On January 1, 2019 at approximately 02:18 hours I, Officer Guarino, responded to 78 Vine St. for a hit and run. I spoke to the operator of MV1, who told me that he was driving Eastbound on Vine St, he turned on his left directional and began to pull into his driveway at 78 Vine St. The operator of MV 2 attempted to pass MV 1 on the left hand side crashing into MV1. MV2 put the vehicle in reverse and left the scene. The operator of MV1 said that the front bumper of MV2 had fallen off in the collision with MA License plate 4KZ917 still attached. The owner of that vehicle lives in Boston, so Boston Police were notified. I attempted to make contact with the owner of MV 2 with negative results. Update January 1, 2019 16:15 hours: I was able to contact the owner of MV2, who admitted that she was the operator of the vehicle and that she was in the vehicle alone. The operator of MV2 said that the operator of MV1 was driving very slow and stopped in the right lane so she attempted to pass the vehicle. MV1 began turning and MV2 struck MV1. The operator of MV 1 said that she was nervous and left the scene because her phone died and attempted to contact the Newton Police in the morning. I am mailing citation T1441275 to Cecelia Spangenberg for MGL90/24C, leaving the scene of property damage. Photographs of the bumper have been submitted to IT to be attached to this report. The license plate was logged into evidence and placed into property and evidence locket #8.

ON 1-1-19 AT APPROX. 0815HRS. WHILE WORKING N492 I TOOK A REPORT FOR MOTOR VEHICLE ACCIDENT. UPON ARRIVAL AT 416 WALNUT ST. I SPOKE TO THE OPERATOR OF VEHICLE #1. VEHICLE #1 HAD FRONT END AND HOOD DAMAGE, A SMASHED WINDSHIELD AND RIGHT SIDE AIRBAG DEPLOYMENT. THERE WAS NO DAMAGE TO VEHICLE #2. VEHICLE #1 DID NOT MAKE CONTACT WITH VEHICLE #2. ALL PARTIES REPORTED NO INJURIES. ALL PARTIES ADVISED TO CONTACT THEIR INSURANCE COMPANY. VEHICLE #1 HAD HIS VEHICLE TOWED BY AAA. Operator of vehicle one stated that while driving east bound on Crafts St at Albemarle Rd vehicle two darted out into the path of his vehicle from the south bound lane of Albemarle Rd. Operator of vehicle one stated that he attempted to avoid a crash with vehicle two by applying his vehicle's brakes and swerving to his left. Operator of vehicle one stated that his vehicle's front bumbler made contact with vehicle two's front driver's side fender and bumper. Operator of vehicle one stated that he was not injured his vehicle was not towed. Operator of vehicle two stated that he had stopped at the stop sign in the north bound lane of Albemarle Rd at Crafts St. Operator of vehicle two stated that he saw vehicle one driving east bound on Crafts St and he pulled out into the east bound lane of Crafts St in font of vehicle one believing that he had enough time to cross over Crafts St . Operator of vehicle two stated that vehicle one's front bumper struck his vehicle's front driver's side. Operator of vehicle two stated that he was not injured and his vehicle was not towed. Passenger in vehicle two Zbigniew Saletnik stated that he was not injured and had little recollection of the crash. All Streets are public ways in the city of Newton. I issued operator of vehicle two MA Citation T0340520 and cited him for MLG 89/8 , failure to yield. I took photos of the vehicles and crash area, the disk was downloaded by the NPD's IT bureau.

UPTON POLICE LATER MADE CONTACT WITH THE OWNERS SISTER WHO RELAYED THE MESSAGE TO BRIANNA TO CONTACT NEWTON POLICE. A SHORT TIME LATER I RECEIVED A CALL FROM BRIANNA COSKIE SHE REPORTED THAT HER BOYFRIEND WAS OPERATING HER VEHICLE THIS MORNING. SHE HAD ALREADY CONTACTED HIM PRIOR TO CALLING POLICE. HE TOLD BRIANNA THAT SOMEONE CUT HIM OFF THIS MORNING BUT WASN'T INVOLVED IN ANY ACCIDENT. I TOLD BRIANNA WHERE THE DAMAGE WAS ACCORDING TO THE OTHER DRIVER/ PASSENGER SIDE FRONT QUARTER. MV1 (MA Reg: 51JD62, 2007 green Toyota Pruis) operated by Marcia Gittes (DOB 11/29/1948) was traveling Southbound on Walnut St when it collided with a pedestrian in the crosswalk at Walnut St/Foster St. MV1 collided with a man, later identified as Jerome Shectman (DOB 10/7/1964). He had an injury to the back of his head, right hand, left shoulder and lower spine and was transported to Beth Israel Hospital. Witness, Patrick Clare-O'Brien saw the crash take place. He stated that the pedestrian, Jerome was crossing in the crosswalk traveling Westbound towards Foster St, successfully passed through the lane where vehicles were traveling Northbound on Walnut St and was then hit by the Toyota Prudish in the lane going Southbound. Jerome was already halfway through the crosswalk at this point. It was dark, but there was a streetlight directly over this crosswalk on Walnut St creating a semi-lit area for visibility. Mrs. Gittes stated that she didn't see him because he was wearing dark clothing and it was dark outside. She saw him when it was too late. There was no damage to her vehicle. Mrs. Gittes was given a monetary citation (T0646789) for 89/11 Crosswalk Violation. pictures were taken at the scene and the photo SD card was sent to IT. Traffic Bureau update (Officer Gaudet): I was asked to follow up with the injured pedestrian involved in this accident, Jerome Schectman (S77606276). Schectman stated he was attempting to cross Walnut Street east to west towards Foster Street. Schectman stated he entered the crosswalk after observing no cars traveling towards him in the Northbound lane of Walnut Street. Schectman stated he began walking across the street and stopped in the middle of Walnut Street after observing 2 vehicles traveling towards him in the Southbound lane. Schectman stated as the first vehicle went by, he stared at it as it traveled past him and down the street. Schectman stated as he looked back at the second car it was traveling right at him and he was unable to get out of the way. Schectman stated the vehicle hit him on his right side. Schectman listed his injuries as follows: fractured vertebrae, laceration to the back of his head, neck pain, and left shoulder/arm pain.

On Sunday January 6, 2019 at approximately 1747hrs, I responded to the intersection of Pleasant Street and Centre Street for a report of a city motor vehicle crash. Upon arrival I located all vehicles pulled off on Pleasant Street about 50 feet from the Centre Street intersection. The City vehicle involved was Newton Police Cruiser N 496 ("MV #2") and it was driven by Officer S. Siegal. Siegal reported that he was directly behind MV #1 and observed the vehicle make a left turn onto Pleasant Street which was against the one way sign. Officer Siegal reports upon seeing this illegal turn he immediately turned his emergency lights and was trying to make a motor vehicle stop. The vehicle immediately stopped and while trying to back up and turn around, the vehicle backed into his cruiser. Officer Siegal reported that the vehicle was backing at just a few miles per hour. MV #1 was MA Reg. 3ZN523 a 2004 Nissan Sentra. This vehicle was operated by Huihui Tang. Tang reported that she was trying to go to CVS at that intersection when she turned onto Pleasant Street. Tang reported when the emergency lights were activated she tried to turn around and made minor contact with the police cruiser. During our conversation there was a bit of a language barrier and Tang appeared confused on why we needed to do a report. There was no injuries or any damage to any vehicle. Centre Street and Pleasant Street are Public ways in the City of Newton. Officer Siegal issued Tang MA Uniform Citation T0646880 for violating 19/85 for operating the wrong way. This citation was mailed to Tang. The initial citation issued on scene was later voided due to an address error. Officer Siegal also took pictures of both vehicles. Tang was advised on the process of what to do following a crash and reported she understood.

On Saturday, January 12th 2019, at approximately 4:12pm, I, Officer Brooks, responded to a single vehicle accident in the area of Cherry street and Derby street, both of which are public ways in the city of Newton. Upon arrival in the area I observed the fire department off with MV1(MA REG 9PAK20), in front of 171 Cherry street. The vehicle had a fire hydrant lodged under the front axle, and front end damage. The fire department was attempting to wake the operator who was unresponsive. The fire department ended up administering 2 doses of Narcan to the operator before he became responsive. The operator was transported to Newton Wellesley Hospital by Cataldo for further evaluation. Based on the accident scene, it appears the operator was traveling southbound on Cherry street, crossed over the center line into oncoming traffic, striking the fire hydrant in front of 154 Cherry street, and then crossed back over into the correct lane of traffic before coming to rest in front of 171 Cherry street. The vehicle was towed by Tody's towing, and an inventory form was filled out and filed. The operator was mailed MA Uniform Citations T0648078 and T0648079 charging him with MGL 89/4A Marked Lanes violation, 90/24 OUI Drugs, 90/24(2)(A) Operating to Endanger/Negligent operation, 90/11 No License in Possession, and 90/11 No Registration in Possession. Officer Donahue took pictures of the fire hydrant and crash scene, which have been submitted to the IT Bureau. The fire department was made aware of the broken hydrant.

MA commercial reg M94754 (vehicle #1), a City of Newton pickup/sander truck, was located crashed over the curb in front of 1970 Beacon St. The vehicle was unoccupied, had the keys in the ignition, and was reported stolen just a few minutes prior to discovery. The reporting party of the stolen truck and uninvolved occupant is identified as City DPW worker George Sementelli. The witness/passerby who discovered the collision is also a DPW worker, identified as Donny Brandt. Pursuant to an investigation outlined in incident #19002213, the operator at the time of the crash was determined to be Michael Carter. It is believed that Carter stole the vehicle from 295 Auburn St, fled the area, and ultimately crashed in front of 1970 Beacon St. Corroborating facts outlined in the incident report put Carter as the operator. The vehicle itself was located partially on the sidewalk and partially on the road, therefore Carter is being cited with MGL 89/4A - Marked Lanes Violation (T1268423). Due to the fact it is believed that Carter fled the scene after the crash, MGL 90/24/C - Leaving the Scene of Property Damage was added as well as MGL 90/23/D Operating After a Suspended LIcense, and MGL 90/24/O - Reckless Operation of a Motor Vehicle. The crash occurred during busy weekday commuting about 0.7 miles from Angier Elementary School. The last 3 charges mentioned have been listed on a second citation (T1268422). Officer Brooks also issued T0648082 for OUI Drugs MGL 90/24/G. See the incident report for details about this charge. In total, there are (3) citations issued to Carter. The vehicle sustained heavy front end damage. It should be noted that the utility pole a couple of houses down from the crash site (Beacon/Varick Rd, pole #212) sustained fresh, minor superficial damage, consistent with the vehicle crashing into it before verring onto the sidewalk. Pictures have been taken and submitted to the IT bureau. Tody's responded and towed the vehicle to the police garage for processing due to the pending other criminal charges involved in this accident/incident. Michael Carter was subsequently placed under arrest and his citations have been placed into his property. Carter suffered a hand injury due to the crash an was transported to NWH Hospital for an evaluation after he was booked.

