On Saturday January 5th 2019 at 18:01, I was dispatched to Crafts St at Waltham St for a report of a 2 car accident. Operator of MV1 stated he was driving southbound on Waltham Street and approached the intersection as the traffic control changed to red. He slowed down and came to a complete stop. Approximately 4-6 seconds later, he was rear ended by MV2. MV1 sustained minor damage to the rear passenger side. MV1 had three other occupants in the vehicle at the time of the accident. The two passengers in the back seat complained of back pain and were evaluated by Cataldo Paramedic Basic 3 and both signed patient refusals. The operator of MV2 stated as he approached the intersection he "was sleeping." When I asked him to elaborate further he was unable to provide me any answers. He was evaluated by PB3 and transported to NWH. He was issued citation # T1441363 for Operating Under the Influence of Alcohol (2nd Offense) and Negligent Operation of a Motor Vehicle. See Report #19000596 for further details. MV2 was towed by Todys Towing due to the operator being transported to the hospital and the passenger stating he was too intoxicated to drive. A towed motor vehicle form was filled out.

On Sunday, February 3rd 2019, at approximately 11:45pm, I, Officer Brooks, responded to a single car MVA at the intersection of River street and Auburndale avenue. Upon arrival I observed MV1(MA REG 7TT558) in the travel lane with both tires broken free from the axle. I spoke with the operator who could not recall how the accident happened, or what was struck. After an investigation the operator was placed under arrest for 90/24 OUI Alcohol. Officer Boyle was able to assist in the accident investigation. It appears the operator had been traveling westbound on River street and struck a utility pole on the drivers side front tire. The vehicle continued to the intersection of River street and Auburndale avenue and struck a curb here on the passenger side tire. Both tires were broken free from the axles. The vehicle was towed by Tody's and an inventory form was filed. Eversource was notified about the pole.

At approximately 0110HRs on Sunday February 17, 2019, I was dispatched to the area of Dedham St. and Spiers Rd. (both public ways in the City of Newton), for a report of a motor vehicle vs pole accident with injury, airbag deployment and entrapment. Upon arrival, I exited my cruiser with my medical bag and AED and went to assist the motorist involved in the crash. MV1 (MA Passenger: 255ZA9) was completely off the roadway and on the shoulder of the road (facing Eastbound) with its nose contacting the light pole ( Verizon Pole #:103/80), which was now broken and listing to the side. Attempts to open the doors were unsuccessful and I attempted to communicate with the operator through a partially broken driver's window frame which was bent. The operator was slumped forward with his hand cradling his head and he was unable to speak, but was breathing. Newton Fire arrived and attempted to gain access to the vehicle via several manual tools with no success and instead deployed the Jaws of Life which was successful. Newton Fire also made entry into the rear passenger compartment because we viewed a child's car seat and checked with negative results for any child in the vehicle. Once the operator was cut out of his seatbelt and safely out of MV1 and on board Newton Medic 1, I entered the ambulance where he was identified as Mark Topham. It should be noted that Topham was having difficulty answering basic questions such as his name, date of birth, today's date, Etc. At one point when he was asked what today's date was, he gave his birth date of February 21, 1983 and it took him several attempts to say his last name, I had to run him over the air with a partial name to ascertain who he is. Also of note, in my presence and that of Sgt. Devine, Topham informed the medics that he had been consuming alcoholic beverages prior to the crash. Upon viewing the scene, I noted that the roadway was lit and I did not observe any skid marks on the dry, ice-free payment, indicating that there was unlikely any braking or swerving to avoid the collision. I spoke to the reporting party, Lindsay Giardina, she stated that she was traveling on Dedham St. when she heard what she believed to be a motor vehicle crash. When she came upon said crash, she attempted to assist the operator, as she was an off duty firefighter. She was unable to gain access to the inside of the vehicle, but communicated to the operator in the same manor as I did. She stated that she was able to smell the odor of an alcoholic beverage emanating from the operator. Topham was transported to Beth Israel of Boston, where he was assigned patient record number 3109921. I attempted to speak with him at the hospital, but was unable to do so because of his current state; I noted several injuries on Topham, such as a bloody lip, a wound to his lower left side and a wound to his left leg. Due to Topham's statements onboard of Medic 1 and Lindsay Giardina's observations, I will be charging Topham with one count of violating MGL Ch.90 S. 24 K OUI Liquor 2nd Offence, one count of violating MGL Ch.90 S. 24 E Negligent Operation of a Motor Vehicle and one count of violating MGL Ch. 89 S. 4A Marked Lanes Violation via MA Criminal Citations which I placed in the mail. Additionally, I will be seeking a subpoena for Topham's blood work from the hospital. Note: The crash occurred on the Newton/Boston line, Newton dispatch's GPS indicated that the crash was in Newton. I took several pictures of the scene and have forwarded them to IT to be attached to this report. I completed and filled an NPD Motor Vehicle Tow Inventory Form and Officer Boudrot stood by for the tow.

On 3/1/19 while working N493, myself and N492 Officer Selig were sent to the area of 1354 Washington St for a motor vehicle accident with reported injuries. On arrival, I spoke to Matthew Digregorio DOB7/2/74 ( hereby referred to as operator #1) who was standing on the sidewalk next to MA reg 134TR9 (vehicle #1 ). Vehicle #1 had significant damage to the front and right quarter panels. It was straddled between the travel lanes and did not have the keys in the ignition. It was immediately apparent that operator #1 suffered an injury to his head, as there was a moderate amount of blood and small pieces of glass stuck in his forehead area. I observed operator #1 to be unsteady on his feet, have bloodshot eyes and slurred speech. I could detect a moderate odor of alchoholic beverage coming from operator #1 as I was approaching him, which was apparent from about an arms length away (it should be noted that medics were already en route to the scene at this time). Prior to the medics arrival, I asked operator #1 for a brief synopsis of what transpired. Operator #1 stated that he had just left Paddy's Pub and was driving westbound on Hunter St (which is approximately 1/8 mile from our location) when he collided head on with vehicle #2. Vehicle #2 was not immediately visible upon police arrival, however was pointed out as being located at the intersection of Hunter and Putnam St. I asked operator #1 where he was heading, as Hunter St is a back road not directly in the vicinity of Paddy's. Operator #1 could not answer the question and also remained silent when I asked him how much alcohol he had consumed this evening. At this time the medics arrived on scene. I asked operator #1 for the car keys to reliquish to the tow truck operator, which is standard operating practice. Operator #1 reached into his pocket and then provided me with the keys. Due to concern over operator #1's obvious head trauma, he was then transported to NWH to be evaluated while the investigation continued on scene. Two other parties approached myself and Officer Selig. One was the operator of vehicle #2, MA reg 1RD999. Operator #2 is identified as Luke Ferdinands DOB 5/11/80. The other party who approached is identified as Douglas Dasilva-Pimenta DOB 6/2/86 (Dasilva-Pimenta will now be referred to as operator #3). Operator #2 states that he was taking a right onto Hunter St from Putnam St, when he observed vehicle #1 on the wrong side of the road approaching him head on. Operator #2 states vehicle #1 then collided head on with him, took a right onto Putnam St, and continued onto the Washington St overpass near 1354 Washington St. Operator #3 states he was inside of #5 Hunter St when he heard a loud crash coming from outside. He looked out the window and saw vehicle #1 traveling at a high rate of speed on Hunter St towards Putnam St. Operator #3 observed damage to the right side of his parked vehicle (now referred to as vehicle #3) MA reg 7CAK80. He immediately got in his vehicle and proceeded to follow vehicle #1, which then crashed into vehicle #2 head on. Operator #1 did not stop until it was obvious that operator #3 was following close behind. This ultimately landed vehicle #1 at it's final location near 1354 Washington St. Vehicle #1 and vehicle #2 were not driveable and were towed to Tody's. It should be noted that there was a passenger in vehicle #2 at the time of the collision. Airbags were deployed and medics checked out both operator and passenger. Both declined transport. The passenger is identified as Elizabeth Ferdinands DOB 5/22/53.Ferdinands' version of events coincide with that of operator #2. Upon speaking with Officer Selig it was learned that operator #1 dropped his cell phone several times as he was holding it on scene. Both Officer Selig and operators #2 and #3 observed this. Operators #2 and #3 both expressed concern over the obvious odor of alcohol eminating from operator #1, and the fact that he was unsteady on his feet. I responded to NWH to follow up with operator #1 however he did not wish to speak further. He did express concern over the well being of all parties involved. Operator #1 was issued in hand the following citations: T1268426 - 90/24 OUI Alcohol, 90/24 Leaving the Scene (property damage, vehicle #2), and 90/24 Leaving the Scene (property damage, vehicle #3). T1268425 - 89/4a Marked Lanes violation. T1269216 - 90/24 Negligent Operation of a M/V (mailed after consultation with superiors) All streets mentioned are public ways in the City of Newton. 1354 Washington St will be the address used on this report and subsequent citations due to multiple locations being involved. Citations and paperwork have been placed in the prosecutor's mailbox. An immediate threat form has been filled out and faxed to Mass DOT. *Attention Police Prosecutor for blood work subpoena, if applicable*

Operator of MV#1 stated he was travelling westbound on Commonwealth Ave with his dog in the front seat when he slid on ice and off the roadway. The roadway was wet from previous snow fall but was very well plowed and sanded. MV#1 hit a curb, drove through a snowbank, hit a tree with the left front of his vehicle and then hit a pole with the right front side of his vehicle. The car then came to a rest in the median. The operator appeared confused by the accident and did not realize the extent of the damage to his car.He asked what he had hit. He continuously asked if it was driveable even though the entire front end was totaled. He was able to provide me with his license and all pertinent information but spoke in a slow manner. There was no odor of alcohol. Operator declined medical attention. When asked if he was on any medication he stated he was on heart medication. We were able to contact the operator's son who was transported to the scene and stated the operator had previously suffered a stroke. David Donahue arrived on scene towed the vehicle to Tody's. A licensed driver picked up the operator. A search of the immediate area yielded negative results for ice in the roadway. A request for Immediate Threat License Suspension/Revocation was filed.

DUE TO HER INTOXICATION WAS UNABLE TO PROVIDE ANY STATEMENT REGARDING THE CRASH. VEHICLE WAS TOWED BY TODY'S DUE TO ARREST. THERE WERE NO INJURIES DUE TO THIS ACCIDENT.

