MV1 (MA Reg: 51JD62, 2007 green Toyota Pruis) operated by Marcia Gittes (DOB 11/29/1948) was traveling Southbound on Walnut St when it collided with a pedestrian in the crosswalk at Walnut St/Foster St. MV1 collided with a man, later identified as Jerome Shectman (DOB 10/7/1964). He had an injury to the back of his head, right hand, left shoulder and lower spine and was transported to Beth Israel Hospital. Witness, Patrick Clare-O'Brien saw the crash take place. He stated that the pedestrian, Jerome was crossing in the crosswalk traveling Westbound towards Foster St, successfully passed through the lane where vehicles were traveling Northbound on Walnut St and was then hit by the Toyota Prudish in the lane going Southbound. Jerome was already halfway through the crosswalk at this point. It was dark, but there was a streetlight directly over this crosswalk on Walnut St creating a semi-lit area for visibility. Mrs. Gittes stated that she didn't see him because he was wearing dark clothing and it was dark outside. She saw him when it was too late. There was no damage to her vehicle. Mrs. Gittes was given a monetary citation (T0646789) for 89/11 Crosswalk Violation. pictures were taken at the scene and the photo SD card was sent to IT. Traffic Bureau update (Officer Gaudet): I was asked to follow up with the injured pedestrian involved in this accident, Jerome Schectman (S77606276). Schectman stated he was attempting to cross Walnut Street east to west towards Foster Street. Schectman stated he entered the crosswalk after observing no cars traveling towards him in the Northbound lane of Walnut Street. Schectman stated he began walking across the street and stopped in the middle of Walnut Street after observing 2 vehicles traveling towards him in the Southbound lane. Schectman stated as the first vehicle went by, he stared at it as it traveled past him and down the street. Schectman stated as he looked back at the second car it was traveling right at him and he was unable to get out of the way. Schectman stated the vehicle hit him on his right side. Schectman listed his injuries as follows: fractured vertebrae, laceration to the back of his head, neck pain, and left shoulder/arm pain.

On Wednesday, January 9, 2019, while assigned to Traffic unit N525, I responded to 457 Walnut Street, Newton for a report of a past motor vehicle/pedestrian accident involving a student at Newton North High School. I met with the pedestrian involved in the accident, Ellie McBride, in the Riley House admin office. McBride is a Freshman at Newton North High School. McBride's mother, Linda Hanusaik, was also present while I spoke with her. McBride stated at approximately 0740 hours, she was attempting to cross Lowell Avenue in a marked crosswalk at Highland Street (E). McBride stated she observed a newer model gray Acura SUV traveling towards her Southbound on Lowell Avenue while she was standing in the crosswalk. McBride stated she thought the vehicle was going to slow down for her. McBride stated as the vehicle got closer it appeared to be slowing down but was unable to avoid making contact with her. The front end of MV1 made contact with McBride's left side. The impact caused McBride to fall down onto the roadway. McBride stated the vehicle pulled over and the operator exited the vehicle to check on her. McBride stated the operator was a white female with long brown hair, possibly high school aged. McBride stated after she told the operator that she wasn't hurt, the operator returned to her vehicle and left the area, possibly towards Commonwealth Avenue. McBride could not provide any additional information about the operator of the vehicle involved. McBride stated she then walked to Newton North High School. McBride stated she went to her morning class but left and texted her mother to tell her she was involved in an accident. McBride stated she was shaken up by the accident, but reported no injuries. Newton Medics evaluated McBride and obtained a patient refusal. McBride was advised that due to the reported age of operator, they may be a student at the high school. McBride was advised that if she sees the operator to obtain her information/contact NPD. I checked the area of Lowell Avenue and Highland Street for the vehicle involved/witnesses with a negative result. A portion of Newton North's athletic fields are next to this intersection. Newton North stated there are no surveillance cameras in this area. Lowell Avenue and Highland Street are both public ways maintained by the City of Newton.

On 02/01/2019, while assigned to N494, I, Officer Conary, responded to Crafts St at North Street for a three car MVA. Operator of MV1 stated that she was sitting at the red light on Craft Street at North Street when she saw it turn green and then felt MV2 hit MV1 rear. Operator of MV2 stated that he was sitting at the red light at the intersection when he began to move when the light turned green and then MV3 hit MV2 rear. MV2 stated when MV3 hit him, he then hit MV1. Operator of MV3 stated that she was at the intersection when she began to slowly move with traffic, her foot slipped off the break, and she hit MV2. Operator of MV3 stated that her foot was wet from walking in the snow. There was snow on the ground but not in the roadway. There was no visible damage to MV1 at this time. MV2 had damage to the rear bumper. MV3 had damage to the front bumper. All cars were able to be driven from scene. All parties were offered and declined medical attention. No further incident to report at this time.

MV 1 WAS UNABLE TO GET A LICENSE PLATE OR A DESCRIPTION DUE TO THE WEATHER (HEAVY SNOW) AND THE FACT THAT THEY JUST PULLED OVER TO THE SIDE AND ASSUMED MV 2 WOULD DO THE SAME. MV 2 NEVER PULLED OVER TO EXCHANGE INFORMATION AND CONTINUED GOING SOUTH ON CENTRE STREET. MV 1 SUSTAINED MODERATE REAR END DAMAGE AND NO INJURIES REPORTED. THERE WAS A PARTIAL PLATE GIVEN BY THE PEDESTRIAN CROSSING THE STREET OF 915.

Narrative:
On Friday March 15th 2019 at approximately 0730 hours I responded to the intersection of Beacon Street and Herrick Road for a report of a hit and run involving a bicyclist. The weather at the time of the accident was cloudy and the road conditions were dry. Both streets are public ways in the City of Newton. Upon arrival I observed the victim identified as Glenn Butcher (MA OLN S36552335), inside the ambulance getting medical attention. Butcher was getting a bandage applied to his left leg and complained of leg, back and neck pain. Butcher appeared visibly shaken and in pain. Butcher stated he had the green traffic light and was travelling eastbound on Beacon Street crossing Centre Street and then continuing straight crossing Herrick Road. Butcher stated MV1 was travelling westbound on Beacon Street and took a left turn onto Herrick Road and collided into his bicycle. Butcher states upon impact he flipped over his bicycle and landed on the hood of MV1, before rolling off and landing on the ground. Butcher states he was wearing his helmet which was present. Butcher states his bicycle ended up partially under MV1. Butcher states the operator of MV1 pulled his vehicle to the side of the road and got out of his vehicle and spoke to several witnesses briefly. Butcher states the operator then left the scene without properly exchanging information and did not wait for the police to arrive. Butcher described the vehicle as a dark gray Honda, and described the operator as an older white male, 5'10 approximately 80 years old with white hair. Butcher was also able to provide an email address for another bicyclist who witnessed the accident. The witness left his information with Butcher prior to my arrival. Fire fighters on scene were able to get the registration number of the vehicle from the witness (MA REG 4CX148) and gave it to Officers on scene. Butcher was transported by Medic 1 to NWH with minor injuries. His bicycle had visible damage to the frame area and skid marks were present on both tires. 19 photographs of the scene and the bicycle were taken and sent to the IT dept. email. Officer Gabriel transported the bicycle to the station where it was logged into Property & Evidence for safekeeping. Dispatch was able to query the registration which came back to a gray, 2010 Honda Accord registered to a Matthew Sugarman (MA OLN S38601397), out of W. Roxbury. Dispatch contacted the Boston Police Dept. and had them send an Officer to the address to try to make contact with Sugarman. Sugarman was advised to contact the Newton Police Dept. and I was able to speak with him on the telephone. Sugarman states he was driving the vehicle today and was involved in an accident with a bicycle. Sugarman states he was travelling westbound on Beacon Street and was taking a left onto Centre Street not Herrick Road. While speaking with Sugarman he seemed confused as to his location during the accident and was adamant that he was turning left onto Centre Street and not Herrick Road. I advised Sugarman that I was on scene with the first responding Officers and the accident clearly occurred at the intersection of Beacon Street and Herrick Road based upon the final resting place of the bicycle. Sugarman went on to state that his vehicle was already turning when the bicycle struck his vehicle and he believed it was the bicyclists fault. I advised Sugarman it appears the bicyclist had the right of way since it was traveling straight and that because his vehicle was taking a left turn, he failed to yield for on coming traffic at an intersection. When asked why he did not stay at the scene of the accident Sugarman stated he got out of his vehicle and spoke to the bicyclist and he "seemed okay". Sugarman states he then left the scene while the victim was still sitting on the ground. I asked Sugarman if he had ever been involved in accident before and he replied "no." I advised Sugarman that I am currently looking at his drivers history and see nine accidents that he was involved in. Sugarman stated "he has never been in accident like this before." I then asked Sugarman what the law states when you are involved in an accident and he was not able to provide me with an answer. I advised him that the law states you must stop and exchange information before leaving the scene of an accident. Again he stated the bicyclist seemed okay and "he had somewhere to be so he left." Sugarman has an extensive drivers history including nine surchargeable accidents, reckless operation, two different charges of leaving the scene property damage and two immediate threat affidavits filed against him. I advised Sugarman that I will be mailing him a citation for Ch89 s8 Fail to yield to oncoming traffic, and Ch90 s24 Leaving the scene of personal injury. I also filed an immediate threat form with the registry. I emailed the witness using the information he provided to the Newton Fire Dept that was on scene and received a phone call back from the witness identified as Bruce Adams. See witness report for his statements. I contacted the Bank of America located at 808 Beacon Street in Newton, as they are the closest business to that intersection with video surveillance. I spoke with George Walsh (781-834-8275) who stated they do not have any working cameras on that side of the building to the bank. For this report the bicyclist is entered as a non-motorist for validation purposes. Witness Bruce Adams (MA OLN S96398108) stated that he was riding his bicycle travelling behind the victim about 100 feet away. Adams states he was watching the victim and had a clear view of him as he travelled behind him, through the green traffic light heading eastbound on Beacon Street. Adams stated he witnessed MV1 travelling westbound on Beacon Street take a sharp left turn onto Herrick Road which turns into Union Street. Adams stated that the vehicle turned left colliding into the bicycle and there was no possible way the bicyclist had time to stop to avoid the collision. Adams stated the victim flew over his handle bars and fell on top of MV1's hood and then landed on the ground. Adams stated the victim's bicycle was stuck under MV1's front bumper. Adams stated the operator of MV1 backed his vehicle up with the bicycle still attached to his vehicle bumper and pulled MV1 over to the side of the road. The operator then got out of his vehicle and walked up to the victim who was laying on the ground visibly in pain. Adams stated the operator asked the victim if he was okay to which the victim did not immediatley reply as he was visibly shaken up. Adams stated the operator then walked back to his vehicle and attempted to leave the scene and that is when Adams stood infront of MV1 to stop him from leaving the scene. Adams stated he then removed the bicycle from underneath the bumper of MV1 and placed it on the side of the road. Adams stated the operator got out of his vehicle again and walked up to the victim and asked him "what do you want to do?". Adams stated the victim did not respond and that is when the operator got back into his vehicle and drove away, leaving the scene before any emergency response arrived. Adams stated he was able to memorize MV1's registration and stayed with the victim until police, fire and medics arrived. He stated he gave the fire dept the registration and his contact information prior to leaving the scene.

Operator of MV1 states she parked MV1 on Walker Street, while she was visiting a friend and when she came out to her vehicle she found damage to the drivers side door,left front corner panel and left front tire rim. Operator of MV1 states two people witnessed the hit and run who were both on scene. The first witness, Aaron Creecit, was making deliveries for UPS when he saw MV2, which was a motor cycle with a side car attached to it, take a left from Proctor Street onto Walker Street and struck MV1 with the side car portion of the motor cycle and left the scene. The second witness, Jeanette Even, who lives at 30 Walker Street witnessed the hit and run and stated she saw MV2 take a left from Proctor Street onto Walker Street and struck MV1 and left the scene. The first and second witness took down the registration plate (MA Reg: 2H7713) which came back to 27 Brooks Ave. I responded and found the motor cycle in the driveway covered by a blue tarp. I lifted the tarp and found damage on the right side portion of the side car, which would be consistent with the hit and run. I spoke with the operator of MV2, who states the motorcycle is new and she didn't realize she hit MV1. I issued the operator of MV2 in hand Massachusetts Uniform Citation #T1441458 for MGL Ch. 90 Sec. 24 (2) Leaving the scene of property damage (crash)

On April 19, 2019 at approximately 15:45 Operator of MV1 walked into the Newton Police Station to file a motor vehicle crash report. Operator of MV1 said that the operator of MV2 had left the scene after the crash. Operator of MV1 said that she was on Cabot St driving westbound, turning right onto Harvard St northbound at the stop sign. She said that the operator of MV2 was turning left onto Cabot St from Harvard St and the vehicle's trailer struck front driver's side of her vehicle. Witness, Mike Horner (508)930-7375 followed MV2 and got the license plate information. I contacted the operator of MV2, who said that he was turning left on Cabot St and the operator of MV2 started to turn before he was done. He saw the operator of MV1 hit a wire of the vehicle's trailer, but did not believe that there was any damage done and thought that MV1 drove away.The operator of MV2 was compliant in the investigation and did not believe he left the scene of an accident.

Narrative:
On April 24, 2019, while assigned to N496, I was called by Dispatch to respond to the area Beacon Street and Hammond Street for a motor vehicle crash. This was called in by Boston College Police Department. Upon arrival MV #1 was on Beacon Street just past Hammond Street at the Island with considerable vehicle damage. MV#1 stated while traveling westbound on Beacon St, while approaching the intersection of Hammond he stated he started to feel strange and not like himself. MV#1 stated he then struck the curb with his front right tire, not believing his accident was very serious at this time. He reversed his vehicle off the sidewalk and proceeded to travel westbound on Beacon St. After passing through the intersection he stated his car felt very off at which point he initiated his hazards and pulled over to the right. MV#1 stated he has a history of epilepsy and currently takes Oxcarbazepine twice a day for his condition. He stated he did not believe he had a seizure or lost consciousness but did not recall the incident very well. Boston College Ofc. Cadogan witnessed the incident, and stated the following, while conducting a directed patrol at the intersection of Beacon and Hammond St he saw MV#1 traveling westbound on Beacon St. Ofc. Cadogan stated MV#1 then took a sudden tight turn on to the curb striking the metal fence surrounding the BC facility. MV#1 was then seen / heard revving his engine while still in drive before reversing his vehicle off the curb and attempting to continue on Beacon St westbound. The fence surrounding the BC Facility sustained moderate damage. Tire marks in the grass show the path of MV#1 in direct line to the damaged property. While on scene, I spoke at length with Vanhorne. I did not detect or any alcohol from his breath as he spoke. Vanhorne reported he only consumed one beer tonight at roughly 2030hrs and smoked a little marijuana at 2200hrs. Vanhorne's eyes did not detect any signs of alcohol and he walked with no signs of any impairment. Sgt. Devine administered a horizontal nystagmus test which revealed no signs of impairment. Vanhorne reported he was at a work event and then visited a friend in Brookline. Vanhorne reported his last seizure from epilepsy occurred a little over two years ago. Pictures of the scene were taken and submitted to IT to be attached to this report. MV#1 operator stated he was not injured at this time. MV#1 was towed from the scene by Todys's due to heavy front end damage. Vanhorne was picked up from the scene by Paul Miller his step father. A towed MV form was filled out and placed in the traffic box. Witnesses Cassandra Williams and Bill Peirce observed the crash and stated identical narratives to Ofc. Cadogan's. An Immediate Threat form was filed with the RMV (via Fax and E-mail at approximately 0650hrs 4/24/19)due to his medical history and his explanation with this crash. All streets mentioned are public ways in the City of Newton. It should be noted that the road was wet from rain on this night. Update: on 4/27/19 Sgt.Devine was able to watch the video of the incident from Boston College Police. The video confirmed the statements given by BCPD and witnesses's. Due to the aforementioned statements and the video surveillance of the incident, MV#1 Operator will be cited with Marked Lanes Ch89/4a (MA Uniform Citation #T1441792. Vanhorne will be notified via phone he will be receiving the ticket in the mail.