On 1/18/19 at approximately 1200hrs, a party who wished to remain anonymous reported observing a tractor trailer travelling on Washington St W/B at #1479 where the street curves to the right struck a traffic light pole in front of Burke & Blackington Funeral Home. The side of the trailer struck the pole. It was reported the operator, a non descript black male, stopped after the collision, picked up the downed pole and moved it onto the sidewalk. Markings observed on the trailer were "Powered Transportation" out of Laurel, Mississippi. Unknown plates. Operator left scene and as of this time, it hasn't been reported by the operator. Photos were taken of the downed pole and submitted to the IT bureau. Daigle Electric notified to respond. Google search of "Powered Transportation" was negative results.

On the above date and time I responded to the area of St.James St at Washington Street for a report of a past hit/run with City traffic signal knocked over. Upon arrival I observed the the traffic signal on St. James Street westbound just before the Washington Street bridge on the roadway. I did observe what appeared to be a sidewalk plow tire impressions on the sidewalk to the traffic signal. I cnanvassed the area with negative results and I am waiting to hear back from Public works who may have been assigned the area to plow the side walks. I also checked for any cameras in the area with negative results. I took pictures of the crash site area and I will have them downloaded at th I.T. Bureau.

On the above date and time I responded to the area of Watertown Street at Pearl St for a report of a traffic signal that was knocked down. Upon arrival on scene I observed the traffic signal knocked over and tire impressions of a possible sidewalk plow. I took pictures of the crash site area and will have them downloaded at the I.T. Bureau. I canvassed the area and found a City of Newton sidewalk plow with the operator. I spoke to the operator who stated he observed the damaged traffic signal and moved it out of the way but he did not have contact with it. I had dispatch notify the traffic signal company due the lights in the intersection being out. I also canvassed the area for cameras with negative results.

On 1/21/19 I was working N498 when I responded to 17 Charles River Ter for a report of a Cab that had struck a wall. Upon arrival I met with Pema Jigmey and Miriam Jost. Jost stated that Pema who was driving for Metro Cab (or Photo Cab) picked her up at the airport and brought her home. Once at her home 17 Charles River Ter, she asked him to back into the driveway due to the snow and ice conditions. While backing up in the driveway of 17 Charles River Ter the vehicle struck the residencet causing damage. Pema stated the same thing but believed Jost was half to blame due to the fact she asked him to be dropped in the driveway. I informed Pema that he drove the vehicle into the house and so was at fault. The house only appeared to suffer minor cosmetic damages but could not be accurately examined. Pema and Jost exchanged information in the hopes of settling the damages without insurance. Both parties were satisfied and provided a report number. Both parties stated they were uninjured and refused medical attention.

The operator of MV1 stated he was traveling Northbound on Centre St. at the intersection of Hyde Ave. when a vehicle in front of him braked. When he stepped on his brakes to slow down, MV1 skidded on ice off to the right into the "Speed Limit 25" sign, knocking it over. Tody's responded and pulled the vehicle off of the sign and the vehicle was able to be driven from the scene safetly. No injuries were reported. Photos of the sign were submitted to the IT bureau to be attatched to this report.

Leary was crossing Needham St southbound at the corner of the property between Stop and Shop and Jiffy Lube. She states that she was 1/4 of the way across the street when she was struck by MV1. The left side of her body(arm, hip) struck the right side of the MV. She fell to the ground. MV1 states that he was pulling out of the Stop and Shop driveway to turn right onto Needham St. He saw the pedestrian next to the snow bank on the right side of the driveway as he approached the end of the driveway. When he got to the end he did not see her anymore and assumed she had continued walking west on Needham St. He then turned right and felt the collision and then he saw her. He immediately pulled into the Jiffy Lube lot to check on her. I took pictures of the scene and the MV. They were TOT IT. After further investigation, on 2/7 the operator was cited for 90/14 failure to stop for pedestrian. I spoke with Kenneth via phone and advised him of the update. The citation was mailed to him. I am charging for 90/14 failure to stop for a pedestrian. On Wednesday February 6, the operator information of this report was ammended to show the correct operator information.

At approximately 1615HRs. on Thursday, January 24, 2019, I was dispatched to the intersection of Elliot St. and Boylston St. for a report of an MVA. Upon arrival, I located the operator of MV1 (MA Pass: 1NB459) who had pulled into the BP gas station. He stated that he was traveling Northbound on Elliot St. when his traffic signal turned red and he brought his vehicle to a complete stop at the intersection. He stated that at this time, he was rear ended by MV2. He and the operator of MV2 then got out of their respective vehicles and spoke about the collision, after a few moments, the operator of MV2 got in her vehicle and left. Using the picture of MV2's license plate (MA Pass: 3EY477) which he provided me, I was able to contact the operator of MV2 at her residence. She stated that she was traveling Northbound on Elliot St. and observed MV1 come to a stop and she applied her brakes and came to a complete stop aswell, without making any contact to MV1. She further stated that the operator of MV1 became agitated and started to yell at her. She then left because she asserts that there was no collision and she was concerned by the operator of MV1's behavior. I observed no damage to MV1's rear bumper area, with the exception of an old dent, approx. the size of a quarter, which was highlighted with some type of permanent marker. I observed no damage to MV2's front bumper area and I noted large, pronounced license plate bolts affixing MV2's license plate to its bumper. The operator of MV1 stated that he was suffering from back pain due to the collision and elected to drive himself to Carney Hospital. Due to there being no damage to either vehicle and the large plate bolts on MV2, which would have likely caused notable damage to MV1's bumper, I will not be charging the operator of MV2 with leaving the scene of an accident at this time. Both parties have been advised to contact their insurance companies and I cleared without incident.

On Tuesday, January 29, 2019, while assigned to Traffic unit N525, I responded to the intersection of Cherry Street and Webster Street, Newton for a report of a motor vehicle accident involving a City of Newton owned vehicle. Cherry Street and Webster Street are both public ways maintained by the City of Newton. The weather at the time of the accident was overcast. The road surface was dry. The operator of MV1, John Bryant III (MA: S61611545), stated he was operating a City of Newton owned Volvo BL70 (MA MVN: M84236) Eastbound on Webster Street past Cherry Street. Bryant stated as he came to a stop in traffic, MV2 crashed into the rear of the vehicle he was operating. I observed minor damage to the rear bucket area of MV1. Bryant reported no injuries on scene and signed a patient refusal with Newton Medics. Bryant works for the Utilities Department with the DPW. The operator of MV2, Andrew Bell (NJ: B23900426706004), stated he was operating his 2013 Volkswagon (NJ: C54KKJ) Eastbound on Webster Street past Cherry Street. Bell stated he was following MV1 a little too close while they were traveling down Webster Street. Bell stated while traveling down Webster Street he looked down quickly but does not remember why, and when he looked up MV1 had come to a stop. Bell stated he could not avoid crashing into the rear of MV1. I observed significant damage to the front hood/windshield area of MV1. Bell was transported to Newton Wellesley Hospital with a minor injury. Bell was provided with Massachusetts Uniform Citation T1272991 in hand for Newton City Ordinance Chapter 19 Section 71 (Following Too Closely) . Pictures were taken of both vehicles and submitted to the IT Bureau.

Traffic Bureau Update (Officer Gaudet): On Monday, February 4, 2019 I made contact with the President of Metrowest Packaging, Brian Hersh. Hersh stated his company does fulfillment deliveries for Amazon. Hersh was advised that a vehicle registered to his company was allegedly involved in a hit and run accident. Hersh was provided information on the vehicle involved. Hersh stated an employee named Alexis was operating MA CON:T65665 on the date of the accident and provided a phone number for this party. On Tuesday, February 5, 2019 I spoke with Alexis Laporte-Soto (S84358654). Laporte-Soto stated he was operating a 2017 Mercedes Sprint van (MA CON:T65665) in Newton for Metrowest Packaging on the date of the accident. I explained to Laporte-Soto the vehicle he was operating was alleged to have been involved in a hit and run accident on Highland Street in Newton. Highland Street is a public way maintained by the City of Newton. Laporte-Soto stated the vehicle he was operating hit the driver door mirror of a parked card on Highland Street. Laporte-Soto reported the accident as mirror (MV2 passenger side) to mirror (MV1 driver side). Laporte-Soto stated after his passenger side door mirror made contact with MV1's driver side door mirror, he stopped his vehicle 15 feet down the road. Laporte-Soto stated he walked up to the car he hit and saw the mirror was bent back but there was no damage. Laporte-Soto stated he waited near the car for 10 minutes and the owner never showed up. Laporte-Soto also stated a "random guy" took a picture of his license plate. Laporte-Soto stated he said "hi" to this party but the party ignored him and left the area. I asked Laporte-Soto why he did not call Newton Police to assist him in finding the owner of the vehicle he hit. Laporte-Soto stated he didn't know. I also advised Laporte-Soto that the name of the owner of the vehicle he hit was printed on the driver side door next. The owner's phone number and email address were also printed on the driver door. Laporte-Soto stated he didn't see that. I spoke with the owner of MV1, Jason Correria. Correria stated a co-worker observed the entire accident and observed MV2's passenger side mirror hit MV1's driver side mirror. Correria stated his co-worker then observed MV2 travel down Highland Street with out stopping and pull into the Santander parking lot located at 1314 Washington Street. Correria stated his co-worker saw the operator of MV2 exit his vehicle, check his passenger side door mirror for damage, and leave the area. Laporte-Soto will be mailled Massachusetts Uniform Citation T1443121 for Chapter 90, Section 24 (Leaving the scene of property damage).