On 04/23/19 at approximately 14:35 Officer Gabriel and I responded to #150 Needham St- The Upper Falls Discount Liquor Store for a crash involving two vehicles. Veh #2 backed into parked veh #1. There was slight damage to veh #1 but moderate damage to veh #2. It was later determined operator of veh #2 was operating under the influence of alcohol when she backed into parked veh #1. Veh #2 was towed from the scene by Tody's towing after Officer Gabriel completed a towed vehicle form. Veh #2 registration was queried and came back revoked for insurance. The operator of veh #2 was arrested (NPD Report #19015765) and given in hand Mass. Citation's # T1444225 and T1444226 for Ch 90/Sec 24/J-O.U.I. Liquor, Ch 90 / Sec 24/E- Negligent Operation of a M.V., Ch 90/ Sec 34/J- Operating with out Insurance and Ch 90/ Sec 23 Operating after Registration Revocation.

Narrative:
On April 24, 2019, while assigned to N496, I was called by Dispatch to respond to the area Beacon Street and Hammond Street for a motor vehicle crash. This was called in by Boston College Police Department. Upon arrival MV #1 was on Beacon Street just past Hammond Street at the Island with considerable vehicle damage. MV#1 stated while traveling westbound on Beacon St, while approaching the intersection of Hammond he stated he started to feel strange and not like himself. MV#1 stated he then struck the curb with his front right tire, not believing his accident was very serious at this time. He reversed his vehicle off the sidewalk and proceeded to travel westbound on Beacon St. After passing through the intersection he stated his car felt very off at which point he initiated his hazards and pulled over to the right. MV#1 stated he has a history of epilepsy and currently takes Oxcarbazepine twice a day for his condition. He stated he did not believe he had a seizure or lost consciousness but did not recall the incident very well. Boston College Ofc. Cadogan witnessed the incident, and stated the following, while conducting a directed patrol at the intersection of Beacon and Hammond St he saw MV#1 traveling westbound on Beacon St. Ofc. Cadogan stated MV#1 then took a sudden tight turn on to the curb striking the metal fence surrounding the BC facility. MV#1 was then seen / heard revving his engine while still in drive before reversing his vehicle off the curb and attempting to continue on Beacon St westbound. The fence surrounding the BC Facility sustained moderate damage. Tire marks in the grass show the path of MV#1 in direct line to the damaged property. While on scene, I spoke at length with Vanhorne. I did not detect or any alcohol from his breath as he spoke. Vanhorne reported he only consumed one beer tonight at roughly 2030hrs and smoked a little marijuana at 2200hrs. Vanhorne's eyes did not detect any signs of alcohol and he walked with no signs of any impairment. Sgt. Devine administered a horizontal nystagmus test which revealed no signs of impairment. Vanhorne reported he was at a work event and then visited a friend in Brookline. Vanhorne reported his last seizure from epilepsy occurred a little over two years ago. Pictures of the scene were taken and submitted to IT to be attached to this report. MV#1 operator stated he was not injured at this time. MV#1 was towed from the scene by Todys's due to heavy front end damage. Vanhorne was picked up from the scene by Paul Miller his step father. A towed MV form was filled out and placed in the traffic box. Witnesses Cassandra Williams and Bill Peirce observed the crash and stated identical narratives to Ofc. Cadogan's. An Immediate Threat form was filed with the RMV (via Fax and E-mail at approximately 0650hrs 4/24/19)due to his medical history and his explanation with this crash. All streets mentioned are public ways in the City of Newton. It should be noted that the road was wet from rain on this night. Update: on 4/27/19 Sgt.Devine was able to watch the video of the incident from Boston College Police. The video confirmed the statements given by BCPD and witnesses's. Due to the aforementioned statements and the video surveillance of the incident, MV#1 Operator will be cited with Marked Lanes Ch89/4a (MA Uniform Citation #T1441792. Vanhorne will be notified via phone he will be receiving the ticket in the mail.

Narrative:
I responded to the area 107 Dartmouth St. at approx. 0345 on 04/28/9019 along with N493 Officer Kelly Donahue and N508 Sgt. Devine for a report of an MVA. The MVA was reported to be single vehicle crash. The vehicle left the roadway and was on the front lawn of 107 Dartmouth St. I arrived on location (first on scene ). I observed tire tread marks across the front lawn of 107 Dartmouth St. I then observed a vehicle in the bushes toward the left front side of the house. The vehicle; NY Reg. JHE8252, Porsche color blue. The RMV info on the plate came back registered to Porsche;of ;South. Registration plate type: Dealer Assignment. 185 W Sunrise HWY; Freeport,NY (no further info). The vehicle was unoccupied and secured. I felt the hood of the car which was still warm from the engine. I checked the immediate area surrounding the crash scene for an operator but found no one. I radioed to other responding units to canvas the neighborhood and surrounding area for the operator on foot. I spoke to the homeowners at 107 Dartmouth St., identified as Anthony and June Limberis. Mrs. Limberis stated she heard a load noise and a car engine revving. She stated when she looked out the window she observed a W/M tall, thin, wearing tan khakis and a light colored plaid shirt walking across the front lawn. He proceeded up Dartmouth St. (northbound) toward Commonwealth Ave. Newton Fire Dept arrived on location to check the crash scene and vehicle for possible leaking fluids and any other hazards. As I was talking with the firefighters we were approached by two men. One of the men was intoxicated. He was unsteady on his feet, had glassy bloodshot eyes, and was slurring his speech. The man was a W/M tall/thin approx. 6'2" and was wearing tan khakis and a light colored plaid shirt. He was identified as Eric Adams DOB 09/18/1969. The second man with him was identified as John Adams DOB 02/07/1936; An elderly W/M approx. 5'6" also wearing tan khakis and a light colored plaid shirt. Eric Adams stated his father John was the operator of the vehicle. Eric Adams had a strong odor of Alcoholic beverage emanating from his person and breath. He continued to slur his speech and was unsteady on his feet as he spoke. He was swaying back and forth and side to side as he spoke to me. Officer K. Donahue and Sgt. Devine were on scene at this time and also made the same observations. Multiple times we had to grab hold of Eric Adams to keep him from losing balance and falling. We spoke with Eric and John Adams for several minutes as their accounts of what took place were not consistent. I asked Eric Adams where the keys to the vehicle were. Eric Adams immediately pulled the starter key to the vehicle from his front right pocket. Eric Adams became defensive and belligerent when questioned about who was operating the vehicle. John Adams appeared tired (as if he just woke up) and confused as to the situation. Sgt Devine and I both spoke with Eric Adams and John Adams. Although both men claim John Adams was the operator of the vehicle, a clear determination was uncertain. A query of both mens driver's license status on NY Licenses came back active. Eric Adams has two prior DUI's on his RMV record. Officer Donahue and Sgt. Devine escorted the two men to 93 Dartmouth St. Eric Adams stated they were staying at that residence which is his sister's house. I stayed at the crash scene to document information and assist with clearing the MV from the property with Tody's Towing Service. As they were walking away I observed Officer Donahue and Sgt. Devine continue to have to assist Eric Adams with staying on his feet. Approximately ten minutes later as I was speaking with the aforementioned homeowners Mr.&Mrs. Limberis. Officer Donahue and Sgt. Devine returned to the crash scene. As they were updating me we observed Eric Adams returning to the crash scene. He was stumbling and swaying as he walked and repeatedly almost fell. Officer Donahue and Sgt. Devine immediately intercepted and assisted him before he fell. As they were assisting him again I continued speaking with the homeowners. Suddenly I heard Officer Donahue and Sgt. Devine struggling with Eric Adams who was now on the ground and resisting being handcuffed. I ran to assist them. Eric Adams continued to resist and be uncooperative until he was appropriately restrained in handcuffs. Eric Adams was placed under arrest by officer Donahue for Disorderly Conduct and Resisting Arrest. Reference Officer Donahues Newton Police Incident Report #19016484. The vehicle NY Reg. JHE8252 was removed from the property of 107 Dartmouth St. and towed from the crash scene by Tody's Towing Service.

Narrative:
MV1, operator Frank Distefano (MA Reg:55EL18; a gray 2002 Toyota Highlander) was traveling NORTH on Waltham St when believes he may have fallen asleep and collided with a Eversource utility pole 39/2 along with a city green bin (06 1021851). There was heavy damage to MV1, the utility pole and the bin. There was airbag deployment but Distefano signed a refusal when medics arrived on scene. Distefano was steady on his feet, had no odor of an alcoholic beverage emanating from his person and did not exhibit red or glassy eyes. To be certain, I asked Distefano if he would consent to a field sobriety test to which he said yes. Distefano was able to perform the tests and I made the determination that Distefano was not operating under the influence of alcohol. Distefano said that he suffers from sleep apnea and states that he gets tired during the day due to his lack of sleep and prescribed medications which often makes him fall asleep unexpectedly. MV1 was towed from the scene byTody's Towing. Frank Distefano was given in hand, MA Uniform Citation T1441775 for 89/9a Marked Lanes and 90/9 Expired Registration. Due to Distefano's inability to stay awake while operating a motor vehicle, an immediate threat was filed with the RMV. Eversource arrived on scene to remedy the utility pole for public safety.