Mv#1 operator was travelling on the Boylston St W/B off ramp at the Chestnut St intersection. #1 front seat passenger spoke for #1 operator who spoke limited English. #1 passenger stated #1 operator came to a stop at the posted stop sign, prior to attempting to cut straight across the intersection further W/B on the ramp. After stopping, #1 proceeded straight ahead into the intersection and collided with Mv#2 which was travelling straight ahead on Chestnut St. #1 driver's side front struck #2 passenger side front. No injuries. #1 appeared to sustain moderate damage and did not require towing. #2 stated he was travelling straight ahead on Chestnut St N/B (right of way). #2 stated he was travelling at a low speed. #2 stated when he arrived at the off ramp intersection, #1 drove out straight ahead from his right and crashed into his passenger side front. No injuries. #2 appeared to sustain moderate damage, was leaking fluids and required towing. Tody's towed #2 to their storage yard without incident. Witness was walking on the Chestnut St sidewalk. Witness stated he observed #1 edging out (stop and go fashion) into the intersection before he observed #1 fully proceed forward colliding with #2.

On Sunday, May 5th, 2019 at approximately 1315 hours while working the City of Newton detail for the Walk for Hunger I was standing at my assigned post at the intersection of Centre Street and Willow Street. At the time, the road surface was dry and the weather was cloudy. Traffic was particulary heavy as there were several streets in the area still blocked off for the Walk for Hunger and there were participants still walking the route in the area. My attention was drawn to the intersection of Centre Street and Bowen Street as there was a motor vehicle travelling southbound on Centre Street with their left turn signal on attempting to take a left turn on to Gibbs Street. Gibbs Street was temporarily blocked to non-residential motorists as there were several pedestrians in the road crossing over Gibbs Street. As the motor vehicle attempted to turn, there were several pedestrians in the crosswalk crossing over Gibbs Street. The vehicle had stopped halfway into the northbound lane on Centre Street blocking on coming traffic. The operator appeared to realize Gibbs Street was blocked and attemped to turn the vehicle back into the southbound lane to continue southbound on Centre Street. As the vehicle turned back into the southbound traffic lane, the vehicles rear end collided with Officer Richard Clements, who was operating NPD motorcycle unit 533. Officer Clements was traveling southbound on Centre Street and was passing the vehicles in the southbound traffic lane which were currently all at a standstill. Officer Clements had his emergency lights activated as he was on his way to remove traffic cones from the street to open up all the traffic lanes along the event route. Officer Clements was working the City of Newton detail for the Walk for Hunger assigned to the motorcycle to assist with traffic. Officer Clements front wheel, left side of the motorcycle and left leg collided with the rear end of the motor vehicle. The impact of the crash caused him to fall off the left side of the motorcycle and land on the street face first. At this time I immediately ran from my post to Officer Clements location and radioed dispatch that a motorcycle officer was down and that I needed assistance. As I approached Officer Clements he was face down, unconcious and breathing. I was able to roll Officer Clements into the recovery position and at this time Officer Clements regained conciousness and was able to speak and stated " What happened? What was that lady doing she turned right into me". I advised Officer Clements that he had just been involved in an accident and to stay still and that help was on the way. The operator of the motor vehicle identified as Helen Leibner (S52717988) stopped her vehicle immediatley after the crash and got out of her vehicle to offer her assistance. I advised Helen and several other witnesses and bystanders who were now crowding around Officer Clements and I to back away from the scene and to not move any of the vehicles involved. Officer Selig arrived on scene and was able to help crowd control until further help arrived. Helen and all witnesses were advised to stand by for police to take their statements. While tending to Officer Clements he was disoriented and made several attempts to move his body to which I had to physically hold him still to prevent possible further injuries. While speaking with Officer Clements I noticed blood coming from the inside of his mouth. Officer Clements was in a noticeable amount of pain. He complained of head, back and left leg pain. Officer Clements was wearing a yellow ANSI certified Newton Police reflective jacket and a Newton Police issued motorcycle helmet. Once the paramedics and fire personnel arrived I was able to speak to the operator of the motor vehicle and several other witnesses. Helen stated she was traveling southbound on Centre Street operating her blue 2014 Audi A4 (MA REG 213BC9). Helen states she was attempting to take a left turn onto Gibbs Street and activated her left turn signal. Helen states she had stopped halfway into the northbound lane as several pedestrians were crossing Gibbs Street in the crosswalk at the time. Helen states after the pedestrians cleared she saw the traffic cones blocking the street and realized the street was closed. Helen states she turned her vehicle back into the southbound traffic lane and did not see Officer Clements or the motorcycle until impact. Helen was not injured and her motor vehicle sustained moderate rear end damage. Her motor vehicle was able to drive away from the scene. Witness Adron Gordon (S90357161) stated he was participating in the Walk for Hunger and had just crossed over Gibbs Street when the crash occured. He stated he witnessed the Officer on the motorcycle with the emergency lights on traveling southbound on Centre Street behind the motor vehicle. The motor vehicle stopped in traffic attempting to turn left onto Gibbs Street. He states then the vehicle made a slight turn back into the southbound traffic lane and the motorcycle collided with the rear end of the motor vehicle. He states the Officer then fell off the motorcycle landing in the middle of Centre Street. Witness Elizabeth McCarthy (S00242346) and Katherine Regan (S43486601) stated they both were in the same vehicle together stopped in traffic in the northbound lane of Centre Street just before the set of lights at Centre Street and Bowen Street. Both witnesses stated they do not remember if the driver of the motor vehicle had the turn signal on but they did see her attempt to turn onto Gibbs Street. They stated they also saw the motorcycle with emergency lights activated travel southbound on Centre Street approaching behind the vehicle. Witnesses state the motor vehicle then suddenly turned back into the southbound lane and the motorcycle collided with the passenger side tailight of the motor vehicle. Both witnesses state the motorcycle attemped to turn away from the vehicle to avoid the crash but was unable to do so. Witness Nina Wang (S39460985) stated she was parked on the southbound lane of Centre Street just prior to the crash scene. Nina states she was in her City of Newton DPW marked vehicle with the hazards on as she was working to assist with traffic safety for the Walk for Hunger. Nina states she witnessed the motorcycle travel southbound on Centre Street and pass the vehicles stopped in the traffic lane. Nina states the motorcycle passed the traffic using the left side and had the emergency lights activated. Nina states the motorcycle was just passing through the green light at Centre Street and Bowen Street when the motor vehicle that was stopped at the lights attempting to take a left turn onto Gibbs Street. Nina states the vehicle then abruptly jerked her car to the right and collided with the motorcycles left side. Nina states she heard a loud crash and witnessed the Officer fall off the motorcycle and land face first onto the street. The motorcycle's final resting place was on its left side approximately two feet away from where Officer Clements was located. The motorcycle sustained moderate damage to its left side, including the front wheel well and undercarriage. The motorcycle left scuff marks on the street which were measured and photographed. Several photographs of the scene and damage to both vehicles were taken and submitted to the IT Bureau. The motorcycle was towed by Todys. Centre Street and Bowen Street are both public ways maintained by the City of Newton. The injured motorcyclist, Officer Clements, was transported to Saint Elizabeth Hospital with fire fighters on board. I was able to follow up with Officer Clements on the phone the next day who was admitted over night at the hospital. Officer Clements stated he has no recollection of the accident and can only remember driving down Centre Street to begin to pick up cones to open up all lanes of traffic. Officer Clements stated he suffered a brain bleed, head, back, left foot and right thumb injuries. A Massachusetts Uniform Citation was issued and mailed to Helen for Chapter 89 Section 7A, failure to yield to emergency vehicle, police motorcycle.

I called Lundwalls father with her cell phone, who stated that he lives in Utah and Lisa has no medical issues. Lundwall is a dog walker and had 3 dogs in her vehicle. Cataldo responded and took Lundwall to NWH. Tody's transported the vehicle and dogs to Rotherwood Animal Hospital on Winchester St. The staff at Rotherwood and Sgt. O'Connell called the dog owners to make arrangements for their return. Tody's towed Lundwalls vehicle.

On 05/20/2018 at 17:30 hours I was notified by Captain Anastasia of a motor vehicle crash involving car, and an electric scooter. Captain Anastaisa stated that the operator of the scooter was a 12 year old male who had sustained unknown injures and had been transported to Boston Children's Hospital via ambulance. Upon my arrival at the crash scene I made the following observations, Putnam and Winthrop streets are public ways in the city of Newton that are two way single lane non divided roadways. The roadway surface was wet from rain earlier in the day. Putnam St runs north to south and Winthrop St runs east to west. There is a stop sign at the end of Winthrop St at Putnam St. I observed MA reg 54MN41 a 2005 Buick LeSabre stopped in the south bound lane of Putnam St approximately 1/2 of the way into the intersection with Winthrop St. I observed approximately three feet of skid marks from the Buick's rear tires. I also observed at the crash scene a Segway Ninebot electric scooter that was on the ground near the Buick(cid:31)s rear passenger side door with its handlebars detached. I spoke with the operator of the Buick, Robert DeSouza who stated that on 05/20/2019 at approximately 16:50 hours he was driving south bound on Putnam St at approximately 25 miles per hour. DeSouza stated that he saw a man, later identified as Jose Estabil standing on the east sidewalk of Putnam St facing Winthrop St who was yelling and waving his arms at something on Winthrop St. DeSouza stated he looked to his right towards Winthrop St and his view was obstructed by a row of hedges. DeSouza stated that as he was looking to his right he began to apply his vehicle's brakes when he saw someone coming at me ". DeSouza stated that he heard a crashing noise from the rear passenger's side of his vehicle. DeSouza stated that he stopped his vehicle after the crash and saw a boy lying on the ground at the rear passenger side of his vehicle. DeSouza stated that he was not injured in the crash. DeSouza's vehicle had minor damage to its rear passenger side door, and did not require a tow. Witness Charlotte Hart stated that at approximately 16:30 hours on 05/19/2019 she was diving south bound on Winthrop St. Hart stated that she had to stop short on Putnam St to avoid a crash " with a boy on a scooter that was racing around on Winthrop St. " Hart sated that she told the boy on the scooter that he should not be ridding the scooter in the street. Witness Jose Estabil stated that he was walking on the east side walk of Putnam St across from Winthrop St. Estabil stated that he saw a boy an electric scooter on Winthrop St approaching Putnam St. Estabil stated that he saw DeSouza's vehicle driving south bound on Putnam St approaching Winthrop St. Estabil stated that the boy on the scooter made no effort to stop, slow or avoid the crash with DeSouza's vehicle. Witness Laurel Fransworth stated that she was driving north on Putnam St approaching Winthrop St when she saw the crash occur. Farnsworth stated a boy on an electric scooter on Winthrop St crash into the rear passenger side door of DeSouza's vehicle. Fransworth stated that she believed that the row of hedges at the end of Winthrop St obstructed DeSouz's vehicle. Rowan Delaney ( 02/27/2007 ) stated that on 05/20/2019 at approximately 16:00 hours he and his fellow F.A. Day Middle School student Thiaugo Rubino ( 03/04/2007 ) were having a race around the area of Winthrop St, Putnam St and Shawn St. Delaney stated that he was on foot running on sidewalks while Rubino was on an electric Ninebot Segway scooter. Delaney stated that Rubion was not wearing a helmet or any other safety equipment. I spoke with Delaney(cid:31)s father Royston Delaney, who stated that the scooter was his and that he was unaware that Rubino was using his scooter, and that he has never seen him ridding it before. Royston Delaney stated that the scooter is battery powered and has a maximum speed of 19 MPH. Royston Delaney stated that his son told him that only Rubino was ridding the scooter. Rubino was transported via ambulance to Boston Children(cid:31)s Hospital. On 05/20/2019 Rubino underwent surgery for a brain bleed. I spoke with Rubion(cid:31)s mother Sonia Rubino who stated that as of 05/21/2019 her son was under observation and in addition to the brain surgery her son had a broken arm, broken leg and a broken back. Based upon witnessed statements and my observations of the crash area I believe that Rubion was at fault for the cause of this crash. Myself and Officer Helms took photos of the crash area and the disks were turned over to the NPD(cid:31)s IT bureau for downloading.

On Thursday, June 6, 2019 while assigned to Traffic unit N525, I responded to the intersection of Waverly Avenue and Franklin Street for a report of an accident involving a City of Newton school bus. The weather at the time of the accident was clear and sunny. The road surface was dry. Waverly Avenue and Franklin Street are both public ways maintained by the City of Newton. The operator of MV1, Dorothy Wensink (S40227061), stated she was operating her 2010 Toyota Prius (MA: 538EV6) Eastbound on Franklin Street towards Waverly Avenue. Wensink stated she came to a stop at the stop sign on Franklin Street (E) at Waverly Avenue. Wensink stated as she began to travel through the intersection, a school bus traveling on Waverly Avenue (S) crashed into the rear driver side door area of her vehicle. Wensink reported no injuries on scene. I observed moderate damage to the rear driver side area of MV1. Wensink was able to driver her vehicle away from the scene. MV2 was a City of Newton contracted yellow school bus (MA BUN: 39173) transporting students attending the Ward Elementary School. The bus was returning to the Ward School from a field trip. The operator of MV2, Antonio Goncalves (S54275856), stated he was operating the school bus Southbound on Waverly Avenue towards Franklin Street. Goncalves stated MV1 abruptly accelerated across the intersection from Franklin Street. Goncalves stated he was unable to avoid making contact with MV1 and crashed into the rear driver side of the vehicle. I observed minor damage to the front middle and passenger side bumper area of MV2. The following Ward Elementary School student, teachers, and parents were traveling on the school bus at the time of the accident and reported no injuries. Students: Avishai Arbili, Eleanor Chen, Maeve Donovan, Esat Efendigil, Mark Elentuck, Julian Ismay, Rhea Khanna, Griffin Kirby, Ori Layani, Priscilla Le-Ngo, Callum McLaughlin, Carolina Muniz, Emily Ney, Hrithik Ponduru, Levi Rosenberg Van Gameren, Zachary Schwarzberg, Ava Smoller, Matthew Somers, Lillian Welford, William Balerna, Alexandra Bogdanova, Randi Green, Christopher Iatrou Johnson, Charlotte Nichols, Henry Pozen, Sofia Shadah Alcalde, and Zoey Steinberg. Teachers: Katherine Goldman and Lauren Ludman. Parents: Enrique Shadah, Brian Rosenberg and Xinxin Wang. The Principal of the Ward Elementary School, Becca Brogadir, responded to the crash scene and signed a patient refusal for all of the students with Newton Medics. The students, teachers, and parents, then walked back to the Ward Elementary School with Principal Brogadir. The school bus was able to drive away from the scene. Once the students arrived at the Ward Elementary School, the nursing staff there evaluated each child before they could return to class. The school staff stated they would make notifications to the parents of the children involved in the accident. After speaking with all parties involved, the operator of MV1 was cited in hand for Newton City Ordinance Chapter 19, Section 75 (Failure to Use Care). Pictures were taken of both vehicles and submitted to the IT Bureau.