MV1 stated he was "driving to fast around the corner and hit the pole." MV1 actually hit a curb, took down a street light, went up on the island hitting another street light prior to hitting the curb. The second light he struck fell on MV2. Vehicle 1 was traveling east on Washington Street. The operator of vehicle 1 states he felt the steering wheel pull hard to the right. The operator of vehicle 1 then pulled the steering wheel to the left in attempt to correct the pulling to the right. At this time the vehicle began to pull harder to the right and ended up striking the curb and a concrete light pole. The concrete pole is owned by the City of Newton, pictures taken and submitted to IT. MED2 responded and obtained a patient refusal. Eversource was notified and responded to disconnect the power. After the power was disconnected Todys was able to remove the vehicle. I was able to move the disconnected light pole and some debris to make the sidewalk passable. Eversource placed a cone over the disconnected wires and I was able to tape off the downed pole. Dispatch notified the city for the pole and to clean up the debris.

She stated she got out to look at the vehicle and didn't see any damage, so she took a photo of the license plate and would try to report it once she got home. MA Reg TC58LC had several scratches on the bumper of the vehicle.

At approximately 0110HRs on Sunday February 17, 2019, I was dispatched to the area of Dedham St. and Spiers Rd. (both public ways in the City of Newton), for a report of a motor vehicle vs pole accident with injury, airbag deployment and entrapment. Upon arrival, I exited my cruiser with my medical bag and AED and went to assist the motorist involved in the crash. MV1 (MA Passenger: 255ZA9) was completely off the roadway and on the shoulder of the road (facing Eastbound) with its nose contacting the light pole ( Verizon Pole #:103/80), which was now broken and listing to the side. Attempts to open the doors were unsuccessful and I attempted to communicate with the operator through a partially broken driver's window frame which was bent. The operator was slumped forward with his hand cradling his head and he was unable to speak, but was breathing. Newton Fire arrived and attempted to gain access to the vehicle via several manual tools with no success and instead deployed the Jaws of Life which was successful. Newton Fire also made entry into the rear passenger compartment because we viewed a child's car seat and checked with negative results for any child in the vehicle. Once the operator was cut out of his seatbelt and safely out of MV1 and on board Newton Medic 1, I entered the ambulance where he was identified as Mark Topham. It should be noted that Topham was having difficulty answering basic questions such as his name, date of birth, today's date, Etc. At one point when he was asked what today's date was, he gave his birth date of February 21, 1983 and it took him several attempts to say his last name, I had to run him over the air with a partial name to ascertain who he is. Also of note, in my presence and that of Sgt. Devine, Topham informed the medics that he had been consuming alcoholic beverages prior to the crash. Upon viewing the scene, I noted that the roadway was lit and I did not observe any skid marks on the dry, ice-free payment, indicating that there was unlikely any braking or swerving to avoid the collision. I spoke to the reporting party, Lindsay Giardina, she stated that she was traveling on Dedham St. when she heard what she believed to be a motor vehicle crash. When she came upon said crash, she attempted to assist the operator, as she was an off duty firefighter. She was unable to gain access to the inside of the vehicle, but communicated to the operator in the same manor as I did. She stated that she was able to smell the odor of an alcoholic beverage emanating from the operator. Topham was transported to Beth Israel of Boston, where he was assigned patient record number 3109921. I attempted to speak with him at the hospital, but was unable to do so because of his current state; I noted several injuries on Topham, such as a bloody lip, a wound to his lower left side and a wound to his left leg. Due to Topham's statements onboard of Medic 1 and Lindsay Giardina's observations, I will be charging Topham with one count of violating MGL Ch.90 S. 24 K OUI Liquor 2nd Offence, one count of violating MGL Ch.90 S. 24 E Negligent Operation of a Motor Vehicle and one count of violating MGL Ch. 89 S. 4A Marked Lanes Violation via MA Criminal Citations which I placed in the mail. Additionally, I will be seeking a subpoena for Topham's blood work from the hospital. Note: The crash occurred on the Newton/Boston line, Newton dispatch's GPS indicated that the crash was in Newton. I took several pictures of the scene and have forwarded them to IT to be attached to this report. I completed and filled an NPD Motor Vehicle Tow Inventory Form and Officer Boudrot stood by for the tow.

The owner of MV#1 stated her vehicle was parked in the rear parking lot (Located on Rice St) of 1066 Centre St and was informed by 2 witnesses that stated her vehicle was struck by MV#2. I spoke to the 2 witnesses and they stated they were on the second floor of 1066 Centre St in suite #212 and had a bird's eye view of the rear parking lot on Rice St. The witnesses stated that MV#1 was parked while MV#2 was parked at an angle at a very close proximity to MV#1. The witnesses stated the operator of MV#2 was cleaning the snow off her vehicle, got into her vehicle then backed out of her parking space striking MV#1. The witnesses took a digital photograph of MV#2's registration (MA REG 763YC9). They described the operator of MV#2 as an Asian female in her 40's, 5'1" in height, operating a black colored "Buick" S.U.V type vehicle. MV#1 sustained minor damages to its front passenger door and bumper. A query of MA REG 763YC9 showed that it was registered to an Asian female to a black colored "Buick Rendezvous". The owner of MV#1 stated the owner of MV#2 also has a business in the same building at 630 Commonwealth Ave (Move2Boston Group). I spoke to the registered owner of MV#2 via telephone and she stated she was parked in the rear parking lot on Rice St but denied making contact with any vehicles. I could not observe MV#2 as it was not at the scene. At 14:40 I returned to 1066 Centre St and was able to observe MV#2. MV#2 displayed minor scrapes to its front driver's side bumper which was consistent relative to where both vehicles were parked. Based on the witnesses statements I will document this accident and provide this report number to the vehicle owners.

The operator of MV1, Patrick Carresi (MA: S73958042), stated he was operating a City of Newton owned 2016 Ford F350 plow truck (MA MVN: M94756) turning left onto Ionia Street from Auburndale Av. Carresi stated as he took the turn, the rear passenger corner of the truck made contact with the drivers side front panel of MV2 which was parked on the side of the road facing southbound. I observed minor damage to the rear of MV1. MV2 received heavy front end damage with the entire front panel torn off. Carresi reported no injuries. Carresi works for the Utilities Department with the DPW. The operator of MV2, Donna Canavan (MA: S57637058), stated she was parked inside her 2005 Honda CRV (MA: 8ZEE40) facing southbound on Ionia Street. Canavan stated as the plow truck took the turn onto Ionia Street from Auburndale Av its rear corner of the truck struck the front panel of her parked vehicle ripping the panel off. I observed significant damage to the front panel area of MV2. Canavan reported no injuries and was able to drive her vehicle from the scene. Pictures were taken of both vehicles and submitted to the IT Bureau.

The bicyclist stated that he was travelling Westbound on Newtonville Ave prior to colliding with Vehicle #1. Vehicle #1 was cited for a violation of M.G.L. Ch.89/S.9-Stop Sign. It should be noted that the bicyclist was wearing a helmet, and a rear flasher, however wore no other bright, or reflective clothing. All parties declined medical attention. MV#1 stated while traveling westbound on Commonwealth Ave he closed his eyes for a few moments causing his vehicle to veer to the right. MV#1 drove up on the curb and struck a overhanging street light. MV#1 sustained heavy front end damage as well as uprooting the overhanging street light. Operator of MV#1 stated he had minor injuries and signed a patient refusal. Operator of MV#1 was given the following roadside tests, due to the time and circumstances of the incident. Operator of MV1 states she was driving Northbound on Centre St. She states she was in the right (straight ) lane, going the speed limit. She states MV2 attempted to turn left in front of her, and she was unable to avoid them. She stated MV2 struck her vehicle on the left front side, sending her off the road and into the traffic signal on the northeast side of the roadway. Operator of MV2 states he was driving southbound on Centre St, attempting to turn left onto Walnut St. He stated he did not see MV1 until the least second, because of the cars in the opposite turn lane. He stated he attempted to stop, but believed MV1 was speeding and he did not have time. Witness 1 was directly behind MV2. He stated it looked like MV2 was attempting to turn left in front of him. He stated MV1 did not appear to be speeding, and that MV2 turned into MV1. He stated he did not think the two cars could see each other until the last second. Witness 2 was in the opposite turn lane. She also stated it appeared MV1 was driving the proper speed, and MV2 turned into MV1. MV1 was towed by Tody's. MV2 was moved off to the side on Walnut St to wait for AAA. 2 parties from MV2 were transported to NWH with minor injuries. Operator of MV2 was given in hand MA citation# T1441667 for 89/8, Fail to yield while turning left. A traffic signal was taken down, and Dagle electric was notified to respond. All other lights were functioning properly. 4 photos were taken of the damage.

On Saturday March 9, 2019, at approximately 0230 hours, I, Officer Brandon, responded to the Weston/Newton line on Commonwealth Ave to assist Weston PD with field sobriety. On arrival Weston PD had concluded field sobriety and determined that the party, Glenn Matot, was not under the influence. Weston PD then explained that they had been contacted by AAA stating that a single vehicle accident occurred in Weston's jurisdiction. After further review, Weston PD and I determined that the accident was in fact in Newton. I then spoke with the operator of MV1, Glenn Matot, who stated that he was on his way home from work traveling westbound on Commonwealth ave in front of the Charles River Canoe and Kayak when he became distracted by a text message. Mr. Matot further explained that while texting, his car drifted to the right causing him to drive up on the snow bank and up onto the guard rail before then falling off back into the road. MV1 sustained major damage to both the passenger side and undercarriage. Mr. Matot did not sustain any injuries and denied any medical attention. AAA arrived on scene and removed the vehicle from the road and Mr. Matot took an Uber home. Two pictures were taken of the damaged City of Newton guard rail and submitted to IT to be attached to the report.