ON THIS DATE I RESPONDED TO 5 MEADOWBROOK RD, FOR A REPORT OF AN AUTO ACCIDENT (SEE INCIDENT REPORT #19018289). THE CALL WAS RECEIVED FROM THE ENVIRONMENTAL POLICE WHO WERE ON-SCENE. ON-SCENE PRIOR TO MY ARRIVAL WERE CAPTAIN DOWLING AND TRAFFIC SERGEANT LEE. CATALDO MEDIC 2 AND AMBULANCE 1 ARRIVED ON-SCENE, SHORTLY AFTER I DID. UPON MY ARRIVAL, I OBSERVED A SILVER HONDA CIVIC WITH HEAVY FRONT END DAMAGE. THE VEHICLE DISPLAYED MASSACHUSETTS REGISTRATION 7ZF784. TWO PEOPLE WERE STANDING BESIDE THE VEHICLE. A MAN AND A WOMEN SAID THEY HAD BEEN IN THE CAR. THE MAN, LATER IDENTIFIED AS BENJAMIN SMALL STATED HE HAD BEEN OPERATING THE VEHICLE. THE WOMAN, LATER IDENTIFIED AS KIMBERLY OAKES, STATED SHE WAS A PASSENGER IN THE VEHICLE. I ASKED THEM IF THEY WERE OK OR NEEDED MEDICAL HELP AND THEY SAID THEY WERE NOT INJURED. THE MEDICS CHECKED OUT MR SMALL ( MEDICS ELISE GADANSKY AND ROBERT ANDERSON) WHICH INCLUDED CHECKING FOR LOW BLOOD SUGAR, DUE TO HIS INABILITY TO SPEAK CLEARLY AND LEGIBLY. HIS BLOOD SUGAR CHECKED OUT FINE. I THEN ASKED MR SMALL WHAT HAD HAPPENED. HE STATED THAT HE WAS TRAVELING WESTBOUND ON DEDHAM ST WHEN ALL OF A SUDDEN A WHITE MINI VAN CROSSED OVER THE DOUBLE YELLOW LINE AND WAS HEADING TOWARDS HIM. HE STATED THAT IN ORDER TO AVOID A HEAD ON COLLISION, HE SWERVED RIGHT, OFF THE ROAD AND STRUCK A TELEPHONE POLE (LATER DETERMINED TO BE UTILITY POLE #60 LOCATED IN FRONT OF 556 DEDHAM STREET). HE STATED THAT HE PULLED OVER ONTO MEADOWBROOK RD. BOTH DEDHAM STREET AND MEADOWBROOK RD ARE PUBLIC WAYS IN THE CITY OF NEWTON. AS I WAS TALKING TO MR SMALL HE APPEARED TO SPEAK VERY SLOWLY, HE APPEARED TO BE LETHARGIC, BUT I COULD NOT DETECT ANY ODOR OF AN ALCOHOLIC BEVERAGE ON HIS BREATH. NEXT I SPOKE TO MS OAKES WHO STATED SHE IS MR SMALL'S GIRLFRIEND. SHE STATED SHE WAS A PASSENGER IN THE FRONT SEAT OF THE CAR. SHE ALSO STATED THAT MR SMALL WAS OPERATING THE VEHICLE WHEN A VEHICLE HAD CUT THEM OFF FORCING THEM OFF THE ROAD INTO THE TELEPHONE POLE. DUE TO THE FACT THAT WE COULD NOT SMELL ANY ALCOHOLIC BEVERAGE ON HIS BREATH, CAPTAIN DOWLING REQUESTED THAT A DRUG RECOGNITION EXPERT (DRE) BE CALLED TO THE SCENE. DISPATCH NOTIFIED SURROUNDING CITIES AND TOWNS OF OUR NEED FOR A DRE. NOBODY WAS ABLE TO RESPOND. TRAFFIC OFFICER WADE RESPONDED TO THE SCENE AND PERFORMED A ROADSIDE ASSESSMENT ON MR SMALL. SEE HIS SUPPLEMENTAL REPORT. BASED ON OFFICER WADES ROADSIDE ASSESSMENT AND MY ON-SCENE OBSERVATIONS, I PLACED MR SMALL UNDER ARREST FOR OUI DRUGS, MARKED LANES, AND NEGLIGENT OPERATION OF A MV. MR SMALL WAS HANDCUFFED AND SEARCHED BY OFFICER WADE. PRIOR TO TRANSPORT, CRUISER 499 WAS SEARCHED BY OFFICER WADE FOR CONTRABAND WITH NEGATIVE RESULTS. OFFICER WADE THEN PLACED MR SMALL INTO CRUISER 499 AND SEAT BELTED HIM. WHILE OFFICER WADE DID THIS, OFFICER WILSON AND I DID AN INVENTORY OF THE VEHICLE. DURING THE INVENTORY, 9 CVS PAPER PRESCRIPTION PRINTOUTS WERE FOUND. THEY WERE ALL IN MR SMALL'S NAME FOR THE DRUG "ADDERALL" (8) OR "KLONOPIN" (1). ALSO FOUND WAS A SMALL YELLOW PLASTIC PRESCRIPTION TYPE BOTTLE CONTAINING AN UNKNOWN LIQUID. OFFICER WILSON PLACED THE BOTTLE OF UNKNOWN LIQUID INTO A BAG AND HAD IT LATER EXAMINED AT THE NPD STATION BY DET. ROBINSON OF THE DRUG UNIT (HE DETERMINED IT TO BE NOT SUSPICIOUS AND IT WAS DISPOSED OF). THE VEHICLE WAS THEN TOWED BY TODY'S TOWING. THE CVS PAPER PRESCRIPTION PRINTOUTS WERE REMOVED AND PLACED INTO PROPERTY AND EVIDENCE. TOWED MV AND PROPERTY AND EVIDENCE FORMS WERE FILLED OUT. PICTURES OF THE VEHICLE AND DAMAGED TELEPHONE POLE WERE TAKEN BY OFFICER WILSON. OFFICER WILSON TURNED THE DISC OVER TO DIRECTOR SMITH, WHO DOWNLOADED THEM. AFTER THE MV INVENTORY, I TRANSPORTED MR SMALL TO NEWTON POLICE FOR BOOKING. AT THE STATION MR SMALL WAS REMOVED FROM MY CRUISER AND THE CRUISER WAS AGAIN SEARCHED AND I FOUND NO CONTRABAND OR WEAPONS. HE WAS THEN PROCESSED BY OFFICER JASON SCHLEGEL, BOOKED BY SGT O'CONNELL, THEN PLACED INTO CELL #3. MR SMALL WAS ISSUED CITATION NUMBER T0645459, IN HAND FOR 1.) OUI DRUGS CH90 SEC24, 2.) MARKED LANES VIOLATION CH90 SEC4A, 3.) NEGLIGENT OPERATION CH90 SEC24E. AN IMMEDIATE THREAT FORM WAS FILLED OUT BY MYSELF AND A COPY OF THE REPORT ALONG WITH THE MOTOR VEHICLE CITATION WERE FAXED OVER TO THE MASSACHUSETTS REGISTRY OF MOTOR VEHICLES.

On 05/15/2019, while assigned to N494, I, Officer Conary, responded to a MVA at 109 Adam Street, a public way in the City of Newton. Upon arrival, I observed a utility pole broken in half, wires hanging in the street, and also a transformer on the ground. Fire and medics responded. Other police units were able to block the street from traffic. I spoke to witness, HARRIS, who stated that she was traveling Southbound on Adam Street when she saw MV1 in the wrong lane traveling toward her at a high rate of speed. HARRIS stated that MV1 then turned into the utility pole located outside of 109. MV1 took out the pole, side swiped MV2 and then hit MV3 head on. Operator of MV1 stated that he was traveling Northbound on Adam Street when he sneezed. At this point, he said his eyes were off the road and the next thing he could remember was being in the parking lot of 109 Adam Street after the accident. There was significant damage to the front of MV1 with airbag deployment. Operator of MV1 was checked out by the medics for a head injury and signed a refusal. Operator of MV1 was asked if he had consumed any alcohol or taken any medication today and he declined. Officer Spinney (N491) asked if he was willing to do a Field Sobriety Test, and he stated yes. Operator of MV1 did not show any signs of intoxication. Operator of MV2 stated that he had parked his car outside of 109 Adam Street and was sitting in the driver seat when he was hit by MV1 and also the utility pole. Operator of MV2 was able to exit his car. He was evaluated by the medics and signed a refusal. MV2 has significant damage to the right side and windshield. MV3 was parked in the lot of 109 Adam Street facing Southbound. MV1 hit MV3 head on. There was significant damage to MV3 front end. The electric meter attached to 109 Adam Street was ripped off the house. There are no signs of damage to the house to report at this time. MV1 was towed by Tody's. Eversource arrived on scene. Operator of MV1 was issued a citation for marked lanes violation. Pictures were taken of the scene and will be submitted to IT.

Operator of MV1 stated he was traveling northbound on Waverly Ave and slowed down to turn when he was struck from behind by MV2. Operator of MV2 stated she was traveling northbound on Waverly Ave when she was struck from behind by MV3 pushing her into MV1. Operator of MV3 stated she was traveling northbound on Waverly Ave when she was struck from behind by MV4 pushing her into MV2. Operator of MV4 stated he was traveling to close to MV3 and had no time to stop and struck the vehicle causing the accident. Operator of MV4 was determined to be operating under the influence of alcohol and was placed under arrest for 90/24 OUI (See incident #19021959). No operators reported any injuries. MV3 and MV4 were towed by Todys due to damage.

