The operator of Vehicle #1 stated that he stopped, prior to proceeding through the Stop Sign Southbound at Lewis St, and Newtonville Ave prior to colliding with the bicyclist. The bicyclist stated that he was travelling Westbound on Newtonville Ave prior to colliding with Vehicle #1. Vehicle #1 was cited for a violation of M.G.L. Ch.89/S.9-Stop Sign. It should be noted that the bicyclist was wearing a helmet, and a rear flasher, however wore no other bright, or reflective clothing. All parties declined medical attention. Pictures of the scene were taken by me, and placed in the IT box.

Narrative:
On Friday March 15th 2019 at approximately 0730 hours I responded to the intersection of Beacon Street and Herrick Road for a report of a hit and run involving a bicyclist. The weather at the time of the accident was cloudy and the road conditions were dry. Both streets are public ways in the City of Newton. Upon arrival I observed the victim identified as Glenn Butcher (MA OLN S36552335), inside the ambulance getting medical attention. Butcher was getting a bandage applied to his left leg and complained of leg, back and neck pain. Butcher appeared visibly shaken and in pain. Butcher stated he had the green traffic light and was travelling eastbound on Beacon Street crossing Centre Street and then continuing straight crossing Herrick Road. Butcher stated MV1 was travelling westbound on Beacon Street and took a left turn onto Herrick Road and collided into his bicycle. Butcher states upon impact he flipped over his bicycle and landed on the hood of MV1, before rolling off and landing on the ground. Butcher states he was wearing his helmet which was present. Butcher states his bicycle ended up partially under MV1. Butcher states the operator of MV1 pulled his vehicle to the side of the road and got out of his vehicle and spoke to several witnesses briefly. Butcher states the operator then left the scene without properly exchanging information and did not wait for the police to arrive. Butcher described the vehicle as a dark gray Honda, and described the operator as an older white male, 5'10 approximately 80 years old with white hair. Butcher was also able to provide an email address for another bicyclist who witnessed the accident. The witness left his information with Butcher prior to my arrival. Fire fighters on scene were able to get the registration number of the vehicle from the witness (MA REG 4CX148) and gave it to Officers on scene. Butcher was transported by Medic 1 to NWH with minor injuries. His bicycle had visible damage to the frame area and skid marks were present on both tires. 19 photographs of the scene and the bicycle were taken and sent to the IT dept. email. Officer Gabriel transported the bicycle to the station where it was logged into Property & Evidence for safekeeping. Dispatch was able to query the registration which came back to a gray, 2010 Honda Accord registered to a Matthew Sugarman (MA OLN S38601397), out of W. Roxbury. Dispatch contacted the Boston Police Dept. and had them send an Officer to the address to try to make contact with Sugarman. Sugarman was advised to contact the Newton Police Dept. and I was able to speak with him on the telephone. Sugarman states he was driving the vehicle today and was involved in an accident with a bicycle. Sugarman states he was travelling westbound on Beacon Street and was taking a left onto Centre Street not Herrick Road. While speaking with Sugarman he seemed confused as to his location during the accident and was adamant that he was turning left onto Centre Street and not Herrick Road. I advised Sugarman that I was on scene with the first responding Officers and the accident clearly occurred at the intersection of Beacon Street and Herrick Road based upon the final resting place of the bicycle. Sugarman went on to state that his vehicle was already turning when the bicycle struck his vehicle and he believed it was the bicyclists fault. I advised Sugarman it appears the bicyclist had the right of way since it was traveling straight and that because his vehicle was taking a left turn, he failed to yield for on coming traffic at an intersection. When asked why he did not stay at the scene of the accident Sugarman stated he got out of his vehicle and spoke to the bicyclist and he "seemed okay". Sugarman states he then left the scene while the victim was still sitting on the ground. I asked Sugarman if he had ever been involved in accident before and he replied "no." I advised Sugarman that I am currently looking at his drivers history and see nine accidents that he was involved in. Sugarman stated "he has never been in accident like this before." I then asked Sugarman what the law states when you are involved in an accident and he was not able to provide me with an answer. I advised him that the law states you must stop and exchange information before leaving the scene of an accident. Again he stated the bicyclist seemed okay and "he had somewhere to be so he left." Sugarman has an extensive drivers history including nine surchargeable accidents, reckless operation, two different charges of leaving the scene property damage and two immediate threat affidavits filed against him. I advised Sugarman that I will be mailing him a citation for Ch89 s8 Fail to yield to oncoming traffic, and Ch90 s24 Leaving the scene of personal injury. I also filed an immediate threat form with the registry. I emailed the witness using the information he provided to the Newton Fire Dept that was on scene and received a phone call back from the witness identified as Bruce Adams. See witness report for his statements. I contacted the Bank of America located at 808 Beacon Street in Newton, as they are the closest business to that intersection with video surveillance. I spoke with George Walsh (781-834-8275) who stated they do not have any working cameras on that side of the building to the bank. For this report the bicyclist is entered as a non-motorist for validation purposes. Witness Bruce Adams (MA OLN S96398108) stated that he was riding his bicycle travelling behind the victim about 100 feet away. Adams states he was watching the victim and had a clear view of him as he travelled behind him, through the green traffic light heading eastbound on Beacon Street. Adams stated he witnessed MV1 travelling westbound on Beacon Street take a sharp left turn onto Herrick Road which turns into Union Street. Adams stated that the vehicle turned left colliding into the bicycle and there was no possible way the bicyclist had time to stop to avoid the collision. Adams stated the victim flew over his handle bars and fell on top of MV1's hood and then landed on the ground. Adams stated the victim's bicycle was stuck under MV1's front bumper. Adams stated the operator of MV1 backed his vehicle up with the bicycle still attached to his vehicle bumper and pulled MV1 over to the side of the road. The operator then got out of his vehicle and walked up to the victim who was laying on the ground visibly in pain. Adams stated the operator asked the victim if he was okay to which the victim did not immediatley reply as he was visibly shaken up. Adams stated the operator then walked back to his vehicle and attempted to leave the scene and that is when Adams stood infront of MV1 to stop him from leaving the scene. Adams stated he then removed the bicycle from underneath the bumper of MV1 and placed it on the side of the road. Adams stated the operator got out of his vehicle again and walked up to the victim and asked him "what do you want to do?". Adams stated the victim did not respond and that is when the operator got back into his vehicle and drove away, leaving the scene before any emergency response arrived. Adams stated he was able to memorize MV1's registration and stayed with the victim until police, fire and medics arrived. He stated he gave the fire dept the registration and his contact information prior to leaving the scene.

The operator of vehicle 1 stated that with a green left turn arrow showing, and her left directional on she went to turn onto Waltham Street from Crafts Street when all of the sudden she hit a bicyclist. She stated she did not see the bicyclist at all prior to him hitting her car. The bicyclist stated does not remember anything from the accident at this time. The bicyclist was traveling southbound on Crafts Street and appears to have entered the intersection of Crafts and Waltham Street without stopping and while a red light was showing. He was wearing a helmet at the time of the crash, he was not wearing any reflective clothing(dark green jacket), and the bike did not have any lights. The bike was taken to support services for safe keeping by Ofc. J.March. Vehicle#1 was towed away by Tody's towing due to extensive damage. Bicyclist was transported to Beth Israel hospital for several trauma injuries. Pictures of scene was taken by me and sent to IT Bureau. Both witness's statements were the same. They stated that they were behind vehicle 1 in traffic and saw that she had on her left dirrectional signal and had a green left arrow signal when vehicle 1 went to turn left onto Waltham Street.

Narrative:
On Wednesday, April 10, 2019 while assigned to Traffic unit N525, I responded to the intersection of Centre Street and Wesley Street, Newton for a report of a motor vehicle accident involving a bicycle. It was also reported that the parties involved were arguing with each other. The weather at the time of the accident was cloudy and the road surface was dry. Centre Street and Wesley Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Abdulaziz Stewart (S04075169). Stewart stated he was operating his 2017 Toyota Camry (MA: 669FM3) at the time of the accident. Stewart stated he came to a stop on Wesley Street (E) at Centre Street and was attempting to take a left turn onto Centre Street. Stewart stated there were no vehicles in the Southbound lane of Centre Street and there was a vehicle stopped in the Northbound lane of Centre Street motioning to him to take his left turn. Stewart stated as he began to start his left turn, a bicyclist crashed into the front passenger area of his vehicle. Stewart stated the bicycle had been traveling Northbound on Centre Street in the Southbound Lane. Stewart stated after the collision the bicyclist was yelling at him and called him a "Nigger". Stewart and his occupant, Miriam Stewart, reported no injuries. Miriam is a student at Bigelow Middle School. I observed minor damage to the front passenger quarter panel area of MV1. I spoke with the bicyclist involved in the accident, Timothy Murtagh (S49233464). Murtagh stated he was traveling Northbound on Centre Street on his Cannondale bicycle in the Southbound lane. Murtagh was not wearing any safety equipment while operating his bicycle (helmet) and was wearing a dark red jacket. Murtagh stated as he approached Wesley Street, MV1 "jammed on the gas" and hit him in the roadway. Murtagh stated he then fell to the ground and landed in the middle of the street. While speaking with Murtagh I told him it was reported to me by the operator of MV1 that he used a racial slur during their interaction. Murtagh acknowledged that he did and stated, "I called him a nigger". I observed moderate damage to the front wheel/rim of Murtagh's bicycle. Murtagh reported no injuries. Murtagh was advised and issued Massachusetts Uniform Citation T1443441 for Chapter 85, Section 11B (Fail to ride on the correct side of the roadway). Photos were taken at the scene and submitted to the IT Bureau. Due to the language used by Murtagh during his exchange with Stewart, Officer Rosenbaum of the Community Services Bureau was made aware of the incident for follow up.

Operator 1 of MV 1 was stopped on Brookline St (E/B) to take a turn onto Ober Rd. A vehicle had let Operator 1 turn onto Ober Rd and while turning a Bicycle struck the passenger side of her vehicle causing minor damage. No injuries to Operator 1 or Passenger of the vehicle. No tow needed and no citation issued. The operator of the bicycle was traveling (w/b) on Brookline st passing the cars on the right side. The bicycle did not see that there was a vehicle stopped in traffic allowing MV 1 to turn onto Ober Rd. Minor injuries to the operator of the bicycle on hands and his right knee. Medics responded and got a signed patient refusal. Pictures were taken of the vehicle, operator of the bicycle and turned into IT for attachment to the report.

The OP. of MV#1 states she was travelling on Beacon Street eastbound with a steady green light and was making a right turn onto Chestnut Street. That's when there was a collision with Bicyclist#1. Bicyclist#1 was travelling eastbound on Beacon Street and approaching the intersection of Chestnut Street. He noticed a non-involved vehicle in the intersection stopped there trying to make a left turn. He observed MV#1 slowly moving around that vehicle and thought MV#1 was going to continue going straight on Beacon Street so he pedaled through. That's when MV#1 was actually making a right turn and they collided together. Bicyclist#1 sustained some mouth injury and unknown bodily injuries. His bicycle sustained some damage to the front wheel and right handle bar. He signed a patient refusal with the medics. The OP. of MV#1 gave Bicyclist#1 a ride and transported his bicycle home. Several pictures were taken of the damaged bicycle. No new damage seen on MV#1 to determine impact location.

Bicyclist was traveling west on Beacon St coming down the hill towards Hobart Rd. He stated that he started braking when his light turned yellow and his brakes malfunctioned and he could not stop before Hobart Rd traffic got a green light. He struck the rear quarter of a red Toyota SUV that came out of Hobart Rd. The MV did stop and check on the bicyclist. The operator took out a video camera and recorded the bicyclist admit that the MVA was his fault. They did not exchange information and the operator stated that he could not wait for police to arrive. The bicyclist signed a medical refusal. Pictures were taken by me of the damaged bicycle. According to the bicyclist, there was no damage to the MV.

Bicyclist was traveling north on Grant Ave with traffic on the right side of the cars. He was intending on traveling straight across Comm Ave. The unknown silver BMW who was traveling next to the bicyclist turned right onto Comm Ave eastbound and struck the bicyclist with rear right part of the car. The BMW continued east on Comm Ave. The bicyclist was knocked from his bike and sustained minor cuts to his legs. His bike was not damaged. Bike One was travelling Eastbound on Auburndale Ave when it appeared the operators front tire came in contact with a slightly raised manhole cover causing the operator to fall off his bike and impact the roadway. The cyclist was wearing a safety helmet but received a laceration around his eye and several lacerations to his arms and legs. He was transported to Beth Israel Boston. I spoke to the bicyclist who was unsure of how the crash occurred. I contacted his brother, Paul Colangelo (603 434-1251) who was advised of the incident. Photos were taken of the crash scene and emailed to the IT Bureau. I placed his bike into support services for safekeeping.

The operator of MV1 stated he was taking a left onto Waldorf Rd. Westbound from Canterbury Rd. when he saw a child bicyclist traveling Eastbound on Waldorf Rd. in the street. He stated that immediately after, the solar glare from the sun impaired his vision and he could no longer see the child, and at that time the two collided. The left driver's side door area struck the bicyclist, as well as the possible front left tire. The operator and passenger stated they were uninjured. MV1 sustained little to no damage. The bicyclist was identified as CHO, Elena, and she stated she was traveling Eastbound on Waldorf Rd. approaching Canterbury Rd. She stated MV1 took a left onto Waldorf Rd. towards her and at that time she collided with the left side of MV1 and fell off her bike. The rear wheel of the bike was bent due to the collision. Elena stated that she was ok but had right hip pain. She was wearing a helmet, green jacket, blue shirt, black pants, and was riding a pink and white Diamondback bicycle (Serial # A1504026648). Her mother KIM, Kyung arrived on scene and signed a patient refusal with AMB1, and transported her to Harvard Vanguard Wellesley for an evaluation. I took photos of the scene and submitted them to the IT bureau to be attached to this report.

Bicyclist, Tasker Howell, was traveling SOUTH on Watertown St, entering the lane of traffic when MV1 collided with her handlebars and front tire. MV1 (MA Reg: 8SP529, 2018 Ford SUV) was traveling WEST on Watertown St when she collided with the Tasker on the bicycle. MV1 operator, Maria Forgione, stated that while she was traveling on Watertown St, she had a passed a large landscaping truck parked at 857 Watertown St which hindered her seeing Tasker pulling out into traffic on the bicycle. Tasker stated the same, that she saw traffic clear and believed it would be safe to pull out into traffic but the landscaping truck created a blindspot. Tasker was not wearing a helmet. There was damage to MV1 on the passenger front end. Tasker was transported to Newton Wellesley Hospital. Tasker's bicycle was left in her possession at her residence at 871 Watertown St. Pictures were sumbitted to IT.

Narrative:
On 06/30/2019 at 15:30 hours I was notified by Sgt Lee that a crash involving a motor vehicle and a bicyclist had occurred on Wiswall Rd at M Roadway. Upon my arrival at the crash scene I made the following observations, Wiswall Rd is a two lane non divided public way in the city of Newton that runs north to south from a dead end to Dedham St. The posted speed limit on Wiswall Rd is 25 MPH. M Roadway is a two lane non divided public way that runs west to east from Wiswall Rd to a dead end cul-de-sac. The weather conditions at the at of the crash were cloudy, and the roadway surface was wet from rain. I observed MA commercial registration M82794 a gray 2014 Honda Accord stopped in the north bound lane of Wiswall Rd at M Roadway. The Honda is registered to Newton Driving School. I observed two smudge marks approximately four inches in length on the center portion of the front and rear passenger side doors of the Honda. I also observed a 20 inch Kent bike that had be moved from it's final point of rest prior to my arrival. The bike had damage to it's front handle bars, front tire and it's two front forks. The bike's front tire had gray scuff marks on it. At the crash scene I spoke with the operator of the Honda, David Dombrovsky. Dombrovsky stated that he was driving north bound on Wiswall Rd near M Roadway approximately 20 to 25 MPH. Dombrovsky stated that he has had his learner's permit for six months and is a student at the Newton Driving School. Dombrovsky stated that he did not see the bicyclist but heard the impact of the bicyclist stricking the passenger side of the Honda. At the crash scene I spoke with driving school instructor, Igor Drizik. Drizik stated that the Honda was driving north on Wiswall Rd near M Roadway at approximately 20 to 25 MPH . Drizik stated that he did not see the bicyclist until approximately 1 to 2 seconds before impact on the driver's side of the Honda. Drizik stated the Honda is equipped with dual brakes and that he applied the brakes at the same time as Dombrovsky. Drizik stated that he and Dombrovsky got out of the Honda to render aid to the bicyclist. There were three other driving school students in the rear of the Honda at the time of the crash, neither of them stated that they witnessed the crash. None of the occupants of the Honda stated that they were injured and the vehicle did not require a tow. The bicyclist was identified as David Kerwin-Derrick. Kerwin-Derrick was transported via EMS to Boston Children's Hospital form treatment. At the hospital I spoke with one of Kerwin-Derrick's mother's, Patricia Kerwin-Derrick, who stated " We all know that David rode his bike into the car " and that her son had a broken left leg. Kerwin-Derrick is a student at the Memorial Spaulding School. Based upon my observations of the crash scene and statements made to me , I believe that Kerwin-Derrick's unintentionally rode his bike into the passenger side of the Honda. Photos were taken of the Honda, bike and crash scene and the disk was down loaded by the NPD's IT Bureau.

Operator of MV#1 stated he was travelling westbound on Wolcott St at approximately 25mph. He saw Bicyclist #1 on the sidewalk to his right. He then saw Bicyclist #1 enter the roadway and swerved out of the way to avoid contact. Bicyclist #1 drove into the right side of MV#1. Minor damage to MV#1. Bicyclist #1 stated he was riding his Trek Multi-sport on the sidewalk on Wolcott St when he "made a mistake" and entered the roadway without seeing MV#1. He stated his handlebars made contact with MV#1 and he fell off his bicycle. Bicyclist#1 suffered minor injuries to his elbows. His mother (Elizabeth Viveiros d.o.b. 10/7/66) responded to the scene and signed a patient refusal with the medics. No defects in the sidewalk or roadway. Pictures submitted to IT.

Mr. McDonald pulled over and assisted Mr. Gu to his feet. Mr. Gu got up and walked away. A witness, Mr. Brian Washburn was on his bicycle, and observed the accident. Mr. Washburn was across the intersection traveling west, when he said all the traffic east and west was stopped. Mr. Washburn observed Mr. Gu crossing the street, and stated as he got approximately 2/3 of the was across, he was spun around by the black car. Mr. Washburn believed Mr. Gu to be in the crosswalk. Another witness, Mr. Walter Sims stated he did not see the collision, but did observe Mr. Gu on the ground in the middle of the intersection, not near the crosswalk. Paramedics arrived on scene, Mr. Gu had some scratches on his right elbow, which were bandanged. Mr. Gu signed a patient refusal.