On Monday, March 11, 2019 while assigned to Traffic unit N525, I responded to the area of Watertown Street and Adams Street, Newton for a report of a motor vehicle/pedestrian accident. The accident was reported to Newton Police Dispatch by Newton Police Officer Charles Guarino. Officer Guarino identified the pedestrian involved in the accident as Newton Police Officer James Selig. Watertown Street and Adams Street are both public ways maintained by the City of Newton. After completing my investigation, the operator of MV1, Colleen Butaney (S20012566) was issued Massachusetts Uniform Citation T1272995 for Chapter 90, Section 25 (Fail to Stop for a Police Officer) and Chapter 89, Section 4A (Marked Lanes Violation). Butaney was advised and the citation was placed in her property in Locker #4 in the NPD holding area prior to her release. Officer T. McCarthy completed and submitted a criminal application for Butaney for Chapter 265, Section 15b (Assault with a Dangerous Weapon, MV). Please refer to incident report #19009204 for statements from all parties involved. Photos were taken of the area/vehicle and submitted to the IT Bureau. The vehicle involved, (MA: 531PX6) was removed from the roadway by Tody's towing. Officer Marini completed a towed motor vehicle report form. Surveillance footage of the incident was recovered from a local business and was submitted to the IT Bureau/Support Services. A property and evidence form was completed and submitted to Officer Manouk.

MV1 had just picked up a student at 56 Crescent Ave(at the intersection of Throwbridge). He made the pick up just west of the stop sign. He turned off his illuminated bus stop sign, paused and then began to pull into traffic. MV2 was stopped at the stop sign on Trowbridge st at Crescent St waiting for the bus to turn off the stop sign. When the bus turned it off, it appeared to him that the bus was not pulling into traffic. MV2 began to turn left "very slowly". As he was driving next to the van, the van pulled into traffic and the 2 MVs touched mirrors. There was no damage to either MV. A BLS ambulance was called to the scene because there were three students on board. All parents showed up and signed refusals for their children. Pictures were taken of the two mirrors that had no damage. Narrative:
On Friday March 15th 2019 at approximately 0730 hours I responded to the intersection of Beacon Street and Herrick Road for a report of a hit and run involving a bicyclist. The weather at the time of the accident was cloudy and the road conditions were dry. Both streets are public ways in the City of Newton. Upon arrival I observed the victim identified as Glenn Butcher (MA OLN S36552335), inside the ambulance getting medical attention. Butcher was getting a bandage applied to his left leg and complained of leg, back and neck pain. Butcher appeared visibly shaken and in pain. Butcher stated he had the green traffic light and was travelling eastbound on Beacon Street crossing Centre Street and then continuing straight crossing Herrick Road. Butcher stated MV1 was travelling westbound on Beacon Street and took a left turn onto Herrick Road and collided into his bicycle. Butcher states upon impact he flipped over his bicycle and landed on the hood of MV1, before rolling off and landing on the ground. Butcher states he was wearing his helmet which was present. Butcher states his bicycle ended up partially under MV1. Butcher states the operator of MV1 pulled his vehicle to the side of the road and got out of his vehicle and spoke to several witnesses briefly. Butcher states the operator then left the scene without properly exchanging information and did not wait for the police to arrive. Butcher described the vehicle as a dark gray Honda, and described the operator as an older white male, 5'10 approximately 80 years old with white hair. Butcher was also able to provide an email address for another bicyclist who witnessed the accident. The witness left his information with Butcher prior to my arrival. Fire fighters on scene were able to get the registration number of the vehicle from the witness (MA REG 4CX148) and gave it to Officers on scene. Butcher was transported by Medic 1 to NWH with minor injuries. His bicycle had visible damage to the frame area and skid marks were present on both tires. 19 photographs of the scene and the bicycle were taken and sent to the IT dept. email. Officer Gabriel transported the bicycle to the station where it was logged into Property & Evidence for safekeeping. Dispatch was able to query the registration which came back to a gray, 2010 Honda Accord registered to a Matthew Sugarman (MA OLN S38601397), out of W. Roxbury. Dispatch contacted the Boston Police Dept. and had them send an Officer to the address to try to make contact with Sugarman. Sugarman was advised to contact the Newton Police Dept. and I was able to speak with him on the telephone. Sugarman states he was driving the vehicle today and was involved in an accident with a bicycle. Sugarman states he was travelling westbound on Beacon Street and was taking a left onto Centre Street not Herrick Road. While speaking with Sugarman he seemed confused as to his location during the accident and was adamant that he was turning left onto Centre Street and not Herrick Road. I advised Sugarman that I was on scene with the first responding Officers and the accident clearly occurred at the intersection of Beacon Street and Herrick Road based upon the final resting place of the bicycle. Sugarman went on to state that his vehicle was already turning when the bicycle struck his vehicle and he believed it was the bicyclists fault. I advised Sugarman it appears the bicyclist had the right of way since it was traveling straight and that because his vehicle was taking a left turn, he failed to yield for on coming traffic at an intersection. When asked why he did not stay at the scene of the accident Sugarman stated he got out of his vehicle and spoke to the bicyclist and he "seemed okay". Sugarman states he then left the scene while the victim was still sitting on the ground. I asked Sugarman if he had ever been involved in accident before and he replied "no." I advised Sugarman that I am currently looking at his drivers history and see nine accidents that he was involved in. Sugarman stated "he has never been in accident like this before." I then asked Sugarman what the law states when you are involved in an accident and he was not able to provide me with an answer. I advised him that the law states you must stop and exchange information before leaving the scene of an accident. Again he stated the bicyclist seemed okay and "he had somewhere to be so he left." Sugarman has an extensive drivers history including nine surchargeable accidents, reckless operation, two different charges of leaving the scene property damage and two immediate threat affidavits filed against him. I advised Sugarman that I will be mailing him a citation for Ch89 s8 Fail to yield to oncoming traffic, and Ch90 s24 Leaving the scene of personal injury. I also filed an immediate threat form with the registry. I emailed the witness using the information he provided to the Newton Fire Dept that was on scene and received a phone call back from the witness identified as Bruce Adams. See witness report for his statements. I contacted the Bank of America located at 808 Beacon Street in Newton, as they are the closest business to that intersection with video surveillance. I spoke with George Walsh (781-834-8275) who stated they do not have any working cameras on that side of the building to the bank. For this report the bicyclist is entered as a non-motorist for validation purposes. Witness Bruce Adams (MA OLN S96398108) stated that he was riding his bicycle travelling behind the victim about 100 feet away. Adams states he was watching the victim and had a clear view of him as he travelled behind him, through the green traffic light heading eastbound on Beacon Street. Adams stated he witnessed MV1 travelling westbound on Beacon Street take a sharp left turn onto Herrick Road which turns into Union Street. Adams stated that the vehicle turned left colliding into the bicycle and there was no possible way the bicyclist had time to stop to avoid the collision. Adams stated the victim flew over his handle bars and fell on top of MV1's hood and then landed on the ground. Adams stated the victim's bicycle was stuck under MV1's front bumper. Adams stated the operator of MV1 backed his vehicle up with the bicycle still attached to his vehicle bumper and pulled MV1 over to the side of the road. The operator then got out of his vehicle and walked up to the victim who was laying on the ground visibly in pain. Adams stated the operator asked the victim if he was okay to which the victim did not immediatley reply as he was visibly shaken up. Adams stated the operator then walked back to his vehicle and attempted to leave the scene and that is when Adams stood infront of MV1 to stop him from leaving the scene. Adams stated he then removed the bicycle from underneath the bumper of MV1 and placed it on the side of the road. Adams stated the operator got out of his vehicle again and walked up to the victim and asked him "what do you want to do?". Adams stated the victim did not respond and that is when the operator got back into his vehicle and drove away, leaving the scene before any emergency response arrived. Adams stated he was able to memorize MV1's registration and stayed with the victim until police, fire and medics arrived. He stated he gave the fire dept the registration and his contact information prior to leaving the scene.

On 03/19/19 at 14:57 hours, I responded to 220 Dedham Street for a past motor vehicle hit and run accident involving a parked car that occurred at 12:26 hours on this date. Dedham Street is a public way maintained by the City of Newton. The owner of M/V # 1 states her vehicle was legally parked in front of 220 Dedham Street facing northbound when she came out and found a note from a witness saying it was struck by a gray Honda Accord bearing MA Reg. # 8512HV. It appears that the operator of M/V # 2 side swiped M/V # 1 as it was passing by on Dedham Street. I observed marks to the driver's side rear door area and the side view mirror was broken. On 03/20/19 at 08:47 hours, I spoke to the witness, Kawtar Bhih, on the phone and she stated that she was parked on the opposite side of where the accident took place. Bhih observed a gray Honda Accord with an elderly female operating M/V # 2 on Dedham Street almost side swiped another parked car before side swiping M/V # 1. She says that the vehicle slowed down after and then continued to leave the scene of the accident. She then took a photo of the above listed registration plate. I attempted to contact the owner of M/V # 2 (Jali Medical Inc Waltham, MA) and the receptionist was not able to provide any information at the time. I was told to call back the next day. I gave the vehicle and registration info to the person inquiring if they could find a possible driver and call back. While working on this report, I observed that the owner of M/V # 2 was involved in a past accident in our system and the operator at the time had an address of 66 Country Club Rd. Newton. On 03/20/19 at approx. 09:30 hours, I went over to this address and observed M/V # 2 in the driveway with an operator inside. After inquiring about the accident, she stated she was driving down Dedham Street when she heard a noise coming from her passenger side view mirror as she had struck something. She then left the scene not thinking it was serious. I observed fresh damage to her passenger side mirror along with other marks along the doors which appeared to be older. Operator was issued in hand MA Uniform Citation # T1441710 for Ch. 90/S24 Leaving the scene of property damage.

Operator of vehicle one ( MA reg 3986BV 2012 MERZ ) , Vladimir Krapchev stated that on 03/21/2018 at 08:56 hours he was stopped at a red light on Center St at Commonwealth Ave. Krapchev stated that his vehicle was heading south on Center St and was the third vehicle in line to turn west bound on Commonwealth Ave. Center St and Commonwealth Ave are both public ways in the city of Newton. Krapchev stated that " a red/maroon full size sedan fire department car " struck the front driver's side fender of his vehicle. Krapchev stated that the fire department car was travailing south bound on Center St in the north bound lane, passing stopped south bound Center St traffic. Krapchev stated that there was also north bound traffic on Center St that was turning from the west bound lane of Commonwealth Ave. Krapchev stated that the fire department car turned onto the east bound lane of Commonwealth Ave and did not stop. Operator of vehicle two Newton Fire Department LT Phillip McCully stated that he was driving Newton Fire Department Car 14 ( MA reg MVN MF461 2004 Ford Crown Victoria ) south bound on Center St with his vehicle's emergency lights and siren activated. Lt McCully stated that he was responding to a motor vehicle crash with possible entrapment on Hammond Pond Parkway. Lt McCully stated that he was passing stopped Center St south bound traffic in the north bound lane of Center St. Lt McCully also stated that there was north bound traffic on Center St and " it was tight between the cars ". Lt McCully stated that he was unaware that a crash had occurred. Lt. McCully stated that he did not fell and contact between his vehicle and Krapchev's vehicle. Lt McCully also stated that he did not hear the crash because of his vehicle's siren was activated. Krapchev's vehicle had minor damage and red paint marks on it's front driver's side fender. The Fire Department car had scuff marks on it's passenger side rear door. Neither vehicle was towed and both operators stated that they were not injured in the crash. I took photos of both vehicles and forwarded the disk to the NPD It bureau for down loading.