Witness #1 stated she was walking on Boylston St and observed MV#2 stopped at the stop sign on Boylston St. Witness #1 stated she observed MV#2 proceed to move forward and made contact with MV#1. Witness #2 stated she was travelling northbound on Chestnut St and stopped at the stop sign at the intersection of Boylston St. She observed MV#2 stopped at the stop sign then proceeded to move forward making contact with MV#1. Both vehicles were towed by Tody's Towing. The operator of MV#1 was picked up by her husband and the operator of MV#2 was transported to Police Headquarters by Witness #2 to be picked up by her friend.

The OP. of MV#1 states he was travelling eastbound on Beacon Street. As he was entering the intersection of Chestnut Street, MV#2 on the oncoming lane suddenly made a left turn in front of his path causing a collision. He pulled over and couldn't find MV#2 anywhere around. He describes MV#2 as a black pick-up truck. The OP. of MV#1 is a dog walker and there were 6 dogs inside the vehicle during the accident. He states the dogs appear fine and the collision wasn't a large impact. Witness #1 states he was the first car stopped on Chestnut Street waiting for the traffic light to turn green. He witnessed MV#2 cut in front of MV#1 and cause a collision. MV#2 then continued driving down Chestnut Street southbound and didn't stop. When they were all stopped at a traffic light for Chestnut Street and Woodward Rd., Witness#1 took down the plate of MV#2 as L92280 and described it as a black pick-up truck with possible MA commercial plates. He describes that it has a spare tire on the bed of the truck leaning against the back window. MV#2 then accelerated away when the light turned green and turned into a unknown side street. The owner of the plate given is for Eric P. Rowe out of Norton, MA. His vehicle model does match the description of a black pick-up truck. I gave Norton P.D. a call at approx. 1800 hrs. A short while later, they called back and said the pick-up wasn't home but gave me a cell phone number. I was able to speak with Eric Rowe and he stated he was the OP. of MV#2. He stated he was on Beacon Street westbound making a left towards Chestnut Street southbound. There was a car making a turn in front of him and he saw MV#1 slow down, which is why he made the turn. A minor collision happened so he stopped to look at this truck and saw no damage. He didn't see MV#1 stopped anywhere so he drove away thinking there was no need to exchange paperwork for no damage to his truck. The OP. of MV#2 was advised of the proper procedure and that he will be getting a citation in the mail. An incident report was also generated.

Veh #1, MA reg 628BJZ, being operated by Mr. David McDonald was traveling east on Commonwealth Ave, attempting to turn right on to Auburn St. According to Mr. McDonald, he began to turn right when he heard a thump against the driver's side of his car, and as he looked, notice a man, Mr. Kejie Gu, fall away from his car. Mr. McDonald pulled over and assisted Mr. Gu to his feet. Mr. Gu got up and walked away. A witness, Mr. Brian Washburn was on his bicycle, and observed the accident. Mr. Washburn was across the intersection traveling west, when he said all the traffic east and west was stopped. Mr. Washburn observed Mr. Gu crossing the street, and stated as he got approximately 2/3 of the was across, he was spun around by the black car. Mr. Washburn believed Mr. Gu to be in the crosswalk. Another witness, Mr. Walter Sims stated he did not see the collision, but did observe Mr. Gu on the ground in the middle of the intersection, not near the crosswalk. Paramedics arrived on scene, Mr. Gu had some scratches on his right elbow, which were bandanged. Mr. Gu signed a patient refusal.

Ross stated that she did not see Baron in the marked crosswalk. Charles Hannum was a front seat passenger in vehicle one and stated that he did not see Baron in front of the vehicle until the crash occurred. I took photos of vehicle one and forwarded to the NPD IT bureau. I issued Ross M Citation T21065501 and cited her for a violation of CO 19/74 , failure to use care while turning.

On October 12, 2019 at approximately 2347 hours, I responded along with multiple NPD units to a report of a MV into a pole at the intersection of Washington St and Commonwealth Ave. Upon arrival, I met with Officer Boyle who directed me to a 2007 Jeep Wrangler(MA Reg:7KK957) that was popped up onto the curb and through a traffic light pole in the intersection on the Westbound side of commonwealth Ave. I was then directed over to the vehicles operator, Sebastian Pike. Sebastian was outside of the vehicle walking around when I had arrived. Sebastian was directed to sit down for now due to airbag deployment from the accident. Sebastian was not complaining of any pain and did not need any medical attention. I then asked Sebastian what happened tonight. Sebastian stated he had just left a friends house and was driving the Jeep Westbound on Commonwealth Ave. He was driving through the intersection with Washington St when he became distracted and looked away from the road. At this point, his Jeep had jumped the curb and crashed into the traffic light pole. The traffic light pole was knocked down and blocked the road Westbound on Commonwealth Ave. Cruisers were used to block the road until Daegle Electric had arrived on scene to clear away the debris. The Jeep was towed by Tody's and a towed motor vehicle form was filed. Due to Sebastian's failure to pay attention, Sebastian Pike was issued Massachusetts Uniform Citation #T2079375 for 90/24 Negligent Operation and 89/4a Marked Lanes Violation. A copy of the report was attached to the citation and submitted to the police prosecutors box as a Criminal Application. Sebastian's Father, Jeffrey Pike, had arrived on scene and drove his son home for the night. All aforementioned streets and Avenue's are public ways in the Commonwealth of Massachusetts.

On Wednesday October 23, 2019, I, Patrolman Hatfield, was assigned to marked cruiser N495 in full uniform to Division 5 for the 1530 to 2330 hour shift. At approximately 2040 hours, myself and Officer Selig were traveling northbound on Centre St (a public way) in Newton Center. We were behind MA reg 9KT873 (2004 Toyota Corolla grey). We observed the motor vehicle drive around a pedestrian in the crosswalk who was attempting to cross at Centre St and Pelham St. I activated my emergency blue lights and attempted to conduct a motor vehicle stop of the Toyota Corolla. The operator continued to drive northbound on Centre St before pulling over just before the crosswalk at Centre St and Pleasant St. The operator then continued driving forward and struck a pedestrian crossing in the crosswalk Officer Selig and I saw the pedestrian being struck before landing on top of the Toyota Corolla hood, and falling forward onto the street. Officer Selig and I spoke with the two parties involved. I spoke with the victim, who was identified as Vivian Rubinstein (Vivian). Vivian crawled towards the sidewalk of Centre St while clutching her lower back. Initially Vivian denied being injured and refused medical aid. The Toyota Corolla operator was identified as the register owner Elise Ruben (Elise). Elise stated to Officer Selig that her front windshield was foggy and when she noticed the blue lights, she attempted to pull over. Elise stated she did not see the pedestrian in the crosswalk. Elise appeared very upset and refused medical treatment. Officer Selig was able to speak to two witnesses of the accident. The witnesses were identified as Stephan Aparicio (Stephan) and Mikaela Rice (Mikaela). Stephan said he was behind the victim in the same crosswalk. Stephan stated he saw the Toyota stop in front of the crosswalk and then drove forward hitting the female. Mikaela stated she was parked in her motor vehicle on Centre St facing northbound (facing the crosswalk). Mikaela stated she saw the female walking halfway across the crosswalk and the Toyota continuing drive forward before hitting the female. Officer Siegel arrived on scene and took four photographs which was submitted with this report. Vivian was transported by Newton Medics to Faulkner Hospital for an evaluation. The pedestrian stated that he was more than half way across the cross walk when he was struck by a vehicle. The pedestrian stated that he did not see the vehicle until it was to late. Operator of MV#1 stated that she did not see the pedestrian crossing the cross walk until right before she struck him. Operator of MV#1 stated that as soon as she saw him she attempted to stop, but was not able to do so until after she struck the pedestrian. A witness at the scene stated that he was stopped in the west bound side of Commonwealth Ave allowing the pedestrian to cross. He stated that he saw MV#1 approaching the crosswalk and not stopping. He stated that he was not able to signal the pedestrian or operator of MV#1. The witness stated that he observed the pedestrian struck, and immediately got out of his vehicle to help. The pedestrian was transported to the hospital by medics. Pictures were taken of his injuries to be attached to this report. MV#1 was driven off scene. Pictures were take of the damage to MV#1. A citation was issued to the operator of MV#1.

On Tuesday November 12th, 2019 at approximately 1224 hours while working in N526 I responded to the intersection of Derby Street and Waltham Street for a motor vehicle vs. pedestrian accident. At the time of the accident the weather conditions were cloudy and rainy, and the road surface was wet. Both Derby Street and Waltham Street are public ways owned and maintained by the City of Newton. Upon arrival I spoke with the pedestrian identified as Helen Makadia (S35538182) who stated she was walking in the crosswalk on Waltham Street heading towards Derby Street when she was struck by MV1. Helen stated she was able to walk to the side of the road after impact but complained of knee pain. Medic 2 responded and Helen signed a patient refusal. Sgt. Lee transported Helen to the Franklin Elementary School where she was picking up her children and then she left on her own accord. The operator of MV1 identified as James Bond (S93760526) stated he was taking a left turn from Derby Street onto Waltham Street and did not see the pedestrian in the crosswalk until he struck her with his vehicle. James was very remorseful and acknowledged he was at fault. James reported no injuries and had no damage to his vehicle. I issued James in hand a Mass Uniform Citation #T2012435 for Chapter 89 Section 11 for failing to stop for a pedestrian in the crosswalk.

MV#1 was traveling south on Walnut St, and attempting to take a right turn onto Floral St. The pedestrian was crossing Floral St, south bound, in a cross walk. MV#1 hit the pedestrian with his passenger side mirror causing him to fall to the ground. I first spoke with the operator of MV#1. The operator stated he was making a right turn onto Floral St from Walnut St, and due to the heavy traffic he was moving at a slow pace. The operator stated that as he was making the right turn, he did not see the pedestrian in the cross walk. Operator stated that as soon as he heard his mirror hit something, he immediately came to a stop and went to go and check what he hit, and found that it was a pedestrian. I next spoke with a witness. The witness stated that he was walking behind the pedestrian. The witness stated that he observed the pedestrian begin to cross at the cross walk, and the truck make the turn. The witness stated that the truck was moving slowly as he made the turn. The witness stated that as he was making the turn, he observed the side mirror hit the pedestrian, knocking him over. I finally spoke with the pedestrian. He stated that he does not remember getting hit by the mirror of the truck. Multiple pictures were taken of the scene. MV#1 had no visible damage to the vehicle, but the passenger side mirror was pushed back against the door. The pedestrian was transported to Brighams by medics with apparent minor injuries. Due to the poor lighting conditions, the statments made that the vehicle was traveling slowly, and that the pedestrian was dressed in dark clothing, no citation was issued at this time.

On Monday, December 9, 2019, while assigned to Traffic unit N525, I responded to the intersection of Lincoln Street and Walnut Street, Newton for a report of a motor vehicle crash involving a pedestrian. The weather at the time of the crash was rain. The road surface was wet. Lincoln Street and Walnut Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Jill Edelson (S99137352). Edelson stated she was stopped in traffic while operating her 2012 Toyota Camry (MA: 81ZH83) Northbound on Walnut Street at Lincoln Street at a red light. Edelson stated the light turned green and she had a green left turn only arrow. Edelson stated she turned left into Lincoln Street from Walnut Street when the front passenger side of her vehicle crashed into a pedestrian in the roadway. Edelson stated she did not see the pedestrian prior to the impact. I observed damage to the lower portion of the passenger side windshield. Edelson reported no injuries. I spoke with the injured pedestrian, Lawrence Murren, at Brigham and Women's Hospital. Murren stated he had entered the crosswalk on Lincoln Street at Walnut Street and does not remember if he had the pedestrian signal. Murren believes MV1 did have the green light. Murren stated after he entered the crosswalk he looked back towards the "59 Bus". Murren stated he then looked forward and saw MV1 was in front of him. Murren stated he was unable to avoid the vehicle. Murren stated he has an injury to his hip and had a head laceration. I spoke with a witness to the accident, Edward Austin. Austin stated he was in the vehicle behind MV1 at the traffic light on Walnut street. Austin stated the traffic light turned green and MV1 had a green left turn arrow. Austin stated MV1 started to go and make their left turn. Austin stated he observed an older gentleman starting to walk out into the street. Austin stated the pedestrian had his head down and had an umbrella due to the rain. Austin stated the pedestrian also had a do no walk sign. Austin stated MV1 hit the crossing pedestrian in the crosswalk. Austin stated he does not believe either saw each other. Photos were taken of the area and submitted to the IT Bureau.

On 01/09/20 at approximately 13:30 hours, a pedestrian Scott Lorenz came in to the lobby of Newton Police Headquarters to report that he was struck by a motorist while crossing the intersection of Cherry & Webster Streets. This accident took place at approximately 13:00 hours on this date. Mr. Lorenz further stated that he was walking on foot and attempting to cross Cherry Street going eastbound at Webster Street. He says that he did not activate the cross walk signal but thought it was clear to proceed as Webster Street had a red light signal. While attempting to cross, he says that the westbound lane of Webster Street received a green light and MV1 proceeded to turn left on to Cherry Street from Webster Street. He then looked at the motorist and thought that she saw him. Once she kept approaching and realizing that he was not seen, he started to back track but was struck by the front end of MV1. Lorenz then tumbled back and fell down to the ground. He says that he got up feeling fine and alerted the motorist that he was struck. The two of them exchanged information and then left the scene with out notifying 911 of the accident. After, Lorenz then came in to Newton Police Headquarters to report it. I observed a small round swollen red mark to the inside of his right knee area and a red mark to the back left side of his neck. Digital photos were taken of his injuries. Mr. Lorenz declined medical attention and wanted this incident documented in case his possible injuries worsened. I then spoke to the operator of MV1, Sharon Pywell (MA S23277423), on the phone after. Pywell stated that she was operating her Toyota Prius bearing MA reg. # 2197RW on Webster Street facing westbound at Cherry Street waiting for the green signal to turn left on to Cherry Street. Once the light changed, she attempted to turn and never saw a pedestrian trying to cross Cherry Street. I asked her if she ever felt contact to which she replied that she was not aware that she ever struck someone. She further says that once she did see him, she believed that he never lost his balance or ever fell down. She says that he retrieved his backpack from the ground and approached her driver's side opening her door stating that he was struck by her.