On 06/08/2019 at 0150 hours I received a call from Sgt Lee in regard to a head on motor vehicle crash with entrapment that had occurred on Center St at the four way intersection with Cabot St and Sergeant St. Upon my arrival at the crash scene I was advised by Sgt Lee that all occupants of the involved vehicles had been transported to hospitals for treatment. I made the following observations of the crash scene , Center St is a two lane public way in the city of Newton that runs north to south. I observed a city of Newton contracted Cataldo ambulance stopped in the south bound lane of Center St at Cabot St. The ambulance was MA AMN registration AMB 370 a 2017 Ford Econo Line that had heavy damage to the front end and driver's side fender. I observed that the front tire of the ambulance was snapped off and was pushed back towards the driver's side door. I further observed that both of the front and side air bags of the ambulance were deployed. The front of the ambulance's final point of rest was 8'8" from a fixed overhead light pole on the northeast corner of Center St at Cabot St. The ambulance's front passenger side tire was 4'3" front the curb on the Cabot St side. The ambulance's rear passenger side tire was 2'3" from the Cabot St side curb. The ambulance's rear driver side tire was 5'1" from the double yellow line on Center St. The ambulance's front driver side tire was 6'3"from the Center St double yellow line. The width of Center St from the double yellow line to the Center St curb is 15'' and 16'" to the Sergeant St side. I observed a 2011 Mazda 3 with MA PAN registration 6KJ783 facing south bound in the north bound lane. The Mazda had heavy damage to it's front end, and I observed that it's front tires had snapped off. The Mazda's roof had been removed by Newton Fire to extract the occupant. The front of the Mazda's final point of rest was 40'3" from a fixed overhead light pole on the northeast corner of Center St and Sergeant St. The Mazda's front passenger tire was 4'6" from the double yellow line on Center St. The Mazda's rear passenger side tire was 7'6" from the Center St double yellow line. The Mazda's rear passenger side tire was 1'2" from the Center St double yellow line. The Mazda's front driver's side tire was on the curb on the Sergeant St side of Center St. There were no skid marks from the Mazda which indicates that no braking occurred. At the time of the crash, the Cataldo Ambulance was being operated by Paramedic Corey Bohan and Paramedic Tom White was in the front passenger seat. Bohan stated that he was operating his vehicle southbound on Center St towards Cabot St after clearing a medical call. There were no patients in the ambulance at the time of the crash, and Bohan estimated he was travelling 25 MPH . Bohan stated within less than two seconds he observed a vehicle traveling towards him northbound on Center St in the southbound lane and estimated it's speed to be approximately 80 to 100 MPH.Bohan stated he was able to slow to a near stop and had moved his vehicle towards the right shoulder on Center St before the Mazda struck his vehicle head on. Bohan stated that after forcing his way out of the driver's seat of his vehicle, he rendered medical aid to the operator and only occupant of the Mazda, Jessica Pondish. Bohan stated that Pondish speech was slurred and he detected an odor of an alcoholic beverage emanating from her breath and person. Bohan was later transported to Newton Wellesley Hospital for evaluation. The passenger in the ambulance, Tom White stated to officers that he was working on the ambulance's laptop computer and did not see anything leading up to the impact from the crash. White stated that he was able to force himself free of the passenger side of the ambulance, and rendered medical aid to Pondish. White stated that Pondish was " in and out of it " and did not appear coherent.White stated that he asked Pondish if she had consumed any alcoholic beverage and she nodded in the affirmative. White Stated that he was unsure if Pondish understood his questions. White stated that he did not detect any odor of an alcohol beverage emanating from Pondish's breath or person. White was transported to Newton Wellesley Hospital for evaluation. Pondish was freed from her vehicle after approximately 22 minutes by Newton Fire Department units by utilizing special extraction tools. Pondish was transported by Newton Medic Unit Two to the Brigham and Women's Hospital in Boston for treatment. From 06/08/2019 to 06/10/2019 Pondish had two surgeries and was unable to speak due to her condition. On 06/10/2019 myself and Officer Gaudet were able to speak with Pondish in her hospital ICU room at the Brigham and Women's Hospital. Pondish's parents Lorena and John Pondish were present while we spoke with her. Officer Gaudet asked Pondish about the events that led up to the crash. Pondish stated that on 06/07/2019 she was at a friend's residence in Norton, MA. Pondish stated that while at her friend's residence she consumed a bottle and a half of Riesling wine. After Pondish's admission myself and Officer Gaudet stopped our conversation with her. I read Pondish her rights directly from a Miranda card and explained them in full before allowing her to continue speaking with myself and Officer Gaudet about the events of that led to the crash. Pondish stated that she understood her rights. Officer Gaudet asked Pondish if she had consumed any alcoholic beverages prior to driving home to her residence in Newton. Pondish stated that she drank a bottle and a half of Riesling wine by herself between the hours of 1700 and 0000 hours on 06/08/2019. Officer Gaudet asked Pondish how large the bottles of wine was that she drank, and she stated that they were average size. Officer Gaudet asked Pondish how she perceived her state of being was after consuming a bottle and a half of wine. Pondish stated that she felt " buzzed " . Pondish stated that she left her friend's residence in Norton at approximately 0100 hours on 06/08/2019 to return to her residence in Newton. Pondish stated that she does recall the events leading up to the crash, except that she tried to make a phone call but the person did not pick up. Pondish stated that her seat belt was on and that she was not texting while operating her vehicle. Pondish stated that her injuries consisted of a broken left elbow and internal injures to her intestines. On 06/09/2019 I spoke to Cataldo Paramedic Robert Canning and Stephen Heirholcer who were the medic unit that transported Pondish to the Brigham and Women's Hospital. Canning stated that he rendered medical aid to Pondish for approximately 20 minutes while Fire units worked to free her. Canning stated that Pondish's legs were pinned under her vehicle's dashboard. Canning stated that during the approximately 20 minutes that he was in close proximity to Pondish he could detect a strong odor of an alcoholic beverage that was emanating from her breath and person. Canning stated that once Pondish was freed he continued to treat and monitor her during the transport to the Brigham and Women's Hospital. Canning stated that when he asked Pondish if she had consumed any alcoholic beverage she stated that she had. Paramedic Heirholcer stated that he did not detect any odor of an alcoholic beverage emanating from Pondish's breath or person. Based upon the physical evidence at the crash scene, and statements made to officers by all of the above mentioned persons, Pondish is being charged with violation of MGLs 90/24j OUI liquor, 90/24e negligent operation of a motor vehicle, 89/4a failure to stay within marks lanes, and 90/17 speeding. On 06/12/2019 at the conclusion of the crash investigation I issued MA Criminal Application T 1269996 in hand to Pondish at her hospital room and explained to her what action she needed to take with court. On 06/11/2019 a letter of preservation was sent to Brigham and Women's Hospital requesting that a sample of Pondish's blood, urine and medical records be saved. On 06/12/2019 Brigham and Women's Hospital confirmed that a sample of Pondish's blood had been preserved. As of 06/12/2019 a search warrant for Pondish's blood sample was pending. Photos of the involved vehicles and of the crash scene were taken and downloaded by the NPD's IT Bureau. Both involved vehicles were towed from the crash scene and towed motor vehicle forms were filled out. An Iphone and backpack belonging to Pondish were taken from her vehicle for safekeeping and returned to her on 06/11/2019. A copy of this report was faxed to the MA RMV Driver Control Unit to request an immediate threat suspension.

OPMV#1 Was traveling Southbound on Chestnut St when she saw an object in the middle of the road and swerved into the Northbound lane of Chestnut St. OPMV#1 Drove up over the curb and onto the sidewalk colliding with a stone wall at 542 Chestnut St and a Utility pole. The vehicle then traveled Southbound on the sidewalk and stopped at the intersection of Chestnut St and Roslyn Rd. I observed major damage to front of the vehicle along with left and right side damage. Airbags were deployed on all sides. OPMV#1 Was evaluated by EMS and she signed a medical refusal. Vehicle was towed by Tody's Towing. OPMV#1 is charged with the following: M.G.L. C.89 S.4A Marked Lanes, M.G.L. C.90 S.24 Negligent Operation, M.G.L. C.90 S.24 OUI Alcohol. On Thursday, August 8th 2019, at approximately 8:25pm, I, Officer Brooks, was parked in front of 719 Washington street facing westbound. I looked into my side view mirror to pull into traffic and observed MV1 (MA REG 118GL4) parked behind me with the driver's side door open. The operator was leaning into the car to retrieve an item, and then stood up and turned around to close the door. I observed MV2(IN REG VWI565) traveling westbound, at what I estimated to be 45 miles per hour. MV2 struck the open door of MV1, narrowly missing operator #1. MV1 sustained major damage to the driver's side door and was towed by Tody's. MV2 had heavy damage to the passenger side front end. The operator of MV2 was placed under arrest for Operating under the influence of alcohol after investigation. MV2 was towed by Tody's. There were no injuries as a result of the accident.

MV1 operator, David Gorman (2017 Mazda Cx3, MA Reg:6TL761), stated that he was traveling from Commonwealth Ave turning right on Lexington St heading NORTH when he realized the vehicle behind him was following him very closely. MV1 continued to drive on Lexington St when MV2 (2015 Toyota Highlander, MA Reg: 6VS151), started to beep at him continuously and went over the double yellow line in an attempt to pass MV1. MV2 was unable to pass MV1 because of oncoming traffic so MV2 steered to get back into his lane. MV2 collided with MV1 in the area of 281 Lexington St. A witness, John Maclellan (off-duty police officer Watertown) who was in the area of Lexington St and Orris St. stated that he heard a vehicle beeping repeatedly and then heard a collision. Maclellan came outside to find MV2 over the double yellow lines facing oncoming traffic. MV2 had damage to its passenger front and MV1 had damage to its drivers side rear. Maclellan told MV2 operator, Renato Ribeirodasilva, to move his vehicle to a safe location on the right side of the road and get out of the vehicle to exchange paperwork with the other driver involved (MV1, Gorman). Maclellan phoned Newton PD to notify of the accident and as he was on the line, he witnessed both parties getting into a heated arguement on the sidewalk outside of their vehicles. MV2 operator, Renato Ribeirodasilva was taken into custody for the following charges: 90/24J - OUI Liquor, 90/24E - Neglegant Operator of a MV, and 89/4A - Marked Lanes Violation. Claudineia called a sober friend to drive her and her three children home to Waltham in Claudineia's vehicle. Claudineia was also under the influence of alcohol.

MV1 jumped a curb and collided with a parked vehicle MV2 (a 2004 GMC Yukon, MA Reg: 8EC792) in front of 185 Waltham St. MV1 operator, Angel Gonzales, was unconscious on scene in the driveway of 185 Waltham St. Waltham St is a public way that is owned and maintained by the City of Newton. A passerby, Joseph Anderson saw the aftermath of the crash and called 911. MV2 had damage to its drivers side door and rear side. MV1 was heavily damaged, on its side, and keys were in the ignition. MV1 was towed by towed by Tody's. Gonzales was transported to Beth Isreal in critical condition. When Gonazales was in the back of the ambulance, myself and medics smelled an odor of an alcoholic beverage emanating from Gonzales. All first responders thoroughly checked the surrounding area for a helmet but one could not be located. Due to Gonzales' critical condition and urgency to get to the hospital, and ID was not thoroughly looked for on his person. Ofc. Guarino, N491, retrieved an ID from Gonzales upon arrival at Beth Isreal Hospital. Ofc. Stake filled out a towed inventory form. Pictures taken and sent to IT. Sgt. Lee was notified and will be following up with this incident. MV1 operator, Angel Gonzales is being charged with the following (MA Uniform Citations T1442823 & T1442824): 90/24J - OUI Liquor (public way) 90/24E - Negligent Operation of a MV (operating recklessly at a high rate of speed) 89/4A - Marked Lanes 90/23 - Attaching Registration Plates (attaching registration plates to motorcycle to conceal the fact that it was unregistered. Registration plate on the motorcycle came back to a 2002 Honda VT750 motorcycle, MA Reg: 1T3988; VIN on the motorcycle came back to a 2005 Suzuki GSXR60, MA Reg: 1L4389) 90/9B - Unregistered MV (motorcycle 2005 Suzuki MA Reg: 1T3988 was confirmed unregistered by RMV) 90/23D - Operating MV with a Suspended License (RMV confirmed that Gonzales' license was suspended S94722414) (see Incident #19039806 for more details). For QED purposes, the charge 266/139 - Stolen Registration was added to this report because 90/23 - Attaching Registration Plates was not an option. Due to Gonzales' hospitalization, the citations will be mailed to his last known address. Officers were able to rise a Harold Curtis, the father of Anthony Curtis (owner of MV2, the GMC Yukon) at 185 Waltham St. He was notified of the incident and advised to call their insurance company. Curtis mentioned that he has cameras facing the street where the incident took place and will see if he can retrieve the footage for us. Police prosecutor to subpoena blood.