MV1, a City of Newton contracted school van, was the first car stopped at the red light north on Walnut St at Homer St. MV2 was slowing as she approached the red light and rear ended MV1. According to MV1, driver of MV2 got out of her MV and looked at both MVs. She then got back into her car and when the light turned green they both pulled over just past the intersection. MV2 asked MV1 if she hit him and he stated yes. She stated that she did not see his van, which is bright blue. MV2 operator stated to me that she was stopped at the traffic light and thought MV1 backed into her. When I told her MV1 statement she didn't argue. There was minimal damage to MV1. The outline of MV2 license plate was imprinted in dust on the bumper. There was no visible damage to MV2. I took pictures of the damage to MV1 and MV2. AFTER HITTING THE UTILITY POLE HIS VEHICLE CONTINUED TO MOVE ACROSS THE STREET TO 35 WEBSTER WHERE HE HIT A ROCK WALL CAUSING DAMAGE TO HIS LEFT FRONT. VEHICLE #2 STATES SHE WAS TRAVELING S-BOUND ON CHERRY ST. AS SHE APPROACHED WEBSTER ST. SHE STATES SHE WAS BLINDED BY SUN GLARE AND CONFUSED THE LIGHTS AT CHERRY AND WASHINGTON AS BEING THE CORRECT LIGHTS ( THEY WERE GREEN AT THE TIME ). WHEN SHE REALIZED THE LIGHT AT CHERRY AND WEBSTER WAS RED SHE WAS UNABLE TO AVOID HITTING VEHICLE #1. VEHICLE #1 HAD EXTENSIVE REAR AND LEFT FRONT END DAMAGE AND WAS TOWED BY TODYS. VEHICLE #2 HAD EXTENSIVE FRONT END DAMAGE AND WAS TOWED BY TODYS. OPERATOR OF VEHICLE #2 WAS MAILED CITATION ( T1442287 ) FOR CHAPTER 89/9 FAILURE TO YIELD. VEHICLE #1 WAS MAILED CITATION ( T1442286 ) FOR PASSENGER RESTRICTION VIOLATIONS UNDER JUNIOR OPERATOR LICENSE. ALL PARTIES , ( WITH THE EXCEPTION OF WRIGLEY LOWE ) REPORTED NO INJURIES AND SIGNED PATIENT REFUSALS. CHRISTOPHER CAMPBELL AND SERGIO ALVAREZ WERE TURNED OVER TO THEIR PARENTS. WRIGLEY LOWE WAS TRANSPORTED BY MEDIC2 TO NEWTON WELLESLEY HOSPITAL FOR MINOR CUTS. ALL PARTIES ADVISED TO CONTACT THEIR INSURANCE COMPANIES. MV1 was backing out of her parking spot in the parking lot at 916 Walnut St when she stopped to allow a pedestrian to cross in front of her vehicle. While she was waiting for the pedestrian to cross safely a vehicle backing out of the parking space across from hers backed into her vehicle and left the scene. Operator 1 was able to obtain a photo of the license plate. I then was able to contact operator 2 on the phone who stated she was at 916 Walnut St and "tapped" a vehicle when leaving and then left the scene. No injuries and both vehicle driven from the scene. MV1 sustained minor damage to the passenger side. Operator 2 states there is no damage to MV2. Operator 2 issued and mailed MA Uniform Citation T1442192 for leaving the scene property damage.

On Friday, March 29th 2019, at approximately 5pm, I, Officer Brooks, responded to the area of 450 Crafts street to speak with an operator who was involved in an accident. On my arrival I spoke with the operator of MV1(MA REG 28Z390), who stated approximately a half hour ago she was involved in a MVA with MV2(MA REG 7HA817), at the intersection of Crafts street and Albemarle road. The operator of MV1 stated she had been traveling westbound on Crafts street, when MV2 pulled off of Albemarle road heading southbound and struck her vehicle. I observed damage to the passenger side front quarter panel and wheel well of MV1. The operator stated she exchanged information with the operator of MV2, and they both went their seperate ways. MV1 is a rental car, and then the operator of MV1 called the rental car company they requested she make a police report. I was able to speak with the operator of MV2 via telephone. He states he was traveling on Albermarle road, and stopped at the stop sign at the intersection with Crafts street. After stopping he began to pull out, and his vehicle "scraped" MV1. The operator of MV2 stated he never saw MV1 coming. I saw pictures of the damage to his vehicle, which consisted of scratches on the drivers side front bumper and quarter panels. No injuries were reported and both vehicles were driven from the scene. I provided both operators with the report number.

On 04/01/2019, at 1736 hrs, I responded to the intersection of Washington St and Waverley Ave for a single vehicle MVA. Upon arrival, I observed a city sign with street names and a stop sign bent over to the ground. There were tire marks across the small island leading up to the signs at the intersection. The vehicle on scene had damage to its front passenger side. The operator of the vehicle stated he was traveling westbound on Washington St and attempted to turn left onto Waverley Ave when he ran over the island and struck the sign. MV1 a City of Newton school bus was stopped southbound on Parker St at Rte 9 east to turn left onto the ramp. MV2 began passing the bus on the right when the bus turned left onto the ramp. The right rear corner of the bus struck the front left wheel well of MV2. I took pictures of the damage to MV2 and TOT IT. I spoke with Regina Moody of transportation and she put me in contact with the driver of a bus who was in the area at the time of the MVA. On Thursday I met with Joseph Montuna who was in the area at the time of the MVA. His bus is 362. The side of his bus says Eastern Bus Company. It does not say Newton Public Schools anywhere visible. I looked at the right rear of the bus that would have come into contact with the MV. There was not even a smudge on the bumper. I am not positive that this is the bus involved. I have attempted to contact MV2 for clarification to positively ID the correct bus. The number provided goes directly to VM which is full. It is possible that this was a non Newton school bus involved that I am unable to identify.

The operator of vehicle 1 stated that with a green left turn arrow showing, and her left directional on she went to turn onto Waltham Street from Crafts Street when all of the sudden she hit a bicyclist. She stated she did not see the bicyclist at all prior to him hitting her car. The bicyclist stated does not remember anything from the accident at this time. The bicyclist was traveling southbound on Crafts Street and appears to have entered the intersection of Crafts and Waltham Street without stopping and while a red light was showing. He was wearing a helmet at the time of the crash, he was not wearing any reflective clothing(dark green jacket), and the bike did not have any lights. The bike was taken to support services for safe keeping by Ofc. J.March. Vehicle#1 was towed away by Tody's towing due to extensive damage. Bicyclist was transported to Beth Israel hospital for several trauma injuries. Pictures of scene was taken by me and sent to IT Bureau. Both witness's statements were the same. They stated that they were behind vehicle 1 in traffic and saw that she had on her left dirrectional signal and had a green left arrow signal when vehicle 1 went to turn left onto Waltham Street.

On Wednesday, April 10, 2019 while assigned to Traffic unit N525, I responded to the intersection of Centre Street and Wesley Street, Newton for a report of a motor vehicle accident involving a bicycle. It was also reported that the parties involved were arguing with each other. The weather at the time of the accident was cloudy and the road surface was dry. Centre Street and Wesley Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Abdulaziz Stewart (S04075169). Stewart stated he was operating his 2017 Toyota Camry (MA: 669FM3) at the time of the accident. Stewart stated he came to a stop on Wesley Street (E) at Centre Street and was attempting to take a left turn onto Centre Street. Stewart stated there were no vehicles in the Southbound lane of Centre Street and there was a vehicle stopped in the Northbound lane of Centre Street motioning to him to take his left turn. Stewart stated as he began to start his left turn, a bicyclist crashed into the front passenger area of his vehicle. Stewart stated the bicycle had been traveling Northbound on Centre Street in the Southbound Lane. Stewart stated after the collision the bicyclist was yelling at him and called him a "Nigger". Stewart and his occupant, Miriam Stewart, reported no injuries. Miriam is a student at Bigelow Middle School. I observed minor damage to the front passenger quarter panel area of MV1. I spoke with the bicyclist involved in the accident, Timothy Murtagh (S49233464). Murtagh stated he was traveling Northbound on Centre Street on his Cannondale bicycle in the Southbound lane. Murtagh was not wearing any safety equipment while operating his bicycle (helmet) and was wearing a dark red jacket. Murtagh stated as he approached Wesley Street, MV1 "jammed on the gas" and hit him in the roadway. Murtagh stated he then fell to the ground and landed in the middle of the street. While speaking with Murtagh I told him it was reported to me by the operator of MV1 that he used a racial slur during their interaction. Murtagh acknowledged that he did and stated, "I called him a nigger". I observed moderate damage to the front wheel/rim of Murtagh's bicycle. Murtagh reported no injuries. Murtagh was advised and issued Massachusetts Uniform Citation T1443441 for Chapter 85, Section 11B (Fail to ride on the correct side of the roadway). Photos were taken at the scene and submitted to the IT Bureau. Due to the language used by Murtagh during his exchange with Stewart, Officer Rosenbaum of the Community Services Bureau was made aware of the incident for follow up.