On Monday January 13th 2020 at 1830, CHAN, Alyssa came into the front desk to report a past MVA vs pedestrian. At 1300, she was walking on Herrick Rd when she crossed by an entrance to a driveway by 17 Herrick Rd, when a vehicle pulled out and struck her. She states she was hit on her left side of her body and used her hand to brace herself against the car. The operator of MV1 asked her if she was ok, which she said she was, and then drove off. CHAN was later evaluated by her primary care physician, which advised her to monitor her wrist for any development of injury in the coming days. I spoke to the owner of MV1, who stated his son was driving the car today. Operator of MV1 stated he was pulling out of a driveway next to 17 Herrick Rd and looked both ways before pulling out, but did not see the pedestrian walking in front of his car. He states he got out and asked if she was ok, and she continued to walk away without talking. I did not observe any injuries on CHAN while speaking with her and she denied any further medical attention. No damage was reported on MV1.

On Sunday, March 1st 2020, at approximately 5:38pm, I, Officer Brooks, was dispatched to the intersection of Linwood avenue and Watertown street for a bicyclist struck by a MV. Upon my arrival I spoke with the bicyclist who stated she was traveling westbound on Watertown street, and was in the crosswalk at the intersection of Linwood avenue, when she was struck by MV1(MA REG67FD40), which had been traveling southbound on Linwood avenue. The bicyclist stated that the operator of MV1 did not come to a stop at the stop sign. The bicyclist was complaining of minor leg pain, but signed a patient refusal with Cataldo. The bicyclist was dressed in black pants, and a gray sweater, and was not wearing a helmet. The bicycle sustained damage to the handlebars. At the time of the accident the sun was setting, however the street lights had not yet come on. I then spoke with the operator of MV1 who stated she was traveling southbound on Linwood avenue, and was attempting to turn right onto Watertown street when she struck the bicyclist. The operator stated she never saw the bicyclist before the collision. The front of MV1 sustained minor damage. I was able to speak with a witness to the accident over the phone after clearing the scene. The witness stated that MV1 failed to stop at the stop sign at the intersection of Linwood and Watertown street, and that the bicyclist was already well into the crosswalk at the time of the collision. Officer Howes took pictures of the accident scene that have been submitted to the IT bureau. Based of the witness statements MA Uniform citation T2080576 has been mailed to the operator of MV1 for MGL C.89 S.11 Failing to yield for a pedestrian in a cross walk.

On 3/17/20 while working N493, I responded to the intersection of Auburndale Ave and Newell Rd for an MVA car vs pedestrian. On arrival I located pedestrian Stephen Dugas DOB 8/25/50 sitting in the middle of Newell Rd bleeding profusely from the top of his head, but otherwise consious/alert. The driver of the motor vehicle (MA reg 93Y880) was still on scene. He is identified as Ali Alnamos DOB12/10/59. While the medics were tending to Dugas I obtained a statement from Alnamos. He stated that he was driving on Auburndale Ave towards Lexington St and went to turn right onto Newell Rd. Upon turning, he made contact with the pedestrian with what he believes to be his passenger side mirror. Alnamos was distraught while speaking with me, and told me that he did not see the man. It should be noted that there is a clearly marked pedestrian crosswalk on Newell Rd, right at the location of this accident. There are street lights in the vicinity and Dugas was wearing darker clothing. Medic 2 transported Dugas to St. Elizabeth's due to his head injuy. I responded to the St E's ER Department and spoke with Dugas shortly after he was transported. Dugas reports that he was out for a walk on Auburndale Ave and was heading towards Auburndale Square. He went to cross Newell Rd and was hit by a vehicle shortly after entering the crosswalk. Dugas is not sure what part of the vehicle made contact with him but states that he did not go over the hood. Newell Rd intersects Auburndale Ave only on the westbound side. Several pictures were taken of the scene and have been submitted to IT. I did not observe any damage to the vehicle involved, therefore a tow was not needed. Alnamos stated that he was not in need of medical attention. Due to Dugas' statement at the hospital, I am mailing Alnamos MA citation T2079194 for 89/11 Fail to Yield to Pedestrian in Crosswalk.

The operator of the MV stated she was traveling westbound on Watertown St, and approaching the intersection of Watertown and Craft St. As she approached the intersection, the traffic light turned green and did not see a bicyclist in the crosswalk. Operator of MV1 struck the bicyclist on the front driver side of her vehicle. MV1 had a minor scratch on the driver side front bumper. The bicyclist stated he was in the crosswalk, crossing Watertown Street, heading toward Craft Street, northbound and the walking light was flashing as he was approaching the sidewalk. The bicyclist stated as he was approaching the sidewalk, while still in the crosswalk, MV1 struck the right side of his bike, knocking he and the bike over. The operator of the bike and the bike were then under the front driver side of the vehicle. The bicyclist stated the operator of the MV was not traveling fast but the impact still knocked him and the bike over. The bike was then stuck under the vehicle. Once he was off the ground, the operator of MV1 backed up her vehicle to get the bike out from under the vehicle. The bicyclist stated he had knee pain but the medics checked him out and he stated he was okay. The bicyclist was able to ride away on his bike after all proper paperwork and statements were gathered.

MV1 was operating westbound on Watertown St (public way). MV2 was parked on Watertown St in front of 144 Bridge St (public way). MV1 operator struck and side swiped MV2. MV2 sustained extensive damage. MV1 continued westbound on Watertown St and struck a cross walk sign and Newton Fire Department box which both in front of Coletti-Magni Park, and both were destroyed. MV1 hit and hopped the curb of Watertown St in front of Coletti-Magni Park, drove onto the side walk, and hit the fence of Coletti-Magni Park and damaged much of it. MV1 then came at rest on top of the Coletti-Magni Park fence and sustained extensive damage. MV1 operator stated he was not injured at this time and sign a patient refusal with Newton Medics. On Wednesday September 2nd, 2020 I responded to 341 Lexington Street for a report of a past motor vehicle accident involving a pedestrian that reportedly occurred around 12:25pm at the intersection of Commonwealth Ave and Lexington St. At the time of the reported incident the weather was cloudy/rainy and the road surface was wet. Both Commonwealth Ave and Lexington St are owned and maintained by the City of Newton. Upon arrival I spoke with the parent of the pedestrian identified as Tamika Olszewski. Tamika stated her daughter, Morgan Olszewsk, her twin brother Dean Olszewski and several friends took their bikes and went to Dunkin Donuts in Auburndale. Tamika stated when the group returned from Dunkin Donuts her daughter Morgan told her that she was hit by a car while crossing Commonwealth Ave. I spoke with Morgan and she stated she was in front of Dunkin Donuts and pressed the crosswalk button on the traffic light to cross over Commonwealth Ave. Morgan stated she crossed the street inside the crosswalk and noticed the crosswalk light signal was counting down. Morgan stated she heard a shrieking noise from a car slamming on the brakes and stuck hand out and touched a white car to keep her balance. Morgan stated she did not fall down or sustain any injuries. Morgan stated she continued across the street towards the picnic benches that are located in front of Starbucks. Morgan stated she then walked home and told her mother what happened. Morgan's only description of the vehicle involved was white car. Dean Olszewski and Ryan Poras stated they were at the picnic benches and left their bikes there and walked in the crosswalk to Dunkin Donuts to get some food. Dean and Ryan stated they then left the store and crossed back to the picnic benches where Deans sister Morgan was waiting. Dean gave Morgan some money so she could go to Dunkin Donuts and Morgan went and crossed the street alone and the next thing they saw was Morgan in front of Dunkin Donuts with an unknown woman with her arms around Morgan. Dean and Ryan stated Morgan crossed back to the picnic benches and when they asked Morgan what had happened she stated "nothing". Later Morgan then told Dean she was hit by a car. I spoke with an employee of Dunkin Donuts who stated he witnessed the entire incident. Kelvin Matovu stated he had groups of kids coming inside to get donuts around 12:25pm. Kelvin stated he witnessed Morgan with other children at the picnic benches in front of Starbucks. Kelvin stated he saw Morgan attempting to cross Commonwealth Ave with her helmet on and no bicycle with her. Kelvin stated Morgan pressed the crosswalk button on the traffic light at the intersection but stated she did not cross in the crosswalk and crossed directly in front of the stores windows which are not in line with the crosswalk. Kelvin stated he did not notice if she had the walk sign or not. Kelving stated as Morgan crossed into traffic she was rushing and stopped in the middle of the road where the two yellow medium stripes are and looked confused. Kelvin stated it seemed she was confused because cars were going past her in both directions and so she stopped in the middle of the road. Kelvin stated a female customer who was inside the store went out and made contact with Morgan when she finally crossed the street and made it to the front door of Dunkin Donuts. Kelvin stated he did not see a car make contact with Morgan or hear anything related to a crash. Kelving stated Morgan seemed confused and did not appear injured. Kelvin stated the female customer put her arms around Morgan to make sure she was okay. After the incident, Kelvin stated Morgan did not enter the store and went back to the picnic benches where the other children were located and they left northbound on Lexington Street. Kelvin stated the female customer came into the store and Kelvin gave the woman a free coffee for assisting Morgan. The unidentified female customer then left the area. Dunkin Donuts has no cameras that face the street. Officer G. Claflin spoke with the employees at Keys Drugstore and they stated they did have cameras facing the street and will contact the store manager who will contact the Traffic Bureau if the incident was caught on the camera. I advised Tamika that a report will be filed and if there is any development regarding the possible car involved I will contact her. Medic 2 was on scene and Tamika signed a patient refusal for Morgan. Morgan is a student at Burr Elementary School. While writing this report Tamika called and stated that Morgan remembered that the woman who assisted her after the collision walked her inside Dunkin Donuts.