No damage was done to MV2. No injuries were reported. MV1 operator, Victoria Thurston, called AAA for a tow. Tody's was called for the Ford F250 due to MV2 operator, Brian Cernabentura's level of intoxication and unlicensed operation of the vehicle. Brian spoke Spanish and a passerby was able to translate some of my questions to him. I asked for identification and if he had been drinking. Brian did not give me any form of identification and he was very unsteady on his feet, glassy and bloodshot eyed. He was taken into custody by myself and booked at headquarters in the usual manner. Based on observations and statements made, the following occurred. M/V#1 was parked facing south on Chestnut St. awaiting to pull a M/V from an unrelated accident scene, with his yellow hazard light bar activated. A Verizon truck was parked facing north in the northbound lane of Chestnut St. and through traffic was being routed up the westbound side of Amherst St. M/V#2 approached traveling south on Chestnut St., and stopped approx. 100 feet away from M/V#1. It then began to slowly drive up to M/V#1 and attempt to pass between the two parked trucks, at a slow speed, when the right fender of M/V#2 struck the towing rig of M/V#1. The right fender of M/V#2 had damage along the right front wheel well. I was unable to see the extent of the damage to the tow rig. I went to speak to the operator of the M+#2 (who was standing outside to the right of his car) and as I approached him, I observed that he was swaying while standing. I asked the operator (later identified as David Taube-Perrotta) if he was ok, and he only said yeah. I then asked him what had happened, and he just motioned to his car with his right hand. As I stood next to him, I observed his eyes to be glassy and bloodshot. I asked him for his license and registration, and he kept staring towards the car without saying anything. I had to request his license and registration three times before he produced his license from a hip pocket. I then asked again for his registration, and he took approx. five unsteady steps to his passenger side door, opened the door, and almost fell into his car as he bent from the waist. He then stood up, closed the door, and started to return to me, until I told him I needed his registration again. He returned to his door, and again, almost fell into the car as he bent over to open the glove box. As he returned to me he appeared unsteady on his feet. He handed me the registration in a plastic sleeve, and I asked him to remove it from the sleeve. He appeared to have trouble removing the registration. I asked him where he was coming from, he stated that he was coming from Cambridge. I asked where in Cambridge, and he did not reply. I asked him if he had any alcoholic beverages during the evening, he shook his head in an exaggerated manner and stated that he didn't drink tonight. As I spoke more with him, I observed that his speech was slurred. I held my pen up and asked him if he could focus on the tip of pen. Instead of answering he tried to reach out and touch it. I advised him, I just wanted to know if he could focus on it, he stated yes, then raised his finger in an attempt to touch his nose, but instead, touched between his upper lip and nose, then tried to touch the tip of the pen again. I asked him to keep his down, and without moving his head, follow the tip of the pen. As I moved the pen from left to right, he turned his head to follow the pen. I had to remind him several times, to keep his head still, and follow only with his eyes. I asked him if he would be willing to take a field sobriety test, and he declined. I had also observed a small scratch on his forehead, and requested medics to evaluate him. As I took digital pictures of the accident, Taube-Perrotta was seen in the back of a Cataldo Ambulance, while Sgt. Devine observed. When I entered the ambulance, Sgt. Devine informed me that Taube-Perrotta stated that he was at "The Lizzard Lounge" in Cambridge earlier in the evening, and admitted that he had a few drinks. In my presence Taube-Perotta stated that he had two drinks, much earlier in the evening. While in the ambulance, Taube-Perrotta had trouble answering common questions by the medics, such as what his middle name was and where he lived. The operator of M/V#2 was placed under arrest for OUI. (See NPD Incident Report # 19053361)

On Sunday, December 15th 2019, at approximately 3:35am, Officer Donovan and I, Officer Brooks, responded to Washington street at Saint James street, for a report of a single car MVA. Upon our arrival we observed MV1 (MA REG 1GHG66) facing westbound on the sidewalk of Saint James street. The vehicle had heavy damage to the front drivers side door, broken axles, and all of the vehicles airbags had deployed. The operator of the vehicle was sitting outside of the vehicle speaking with MA State Trooper Newman who was on scene prior to my arrival, and had witnessed the accident. Trooper Newman stated MV1 was traveling westbound on Washington street, drove over a traffic island on Saint James street, hit a light post on the sidewalk, and spun sideways off the fence that separates Saint James street from the MA Turnpike. The vehicle then struck a tree and came to rest facing westbound on Saint James street. The vehicle was only occupied by the operator. Medics were called to evaluate the operator and a patient refusal was signed. After being cleared from the medics, Officer Donovan initiated an investigation into the circumstances of the accident, and subsequently placed the operator under arrest for operating a MV under the influence of alcohol. Tody's towing was notified to remove the vehicle due to its inoperability on the sidewalk. Officer Helms took photos of the accident scene which were submitted to the IT bureau. Officer Howes completed a motor vehicle inventory form which has been filed.

Vehicle #1 was traveling south on Crafts St. Vehicle #1 came to a stop to take a left turn into the operators driveway in front of 297 Crafts St. when it was struck in its rear end by Vehicle #2. Vehicle #2 was traveling south on Crafts St. and failed to slow for the Vehicle #1 that was stopped in traffic. Vehicle #2 crashed into vehicle #1 then continued south on Crafts St. before turning left onto Linwood Ave and leaving the scene. While on a routine traffic stop at California and Bridge St. Officer Spinney and Sergeant Mcneil heard me give out the description of vehicle #2. Officer Spinney and Sgt. Mcneil saw a damaged vehicle matching the description pass them going east on California St. Sgt. Macneil stated the truck said "Franchi" on the side. When Officer Spinney cleared the MV stop he was able to locate vehicle #2 located behind 37 Riverdale Ave. The Trucks hood and engine was still warm to the touch and had corresponding damage that matched witness statements. I was able to match pieces of the truck left at the scene of the accident to the vehicle Officer Spinney located. Pictures of the scene and both vehicles were taken and turned into the IT bureau. The co-owner of Vehicle #2 Robert Franchi could not tell us who was operating the vehicle. The co-owner of Vehicle #2 Robert appeared to be intoxicated and admitted to drinking. The owner of vehicle #2 has video footage of the vehicle being parked but could not provide us with a copy of it. Vehicle #1 suffered minor damage to its rear but was disabled and needed to be towed from the scene. Todys towed the vehicle. A towed MV report was completed and filed. Vehicle #2 suffered heavy front end damage primarily to its driver side. No injuries were reported.

MV2 operator stated MV1 took a quick left hand turn in front of him and that he was unable to stop. MV2 struck the front passenger bumper of MV1 and MV2 sustained front end damage. MV2 operator reported no injuries. MV1 operator was placed under arrest for Operating after Suspension, OUI Liquor, Negligent Operation, and for a warrant out of Waltham District Court.

MV #1 was traveling EASTBOUND on Webster St (a public way as it is maintained by the City of Newton) when it collided with a curb then a stone wall (private property belonging to 239 Webster St). MV#1 operator, Jordan Feinberg was found in front of 174 Webster St sitting on the sidewalk. He had a laceration on his arm and a lump forming on his forehead. Feinberg said that he drank half a bottle of wine tonight and hit a curb down the road (Webster St). Feinberg was sweating profusely, unsteady on his feet and had a very strong odor of an alcoholic beverage on his person. He said he was the only person in the vehicle. Officers went to go observe the vehicle and it had major front end damage and had collided with a stone wall belonging to 239 Webster St. When asked if he hit a stone wall, Feinberg said "no, I just hit a curb". He had no memory of hitting a stone wall. Resident of 239 Webster St was also the reporting party, James Pelis, said that he heard tires screeching and then a crash. He came outside and saw a MV up on the sidewalk and a male individual approximately 250lbs, heavyset, grey sweatpants and a dark shirt walking Eastbound on Webster St away from the crashed MV (this description fit Feinberg). Pelis assumed it was the driver but never saw him get out of the car. Feinberg was transported to NWH by medics. The vehicle (belonging to Feinberg's grandfather, Frederick Shapiro) was towed by Tody's. A towed motor vehicle formed was filled out. Pictures of the scene, damage to the stone wall and the MV condition were taken and the SD card was placed into IT's box. A criminal application was issued and given in hand to Feinberg at NWH by Ofc. Stake. The criminal application included 90/24J - OUI Liquor, 89/4a - Marked Lanes Violation, and 90/24E - Negligent Operation of a Motor Vehicle.

On 05/15/2020, at 2100 hours, I responded to the area 399 Washington St. for a single vehicle accident. Upon arrival, I observed a red Toyota Highlander (MA Reg. 82F930) with heavy front end damage from colliding with and knocking down a cement light pole. The operator of the vehicle had fled the scene prior to our arrival. The registered owner is Orlin R. Aguilar. Inside the vehicle were 'Five Star Moving' logs indicating that Aguilar works at 95 Adams St. The route Aguilar would take home from his employer's address to his house in Chelsea would take him past the crash location. Chelsea PD was contacted to check on Aguilar's wellbeing. Ofc. Serrano of CPD located Aguilar in his apartment taking a shower. He appeared intoxicated with redness on his nose and face. Aguilar stated his car was stolen and he had no idea why it would be in Newton. Chelsea PD's wellbeing check was performed over a half hour after the accident and, according to GPS, Aguilar's home is 14 minutes from the crash location. Dispatch contacted Uber and Lyft to inquire if Aguilar was picked up in the area of the crash. There are also surveillance cameras outside of Honda Village across from the crash. Charges are pending further investigation of the ride-share info and surveillance footage. Pictures of the damage to the city pole and vehicle were emailed to IT. Tody's responded and towed the vehicle. Washington St. is a public way maintained by the City of Newton.

Pictures were taken and submitted to IT. The airbag was deployed. Perez complained of chest and head pain. Perez was taken by Ambulance to Newton Wellesley Hospital. There was extensive damage to the front of the vehicle. Tody's Towed the vehicle. A Towed Motor Vehicle Inventory form was completed. Perez was mailed Mass Uniform Citation #T1273442 in the amount of $ 105 for M.G.L Ch. 89/9 Failure to Stop at Stop Sign.