On Wednesday April 10th, 2019 at approximately 0755 hours I responded to the area of Centre Street and Washington Street for two car motor vehicle accident involving a Newton school bus with children on board. Centre Street and Washington Street are both public ways in the City of Newton. At the time of the accident the weather was cloudy with light rain. The road conditions were fairly dry. I spoke to the operator of MV1 identified as Julie Lym (S16060051) who stated she was traveling northbound on Washington Street onto the Centre Street bridge. MV1 stated she was attempting to cut across lanes to merge on to the Mass Pike Westbound. MV1 stated traffic was at a standstill and she saw an opening to change lanes. MV1 stated MV2 was stopped in front of her and as she attempted to change lanes her vehicle side swiped the rear drivers side corner of the school bus. The operator of MV1 reported no injuries. MV1 sustained minor damage and was able to leave the scene. I spoke with the operator of MV2 identified as Antonio Mendes Goncalves (S54275868) who stated he was stopped at the red light in the right middle lane on the Centre Street bridge. MV2 stated MV1 attempted to change lanes and struck the rear drivers side corner of the school bus. MV2 sustained minor damage and the operator reported no injuries. MV2 is a City of Newton contracted yellow school bus that had six children present on the bus at the time of the accident. The school bus was transporting th e children to Bigelow Middle School. All children present reported no injuries and their parents were notified by the school administration. I escorted the school bus back to the school where the children were all evaluated by the school nurse. 14 photographs were taken and submitted to the IT Bureau.

The operator of MV#1 states that she was traveling north on Melrose St from Auburn St when she encountered a large flat bed truck blocking the roadway in front of #283 Melrose St, which is currently under construction. The operator of MV#1 states she then spoke with an individual whom she believes to be Steven Vona of Vona Construction who is currently developing the site at #283 Melrose St. According to operator #1, Mr. Vona told her she needed to turn around immediately, which she attempted to do when the front of her MV struck a raised sidewalk causing damage to the front of her MV. Operator #1 was very concerned that there was no signage or personnel from Vona Construction directing motorist where to go and feels he is responsible for the damage to her MV as he was the one informing her she needed to leave the "construction zone" immediately. She further states that no one assisted her in turning around, her view was obstructed because her MV is so low to the ground and that a construction truck was blocking the nearest driveway, making it even more difficult to maneuver. As I entered Melrose St from Comm Ave when I arrived I observed no signage and MV's were having to turn around. I informed Steven Vona that if he was going to temporarily block the street to unload equipment he needed to either use cones, signs or workers to assist drivers. In regards to the crash, Mr. Vona stated that as operator #1 attempted to turn her MV around the front of her MV struck the sidewalk. On Tuesday, April 16, 2019 while assigned to Traffic unit N525, I responded to the area of Plymouth Road and Cochituate Road, Newton for a report of a motor vehicle/pedestrian accident involving a City of Newton vehicle. The weather at the time of the accident was clear and sunny. The road surface was dry. Plymouth Road and Cochituate Road are both public ways maintained by the City of Newton. The injured pedestrian, Officer Steven Emmanuel, was transported to Newton Wellesley Hospital prior to my arrival on scene. I spoke with the operator of MV1, Officer Justin Lau. Lau stated he was on duty in his official capacity as a Newton Police Officer while operating a City of Newton owned 2018 Ford Fusion (MA: 9PYM80, Newton PD #1319). Lau stated he was parked on Plymouth Road (N) at Cochituate Road and was speaking with Officer Steven Emmanuel. Lau stated Emmanuel was standing next to the front driver side door area of his vehicle in the roadway. Lau stated a large delivery trucked approached their location on Plymouth Road from Woodward Street and was attempting to make a right turn onto Cochituate Road. Lau stated Emmanuel directed him to back his vehicle up so the delivery truck could get by their location. Lau stated he cut the wheel of the vehicle he was operating to the right; and very slowly began to back up from his location. Lau stated he was attempting to back the vehicle up to get closer to the curbing and out of the roadway. Lau stated as the vehicle was in motion the front driver side wheel made contact with Emmanuel's left foot. Emmanuel's left foot subsequently became lodged in the front driver side wheel well area. Emmanuel fell to the ground in obvious pain. Emmanuel directed Lau to pull the vehicle forward in an effort to release his foot. Emmanuel's foot was freed and NPD Dispatch was notified of the accident. Pictures were taken of MV1 and submitted to the IT Bureau. I observed no damage to the front driver tire area. I spoke with Officer Steve Emmanuel in the Newton Wellesley Hospital emergency room where he was being evaluated for a left foot injury. Emmanuel stated at the time of the accident he was working a paid detail for Paramount Pictures on Plymouth Road in his official capacity as a Newton Police Officer. Emmanuel stated he was speaking with Officer Lau on Plymouth Road at Cochituate Road. Emmanuel was standing in the street on his post and Lau was sitting in MV1 (parked). Emmanuel stated a Fed Ex delivery truck approached their location in the roadway and was attempting to get by them. Emmanuel stated Lau began to back his vehicle up in an effort to get out of the way of the delivery truck. Emmanuel stated the front driver side tire of MV1 ran over his left foot. After the tire ran over his foot, it then became lodged in the wheel well and he fell to the ground. Emmanuel stated his foot was freed from the vehicle and he was transported to Newton Wellesley Hospital by Newton Medics for further evaluation.

Upon arrival I spoke with the operator of MV1 who stated while trying to manuever through oncoming traffic on Oak Street heading southboud MV1 struck MV2's drivers side mirror while MV2 was parked. MV1 reported no damage and reported no injuries. MV2 reiterated the same events and reported very minor damage to the drivers side mirror. No injuries were reported. Several pictures were taken of both vehicles and submitted to the IT Bureau.

Mrs. Weiss stated that she was attempting to back out of her driveway at 285 Crafts Street when her vehicle accelerated for no reason "like a bat out of hell." The vehicle then crossed Crafts street at a high rate of speed, jumped the curb, crossed the large grass island, and only stopped when the vehicle crashed into a tree. Mrs. Weiss was uninjured and signed a patient refusal. The vehicle sustained moderate damage to the tires, undercarriage, and rear bumper and was towed from the scene by Todys. Photos were taken of the damaged city tree and were placed in the IT bureaus mailbox to be attached to this report. Based on the facts that Mrs. Weiss could not explain the reason for the cars acceleration, the distance the vehicle traveled without stopping, and the close proximity of the crash to an elementary and middle school I filed a request for Immediate Threat License Suspension/Revocation. All proper paperwork as well as a copy of this report were faxed to the Registry of Motor Vehicles.

The operator of Vehicle #1, identified as Ms.Erzsebet Piros, stated that she took a left turn from Walnut St onto Washington St prior to the colliding with Ms. Kim Nguyen. She further stated that she did not see the pedestrian prior to hearing the collision. Her passenger, identified as Ms. Amy Torres, was sitting in the front passenger seat. She stated a similar account, and did not see the pedestrian prior to the collision. Neither party complained of injury, when asked. A witness, Ms. John Angelucci, was travelling in his vehicle, in the lane next to Ms. Piros. He stated that he only heard the collision, and couldn't see it due to vehicle lights, and the falling rain. The pedestrian, Ms. Kim Nguyen, stated that she attempted to cross the street, when she did not see any cars coming. She stated that she didn't see Vehicle #1 approaching until it was too late to get out of the way. It should be noted that Ms. Nguyen was not attempting to cross inside of a crosswalk, and was wearing dark colored/Navy Blue clothing. Ms. Nguyen was transported to Beth-Israel Hospital, and was communicating effectively prior to transport. Pictures of the scene, and damage to the vehicle were taken, and sent to IT for entry.

On April 24, 2019, while assigned to N496, I was called by Dispatch to respond to the area Beacon Street and Hammond Street for a motor vehicle crash. This was called in by Boston College Police Department. Upon arrival MV #1 was on Beacon Street just past Hammond Street at the Island with considerable vehicle damage. MV#1 stated while traveling westbound on Beacon St, while approaching the intersection of Hammond he stated he started to feel strange and not like himself. MV#1 stated he then struck the curb with his front right tire, not believing his accident was very serious at this time. He reversed his vehicle off the sidewalk and proceeded to travel westbound on Beacon St. After passing through the intersection he stated his car felt very off at which point he initiated his hazards and pulled over to the right. MV#1 stated he has a history of epilepsy and currently takes Oxcarbazepine twice a day for his condition. He stated he did not believe he had a seizure or lost consciousness but did not recall the incident very well. Boston College Ofc. Cadogan witnessed the incident, and stated the following, while conducting a directed patrol at the intersection of Beacon and Hammond St he saw MV#1 traveling westbound on Beacon St. Ofc. Cadogan stated MV#1 then took a sudden tight turn on to the curb striking the metal fence surrounding the BC facility. MV#1 was then seen / heard revving his engine while still in drive before reversing his vehicle off the curb and attempting to continue on Beacon St westbound. The fence surrounding the BC Facility sustained moderate damage. Tire marks in the grass show the path of MV#1 in direct line to the damaged property. While on scene, I spoke at length with Vanhorne. I did not detect or any alcohol from his breath as he spoke. Vanhorne reported he only consumed one beer tonight at roughly 2030hrs and smoked a little marijuana at 2200hrs. Vanhorne's eyes did not detect any signs of alcohol and he walked with no signs of any impairment. Sgt. Devine administered a horizontal nystagmus test which revealed no signs of impairment. Vanhorne reported he was at a work event and then visited a friend in Brookline. Vanhorne reported his last seizure from epilepsy occurred a little over two years ago. Pictures of the scene were taken and submitted to IT to be attached to this report. MV#1 operator stated he was not injured at this time. MV#1 was towed from the scene by Todys's due to heavy front end damage. Vanhorne was picked up from the scene by Paul Miller his step father. A towed MV form was filled out and placed in the traffic box. Witnesses Cassandra Williams and Bill Peirce observed the crash and stated identical narratives to Ofc. Cadogan's. An Immediate Threat form was filed with the RMV (via Fax and E-mail at approximately 0650hrs 4/24/19)due to his medical history and his explanation with this crash. All streets mentioned are public ways in the City of Newton. It should be noted that the road was wet from rain on this night. Update: on 4/27/19 Sgt.Devine was able to watch the video of the incident from Boston College Police. The video confirmed the statements given by BCPD and witnesses's. Due to the aforementioned statements and the video surveillance of the incident, MV#1 Operator will be cited with Marked Lanes Ch89/4a (MA Uniform Citation #T1441792. Vanhorne will be notified via phone he will be receiving the ticket in the mail.