On Monday, July 15, 2019, while assigned to Traffic unit N525, I responded to the area of Beacon Street and Paulson Road, Newton, for a report of a hit and run motor vehicle accident involving a bicyclist. The weather at the time of the accident was clear and sunny. The road surface was dry. Beacon Street and Paulson Road are both public ways maintained by the City of Newton. I spoke with the injured bicyclist in front of 165 Paulson Road, Alexander Mendonez. Mendonez stated he was traveling Westbound on Beacon Street on his bicycle near Paulson Road. Mendonez stated he observed a late model gray sedan "inch to a stop" on Beacon Street (W) at Paulson Road. Mendonez stated he did not remember if the vehicle had it's right directional on at the time. Mendonez stated as he was traveling through the intersection with the vehicle on his left, the vehicle took a right turn onto Paulson in front of him. Mendonez stated he attempted to brake and veer to the right of the vehicle, but was unable to avoid the collision. Mendonez stated his left side made contact with the rear passenger door/rear fender area of the vehicle. Mendonez fell to the roadway and the vehicle left the area Northbound on Paulson Road. Mendonez was unable to see who was operating the vehicle. Newton Medics responded and treated Mendonez for injuries to his left knee/arm area. Mendonez signed a patient refusal with Newton Medics. I observed minor damage to the left handlebar area of Mendonez's bicycle (black Trek). Mendonez was wearing a white helmet at the time of the accident with a blue shirt and white and black shorts. Pictures were taken of the area and bicycle and submitted to the IT Bureau. Mendonez was able to provide a partial Massachusetts registration of "7BS32". I attempted run this plate with multiple combinations. I searched the area for a vehicle matching the description given by Mendonez with a negative result. On July 16, 2019, I spoke with a witness to the incident Mark O'Hearne. O'Hearne stated he was traveling Westbound on Beacon Street a few car lengths behind where the accident occurred. O'Hearne stated he observed a bicyclist on the right side of the road abruptly stop and fall to the roadway. O'Hearne stated he observed a vehicle in the path of the bicycle. O'Hearne stated the vehicle did not stop after the bicyclist fell and took a right onto Paulson Road from Beacon Street. O'Hearne stated he followed the vehicle involved in the accident to Commonwealth Avenue, and while doing so took a picture of the vehicle's license plate. O'Hearne stated he did not observe who was driving the vehicle. The Massachusetts registration provided to me by O'Hearne is 7BS322. This vehicle comes back to a 2010 Volkswagon Jetta registered to Peter Giorgi (S20952090) out of Paxton, Ma. I spoke with Peter via telephone. Peter acknowledged he is the registered owner of the vehicle, but stated his daughter was using the vehicle and was in the Newton area. I spoke with Lindsey Giorgi (S35711247) via telephone. Giorgi stated she was operating MA: 7BS322 in Newton yesterday, but does not recall being in an accident. Giorgi stated she is not familiar with the area and does not know the area where the accident occurred. Giorgi stated there is no damage to her vehicle and stated she does not believe she hit anyone. Giorgi emailed me 4 photos of her vehicle where I described the damage would be. I observed a small area of minor damage to the rear passenger side door area of this vehicle. After speaking with all parties involved, I am requesting a hearing in Newton District Court for Chapter 90, Section 24 (Leaving the Scene, Personal Injury). Giorgi was advised and mailed Massachusetts Uniform Citation T1269847. All photos obtained from O'Hearne and Giorgi were submitted to the IT Bureau.

On Friday, July 19, 2019, while assigned to traffic unit N525, I responded to the area of 845 Beacon Street, Newton for a report of a motor vehicle accident involving a bicyclist. It was reported that the bicyclist sustained minor injuries as a result of the accident. The weather at the time of the accident was clear and sunny. The road surface was dry. Beacon Street is a public way maintained by the City of Newton. I spoke with the operator of MV1 while Newton Fire and Medics attended to the injured bicyclist. Andrei Jordao (S09978620) stated he was parked in his 2019 Hyundai Kona (NY: JFP5331) at a metered parking spot in front of 847 Beacon Street, Newton. Jordao stated he opened his driver door to exit his vehicle when a passing bicyclist crashed into the door. Jordao stated he did not look back at traffic prior to opening the door. Jordao stated the bicyclist fell to the roadway. I observed moderate damage to the driver side door and it was unable to close as a result of the collision. I spoke with the injured bicyclist, Leonard Engel (S53573803). Engel stated he was operating his bicycle Westbound on Beacon Street in the travel lane. Engel stated a vehicle to his right opened it's driver door into the roadway and he was unable to avoid hitting it. Engel stated he fell over the top of his handlebars and onto the roadway. Engel stated he injured his right shoulder/arm/neck area and his right ankle. Engel also had a small injury to his left knee. Engel stated he does not believe he hit his head as a result of the accident. Engel was wearing a helmet, I observed some scratch marks on it. Engel signed a patient refusal with Newton Medics. I observed damage to the rear tire area of Engel's black and green Giant bicycle. There was also damage to chain/pedal area. Engel's estimated the value of the bicycle at $4,000.00 USD. Massachusetts Uniform Citation T1271041 was mailed to Jordao for Chapter 90, Section 14 (Open car door into traffic). Tody's responded the removed MV1 from the roadway. Photos were taken of MV1 and the bicycle and submitted to the IT Bureau.

On Tuesday, July 23, 2019, while assigned to Traffic unit N525, I responded to the intersection of Beacon Street and Washington Street, Newton for a motor vehicle accident involving a bicyclist. The weather at the time of the accident was overcast. The road surface was dry. Beacon Street and Washington Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Paige Mahoney (S85200426). Mahoney stated she was stopped in traffic at a red light on Beacon Street (W) at Washington Street in her 2018 black Volkswagon Tiguan (MA: 633MV6). Mahoney stated while her vehicle was at a complete stop, she felt and heard something hit the rear of her vehicle. Mahoney exited her vehicle and saw a bicyclist on the roadway. I observed minor damage to the rear middle bumper area of MV1. There was a small amount of blood present on the damaged area. I observed the roadway where the accident occurred. There was a small pool of blood in the left lane of Beacon Street (W) where the bicyclist fell to the roadway. The area of the roadway where the accident occurred is currently undergoing restoration and the asphalt has been graded down to it's sub base in preparation to be resurfaced. The current road surface condition is bumpy and uneven. The area where the roadway goes from a smooth surface to a bumpy surface is where the accident occurred. The injured bicyclist was identified as Timothy Johnson (S29270605). I spoke with him in the Newton Wellesley Hospital emergency room. Johnson stated he was operating his bicycle Westbound on Beacon Street on the right side of the left lane. Johnson stated he was coming to a stop in traffic at a red light when his wheel abruptly turned to the left and he began to fall over. Johnson stated his head hit the back of a vehicle stopped in front of him and he landed on his right side, with his bicycle landing on top of him. As a result of the accident, Johnson suffered an injury to the right side of his head and had scrapes on his right arm. Johnson stated he did not lose consciousness as a result of the accident and he appeared to be alert and orientated while I was speaking with him. Johnson was wearing a helmet at the time of the accident. There were fresh markings on the right side of the helmet with minor black paint transfer. These markings are consistent with Johnson's statement that he fell into the back of MV1 and hit his head. Johnson's bicycle was removed from the roadway prior to my arrival and was being stored in the driveway of 2044 Beacon Street by the resident there. I observed no obvious damage to Johnson's bicycle. After speaking with all parties involved and examining the roadway where the accident occurred, it appears that the condition of the road surface contributed to Johnson losing control of his bicycle and crashing into the rear bumper area of MV1 while it was stopped in traffic. Photos were taken of the road surface, John's bicycle, and MV2 and submitted to the IT Bureau.

At approximately 1825HRs on August 06, 2019, I was dispatched to 785 Centre St. (Newton Country Day School) in reference to a motor vehicle vs bicycle crash. Upon arrival, I located both parties on the sidewalk adjacent to the intersection of Centre St. and Colby Rd. The operator of the bicycle was complaining of feeling dizzy, although she stated she did not hit her head, and suffered several abrasions on her left leg and hands; the operator of MV1 stated she was uninjured. The operator of MV1 stated that as she was traveling northbound on Centre St., she attempted to give the operator of the bicycle room, but the bicyclist made an abrupt left hand turn and struck MV1. The operator of the bicycle stated she was traveling northbound on Centre St. in the Bicycle Lane. She then signaled a left hand turn and entered the Motor Vehicle Travel Lane to make a second left hand turn to travel eastbound on Colby Rd. Once she exited the northbound Motor Vehicle Travel Lane on Centre St. and began to cross over the southbound lane, MV 1 crossed over the solid yellow lines onto the southbound side of Centre St. and struck her bicycle. MV1 sustained damage to its right front bumper and I noted red paint transfer of the left side of the front bumper, which the operator of MV1 states was old damage. MV1 also sustained a flat left front tire after contacting the curb. The bicycle sustained damage to both tires and where the rear tire attaches to the frame appeared to be warped. I took several photos of the damage and have submitted them to be attached to this report. The operator of the bicycle was transported to the hospital by Newton Medics and the operator of MV1 signed a patient refusal. Todys Services arrived and took custody of MV1, for which I completed and filled an NPD Towed Motor Vehicle Form. All streets mentioned are public ways in the City of Newton. Due to the potential danger of serious bodily injury caused by the operator of MV1's reckless driving behavior (crossing the solid yellow road divider line and driving on the wrong side of the road against traffic), the actual damage caused (striking and causing the bicycle operator to be transported to the hospital and damage to the bicycle) and that the bicycle operator was clearly visible/in clear contrast with the road (riding a red bicycle and wearing a red shirt) I issued the operator of MV1 MA Criminal citation T1445010, in hand, for violating one count of MGL Ch.90 S. 24 (Operating To Endanger) I cleared without incident. Note: I logged the bicycle into property/evidence for safekeeping, as it could not be taken on the ambulance.

On Friday, August 16th 2019, at approximately 6:40pm, I, Officer Brooks, responded to Dunstan street at Washington street for a MVA pedestrian. Upon my arrival I spoke with the operator of MV1(294NZ5), who stated she was traveling southbound on Dunstan street and was attempting to pull out onto Washington street, when she made contact with a bicyclist traveling westbound on Washington street. The operator stated she never saw the bicyclist, and that she was traveling less than a mile per hour when she made contact. It should be noted that the sun was setting and the operators vision would have been impaired by the sun at the location of the accident. MV1 had a minor scuff mark on the front bumper. I spoke with the bicyclist who stated he was traveling westbound on Washington street and was crossing over Dunstan street when he was struck by MV1. He stated he was knocked off the bike, scraped his arm, and had minor back pain. The mirror on the right side of his bike was broken. The bicyclist was wearing greenish gray clothing, and was not wearing protective equipment such as a helmet. The bicyclist signed a refusal from Cataldo and was given a copy of the report number. Pictures were taken of the scene and all parties were sent on their way.

On Tuesday, September 10, 2019 while assigned to Traffic unit N525, I responded to the area of Beacon Street and Roslyn Road, Newton for a report of a motor vehicle/bicycle crash. The weather at the time of the crash was overcast. The road surface was dry. Beacon Street and Roslyn Road are both public ways maintained by the City of Newton. I spoke with the bicyclist involved in the crash, Steven Greenzang (S96615185). Greenzang stated he was traveling Westbound on Beacon Street in the shoulder lane on his black Specialized bicycle. Greenzang had a yellow reflective vest on and was wearing a helmet at this time. Greenzang stated a vehicle in the travel lane to his left drove by him and hit the mirror located on his left handlebar. I observed damage to the mirror. Greenzang report no injuries. I spoke with the operator of MV1, Sarah Bonfanti (S66811372). Bonfanti stated she was parked in front of 1411 Beacon Street waiting to pick up a co-worker that resides at that address. Bonfanti stated a bicycle traveling on the sidewalk to her right crashed into the passenger side door mirror of her 2008 Toyota Scion (MA: 681YH1). Bonfanti stated the bicyclist was acting "crazy" during her interaction with him and he was trying to take her picture. Bonfanti stated she got back into her vehicle and moved up the roadway to wait for police to arrive on scene. I canvassed the area where the accident occurred with Sgt. Dempsey. There was glass from the passenger side mirror of MV1 and Greenzang's bicycle in the main travel lane of the roadway and the shoulder lane where Greenzang stated he was traveling. We also observed a large tree and a telephone pole on the sidewalk next to the roadway where the accident is alleged to have occurred. After speaking with all parties involved, observing the location of the glass in the roadway from the crash, and the location of the tree and telephone pole on the sidewalk where he accident occurred; Greenzang would not have been able to operate his bicycle on the sidewalk and be close enough to the roadway to make contact with MV1. Prior to clearing the accident, I asked Bonfanti if she had any questions and if she wanted to report any injuries. Bonfanti stated she was hit by the bicyclist during her exchange with him and began grabbing her left leg. I asked Bonfanti why she did not inform the officers on scene that she was assaulted. Bonfanti stated she said something to our Dispatch when she called. I asked Bonfanti if her leg was injured. Bonfanti stated I was putting words in her mouth and that she was just scratching her leg. Bonfanti then stated she was hit in the right shoulder. I asked Bonfanti if she would like an ambulance to respond and evaluate her. Bonfanti declined and stated she was more concerned about her mirror. I advised Bonfanti if she wanted to pursue charges against Greenzang she could do so in Newton District Court. I listened to the 9-1-1 recording Bonfanti made in regards to this incident. Bonfanti stated a pedestrian busted out her window. Bonfanti then stated to our dispatcher that the bicyclist lost control of his bicycle and smashed into her car. During her exchange with the our dispatcher, I did not hear Bonfanti say she was physically assaulted by Greenzang.

Baron was transported via EMS to Mt Auburn Hospital for treatment for possible internal injuries. Operator of vehicle one Sara Ross stated that she was stopped at a red light on Center Ave at Center St. Ross stated that she was waiting to turn right on a red light and look to her left and then her right and drove forward. Ross stated that she did not see Baron in the marked crosswalk. Charles Hannum was a front seat passenger in vehicle one and stated that he did not see Baron in front of the vehicle until the crash occurred. I took photos of vehicle one and forwarded to the NPD IT bureau. I issued Ross M Citation T21065501 and cited her for a violation of CO 19/74 , failure to use care while turning.

Upon arrival with other units, we determined that MV 1 was parked in front of 749 Beacon St.The operator of MV1 opened the door to her vehicle to exit and her door struck a passing bicyclist. Traffic on Beacon St. westbound was stopped, the bicyclist fell off of the bicycle and sustained injuries and was transported to Newton-Wellesley Hospital for further evaluation.As the bicyclist was falling, he struck the rear of MV2, which did not appear to have any damage. The operator of MV1 said she did not see the bicyclist, as she went to exit her vehicle. Witness 1, who was stopped in traffic said that the bicyclist was traveling at a high speed and understood how MV1 did not see the bicycle coming. Officer D. Siegal transported the bicycle to the Newton Police Department and secured it in support services.

On 09/27/19 at 08:41 hours while assigned to Traffic Unit 523, I responded to a motor vehicle/bicyclist accident at 1330 Centre Street. The weather at the time was clear and sunny. The road surface was dry and Centre Street is a public way maintained by the City of Newton. Traffic conditions were at a heavy volume and Centre Street was congested at the time. There is no dedicated bicycle lane in this area due to the road being too narrow. I spoke to the bicyclist involved (Unit 2), Michael Hnatko (S10432772). Mr. Hnatko stated he was traveling northbound on Centre Street on the right side of the road on his 20 inch gray Trek bicycle. He further says that he was peddling very fast at the time and must have not been paying attention to MV1 turning right in to parking lot of 1330 Centre Street as he was approaching from behind. As MV1 was turning right, he then struck the passenger side rear quarter panel of the vehicle and fell forward off of his bicycle. He sustained minor injuries such as scrapes to his knuckles on both hands and a small cut to the bridge of his nose. He signed a patient refusal with Cataldo Ambulance. It appeared that the front alignment was now off on his Trek bicycle. I then spoke to the operator of MV1, Lonnie McGinnis (S66044083). He states that he was inching along in heavy traffic waiting to turn right in to the lot of 1330 Centre Street with his right turn directional signal on. As he was turning right, the bicyclist struck his vehicle on his passenger side rear quarter panel area. McGinnis thought it was clear to turn right at the time and never saw the bicyclist approaching from behind. No injuries reported by McGinnis and I observed minor dents and scratches to the passenger rear quarter panel area. Digital photos taken by Ofc. Gaudet.

Operator of motor vehicle 1 states he came to a stop on Grove Street headed north at the stop sign at the intersection of Woodland Rd. Vehicles on Woodland Rd. stopped to let him go. As motor vehicle 1 proceeded into the intersection a bicycle came out of no where and the operator of motor vehicle 1 struck the bicycle at a low speed with the front of motor vehicle 1. The cyclist states he was traveling east on Woodland Rd. when he proceeded into the intersection he was struck on his right side by motor vehicle 1. The crash was at a low speed and the bicycle tipped over to the left side, causing an injury to his left arm. The cyclist states it was hard to see due to the rain. When the cyclist was asked if he had stopped at the intersection he stated he was not sure if he stopped or just slowed down. When asked if he came to a complete stop and placed a foot onto the ground, the cyclist stated no. The cyclist stated normally when he stops he just balances in place and doe not take his foot off the pedals. When I asked the cyclist if he passed other vehicles on the right to get up to the intersection he stated yes, he normally does so. It should be noted there is no dedicated bike lane and both streets are narrow at this intersection. MED2 transported the cyclist to NWH for his arm injury. I took pictures of the roadway as well and the bicycle and motor vehicle 1. N497 transported the bicycle to property and evidence for safe keeping, N497 submitted memory chip with photos to IT.

On 10/04/19 at 11:49 hours while assigned to Traffic Unit 523, I responded to a motor vehicle/bicyclist accident at Centre Street and Nathan Road. The weather at the time was cloudy. The road surface was dry and Centre Street and Nathan Road are public ways maintained by the City of Newton. Traffic conditions were heavy and Centre Street was congested with vehicles at the time. There is no dedicated bicycle lane in this area but there are bicycle indicators painted on the roadway to make drivers aware of bicyclists traveling. I spoke to the bicyclist involved (Unit 2), Marvin Goldman (S67373495). Goldman was wearing a helmet, gray sweatshirt, gray shorts, and black/orange reflective sneakers. Mr. Goldman stated that he was traveling southbound on Centre Street on the right side of the road on his black Fuji Sagres bicycle. He further says that he was peddling fast at the time while crossing over Nathan Road and that is when he suddenly struck Unit 1 on it's passenger side front quarter panel/door area. He does not recall any other details of the incident along with Unit 1 attempting to turn left towards him. Goldman sustained scraped up knees and a small laceration below his left eye. He refused medical attention signing a patient refusal with Cataldo Medic One. I observed that his front wheel was bent as a result of the accident. The rest of the bicycle appeared to be intact. I then spoke to the operator of Unit 1, Darlene Martins (S27966454). Ms. Martins spoke with the assistance of Ofc. Calderon who was translating for her. She says that she was traveling northbound on Centre Street and was attempting to turn left on to Nathan Road in order to turn around and travel the other way on Centre Street. She says that a vehicle in the southbound travel lane left space for her to make her left turn. She then proceeded to turn thinking it was clear and that is when the bicyclist suddenly approached and struck her on her passenger side. She also stated that it was hard to see past the congestion of vehicles waiting in the southbound travel lane. I observed scratch marks and a dent to her passenger side front quarter panel area along with minor scuff marks to her front passenger door. The scuff marks appear to be from the bicyclist rubbing against the vehicle. I also observed a dent on the top of the passenger door frame. It is unknown if the damage is the result of the accident or old damage Ofc. Calderon spoke to Rosangela Dias (Passenger in Unit 1), who stated that everything happened so quick but she never saw the bicyclist approaching when Martins attempted to turn left. I then spoke to a witness on scene identified as Matthew Miner. He says that he was two vehicles behind an unknown vehicle in the southbound travel lane of Centre Street. He says that the unknown vehicle left space for Unit 1 to turn left and waved Unit 1 on to turn left. He does not recall what transpired with the bicyclist. As a result of the accident, it was determined that Martins did not yield the right of way to the bicyclist while she was turning left. She also does not have a license to operate in Massachusetts or any other state. She was issued MA Uniform Citation # T2012393 for Ch. 89/8 Failure to yield and Ch. 90/10 Unlicensed Operation of a Motor Vehicle. Digital photos taken by me of the scene.

