Lafaiete-Gheringer MA citation number T1445575(warning) for Chapter 90 Section 26a Failure to notify registry of his license address change.

On December 9, 2021, at approximately 1754hrs, while operating cruiser N495, I, Officer Dragone responded to the intersection of Beacon St and Grant Ave for a report of a motor vehicle accident involving a pedestrian. Beacon St and Grant ave are both public ways in the city of Newton. I spoke to a female party, later identified as Jennifer Diamond, who stated she was hit by a vehicle. Ms. Diamond was visibly shaken up but stated she was not injured. She stated that she was walking Eastbound in the crosswalk on Beacon St crossing the intersection of Grant Ave when she was lightly hit on the right side of her body by a motor vehicle, which caused her to fall to the ground. She stated the vehicle was taking a left onto Grant Ave from Beacon St. She stated the operator, later idenified as, Georgia Giannakopoulos got out of the vehicle to check on her. Ms. Diamond took a photo of the license plate (MA Registration 5SV474 ). Ms. Diamond states the operator then got into her vehicle and drove Northbound on Grant Ave. A witness, Andrew Greenberg, stated he saw a gray Honda CRV take a left onto Grant Ave from Beacon St and hit Ms. Diamond causing her and her dog to fall to the ground. While on the phone with dispatch, he gave the license plate of Massachusetts Registration: 5SV474 (registered to Georgia Giannakopoulos). He also stated, he saw the operator get out of the vehicle to check on Ms. Diamond and when traffic started to build up she became frantic and left, heading Northbound up Grant Ave. I then responded to the residence of Ms. Giannakopoulos. When asked what happened during the accident, Ms. Giannakopoulos stated she was in the car with her granddaughter and was in a rush because her granddaughter had to take a test. She stated she took a left onto Grant Ave from Beacon St when her granddaughter yelled and she hit Ms. Diamond who was in the crosswalk. She stated that she got out of the car to check on Ms. Diamond, who implied she was ok. Ms. Giannakopoulos stated she then went back into her vehicle to drive home and call the police. Ms. Diamond signed a patient refusal with Fallon EMS and was picked up by her parents. Georgia Giannakopoulos was issued in hand Massachusetts Uniform Citation# T1445617- Massachusetts General Law- Ch. 90 S. 24- Leaving the scene of a collision after personal injury. Operator of vehicle 1 was traveling westbound on River St towards Lexington St. Operator states she felt uncomfortable with how close vehicle 2 was behind her while she was driving. Vehicle 1 came to a stop at the red light on River St at Lexington St and was waiting for a pedestrian to cross before turning right onto Lexington St when she was struck from behind by vehicle 2. Vehicle 2 then backed up and drove around vehicle 1 and headed northbound on Lexington St. Operator of vehicle 1 immediately called 911 and followed vehicle 2 approximately 0.7 miles into Waltham where the vehicle stopped on Crescent St @ Brown St in the City of Waltham. Operator of vehicle 2 begged operator 1 not to call the police when at this time Waltham PD arrived on scene and notified us. After further investigation it was determined that the operator of vehicle 2 did not have a drivers license. No one reported any injuries and neither vehicle required a tow. I cited the operator of vehicle 2 MA Citation #T144336 for unlicensed operation and for leaving the scene.

On 01/27/2022 while working a detail for Feeney Utility Co, Lt Healy called over the air that he had just witnessed a motor vehicle pedestrian accident at his location and that no one was injured. On arrival I spoke to the pedestrian involved, Jinny Lin who stated he was walking northbound on Lowell Ave and was crossing Highland Ave in the marked crosswalk when he was struck by vehicle 1. Lin stated he was more than halfway across the street when he was struck. Lin said he was only bumped by the vehicle and was never knocked over. Lin had already notified his mother, Tina Chan who arrived on scene shortly after. Lin was seen by Fallon medics and signed a patient refusal. I than spoke to the operator of vehicle, Ali Roozbehani1 who stated he was traveling southbound on Lowell Ave and saw that it was blocked off and detoured down Highland Ave due to road construction. Roozbehani said he was slightly blinded due to solar glare as he made a left turn onto Highland Ave and as he did so struck a pedestrian. Roozbehani had no damage to his vehicle and was uninjured. I took several digital images of the scene and submitted them to IT to be attached to this report. Roozbehani was issued MA Uniform Citation #T2016735 for 89/11 pedestrian in a crosswalk.