The operator of MV1(ma reg 773KV5) was traveling WB on River Street through the intersection of Cherry St when her vehicle was struck by a motor vehicle traveling on Cherry St. The operator of MV1 stated she had a green light and MV2 went through a red light striking her driver's side door. The operator of MV2 (MA reg 5CG678) stated she was traveling NB on Cherry St approaching the intersection of River St when she struck MV1. Operator of MV2 admitted she ran the red light and stated she zoned out for a minute. Operator of MV2 stated she was unsure if she wanted to turn onto River or continue straight onto Cherry and she ended up driving through the red light. Operator of MV1 was complaining of possibly head injury so I called for an ambulance. ALS 28 arrived on scene to evaluate and ended up transporting Operator of MV1 to NWH. Operator of MV2 stated she was not injured and did not require medical evaluation. Both vehicles sustained heavy damage and required tow's. Tody's arrived on scene on towed both vehicles. After MV1 was struck the operator ended up crashing into the retaining wall of the West Parrish Burial Ground. There was significant damage to the fence and wall. I had dispatch call for a traffic car to respond to the accident to take pictures since the Burial Ground is City Property. Traffic Officer Gaudet responded and took pictures of the vehicles and damage to the wall. The operator of MV2 was cited for CH 89-9 Fail to stop for a red light. MV1 was traveling east on Madison Ave from Walnut St approaching #80. There were 2 landscape vehicles parked on left side of the street. The operator, Sarah Ruth Loper-Sengupta, stated that she never saw the pedestrian that was in the roadway (N) due to solar glare. Loper-Sengupta stated she heard a thump coming from the passenger side of her vehicle. Loper-Sengupta stated she looked over to her right and saw a trash barrel in the air. Loper-Sengupta stated she then saw a male party lying on the roadway on her passenger side. Immediately after striking the pedestrian, Loper-Sengupta, stopped to check on him. There was a golden doodle dog in the back seat of the MV at the time of the accident, unrestrained. There were no obstructions hanging from the mirror or windshield area. The front drivers visor was down. There was no airbag deployment. I observed significat damage to the front passenger side windshield area. There was also damage to the front passenger side hood area. See Sgt. Lee update for victim statement Numerous pictures were taken by Ofc. Gaudet of the MV and scene. They were TOT IT. The MV was towed by Tody's due to its shattered windshield. No citation will be issued to Loper-Sengupta. The solar glare caused her to not able to see the pedestrian. The Sgt. and I dont believe the pedestrian looked before crossing with the barell on his left shoulder because he would have been able to see the MV coming as this is straight away section of Madison Ave. It should be noted, that when I arrived on scene I immediately noticed the seolar glare as I walked east on Madison Ave.

The OP. of MV#1 states she was travelling on Beacon Street eastbound with a steady green light and was making a right turn onto Chestnut Street. That's when there was a collision with Bicyclist#1. Bicyclist#1 was travelling eastbound on Beacon Street and approaching the intersection of Chestnut Street. He noticed a non-involved vehicle in the intersection stopped there trying to make a left turn. He observed MV#1 slowly moving around that vehicle and thought MV#1 was going to continue going straight on Beacon Street so he pedaled through. That's when MV#1 was actually making a right turn and they collided together. Bicyclist#1 sustained some mouth injury and unknown bodily injuries. His bicycle sustained some damage to the front wheel and right handle bar. He signed a patient refusal with the medics. The OP. of MV#1 gave Bicyclist#1 a ride and transported his bicycle home. Several pictures were taken of the damaged bicycle. No new damage seen on MV#1 to determine impact location.

On 05/02/19 while on patrol I observed a Traffic Light Post knocked over and resting against a damaged wooden fence. The pole appears to have been struck by a vehicle as there are tire marks leading up to the base. On May 3, 2019 at approximately 18:18 I responded to a motor vehicle crash on Beacon St at the intersection of Hammond Pond Pkwy. It was reported that a school bus was involved with no passengers on board. Upon arrival, both vehicles were pulled over on the westbound lane of Beacon St. Both vehicles were turning left onto Beacon St. from Hammond Pond Pkwy, which has two left turn only lanes. On 05/04/19 at approximately 09:47 a citizen called in a vehicle that was parked on Elinor Rd near Woodcliff Rd with heavy damage. The anonymous caller stated the car had been parked there for at least 4 hours. Upon arrival Mass Reg #4FJ861 a 2004 Grey Honda Accord was spotted parked crooked in the road with its back bumper missing, bent drivers side rim and flat tire and large dent in the middle of the front bumper. Dispatch was able to get in touch with the vehicle owner Jaleh Jalili who stated her son Pouya Jalili was driving her car last night. While canvassing the neighborhood of Elinor Rd , Sgt. O'Connell was able to find a tire marks on a lawn and a downed "Sharp Bend" sign in front of #273 Dedham St. This crash site is approximately 1/4 mile away from where the parked car was found. I went to #273 Dedham St and witnessed fresh tire marks that went up on the curb onto the lawn of #273 Dedham St, over a vacant sign post hole and then a "Sharp Bend" sign that was half bent and then resting in the South brake down lane of Dedham St.. There was also a plastic black part of a car along with two (2) metal parts to the under side heat shield of an exhaust. The owner of #273 Dedham St was not home so I left a message on his door regarding this incident. Tody's was called and David showed up and towed the car from the scene. Officer Hagopian went to the residence of Pouya Jalili and spoke with him. Pouya told Officer Hagopian that he was involved in a spin out somewhere on Rt 9. in Wellesley and his bumper became detached. He then pulled into the CVS in Newton at #978 Boylston St where he pulled his bumper the rest of the way off. He then told Officer Hagopian that he continued down Rt 9 until he realized his car wouldn't make it any further and that's when he pulled off and parked on Elinor Rd. He then called a friend to pick him up and drive him home. On the way back to the station I stopped by #978 Boylston St with Officer Benes. He found a Grey rear bumper which is believed to belong to Pouya Jalili's car. I called David Donahue (Tow Driver) and asked that he look under the Honda to see if it had its heat shield. Donahue responded back that Mass Reg# 4FJ861 was missing its heat shield. I then drove to #93 Waltham St and spoke with Pouya Jalili with his mother Jaleh present. Pouya restated the same story he told Officer Hagopian and that he never struck anything in Newton nor was he drinking. Pouya said he might have been in a rush because he wanted to get home before his junior operator curfew. After finishing my interview with Pouya, I went to my cruiser and wrote Mass Criminal Citation #T1444231 for Ch 90/ Sec 24-Leaving the Scene of Property Damage (lawn and sign damage), Ch 90 / Sec 24-Operating to Endanger(putting the public at risk by driving up on the sidewalk) and Ch 89/ Sec 4a- Marked Lanes Violation (crossing Dedham St marked double yellow lines) and handed it to Pouya. I took pictures of the scene where the car was found, the crash site at #273 Dedham St and the bumper found at CVS and placed the disk in an envelope. The envelope was t.o.t. our I.T. Bureau for attachment to this report. Jaleh said her son was returning to Alabama tomorrow to finish high school and then he would be attending The University of Alabama in the Fall. I advised Jaleh about the Criminal Application process. As of today 05/04/19, Pouya has an active Massachusetts License and no B.O.P..Wellesley P.D. was notified of this incident in case they came across new damage on Rt 9.