On Thursday, October 24, 2019, while assigned to Traffic unit N525, I responded to the intersection of Commonwealth Avenue and Cedar Street, Newton for a report of a motor vehicle crash involving a bicyclist. The weather at the time of the crash was clear and sunny. The road surface was dry. Commonwealth Avenue and Cedar Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Samuel Ntonme (S52001288). Samuel Ntonme stated he was operating his 2009 Nissan Murano (MA: 192VH6) Northbound on Cedar Street at Commonwealth Avenue. Ntonme stated he crossed Commonwealth Avenue and entered the carriage road area of Commonwealth Avenue to continue onto Cedar Street when a bicyclist crashed into the front driver side bumper/fender area of his vehicle. Ntonme stated there was a delivery truck partially blocking the intersection of Cedar Street (S ) at the Commonwealth Avenue carriage road. Ntonme stated he did not see the bicyclist until it crashed into his vehicle and stated the vehicle was traveling Eastbound on the roadway in the Westbound lane. I observed minor damage to the front driver side bumper/fender area of MV1. Ntonme reported no injuries. The operator of the bicycle, Ezra Robison (S83132607), was transported to Newton Wellesley Hospital with a leg injury prior to my arrival. I observed damage to the front and rear wheels on the Robison's bicycle on scene. Robison's bicycle was transported to the Newton Police Station for safe keeping. I went to Newton Wellesley Hospital to obtain a statement from Robison but he was discharged prior to my arrival. I spoke with Robison at his residence later in the day. Robison stated he was operating his bicycle on the Commonwealth Avenue carriage road (E) towards Cedar Street. Robison stated there was a delivery truck stationary on Cedar Street partially in the carriage lane. Robison stated he went around the delivery truck and didn't see MV1 until impact. Robison stated he crashed into the front driver side wheel area. Robison stated the front wheel of his bicycle went under the front driver tire of MV1 and he fell to the roadway with his bicycle. Robison stated he has minor injuries as a result of the crash. Pictures were taken of the crash scene and submitted to the IT Bureau.

On 11/27/19 at 12:43 hours, I responded to the Petsmart located at 215 Needham Street for a motor vehicle bicyclist accident. The weather at the time was approximately 50 degrees, cloudy and the road conditions were dry. No injuries reported. Operator of MV # 1 (Barbara Cooper) states she was facing eastbound on Needham Street waiting in the center turn lanes to take a left turn in to the garage of 215 Needham Street. Next, she states that a large truck going westbound stopped for her and waved her on to turn. She then proceeded in to the garage and parked and that is when she was confronted by the bicyclist saying that she was struck with her vehicle. The operator was unaware of an accident occurring and was not able to visibly see past the truck while turning. I observed a minor scratch to the passenger rear quarter panel area of the vehicle. Operator of the bicyclist (Merissa Brousseau) states she traveling westbound in the bicycle lane on the right side near 215 Needham Street when she observed the large truck mentioned above suddenly stop. She states that she was also visibly blocked from seeing ahead due to the truck. She then kept peddling straight through and struck MV # 1 in the passenger side rear end as it was making its left turn. The operator was evaluated by Cataldo Ambulance but refused medical attention. I observed no apparent damage to the bicycle. Ms. Brousseau was wearing a bicycle helmet, black and red Boston University bicycle suit, and red BU sock covers over her shoes. The OP. of MV#1 states he was on the eastbound lane of Washington Street, waiting to make a left turn onto Beacon Street. When he saw there was a break in traffic, he made the left turn and did not see Bicycle#1 coming off the sidewalk, thus colliding with it. The OP. of Bicycle#1 states he was travelling westbound on Washington Street on the sidewalk. He states Washington Street westbound is too dangerous for him to ride on the roadway during rush hour traffic. As he was crossing Beacon Street, Washington Street westbound traffic still had a green light and that's when MV#1 collided into him while making a turn. The OP. of Bicycle#1 was wearing a helmet and had front and rear lights. He did not want me to take his bicycle so he brought it with him to the hospital to be picked up by a family member. On January 16, 2020 Officer Bergdorf, Sergeant M Wade and I, Officer Guarino responded to Union St @ Langley Rd for a report of a motor vehicle crash into a bicyclist. Upon arrival, both the operator of MV1 and the bicyclist were inside of 45 Union St, "Baramor" to get out of the cold. I spoke with the bicyclist who was complaining of left wrist and left hip/ tailbone pain. The bicyclist was driving Southbound on Langley Rd on the sidewalk on his black bicycle with no lights. He said that as he was traveling on the sidewalk on Langley Rd, crossing the intersection of Union St (just outside of the crosswalk), he was struck on his right front of the bicycle causing him to fall on his left side. The bicyclist was not wearing a helmet and did not have any lights on his bicycle. He was wearing a blue jacket and dark pants on a black bike. The operator of MV1 spoke with Sergeant M. Wade and Officer Bergdorf. MV1 said that he was traveling East on Union St and stopped at the stop sign and did not see any pedestrians or traffic coming. He proceeded across Langley Rd and struck the bicyclist with the front driver's side of his vehicle. Officer Bergdorf took photos at the scene, which were submitted to IT to be attached to this report. The bicyclist was transported to Newton-Wellesley for medical treatment. His bicycle was transported to his house and secured by Officer Larson.

On Sunday, March 1st 2020, at approximately 5:38pm, I, Officer Brooks, was dispatched to the intersection of Linwood avenue and Watertown street for a bicyclist struck by a MV. Upon my arrival I spoke with the bicyclist who stated she was traveling westbound on Watertown street, and was in the crosswalk at the intersection of Linwood avenue, when she was struck by MV1(MA REG67FD40), which had been traveling southbound on Linwood avenue. The bicyclist stated that the operator of MV1 did not come to a stop at the stop sign. The bicyclist was complaining of minor leg pain, but signed a patient refusal with Cataldo. The bicyclist was dressed in black pants, and a gray sweater, and was not wearing a helmet. The bicycle sustained damage to the handlebars. At the time of the accident the sun was setting, however the street lights had not yet come on. I then spoke with the operator of MV1 who stated she was traveling southbound on Linwood avenue, and was attempting to turn right onto Watertown street when she struck the bicyclist. The operator stated she never saw the bicyclist before the collision. The front of MV1 sustained minor damage. I was able to speak with a witness to the accident over the phone after clearing the scene. The witness stated that MV1 failed to stop at the stop sign at the intersection of Linwood and Watertown street, and that the bicyclist was already well into the crosswalk at the time of the collision. Officer Howes took pictures of the accident scene that have been submitted to the IT bureau. Based of the witness statements MA Uniform citation T2080576 has been mailed to the operator of MV1 for MGL C.89 S.11 Failing to yield for a pedestrian in a cross walk.

On April 16, 2020, while assigned to WN, I took a report at the front desk for a past MVA/Bicyclist hit and run. LISTUNOV, Oleg reported that on 4/15/20, at approximately 2000 hrs, he was traveling on his bicycle Northbound on Chestnut St. approaching the intersection of Boylston St. He stated he did not stop at the stop sign due to the hill decent, at which time he was struck by MV1 on the left side and knocked to the ground. MV1 was traveling Eastbound on the Boylston St. off ramp. LISTUNOV stated MV1 stopped at the stop sign, and probably did not see him as they then proceeded straight into the intersection. LISTUNOV stated the female driver asked if he was okay and then left the scene. He wasn't able to remember any description other than a possibly yellow, orange, or light colored car. LISTUNOV then proceeded home before responding to Brigham and Women's Hospital. He sustained the following injuries: abrasion to the left side of forehead with internal bleeding, left black eye, right dislocated pinky, cut under chin, abrasions and swelling on both knees. I took photos of his injuries and submitted them to the IT bureau. LISTUNOV was riding a black bicycle, and was wearing black jeans, blue jacket, blue baseball hat, and no helmet.

Operator of MV1 stated she was traveling Westbound on Tremont Street and could not see well due to a sun glare. Operator of MV1 further stated when she approached the intersection of Tremont Street at Hibbard Road she struck a pedestrian riding a bicycle. I was able to speak with two witnesses on scene who were friends with Ms. Shokri. Both were approximately 10 feet behind her in the crosswalk before she was struck by MV1. Witness statements are documented in this report. Both parents responded on scene and were entered into this report as non-motorists. Both followed medics to Newton Wellesley Hospital. MV1 sustained moderate front end damage. Pedestrian involved suffered minor injuries and was transported to Newton Wellesley Hospital. Operator of MV1 was evaluated on scene and signed a patient refusal. Due to the bicycle being moved prior to my arrival, pictures were not taken on scene. The bicycle was left off the roadway for her friends to pick up. Ms. Skokri was wearing a pink shirt, black shorts and was riding a black bicycle. Ms. Shokri was not wearing any protective equipment.

On June 14, 2020 at approximately 17:13 hours Newton Police responded to Union St at Langley Rd for a report of a motor vehicle crash into bicyclist where the motorist took off. Upon arrival, I spoke with the operator of Bike1, who informed me that he was traveling eastbound on Union St when he rode his bicycle into the back of MV1. MV1 did not get out of the vehicle and drove away from the scene. Bike1 informed me that he was traveling behind MV1 and observed MV1 traveling slow on Union St at approximately 10-15mph. MV1 stopped at 45 Union St which is when he collided into the rear bumper. Witness 1 said that she saw a white male operator of MV1 and a female passenger. Both the operator and passenger looked behind them and then continued to drive away. it is unknown if the operator was aware that there was a collision. It should be noted that the collision caused a loud yell and bang that multiple people were able to hear. Bike1 did not have any visible damage to his bicycle and declined medical attention. A photograph of MV1 was forwarded to IT to be attached to this report along with a photograph of bike 1.

On Wednesday 6/17/2020 at approx 2116hrs, while assigned to N-494, I responded to the intersection of Walnut St and Comm Ave for MVA involving a bicyclist. The bicyclist, Aziz Boltayev, said he was traveling NB on Walnut St and attempted to cross Comm Ave. He stated that he was in the middle of the intersection when Comm Ave' light signal turned green. Contact was made to MV1s driver side front panel. Boltayev was transported to Beth Israel with serious injuries to his legs. Boltayev was not wearing a helmet nor wearing reflective clothing. His bicycle, a blue Schwinn, had no front head lamp attached in violation of MGL c85 s11B. A citation was issued and mailed to Boltayev. He was wearing a light colored shirt and shorts. Operator of MV1 states that he was on Comm Ave heading WB and stopped at a red light at the intersection of Walnut St. He states that he had a green signal when attempting to cross the intersection and did not see the bicyclist prior to the accident. Pictures were taken and submitted to IT. The Schwinn bike was placed in property and evidence for safekeeping.

The operator of the MV stated she was traveling westbound on Watertown St, and approaching the intersection of Watertown and Craft St. As she approached the intersection, the traffic light turned green and did not see a bicyclist in the crosswalk. Operator of MV1 struck the bicyclist on the front driver side of her vehicle. MV1 had a minor scratch on the driver side front bumper. The bicyclist stated he was in the crosswalk, crossing Watertown Street, heading toward Craft Street, northbound and the walking light was flashing as he was approaching the sidewalk. The bicyclist stated as he was approaching the sidewalk, while still in the crosswalk, MV1 struck the right side of his bike, knocking he and the bike over. The operator of the bike and the bike were then under the front driver side of the vehicle. The bicyclist stated the operator of the MV was not traveling fast but the impact still knocked him and the bike over. The bike was then stuck under the vehicle. Once he was off the ground, the operator of MV1 backed up her vehicle to get the bike out from under the vehicle. The bicyclist stated he had knee pain but the medics checked him out and he stated he was okay. The bicyclist was able to ride away on his bike after all proper paperwork and statements were gathered.

On Thurs 7/9/20 at approximately 1911 hrs I responded to 111 Dedham St for a report of an accident involving a bicyclist. Upon arrival I observed the MV and the bicycle on the EB travel lane side of Dedham St with the bicycle on the sidewalk/driveway and the MV facing the driveway at 111 Dedham St. I spoke with the operator of MV#1 who stated that he was traveling EB on Dedham St and then turning right into his driveway when he collided with the bicyclist. He stated that he never saw her until the last second as the bike was in his blind spot. When contact was made he immediately got out of his car to see if the bicyclist was okay. The passenger in the vehicle stated that the bicyclist was traveling Eastbound on Dedham St on the sidewalk when MV#1 struck her. The bicyclist was riding a turquoise and black Bianchi Aria racing bike with black leggings and a white and blue tank top. The bicyclist was wearing a helmet which had little to no damage on it. Before being transported to BI by the medics, Ms. Loomis stated she was traveling EB on Dedham St in the shoulder/bike lane when she was struck by MV#1 who was attempting to turn into the driveway. Pictures were taken of the scene and the SIM card was turned over to the IT bureau to be uploaded into this report. The bike was turned over to the bicyclist's friend, Christine Long.

The operator of MV1 (CANAS, Marco) stated he was traveling Westbound on Dedham St., crossing over Winchester St., when he was struck by a bicyclist (ENELAMAH, Jojo) on the driver's side bumper. He stated that he had a green light, and the bicyclist abruptly came out of Winchester St. Northbound into the intersection, striking the truck. CANAS stated he and ENELAMAH exchanged information and both went on their way, at which time he decided to report the accident at the police station. ENELAMAH had two scrapes on her right wrist, but she stated to him that she was uninjured. CANAS stated he was uninjured. He could not remember a description of the bicycle involved, but stated ENELAMAH was wearing red shorts, a blue shirt, backpack, and no helmet. I left a message on the phone number provided for ENELAMAH, and will update further upon making contact with her.

On 08/03/2020, while assigned to West Newton Square, I, Officer Conary, took a report of a past mva, car vs bicycle. No police officer was on scene at the time of the accident. Both parties wanted the incident documented. The operator of the bicycle, JIANG, explained to me that he was pedaling Eastbound on Washington Street, crossing over Adam Street, in the crosswalk, when he was struck by MV1. JIANG stated he tried to move out of the way but didn't have time. The bicycle went under the car. Operator of MV1 explained to me that he was traveling Westbound on Washington Street and signaled to take a right turn going Northbound on Adam Street. He said he had a green light and proceeded to take the right turn when he hit the cyclist. There is a regular green signal, no right turn green signal. There was minor damage to the front of MV1 (seen from pictures). JIANG stated that his bike is damaged. All parties did not receive medical attention at this time. JIANG stated that his right shoulder is sore.

On August 19th, 2020, while working in marked unit N526, I responded to a MVA vs. bicyclist in the area of the intersection of Crafts Street and Watertown Street, Newton. The weather at the time of the crash was clear and cloudy. The road surface was dry. Crafts Street and Watertown Street are both public ways maintained by the City of Newton. The operator of MV1, Cody Hjelm (NHL19517660), stated he was traveling westbound on Watertown Street and had just crossed over Crafts Street when he saw a bicyclist traveling in the same direction on Watertown Street. As MV1 approached the bicyclist he moved over to the left towards the double yellow lines to give the bicyclist room. MV1 states the bicyclist was no longer in front of his vehicle when he heard a thud type noise come from the side of his van. MV1 stated he pulled over and saw the bicyclist on the ground with a head injury. MV1 sustained moderate damage to the right passenger side of the vehicle. The operator of MV1 reported no injuries and signed a patient refusal. MV1 was able to leave the scene of the accident. The bicyclist identified as Harriet Fell (S04980771) was being treated by medics on scene at the time of my arrival. I spoke with her briefly inside the ambulance as she was being treated for a head injury. Harriet stated she has no recollection of the accident and does not remember what happened before or after the crash. Medics advised she was being taken to NWH for treatment. I spoke with Harriet on the telephone around 1630 hours. She stated she still does not remember what happened but stated she was just finishing her forty mile bike ride and was heading home. Harriet stated she has a hematoma on her head and recieved three stiches. Harriet also stated she has small abrasions on both hands. Harriet stated she was being released from the hospital shortly and will pick up her bicycle tomorrow. The bicycle was transported to the police station by Newton DPW and was secured for safekeeping inside Support Services by Officer Manouk. A property form was completed and submitted along with an Incident report # 20039014. I took photographs of the accident scene and submitted them to the IT Bureau. Update by Ofc. Geagan: On 08/20/2020 Ms. Fell came to the Support Serices Bureau to retrive her bicycle. See attached Evidence/ Property Form and Return of Property Sheet

On Tuesday, September 1, 2020, while assigned to marked unit N496, I responded to the area of 780 Beacon Street, Newton for a report of a motor vehicle crash involving a bicyclist. The weather at the time of the crash was clear and sunny. The road surface was dry. Beacon Street is a public way maintained by the City of Newton. I spoke with the operator of the vehicle involved in the crash, Dina Hudson (S33833807). Ms. Hudson stated she was sitting in her 2015 white Jeep Grand Cherokee (MA: 727SZ7) that was parked (E) in a metered parking spot in front of 780 Beacon Street. Ms. Hudson stated traffic in the Eastbound lane of Beacon Street to her left was stopped. There was a red light ahead at the intersection and traffic had built up past where her vehicle was parked. Ms. Hudson stated she opened her driver side door while she was looking for her debit card to go to the bank. Ms. Hudson stated at this time a bicyclist was traveling at a high rate of speed around the stopped traffic towards the intersection and crashed into her driver side door. Ms. Hudson stated the operator of the bicycle then traveled further up the roadway and crashed behind a vehicle stopped in traffic. Ms. Hudson stated she was unsure if the bicyclist crashed into the stopped vehicle or if it had landed on the roadway just before it. Ms. Hudson stated the bicyclist then got up from the roadway and began yelling at her that the crash was her fault. I observed a few small fresh scrapes on the outside of the driver side door area. When I initially arrived at the crash location, I observed Officer Lazarakis checking on his well-being of the injured bicyclist, Marc Lind. Lind was observed laying on the sidewalk in front of 780 Beacon Street. After being evaluated by Newton Medics, I spoke with Mr. Lind. Mr. Lind stated he was traveling on his Trek bicycle Eastbound on Beacon Street towards Langley Road. Mr. Lind stated while traveling through the area at this time, traffic in the Eastbound Lane was stopped and there was a red light ahead of him at the intersection. Mr. Lind estimated his speed at this time to be 10-12 miles per hour. Mr. Lind stated as he travelled past the Santander Bank at 780 Beacon Street, the operator of a parked white Jeep to his right abruptly opened their door into traffic. Mr. Lind stated he attempted to avoid the vehicles door and veered to the left. Mr. Lind stated the right end of his handlebar made contact with the door and as he traveled forward and applied his brakes his right side crashed into the rear of a vehicle stopped in traffic ahead of him. Mr. Lind stated he crashed to the roadway on his right side. Mr. Lind was able to move to the side of the roadway and wait for Newton PD, Fire, and Medics to respond. Mr. Lind reported injuries to his right arm, side, and leg area. Mr. Lind signed a patient refusal with Newton Medics and was transported away from the area by his wife with his bicycle. I observed no substantial damage to his Trek bicycle. At the time of the crash, Mr. Lind was wearing a white t-shirt, black shorts, black, shoes, and a gray helmet with sunglasses. I spoke with a witness to the crash, Steve Worthington. Mr. Worthington stated he was stopped in traffic on Beacon Street about 4 vehicles back from the red light. Mr. Worthington stated he looked out of his passenger door mirror and observed a bicyclist "whipping" down Beacon Street in between vehicles parked on the side of the road and vehicles stopped in traffic at the red light. Mr. Worthington estimated the speed of the bicycle to be approximately 20 miles per hour. Mr. Worthington stated the bicyclist had to "lean" by his vehicle to get by. Mr. Worthington stated a vehicle just ahead of him that was parked opened their door and the bicyclist made contact with the door. Mr. Worthington stated the bicyclist then went down in front of the car that was in front of him. Mr. Worthington stated the bicyclist was rolling around on the ground and screaming "It's your fault" at the woman that opened her door Photos were taken of the bicycle and the vehicle involved and submitted to the IT Bureau.