On Friday, September 18th, 2020 at approximately 1619 hours I, Officer Newton, was dispatched to Brookline St and Spaulding Ln(both are public ways in the City of Newton) for a report of a vehicle that crossed over Brookline St and struck a tree and drove off with major front end damage. The RP was able to give a description of the vehicle as a White Audi with the license plate beginning with 8X. The RP also stated the vehicle was going down Dedham St and possibly turned down Marvin Ln. Sgt M. Wade located the vehicle, White Audi MA Reg 8XVP10, with major front end damage, parked outside of 45 Indian Ridge Rd and made contact with the operator, John Bigda. It should be noted that the house is 2 houses from Marvin Ln. Upon arrival I spoke to John. John stated he was driving his vehicle and got into an accident but it was not a big deal because he was able to drive home. John was not able to explain the details of his crash and was very evasive as to exactly what happened, just that he got into an accident because somebody cut him off. John continued to tell me multiple times nothing bad happened and everything was fine. John was very unsteady on his feet and was stumbling around and almost fell several times while I was trying to speak with him. John also had slurred speech and a strong odor of an alcoholic beverage coming from his person that I was able to smell even though I was wearing a mask. At this time I asked John to take field sobriety tests to which he refused by saying "I'm not taking the test." The Medics arrived on scene to evaluate John. John was not able to answer their questions and the medics decided he should go to the hospital for an evaluation. However, John refused to go to the hospital. NFD arrived on scene and stated they saw tire marks and debris at the location of the crash. Ofc. Guarino went to that location to take pictures that will be added to this report. Due to the above facts and because John was almost falling over while speaking with us, he was placed under arrest for Operating Under the Influence of Liquor. John was handcuffed (D/L) and searched prior to being placed in cruiser 499. Cruiser 499 was searched before and after transport for contraband with negative results. John was booked and read his Miranda rights by Sgt M. Wade and Ofc Donovan processed him. John was handed citation T2014721 for 89/4/A Marked Lanes Violation (Driving over the double yellow line and leaving the roadway to strike the tree on Brookline St), 90/24/C Leaving the Scene of Property Damage (Hitting a city tree and causing damage), and 90/24/K (Operating Under the Influence of Liquor, 2nd Offense.. 1st offense was 11/18/2004 OUI docket 0443CR2527A CWOF ). The citation was placed with John's property. The vehicle was towed by Todys.

On 9/27/20 I was Working N497 when I responded to an MVA with rollover in the area of Chestnut and Beacon St. along with multiple other units. Upon arrival at 565 Chestnut St. (which is a publicway in the city of Newton) I spoke with the operator of Veh 1 Jenna Wolf. Wolf stated that she was traveling northbound on Chestnut St. when a Vehicle traveling southbound swerved at her causing her to swerve to the left causing her to jump the curb and collide with a parked car. Wolf stated the car then rolled over and she was able to climb out on her own. Wolf had a laceration to the head that was bleeding so Newton Medics transported her to NWH for treatment. Wolf had a moderate smell of alcoholic beverages emanating from her person and glassy eyes and was slurring her words. Wolf was not asked to do field sobriety due to her injuries. The first parked car (Veh 2) that was struck by Veh 1 slid across the driveway and struck Veh 3, also causing damages to the driveway and yard. The Vehicles owner Vladimir Berezovsky was notified and provided a report number. Veh 2, and Veh 3 were disabled and towed away by Todys at the owners request. A witness named Reza Dana spoke with Ofc. T Keefe and stated "We were traveling down Beacon St. and had a green light at the intersection of Chestnut St. when two cars came speeding northbound on Chestnut St. and ran the red light at Beacon St. almost killing him". Then one of the cars went off the road and struck a parked car causing it to rollover. Veh 1 came back through dispatch as unregistered. Due to the fact that it was a residental area, the vehicle almost struck a home and the witness statment, Wolf was issued a Ma Uniform Citation T2080019 for 90/24/j Oui, 90/24/E MV Negligent Operation, 90/9/b Unregistered, 90/17/A Speeding. Pictures were taken by Ofc Keefe and submitted to IT.

On Wednesday, October 21st 2020 at 0341 hours, Myself N-499 and Ofc Crowe N498 responded to 524 Parker St for a single vehicle accident into a city tree. Upon arrival, I identified Mass Vet #VT36122, 2016 Dodge Sedan, Color Black had crashed into Verizon Pole number 340/50A. The airbags had been deployed. The operator was no longer in the vehicle. The operator was sitting down on the ground nearby . He was identified as Joshua Stomberg. Stomberg admitted he had operated the vehicle. Stomberg stated he was driving south on Parker St toward the VA Hospital for his work shift. Stomberg stated he was tired and did not feel alert. Stomberg also stated there was a heavy fog that made the road difficult to see. Stomberg's vehicle veered off the side of the road and collided with the pole causing heavy front end damage. Stomberg did not show any signs of being impaired by alcohol. An inventory of Stomberg's vehicle showed no discovery of any alcohol. It should be noted that on my way to the accident scene, I observed a very heavy fog on Parker St that made it difficult to see the road in front of me. Stomberg suffered an injury to his back and was transported to the VA Hospital by Cataldo Ambulance. Tody's towed the vehicle. Stomberg was mailed MA Uniform Citation # T2013041 for the amount of $ 105 for M.G.L Ch 89/S4A Marked Lanes Violation. Pictures were taken of the accident and submitted to Newton IT Bureau.

Upon arrival, the operator of the vehicle was out of her vehicle and speaking with the medics. She stated is that she was driving southbound on Grant Ave when a car swerved at her causing her to swerve. As I was speaking with her, I smelt a strong odor of alcohol and she was slurring her speech. She was brought into the ambulance due to her possible head injuries. She was transported to Newton Wellesley for an evaluation. The residence had structural damage to front window and the door frame. The vehicle was removed and towed by Todys and a towed motor vehicle form was filled out and filed.

Operator of MV1 left the scene of the accident and was located nearby at the intersection of Hammondswood Rd. at Intervale Rd. During questioning, Operator of MV1 admitted to consuming alcohol, appeared impaired and under the influence of alcohol on scene. Operator of MV1 completely left his lane of travel and was operating in a negligent manner. Operator of MV1 sustained injuries to his head and left ankle. He was then transported to Newton Wellesley Hospital for evaluation. MV1 sustained heavy front end damage due to impact. MV1 was unable to be towed due to live power lines underneath the vehicle. A voicemail was left with the traffic bureau to follow up on when it was safe to tow the vehicle involved. Operator of MV1 was mailed a criminal application, citation #T2012668 for the following offenses: 1. Ch. 90 Sec. 24/C (Leaving the scene of property damage). 2. Ch. 90 Sec. 24/E (MV, Negligent operation). 3. Ch. 90 Sec 24/J (OUI, Liquor). See incident #21016286 for further review.

On 5/4/21 at approx 2327 dispatched called in an erratic opertor in front of the NPD Headquarters, 1321 Washington St. Multiple units located the involved vehicle after it had turned onto Chrery St. (See Incident# 21019152) Traces of the vehicles skid marks were seen all the way into Waltham from our Highland St. While on Highland St it was clear MV 1 was traveling northbound on Highland St when the operator of the MV collided with telephone pole 208/22 in front of 200 Highland St causing significant damage to the passenger side of the truck. The vehicle continured NB driving by the police station and ultimately all the way to Waltham failing to stop for police. The operator, Mr. Edgar Ramirez was cited two citations MA uniform citation T2080798 for Ch 90/24J oui liquor, Ch 90/25D failure to stop for police, and Ch 9024 E Negligent Oper. MA uniform citation T 2080799 for Ch 90/24C Leaving the scene of property damage (telephone pole), Ch 90/24I Open container of alcohol, and Ch 89/4A marked lanes violation. The vehicle MA Reg 3GDB19 was towed by Tody's towing.

On 6/18/21 at approximately 0119 hrs Sgt. Fleming, Officer L. Keefe, and I, Officer Mildner responded to Sumner St @ Willow St. (public ways in Newton) for a report of a single motor vehicle crash. Upon arrival I noticed MA Reg: 8SP545 up on the sidewalk, air bags deployed, with heavy front end damage from what appeared to be from crashing into a tree. The operator was identified as Saurabh Korgaonkar, who was being evaluated by the medics and signed a patient refusal. I spoke with Korgaonkar and asked him what happened. As I began speaking to Korgaonkar I noticed he a strong odor of alcoholic beverage coming from his breath, glassy eyes, and slurred speech. Korgaonkar stated he was driving home from Brookline somewhere in the area of Commonwealth Ave. and Washington St. I asked Korgaonkar where he was specifically coming from and he stated "Abbey". I asked Korgaonkar if he had anything to drink while he was there to which he stated "two drinks". It should be noted Korgaonkar was unsteady on his feet and seemed extremely confused about what just happened. Given the damage from the crash, my conversation with Korgaonkar, and Korgaonkar's current state, I asked him if he was willing to perform Field Sobriety Tests. Korgaonkar stated he was willing to take the tests. I asked Korgaonkar if he wears glasses or contacts to which he stated "no". I asked Korgaonkar if he had any medical conditions that would affect his ability to take the tests to which he stated "no". I asked Korgaonkar if he felt comfortable in the shoes he was wearing to which he stated "yes". I brought Korgaonkar over to a clear spot on the side of the road on the fog line where the area was illuminated by the street light and cruiser spotlight. There were no blue lights on the cruisers. I used a field sobriety card I carry with me on my person to explain and instruct the tests. The first test I administered to Korgaonkar was Horizontal Gaze Nystagmus. I explained to Korgaonkar I was going to use a pen as the stimulus and to only follow it using his eyes only, not his head. Korgaonkar stated he understood the directions. The first attempt, Korgaonkar follow the pen using his head. I explained to Korgaonkar not to follow the pen using his head, but his eyes only. Korgaonkar stated he understood. The second attempt, Korgaonkar followed the pen using his head. I advised Korgaonkar again, to only use his eyes. On the third attempt, Korgaonkar followed the pen using his eyes only and I saw distinct nystagmus at maximum deviation and onset of nystagmus prior to 45 degrees. The second test I administered was the 9 Step Walk and Turn. I demonstrated the test for Korgaonkar and instructed him on how to complete the test. I placed my left foot on the fog line and right foot, heal to toe in front of the left. I demonstrated three heal to toe steps on the line, counting out loud, and keeping my hands by my side. Korgaonkar was advised to take 9 heal to toe steps, and then turn around and complete 9 more heal to toe steps. Korgaonkar stated he understood. During the test Korgaonkar did not place his heal to toe on steps 3,4,5. Korgaonkar almost fell over on the fourth step. Korgaonkar did not count out loud his steps and was using his arms for balance. On Korgaonkar's return, he did not count out loud again, almost fell to the side on step 6, was using his arms for balance, and stopped the test on his own at step 7. The third test I administered was the one leg stand. I explained to Korgaonkar the instructions and demonstrated the test for him. Korgaonkar stated he understood. I placed my hands by my side, feet together, raised my right foot six inches while looking at my foot, and counted 1001, 1002, 1003. I asked Korgaonkar if he understood, and not to stop counting until I told him to. Korgaonkar stated he understood. On the first attempt, I told Korgaonkar to start and he didn't lift a foot off the ground. On the second attempt, Korgaonkar lifted his left leg off the ground two inches, was looking straight ahead, and was not pointing his left foot. I explained to Korgaonkar his foot needed to be six inches off the ground, pointed, while keeping his eyes on his foot. On the third attempt, Korgaonkar dropped his left foot on 1004 and lost his balance on 1012. I concluded the test at 1020 counts. Based on my observations and Korgaonkar's performance on the field sobriety tests, I concluded that Korgaonkar had been operating a motor under the influence of alcohol. Korgaonkar was handcuffed (DL), searched, and placed in the rear of 496 where he was seat belted. The prisoner compartment was checked prior to and after transportation to NPD. Korgaonkar was booked by Sgt. Fleming and processed by Officer Ka. Donahue in the normal fashion. During booking, Korgaonkar was read his rights and asked if he wanted to take a breathalyzer test. Korgaonkar refused the breathalyzer test. Korgaonkar was notified his license was suspended, and his MA drivers licensed seized. Officer L. Keefe stood by and waited for Tody's to arrive and tow away the vehicle. A towed MV form was filled out and placed in appropriate mailbox. Korgaonkar was charged with the following: MGL Ch. 90 Sec. 24/J OUI Alcohol (Korgaonkar crashed his vehicle and failed field sobriety tests) MGL Ch. 90 Sec. 24/E Negligent Operation of MV (Korgaonkar failed to operate his vehicle in a safe manner) MGL Ch. 89 Sec. 4/A Marked Lanes Violation (Korgaonkar crossed the fog line, went onto the sidewalk, and hit a tree) Photo's of scene sent to IT. A court packet was filled out with all pertinent information and placed in the court prosecutors mailbox.