On Tuesday, October 6, 2020, I received a call at approximately 2158 hours from Sgt. Devine of the Newton Police Traffic Bureau. Sgt. Devine stated there was a motor vehicle crash with serious injury that had just occurred at the intersection of Crafts Street and Waltham Street in Newton. Sgt. Devine stated that one of the parties involved had suffered life threatening injuries and was transported to Brigham and Women's Hospital. I responded to the scene and conducted an investigation of the crash with the assistance of Sgt. Devine and Captain Boudreau. Upon arrival it was reported to me by officers on scene that a party operating a motorized scooter on Crafts Street (E) had been struck by a 2007 Chrysler Town and Country (MA: 5EE316). The Chrysler was attempting to make a left turn from Crafts Street (W) onto Waltham Street (S). The operator of the motorized scooter, identified as Nadhir Tchikou (DOB: 11/23/1993), had suffered serious injuries to his head and left leg area and was transported to Brigham and Women's Hospital. It was reported to me that Officers Conary, Boyle, and Donovan were the first to arrive at the crash and provided life-saving care to Mr. Tchikou prior to being transported to Brigham and Women's Hospital. Officer Donovan responded to Brigham and Women's to keep us updated on Mr. Tchikou's status. The update provided to me while on scene was that Mr. Tchikou was in critical condition and in surgery. Due to the seriousness of the crash and potential fatal injury, Sgt. Devine contacted the Massachusetts State Police to assist in the investigation. Sgt. Mahoney and Trooper Paul responded as part of the Massachusetts State Police Crash Reconstruction team and conducted a supplemental investigation of the crash (MSP report 2020-CAR-000285). The location where the crash took place is Crafts Street and Waltham Street. Crafts Street and Waltham Street are public ways maintained by the City of Newton. Crafts Street and Waltham Street are municipal roadways that support two way travel for motor vehicles and bicycles with an unprotected median in the middle of both roadways to separate the direction of travel. This intersection was recently re-paved within the last month and has newly painted street markings including crosswalks, dedicated bicycle lanes, and stops lines at the intersections. Crafts Street at this intersection features two travels lanes. I observed the road surface to be dry at the time of my arrival on scene. The north lane in the westbound direction of Crafts Street permits travel straight ahead and also permits motorists/bicyclist to take a right turn onto Harding Street. The south lane in the westbound direction of Crafts Street is a dedicated left turn only lane that coincides with a left turn only arrow on the traffic signal in the middle of the intersection. The opposite side of Crafts Street permits traffic traveling in the eastbound lane to travel straight or take a left turn onto Harding Street from is a single lane travel lane. The area is well lit featuring street lights bright enough to illuminate the intersection for motorist traveling through the area. The weather at the time of the crash appeared to be clear. In the intersection where the crash took place, I observed a large debris field comprised of parts from a 2020 Tao Tao motorized scooter (49CC) and a 2007 Chrysler Town and Country (MA: 5EE316). I observed the motorized scooter (VIN: L9NTCBAG1L1010287) resting on its side facing North in the northbound lane of Crafts Street in the intersection. The motorized scooter has significant damage to its front, right, and left side and was inoperable. The area in the immediate vicinity of the motorized scooter was saturated with gasoline. The rear lights and dash of the motorized scooter were illuminated while I was observing the crash scene. The headlights were not intact due to the impact from the crash and I was unable to determine if they were functioning. The motorized scooter was removed from the roadway by Tody's Towing. The intersection where the crash took place had numerous first responders present immediately after the crash rendering aid to Mr. Tchikou prior to his transport to the hospital. It was reported by officers on scene that some of the items and debris in the intersection had been moved from their initial place of rest after the crash took place. A black MMG helmet was observed resting on the ground outside the debris field from the crash before the westbound left turn only lane of Crafts Street. It is unknown if it was moved from its initial place of rest by a first responder. I observed the strap on the helmet that would be used to secure it to the operator to be in good operable condition. I did not observe it to be defected and the securing feature of the strap was in working order. I did not observe any blood, hair, or other apparent physical evidence inside the helmet that would be consistent with the head injury reported to the operator of the motorized scooter. I observed what appeared to be fresh markings on the front mouth/nose area of the helmet. I observed a white Iphone with a red phone case lying on the roadway a short distance away from the impact area. The Iphone was on and displaying travel directions from the Iphone application Waze. The Iphone and the helmet were seized pending the status of the operator of MV2. A property/evidence form was completed and the Iphone and helmet were secured in property locker number 9. I spoke with the operator of MV1, William Moran (S34946215). Moran stated he was operating his white 2007 Chrysler Town and Country (MA: 5EE316) on Crafts Street (N) as he approached Waltham Street. Moran stated he had a green light and activated his left blinker as he approached the intersection with the intention of taking a left turn onto Waltham Street. Moran stated as he proceeded to take his left turn he saw "orange" and was unable to avoid hitting the object in front of him. Moran stated the object came out of nowhere and he swerved to the left in an attempt to avoid the crash. Moran stated after the collision he accelerated away from the impact area and came to a controlled stop on Waltham Street (S) just past the intersection. Moran stated he exited his vehicle and looked back at the intersection he had just travelled through. Moran stated as he began walking towards the intersection he observed a party laying on the roadway in the intersection. Moran stated the party was not wearing a helmet at this time. Moran also added that he believes the moped involved in the crash did not have its headlights on prior to impact. Moran stayed on scene and cooperated fully with officers during the investigation. A query of Moran's license and registration status through Newton Police Dispatched showed they are both active. I asked Moran if he was using a cell phone, GPS, or any other type of hand held device prior to the crash. Moran stated he was not. I asked Moran if he was distracted by anything either inside the vehicle or something on the roadway prior to the crash. Moran stated he was not. I asked Moran if he was currently impaired in any way that would impede his ability to operate a vehicle safely. Moran stated he was not. I asked Moran if he takes any medications or has a medical condition that would impede his ability to operate a vehicle safely. Moran stated he does not. Moran reported no injuries as a result of the crash. I observed Moran's vehicle at its controlled rest location. The vehicle was parked on Waltham Street (S) in the southbound lane just past the intersection of Crafts Street. The 2007 Chrysler Town and Country (MA: 5EE316) had substantial damage to the front passenger side bumper, hood, fender, windshield, and passenger door area. There was physical evidence of what appeared to be hair, blood, and tissue presumed to be from the operator of MV2 present in the cracked windshield, and on the passenger side door/mirror area. I observed a blue Commonwealth of Massachusetts "R" inspection sticker with a date of 05/28/2020 affixed to the windshield. Moran stated the rejection sticker was a result of an emissions failure. The inspection sticker expires in 2021. I asked Moran if there were any other mechanical issues with the vehicle. Moran stated there were no issues to his knowledge. I observed no objects present inside the vehicle during my investigation that would have potentially impeded the operators ability to see clearly through the windshield. I observed glass debris from the windshield inside the passenger and driver area of the vehicle. There was no air bag deployment inside the vehicle. Subsequent to my investigation, the vehicle was seized pending the status of the operator of MV2. The vehicle was towed from the scene by Tody's towing and secured in the Newton Police Department garage. The vehicle was escorted to the garage by Officer Donovan. A towed motor vehicle form was completed by Officer Donovan and the key for the vehicle was secured in property locker number 9. A property/evidence form was completed. Subsequent to my investigation Moran's black Alcatel cell phone was seized pending the status of the operator of MV2. A property/evidence form was completed and the phone was secured in property locker number 9. Officer Conary stated to me that prior to my arrival on scene she interviewed a witness to the crash and provided me with the following information. Joshua Hamel was operating his vehicle (W) in the right lane of Crafts Street towards Waltham Street. Hamel stated that MV1 (MA: 5EE136) was in the left turn lane on Crafts Street (W) towards Waltham. Hamel stated the scooter was headed eastbound on Crafts Street from Waltham. Hamel stated MV1 began to take a left turn and there was a head on collision with the scooter. Hamel stated he believed the traffic light at the time of the crash was green. On Friday, October 9, 2020, I spoke with Hamel via telephone. Hamel corroberated the statement he gave to Officer Conary. I asked Hamel if he believed the headlights on the motorized scooter were activated at the time of the crash. Hamel stated he believes the headlights on the motorized scooter were on as it approached the intersection but was not postive. On Wednesday, October 7, 2020, I spoke with Mr. Tchikou in his ICU room at Brigham and Women's Hospital. Tchikou's wife, Yami Carrajza, was present in the room while I spoke with him. Tchikou stated he had a significant head injury, injuries to his nasal cavity, his back, and a significant injury to his left leg. I asked Tchikou about his recollection of the crash. Tchikou stated he had just left his friend's home on Hazelhurt Avenue in Newton and was traveling home to Brighton to bring his wife dinner. Tchikou stated he was traveling Eastbound on Crafts Street as he approached the intersection of Crafts Street and Waltham Street. Tchikou stated he had a green light and as he entered the intersection a white vehicle took a turn from the opposite side of the road in front of him. Tchikou stated he does not remember anything after that. I asked Tchikou if he was wearing a helmet at the time of the crash. Tchikou stated he was. I explained to Tchikou that I recovered a white Iphone with a red case at the scene of the crash. Tchikou identified the Iphone as his. I explained that the phone was displaying travel directions when I found it and I asked Tchikou if he was distracted by his phone prior to the crash. Tchikou stated he was not distracted by the phone and the phone was in a holder on the motorized scooter. I asked Tchikou if he remembers if his headlights were activated on his motorized scooter at the time of the crash. Tchikou stated they were on. I asked Tchikou if he could produce paperwork for the motorized scooter to prove he was the owner. Tchikou stated he had recently purchased the scooter and the paperwork for it was at his residence. Tchkou's wife e-mailed me a picture of the Certificate of Origin for the motorized scooter. I asked Tchikou if he could produce a license or permit that would allow him to operate the motorized scooter. Tchikou stated he did not have a Massachusetts license or permit, but had an Algerian license at this residence. I was able to observe a picture of the license on his wife's cell phone. The written text on the license was in Arabic. Tchikou did not have a translation of the license in English and did not possess an International Driver's Permit. As a result of my investigation, Mr. William Moran while operating MV1 (MA: 5EE316) entered the travel lane of MV2 (Tchikou) as he was making a left turn onto Waltham Street from Crafts Street. MV2 had the right of way and MV1 failed to yield to MV2's right of way causing the collision to take place. Moran was advised of my investigation and issued Massachusetts Uniform Citation T0115914 via mail by request for Chapter 90, Section 8 (Fail To Yield To The Right Of Way At An Intersection.) Mr. Nadhir Tchikou operated his motor scooter at the time of the crash without a valid license/permit. Tchikou is also in violation of operation of a motor scooter after dark (prohibited). The crash occurred at 2147 hours. Tchikou will be issued Massachusetts Uniform Citation T0115915 in hand at Brigham and Women's Hospital for Chapter 90, Section 1E (Unlicensed Operation Of A Motor Scooter) and Chapter 90, Section 1E (Operation Of A Motor Scooter After Sunset - Hours Restriction.)

Operator of MV1 states he just left Wegman's where he works the overnight shift and was traveling home to 223 River Street. Operator of MV1 states he was traveling westbound on Commonwealth Ave and was going to take a right hand turn onto Lowell Ave when he doesn't know what happened and struck the concrete street light pole dislodging it from its base where it laid across MV1 and part of the roadway. It should be noted while speaking with the operator of MV1 there was a slight language barrier and he couldn't elaborate much on the events leading up to the crash. MV1 sustained heavy front end damage and air bag deployment. Medics were requested for an evaluation and found no signs of fatigue, impairment or injuries and cleared with a signed patient refusal. Coviello Electric was notified for the street light pole and the Newton Fire Department capped off the exposed wires from the base and it was taped off with caution tape. Tody's towing responded and removed the vehicle from the roadway. The operator of MV1 insisted on walking home from the scene.

Techler stated that he came to a stop at the stop sign at Walnut St and then turned left into the north bound lane of Walnut St. Techler stated that he did not see any on coming traffic , bicyclist or pedestrians in the roadway before he turned into the north bound lane of Walnut St. Techler stated that his vehicle's front bumper made contact with a bicycle ridden by Nicolas Le ( DOB 04/05/2006 ) . Le stated that he was stopped on his bike on the northeast corner of the intersection of Linwood Ave and Walnut St. Le stated that he saw a pedestrian latter identified as Jason Kaufman walking west bound in the crosswalk from the east side of Walnut St to the west side of Walnut St. Le stated that as Kaufman was crossing over Walnut St he assumed that it was clear to cross over Walnut St while riding his bike. Le stated that he was unsure if the yellow flashing crosswalk lights were activated. Le stated that he rode his bike off of the side walk at the northeast corner of Walnut St at Linwood Ave. Le stated that he did not ride his bike in the marked crosswalk that run from east to west over Walnut St at Linwood Ave. Le stated he rode his bike diagonally into the intersection towards the south west corner of the intersection. Le stated that he did not see Techler's vehicle prior to entering the intersection. It should be noted that at the time of the crash Le was wearing earphones and stated the he was listening to music. Le stated that he was not injured in the crash and signed a patient refusal from in the presence of his father Thanh Le who responded to the crash scene. Le's bike had damage to the front tire and front breaks. Based upon statments made to me by Le, Techler and my observations of the crash area, I believe that they both bear responsibility for the cause of the crash. Le was not in a marked crosswalk and was not sure if the flashing yellow crosswalk lights were activated. Le also was listening to earphones while crossing diagonally into the intersection. I issued Techler MA Unifrom Citation T2015904 and cited him for a violation of MGL 90/14 , failure to yield to a bicyclist while turing left.

The operator of MV#1 stated he was travelling southbound on Walnut St making a right turn onto Beacon St when he went over the curb (Snow mound) and struck a utility pole. The operator of MV#1 stated he suffers from a neurological medical condition and typically walks with a folding walker. He was evaluated by Newton Paramedics and signed a patient refusal of treatment. While he was speaking to the Paramedics, it was apparent that he was unstable on his feet but was able to walk on his own will. His portable walker was located in the back seat of his vehicle. He appeared to be of sound mind. His daughter in-law picked him up and drove him home. MV#1 sustained damages to its passenger side front wheel area. MV#1 was towed by Tody's Towing. The utility pole (Boston Edison pole #31/107) that was struck is located on Walnut St southbound at the intersection of Beacon St westbound. The pole sustained minor damages to its base. Traffic Officer took pictures of the damaged pole and Boston Edison was notified. Based on the statements made to me and the health condition of the operator of MV#1, I believe his continued operation would constitute an immediate threat to the public safety. A request for immediate threat of license suspension/ revocation form was completed and emailed to the R.M.V.

On Monday, March 8th 2021, at approximately 4:51pm, I, Officer Brooks, responded to the intersection of Washington street and Adams street for an auto pedestrian accident. The vehicle involved was described as a 4 door blue sedan and had fled the scene northbound on Adams street. The injured party was not able to provide any further description of the vehicle or operator, and no witnesses were present. I spoke with Traivon King who was the party that had been struck by the vehicle. He stated he was walking eastbound on Washington street, and had the cross walk signal to cross over Adams street. The blue sedan was traveling westbound on Washington street and turned northbound on Adams street ignoring the crosswalk signal. King stated he was struck on the right side of his body and knocked to the ground. The operator of the car stopped briefly and stated the sun had been in his eyes before driving away. King complained of pain to his right arm, and was transported by Fallon ambulance services to NWH. It should be noted it was day light, the weather was clear, and King was wearing a green plaid jacket, a plaid hat, and blue jeans. Due to the fact the vehicle had fled the scene and the victim was aready being tended to by the medics photos were not taken.

On March 16th, 2021 at approximately 08:56 hours while working N491 I responded to a report of a two car MV crash at the intersection of Centre St @ Centre Ave. On my arrival I located both involved vehicles. Vehicle #1 was a 2016 blue Toyota camry, MA tag 7HL412. The operator was identified as Renee Joseph. She stated she was on Centre St N/B and was attempting to merge out onto Centre Ave E/B when she was rear ended by vehicle #2. She reported having head and neck pain from the crash. However she declined medical attention at this time. Vehicle #2 was a 2020Toyota prius, MA tag 8ZZ382. The operator was identified as Jacob A Walker. He stated he was stopped behind vehicle #1 at the intersection of Centre St @ Centre Ave. As vehicle #1 began to enter out into the intersection he looked back to his left for oncoming traffic not realizing vehicle #1 has stopped again in front of him. He then crashed into the rear of vehicle #1. No tows were required from this crash. Operator #1 reported an injury but declined an Ambulance.

The operator of MV#1 stated he was travelling westbound on Homer St when MV#2 crossed over Homer St from Pleasant St and made contact with MV#1. MV#2 was observed travelling northbound onto Ashton Ave and leaving the area. MV#2 was described as a grey colored station wagon type vehicle. The operator of MV#1 stated the damages to MV#2 should be to its rear passenger side area. MV#1 sustained damages to its front bumper area. There were no reported injuries to the operator of MV#1. I spoke to the witness who was walking his dog on the sidewalk. The witness stated he heard the accident and observed MV#2 leave the intersection travelling northbound on Ashton Ave with flat tires. The witness provided me with MV#2's registration of 98WS56. The witness stated he was 100% sure he had the correct registration for MV#2. A query of MV#2 showed it had a local address in Newton MA. I arrived at this address and observed MV#2 bearing MA REG 98WS56 parked in the driveway. This vehicle fit the initial description of a grey colored station wagon type of vehicle. This vehicle had both of its passenger side tires flat and the hood of the engine was warm to the touch, indicating that the vehicle was recently on. I spoke to the owner of MV#2 and he stated he was driving in the area and just arrived home. The owner of MV#2 stated he did cross over on Homer St but did not realize he made contact with another vehicle. The owner of MV#2 stated he believed he struck a curb or a metal plate in the road which caused his front tire to go flat right after he crossed Homer St. The owner of MV#2 stated he was close to his home so he decided to drive home to deal with his flat tire. The owner of MV#2 stated he was unaware that his rear passenger side tire was also flat. MV#2 is an older vehicle with old damages throughout its exterior. The rear passenger side tire appeared to be misaligned and may have axle damage. The front passenger side tire was completely flat and had a huge slash to its sidewall. Based on the statements made to me I did not believe the operator of MV#2 was attempting to evade. All parties involved were provided with this accident report number and to contact their respective insurance providers.

Operator of MV1 stated he was stopped at the red light at Centre Street and Cabot Street facing southbound. MV2 was traveling Northbound, crossed into southbound lane of traffic and struck his vehicle, head on. After the collision MV1 spun out and rested in the southbound lane at Centre Street and Converse Ave. The operator of MV1 was transported to NWH for evaluation. After locating the operator who had walked away from the accident, the operator of MV2 stated he was traveling Northbound on Centre Street and struck MV1. After striking MV1, MV2 continued traveling and struck a stone wall, located at 709 Centre Street. Operator of MV2 stated he may have fallen asleep and would not go further into the how the accident occurred or what lead up to it. The operator and passenger both refused to see the medics, stating they were okay. I advised them multiple times it be best to be evaluated and they stated no. The operator of MV2 is also going to be charged with M.G.L. 90/24/A leaving the scene of personal injury and M.G.L. 90/24/C leaving the scene of property damage. MV1 and MV 2 sustained major damage to the front of the vehicles. Todys was notified and both vehicles were towed. Photos were taken of the property damage and submitted to IT to be added to the report.