On Wednesday September 2nd, 2020 I responded to 341 Lexington Street for a report of a past motor vehicle accident involving a pedestrian that reportedly occurred around 12:25pm at the intersection of Commonwealth Ave and Lexington St. At the time of the reported incident the weather was cloudy/rainy and the road surface was wet. Both Commonwealth Ave and Lexington St are owned and maintained by the City of Newton. Upon arrival I spoke with the parent of the pedestrian identified as Tamika Olszewski. Tamika stated her daughter, Morgan Olszewsk, her twin brother Dean Olszewski and several friends took their bikes and went to Dunkin Donuts in Auburndale. Tamika stated when the group returned from Dunkin Donuts her daughter Morgan told her that she was hit by a car while crossing Commonwealth Ave. I spoke with Morgan and she stated she was in front of Dunkin Donuts and pressed the crosswalk button on the traffic light to cross over Commonwealth Ave. Morgan stated she crossed the street inside the crosswalk and noticed the crosswalk light signal was counting down. Morgan stated she heard a shrieking noise from a car slamming on the brakes and stuck hand out and touched a white car to keep her balance. Morgan stated she did not fall down or sustain any injuries. Morgan stated she continued across the street towards the picnic benches that are located in front of Starbucks. Morgan stated she then walked home and told her mother what happened. Morgan's only description of the vehicle involved was white car. Dean Olszewski and Ryan Poras stated they were at the picnic benches and left their bikes there and walked in the crosswalk to Dunkin Donuts to get some food. Dean and Ryan stated they then left the store and crossed back to the picnic benches where Deans sister Morgan was waiting. Dean gave Morgan some money so she could go to Dunkin Donuts and Morgan went and crossed the street alone and the next thing they saw was Morgan in front of Dunkin Donuts with an unknown woman with her arms around Morgan. Dean and Ryan stated Morgan crossed back to the picnic benches and when they asked Morgan what had happened she stated "nothing". Later Morgan then told Dean she was hit by a car. I spoke with an employee of Dunkin Donuts who stated he witnessed the entire incident. Kelvin Matovu stated he had groups of kids coming inside to get donuts around 12:25pm. Kelvin stated he witnessed Morgan with other children at the picnic benches in front of Starbucks. Kelvin stated he saw Morgan attempting to cross Commonwealth Ave with her helmet on and no bicycle with her. Kelvin stated Morgan pressed the crosswalk button on the traffic light at the intersection but stated she did not cross in the crosswalk and crossed directly in front of the stores windows which are not in line with the crosswalk. Kelvin stated he did not notice if she had the walk sign or not. Kelving stated as Morgan crossed into traffic she was rushing and stopped in the middle of the road where the two yellow medium stripes are and looked confused. Kelvin stated it seemed she was confused because cars were going past her in both directions and so she stopped in the middle of the road. Kelvin stated a female customer who was inside the store went out and made contact with Morgan when she finally crossed the street and made it to the front door of Dunkin Donuts. Kelvin stated he did not see a car make contact with Morgan or hear anything related to a crash. Kelving stated Morgan seemed confused and did not appear injured. Kelvin stated the female customer put her arms around Morgan to make sure she was okay. After the incident, Kelvin stated Morgan did not enter the store and went back to the picnic benches where the other children were located and they left northbound on Lexington Street. Kelvin stated the female customer came into the store and Kelvin gave the woman a free coffee for assisting Morgan. The unidentified female customer then left the area. Dunkin Donuts has no cameras that face the street. Officer G. Claflin spoke with the employees at Keys Drugstore and they stated they did have cameras facing the street and will contact the store manager who will contact the Traffic Bureau if the incident was caught on the camera. I advised Tamika that a report will be filed and if there is any development regarding the possible car involved I will contact her. Medic 2 was on scene and Tamika signed a patient refusal for Morgan. Morgan is a student at Burr Elementary School. While writing this report Tamika called and stated that Morgan remembered that the woman who assisted her after the collision walked her inside Dunkin Donuts.

Albemarle Rd is a pubic way in the City of Newton that is one way. Morse stated that as he turned onto Abermarle Rd he observed vehicle one parked facing east bound in front of 478 Abermarle Rd. Morse also stated that vehicle two was slowing down in front of 478 Abermarle Rd facing east bound. Morse stated that he had intended to ride his bike in between the vehicles. Morse stated that as he rode his bike pass vehicle one , it's front driver's side door opened. Morse stated that he crashed into the open front driver's side door of vehicle one and the impact caused him to lose control of his bike. Morse stated that after he had lost control of his bike he crashed into the rear quarter panel of vehicle two. Michael Thomas operator of vehicle two stated that he was slowing down in front of 478 Albermarle Rd to look at his childhood home when Morse crashed into the rear quarter panel of his vehicle, causing damage. Operator of vehicle one Larissa Pazmino stated that she opened the front driver side door of her vehicle and did not see Morse prior to opening the door. Morse transported himself to NWH where he was treated for a broken collar bone. Pazmino was cited ( MA T2016094 ) for MGL 90/14 , opening a door near bicyclist.

Operator of vehicle one Peter Bradley stated that on 09/18/2020 at 08:39 hours he was driving his 2014 Land rover ( MA reg 1EV437 ) south bound on Cherry St near Adams Ave. Cherry St. is a public way in the City of Newton. Bradley stated that as his vehicle was approaching Adams Ave he saw a vehicle stopped facing east bound that was about to turn into the south lane of Cherry St. Bradley stated he also saw a bicyclist riding south bound on Cherry St. Bradley stated that as the bicyclist passed by the vehicle that was stopped at Adams Ave. it suddenly swerved to the left and into the path of travel of his vehicle. Bradley stated that the passenger side mirror of his vehicle struck the bicyclist causing him to fall off his bike. The bicyclist Tameon Dames, a 10th grader at NNHS ( DOB 02/16/2005 ) stated that he was riding his bike south bound on Cherry St. near Adams Ave. when he saw a vehicle stopped on Adams Ave about to turn south bound on Cherry St. Dames stated that he steered his bike to the left to create space between himself and the stopped vehicle. Dames stated that when his bike moved to the left he came in contact with the Landrover's passenger side mirror causing him to fall from his bike. Dames stated that he did not lose consciousness after the crash and was not wearing a helmet . Dames had cuts to his left hand and was transported to Children's Hospital in Boston via EMS from treatment. The operator of the vehicle that was stopped on Adams Ave was Pin Cao. Cao stated that he saw Dames "swerve" his bike into Bradley's vehicle as passed his. At the time of the crash Dames was wearing ear pods. Bradley's vehicle had minor scuff marks on it's passenger side mirror case. I took photos of Bradley's vehicle and of Dames bike and had the photo disk downloaded by the NPD's IT Bureau. While taking photos of Dames bike I observed that both of it's tires had very little tread left leaving them almost completely bladed. I further observed the bike was missing left pedal. Officers searched the crash area for the bike's pedal with negative results, it appeared that the pedal was missing prior to the crash. I further observed that only the front breaks of Dames bike where in working order. Dames bike was transported to the station and I filled out a property form ( see report 20042471 )

The operator of Vehicle #1, identified as Mr. Stephen McCarthy, stated that he heard a noise beside his vehicle, which startled him. He then stopped his vehicle immediately to discover that a bicycle had fallen next to his vehicle. Mr. McCarthy stated that he is unsure if his vehicle was struck by the bicycle. He initially believed that contact was made, but he could not find any damage to the vehicle. Upon inspecting the vehicle myself, I did not find any damage. Mr. Richard Hohmann stated that he rode his bicycle out of the driveway at 276 Church St, and turned left onto Church St. He stated that the rear of his bicycle was struck by Vehicle #1 as it turned right from Richardson St. onto Church St. Mr. Hohmann was seen by the medics, but declined service. His bicycle, a grey Trek, appeared to have damage to the rear frame. As I was clearing the scene, Dispatch received a call from a Mr. James Gauthier. I spoke to Mr. Gauthier, and he stated that Mr. Hohmann's bicycle appeared to be broken when he observed him ride out of the YMCA driveway. He further stated that he was approximately 50 feet away from the scene, and did not see the accident occur, but that his attention was drawn to it when he heard the vehicle stop short. He stated that he does not believe that Mr. Hohmann struck the vehicle, because he didn't hear anything consistent with a bicycle making contact with a vehicle.

On 9/20/20, I received a phone call from Dezhen Zhang in regards to an auto pedestrian accident this morning. Zhang stated that at 0630hrs, he was bicycling to work northbound on Centre St just before Cabot St. Zhang stated that an unidentified vehicle struck him with the passengers side mirror and continued driving northbound on Centre St. Zhang stated that he was very confused because he did not feel the vehicle hit him or his bicycle, but observed the mirror fall off. Zhang stated he was not injured and his bicycle was not damaged. The only description of the vehicle is a black small car. Zhang could not give any information on the driver.

On 09/30/2020 at approximately 19:32hrs members of the Newton Police Patrol Bureau responded to a motor vehicle crash near the intersection of Washington St and Eddy St. After an initial investigation of the crash the Patrol Bureau secured the crash scene and called in the Newton Police Traffic Bureau to investigate. At approximately 19:45hrs Sgt. Devine, Ofc Wilson and I (Ofc Schlegel) from the NPD Traffic Bureau responded to the scene to investigate. Upon arrival to the scene I was met by Ofc Kane of the NPD Patrol Bureau. Ofc Kane stated that the crash was located in the driveway of 74 Eddy St and that it involved a Ford F350 pickup striking two parked cars. Ofc Kane stated that the operator identified as Kyle Butler had already been taken to Newton Wellesley Hospital by Cataldo EMS for injuries. . Upon approaching the crash scene I observed the following: The crash occurred at night time hours at approximately 19:32EST near the intersection of Washington St and Eddy St. Both Washington St and Eddy St are public ways in the City of Newton. The weather conditions at the time of the crash were a dark and clear with a temperature of approximately 60 degrees F. Washington St is a four lane undivided roadway (2 westbound travel lanes and 2 eastbound travel lanes). Washington St lighted roadway which has concrete light poles on both the westbound and eastbound sides. Washington St was under construction at the time and had a base coat of asphalt applied. At the time of the crash Washington St did not have any painted lane markings due to ongoing construction. Washington St is separated from the road sides on both the eastbound edge and the westbound edge with fixed granite curbing. The roadway also had several orange traffic barrels and traffic cones located edges of the eastbound and westbound lanes. Affixed to the light poles and the traffic barrels were temporary no parking signs for the ongoing road construction. At the time of the crash no road construction activities were taking place. No major debris or other obstructions were observed in the roadway. Washington St is a major roadway in the City of Newton and travels west to East across the entire City of Newton. This area of Washington St where the crash occurred is in between West Newton Square and Newtonville Square, this area has a posted 35 MPH speed limit. Both West Newton Square and Newtonville Square are densely populated with several businesses and residential areas. The section of Washington St where the crash occurred is also traveled frequently by pedestrian, bicycle and motor vehicle traffic. At the time the crash occurred 19:32hrs This area of Washington St is still a heavily travelled roadway. I observed Vehicle 1 described as a 2003 Ford F350 color white (MA Reg 5DT664) located in the driveway of 74 Eddy St. 74 Eddy St is a multi-family dwelling house located on the corner of Washington St and Eddy St. The driveway of 74 Eddy St is on the Washington St side. Vehicle was faced easterly across the driveway. I observed Vehicle 1to have extensive damage to the entire vehicle including but not limited to the enclosed cab area, cab roof and all windows, front end, rear end, along with both driver and passenger side. I also observed city of Newton owned concrete traffic light resting on top of the cab area of Vehicle 1. Upon further observation of Vehicle 1 it appears that both front tires and rims were flat, heavily damaged and had little to no tread left. Both front tires were worn down to the interior steel belt. I also observed that Vehicle 1 did not have a valid inspection sticker. Located to the immediate front of Vehicle 1 and resting on the front end was a white fence which had damage consistent with the impact of a motor vehicle. Immediately to the driver's side of Vehicle 1 was Vehicle 2 described as a 2007 gray Subaru Forester (MA Reg 45D610. Vehicle 2 was facing westerly across the driveway. Vehicle 2 had extensive damage to the driver's side front end, rear end, in addition to the entire driver and passenger sides. At this time Vehicle 2's drivers door was in contact with Vehicle 1's drivers door. Both drivers doors could not be opened.The damage to Vehicle 2 appeared to be consistent with impact from another motor vehicle. To immediate passenger side of the Vehicle 2 I observed Vehicle 3 described as a 2011 Toyota Rav4 color black (MA Reg 47XB99). Vehicle was facing in an easterly direction across the driveway. I observed the Vehicle 3 to have extensive damage to driver's side rear quarter panel, passenger side front quarter panel and front end. Also observed was damage to south east corner of the dwelling of 74 Eddy St. This area of the dwelling is located adjacent to the drive way. The damage appeared consistent with the impact caused by a motor vehicle. Also observed were large amounts of debris located in the area of the crash which included the sidewalk, yard and the driveway of 74 Eddy St. The debris included pieces of concrete which appeared to have been dislodged from the concrete light pole. A city of Newton no parking sign was lying in the yard of 74 Eddy St. This parking sign would have been attached to the concrete light pole due to ongoing road construction on Washington St. I also observed two tire marks on a curb stone located next the westbound lane of Washington St. These tire marks were in front of the residence of 74 Eddy St and were to the immediate left of a storm drain. The tire marks were consistent with being struck by a motor vehicle. In between the tire marks and just after the curb there was a hole in the ground with wires sticking out of it. This hole appears to be the location the concrete light pole was located prior to impact. Tire marks were located on Washington St traveling from the east bound lane easterly across the westbound lane and ending at the tire marks on the curb. The total length of the tire marks was approximately 190 feet. After conducting an on scene investigation it appears that Vehicle 1 from the start of the tire mark in eastbound travel lane of Washington St traveled 190 feet in the easterly direct across the westbound lane of Washington St and impacted the curb in front of 74 Eddy St. The tire marks had lateral striations almost the entire length indicating that the front tires were rolling and sliding with little to no braking prior to impact with the curb. After impact with the curb Vehicle 1 exited the roadway, struck a concrete light pole. Vehicle 1 then traveled over a sidewalk, across the yard of 74 Eddy St and into the driveway of 74 Eddy St. Located in the driveway of 74 Eddy St were Vehicle 2 and Vehicle 3. Vehicle 2 was parked facing toward the rear of 74 Eddy St. Vehicle 3 located to the passenger side of Vehicle 2 and was parked facing towards Washington St. When Vehicle 1 entered the driveway it struck Vehicle 2. The force of the impact of Vehicle 1 striking Vehicle 2 caused Vehicle 2 to strike Vehicle 3. The force of the impact of Vehicle 2 striking Vehicle 3 caused Vehicle 3 to strike the southeast corner of the dwelling located at 74 Elliot St. Vehicle 1 continued across the drive way and struck a white fence before coming to final rest. Vehicle traveled a approximately 55 feet from when it initially struck to the curb till final rest. No other injuries were reported on scene. All involved vehicles were towed from the scene by Tody's Towing. After the investigation the operator of Vehicle 1 Kyle Butler was issued Citations T2015882 and T2015883 for: Mgl 90/24/O Recklass Operation of a Motor Vehicle Mgl 89/4B/A Failure to Operate in the Right Lane Mgl 90/20 Failure to Submit a Motor Vehicle for Inspection Mgl 90/7 Defective Equipment (worn front tire treads) Mgl 90/13A Failure to wear a seatbelt An immediate threat form was also filed with the MA RMV. Narrative:
On Tuesday, October 6, 2020, I received a call at approximately 2158 hours from Sgt. Devine of the Newton Police Traffic Bureau. Sgt. Devine stated there was a motor vehicle crash with serious injury that had just occurred at the intersection of Crafts Street and Waltham Street in Newton. Sgt. Devine stated that one of the parties involved had suffered life threatening injuries and was transported to Brigham and Women's Hospital. I responded to the scene and conducted an investigation of the crash with the assistance of Sgt. Devine and Captain Boudreau. Upon arrival it was reported to me by officers on scene that a party operating a motorized scooter on Crafts Street (E) had been struck by a 2007 Chrysler Town and Country (MA: 5EE316). The Chrysler was attempting to make a left turn from Crafts Street (W) onto Waltham Street (S). The operator of the motorized scooter, identified as Nadhir Tchikou (DOB: 11/23/1993), had suffered serious injuries to his head and left leg area and was transported to Brigham and Women's Hospital. It was reported to me that Officers Conary, Boyle, and Donovan were the first to arrive at the crash and provided life-saving care to Mr. Tchikou prior to being transported to Brigham and Women's Hospital. Officer Donovan responded to Brigham and Women's to keep us updated on Mr. Tchikou's status. The update provided to me while on scene was that Mr. Tchikou was in critical condition and in surgery. Due to the seriousness of the crash and potential fatal injury, Sgt. Devine contacted the Massachusetts State Police to assist in the investigation. Sgt. Mahoney and Trooper Paul responded as part of the Massachusetts State Police Crash Reconstruction team and conducted a supplemental investigation of the crash (MSP report 2020-CAR-000285). The location where the crash took place is Crafts Street and Waltham Street. Crafts Street and Waltham Street are public ways maintained by the City of Newton. Crafts Street and Waltham Street are municipal roadways that support two way travel for motor vehicles and bicycles with an unprotected median in the middle of both roadways to separate the direction of travel. This intersection was recently re-paved within the last month and has newly painted street markings including crosswalks, dedicated bicycle lanes, and stops lines at the intersections. Crafts Street at this intersection features two travels lanes. I observed the road surface to be dry at the time of my arrival on scene. The north lane in the westbound direction of Crafts Street permits travel straight ahead and also permits motorists/bicyclist to take a right turn onto Harding Street. The south lane in the westbound direction of Crafts Street is a dedicated left turn only lane that coincides with a left turn only arrow on the traffic signal in the middle of the intersection. The opposite side of Crafts Street permits traffic traveling in the eastbound lane to travel straight or take a left turn onto Harding Street from is a single lane travel lane. The area is well lit featuring street lights bright enough to illuminate the intersection for motorist traveling through the area. The weather at the time of the crash appeared to be clear. In the intersection where the crash took place, I observed a large debris field comprised of parts from a 2020 Tao Tao motorized scooter (49CC) and a 2007 Chrysler Town and Country (MA: 5EE316). I observed the motorized scooter (VIN: L9NTCBAG1L1010287) resting on its side facing North in the northbound lane of Crafts Street in the intersection. The motorized scooter has significant damage to its front, right, and left side and was inoperable. The area in the immediate vicinity of the motorized scooter was saturated with gasoline. The rear lights and dash of the motorized scooter were illuminated while I was observing the crash scene. The headlights were not intact due to the impact from the crash and I was unable to determine if they were functioning. The motorized scooter was removed from the roadway by Tody's Towing. The intersection where the crash took place had numerous first responders present immediately after the crash rendering aid to Mr. Tchikou prior to his transport to the hospital. It was reported by officers on scene that some of the items and debris in the intersection had been moved from their initial place of rest after the crash took place. A black MMG helmet was observed resting on the ground outside the debris field from the crash before the westbound left turn only lane of Crafts Street. It is unknown if it was moved from its initial place of rest by a first responder. I observed the strap on the helmet that would be used to secure it to the operator to be in good operable condition. I did not observe it to be defected and the securing feature of the strap was in working order. I did not observe any blood, hair, or other apparent physical evidence inside the helmet that would be consistent with the head injury reported to the operator of the motorized scooter. I observed what appeared to be fresh markings on the front mouth/nose area of the helmet. I observed a white Iphone with a red phone case lying on the roadway a short distance away from the impact area. The Iphone was on and displaying travel directions from the Iphone application Waze. The Iphone and the helmet were seized pending the status of the operator of MV2. A property/evidence form was completed and the Iphone and helmet were secured in property locker number 9. I spoke with the operator of MV1, William Moran (S34946215). Moran stated he was operating his white 2007 Chrysler Town and Country (MA: 5EE316) on Crafts Street (N) as he approached Waltham Street. Moran stated he had a green light and activated his left blinker as he approached the intersection with the intention of taking a left turn onto Waltham Street. Moran stated as he proceeded to take his left turn he saw "orange" and was unable to avoid hitting the object in front of him. Moran stated the object came out of nowhere and he swerved to the left in an attempt to avoid the crash. Moran stated after the collision he accelerated away from the impact area and came to a controlled stop on Waltham Street (S) just past the intersection. Moran stated he exited his vehicle and looked back at the intersection he had just travelled through. Moran stated as he began walking towards the intersection he observed a party laying on the roadway in the intersection. Moran stated the party was not wearing a helmet at this time. Moran also added that he believes the moped involved in the crash did not have its headlights on prior to impact. Moran stayed on scene and cooperated fully with officers during the investigation. A query of Moran's license and registration status through Newton Police Dispatched showed they are both active. I asked Moran if he was using a cell phone, GPS, or any other type of hand held device prior to the crash. Moran stated he was not. I asked Moran if he was distracted by anything either inside the vehicle or something on the roadway prior to the crash. Moran stated he was not. I asked Moran if he was currently impaired in any way that would impede his ability to operate a vehicle safely. Moran stated he was not. I asked Moran if he takes any medications or has a medical condition that would impede his ability to operate a vehicle safely. Moran stated he does not. Moran reported no injuries as a result of the crash. I observed Moran's vehicle at its controlled rest location. The vehicle was parked on Waltham Street (S) in the southbound lane just past the intersection of Crafts Street. The 2007 Chrysler Town and Country (MA: 5EE316) had substantial damage to the front passenger side bumper, hood, fender, windshield, and passenger door area. There was physical evidence of what appeared to be hair, blood, and tissue presumed to be from the operator of MV2 present in the cracked windshield, and on the passenger side door/mirror area. I observed a blue Commonwealth of Massachusetts "R" inspection sticker with a date of 05/28/2020 affixed to the windshield. Moran stated the rejection sticker was a result of an emissions failure. The inspection sticker expires in 2021. I asked Moran if there were any other mechanical issues with the vehicle. Moran stated there were no issues to his knowledge. I observed no objects present inside the vehicle during my investigation that would have potentially impeded the operators ability to see clearly through the windshield. I observed glass debris from the windshield inside the passenger and driver area of the vehicle. There was no air bag deployment inside the vehicle. Subsequent to my investigation, the vehicle was seized pending the status of the operator of MV2. The vehicle was towed from the scene by Tody's towing and secured in the Newton Police Department garage. The vehicle was escorted to the garage by Officer Donovan. A towed motor vehicle form was completed by Officer Donovan and the key for the vehicle was secured in property locker number 9. A property/evidence form was completed. Subsequent to my investigation Moran's black Alcatel cell phone was seized pending the status of the operator of MV2. A property/evidence form was completed and the phone was secured in property locker number 9. Officer Conary stated to me that prior to my arrival on scene she interviewed a witness to the crash and provided me with the following information. Joshua Hamel was operating his vehicle (W) in the right lane of Crafts Street towards Waltham Street. Hamel stated that MV1 (MA: 5EE136) was in the left turn lane on Crafts Street (W) towards Waltham. Hamel stated the scooter was headed eastbound on Crafts Street from Waltham. Hamel stated MV1 began to take a left turn and there was a head on collision with the scooter. Hamel stated he believed the traffic light at the time of the crash was green. On Friday, October 9, 2020, I spoke with Hamel via telephone. Hamel corroberated the statement he gave to Officer Conary. I asked Hamel if he believed the headlights on the motorized scooter were activated at the time of the crash. Hamel stated he believes the headlights on the motorized scooter were on as it approached the intersection but was not postive. On Wednesday, October 7, 2020, I spoke with Mr. Tchikou in his ICU room at Brigham and Women's Hospital. Tchikou's wife, Yami Carrajza, was present in the room while I spoke with him. Tchikou stated he had a significant head injury, injuries to his nasal cavity, his back, and a significant injury to his left leg. I asked Tchikou about his recollection of the crash. Tchikou stated he had just left his friend's home on Hazelhurt Avenue in Newton and was traveling home to Brighton to bring his wife dinner. Tchikou stated he was traveling Eastbound on Crafts Street as he approached the intersection of Crafts Street and Waltham Street. Tchikou stated he had a green light and as he entered the intersection a white vehicle took a turn from the opposite side of the road in front of him. Tchikou stated he does not remember anything after that. I asked Tchikou if he was wearing a helmet at the time of the crash. Tchikou stated he was. I explained to Tchikou that I recovered a white Iphone with a red case at the scene of the crash. Tchikou identified the Iphone as his. I explained that the phone was displaying travel directions when I found it and I asked Tchikou if he was distracted by his phone prior to the crash. Tchikou stated he was not distracted by the phone and the phone was in a holder on the motorized scooter. I asked Tchikou if he remembers if his headlights were activated on his motorized scooter at the time of the crash. Tchikou stated they were on. I asked Tchikou if he could produce paperwork for the motorized scooter to prove he was the owner. Tchikou stated he had recently purchased the scooter and the paperwork for it was at his residence. Tchkou's wife e-mailed me a picture of the Certificate of Origin for the motorized scooter. I asked Tchikou if he could produce a license or permit that would allow him to operate the motorized scooter. Tchikou stated he did not have a Massachusetts license or permit, but had an Algerian license at this residence. I was able to observe a picture of the license on his wife's cell phone. The written text on the license was in Arabic. Tchikou did not have a translation of the license in English and did not possess an International Driver's Permit. As a result of my investigation, Mr. William Moran while operating MV1 (MA: 5EE316) entered the travel lane of MV2 (Tchikou) as he was making a left turn onto Waltham Street from Crafts Street. MV2 had the right of way and MV1 failed to yield to MV2's right of way causing the collision to take place. Moran was advised of my investigation and issued Massachusetts Uniform Citation T0115914 via mail by request for Chapter 90, Section 8 (Fail To Yield To The Right Of Way At An Intersection.) Mr. Nadhir Tchikou operated his motor scooter at the time of the crash without a valid license/permit. Tchikou is also in violation of operation of a motor scooter after dark (prohibited). The crash occurred at 2147 hours. Tchikou will be issued Massachusetts Uniform Citation T0115915 in hand at Brigham and Women's Hospital for Chapter 90, Section 1E (Unlicensed Operation Of A Motor Scooter) and Chapter 90, Section 1E (Operation Of A Motor Scooter After Sunset - Hours Restriction.)