Operator of vehicle one , Yuan Chen stated that while turning onto the west bound on ramp of RT 9 from the north bound lane of Center St the front driver's side bumper of his 2013 Land Rover SUV struck pedestrian Anastassia Javortchouk on her right side. Chen stated that the roadway was not well lit and he did not see Javortchouk in the marked crosswalk. Chen stated that he was not injured in the crash and his vehicle had no visitable damage. Javortchouk stated that she looked both ways before crossing over the RT 9 west bound on ramp in the marked crosswalk heading north bound. Javortchouk stated that she did not see any vehicles approaching and entered the marked crosswalk. Javortchouk stated that she was struck on her right side by vehicle one. Javortchouk had a visible minor laceration to her right leg. It should be noted that Javortchouk was wearing a black shirt and black shorts at the time of the crash, and I observed the lighting conditions to be low. Per Javortchouk's request she was transported via EMS to Boston Medical Center for treatment. Chen was issued MA Uniform Citation T 2016706 and cited for a violation of MGL 89/11, failure to yield to a pedestrian in a crosswalk. All roadways in this report are public ways in the City of Newton.

On Wednesday, February 16, 2022, while assigned to Traffic unit N525, I responded to the intersection of Cabot Street and East Side Parkway for a report of a motor vehicle/bicycle crash. The weather at the time of the crash was clear and sunny. The road surface was dry. Cabot Street and East Side Parkway are both public ways maintained by the City of Newton. I spoke with the operator of MV1 (2016 Mazda CX3, NY: JNB6711), Mr. Tushar Singhal (NY: 287647610). Mr. Singhal stated he was operating his vehicle on Cabot Street (E) towards the East Side Parkway intersection. Mr. Singhal stated he came to a complete stop at the stop sign on Cabot Street. Mr. Singhal stated he did not see any vehicles or pedestrians in the area at this time. Mr. Singhal stated he proceeded to travel through the intersection from his stopped positon and take a left turn onto East Side Parkway. Mr. Singhal stated at this time a bicyclist crashed into the passenger side of his vehicle. Mr. Singhal stated the bicyclist then fell over his hood and onto the roadway. Mr. Singhal reported no injuries from the crash. I observed damage to the front passenger side door, mirror, fender, and hood. Sgt. M. Wade spoke with the injured bicyclist, Keiji Imai, while he was being evaluted by Newton Medics. Mr. Imai stated he was operating his Trek bicycle on Cabot Street (W) towards the East Side Parkway intersection. Mr. Imai stated he was on the sidewalk and entered the intersection with out stopping. Mr. Imai stated he crashed into the side of MV1 and fell to the roadway. Mr. Imai was transported to Newton Wellesley Hospital with minor injuries to his left wrist and rear. Keiji was wearing a helmet at the time of the crash. I observed the helmet to have no fresh damage or defects. Photos were taken of the helmet to document it's condition. Keiji's father, Koguke Imai, was made aware of the crash involving his son and stated he would respond to the hospital. I observed no substantial damage to the Trek bicycle. I transported Keiji's blackTrek bicycle to Keiji's residence. I spoke with a witness to the crash, Ms. Madison Albano. Ms Albano stated she was walking her dog on Cabot Street (E) on the Northbound sidewalk at the East Side Parkway intersection. Ms. Madison Albano stated she observed MV1 approach the intersection to her right side on Cabot Street (E) and come to a stop at the stop sign. Ms. Albano stated she then observed MV1 make a left turn onto East Side Parkway and she heard a crash. Ms. Albano stated she observed a bicyclist crash into the passenger side of MV1 and then fall to the roadway. Ms. Albano stated she did not see the bicyclist prior to the crash and does not know if he came off of the sidewalk or was in the roadway. After speaking with all involved parties, I have summized the following. As MV1 was completing his left turn onto East Side Parkway (N) from Cabot Street (E), the involved bicylist failed to yield at the stop sign while traveling on Cabot Street (W) across the intersection. The bicyclist entered the intersection with out yielding and crashed into the passenger side of MV1. MV1 had the right of way. No citations will be issued as a result of this crash. Photos were taken of the scene and submitted to the IT Bureau. Keiji is a student at Newton North High School.