On Friday, April 23rd 2021, at approximately 6:55am, I, Officer Brooks, responded to Chestnut street at Prince street, for an MVA pedestrian. Upon my arrival I spoke with an adult female who stated she was walking eastbound on Prince street and was attempting to cross Chestnut street. She stated she looked northbound and did not see anyone coming so she attempted to run across the street and was struck by a vehicle coming from her left. The pedestrian stated she was not in the cross walk, and that she was struck in the area of her left hip and thrown to the ground. She was not complaining of any injuries and refused to be evaluated by EMS. I noted the pedestrian was wearing a full body length purple coat and a winter hat. The operator of MV1(MA REG 9JYJ50) stopped to check on the pedestrian and left her phone number before leaving the scene. I was able to speak with the operator who stated she was traveling northbound on Chestnut street, and as she approached Prince street a female party ran out in front of her vehicle causing her to slam on the breaks. The operator stated she did not believe that she made contact with the pedestrian but that she did observe her fall to the ground. She stopped to check on the pedestrian who stated they were ok, and she provided her phone number to her. I explained in the future she would need to contact us immediately or she could be charged with leaving the scene of an accident, and she was unaware of all the information she needed to provide to the other party. The operator and the pedestrian were both provided the report number. Due to MV1 leaving the scene before my arrival photographs could not be taken.

On Monday May 10th, 2021 at approximately 0825 hours, dispatch sent units to the intersection of Eldredge Street and Vernon Street for a report of a road rage incident involving a crossing guard and a motor vehicle. When units arrived it was determined that the crossing guard who was performing her duties at the time of the incident, was struck by a motor vehicle that left the scene without stopping. I responded to the scene of the accident to conduct an investigation. At the time of the incident the weather was cloudy and the road surface was dry. Eldredge Street and Vernon Street are both public ways owned and maintained by the City of Newton. Upon arrival I spoke with the injured crossing guard inside the ambulance identified as, Margaret Monbouquette. Margaret was being treated by Fallon Medic 3 for leg pain. Margaret stated she was in the middle of the intersection holding her stop sign up as children and adults were actively crossing to get to the Underwood School. Margaret stated she had all three streets stopped when her attention was brought to the vehicle at the stop sign on Eldredge Street on the one way side. Margaret stated it kept inching forward into the intersection attempting to turn left. Margaret stated she still had people crossing at that intersection so she stepped in front of the vehicle and held up the stop sign directly in front of the vehicle and the female driver. Margaret stated she looked at the female driver and stated "No, stop" and that is when the driver started to yell back at her inside her vehicle but she could not make out what she was saying as her window was rolled up. Margaret stated the driver then tried to drive around her and struck her with the front passenger side bumper of the vehicle. She stated she was struck in her hip area which caused her to fall onto the street. Margaret stated the vehicle never stopped and sped up Vernon Street. Margaret described the driver as a slight female with dark hair driving a dark colored SUV. Margaret was able to provide a license plate of MA REG: 1XCS97. A query of the license plate through dispatch was able to provide an address of 74 Charlesbank Rd, Newton. Officers checked this address but got no response at the door and the vehicle was not located. A witness to the incident identified as Alicia Matos left her phone number and I was able to make contact with her over the phone. She stated she was in her motor vehicle stopped at the stop sign on Eldredge St, directly across from the vehicle involved. Alicia stated she was stopped because the crossing guard was in the intersection holding up her stop sign and was actively crossing children and adults. Alicia states she noticed the vehicle across from her kept creeping out into the intersection trying to take the left turn up Vernon Street. She states the crossing guard walked over to that vehicle and told her to stop and saw the female driver start yelling and pointing her hands at her inside the vehicle. Alicia states the crossing guard then backed up and was looking down at the drivers license plate when the driver drove at the crossing guard and struck her with her front passenger side and knocked the crossing guard to the ground. Alicia states the vehicle clearly made contact and did not stop and left the scene turning onto Vernon Street at a high rate of speed. Alicia states several people in the area came to the crossing guards aid and police and medics arrived shortly. Alicia described the driver of the motor vehicle to be a female with dark hair. The principal of the Underwood School, Suzie Talukdar was present after the accident and stated the secretary of the school received a phone call shortly after the incident from a grandparent of the school. The grandparent was identified as Dawn Coleman. Dawn stated her daughter was driving the vehicle involved and was having anxiety over the incident and didn't know what to do. Dawn identified the driver as Chelsey Sullivan (S83874401). I attempted to make contact with Chelsey at her residence of 74 Charlesbank Rd with negative results. The secretary was able to provide phone numbers for Dawn and Chelsey and I responded to the police station to attempt to make contact. While at the police station, I was notified that Chelsey Sullivan was downstairs in the lobby. I met with Chelsey and she stated the following: She was driving MA REG 1XCS97 a black Toyota Rav4 and was stopped at the stop sign on Eldredge Street the one way side. She noticed the crossing guard in the intersection holding up the stop sign but stated there was no one crossing at the time. Chelsey stated she started to inch forward and wanted to turn left onto Vernon Street as she was in a rush. Chelsey stated the crossing guard came right up to her vehicle and started shouting and holding up the stop sign in her hand telling her to stop. Chelsey stated she was yelling back at her stating that the cars behind her were going so she wanted to go too. Chelsey stated when the crossing guard started to walk away from her, she got very anxious and decided to take the left onto Vernon Street. She stated she saw the crossing guard stumble and fall to the ground but at no time did she think she made contact with the crossing guard. Chelsey stated she drove home and called her mother to tell her about the incident. Chelsey stated she wrote an apology letter to the crossing guard and has really bad anxiety and wasn't sure what to do. I advised Chelsey she needs to follow the crossing guards instructions when they are performing their duties no matter if she thinks the road is clear for her to enter/pass. Chelsey stated she understood and was also advised she will be getting a citation and summons in the mail. Chelsey took me to her vehicle where I took several photographs and submitted them to the IT Bureau. No damage was reported or observed. Massachusetts Uniform Citation 997066AA and criminal application was issued and mailed to Chelsey for Chapter 90 section 24 Operating to Endanger and Chapter 90 section 14 Failure to slow near pedestrian.

On 6/18/21 at approximately 0119 hrs Sgt. Fleming, Officer L. Keefe, and I, Officer Mildner responded to Sumner St @ Willow St. (public ways in Newton) for a report of a single motor vehicle crash. Upon arrival I noticed MA Reg: 8SP545 up on the sidewalk, air bags deployed, with heavy front end damage from what appeared to be from crashing into a tree. The operator was identified as Saurabh Korgaonkar, who was being evaluated by the medics and signed a patient refusal. I spoke with Korgaonkar and asked him what happened. As I began speaking to Korgaonkar I noticed he a strong odor of alcoholic beverage coming from his breath, glassy eyes, and slurred speech. Korgaonkar stated he was driving home from Brookline somewhere in the area of Commonwealth Ave. and Washington St. I asked Korgaonkar where he was specifically coming from and he stated "Abbey". I asked Korgaonkar if he had anything to drink while he was there to which he stated "two drinks". It should be noted Korgaonkar was unsteady on his feet and seemed extremely confused about what just happened. Given the damage from the crash, my conversation with Korgaonkar, and Korgaonkar's current state, I asked him if he was willing to perform Field Sobriety Tests. Korgaonkar stated he was willing to take the tests. I asked Korgaonkar if he wears glasses or contacts to which he stated "no". I asked Korgaonkar if he had any medical conditions that would affect his ability to take the tests to which he stated "no". I asked Korgaonkar if he felt comfortable in the shoes he was wearing to which he stated "yes". I brought Korgaonkar over to a clear spot on the side of the road on the fog line where the area was illuminated by the street light and cruiser spotlight. There were no blue lights on the cruisers. I used a field sobriety card I carry with me on my person to explain and instruct the tests. The first test I administered to Korgaonkar was Horizontal Gaze Nystagmus. I explained to Korgaonkar I was going to use a pen as the stimulus and to only follow it using his eyes only, not his head. Korgaonkar stated he understood the directions. The first attempt, Korgaonkar follow the pen using his head. I explained to Korgaonkar not to follow the pen using his head, but his eyes only. Korgaonkar stated he understood. The second attempt, Korgaonkar followed the pen using his head. I advised Korgaonkar again, to only use his eyes. On the third attempt, Korgaonkar followed the pen using his eyes only and I saw distinct nystagmus at maximum deviation and onset of nystagmus prior to 45 degrees. The second test I administered was the 9 Step Walk and Turn. I demonstrated the test for Korgaonkar and instructed him on how to complete the test. I placed my left foot on the fog line and right foot, heal to toe in front of the left. I demonstrated three heal to toe steps on the line, counting out loud, and keeping my hands by my side. Korgaonkar was advised to take 9 heal to toe steps, and then turn around and complete 9 more heal to toe steps. Korgaonkar stated he understood. During the test Korgaonkar did not place his heal to toe on steps 3,4,5. Korgaonkar almost fell over on the fourth step. Korgaonkar did not count out loud his steps and was using his arms for balance. On Korgaonkar's return, he did not count out loud again, almost fell to the side on step 6, was using his arms for balance, and stopped the test on his own at step 7. The third test I administered was the one leg stand. I explained to Korgaonkar the instructions and demonstrated the test for him. Korgaonkar stated he understood. I placed my hands by my side, feet together, raised my right foot six inches while looking at my foot, and counted 1001, 1002, 1003. I asked Korgaonkar if he understood, and not to stop counting until I told him to. Korgaonkar stated he understood. On the first attempt, I told Korgaonkar to start and he didn't lift a foot off the ground. On the second attempt, Korgaonkar lifted his left leg off the ground two inches, was looking straight ahead, and was not pointing his left foot. I explained to Korgaonkar his foot needed to be six inches off the ground, pointed, while keeping his eyes on his foot. On the third attempt, Korgaonkar dropped his left foot on 1004 and lost his balance on 1012. I concluded the test at 1020 counts. Based on my observations and Korgaonkar's performance on the field sobriety tests, I concluded that Korgaonkar had been operating a motor under the influence of alcohol. Korgaonkar was handcuffed (DL), searched, and placed in the rear of 496 where he was seat belted. The prisoner compartment was checked prior to and after transportation to NPD. Korgaonkar was booked by Sgt. Fleming and processed by Officer Ka. Donahue in the normal fashion. During booking, Korgaonkar was read his rights and asked if he wanted to take a breathalyzer test. Korgaonkar refused the breathalyzer test. Korgaonkar was notified his license was suspended, and his MA drivers licensed seized. Officer L. Keefe stood by and waited for Tody's to arrive and tow away the vehicle. A towed MV form was filled out and placed in appropriate mailbox. Korgaonkar was charged with the following: MGL Ch. 90 Sec. 24/J OUI Alcohol (Korgaonkar crashed his vehicle and failed field sobriety tests) MGL Ch. 90 Sec. 24/E Negligent Operation of MV (Korgaonkar failed to operate his vehicle in a safe manner) MGL Ch. 89 Sec. 4/A Marked Lanes Violation (Korgaonkar crossed the fog line, went onto the sidewalk, and hit a tree) Photo's of scene sent to IT. A court packet was filled out with all pertinent information and placed in the court prosecutors mailbox.

Vehicle #2 then proceeded to take the left turn onto Middle St prior to the collision with Vehicle #1. Roy complained of pain to her wrist area, but declined transport. After the collision, the operator of Vehicle #2, Mr James MacCormack exited his vehicle and began to walk over to Vehicle #1. He then fell over and struck his head on the pavement. As he was being treated by the medics, he stated that he suffers from diabetes, and hasn't checked his blood sugar in a while. The medics confirmed that his levels were off. He was then transported to Newton-Wellesley Hospital via Medic-5.

Narrative:
On 07/28/21 at 13:39 hours, I (Traffic Unit # 523) responded to 10 Cummings Road for a past hit and run motor vehicle bicyclist crash which occurred approximately twenty minutes prior. Dispatch updated units that the accident occurred at the intersection of Watertown and Walnut Streets and that a white colored SUV left the scene after striking the bicyclist. The white SUV was last seen heading southbound on Walnut Street towards Washington Street. The bicyclist then walked back home to 10 Cummings Road and told her mother about the incident. The mother then notified NPD. Watertown Street and Walnut Street are both public ways maintained by the City of Newton. It is a four way intersection with crosswalks on every side. There are no turn on red signs on every corner of the intersection. The weather at the time was partly cloudy and sunny and the road conditions were dry. On arrival at 10 Cummings Road, I spoke to the mother identified as Vanessa Cruz and her daughter, Angelique Cruz, who was involved in the crash. Fallon Ambulance was already on scene and a patient refusal was signed as Angelique did not have any injuries. I asked Angelique what had occurred and she stated that she left FA Day Middle School at approximately 13:00 hours. It is estimated that the crash took place between 13:10 and 13:20 hours. She was then bicycling down to the intersection of Walnut & Watertown Streets. She says that she pushed the walk signal button to cross the street at the crosswalk to continue southbound on Walnut Street towards Lowell Avenue. Once the cross signal light activated, she bicycled through the crosswalk. At the tail end of the crosswalk, her rear bicycle tire on the right side was struck by a white SUV making a right turn on to Walnut Street from Watertown Street. She was then knocked to the ground where she sustained a scrape mark to her left knee on her sweat pants. The white SUV continued southbound on to Walnut Street without stopping. She feels that the driver might of misjudged taking the right turn and never realized that she struck her. Angelique says she only saw a female operator in the SUV and could not determine the race or age. She also did not observe the registration on the vehicle. She further stated that a female assisted her up from the ground. Once she said she was fine she then proceeded home. No one else phoned 911 regarding the incident. At this point, I asked to see the bicycle which was stored away. The bicycle is a Schwinn Sidewinder 21 speed color black with lime green block style writing for the brand and model on it. Both tires have white reflectors attached to them. I observed no damage to the bicycle. At the time of the crash, Angelique stated she was wearing purple sweat pants, blue sweater, and no bicycle helmet. She was also carrying a black backpack attached to her rear shoulders. I took digital photos of Angelique along with her Schwinn bicycle. After, I went over to the intersection of Watertown and Walnut Streets and took photos of the scene. A canvass was also conducted that produced negative results. I observed no surveillance cameras on the buildings or residences that are near the intersection. At 109 Walnut Street, I spoke to several tenants in the six unit apartment complex and they have no security cameras. 583 Watertown Street has no cameras along with 592 Watertown Street. I also checked near the intersection of Walnut and Washington Streets as the white SUV was last seen heading in that direction. The Trio apartment complex along with other businesses are lined against both streets and have outside security cameras. I spoke to the leasing office and they stated that the cameras do not provide any coverage of the street area.

Operator of vehicle one Sara Kolaczyk stated that while turning right from Albemarle Rd onto Crafts St her vehicle's front drive's side quarter panel struck pedestrian Mariana Pishtikova in the marked crosswalk. Kolaczyk stated that she was looking to her left at on coming traffic on Crafts St and had began to turn right when crash occurred. Kolaczyk stated that she did not see Pishtikova before the crash. Pishitkova stated that she entered the marked crosswalk at Crafts St and Albemarle Rd after she saw that Kolaczyk vehicle had stopped. Pishtikova stated that she walked around the front of Kolaczyk's vehicle and it then turned into her at a very low speed. Pishtikova stated that the front drivers side quarter panel of Kolaczyk's vehicle struck her right side. Pishtikova stated that her right ankle was sore but refused medical treatment. Pishtikova signed a patient refusal form provided to her by Newton Medic Unit Three. I took photos of Kolaczyk's vehicle and the disk was downloaded by the NPD's IT bureau. Kolaczyk's vehicle had no damage and did not require a tow. Kolaczyk stated that she was not injured in the crash. I issued Kolaczyk MA Uniform Citation T2016945 and cited her for a violation of MGL 89/11 , failure to yield to a pedestrian in a crosswalk. Crafts St and Albemarle Rd are public ways in the City of Newton.