On Monday, June 28, 2021, while assigned to Traffic unit N525, I was entering my marked cruiser to leave the parking lot at the rear of 1321 Washington Street, Newton. The rear parking lot of the police station features a public right of access, but is restricted for authorized vehicle. There are signs posted at both entrances to the parking lot stating, "RESTRICTED AREA Newton Police Department Authorized Vehicles Only Beyond This Point. As I entered my cruiser, I observed a red 2020 Jeep Wrangler (CT: AX89516) parked directly across from my cruiser facing Eastbound. This vehicle was not parked in a marked parking spot and was the last vehicle in the parking lot from the Cherry Street entrance on the North side of the lot. I observed that the front bumper of this vehicle made contact with the rear bumper area of a parked 2018 Tesla Model 3 (EV3617 ). I exited my vehicle and walked over to the vehicles to investigate if a crash had occurred. I observed a black male party sitting in the front passenger seat of the Jeep. The driver seat was vacant. The Jeep had its driver door and passenger door windows rolled down. The vehicle was not running and there were no keys in the ignition. As I approached the passenger side door, the male passenger appeared to be asleep and I could detect a moderate odor of alcoholic beverage emanating from the passenger seat area. I woke up the passenger and inquired where the driver of the vehicle was. The passenger identified himself by his Connecticut ID as Masengo Kabongo (#178372788). Mr. Kabongo stated his cousin Marcel was the operator of the vehicle and they had pulled into their current parking spot so Marcel could run an errand. Mr. Kabongo stated he did not know where his cousin was, and he could not locate his phone to contact his cousin. I asked Mr. Kabongo if he was aware he was parked in the Newton Police Station parking lot and that the vehicle he was sitting in crashed into an employee's vehicle parked in front of them. Mr. Kabongo stated he was not aware. Mr. Kabongo appeared to be very confused with the situation and continued to state he did not know why they were there and where his cousin was. The registered owner of the Tesla arrived and assessed the damage to his vehicle. I observed minor damage to the rear bumper area to MV2. There was also minor damage to the front bumper of MV1. The owner of MV2 was able to review footage of the crash from his vehicles exterior surveillance system. While viewing this video with him, I observed MV1 enter the Newton Police Department parking lot from Cherry Street and pull right behind MV2. MV1 appeared to be occupied by two black males at this time. One in the passenger seat and one in the driver seat. MV1's front bumper area is then observed crashing into the rear bumper area of MV2. The Newton Police Department IT Bureau was able to observe the crash from a surveillance camera affixed to the Newton Police Department maintenance garage (facing Cherry Street). The video captures MV1 entering the parking lot and crashing into the rear of MV2. A black male with light colored shorts and a dark T-shirt is observed exiting the driver side door and walking away from the area up Cherry Street (S) to Washington Street. I explained to Mr. Kabongo that the crash was captured on our surveillance system and that his cousin appeared to be the operator. Mr. Kabongo stated his cousin was currently in Newton District Court being arranged for a previous incident (Report #21027283). I looked up recent bookings for NPD and I observed a party matching the name Mr. Kabongo provided. On Friday, June 25, 2021. Mr. Marcel Mengue-Ngoumou was arrested and cited by the Newton Police Department for OUI (Subsequent Offense), Negligent Operation, Marked Lanes, Open Container, and Unlicensed Operation. I contacted the Newton Police Department Court Prosecutor, Officer Hagopian, to see of Mr. Mengue-Ngoumou was still present in Newton District Court. Officer Hagopian stated he contacted the court and Mr. Mengue-Ngoumou was waiting to be arraigned. Myself and Officer Hagopian responded to Newton District Court to try and speak with Mr. Mengue-Ngoumou. Upon entering Session 1 in NDC, the lone individual sitting in the gallery was a party matching the description of the party from the surveillance footage. I spoke with Assistant District Attorney Nathan Stetson who was present in the court room. I apprised him of the current incident that Mr. Mengue-Ngoumou was involved in and told him I was going to speak with him. Mr. Mengue-Ngoumou at this time was sitting on the second to last bench on the left side of Session 1 as you walk into the courtroom. The exit to the courtroom was behind him. I approached Mr. Mengue-Ngoumou from the front of the courtroom and explained to him that I had just spoken to his cousin in the parking lot of the Newton Police Department. I explained to him the vehicle his cousin was sitting in had crashed into a parked vehicle belonging to a Newton Police Department employee. I explained to Mr. Mengue-Ngoumou that his cousin had identified him as the operator of the vehicle. I then asked Mr. Mengue-Ngoumou who was operating the vehicle when they were traveling to court today. Mr. Mengue-Ngoumou stated he was the operator. I asked Mr. Mengue-Ngoumou if he knew he had parked in the Newton Police Department parking lot. Mr. Mengue-Ngoumou stated he did not. I asked Mr. Mengue-Ngoumou if he knew he crashed into a parked vehicle in the parking lot. Mr. Mengue-Ngoumou stated he did not. I asked Mr. Mengue-Ngoumou if he knew he was not supposed to be operating a vehicle because of his incident from the other night and his license being suspended. Mr. Mengue-Ngoumou stated he did. I apprised ADA Stetson to my conversation with Mr. Mengue-Ngoumou. Mr. Mengue-Ngoumou was issued Massachusetts Uniform Citation 054528AB in hand for Chapter 90, Section 23(K) (Operating a MV after suspension, subsequent offense), and Chapter 90, Section 24 (Leaving the Scene of Property Damage). Mr. Mengue-Ngoumou knowingly crashed into MV2, parked his vehicle, took the keys from the ignition, and left the area with out making an effort to contact the owner of MV2. The 2020 Jeep Wrangler from the crash was removed from the Newton Police Department parking lot by Tody's towing. A towed MV form was completed and submitted. Washington Street and Cherry Street are both public ways maintained by the City of Newton.

On Thursday 7/15/21 at approximately 0900hrs I was dispatched to 12 Rockland Street for the report of a motor vehicle with heavy damage resting in the middle of the street. Upon arrival I observed a brown Nissan Altima unoccupied not running in the middle of street. Heavy front end damage on the passenger side along with two flat tires on the passenger side. There was no operator on scene but the car was registered to 12 Rockland Street. It should be noted that Rockland Street is a public way located in the City of Newton. I spoke to the reporting party Barry Cocuzzo who lives at 18 Rockland Street. Mr. Cocuzzo stated he witnessed William Power operating the Nissan and turn onto Rockland Street. Mr. Cocuzzo observed Power drive into his driveway with the two flat tires and heavy front end damage. When Power exited the vehicle Cocuzzo yelled over to him but stated Power's was unable to communicate clearly to him. Cocuzzo observed Power's walk into his residence at 12 Rockland and then bereaved the vehicle slowly roll back out of the driveway. Medic 3 and Tody's responded to the scene. Due to the heavy damage and two flat tires Tody towed the vehicle. A towed motor vehicle inventory report was filled out. Medic 3 was called to the scene to evaluate the health of Power's. Officer Tocci and myself located Power's in the residence passed out on the couch. Empty alcohol cans were all around Power's. After several attempts to wake up Power's he finally came too. Power's speech was severely slurred, he could barely keep his eyes upon and he lacked the ability to stand up without assistance. The Medics transported Power's to Newton Wellesley. Power's is being cited (Ma Citation 069847AB and 06850AB) for 90/10/A Unlicensed Operation, 90/24/E Negligent Operation of MV, 90/24/C Leave Scene of Property Damage, 90/24/J OUI Liquor and 90/24/P Use MV Without Authority. 5 photos were taken of the motor vehicle. It should be noted that the original location of the crash and the object that was struck are unknown to us at this time. Dispatch was also able to confirm that Power's did not have an active license at this time. Power's mother Bernice Fougere who is the owner of the vehicle stated to me that Power's did not have permission to use her vehicle.

See incident report 21039916 for further information. The vehicle had not been towed yet, since the vehicle was trapped under a broken/ hanging part of the telephone pole. The vehicle will be towed as soon as the power company is able to replace the pole.

On 09/28/2021 @ approx. 0339 hrs. while on patrolin the area of 1717 Beacon St. I, Officer Sullivan, observed two motor vehicles pulled off to the side of the Beacon St. (public way). The rear vehicle MA Reg. W27879 had its hazard lights on with the operator, in the vehicle, in the driver's seat. The forward vehicle MA Reg. 3FHK99 also with its operator seated in the driver's seat. The vehicle was running and the operator was testing the operation of the vehicle by slowly moving forward by tapping the accelerator. I observed the vehicle to have tire/wheel damage to multiple tires. I activated my blue lights and exited my cruiser. As I approached the two vehicles I instructed the forward operator identified as Jiang, Xuan to stop the vehicle. The operator from the rear vehicle exited his vehicle. He was identified as Tao,Haichun. Mr. Tao stated his friend (Mr. Jiang) called him and stated he had a damaged tire. I later discovered through continued conversation that Tao is his boss. The two men work at IQ kitchen restaurant located at 1158 Beacon St, Newton. The location of the business is approximately 1 mile from the location of this incident. Jiang stated he was coming from work. while speaking with Jiang the odor of Alcoholic beverage was detected. further information in regards to this incident is documented. Reference Newton PD incident report #21041400. The location of a crash is unknown at this time. The vehicle sustained damage along the passenger side of the vehicle, mirror taken off and damage to three tires; two front and rear passenger. The vehicle MA Reg. 3FHK99 was towed from the area of 1717 Beacon St, Newton by Tody's Towing. The Incident/crash to be further investigated with pending MV violations.