On Tuesday, March 02, 2022 at approximately 2126hrs, I, Officer Fay responded to the intersection of Chestnut St. and Larchmont Ave. for a report of a vehicle that had struck a sign. Prior to my arrival dispatch informed me that the vehicle that had struck the sign was a blue hatchback, but the reporting party was unable to see a license plate. Upon arrival, I noticed tire tracks of a vehicle that had hopped the curb and sidewalk that was travelling Northbound and a yellow pedestrian sign that had been struck. Upon closer inspection of the area I noticed a fire hydrant had been struck as well. The fire hydrant was broken off when hit by the vehicle and had broke through fence of the house at 750 Chestnut St. Pictures of the scene and the damaged property were taken and sent to the IT Bureau to be attached to this report. I spoke to the resident of 750 Chestnut St., Vladimir Valtchinov, in regards to his damaged fence. I also asked Valtchinov if he had heard or seen anything in regards to the incident. Valtchinov stated that he did not see anything, but did hear a loud bang outside his house. I informed Valtchinov that a report would be generated in regards to this incident. Upon canvassing the area in search of the vehicle. I was unable to locate the vehicle. I also spoke to the resident of 757 Chestnut St. who had cameras facing the street, which they stated the cameras did not capture the incident, but are only able to see a live feed.

On Friday, March 11, 2022, I responded to the area of Washington Street and Lowell Avenue for a report of a motor vehicle crash. The weather at the time of the crash was clear and sunny. The road surface was dry. Washington Street and Lowell Avenue are both public ways maintained by the City of Newton. The operator of MV1, Ms. Caroline Wilson (S14662375), stated she was operating her 2019 Mini Cooper (MA: 7GK482) Southbound on Lowell Avenue towards Washington Street. Ms. Wilson stated she came to a stop at the red light on Lowell Avenue, observed no traffic in the area, and then made a right turn onto Washington Street. Ms. Wilson stated after she completed her right turn, she observed the pedestrian signal activate in front of her and a pedestrian began entering a marked crosswalk on Washington Street to cross. Ms. Wilson stated she stopped her vehicle to allow the pedestrian to cross. Ms. Wilson stated at this time, MV2 crashed into the rear of her vehicle. Ms. Wilson reported no injuries. I observed damage to the rear passenger side of MV1. The operator of MV2, Ms. Geraldine Bartlett (S68389347), stated she was operating her 2020 Jeep Grand Cherokee (Ma: 371TV3) Southbound on Lowell Avenue towards Washington Street. Ms. Bartlett stated she came to a stop at the red light on Lowell Avenue behind MV1. Ms. Bartlett stated she observed MV1 take a right turn onto Washington Street. Ms. Bartlett stated after MV1 made her turn, she observed no traffic in the area. Ms. Bartlett stated she then made a right turn onto Washington Street. Ms. Bartlett stated MV1 stopped in front of her in the roadway and she crashed into the rear of MV1. I observed damage to the front passenger side of MV2. Ms. Bartlett report not injuries. Both vehicles were able to be driven away from the crash scene.