On Thursday, October 15, 2020, while assigned to Traffic unit N525, I responded to the Whole Foods parking lot entrance located at 916 Walnut Street, Newton for a report of a motor vehicle/bicycle crash. Walnut Street is a public way maintained by the City of Newton. The weather at the time of the crash was clear and sunny. The road surface was dry. I spoke with the operator of MV1, Tyrone Powell. Powell stated he was operating his 2016 Toyota Highlander (MA: VTT188) while traveling across Walnut Street (E) from Carthay Circle. Powell stated there was a strong sun glare at this time on his passenger side. Powell stated as he entered the Whole Foods parking lot entrance, the passenger side of his vehicle collided with a passing bicyclist that was traveling northbound on Walnut Street. Powell reported no injuries. I observed damage to the passenger side hood/fender of MV1. I spoke with the bicyclist involved in the crash, Scott Chamberlain. Chamberlain stated he was operating his bicycle on Walnut Street (N) in the marked bicycle lane near the entrance to the Whole Foods located at 916 Walnut Street. Chamberlain stated he had a bicycle helmet on at this time. Chamberlain stated that he observed a vehicle to his left travel across Walnut Street in front of him into the Whole Foods parking lot. Chamberlain stated he was unable to avoid crashing into him. Chamberlain reported minor injuries and signed a patient refusal with Newton Medics. I observed no substantial damage to his red Specialized bicycle. Photos were taken and submitted to the IT Bureau. While on scene, Officers did notice a strong sun glare coming from the Southeast direction of Walnut Street. This glare would have shined on the passenger side area of MV1 as it crossed Walnut Street.

MV1, operator:Oscar Benavidez was driving Eastbound on Beacon St and was attempting to turn right on to Chestnut St when he struck a bicyclist. MV1 stated "He was moving to the right side of the roadway to go around a vehicle that was making a left turn at Beacon and Chestnut. He didn't see a bicylist and heard something hit his car and that's when he stopped and observed a bicyclist on the ground". The bicyclist Jeffery Glassman complained about his right side being sore, but had no other visible injuries. He stated "he was riding his bike on Beacon St and about to be entering the intersection at Beacon and Chestnut when a vehicle pulled to the right and hit him" He signed the refusal on scene with EMS. No damage was done to MV1. Corrina Mieth witnessed the accident and stated "She observed the vehicle move over to the right side of the road and that's when the vehicle collided with the bicyclist". Pictures were taken of the scene.

Operator of vehicle one ( MA reg 1HK920 2010 Toyota Tacoma ) Brian Robidoux stated that on 11/06/2020 at 14:49 hours he was driving west bound on Auburndale Ave near Lexington St. Both Auburndale Ave and Lexington St are public ways in the City of Newton. Robidoux stated that west bound traffic had a green light at the intersection of Lexington St, and that north and south bound traffic on Lexington St had a red light. Robidoux stated that as he turned his vehicle left into the north bound lane of Lexington St was hit on the front driver's side quarter panel by motorized bicycle that did not stop for the red light. Robidoux stated that he was not injured in the crash and his vehicle did not required a tow. The operator of the motorized bicycle Arif Ahmed stated that he was riding north bound on Lexington St on a Lectric XP motorized bicycle. The vehicle that Ahmed was riding on meets the definition of a moped set forth by MGL 90/1, specifically that it's top seed was not in excess of 30 MPH. According to the owners manual that I found on line the top speed for the Lectric XP is 20 MPH. Ahmed stated that he believed that north bound traffic on Lexington St had a green light but he could not be sure. Ahmed also stated that he was unfamiliar with the area and it traffic patterns. Ahmed stated that he saw Robidoux vehicle and thought it would stop. Ahmed stated that at the time of crash be estimated that he was travailing approximately 12 MPH. Ahmed was transported via EMS to Newton Wellesley Hospital form treatment of lacerations to his hands, legs and possible internal injuries. During the investigation of this crash I discovered via the MA RMV data base that Ahmed's driver's licenses was suspend on 10/05/2020 as a part of a CWOF for 90/24 OUI . Ahmed is on active probation of out Natick Distinct Court until 09/24/2021. Under Comm v. Lopez 91 Mass App. Ct. 485 ( 2017 ) the charge for operating a moped with a suspended license should be charged as 90/10 , operating with out a license as opposed to 90/23 operating with a suspended licenses. Under MGL 90/1d moped must have one number plate issued by the MA RMV , and Ahmed's moped did not. I took photos of Robidoux's vehicle and of Ahmed moped and the disk was downloaded by the NPD's IT Bureau. Based upon statements made to me as well as information from the MA RMV data base I issued Ahmed MA Criminal Application T2015903 and cited him for MGL 90/10, operating with out a license, 89/9 failure to stop for a red light and 90/1d, unregistered moped.

MV1 stated she was on Watertown St heading w/b and "stopped, then turned left onto Adams St when the bicycle hit me." I observed minor damage to the driver's side front bumper, however the operator stated that she "did not know if that was old or new." I asked the operator if the bicycle was coming towards her or was travelling next to her to which both she and a witness stated "alongside on the left by the yellow lines." No tows required or injuries reported. The bicyclist stated he was travelling e/b and not w/b on Watertown St as the witness and operator of MV1 reported. The bicyclist further stated that MV1 was "stopped" in the intersection so "I continued straight and she turned right into me." The bicyclist further stated that he remembers seeing the "headlight and drivers side front hit the back of my bike." The bicycle was heavily damaged and the rear wheel was broken off. The bicyclist was placed in a c-spine collar by Cataldo Ambulance and transported to Newton Wellesley Hospital for abrasions to his head, left hand and right leg." Digital images of the scene were captured and turned over to the IT Bureau by Ofc Durickas. The bicyclist had a helmet, headlight, rear light and was wearing reflective clothing. It should be noted that the Village Bank has a camera which faces this intersection. Due to both MV1 & the bicycle being moved from the scene prior to my arrival, the conflicting stories regarding the direction of travel regarding the bicyclist, it is unknown at this time who is at fault.

Operator of vehicle one Timothy Trencher stated that on 12/01/2020 at 08:36 hours he was driving his vehicle a 2010 Toyota Prius east bound on Linwood Ave near Walnut St. Linwood Ave and Walnut St are public ways in the City of Newton. Techler stated that he came to a stop at the stop sign at Walnut St and then turned left into the north bound lane of Walnut St. Techler stated that he did not see any on coming traffic , bicyclist or pedestrians in the roadway before he turned into the north bound lane of Walnut St. Techler stated that his vehicle's front bumper made contact with a bicycle ridden by Nicolas Le ( DOB 04/05/2006 ) . Techler stated that he was not injured and his vehicle did not require a tow. Le stated that he is a student at Newton North High School and was riding his bike a Giant mountain bike to school. Le stated that he was stopped on his bike on the northeast corner of the intersection of Linwood Ave and Walnut St. Le stated that he saw a pedestrian latter identified as Jason Kaufman walking west bound in the crosswalk from the east side of Walnut St to the west side of Walnut St. Le stated that as Kaufman was crossing over Walnut St he assumed that it was clear to cross over Walnut St while riding his bike. Le stated that he was unsure if the yellow flashing crosswalk lights were activated. Le stated that he rode his bike off of the side walk at the northeast corner of Walnut St at Linwood Ave. Le stated that he did not ride his bike in the marked crosswalk that run from east to west over Walnut St at Linwood Ave. Le stated he rode his bike diagonally into the intersection towards the south west corner of the intersection. Le stated that he did not see Techler's vehicle prior to entering the intersection. It should be noted that at the time of the crash Le was wearing earphones and stated the he was listening to music. Le stated that he was not injured in the crash and signed a patient refusal from in the presence of his father Thanh Le who responded to the crash scene. Le's bike had damage to the front tire and front breaks. Based upon statments made to me by Le, Techler and my observations of the crash area, I believe that they both bear responsibility for the cause of the crash. Le was not in a marked crosswalk and was not sure if the flashing yellow crosswalk lights were activated. Le also was listening to earphones while crossing diagonally into the intersection. I issued Techler MA Unifrom Citation T2015904 and cited him for a violation of MGL 90/14 , failure to yield to a bicyclist while turing left.

The operator of MV1, Baruch Ticho, stated that he was traveling Northbound on Waverly Avenue and came to a complete stop at the stop sign before attempting to take a left turn onto Washington Street. Mr. Ticho stated that he did not see the bicyclist at anytime because she was wearing all dark clothes and collided with her while attempting to turn. The bicyclist, Ellen Messing, stated that she was traveling East on Washington Street in the marked bike lane and believed MV1 saw her and was letting her pass. The MV continued on after stopping at the stop sign and t boned her bicycle. Ms. Messing had no visible injuries but stated she had leg pain and was transported to the BI. Ms. Messing's bicycle sustained major damage so I transported it to the station and secured it in support services to be picked up by Ms. Messing. MV1 sustained minor driver side and front bumper damage and was driven from the scene. Officer Stake took photos of the scene which were submitted to IT to be attached to the report.

Operator of MV1 states he was traveling westbound on Commonwealth Ave when he attempted to take a left turn onto Fuller Street and struck a bicyclist who was traveling eastbound on Commonwealth Ave. Operator of MV1 states he didn't see the bicyclist due to the solar glare from the sun obstructing his view of the roadway. It should be noted the sun was setting in the west at this time. MV1 sustained minor damage to the windshield and front right fender. No injuries reported by the operator of MV1. The bicyclist, Martin Pleynet, states he was riding his bicycle eastbound on Commonwealth Ave traveling towards the Boston College area when he was struck by MV1. Mr. Pleynet states he doesn't have recollection of the accident since he lost consciousness for a brief time after being struck. Mr. Pleynet was transported to Brigham and Women's Hospital where he sustained a fractured left shoulder, abrasion on his right shin and abrasion on his forehead. The bicycle sustained damage to the front wheel and was placed into property and evidence for safekeeping. Pictures of the scene were captured and the SIM card was submitted to the IT bureau.

Operator of vehicle one stated that while driving west bound on Washington St at Elm St a bike came off of the south bound sidewalk of Elm St and into the front passenger side of his vehicle. Operator of vehicle one stated that west bound traffic had a green light and that he had just began to drive from a stop when the crash occurred. Operator of vehicle one was not injured and his vehicle had no damage. Both passengers of vehicle one confirmed vehicle's one operators statements. Witness stated that she was in her vehicle west bound on Washington St behind vehicle one when the bike came off of the north bound Elm St sidewalk and into the front passenger side of vehicle one. Witness stated that west bound traffic had a green light. Bicyclist stated that he believed the red light that he saw for north bound elm St traffic was for west bound Washington St traffic, so he proceeded into vehicle one's lane of traffic. Bicyclist was not injured and his bike had no damage. Bicyclist refused medical treatment at scene and singed a patient refusal form. Due to the bicyclist entering onto Washington St when they did not have the right of way and then riding on the sidewalk in violation of a City Ordnance, he is at fault for the cause of this crash.

Narrative:
On 04/29/2021 at 15:22 hours I was dispatched to 53 Brentwood Ave for a report of a motor vehicle crash involving a bicyclist. Upon my arrival, I made the following observations of the crash scene. Brentwood Ave is a two way non divided public way in the City of Newton that runs east to west from Greenlawn Ave to Walnut St. Brentwood Ave is a thickly settled residential area with a 25 MPH speed limit. The roadway conditions at the time of the crash were wet due to rain. I observed MA reg 111ZS1 a 2020 Honda Civic parked on the side of Brentwood Ave just passed the intersection of Judith Rd facing westbound. I observed that the Honda had damage to it's front driver's side bumper. When I inspected the Honda I observed that the driver's side headlight casing was cracked and a piece of it was missing. I further observed an approximately six inch in diameter spider web like crack in the lower driver's side windshield. The windshield crack was inward , indicating that an external object had caused the damage. There was another single crack onn the driver's side windshield that extended from the hood to the roof. The operator of the Honda , Lisabeth Ioannilli stated that on 04/29/2021 at 15:20 hours she was driving westbound on Brentwood Ave near the intersection of Judith Rd. Ioannilli stated that she estimated that the speed of her vehicle was approximately 25 to 30 MPH. Ioannilli stated that she did not see a bicyclist in her path of travel until the point of impact when her vehicle was aproximately 3/4 of the way passed the intersection of Judith Rd. Ioannilli stated that her vehicle's front driver's side bumper made contact with the bicyclist. Ioannilli stated that the bicyclist was tossed off of her bike and onto the hood and windshield of her vehicle before rolling onto the ground. Ioannilli stated that she pulled her vehicle to the side of the road and went to check on the bicyclist. Judith Rd is a public way in the City of Newton that runs east and then turns south from Walnut St to Brentwood Ave. There are no traffic control devices at the intersection of Judith Rd and Brentwood Ave. Ioannilli stated that she was not injured in the crash and her vehicle did not require a tow. At the crash scene, the bicyclist , Lucia Campbell, a student a FA Day Middle School ( DOB 11/08/2006 ) was being treated in an ambulance and was transported to Boston Children's Hospital for treatment. Campbell was conscious and was able to answer questions from EMS members. Campbell stated that she was wearing a helmet at the time of the crash and that she rode her bike south on Judith Rd and was turning eastbound onto Brentwood Ave when the crash occurred. I spoke with Campbell's parents Adam Campbell and Iris Delasota who stated that their daughter was under going x rays and other tests to determine if she has internal injuries. I took photo's of the bike, Honda and crash scene and the disk was downloaded by the NPD's IT Bureau. Based upon my investigation of this crash I concluded that Ioannilli was at fault for it. I issued via US mail Ioannilli MA Uniform Citation T1446633 and cited her for a violation of MGL 90/14 failure to use care while approaching a bicyclist. Campbell's bike was turned over to her parents at the crash screen.