The pedestrian, identified as Yuanhua Wei stated that she was walking west on Derby St and attempting to cross Parmenter Rd in the cross walk when she was struck by MV#1. The operator of MV#1 stated that she was traveling east on Derby St and began turning left onto Parmenter Rd because in her words, she didn't observe the pedestrian. The operator stated as she turned through the intersection, she observed the front of her MV strike the pedestrian, the pedestrian dropped to the ground and the MV#1 pulled over to the right side of Parmenter Rd. When asked, the operator stated she were not distracted while operating her MV. When I arrived Mrs. Wei was sitting in the cross walk directly next to the north west corner of that intersection. When asked about her injuries, she stated her hip hurt, she showed me an abrasion on her right elbow/forearm and her lower body was sore. I also observed one of Mrs. Wei's sneakers was on the ground next to her. Mrs. Wei was sitting the entire tire time, did not appear to have any serious injuries and attempted to get up shortly after I arrived, but advised her to remain sitting. Paramedics evaluated Mrs. Wei for minor injuries at the scene and she chose not to be transported to a local hospital for her injuries. I did not observe any damage to MV#1, which the operator confirmed. I informed both parties that I was filing a crash report with charges pending.

On 09/19/2021 at 19:24 hours I responded to the area of 215 Needham St for a report of a motor vehicle crash involving a pedestrian. Needham St is a public way in the City Newton. Upon my arrival I spoke with Elemar Bayramov who stated that he and his aunt Sevda Nasirova were walking in the marked crosswalk in front of 215 Needham St . Baryamov stated that he and Nasirova were crossing from the west side of Needham St to the east side when Nasirova was struck by a car. Baryamov stated that Nasirova was struck on the right side and the impact caused her to land approximately 15 feet from the point of impact. EMS on scene stated that Nasirova had a broken right arm and had no recollection of the crash. Nasirova was transported via ambulance to the Beth Israel Hospital in Boston. Gulnar Shukurova stated that she was in the crosswalk with Nasirova and Baryamov and she saw a gray car " driving fast " hit Nasirova. I spoke with the operator of MA reg 6MT891 a 2017 Toyota Rav 4, Vladimir Beyninson ( DOB 01/22/1937 ). Bannon stated that he was driving north bound on Needham St when his vehicle stuck Nasirova. Bannon stated that he did not see anyone in the crosswalk. Beyninson stated that he was injured and his vehicle did not require a tow. Beyninson's vehicle had damage to the driver's side door, bumper and mirror. I took photo's of Beyninson's vehicle and forwarded the disk to the NPD IT Bureau. I also took a statement from witness William Rosensweig who stated that he was driving behind Beyninson and did not see him apply the breaks until the point of impact. Based upon statements made to me , I issued Beyninson MA Uniform Citation T2016956 and cited him for a violation of MGL Ch 89 Sec 11, failure to yield to pedestrian in a crosswalk. I also filed a request for immediate threat license suspension with the MA RMV.

On Tuesday, September 28, 2021 while assigned to Traffic unit N525, I responded to the area of Parker Street and Boylston Street for a report of a motor vehicle crash involving a pedestrian. The weather at the time of the crash was overcast. The road surface was dry. Parker Street and Boylston Street are both public ways in the City of Newton. The operator of the vehicle involved was identified as Mr. Viktor Gyuris (S12195708). Mr. Gyuris stated he was operating his 2012 Honda Odyssey (MA: 231EG9) on Parker Street (S). Mr. Gyuris stated he had a green light and proceeded to make a left turn on to Boylston Street (W) when a pedestrian walked into the front driver side fender area of his vehicle. Mr. Gyuris stated he observed the pedestrian at the last second and stated she was not in the crosswalk and was talking on her phone. I observed very minor damage to the front driver side fender/hood area above the front driver side tire. Mr. Gyuris reported no injuries. I spoke with the injured pedestrian, Ms. Marine Manukian (S20246517). Ms. Manukian stated she was crossing Boylston Street (W) at Parker Road (N) when she was hit by the front driver side of MV1. Ms. Manukian stated she was on her phone at the time of the crash and does not recall if she had the pedestrian signal to cross. Ms. Manukian reported injuries to her right hand, elbow, and both knees. Ms. Manukian signed a patient refusal with Fallon Medics and was provided a ride away from the area by the operator of MV1.

MV1 was travelling North bound on Parker St. while waiting in traffic MV2 had rear ended MV1. Operator of MV2 exited vehicle to assess damage, then proceeded to get back in his vehicle and leave. Owner and passenger of MV1 proceeded to step in front of MV2 to obtain his information, but MV2 proceeded to drive towards the operator of MV1. Passenger of MV2 stated he placed his hands on the hood of MV2's vehicle to block him from leaving. MV2 proceeded to drive around MV1 passenger and left the scene. The driver and passenger of MV1 described the operator of MV2 as an older black male, in his 70's, with a salt and pepper beard and short black hair and wearing a white t-shirt. Driver and passenger of MV1 are unsure if the operator of MV2 is under the influence, due to the operator appearing "dirty" and having "eyes really wide open." It was asked if they could smell alcohol on the man or if he walked unsteadily, which the reporting party stated "no." Driver and passenger of MV1 stated they were okay and did not sustain any injuries and declining medical attention. MV1 had minimal damage to the rear bumper consisting of scratches. A description of MV2 was given as a gray Honda Civic with a Connecticut license plate. Upon clearing the scene, I canvassed the area yielding negative results. State Police was also notified, due to the accidents close proximity to Route 9.

Narrative:
On 10/13/21 at 08:50 hours, I responded to Washington Street & Brookside Avenue for a motor vehicle accident involving a bicyclist. The weather at the time was clear and sunny (70 degrees) and the road conditions were dry. The accident location is a t type intersection with Brookside Avenue having a stop sign in order to turn onto Washington Street. Washington Street is a four lane road with a painted divider. There is no crosswalk at the intersection as it appears it was recently paved. On arrival, the accident scene was already clear as the bicyclist and his bicycle were waiting on the sidewalk. The motor vehicle involved was parked further back on Brookside Avenue away from the intersection. I spoke to the operator of the motor vehicle identified as Balarama Thavanati. He was operating a 2012 Toyota Camry color white bearing MA reg. # 44VN32. He states that he was operating southbound on Brookside Avenue and stopped at the stop sign at Washington Street. He was attempting to make a left turn onto Washington Street. He states that he inched out after because you can not see the vehicles approaching you. Next, a vehicle stopped on Washington Street to let him out and he thought it was clear never seeing the bicyclist on the right of him. He says the bicyclist approached him very fast and it appeared that he never stopped the bicycle prior to entering the street from the sidewalk. Once he attempted to pull out for the turn he then made contact with the bicycle on the left side. Thavanati pointed to the approximate location where the bicycle came to rest and it appears he was pushed forward approximately three feet from the impact. I observed black scrape marks on the right side of the front bumper which appear to be from the bicycle tires. At this time, the bicyclist, Jacob Harrison, was being tended to by Fallon Medics and Jacob's mother (Juliet Harrison) was already on scene. Jacob stated he was fine but since he was not wearing a helmet and hit his head on the pavement his mother had him transported to Newton Wellesley Hospital by Fallon Ambulance. After, I spoke to Jacob in the emergency room along with his parents. He sustained whiplash to his neck and a scrape to his right inner thigh area. I then asked him what had occurred during the collision. He states he was bicycling on the sidewalk eastbound on Washington Street. He says he stopped at Brookside Avenue and saw the Toyota Camry which was also stopped. He thought it was clear to proceed as if the vehicle was going to stay stopped. He then pedaled into the street and was struck by the Camry on the left side of his body. He fell down and he does not recall what else occurred as the incident happened so fast. The bicycle sustained damage to the front tire rim as it became bent. No other visible damage. At the time, Jacob was wearing black shorts and a white t-shirt with a red picture on it. He was not wearing a helmet and was going against the traffic on Washington Street. On scene there were three witnesses who were walking southbound on Brookside Avenue near Washington Street at the time of the crash. There names were Christine Butera, Marlene Austen, and Marta Travers. All three of them stated that the operator of the Toyota Camry was stopped on Brookside Avenue waiting to make the left turn. He then pulled out and in a split second the bicycle entered the intersection and was struck. They did not have the vantage point to see if the bicyclist ever stopped first before entering the roadway from the sidewalk. Digital photos were taken of the scene.

On October 14th, 2021 at approximately 12:59 hours while working N491 I responded to the intersection of Sargent St @ Waverley Ave for a report of a MV crash. On my arrival I located both involved vehicle parked on the other side of the intersection on Kenrick St. Vehicle #1 was a United States Postal Truck operated by a Liam Cunningham. He stated he was stopped on Sargent St/ E/B @ Waverly Ave for the traffic light/pedestrian walk light. He further stated there were two women walking across the street from the northeast side to the southwest side. His light turned green but waited until the women made it to the right of his truck. Operator#1 then began to make a left turn onto Waverely Ave when vehicle #2 who was behind his vehicle drove around him at the same time he began his turn causing the crash. Vehicle #2 was a 2021 Black Mazda C X utility, CA. tag, 8XDZ707, operated by a Edward Ramirez. He stated he was stopped behind vehicle #1/ UPS truck while the light was red. He then stated the light turned green but the UPS truck with its flashers on wasn't moving. Operator then assumed the UPS truck was stopped making a delivery and began to go around him. As he got to the intersection the UPS truck suddenly began to go forward attempting to make a left turn causing his vehicle to get struck by the truck as he 9vehicle #2) was attempting to go straight across the intersection to Kenrick St. Postal truck are government owned vehicle thus have no plates attatched and carry no registations/ insurance.

Operator of MV1 states he was traveling northbound on Walnut Street and entered the left turn only lane at the intersection of Walnut Street and Beacon Street. Operator of MV1 states while entering the left turn only lane, a pedestrian appeared from behind a car that was in the straight only lane and he struck her at a very low rate of speed with the front end of MV1. Operator of MV1 states the pedestrian said she was fine and kept walking across the street. Operator of MV1 states he pulled into the parking lot of the Walgreen's, got out of his vehicle and attempted to speak with the pedestrian again, which she waved him off stating she was fine and walked away from him. Operator of MV1 at this time left the scene believing the pedestrian was not injured. No damage to MV1. The pedestrian, Elizabeth Kennedy, states she was walking across Walnut Street (not in the crosswalk) when she entered the left turn only lane on Walnut Street and was struck by MV1. Ms. Kennedy states she hit the ground, but got back up and told the operator of MV1 she was fine and he left the scene. Ms. Kennedy complained of knee and elbow pain. Fallon Medics evaluated Ms. Kennedy and she signed a patient refusal, but stated she will have someone transport her to Tuft's medical center.

Narrative:
On Monday November 1st 2021, I responded the intersection of Cherry Street and Webster Street with several other units, for a report of a motor vehicle accident involving a bicyclist. At the time of the accident the weather was sunny and the road surface was dry. Both Cherry Street and Webster Street are owned and maintained by the City of Newton. While in route to the scene, units updated dispatch that the party was unconscious and not responding. Upon arrival I observed the bicyclist laying in the middle of the intersection being tended to by the medics. Medics on scene updated that the bicyclist was now conscious but was not alert and not responding to questions. Medics were able to locate a wallet and cell phone in his pocket and I was able to identify the bicyclist by his Mass License as Thanh Nguyen (S84815152). My first observations of the scene was that Mr. Nguyen was wearing a helmet at the time of the accident. I also observed his bicycle to be completely intact and the brakes functioning properly. The bicycle is a red Fifiel folding bicycle with a basket attached to the front. Inside the basket was a plastic bag containing recyclable cans. Also inside the basket was a bike lock and cable charger. Fastened on the handlebars of the bicycle with tape was a King meter reader. While the medics were preparing Mr. Nguyen for transport I spoke with the operator of the motor vehicle involved, identified by a Mass License as Jeffrey Carter (S21903831). Mr. Carter was visibly shaken up and very concerned about the bicyclist. Mr. Carter stated he was travelling eastbound on Webster Street and had the green light to cross over Cherry Street. He stated as he proceeded through, the bicyclist appeared out of nowhere very fast in the wrong lane and struck the front of his Ford F150 truck. Mr. Carter stated he immediately pulled over and tried to assist the bicyclist but he was not responsive. Mr. Carter stated he moved the bicycle to the side of the road to get it out of the way and waited for help to arrive. Mr. Carter stated his vehicle struck the bicyclist on his right side which caused him to fall to the ground and slide several feet. Mr. Carter stated the bicyclist did not come up onto the roof of his vehicle. He reported minor damage to the front grill and bumper of his truck. Mr. Carter stated he was not injured and signed a patient refusal on scene. His Ford F150 had minor front damage and was able to leave the scene. Sgt. Wade was on scene and speaking with a witness who was in the area walking her dog at the time of the accident. Kara Brewton stated she was walking on the sidewalk of Cherry Street, approaching Webster Street when she heard a loud pop sound. As she looked towards the sound she saw the bicycle and truck make contact and she remembers the red light was facing her on Cherry Street. Kara stated the truck had the green light and the bicycle had the red light at the time she heard and saw the crash. She stated she ran over to assist and dialed 911. She stated she observed the bicyclist with a helmet on at the time of the accident and he was not responsive. Several photos of the scene were taken and submitted to the IT Bureau. The bicycle was taken over to support services were it was logged into evidence for safe keeping. Property and evidence form was completed and submitted by Officer Gaudet. I responded to 223 River Street the residential address listed for Mr. Nguyen to notify his family of the accident but got no response. I was able to locate a phone number for his place of work who was able to provide me with his emergency contact information. I was able to leave several messages with his wife, daughter and sister. His daughter identified as Quynh-Chi Nguyen returned my phone call and was notified of the accident and that her father was transported to the Beth Israel Hospital in Boston. I provided her with my direct line and advised her to contact me with any questions. Later in the day, she contacted me back to state that her father was in stable condition and was going through a number of tests by hospital staff. I will be following up with Mr. Nguyen tomorrow after all his tests are completed. On Tuesday November 2nd, 2021 I was able to make contact with Mr. Nguyen's wife, Cindy Chau. Cindy stated her husband was ok and she was on her way to pick him up from the hospital. She stated she will have him contact me when he arrives home. I asked about his injuries and she stated he did not have any broken bones but wasn't sure and will contact me when they get home. Later that afternoon I attempted to make contact with Mr. Nguyen and was only able to leave a message. I am still waiting to hear back. On Friday 11/05/2021 I returned a phone call to Mr. Nguyen's daughter, Quynch-Chi who left me a voicemail. She stated Mr. Nguyen was home and all his test results came back negative. She stated she provided him with my contact number and he will contact me when he is feeling up to it. She also stated she believes Mr. Nguyen suffered some kind of head injury as he has wound on his head and does not remember anything about the accident. Quynch-Chi asked that I refrain from contacting her mother as she does not feel comfortable speaking to me since she does not speak English well. She asked that all communication go through her. She also asked for a copy of the report and I advised Quynch-Chi that I am still waiting to hear from her father so I can complete the report. I received a call from Mr. Nguyen a few minutes later. He was able to state that he doesn't remember anything from the accident except that he thinks when he went through the intersection the light changed from green to red. Mr. Nguyen also stated that the only other thing he remembers is waking up in the hospital. When asked about his injuries Mr. Nguyen stated he has a hard time breathing and his head, neck and legs are sore. I advised Mr. Nguyen that I will be adding his statements to the report and to have his daughter contact me if he needs anything further. Mr. Nguyen called me again to state that the accident happened because he was turning left and the driver was turning right. I informed Mr. Nguyen that based on the evidence and witness statements it appears that both him and the driver of the motor vehicle were travelling straight at the time of the accident and neither party were attempting to turn. Mr. Nguyen remained silent and just kept stating he was turning left and they were turning right. I advised Mr. Nguyen I will add his statements to my report to which he was satisfied.