MV1 was travelling North bound on Parker St. while waiting in traffic MV2 had rear ended MV1. Operator of MV2 exited vehicle to assess damage, then proceeded to get back in his vehicle and leave. Owner and passenger of MV1 proceeded to step in front of MV2 to obtain his information, but MV2 proceeded to drive towards the operator of MV1. Passenger of MV2 stated he placed his hands on the hood of MV2's vehicle to block him from leaving. MV2 proceeded to drive around MV1 passenger and left the scene. The driver and passenger of MV1 described the operator of MV2 as an older black male, in his 70's, with a salt and pepper beard and short black hair and wearing a white t-shirt. Driver and passenger of MV1 are unsure if the operator of MV2 is under the influence, due to the operator appearing "dirty" and having "eyes really wide open." It was asked if they could smell alcohol on the man or if he walked unsteadily, which the reporting party stated "no." Driver and passenger of MV1 stated they were okay and did not sustain any injuries and declining medical attention. MV1 had minimal damage to the rear bumper consisting of scratches. A description of MV2 was given as a gray Honda Civic with a Connecticut license plate. Upon clearing the scene, I canvassed the area yielding negative results. State Police was also notified, due to the accidents close proximity to Route 9.

MV1 and MV2 were involved in a road rage incident in the area of City Hall on Commonwealth Ave. Commonwealth Ave is a public way that is owned and maintained by the City of Newton. Stated by MV2 operator, James DAVIS: MV1 was operating his vehicle erratically behind and tailgating closely behind MV2. MV1 turned on his flashing white lights that were mounted in front of his driver and passenger side visors. MV2 believed that he was being pulled over by law enforcement so he turned right onto Chestnut St in order to pull over safely. MV2 operator, DAVIS observed the flashing light vehicle continue straight on Commonwealth Ave. MV2 continued his drive from Chestnut St to Temple St to Putnam St where he observed that same vehicle, MV1, driving around the rotary on Washington St over the Mass Pike heading in his direction. DAVIS stated that MV1 pinned MV2 by the driver's side door (B pillar). DAVIS was exiting his vehicle when MV1 closed in on his leg, injuring DAVIS with the car door and HELMS front bumper. Damage was visible on MV1 passenger side front bumper and MV2 driver's side door. DAVIS did not want medical treatment for his leg. Stated by operator HELMS in MV1: MV1 was being followed by MV2 in a dangerous manner in front of City Hall on Commonwealth Ave. MV2 operator, DAVIS, exited his vehicle when MV1 was stopped at the red light (Commonwealth Ave/Chestnut St). MV2 operator, DAVIS, threatened HELMS and brandished a knife. HELMS stated that he was scared for his life. At some point in the interaction, DAVIS got out of his vehicle again and brandished the knife again. HELMS was able to escape DAVIS and continue driving until he reached the backyard of the police station. During my interview with HELMS in the backyard I observed him trembling uncontrollably. I asked if he took anything tonight to which he said no, he was just cold. I asked if he smoked anything and he said he smoked a little marijuana earlier this afternoon but nothing since. HELMS is physically unable to complete field sobriety due to his past injuries including a TBI from a motorcycle accident, a rollover car accident and a bicycle accident where he was not wearing a helmet. He stated that he has multiple pins and plates in various parts of his body and does not feel safe doing field sobriety. I did not observe any odor of alcohol and HELMS stated that he has been sober for 10 years now. A MV search was conducted as well as pat frisk of DAVIS for officer safety. No knife was found on his person or in his vehicle. A MV search was conducted of HELMS vehicle due to arrest. Tody's towed HELMS' vehicle. Theodore Helms is being charged with the following: 90/7E - Improper Display of Flashing Lights (HELMS' mounted white light bar that flashes oscillating lights when turned on). 265/15A - Assault & Battery with a Dangerous Weapon (HELMS' vehicle pinning DAVIS' leg between his driver's side car door). UPDATE: 0030hrs DAVIS returned to the front desk of headquarters to claim that his leg was throbbing (the leg that was pinned between his car door by HELMS' vehicle). Pictures were taken of his knee and the SD card was sent to IT.

On Saturday, January 22, 2022 at approximately 1903hrs, MV1 was stopped at the intersection of Walnut St and Beacon St. when MV2 traveling Northbound on Walnut St. rear ended MV1. I asked the operator of MV1 if he was okay and if he would like to be evaluated by paramedics, which he replied "no." MV1 sustained minimal damage, consisting of a cracked rear bumper. Operator of MV1 stated he believed the operator of MV2 was under the influence of alcohol because the operator kept repeating himself. The operator of MV2 was no longer on scene, but Ofc. Boyle, who also responded to the call was able to make contact with the operator. It was concluded the operator was not under the influence, but had been repeating himself because he could not understand the other operators language. The operator of MV2 stated he spoke over the phone with MV1's niece, Nawarath Kluaypanngam, in order to exchange information. Operator of MV2 stated that he was not paying attention and thought the operator of MV1 was going to continue to drive forward. He stated he did not expect to see the brake lights in front of him and was unable to stop in time, causing him to rear end MV1. MV2 stated that his vehicle sustained no damage and also refused medical attention. Both vehicles were operational and the operators of MV1 and MV2 were informed a report would be generated.

On Tuesday, February 15th, 2022 at approximately 1908 hours the operator of Vehicle 1 was travelling Westbound on Auburn St when it crossed over the center double yellow lines, crossed the opposing lane of traffic, and went off the roadway before crashing through the vinyl privacy fence at #106 Auburn St. Vehicle 1 came to rest after colliding with the North-East corner of the residence. The operator of Vehicle 1 then attempted to reverse away from the crash and backed into and destroying more of the residence's privacy fence. The operator was then confronted by the occupants of the residence, including the homeowner. Fire and EMS arrived on scene and conducted patient care on the operator and formed the opinion that she was intoxicated. I arrived and interviewed the operator who stated that she had previously taken oxycodone. The operator was then transported to Newton Wellesley Hospital. The vehicle was towed from the scene by Tody's. The operator was charged with the following violations: C90ss24 OUI- Drugs C90ss24 Neg Op C89ss4A Marked Lanes An incident report was completed for this crash (See Report #22005833).

On April 9th 2022, at approximately 0038hrs, while assigned to cruiser N494, I, Officer Dragone, along with Officer Stake (N491) and Sgt. Brooks (N505) responded to the area of 196 Tremont St (public way in the City of Newton) for a report of a motor vehicle accident. Dispatch reported that the reporting party's vehicle was hit while it was parked in front of his address, and the operator of the other vehicle exchanged partial information and then left the scene. Upon arrival, I observed a blue Honda Accord bearing Massachusetts Registration: 1TDF63 (Vehicle 1) parked on the side of the road, blocking the driveway to 196 Tremont St. The vehicle had heavy damage along the driver's side of the vehicle and back left tire was pushed into the wheel well. In front of 190 Tremont St, I also observed a black BMW 528 bearing Massachusetts Registration: 1FDB38 ( Vehicle 2) with heavy damage along the passenger side of the vehicle and the front right wheel was completely detached from the axel. All the airbags in the vehicle were deployed, and it appeared that vehicle 2 was traveling Eastbound on Tremont St when it crashed into vehicle 1 at an angle. It should be noted that there were multiple deep scratches/dents on the hood, roof, and drivers side panels of vehicle 2 that were not consistent with the crash that just occurred; which indicates the operator was in multiple accidents prior to this one. Pro-tech Towing was also on scene to tow vehicle 2. I then spoke to the owner of vehicle 1, Ryan Desrosiers, who stated that his vehicle was parked on the side of the road when he heard a crash outside at approximately 2345hrs. Mr. Desrosiers stated when he went outside, he discovered his vehicle pushed in front of his driveway, approximately 10-15 feet from where he parked it, and the operator of vehicle 2 standing outside. Mr. Desrosiers stated when he spoke to the operator, he smelled like alcohol and had slurred speech. The operator, later identified as, Benjamin Wadsworth, told Mr. Desrosiers that he was "coming from in town" and "probably should have taken a Lyft tonight." When Mr. Desrosiers tried to exchange information, Mr. Wadsworth took Mr. Desrosiers' phone number and then texted him a link to a generic RMV website. Mr. Desrosiers then said Mr. Wadsworth called a tow company for his vehicle and insisted on paying out of pocket tomorrow for the damage to Mr. Desrosiers' vehicle but told him if he wanted he could call his insurance company. According to Mr. Desrosiers, Mr. Wadsworth then walked Eastbound on Tremont St towards Brighton. It should be noted that Mr. Wadsworth did not provide his name, address, or insurance company to Mr. Desrosiers prior to leaving. I had dispatch run a query on vehicle 2 (MA Reg: 1FDB38) and it came back registered to Benjamin Wadsworth out of 13 Charmane Rd East Falmouth, Massachusetts. While speaking with Mr. Desrosiers, the driver of the tow truck called Mr. Wadsworth cell phone to notify him that he was not going to be towing his vehicle. I was then able to get on the phone and speak with him, and he identified himself as Benjamin Wadsworth and admitted to being involved in the accident that just occurred. When I asked Mr. Wadsworth his location because I was concerned for his well-being due to the severity of the crash and airbag deployment, he stated he was at his apartment in Brighton. When I asked for the address of his apartment, he refused to give it to me and stated he was fine. I stated to Mr. Wadsworth that because he only gave limited information and then left the area that he could be charged with Leaving the scene of a collision, to which he replied, "I am in law school you can see the books in the back of my car, you can't do that, you have my plate, he can look that information online." When asked about having an address out of Falmouth, Mr. Wadsworth stated he has two addresses because he attends school in the area. It should be noted that while speaking with Mr. Wadsworth on the phone, his speech was slurred, slow, and dilerbrate, consistent with being intoxicated. Tody's towing arrived on scene and took possession of Mr. Wadsworth's vehicle. I then tried a second time to speak with Mr. Wadsworth via a phone call to get him to agree to a well-being check. Mr. Wadsworth, again, refused to provide me with his address in Brighton, insisting he was fine. Although Mr. Wadsworth sounded intoxicated, he did not sound injured and was coherent when answering my questions. Due to Benjamin Wadsworth operating recklessly, knowingly getting into a collision causing property damage, not providing his name, not providing his address, and leaving the scene, I am issuing him Massachusetts Uniformed Citation T1445620 for the following: MGL. Ch. 90 S.24 (Leaving the scene of a collision after property damage) MGL. Ch. 90 S.24/E (Negligent operation of a motor vehicle) A Request for Immediate Threat License Suspension/Revocation form was filled out and faxed over to the RMV.