Narrative:
Bicyclist Michael Foley stated that on 05/11/2021 at approximately 22:00 hours he was riding his Blanch mountain bike west bound near 2401 Commonwealth Ave when he was struck from behind by an unknown vehicle. Commonwealth Ave is a public way in the City of Newton. Foley stated that he was thrown from his bike and onto the roadway. It should be noted that the section of Commonwealth Ave were the crash occurred is not lit. At the time of the crash Foley was wearing dark non reflective clothing. Foley was not wearing a helmet or any other safety equipment at the time of the crash. Foley stated that he did not see what type of vehicle struck him from behind and could not offer any other description. Foley was discovered laying in the roadway by a Good Samaritan at 22:08 hours. Upon inspection of Foley's bike I observed that the rear tire and rear fender was bent inward to the left side. I further observed that Foley's bike had no reflective materials affixed to it. Foley stated he did not lose consciousness as a result of the crash. Foley was transported via EMS to the Beth Israel Hospital in Boston for treatment. I respond to the Beth Israel Hospital and Foley again reiterated what he had stated at the crash site, about not having any description of the vehicle that struck him. The staff I spoke with at the hospital stated that Foley had a possible broken shoulder and/or collarbone and abrasions to his hands and legs. Foley's bike and a bag of his possessions were secured at Support Services at the station and Ofc Fay filled out a property form. During a canvass of the crash site no physical evidence from a vehicle was observed. I also observed no skid marks on the roadway. There were no cameras in the area. Due to the lack of physical evidence ,and no witness to this crash I believe that the operator of the vehicle that struck Foley may not of even been aware that a crash occurred. It should be noted that over the past 18 years I have had numerous interactions with Foley, and I know that he is homeless and has resisted any aid from social service agencies. Foley is know to camp in the Town of Weston in woods adjacent to the Massachusetts Turnpike. From pass reports Foley has used Harris Cycles at 1351 Washington St Newton, and the law firm of Jason and Fisher at 47 Winter St Boston as contact locations.

Operator of vehicle one Ziting Liu stated on 05/14/2021 at approximately 17:38 hours she was driving west bound on Commonwealth Ave in her vehicle a 2015 Honda CRV ( MA reg 497yy1 ). Liu stated that she was driving into the setting sun and was wearing sunglasses at the time. Liu stated that as she approached the four way intersection with Chestnut St she observed that west and east bound traffic on Commonwealth Ave had a green light and that north and south bound traffic on Chestnut St had a red light. Liu slowed her vehicle to turn left onto the south bound lane of Chestnut St. It should be noted that both Commonwealth Ave and Chestnut St are both public ways in the City of Newton. Liu stated that she did not observed any " cars " driving east bound on Commonwealth Ave so she proceed to make the left turn onto Chestnut St. Liu stated that she realized that her vehicle has struck an unknown object as she was turning left. Liu stopped her vehicle and saw that her vehicle had struck a female bicyclist. Liu stated that the bicyclist was thrown from their bike and was on the ground. Liu stated that she was not injured as a result of the crash. Liu's vehicle had damage to the front passenger side hood . The front passenger side of Liu's windshield had an inward crack that was approximately 12 inches in length and 12 inches in width. The type of inward crack on the windshield is indicative of an outside force making contact with it. Liu's vehicle was towed by Tody's Services to their lot for storage. I filled out a towed motor vehicle form. Bicyclist Isabella Turinovic stated that she was ridding her bike , east bound on commonwealth Ave near Chestnut St. Turinovic stated that east bound traffic had a green light. Turinovic stated that as she was crossing over Chestnut St Liu's vehicle struck her causing her to hit the windshield. Turinovic was tossed from her bike and onto the roadway. Turinovic was wearing a helmet at the time of the crash. Turinovic stated that she did not lose consciousness and she was transported to Newton Wellesley Hospital via EMS from treatment . Turinovic agreed to have her bike taken by NFD Ladder One to be stored at NFD station Two. I took photo's of Liu's vehicle, Turinovic's bike and the disk was downloaded by the NPD IT Bureau. Witnees Alexander Delima stated that he was the first vehicle stopped a red light on Chestnut St in the south bound lane. Delima stated that Liu's vehicle did not yield to Turinovic as she turned left onto the south bound lane of Chestnut St from the west bound lane of Commonwealth Ave .A second witness Lindsay Bentis stated that she was the second vehicle stopped a the red light in the south bound lane of Chestnut St behind Delima. Bentis stated that she also saw Liu fail to yield to Turinovic as she turned onto Chestnut St. Based upon statements made to be by all involved parties, I concluded that Liu is at fault for this crash. I issued via U.S. Mail, Liu MA Uniform Citation T1446670 and cited her for a violation of MGL 90/14, failure to yield to oncoming bicyclist when turning left.

On May 16, 2021 at approximately 13:17 hours I, Officer Guarino responded to a motor vehicle crash into a bicycle. Upon arrival I spoke with the cyclist who said that he was traveling southbound on Centre St. on the sidewalk on the left side of the roadway. He stopped at the intersection of Boylston St and Winchester St at the crosswalk and saw began to cross the roadway in the crosswalk when he was struck by MV1. He said that MV1 "yielded" but didnt really stop. he said that she came to a slow roll and then struck him. He made contact with the front right side of the vehicle, hit his left elbow on the hood and then fell to the ground where he struck his head. The operator of MV1 said that she came to the stopsign at Boylston St and Centre St, stopped, looked both ways and then took her foot off the brake to make a right turn onto Centre St when she noticed she struck the bicyclist. She did not see him prior to the crash. She said that upon impact, he let the bike down slowly and fell to the ground but doesn't believe that he had hit his head. Cyclist was evaluated by the medics for an arm injury and head injury but refused further medical attention. Both parties were issued report numbers and advised that a report would be on file. Photographs of the vehicle and bicycle have been submitted to IT to be attached to this report.

This accident was reported approx. 8 hours later due to reporting party not familiar with laws in the U.S. Bicyclist #1 doesn't speak English well and needed her husband (Siarhei Byk) to translate. Bicyclist #1 stated on 05/17/2020 at approx. 1600 hrs., she was travelling southbound on Chestnut Street on the sidewalk. While crossing Anita Cir, MV#1 approached the intersection and collided into her. She was thrown onto the hood of MV#1 as a result of the collision. The OP. of MV#1 helped her into his car and drove her home. The OP. of MV#1 only gave her a business card and nothing else. The husband of Bicyclist #1 came home later and drove Bicyclist #1 to the hospital to be checked out. The husband of Bicyclist #1 called the OP. of MV#1 to get some car insurance information and was denied. The OP. of MV#1 stated he felt uncomfortable giving that information and they would talk the next day about it. The husband of Bicyclist #1 felt this was strange and decided to report it to the police after getting out of the hospital. Bicyclist #1 was wearing black pants and a blue shirt. She did not have a helmet on and didn't have any reflective clothing on. She sustained bruising to both legs and didn't get a concussion. Her bicycle gears and her wheel was damaged from the accident and pictures were taken by me. The brand of the bicycle is Infinity Hybrid and it cost approx. $350.00 USD when new. Bicyclist #1 describes the OP. of MV#1 as a white male around 50's - 60's years of age. She describes the vehicle that struck her as a red SUV. The OP. of MV#1 gave a business card with the name Ruth Robart out of 28 Richardson Rd., Newton 617-818-8660. Further investigation revealed a Ralph Robart out of that address with a similar age. Due to the time of night, the investigation would be postponed to daylight hours. At approx. 1550 hrs., I made contact with the OP. of MV#1. He stated he was stopped on Anita Cir., waiting to make a right turn onto Chestnut Street. When there was no more oncoming traffic to his left, he looked to the right and saw it was clear as well and started to accelerate. That's when Bicyclist #1 suddenly rode out from the sidewalk and they collided together. There's a 6 foot wall from a residence that blocked his vision to see further down the sidewalk. The OP. of MV#1 stated there was no damage to his vehicle.

Operator of MV1 states she was traveling eastbound on Canterbury Rd approaching the intersection at Waldorf Rd when a bicyclist appeared out of nowhere traveling from Waldorf Rd northbound, didn't attempt to stop at the intersection and struck MV1 in the front right fender and windshield. Operator of MV1 remained on scene until emergency personnel arrived. The juvenile bicyclist, Daniel Yeo, states he was riding his bicycle with a helmet on northbound on Waldorf Rd approaching the intersection at Canterbury Rd when he saw MV1 enter the intersection and struck MV1 with his bicycle in the front right fender where he went over the bicycles handlebars landing on the roadway. Daniel states he attempted to apply the brakes, but realized it was too late and made contact with MV1. Medics evaluated Daniel for injuries where he complained of head and stomach pain. Daniel was transported with his mother, Jennifer Wu, to Mass General Hospital. Pictures were taken of the scene and submitted to IT to be attached with this report.

Operator of vehicle one Kathryn Packman stated that she was driving westbound on Dedham St near Winchester St. Packman stated that she had a green light and began to turn left into the southbound lane of Winchester St. Packman stated that as she turned left a bike that was travelling southbound in the northbound lane of Winchester St went through the red light and struck the front passenger side fender of her vehicle. Packman stated that there was a solar glare as she turned left. Packman stated that she did not see the bicyclist prior to the crash. Packman stated that she was not injured . Packman's vehicle had a small dent on it's front passenger side fender. Bicyclist Paul Cannon stated that he was riding his bike southbound on Winchester St in the northbound lane against traffic. Cannon stated that he was riding against traffic because he was scared of the north side of the intersection of Winchester St at Dedham and Needham Streets. Cannon stated that he did not look at the traffic signal to see if he had the right of way because he wanted to focus on the road. Cannon stated that he assumed that Packman's vehicle wold stop for him. After the crash Cannon fell from his bike and onto the roadway. Cannon was treated at the scene by Newton EMS for minor abrasions to his left arm and left leg. Cannon refused further medical aid and signed a patient refusal form. Cannon's bike was not damaged in the crash. I took photos of Packman's vehicle and forwarded the disk to the NPD's IT bureau for downloading. Based upon statements made to me by Packman and Cannon , I believe that Cannon is at fault for the crash because he failed to see if he had the right way.

On 06/02/2021 at 19:19 hours I was dispatched to 21 Hale St for a report of a past MVA involving a bike. Upon my arrival I spoke with Jason Lobell who stated approximately three and a half hours prior at 15:50 hours he was moving his vehicle MA reg 1CTG62 a 2017 Toyota Corolla from where it was parked on Hale St into his driveway at number 21. The Toyota was parked across from number 21 facing north bound. Lobell stated that as he was turning left into his driveway at approximately 5 MPH a male bicyclist that was riding north bound on Hale St attempted to pass his vehicle on the left. Lobell stated that the bicyclist drove into the front drivers side of his vehicle. Lobell stated that the impact of the bicyclist riding into his vehicle caused the driver's side mirror to be damaged. Lobell stated that the bicyclist did not stop and did not exchange any information. The only description that Lobell had of the bicyclist was a male of an unknown race that was approximately 20 years of age. I canvassed the area with negative results. As of the writing of this report at 21:00 hours on 06/02/2021 no bicyclist has reported being involved in a MVA in the area of 21 Hale St.

Bicyclist Cory Small stated that on 06/10/2021 at 17:48 hours he was riding his Specialized carbon frame bike in the westbound bike lane on Beacon St near Garland Rd. Beacon St and Garland Rd are both public ways in the City of Newton. Small stated that westbound Beacon St traffic was stopped at the intersection of Walnut St. Small stated that he continued riding westbound in the bike lane while traffic was stopped. Small stated that as he was crossing over the intersection of Garland Rd. when a vehicle that was driving in the eastbound lane of Beacon St turned left onto the northbound lane of Garland Rd and into his path of travel. Small stated that when the vehicle turned onto Garland Rd it caused him to crash into the rear passenger side of it. As a result of the crash Small had lacerations to his left hand and leg. Small's left ankle became swollen due to the crash. Small was transported via EMS to Newton Wellesley Hospital for treatment. Small was wearing a helmet at the time of the crash. Operator of vehicle one ( 2012 Volvo XC70 MA reg 2FJK50 ) Matthew Ristuccia stated that he was driving eastbound on Beacon St and was turning left onto the northbound lane of Garland Rd when the crash occurred. Ristuccia stated that he did not see Small prior to the crash. Ristuccia stated that he and his two sons who were passengers were not injured. Ristuccia's vehicle had minor scrape marks on the rear and center passenger side. I took photos of Ristuccia's vehicle and the disk was downloaded by the NPD's IT Bureau. Small's bike had damage to the left hand brake, and possible frame damage. Based upon statements made to me by Small and Ristuccia and my observation of the vehicle and bike, I issued Ristuccia MA Uniform Citation T1447316 and cited him for a violation of MGL 90/14 , failure to yield to an oncoming bicyclist when turning left. I explained to Ristuccia his payment and appeal options.

On 06/14/21 at approximately 12:00 hours, Sgt. Wade received an email from Nina Wang (D.P.W. Transportation Traffic Superintendent) that a city utility trailer with a signboard attached to it was struck by another motor vehicle at 275 Brookline Street sometime over the weekend between 06/11/21 and 06/14/21. A photo was sent over in the email of the utility trailer and signboard knocked over on it's side over the sidewalk. The utility trailer is 2020 Wanco color orange bearing MA Official registration # M9994A. The trailer was parked in the bicycle lane of the northbound travel lane next to 275 Brookline Street. The signboard was there in an attempt to get motorists to drive the speed limit due to the Memorial Spalding School located at 250 Brookline Street. On 06/14/21 at approximately 12:00 hours, I responded to Brookline Street to photograph the trailer and possibly process the scene. The trailer could not be located. I learned later that the trailer had already been towed by Tody's towing and brought to the City D.P.W. yard located at 110 Crafts Street. On 06/15/21 at approximately 09:00 hours, I went over to 110 Crafts Street and was told that the trailer/signboard was in the garage. The trailer was already being repaired to be placed back in to service. It had sustained damage to the two rear brackets where the jacks are located and the license plate bracket and registration plate were bent. The signboard message frame board is no longer aligned properly as a result of the accident but reportedly still functions. After, I then responded back to 275 Brookline Street and took digital photos of the scene. I observed in the bike lane at the accident scene two small pieces of lens covers to a vehicle with no identifying marks. I also did a canvass for possible surveillance cameras in the area. There was no response at number 269 and 275 Brookline Street but I left a note for them to call me. 283 Brookline Street has no surveillance cameras. Memorial Spalding School is across the street from the accident and I observed a camera on the side of the building which faces the staff parking lot on to Brookline Street. I spoke to a staff member Jesse Brackett at the school. He called David Stickney (Superintendent of Schools) and notified him of the accident. Mr. Stickney was provided with my email and will send over any possible footage if he has it. At approximately 12:45 hours, I spoke to Mike Sylvester who resides at 275 Brookline Street. He stated that he had surveillance footage and emailed it over to me. I viewed the footage which is a camera that views his approx. 75 foot driveway leading out to Brookline Street. There is a fence and bushes behind where the signboard is located which limits it's view. The video shows the accident took place on 06/11/21 at 18:48 hours. At this time, you can see the trailer is struck and slowly falls over on it's side. Immediately after a white colored four door sedan continues to slowly drive past the scene northbound on Brookline Street in the bicycle lane without stopping. Two other vehicles behind the white sedan drive around to the left of the white vehicle at this point. In the footage, you can not view the registration number, operator details, or the type of sedan from the footage. On 06/16/21 at 09:40 hours, I spoke to David Stickney who called the Traffic Bureau. He stated that he had footage of the accident but it did not reveal any other details besides the same white sedan striking the trailer.

On July 5th 2021 while assigned to NPHQ front desk, Jaden Chin DOB 4/5/05 came in with his father Michael Chin to report a past auto vs bicyclist accident. Jaden stated the accident occurred on June 19th at the intersection of Beacon St and Glen Ave. When I inquired as to the reason this was being reported several weeks after the incident itself, Jaden and his father originally told me that they thought it was the motorist's responsibility to report it. After a few minutes of conversation it was learned that the Chin family had recently been contacted by the insurance company of the involved driver, allegedly due to exterior damage on the vehicle exceeding cost expectations. I was then told that a verbal agreement had previously been made by all parties to handle any incurred costs (whether they be medical bills for Jaden or auto body bills for the vehicle) without involving insurance. The recent call from the insurance company prompted Michael and Jaden Chin to come in to file a report. I then advised them that although I will document a statement from Jaden, the circumstances no longer provide for a standard police crash investigation. Jaden stated he was riding his bicycle on the sidewalk of Beacon St heading westbound towards Newton Center, when he and a black Mercedes collided in a "t-bone" manner as the Mercedes was pulling out of Glen Ave to turn onto Beacon. Jaden stated he hit a passenger side door of the car when he was crossing Glen Ave, dropping to the ground on his bike after impact. He added that there were bushes blocking his view of Glen Ave and is not sure if he stopped before entering the roadway. Injuries reported are jaw pain and minor bruising. The driver left his information with Jaden and is identifed as Joowon Park DOB 6/15/88. He has an active license and CJIS has him listed as leasing MA reg 9EB432, a black Mercedes GLC. I attempted to call Park at the number provided to me by Jaden Chin with negative results. All streets mentioned are public ways in the City of Newton. The Chins were advised that a report will be on file documenting Jaden's statement, but that in the future they need to call police immediately after an incident like this occurs.

On 07/28/21 at 13:39 hours, I (Traffic Unit # 523) responded to 10 Cummings Road for a past hit and run motor vehicle bicyclist crash which occurred approximately twenty minutes prior. Dispatch updated units that the accident occurred at the intersection of Watertown and Walnut Streets and that a white colored SUV left the scene after striking the bicyclist. The white SUV was last seen heading southbound on Walnut Street towards Washington Street. The bicyclist then walked back home to 10 Cummings Road and told her mother about the incident. The mother then notified NPD. Watertown Street and Walnut Street are both public ways maintained by the City of Newton. It is a four way intersection with crosswalks on every side. There are no turn on red signs on every corner of the intersection. The weather at the time was partly cloudy and sunny and the road conditions were dry. On arrival at 10 Cummings Road, I spoke to the mother identified as Vanessa Cruz and her daughter, Angelique Cruz, who was involved in the crash. Fallon Ambulance was already on scene and a patient refusal was signed as Angelique did not have any injuries. I asked Angelique what had occurred and she stated that she left FA Day Middle School at approximately 13:00 hours. It is estimated that the crash took place between 13:10 and 13:20 hours. She was then bicycling down to the intersection of Walnut & Watertown Streets. She says that she pushed the walk signal button to cross the street at the crosswalk to continue southbound on Walnut Street towards Lowell Avenue. Once the cross signal light activated, she bicycled through the crosswalk. At the tail end of the crosswalk, her rear bicycle tire on the right side was struck by a white SUV making a right turn on to Walnut Street from Watertown Street. She was then knocked to the ground where she sustained a scrape mark to her left knee on her sweat pants. The white SUV continued southbound on to Walnut Street without stopping. She feels that the driver might of misjudged taking the right turn and never realized that she struck her. Angelique says she only saw a female operator in the SUV and could not determine the race or age. She also did not observe the registration on the vehicle. She further stated that a female assisted her up from the ground. Once she said she was fine she then proceeded home. No one else phoned 911 regarding the incident. At this point, I asked to see the bicycle which was stored away. The bicycle is a Schwinn Sidewinder 21 speed color black with lime green block style writing for the brand and model on it. Both tires have white reflectors attached to them. I observed no damage to the bicycle. At the time of the crash, Angelique stated she was wearing purple sweat pants, blue sweater, and no bicycle helmet. She was also carrying a black backpack attached to her rear shoulders. I took digital photos of Angelique along with her Schwinn bicycle. After, I went over to the intersection of Watertown and Walnut Streets and took photos of the scene. A canvass was also conducted that produced negative results. I observed no surveillance cameras on the buildings or residences that are near the intersection. At 109 Walnut Street, I spoke to several tenants in the six unit apartment complex and they have no security cameras. 583 Watertown Street has no cameras along with 592 Watertown Street. I also checked near the intersection of Walnut and Washington Streets as the white SUV was last seen heading in that direction. The Trio apartment complex along with other businesses are lined against both streets and have outside security cameras. I spoke to the leasing office and they stated that the cameras do not provide any coverage of the street area.