On March 18, 2022 at approximately 16:21 hours I, Officer Guarino, responded to the area of Commonwealth ave for a two car motor vehicle crash. Upon arrival, I observed both occupants out of their vehicles. MV2 had struck the rear of MV1 and were still together at the time of my arrival. The operator of MV1 had stopped for a pedestrian in the crosswalk and the operator of MV2 did not stop in time and crashed into the rear of MV1. There were no reported injuries and both vehicles were able to be driven away. Both parties exchanged information and were informed that a police report would be on file.

On 04/08/2022 at 1454 hours while assigned to unit N524 I responded to the area of Hammon St and Priscilla Rd for a report of pedestrian that had just been struck by a motor vehicle. On arrival the pedestrian was already being treated by Fallon medics for minor injuries. I spoke to the operator of the vehicle, Gunter Heinrich who stated he was traveling southbound on Priscilla Rd and stopped at the stop sign at Hammond St. He then proceeded forward turning left onto Hammond St where he struck pedestrian crossing the street. Heinrich reported no injuries and no damage to his vehicle. I then was able to speak to the pedestrian involved who was identified as Emily Singley. Singley stated she was walking eastbound on Hammond St just past Priscilla Rd and saw vehicle 1 stopped at the stop sign so she believed it was safe to cross. As she was crossing she noticed vehicle 1 come at her and had no time to react. She was struck by vehicle 1 and knocked backwards onto the pavement. Singley had scratches to her left arm/elbow and believed she bumped her head but signed a patient refusal with the medics. Where Singley crossed there was no crosswalk but there was a curb cut in the sidewalk for pedestrians. Singley was about half way across the road when she was struck. Based on the statements given by the involved parties I issued Heinrich MA Uniform Citation #T1448567 in hand for 90/18A Failure to yield for a pedestrian. Heinrich is here from Austria visiting his daughter (the vehicle owner) and was operating on an Austria drivers license.

Narrative:
On 04/20/2022 I was notified of a motor vehicle accident involving a pedestrian that was reported to Lasell University PD. I spoke to Lasell PD Officer Gilfoy who stated the accident happened on 04/19 sometime between 2130 and 2200 hours and that the pedestrian involved had just reported it to their office. Officer Gilfoy faxed over a copy of their report (report #22-0316). Andrea Simms reported to Lasell PD that on 04/19/2022 between 2130 and 2200 hours she was walking down Woodland Rd and was about to cross Lake Ave when her attention was drawn to a vehicle parked on Lake Ave. She said it looked like the vehicle was waiting to back out of Lake onto Woodland and she waited approximately 1 minute before crossing behind the vehicle. As Simms crossed the vehicle backed up and struck her left knee/thigh. Simms walked over to the passenger side of the vehicle and spoke to the operator who was very apologetic and stated she did not see her. Simms then left the area and did not think to report it until she was advised to the next day by another student. The vehicle operator was identified as Nicole Catania. Catania stated she had just dropped a friend off on Lake Ave and was waiting for traffic on Woodland Rd to go by before she backed out onto the street. As she backed out she heard what sounded like someone hitting her trunk with their hand. Catania stated that a party then came to her passenger side window and Catania stated that Simms never said she was struck but Catania still apologized and told her she never saw her. Simms replied "OK" and walked off. Catania never reported the incident because she did not believe there was anything to report. In the report I received from Lasell it stated that they had reviewed CCTV from Karandon House that showed Catania backing up and stopping to allow a passing vehicle to continue on Woodland. Simms is then observed crossing behind Catanias vehicle as it stopped for the other vehicle and it could not be determined if she was struck or hit the trunk with her hand. Simms can be seen speaking to Catania through the passenger side before walking away.