On December 9, 2021, at approximately 1754hrs, while operating cruiser N495, I, Officer Dragone responded to the intersection of Beacon St and Grant Ave for a report of a motor vehicle accident involving a pedestrian. Beacon St and Grant ave are both public ways in the city of Newton. I spoke to a female party, later identified as Jennifer Diamond, who stated she was hit by a vehicle. Ms. Diamond was visibly shaken up but stated she was not injured. She stated that she was walking Eastbound in the crosswalk on Beacon St crossing the intersection of Grant Ave when she was lightly hit on the right side of her body by a motor vehicle, which caused her to fall to the ground. She stated the vehicle was taking a left onto Grant Ave from Beacon St. She stated the operator, later idenified as, Georgia Giannakopoulos got out of the vehicle to check on her. Ms. Diamond took a photo of the license plate (MA Registration 5SV474 ). Ms. Diamond states the operator then got into her vehicle and drove Northbound on Grant Ave. A witness, Andrew Greenberg, stated he saw a gray Honda CRV take a left onto Grant Ave from Beacon St and hit Ms. Diamond causing her and her dog to fall to the ground. While on the phone with dispatch, he gave the license plate of Massachusetts Registration: 5SV474 (registered to Georgia Giannakopoulos). He also stated, he saw the operator get out of the vehicle to check on Ms. Diamond and when traffic started to build up she became frantic and left, heading Northbound up Grant Ave. I then responded to the residence of Ms. Giannakopoulos. When asked what happened during the accident, Ms. Giannakopoulos stated she was in the car with her granddaughter and was in a rush because her granddaughter had to take a test. She stated she took a left onto Grant Ave from Beacon St when her granddaughter yelled and she hit Ms. Diamond who was in the crosswalk. She stated that she got out of the car to check on Ms. Diamond, who implied she was ok. Ms. Giannakopoulos stated she then went back into her vehicle to drive home and call the police. Ms. Diamond signed a patient refusal with Fallon EMS and was picked up by her parents. Georgia Giannakopoulos was issued in hand Massachusetts Uniform Citation# T1445617- Massachusetts General Law- Ch. 90 S. 24- Leaving the scene of a collision after personal injury. The operator of MV1 stated he was traveling on Centre Street, North bound, when he stopped while entering Washington Street due to on coming traffic. When he stopped at the intersection of Centre Street and Washington Street, MV2 struck the rear of his vehicle. The operator of MV2 stated she was traveling North bound on Centre Street, approaching Washington Street. The light was green and MV1 began to yield on to Washington Street when MV1 stopped. The operator of MV2 then struck the rear of MV1 with her front driver side bumper. When I approached MV1, I did not observe any damage to the MV. I spoke with the driver and passenger. Both parties stated they were injured. When I asked what was injured they stated "everything". I then asked for the drivers license and registration. He handed me his license without any sign of pain. I requested two ambulances for the driver and passenger. When I returned to give the operator his license back, he stated he was unable to raise his arm now. The passenger was able to walk out into the ambulance. The driver needed assistance by the medics. Due to both parties requesting to be transported, Tody's responded. The operator of the towed vehicle would not provide Tody's with the key to the vehicle. Dave, was still able to tow the vehicle and he secured the doors prior to transporting the vehicle. Inside the vehicle their was numerous blankets, clothing and DVD's. A black cell phone was left in the Centre console. The operator of MV2 was not injured and I observed very minor damage to the driver side bumper. I checked MV1 again for any damage to the rear bumper and did not observe any damage.

On January 26th 2022, at approximately 1730hrs, Operator 1, Matthew Walker, reported to the front desk of Newton Police Headquarters to report a hit and run that just occured at the Centre Ave and Centre St traffic circle in Newton Corner. Operator 1 stated that he was traveling around the rotary in the center lane to continue to travel Westbound into Newton. Operator 1 stated that vehicle 2 was in the left lane approaching the on ramp for the Massachusetts Turnpike Westbound when they crossed into their lane and side swiped their vehicle. I observed heavy damage along the driver's side door of vehicle 1. Operator 1 stated the registration plate of vehicle 2 was MA Registration: 2YTX47 and described it as a "Black Ford Focus;" that sustained damage along the passenger side doors. A query check of MA Registration: 2YTX47 on CJIS comes back on a black 2011 Ford Fusion, registered to "Nine Three Auto Exchange Inc," out of 221 Hancock St, Boston. An internet search of the company provided a phone number of 617-265-0158. An attempt to contact them was made, however, there was no answer and no voice mail set up. This accident report will be forwarded to the Traffic Bureau. Traffic Bureau update (Officer Gaudet): On Friday, January 28, 2022, I attempted to make contact with Nine Three Auto Exchange Inc with a negative result. A "Hit and Run" inquiry was mailed to their address in Boston.

On 01/27/2022 while working a detail for Feeney Utility Co, Lt Healy called over the air that he had just witnessed a motor vehicle pedestrian accident at his location and that no one was injured. On arrival I spoke to the pedestrian involved, Jinny Lin who stated he was walking northbound on Lowell Ave and was crossing Highland Ave in the marked crosswalk when he was struck by vehicle 1. Lin stated he was more than halfway across the street when he was struck. Lin said he was only bumped by the vehicle and was never knocked over. Lin had already notified his mother, Tina Chan who arrived on scene shortly after. Lin was seen by Fallon medics and signed a patient refusal. I than spoke to the operator of vehicle, Ali Roozbehani1 who stated he was traveling southbound on Lowell Ave and saw that it was blocked off and detoured down Highland Ave due to road construction. Roozbehani said he was slightly blinded due to solar glare as he made a left turn onto Highland Ave and as he did so struck a pedestrian. Roozbehani had no damage to his vehicle and was uninjured. I took several digital images of the scene and submitted them to IT to be attached to this report. Roozbehani was issued MA Uniform Citation #T2016735 for 89/11 pedestrian in a crosswalk.

On Wednesday, February 16, 2022, while assigned to Traffic unit N525, I responded to the intersection of Cabot Street and East Side Parkway for a report of a motor vehicle/bicycle crash. The weather at the time of the crash was clear and sunny. The road surface was dry. Cabot Street and East Side Parkway are both public ways maintained by the City of Newton. I spoke with the operator of MV1 (2016 Mazda CX3, NY: JNB6711), Mr. Tushar Singhal (NY: 287647610). Mr. Singhal stated he was operating his vehicle on Cabot Street (E) towards the East Side Parkway intersection. Mr. Singhal stated he came to a complete stop at the stop sign on Cabot Street. Mr. Singhal stated he did not see any vehicles or pedestrians in the area at this time. Mr. Singhal stated he proceeded to travel through the intersection from his stopped positon and take a left turn onto East Side Parkway. Mr. Singhal stated at this time a bicyclist crashed into the passenger side of his vehicle. Mr. Singhal stated the bicyclist then fell over his hood and onto the roadway. Mr. Singhal reported no injuries from the crash. I observed damage to the front passenger side door, mirror, fender, and hood. Sgt. M. Wade spoke with the injured bicyclist, Keiji Imai, while he was being evaluted by Newton Medics. Mr. Imai stated he was operating his Trek bicycle on Cabot Street (W) towards the East Side Parkway intersection. Mr. Imai stated he was on the sidewalk and entered the intersection with out stopping. Mr. Imai stated he crashed into the side of MV1 and fell to the roadway. Mr. Imai was transported to Newton Wellesley Hospital with minor injuries to his left wrist and rear. Keiji was wearing a helmet at the time of the crash. I observed the helmet to have no fresh damage or defects. Photos were taken of the helmet to document it's condition. Keiji's father, Koguke Imai, was made aware of the crash involving his son and stated he would respond to the hospital. I observed no substantial damage to the Trek bicycle. I transported Keiji's blackTrek bicycle to Keiji's residence. I spoke with a witness to the crash, Ms. Madison Albano. Ms Albano stated she was walking her dog on Cabot Street (E) on the Northbound sidewalk at the East Side Parkway intersection. Ms. Madison Albano stated she observed MV1 approach the intersection to her right side on Cabot Street (E) and come to a stop at the stop sign. Ms. Albano stated she then observed MV1 make a left turn onto East Side Parkway and she heard a crash. Ms. Albano stated she observed a bicyclist crash into the passenger side of MV1 and then fall to the roadway. Ms. Albano stated she did not see the bicyclist prior to the crash and does not know if he came off of the sidewalk or was in the roadway. After speaking with all involved parties, I have summized the following. As MV1 was completing his left turn onto East Side Parkway (N) from Cabot Street (E), the involved bicylist failed to yield at the stop sign while traveling on Cabot Street (W) across the intersection. The bicyclist entered the intersection with out yielding and crashed into the passenger side of MV1. MV1 had the right of way. No citations will be issued as a result of this crash. Photos were taken of the scene and submitted to the IT Bureau. Keiji is a student at Newton North High School.

On 04/08/2022 at 1454 hours while assigned to unit N524 I responded to the area of Hammon St and Priscilla Rd for a report of pedestrian that had just been struck by a motor vehicle. On arrival the pedestrian was already being treated by Fallon medics for minor injuries. I spoke to the operator of the vehicle, Gunter Heinrich who stated he was traveling southbound on Priscilla Rd and stopped at the stop sign at Hammond St. He then proceeded forward turning left onto Hammond St where he struck pedestrian crossing the street. Heinrich reported no injuries and no damage to his vehicle. I then was able to speak to the pedestrian involved who was identified as Emily Singley. Singley stated she was walking eastbound on Hammond St just past Priscilla Rd and saw vehicle 1 stopped at the stop sign so she believed it was safe to cross. As she was crossing she noticed vehicle 1 come at her and had no time to react. She was struck by vehicle 1 and knocked backwards onto the pavement. Singley had scratches to her left arm/elbow and believed she bumped her head but signed a patient refusal with the medics. Where Singley crossed there was no crosswalk but there was a curb cut in the sidewalk for pedestrians. Singley was about half way across the road when she was struck. Based on the statements given by the involved parties I issued Heinrich MA Uniform Citation #T1448567 in hand for 90/18A Failure to yield for a pedestrian. Heinrich is here from Austria visiting his daughter (the vehicle owner) and was operating on an Austria drivers license.

On 04/20/2022 I was notified of a motor vehicle accident involving a pedestrian that was reported to Lasell University PD. I spoke to Lasell PD Officer Gilfoy who stated the accident happened on 04/19 sometime between 2130 and 2200 hours and that the pedestrian involved had just reported it to their office. Officer Gilfoy faxed over a copy of their report (report #22-0316). Andrea Simms reported to Lasell PD that on 04/19/2022 between 2130 and 2200 hours she was walking down Woodland Rd and was about to cross Lake Ave when her attention was drawn to a vehicle parked on Lake Ave. She said it looked like the vehicle was waiting to back out of Lake onto Woodland and she waited approximately 1 minute before crossing behind the vehicle. As Simms crossed the vehicle backed up and struck her left knee/thigh. Simms walked over to the passenger side of the vehicle and spoke to the operator who was very apologetic and stated she did not see her. Simms then left the area and did not think to report it until she was advised to the next day by another student. The vehicle operator was identified as Nicole Catania. Catania stated she had just dropped a friend off on Lake Ave and was waiting for traffic on Woodland Rd to go by before she backed out onto the street. As she backed out she heard what sounded like someone hitting her trunk with their hand. Catania stated that a party then came to her passenger side window and Catania stated that Simms never said she was struck but Catania still apologized and told her she never saw her. Simms replied "OK" and walked off. Catania never reported the incident because she did not believe there was anything to report. In the report I received from Lasell it stated that they had reviewed CCTV from Karandon House that showed Catania backing up and stopping to allow a passing vehicle to continue on Woodland. Simms is then observed crossing behind Catanias vehicle as it stopped for the other vehicle and it could not be determined if she was struck or hit the trunk with her hand. Simms can be seen speaking to Catania through the passenger side before walking away.

On Wednesday, 6/29/2022, at approximately 1630 hours, I, Ofc Murphy was dispatched to the intersection of Craft St and Washington St for a MVA involving a pedestrian. Upon arrival, I spoke with a witness, Ms. Tunde Kovacs. Tunde stated she observed MV 1 taking a right turn from Craft St onto Washington St. Tunde stated she also observed an unknown pedestrian attempt to cross the cross walk on Washington St at this intersection without the cross walk light. When MV 1 took the turn he struck the unknown pedestrian. Tunde further stated the pedestrian got into MV 1 with the Operator. Tunde provided the plate of the vehicle, MA reg 387RK5. Tunde also stated the pedestrian was wearing tan pants with a gray short sleeve t shirt. I was able to make contact with the driver of MV 1 via telephone. I spoke with Mr. Santos Hernandez. Santos stated he took the right hand turn from Craft St onto Washington St and did not know anyone was in the cross walk because the cross walk light was not on. Santos struck the unknown pedestrian while making this turn. Santos further stated the pedestrian was ok and just wanted a ride home. Santos stated he brought him home to his address in Belmont. Santos was able to provide a phone number for the unknown pedestrian. There was no damage to MV 1. I spoke with the pedestrian, Mr. Ashley Jeremy. Jeremy stated he was attempting to cross Washington St at the intersection of Washington and Craft St in the cross walk southbound when he was struck by MV 1. Jeremy stated he didn't believe he was badly hurt on scene and just wanted a ride home from MV 1. Jeremy further stated he is unsure if he used the cross walk light but he thinks he "probably didn't." Jeremy stated he has a small cut on his back and his right leg is a little sore. Jeremy further stated he might go to the doctor on his own accord to get evaluated.