On 08/09/2021 at 13:56 hours I responded to the intersection of California St at Adams St for a crash involving a motor vehicle and a bike. California St and Adams St are both public ways in the City of Newton. Upon my arrival I was informed the bicyclist , Joshua Cohen was transported to Newton Wellesley Hospital for treatment . I spoke with Marco Diaz who stated that he was driving his 2004 Honda Pilot ( MA reg 1YEM63 ) east bound on California St near Adams St. Diaz stated that as his vehicle passed Adams St he heard a loud bump coming from the rear passenger side of his vehicle. Diaz stated that he looked into his rearview mirror and realized that something had crashed into his vehicle. Diaz stated that he stopped his vehicle had saw a male on a bike had crash into his vehicle. Diaz stated that he was not injured in the crash and his vehicle did not require a tow. I observed small scrape marks on the rear passenger side quarter panel of Diaz's vehicle. Cohen's bike was a Metakoo 26'' electric bike, that has a top speed of 20 MPH. Cohen's bike did not appear to have any damage on it and was secured at Cohen's residence. I spoke with Cohen at the ER at Newton Wellesley Hospital were he was waiting treatment for a laceration to his forehead and a possible concussion. Cohen stated that he "was going to fast and took a too wide of a turn" from the north bound lane of Adams St onto the east bound lane of California St. Cohen stated "I hit into him " ( Diaz ) . Based upon statements made to me by Diaz and Cohen and my observations of the crash area I belive that Cohen is at fault for this crash. I took photos of Diaz's vehicle and Cohen's bike, the disk was downloaded by the NPD IT Bureau.

On 8/10/2021 at approx 0851hrs while assigned to 497 I responded to the intersection of Washington St at Grove St for a report of a motor vehicle/bike crash with minor injuries. Upon arrival I met with Montgomery Curren a 15 year old adolescent male who related he was in the right travel lane w/b on Washington St crossing the intersection of Grove St when Ma Reg 3SN235 pulled in front of him taking a left from the e/b lane of Washington St onto Grove St. Curren was wearing a bicycle helmet, had minor scrapes and minor damage to his handlebars. I spoke with Triaca Fiorella who stated she was taking a left onto Grove St from Washington St, stopped to see if any cars were coming , when she saw no cars she took the left and Curren ran into the side of her car. Fiorella stated she believed Curren was "speeding" on his bicycle. Mass Uniform Citation T2015318 issued to Fiorella for violation MGL Ch 89 Sec 8 Fail to Yield Right of Way. Currens father , James Curren, responded to the scene to sign a patient refusal for Curren.

On 08/31/2021 at 17:02 hours I was dispatched to Hammond St at Lawrence Rd for a report of a MVA involving a van and a bike. Hammond St and Lawrence Rd are both public ways in the City of Newton. Upon my arrival I spoke with the operator of vehicle one Evandro Ribeiro. Ribeiro stated that he was driving his van ( MA commercial registration W13024 2016 Ford Transit van ) south bound on Hammond St near Lawrence Rd. Ribeiro stated that as he was turning right onto the west bound lane of Lawrence Rd a bicyclist struck the front passenger side door of his van. Ribeiro stated that he activated the right turn signal of his van before turning right onto Lawrence Rd. Ribeiro stated that he did not see the bicyclist prior to the crash. Ribeiro stated that he was not injured in the crash and his van had no damage to it. I also spoke with the bicyclist Kevin Recor who stated that he was riding his bike south bound on Hammond St near Lawrence Rd when Ribeiro's van turned to the right in front of him. Recor stated that he did not recall if Ribeiro's van had it's right turn signal activated before it turned. Recor stated he did not have enough time to stop before the crash. Recor suffered minor lacerations to his left arm and left leg as a result of the crash. Recor was evaluated by Medics at the crash scene and refused further medical aid. I took photos of Ribeiro's van and Recor's bike and the disk was downloaded by the NPD's IT Bureau. Based upon statements made to me by Ribeiro and Recor I issued Ribeiro MA Uniform Citation T2016946 and cited him for a violation of MGL 90/14, failure to yield to a bicyclist when turning right.

Upon arrival, I observed vehicle 1 (Massachusetts Registration:1WTP57, 2007 Honda Civic) and vehicle 2 (Massachusetts Registration: 3STL41, 2010 Honda Civic) in the middle of the intersection of Lowell Ave and Austin St (public ways in the City of Newton). I observed heavy damage to the back passenger door to vehicle 1, the airbags were deployed, and both occupants were out of the vehicle. There was significant damage to the front bumper of vehicle 2 causing the license plate to fall off. Operator 1, Jefferson Contreras Payes, did not speak English, therefore the passenger, Luis Barrera Salguero translated and gave a statement. He stated that they were traveling southbound on Lowell Ave and they were turning left onto Austin St when they collided with vehicle 2. He indicated that vehicle 2 was traveling northbound on Lowell Ave prior to the collision. Mr. Salguero stated he tried to warn operator 1 not to turn, but it was too late. Operator 2, Catherine McDonough, stated she was traveling northbound on Lowell Ave at an estimation of 25 MPH. She stated, when she was crossing the intersection of Lowell Ave and Austin St, vehicle 1 abruptly turned onto Austin St. Ms. McDonough stated she was unable to stop in time, thus colliding into vehicle 1 at an angle. A witness, Alessandro Baccini, stated he was riding a bicycle on Lowell Ave directly behind vehicle 2. He stated vehicle 2 had the right of way and vehicle 1 should not have turned. All parties involved declined medical attention. Vehicle 1 was towed by Tody's Towing, and vehicle 2 was driven away by operator 2.

On Tuesday, September 21, 2021, I received a call from Sgt. Mike Wade of the Newton Police Traffic Bureau. Sgt. Wade stated a serious MVA/Bicycle crash had just occurred at the intersection of Cherry Street and Derby Street in Newton and the bicyclist was a 10-year-old boy with a possible head injury. Sgt. Wade stated the Traffic Bureau was requested to respond by the Shift Commander and asked if I could respond to investigate the crash. On arrival, Officers reported to me that the cyclist involved, Benjamin Lavoie, was transported to Children's Hospital in Boston with a possible head injury. It was reported to them that Benjamin was traveling Southbound on Cherry Street towards Derby Street on his bicycle. Benjamin entered the intersection of Derby Street and crashed into the front passenger side area of a passing motorist that had a green light. Officers on the scene also reported that the motor vehicle and the bicycle involved had been moved from their original rest location. Cherry Street is a public roadway maintained by the City of Newton. It supports two way travel (N and S) from Washington Street (S) to Waltham Street (N). The travel lanes are divided by an unprotected double yellow line median. The posted speed limit for this street is 25 miles per hour. Derby Street is a public roadway maintained by the City of Newton. It supports two way travel (E and W) from Waltham Street (E) to Lexington Street (W). The travel lanes are divided by an unprotected double yellow line median. The posted speed limit for this street is 25 miles per hour. The weather at the time of the crash was clear and sunny. The road surface in the immediate area of the crash was dry. I spoke with the operator of MV1, Ms. Erica Pusateri (S61409866). Ms. Pusateri stated he was operating her 2021 Kia Seltos (MA: 8HC743) Westbound on Derby Street towards Cherry Street. Ms. Pusateri stated that she had a green light at the intersection and proceeded to cross Cherry Street to continue onto Derby Street. Ms. Pusateri stated halfway through the intersection she heard a noise and saw a bicyclist hit the front passenger side door area of her vehicle. The collision caused the glass window from the front driver-side door to shatter. Ms. Pusateri's vehicle controlled her vehicle to a stop and she observed a young boy lying on the roadway in the intersection behind her. Ms. Pusateri exited her vehicle, ran over to the injured bicyclist, and rendered aid to him by stabilizing his neck. Ms. Pusateri remained on scene and cooperated fully with Officers. I asked Ms. Pusateri if she was distracted at all while operating her vehicle prior to the collison. Ms. Pusateri stated she was not. I asked Ms. Pusateri if she could recall where in the intersection the bicyclist crashed into her vehicle. Ms. Pusateri stated the bicyclist crashed into her vehicle in the Northwest side of Derby Street just outside of the marked crosswalk in the intersection. Ms. Pusateri stated she knows it was in the street in the intersection because she observed a woman with a stroller on the sidewalk on the corner of Cherry Street at Derby Street on the Franklin Elementary School side and she had already travelled through the intersection passed the East side of Cherry Street. Due to the unknown injury status of the bicyclist, Ms. Pusateri's vehicle was towed to the Newton Police Station and secured in the garage area as evidence. Ms. Pusateri reported a small laceration on her right hand with no other injuries. I observed damage to the front passenger side fender/door area. There was no airbag deployment as a result of the crash. I observed glass through out the front passenger side compartment area of the vehicle from the window breaking. I contacted Benjamin' s parents, Cheryl and John, to check on the status of their son. Cheryl stated Benjamin did not suffer any life-threatening injuries and appears to have bumps, bruises, and a cut on his head. I asked if I could speak with Benjamin for his account of what happened at the crash. Benjamin stated he was riding his bicycle on Cherry Street (Southbound) on the sidewalk on the East side of Cherry Street. Benjamin stated he left the sidewalk and entered the intersection to cross Derby Street and continue on Cherry Street. Benjamin acknowledged that at this time Cherry Street had a red light and Derby Street had a green light. Benjamin stated he then crashed into a passing car in the roadway. Benjamin was wearing a helmet at the time of the crash. The helmet had significant damage to it as a result of the collision. I told Benjamin his bicycle was being held at the Newton Police Department for safekeeping and we will arrange to get it back to him. Benjamin is a student at the Franklin Elementary School. I make contact with a witness to the crash, Mr. Benjamin Crosby. Mr. Crosby stated he did not witness the actual crash, just the aftermath. I was able to reviewthe 9-1-1 call Mr. Crosby made regarding the crash in Newton Disptach. Mr. Crosby stated a boy on a bicycle was in a crash with a motor vehicle. Mr. Crosby is heard saying "he went through the light" to the Dispatcher taking the call. After completing my investigation, I have summized the following. The bicyclist (Benjamin Lavoie) traveled down Cherry Street (S) and went through a red light to cross the intersection at Derby Street (W). As a result of traveling through the red light and entering the intersection, he crashed into the front passenger side door area of a passing motorist that had a green light (Erica Pusateri). No citation will be issued as a result of this crash.

On Thursday, September 23, 2021, while assigned to Traffic unit N525, I responded to the area of 358 Beacon Street, Newton for a report of a motor vehicle/bicycle crash with injury. The weather at the time of the crash was clear and sunny. The road surface was dry. Beacon Street is a public way maintained by the City of Newton. I spoke with the operator of the vehicle involved, Mr. Thomas Mogan (S29907615). Mr. Mogan stated he was operating his 2015 Jeep Wrangler (MA: 6EBH20) on Beacon Street (W) towards his residence of 358 Beacon Street. Mr. Mogan stated he observed a break in the traffic traveling on Beacon Street (E) towards Hammond Street in front of his driveway. Mr. Mogan took a left turn from the Westbound lane of Beacon Street to enter his driveway. While making his turn, his vehicle crashed into a bicyclist traveling on Beacon Street (E) in the marked bicycle lane in front of 358 Beacon Street. Mr. Mogan stated he did not see the bicyclist until the front passenger side fender/door area of his vehicle made contact with her. I observed minor damage to this area on his vehicle. Mr. Mogan reported no injuries. The injured bicyclist was identified as Ms. Louisa Palmer (S67185637). Ms. Palmer was treated on scene by Fallon Medics for injuries to her left wrist and ankle and transported to Brigham and Women's Hospital for further evaluation. Ms. Palmer was wearing a helmet at the time of the crash and I observed her blue Bianchi Pista bicycle resting on the sidewalk in front of 358 Beacon Street. The bicycle had minor damage in to it's front wheel area and fresh scrapes near the handlebars. I transported the bicycle to Ms. Palmer's residence. I responded to Brigham and Women's Hospital in Boston and spoke with Ms. Palmer in the Emergency Department. Ms. Palmer stated she was riding her bicycle on Beacon Street (E) towards Boston College. Ms. Palmer stated she was riding in the marked bicycle lane with the motor vehicle traffic to her left. Ms. Palmer stated she observed a break in the traffic on Beacon Street ahead of her, and then a Jeep entered her travel lane after it took a left turn from the Westbound travel lane on Beacon Street right in front of her. Ms. Palmer stated her left side crashed into the front passenger side wheel/hood area. Ms. Palmer stated she then fell to the roadway. Ms. Palmer stated she has injuries to her left wrist/arm area, her left ankle, and her hips. I spoke with a witness to the crash, Ms. Kelli McCusker. Ms. McCusker stated she was traveling on Beacon Street (E) towards Boston College at the time of the crash. Ms. McCusker stated there was heavy traffic in the area as she observed a bicyclist travel by the passenger side of her car. Ms. McCusker stated there was a break in the traffic ahead of her in the Eastbound lane and she observed a Jeep in the Westbound lane of Beacon Street make a left turn in front of the car in front of her. Ms. McCusker stated the Jeep and the bicyclist crashed into each other at this time. After speaking with all parties involved, Mr. Mogan did not yield to the right of way while Ms. Palmer was traveling on Beacon Street (E) on her bicycle. Mr. Mogan will be issued Massachusetts Uniform Citation for Chapter 90, Section 14B (Fail To Yield To Bicyclist on Turn). Photos were taken of the scene and submitted to the IT Bureau.

MV1 sustained damage to the front left corner panel and air bag deployment. MV1 towed from the scene. Operator of MV2 states she was traveling eastbound on Commonwealth Ave and came to a stop at the intersection of Lowell Ave and Homer Street. Operator of MV2 states while waiting in the left turn only lane to attempt to take a left onto Lowell Ave, MV1 swerved into the left turn only lane and struck MV2. MV2 sustained damage to the left front corner panel. MV2 towed from the scene. Operator of MV2 confirmed there were a group of bicyclists traveling on Commonwealth Ave. Operator of MV2 complained of right shoulder pain and was transported by Fallon to the BI Needham. On 10/13/21 at 08:50 hours, I responded to Washington Street & Brookside Avenue for a motor vehicle accident involving a bicyclist. The weather at the time was clear and sunny (70 degrees) and the road conditions were dry. The accident location is a t type intersection with Brookside Avenue having a stop sign in order to turn onto Washington Street. Washington Street is a four lane road with a painted divider. There is no crosswalk at the intersection as it appears it was recently paved. On arrival, the accident scene was already clear as the bicyclist and his bicycle were waiting on the sidewalk. The motor vehicle involved was parked further back on Brookside Avenue away from the intersection. I spoke to the operator of the motor vehicle identified as Balarama Thavanati. He was operating a 2012 Toyota Camry color white bearing MA reg. # 44VN32. He states that he was operating southbound on Brookside Avenue and stopped at the stop sign at Washington Street. He was attempting to make a left turn onto Washington Street. He states that he inched out after because you can not see the vehicles approaching you. Next, a vehicle stopped on Washington Street to let him out and he thought it was clear never seeing the bicyclist on the right of him. He says the bicyclist approached him very fast and it appeared that he never stopped the bicycle prior to entering the street from the sidewalk. Once he attempted to pull out for the turn he then made contact with the bicycle on the left side. Thavanati pointed to the approximate location where the bicycle came to rest and it appears he was pushed forward approximately three feet from the impact. I observed black scrape marks on the right side of the front bumper which appear to be from the bicycle tires. At this time, the bicyclist, Jacob Harrison, was being tended to by Fallon Medics and Jacob's mother (Juliet Harrison) was already on scene. Jacob stated he was fine but since he was not wearing a helmet and hit his head on the pavement his mother had him transported to Newton Wellesley Hospital by Fallon Ambulance. After, I spoke to Jacob in the emergency room along with his parents. He sustained whiplash to his neck and a scrape to his right inner thigh area. I then asked him what had occurred during the collision. He states he was bicycling on the sidewalk eastbound on Washington Street. He says he stopped at Brookside Avenue and saw the Toyota Camry which was also stopped. He thought it was clear to proceed as if the vehicle was going to stay stopped. He then pedaled into the street and was struck by the Camry on the left side of his body. He fell down and he does not recall what else occurred as the incident happened so fast. The bicycle sustained damage to the front tire rim as it became bent. No other visible damage. At the time, Jacob was wearing black shorts and a white t-shirt with a red picture on it. He was not wearing a helmet and was going against the traffic on Washington Street. On scene there were three witnesses who were walking southbound on Brookside Avenue near Washington Street at the time of the crash. There names were Christine Butera, Marlene Austen, and Marta Travers. All three of them stated that the operator of the Toyota Camry was stopped on Brookside Avenue waiting to make the left turn. He then pulled out and in a split second the bicycle entered the intersection and was struck. They did not have the vantage point to see if the bicyclist ever stopped first before entering the roadway from the sidewalk. Digital photos were taken of the scene.

MV1 and MV2 were involved in a road rage incident in the area of City Hall on Commonwealth Ave. Commonwealth Ave is a public way that is owned and maintained by the City of Newton. Stated by MV2 operator, James DAVIS: MV1 was operating his vehicle erratically behind and tailgating closely behind MV2. MV1 turned on his flashing white lights that were mounted in front of his driver and passenger side visors. MV2 believed that he was being pulled over by law enforcement so he turned right onto Chestnut St in order to pull over safely. MV2 operator, DAVIS observed the flashing light vehicle continue straight on Commonwealth Ave. MV2 continued his drive from Chestnut St to Temple St to Putnam St where he observed that same vehicle, MV1, driving around the rotary on Washington St over the Mass Pike heading in his direction. DAVIS stated that MV1 pinned MV2 by the driver's side door (B pillar). DAVIS was exiting his vehicle when MV1 closed in on his leg, injuring DAVIS with the car door and HELMS front bumper. Damage was visible on MV1 passenger side front bumper and MV2 driver's side door. DAVIS did not want medical treatment for his leg. Stated by operator HELMS in MV1: MV1 was being followed by MV2 in a dangerous manner in front of City Hall on Commonwealth Ave. MV2 operator, DAVIS, exited his vehicle when MV1 was stopped at the red light (Commonwealth Ave/Chestnut St). MV2 operator, DAVIS, threatened HELMS and brandished a knife. HELMS stated that he was scared for his life. At some point in the interaction, DAVIS got out of his vehicle again and brandished the knife again. HELMS was able to escape DAVIS and continue driving until he reached the backyard of the police station. During my interview with HELMS in the backyard I observed him trembling uncontrollably. I asked if he took anything tonight to which he said no, he was just cold. I asked if he smoked anything and he said he smoked a little marijuana earlier this afternoon but nothing since. HELMS is physically unable to complete field sobriety due to his past injuries including a TBI from a motorcycle accident, a rollover car accident and a bicycle accident where he was not wearing a helmet. He stated that he has multiple pins and plates in various parts of his body and does not feel safe doing field sobriety. I did not observe any odor of alcohol and HELMS stated that he has been sober for 10 years now. A MV search was conducted as well as pat frisk of DAVIS for officer safety. No knife was found on his person or in his vehicle. A MV search was conducted of HELMS vehicle due to arrest. Tody's towed HELMS' vehicle. Theodore Helms is being charged with the following: 90/7E - Improper Display of Flashing Lights (HELMS' mounted white light bar that flashes oscillating lights when turned on). 265/15A - Assault & Battery with a Dangerous Weapon (HELMS' vehicle pinning DAVIS' leg between his driver's side car door). UPDATE: 0030hrs DAVIS returned to the front desk of headquarters to claim that his leg was throbbing (the leg that was pinned between his car door by HELMS' vehicle). Pictures were taken of his knee and the SD card was sent to IT.