Narrative:
On 4/29/22 while working N496, I responded to the area of 287 Jackson St for a pedestrian crosswalk signal that was knocked over due to a possible past hit & run. On arrival I located the signal, along with a small blue advertisement sign for Newton-Wellesley Hospital, laying on the sidewalk on Parker St northbound by Rt 9 westbound. The damage is in fact conistent with a hit & run. I did not locate any cameras in the area. Pictures of the damage were taken and sent to IT. DPW has been notified to remove the signs/clean up debris.

MV#1 Was stopped at the intersection of Walnut & Lakewood to let a pedestrian cross in the crosswalk when she was struck from behind by MV#2. OPMV#1 Stated she was stopped to let a pedestrian go that was in the crosswalk. MV#2 Was stopped at the intersection of Walnut & Lakewood behind MV#1 when he was struck from behind by MV#3. MV#2 then collided into MV#1. OPMV#2 Stated he was stopped behind a vehicle waiting for a person to cross the street when he was struck from behind causing him to hit the car in front of him. MV#3 Was traveling Northbound on Walnut St when he collided with MV#2 that was stopped in traffic. OPMV#3 Stated he was traveling on Walnut St when he didn't notice a vehicle in front of him was stopped in traffic. OPMV#3 Stated he tried to stop but couldn't in time before he collided with the vehicle in front of him. MV#2 & MV#3 Was towed by Tody's Towing. All parties signed patient refusals.

Operator of MV1 states he was traveling east on River Street. Operator of MV1 saw a pedestrian in the crosswalk, he slowed then stopped to allow him cross the street. When MV1 stopped he was hit in the rear by MV2. Operator of MV2 states he must not have been paying attention. Operator of MV2 states MV1 was slowing down and he thought he was going to turn onto Pine Street. Then MV1 came to a stop. MV2 states he did not anticipate the stop. Operator of MV2 states he down shifted and hit the brakes but did not stop in time and struck MV1. Due to witness statements, operator of MV2 was questioned about cell phone use. Operator of MV2 states he was not using his cell phone. He is a delivery driver and it was open on the passenger seat so he could be tracked by the app. Operator of MV2 could not find his phone at first so asked if it had flown out the window. No reported injuries. NFD notified for the spill. MV2 was towed by Todys. MV1 was moved safely off to a parking spot on Pine Street to await his own tow.

On Wednesday, 6/29/2022, at approximately 1630 hours, I, Ofc Murphy was dispatched to the intersection of Craft St and Washington St for a MVA involving a pedestrian. Upon arrival, I spoke with a witness, Ms. Tunde Kovacs. Tunde stated she observed MV 1 taking a right turn from Craft St onto Washington St. Tunde stated she also observed an unknown pedestrian attempt to cross the cross walk on Washington St at this intersection without the cross walk light. When MV 1 took the turn he struck the unknown pedestrian. Tunde further stated the pedestrian got into MV 1 with the Operator. Tunde provided the plate of the vehicle, MA reg 387RK5. Tunde also stated the pedestrian was wearing tan pants with a gray short sleeve t shirt. I was able to make contact with the driver of MV 1 via telephone. I spoke with Mr. Santos Hernandez. Santos stated he took the right hand turn from Craft St onto Washington St and did not know anyone was in the cross walk because the cross walk light was not on. Santos struck the unknown pedestrian while making this turn. Santos further stated the pedestrian was ok and just wanted a ride home. Santos stated he brought him home to his address in Belmont. Santos was able to provide a phone number for the unknown pedestrian. There was no damage to MV 1. I spoke with the pedestrian, Mr. Ashley Jeremy. Jeremy stated he was attempting to cross Washington St at the intersection of Washington and Craft St in the cross walk southbound when he was struck by MV 1. Jeremy stated he didn't believe he was badly hurt on scene and just wanted a ride home from MV 1. Jeremy further stated he is unsure if he used the cross walk light but he thinks he "probably didn't." Jeremy stated he has a small cut on his back and his right leg is a little sore. Jeremy further stated he might go to the doctor on his own accord to get evaluated.