On 10/21/21 at 15:24 hours, I (Traffic Unit 523) responded to 1479 Washington Street for a motor vehicle accident involving a bicyclist. The weather at the time was seventy three degrees with mostly cloudy skies and some sun(weather.com). The road conditions were dry and Washington Street is a public way maintained by the City of Newton. Washington Street is a two way divided roadway with an unprotected median that runs in a easterly and westerly direction. At this location, there is a marked crosswalk with a walk signal along with traffic signals above in both directions. On arrival, the scene was cleared up and both parties were waiting in the parking lot of the Burke & Blackington Funeral Home at 1479 Washington Street. I spoke to the bicyclist involved who was identified as Rajmattie Thakoordeen. I asked her what occurred and she stated that she was attempting to cross Washington Street in a southerly direction on her electric bicycle. She says that she pushed for the crosswalk signal to activate and once it did she began riding her bicycle when she was suddenly struck by a silver Saab 93. She made it out in to the crosswalk approximately four feet when she was struck by the Saab which was travelling westbound in the right lane of Washington Street. She says that she was struck on the left side of her leg area. She complained of her left leg being sore near her knee area but signed a patient refusal with Fallon Ambulance declining transport. At the time, she was riding a Rad Power Bike Roadrunner 1 Plus that is silver and black in color. It is a Class 2 electric bicycle (750W) that can go up to 20 m.p.h. The only damage it sustained was scrapes to the outside left pedal. Ms. Thakoordeen was wearing black/gray/white pants, yellow reflective jacket, and a black bicycle helmet at the time. Next, I spoke to the operator of the Saab 93 bearing RI registration # FN193. He was identified as Nevan Hanumara with Rhode Island Driver's License # 9960501. He stated that he was travelling westbound on Washington Street in the right travel lane when he came around the curve and noticed the red light signal above in the last second. He says by the time he reacted and attempted to stop he went through the red light and made contact with the bicyclist in the crosswalk. He reported no injuries and no damage to his vehicle. Due to his statement and inattention to the traffic signal, I issued him MA Uniform Citation # 168985AB for Chapter 89/9 Fail to Stop/Yield for the red traffic signal. On Monday November 1st 2021, I responded the intersection of Cherry Street and Webster Street with several other units, for a report of a motor vehicle accident involving a bicyclist. At the time of the accident the weather was sunny and the road surface was dry. Both Cherry Street and Webster Street are owned and maintained by the City of Newton. While in route to the scene, units updated dispatch that the party was unconscious and not responding. Upon arrival I observed the bicyclist laying in the middle of the intersection being tended to by the medics. Medics on scene updated that the bicyclist was now conscious but was not alert and not responding to questions. Medics were able to locate a wallet and cell phone in his pocket and I was able to identify the bicyclist by his Mass License as Thanh Nguyen (S84815152). My first observations of the scene was that Mr. Nguyen was wearing a helmet at the time of the accident. I also observed his bicycle to be completely intact and the brakes functioning properly. The bicycle is a red Fifiel folding bicycle with a basket attached to the front. Inside the basket was a plastic bag containing recyclable cans. Also inside the basket was a bike lock and cable charger. Fastened on the handlebars of the bicycle with tape was a King meter reader. While the medics were preparing Mr. Nguyen for transport I spoke with the operator of the motor vehicle involved, identified by a Mass License as Jeffrey Carter (S21903831). Mr. Carter was visibly shaken up and very concerned about the bicyclist. Mr. Carter stated he was travelling eastbound on Webster Street and had the green light to cross over Cherry Street. He stated as he proceeded through, the bicyclist appeared out of nowhere very fast in the wrong lane and struck the front of his Ford F150 truck. Mr. Carter stated he immediately pulled over and tried to assist the bicyclist but he was not responsive. Mr. Carter stated he moved the bicycle to the side of the road to get it out of the way and waited for help to arrive. Mr. Carter stated his vehicle struck the bicyclist on his right side which caused him to fall to the ground and slide several feet. Mr. Carter stated the bicyclist did not come up onto the roof of his vehicle. He reported minor damage to the front grill and bumper of his truck. Mr. Carter stated he was not injured and signed a patient refusal on scene. His Ford F150 had minor front damage and was able to leave the scene. Sgt. Wade was on scene and speaking with a witness who was in the area walking her dog at the time of the accident. Kara Brewton stated she was walking on the sidewalk of Cherry Street, approaching Webster Street when she heard a loud pop sound. As she looked towards the sound she saw the bicycle and truck make contact and she remembers the red light was facing her on Cherry Street. Kara stated the truck had the green light and the bicycle had the red light at the time she heard and saw the crash. She stated she ran over to assist and dialed 911. She stated she observed the bicyclist with a helmet on at the time of the accident and he was not responsive. Several photos of the scene were taken and submitted to the IT Bureau. The bicycle was taken over to support services were it was logged into evidence for safe keeping. Property and evidence form was completed and submitted by Officer Gaudet. I responded to 223 River Street the residential address listed for Mr. Nguyen to notify his family of the accident but got no response. I was able to locate a phone number for his place of work who was able to provide me with his emergency contact information. I was able to leave several messages with his wife, daughter and sister. His daughter identified as Quynh-Chi Nguyen returned my phone call and was notified of the accident and that her father was transported to the Beth Israel Hospital in Boston. I provided her with my direct line and advised her to contact me with any questions. Later in the day, she contacted me back to state that her father was in stable condition and was going through a number of tests by hospital staff. I will be following up with Mr. Nguyen tomorrow after all his tests are completed. On Tuesday November 2nd, 2021 I was able to make contact with Mr. Nguyen's wife, Cindy Chau. Cindy stated her husband was ok and she was on her way to pick him up from the hospital. She stated she will have him contact me when he arrives home. I asked about his injuries and she stated he did not have any broken bones but wasn't sure and will contact me when they get home. Later that afternoon I attempted to make contact with Mr. Nguyen and was only able to leave a message. I am still waiting to hear back. On Friday 11/05/2021 I returned a phone call to Mr. Nguyen's daughter, Quynch-Chi who left me a voicemail. She stated Mr. Nguyen was home and all his test results came back negative. She stated she provided him with my contact number and he will contact me when he is feeling up to it. She also stated she believes Mr. Nguyen suffered some kind of head injury as he has wound on his head and does not remember anything about the accident. Quynch-Chi asked that I refrain from contacting her mother as she does not feel comfortable speaking to me since she does not speak English well. She asked that all communication go through her. She also asked for a copy of the report and I advised Quynch-Chi that I am still waiting to hear from her father so I can complete the report. I received a call from Mr. Nguyen a few minutes later. He was able to state that he doesn't remember anything from the accident except that he thinks when he went through the intersection the light changed from green to red. Mr. Nguyen also stated that the only other thing he remembers is waking up in the hospital. When asked about his injuries Mr. Nguyen stated he has a hard time breathing and his head, neck and legs are sore. I advised Mr. Nguyen that I will be adding his statements to the report and to have his daughter contact me if he needs anything further. Mr. Nguyen called me again to state that the accident happened because he was turning left and the driver was turning right. I informed Mr. Nguyen that based on the evidence and witness statements it appears that both him and the driver of the motor vehicle were travelling straight at the time of the accident and neither party were attempting to turn. Mr. Nguyen remained silent and just kept stating he was turning left and they were turning right. I advised Mr. Nguyen I will add his statements to my report to which he was satisfied.

Bicyclist Winter Douglass stated that they were riding their bike east bound in the bike lane on Beacon St near Union St on 11/01/2021 at 18:20 hours. Douglass stated that an SUV ( MA reg 2ZVE39 2019 Chevrolet Tahoe ) that had taken a prohibited left turn from Union St onto Beacon St was blocking the bike lane. Douglass stated that they attempted to pass the SUV on the right but could not. Douglass stated that they crashed into the rear driver's side of the SUV. Douglass was wearing a helmet at the time of the crash. Douglass's bike was equipped with lights on the front and back. Douglass was transported to Newton Wellesley Hospital via EMS for a left shoulder injury. Susan Hynds the operator of the SUV stated that they turned left from Union St on to Beacon St and were stopped in traffic when the crash occurred. Hynds stated that they did not see the posted sign prohibiting left turns from Union St onto Beacon St. Hynds stated that she and her son, Sean Hynds ( DOB 07/12/2010 ) who was a passenger in the SUV were not injured. Hynds's SUV had a dent in the rear driver's side and it did not require a tow. I took photo's of the SUV and the posted no left turn sign and turned the disk over to the NPD's IT Bureau. Douglass's bike had no visible damage and it was transported to the station and secured at Support Services. I issued Hynds MA Uniform Citation T2016744 for a violation of MGL 90/14 improper left turn.

On 12/01/2021 while assigned to unit 524 I responded to the area of Walnut St and Cabot St for a report of a bicyclist that had possibly been struck by a vehicle. The incident was reported by two passerbys that stated they saw a young white male on a blue bike wearing black pants, red shoes and a black helmet get struck by a gray Honda CRV. Units checked the area and could not find the bicyclist or the vehicle. Shortly after clearing the initial call the operator of the vehicle called to report the accident. I spoke to Jean Ferreira who stated she was traveling southbound on Walnut St and noticed a young male about 13 yoa riding a bicycle along side her on her right side. As they approached the intersection of Cabot St Ferreira felt a thud along her passenger side. She looked in her rearview and saw the male down on the ground. She immediately stopped and exited her vehicle to check on him. As she approached the male party he apologized for hitting her car and said it was his fault. Ferreira did everything she could to help the male but he kept saying he was uninjured and he was sorry and that he only lived down the road (pointing down Cabot St). Ferreira offered to call the males parents or the police and medics but he refused and got back on his bike and left down Cabot St. (cid:31)I advised Ferreira that we had received a call on the incident but was unable to find the bicyclist. I told her I would document the incident for now with a report and if any one reaches out to us we will add to the report.

On Wednesday, February 16, 2022, while assigned to Traffic unit N525, I responded to the intersection of Cabot Street and East Side Parkway for a report of a motor vehicle/bicycle crash. The weather at the time of the crash was clear and sunny. The road surface was dry. Cabot Street and East Side Parkway are both public ways maintained by the City of Newton. I spoke with the operator of MV1 (2016 Mazda CX3, NY: JNB6711), Mr. Tushar Singhal (NY: 287647610). Mr. Singhal stated he was operating his vehicle on Cabot Street (E) towards the East Side Parkway intersection. Mr. Singhal stated he came to a complete stop at the stop sign on Cabot Street. Mr. Singhal stated he did not see any vehicles or pedestrians in the area at this time. Mr. Singhal stated he proceeded to travel through the intersection from his stopped positon and take a left turn onto East Side Parkway. Mr. Singhal stated at this time a bicyclist crashed into the passenger side of his vehicle. Mr. Singhal stated the bicyclist then fell over his hood and onto the roadway. Mr. Singhal reported no injuries from the crash. I observed damage to the front passenger side door, mirror, fender, and hood. Sgt. M. Wade spoke with the injured bicyclist, Keiji Imai, while he was being evaluted by Newton Medics. Mr. Imai stated he was operating his Trek bicycle on Cabot Street (W) towards the East Side Parkway intersection. Mr. Imai stated he was on the sidewalk and entered the intersection with out stopping. Mr. Imai stated he crashed into the side of MV1 and fell to the roadway. Mr. Imai was transported to Newton Wellesley Hospital with minor injuries to his left wrist and rear. Keiji was wearing a helmet at the time of the crash. I observed the helmet to have no fresh damage or defects. Photos were taken of the helmet to document it's condition. Keiji's father, Koguke Imai, was made aware of the crash involving his son and stated he would respond to the hospital. I observed no substantial damage to the Trek bicycle. I transported Keiji's blackTrek bicycle to Keiji's residence. I spoke with a witness to the crash, Ms. Madison Albano. Ms Albano stated she was walking her dog on Cabot Street (E) on the Northbound sidewalk at the East Side Parkway intersection. Ms. Madison Albano stated she observed MV1 approach the intersection to her right side on Cabot Street (E) and come to a stop at the stop sign. Ms. Albano stated she then observed MV1 make a left turn onto East Side Parkway and she heard a crash. Ms. Albano stated she observed a bicyclist crash into the passenger side of MV1 and then fall to the roadway. Ms. Albano stated she did not see the bicyclist prior to the crash and does not know if he came off of the sidewalk or was in the roadway. After speaking with all involved parties, I have summized the following. As MV1 was completing his left turn onto East Side Parkway (N) from Cabot Street (E), the involved bicylist failed to yield at the stop sign while traveling on Cabot Street (W) across the intersection. The bicyclist entered the intersection with out yielding and crashed into the passenger side of MV1. MV1 had the right of way. No citations will be issued as a result of this crash. Photos were taken of the scene and submitted to the IT Bureau. Keiji is a student at Newton North High School.

Narrative:
Bicycle was traveling either north on Walnut Street or west on Washington Street from the area of Newton Centre. MV1 pulled out from a side street, unknown which side of street, in front of the Bicycle. Causing bicycle and vehicle to collide in an unknown manner. Further causing the bicycle and operator to flip forward in the air. MV1 left the area. MV1 is an unknown description. Operator of bicycle continued on foot on his path home where he was picked up by his father and brought by his father to NWH for cuts on his face and hands. Operator of Bicycle was disoriented and stated he did not know where the accident occurred, manner of collision, MV1's description or if he was wearing a helmet. Operator of bicycle left the bicycle on the sidewalk or in the bushes somewhere on his route home. Bicycle was described as a light blue Trek that was most likely mangled. Bicycle did not have any lights on it. Units canvassed the area and were unable to locate bicycle. Bicyclist was wearing a grey sweatshirt, black jeans and brown shoes. If the Bicyclist and his father find the bicycle later they will call NPD to canvas the area. Traffic Bureau update (Officer Gaudet): On March 1, 2022, I was able to speak with the injured bicyclist, Mr. Yonatan Gershon. Mr. Gershon stated he was traveling on Walnut Street (N) in the right shoulder lane towards the area of Hull Street and Kirkstall Road. Walnut Street, Hull Street, and Kirkstall Roads are all public ways maintained by the City of Newton. Mr. Gershon stated while operating his blue Trek gravel bicycle he continued on Walnut Street when a black vehicle (no further description) appeared out of no where on his left hand side and entered his travel lane. Mr. Gershon stated he did not have time to react and crashed into the rear passenger side of the vehicle. Mr. Gershon stated he does not recall anything between the time he made contact with the vehicle and the time he came to a rest on the roadway. Mr. Gershon stated the vehicle never made an attempt to stop and it left the area. Mr. Gershon stated after the crash he began walking towards the Newtonville Square area until his father picked him up and brought him to Newton Wellesley Hospital. Mr. Gershon stated he suffered injuries to the right side of his face, his right should, right hand, and was diagnosed with a concussion as a result of the crash. Mr. Gershon initially believed the vehicle entered Walnut Street from either Kirkstall Road. Kirkstall Road is on the Eastbound side of Walnut Street and if a vehicle exited the street onto Walnut Street it's driver side would be facing Mr. Gershon's direction of travel. Hull Street is on the Westbound side of Walnut Street. Hull Street supports one-way traffic and traffic can only enter Hull Street from Walnut Street. If the vehicle were to enter Mr. Gershon's travel lane as he described, the vehicle would have to travel Eastbound on Hull Street in violation of the one-way restriction to take a left onto Walnut Street and travel Northbound. Mr. Gershon stated it is possible the vehicle may have exited a driveway from a residence on the Westbound side of Walnut Street, taking a left turn to travel Northbound. After speaking with Mr. Gershon about his injuries and his attempt to avoid crashing into the vehicle, we surmised Mr. Gershon attempted to travel around the vehicle's left side prior to impact, with the right side of his person crashing into the vehicle. Mr. Gershon stated he was not wearing a helmet at the time of the crash and there were not lights or reflective equipment on his bicycle. Mr. Gershon stated he was wearing a gray and white hooded sweatshirt with jeans at the time of the crash. Mr. Gershon stated he returned to the scene after the crash and discovered his bicycle resting near the lawn of a residence on Walnut Street in the area of the crash on the Westbound side of the street. Mr. Gershon stated there was extensive damage to the front wheel and the frame of the bicycle was bent in half. I canvassed the area for black vehicles with fresh damage to their rear passenger side with a negative result. I also canavassed the area for cameras with a negative result. To be further investigated.

OP1 of MV 1 was traveling n/b on Wells ave when he was taking a right into 70 Wells ave. The Street was made a one way due to the bike race detail going on. OP1 had to cross over a set of cones to take a right into the parking lot and did not see the bicycle traveling. The bicycle his the passenger side of MV1. Minor damage to MV1. OP1 was not injured. Bicycle operator was traveling around Wells ave N/B when he saw the vehicle turn right, he was unable to stop in time and hit the side of MV1. Bicycle operator had a slight injury to his hand but refused medical treatment. At this time no citations issued at this time.

Operator of MV1 states she was traveling eastbound on Beacon Street approaching the intersection of Centre Street when she came to a stop at the red traffic light. Operator of MV1 states when the traffic light turned green she accelerated and struck a male party on a recumbent trike with the front bumper of MV1. Operator of MV1 states her visibility was obstructed from the hood of her vehicle because the recumbent trike is very low to the ground. It should be noted the trike had a flag attached to it, which the operator of MV1 stated she didn't see until after the accident happened. MV1 sustained minor damage to front bumpers license plate. No injuries. The bicyclist, Christopher Tsu, states he was traveling eastbound on Beacon Street on his recumbent trike when he came to a stop at the red traffic light at Centre Street. Mr. Tsu states when the traffic light turned green, MV1 struck him in the rear of his trike causing him to fall to the ground. Fallon Medic 5 evaluated Mr. Tsu and he signed a patient refusal. No damage done to the trike and no injuries.

Narrative:
Operator #1 states he was turning left onto Rowe St from Commonwealth Ave eastbound, when he made contact with bicyclist #1. Operator states he did not see the bicyclist approaching and was not sure what hit his vehicle until after he exited and saw the bicyclist on the ground. Bicyclist #1 states he was traveling westbound on Commonwealth Ave when vehicle #1 (Ma reg 3TZR51) struck him as it was turning onto Rowe St. Bicyclist sustained minor injuries and was transported to Newton-Wellesley Hospital. Vehicle #1 was towed by Tody's and operator #1 signed a patient refusal. Pictures were taken of the visible damage to the hood/windshield area and were submitted to the IT Bureau. The involved bike was turned over to bicyclist #1's wife, Gloria Gavris.