On Sunday, May 5th, 2019 at approximately 1315 hours while working the City of Newton detail for the Walk for Hunger I was standing at my assigned post at the intersection of Centre Street and Willow Street. At the time, the road surface was dry and the weather was cloudy. Traffic was particulary heavy as there were several streets in the area still blocked off for the Walk for Hunger and there were participants still walking the route in the area. My attention was drawn to the intersection of Centre Street and Bowen Street as there was a motor vehicle travelling southbound on Centre Street with their left turn signal on attempting to take a left turn on to Gibbs Street. Gibbs Street was temporarily blocked to non-residential motorists as there were several pedestrians in the road crossing over Gibbs Street. As the motor vehicle attempted to turn, there were several pedestrians in the crosswalk crossing over Gibbs Street. The vehicle had stopped halfway into the northbound lane on Centre Street blocking on coming traffic. The operator appeared to realize Gibbs Street was blocked and attemped to turn the vehicle back into the southbound lane to continue southbound on Centre Street. As the vehicle turned back into the southbound traffic lane, the vehicles rear end collided with Officer Richard Clements, who was operating NPD motorcycle unit 533. Officer Clements was traveling southbound on Centre Street and was passing the vehicles in the southbound traffic lane which were currently all at a standstill. Officer Clements had his emergency lights activated as he was on his way to remove traffic cones from the street to open up all the traffic lanes along the event route. Officer Clements was working the City of Newton detail for the Walk for Hunger assigned to the motorcycle to assist with traffic. Officer Clements front wheel, left side of the motorcycle and left leg collided with the rear end of the motor vehicle. The impact of the crash caused him to fall off the left side of the motorcycle and land on the street face first. At this time I immediately ran from my post to Officer Clements location and radioed dispatch that a motorcycle officer was down and that I needed assistance. As I approached Officer Clements he was face down, unconcious and breathing. I was able to roll Officer Clements into the recovery position and at this time Officer Clements regained conciousness and was able to speak and stated " What happened? What was that lady doing she turned right into me". I advised Officer Clements that he had just been involved in an accident and to stay still and that help was on the way. The operator of the motor vehicle identified as Helen Leibner (S52717988) stopped her vehicle immediatley after the crash and got out of her vehicle to offer her assistance. I advised Helen and several other witnesses and bystanders who were now crowding around Officer Clements and I to back away from the scene and to not move any of the vehicles involved. Officer Selig arrived on scene and was able to help crowd control until further help arrived. Helen and all witnesses were advised to stand by for police to take their statements. While tending to Officer Clements he was disoriented and made several attempts to move his body to which I had to physically hold him still to prevent possible further injuries. While speaking with Officer Clements I noticed blood coming from the inside of his mouth. Officer Clements was in a noticeable amount of pain. He complained of head, back and left leg pain. Officer Clements was wearing a yellow ANSI certified Newton Police reflective jacket and a Newton Police issued motorcycle helmet. Once the paramedics and fire personnel arrived I was able to speak to the operator of the motor vehicle and several other witnesses. Helen stated she was traveling southbound on Centre Street operating her blue 2014 Audi A4 (MA REG 213BC9). Helen states she was attempting to take a left turn onto Gibbs Street and activated her left turn signal. Helen states she had stopped halfway into the northbound lane as several pedestrians were crossing Gibbs Street in the crosswalk at the time. Helen states after the pedestrians cleared she saw the traffic cones blocking the street and realized the street was closed. Helen states she turned her vehicle back into the southbound traffic lane and did not see Officer Clements or the motorcycle until impact. Helen was not injured and her motor vehicle sustained moderate rear end damage. Her motor vehicle was able to drive away from the scene. Witness Adron Gordon (S90357161) stated he was participating in the Walk for Hunger and had just crossed over Gibbs Street when the crash occured. He stated he witnessed the Officer on the motorcycle with the emergency lights on traveling southbound on Centre Street behind the motor vehicle. The motor vehicle stopped in traffic attempting to turn left onto Gibbs Street. He states then the vehicle made a slight turn back into the southbound traffic lane and the motorcycle collided with the rear end of the motor vehicle. He states the Officer then fell off the motorcycle landing in the middle of Centre Street. Witness Elizabeth McCarthy (S00242346) and Katherine Regan (S43486601) stated they both were in the same vehicle together stopped in traffic in the northbound lane of Centre Street just before the set of lights at Centre Street and Bowen Street. Both witnesses stated they do not remember if the driver of the motor vehicle had the turn signal on but they did see her attempt to turn onto Gibbs Street. They stated they also saw the motorcycle with emergency lights activated travel southbound on Centre Street approaching behind the vehicle. Witnesses state the motor vehicle then suddenly turned back into the southbound lane and the motorcycle collided with the passenger side tailight of the motor vehicle. Both witnesses state the motorcycle attemped to turn away from the vehicle to avoid the crash but was unable to do so. Witness Nina Wang (S39460985) stated she was parked on the southbound lane of Centre Street just prior to the crash scene. Nina states she was in her City of Newton DPW marked vehicle with the hazards on as she was working to assist with traffic safety for the Walk for Hunger. Nina states she witnessed the motorcycle travel southbound on Centre Street and pass the vehicles stopped in the traffic lane. Nina states the motorcycle passed the traffic using the left side and had the emergency lights activated. Nina states the motorcycle was just passing through the green light at Centre Street and Bowen Street when the motor vehicle that was stopped at the lights attempting to take a left turn onto Gibbs Street. Nina states the vehicle then abruptly jerked her car to the right and collided with the motorcycles left side. Nina states she heard a loud crash and witnessed the Officer fall off the motorcycle and land face first onto the street. The motorcycle's final resting place was on its left side approximately two feet away from where Officer Clements was located. The motorcycle sustained moderate damage to its left side, including the front wheel well and undercarriage. The motorcycle left scuff marks on the street which were measured and photographed. Several photographs of the scene and damage to both vehicles were taken and submitted to the IT Bureau. The motorcycle was towed by Todys. Centre Street and Bowen Street are both public ways maintained by the City of Newton. The injured motorcyclist, Officer Clements, was transported to Saint Elizabeth Hospital with fire fighters on board. I was able to follow up with Officer Clements on the phone the next day who was admitted over night at the hospital. Officer Clements stated he has no recollection of the accident and can only remember driving down Centre Street to begin to pick up cones to open up all lanes of traffic. Officer Clements stated he suffered a brain bleed, head, back, left foot and right thumb injuries. A Massachusetts Uniform Citation was issued and mailed to Helen for Chapter 89 Section 7A, failure to yield to emergency vehicle, police motorcycle.

On Tuesday May 7th, 2019 at approximately 13:15 hours I responded to the area of 30 Langley Road for an auto vs. pedestrian accident. At the time of the accident the weather was sunny and the road conditions were dry. Langley Road is a public way maintained by the City of Newton. Upon arrival I first spoke to the pedestrian who was inside the ambulance getting medical attention. The pedestrian identified as Donna Kalikow (S24151638) stated she was standing in an open parking space for a few seconds, attempting to walk across the street to enter J.P. Licks. Donna stated she was standing in the marked parking space waiting for traffic to stop to safely cross the street. Donna states the cars stopped to let her cross and she proceeded into the roadway. She states MV1 was attempting to back into the parking space that she was standing in and struck her right side and knocked her to the ground. Donna states the operator of MV1 stopped the vehicle when he realized he had struck her and got out to contact 911. Donna appeared to have minor injuries and complained of head pain. Medics transported Donna to NWH to be further evaluated. The operator of MV1 identified as Christopher Moos (S24090966) stated he was attempting to parallel park into an empty parking space and never saw the pedestrian standing in the space. Christopher stated as he was backing up into the space he was notified by a bystander that he just struck a pedestrian. Christopher stated he immediately stopped the vehicle and got out to assist the pedestrian and contact 911. Christopher stated he was not travelling no more than 5mph at the time of the accident. MV1 did not have any damage to the vehicle and was able to leave the scene. Christopher reported no injuries. Several photographs were taken of the scene and submitted to the IT Bureau. I mailed the operator a Massachussetts Uniform Citation for a City of Newton Ordinance violation for Section 19-75 Failure to use care when backing.

He struck the rear quarter of a red Toyota SUV that came out of Hobart Rd. The MV did stop and check on the bicyclist. The operator took out a video camera and recorded the bicyclist admit that the MVA was his fault. They did not exchange information and the operator stated that he could not wait for police to arrive. The bicyclist signed a medical refusal. Pictures were taken by me of the damaged bicycle. According to the bicyclist, there was no damage to the MV.

ON-SCENE PRIOR TO MY ARRIVAL WERE CAPTAIN DOWLING AND TRAFFIC SERGEANT LEE. CATALDO MEDIC 2 AND AMBULANCE 1 ARRIVED ON-SCENE, SHORTLY AFTER I DID. UPON MY ARRIVAL, I OBSERVED A SILVER HONDA CIVIC WITH HEAVY FRONT END DAMAGE. THE VEHICLE DISPLAYED MASSACHUSETTS REGISTRATION 7ZF784. TWO PEOPLE WERE STANDING BESIDE THE VEHICLE. A MAN AND A WOMEN SAID THEY HAD BEEN IN THE CAR. THE MAN, LATER IDENTIFIED AS BENJAMIN SMALL STATED HE HAD BEEN OPERATING THE VEHICLE. THE WOMAN, LATER IDENTIFIED AS KIMBERLY OAKES, STATED SHE WAS A PASSENGER IN THE VEHICLE. I ASKED THEM IF THEY WERE OK OR NEEDED MEDICAL HELP AND THEY SAID THEY WERE NOT INJURED. THE MEDICS CHECKED OUT MR SMALL ( MEDICS ELISE GADANSKY AND ROBERT ANDERSON) WHICH INCLUDED CHECKING FOR LOW BLOOD SUGAR, DUE TO HIS INABILITY TO SPEAK CLEARLY AND LEGIBLY. HIS BLOOD SUGAR CHECKED OUT FINE. I THEN ASKED MR SMALL WHAT HAD HAPPENED. HE STATED THAT HE WAS TRAVELING WESTBOUND ON DEDHAM ST WHEN ALL OF A SUDDEN A WHITE MINI VAN CROSSED OVER THE DOUBLE YELLOW LINE AND WAS HEADING TOWARDS HIM. HE STATED THAT IN ORDER TO AVOID A HEAD ON COLLISION, HE SWERVED RIGHT, OFF THE ROAD AND STRUCK A TELEPHONE POLE (LATER DETERMINED TO BE UTILITY POLE #60 LOCATED IN FRONT OF 556 DEDHAM STREET). HE STATED THAT HE PULLED OVER ONTO MEADOWBROOK RD. BOTH DEDHAM STREET AND MEADOWBROOK RD ARE PUBLIC WAYS IN THE CITY OF NEWTON. AS I WAS TALKING TO MR SMALL HE APPEARED TO SPEAK VERY SLOWLY, HE APPEARED TO BE LETHARGIC, BUT I COULD NOT DETECT ANY ODOR OF AN ALCOHOLIC BEVERAGE ON HIS BREATH. NEXT I SPOKE TO MS OAKES WHO STATED SHE IS MR SMALL'S GIRLFRIEND. SHE STATED SHE WAS A PASSENGER IN THE FRONT SEAT OF THE CAR. SHE ALSO STATED THAT MR SMALL WAS OPERATING THE VEHICLE WHEN A VEHICLE HAD CUT THEM OFF FORCING THEM OFF THE ROAD INTO THE TELEPHONE POLE. DUE TO THE FACT THAT WE COULD NOT SMELL ANY ALCOHOLIC BEVERAGE ON HIS BREATH, CAPTAIN DOWLING REQUESTED THAT A DRUG RECOGNITION EXPERT (DRE) BE CALLED TO THE SCENE. DISPATCH NOTIFIED SURROUNDING CITIES AND TOWNS OF OUR NEED FOR A DRE. NOBODY WAS ABLE TO RESPOND. TRAFFIC OFFICER WADE RESPONDED TO THE SCENE AND PERFORMED A ROADSIDE ASSESSMENT ON MR SMALL. SEE HIS SUPPLEMENTAL REPORT. BASED ON OFFICER WADES ROADSIDE ASSESSMENT AND MY ON-SCENE OBSERVATIONS, I PLACED MR SMALL UNDER ARREST FOR OUI DRUGS, MARKED LANES, AND NEGLIGENT OPERATION OF A MV. MR SMALL WAS HANDCUFFED AND SEARCHED BY OFFICER WADE. PRIOR TO TRANSPORT, CRUISER 499 WAS SEARCHED BY OFFICER WADE FOR CONTRABAND WITH NEGATIVE RESULTS. OFFICER WADE THEN PLACED MR SMALL INTO CRUISER 499 AND SEAT BELTED HIM. WHILE OFFICER WADE DID THIS, OFFICER WILSON AND I DID AN INVENTORY OF THE VEHICLE. DURING THE INVENTORY, 9 CVS PAPER PRESCRIPTION PRINTOUTS WERE FOUND. THEY WERE ALL IN MR SMALL'S NAME FOR THE DRUG "ADDERALL" (8) OR "KLONOPIN" (1). ALSO FOUND WAS A SMALL YELLOW PLASTIC PRESCRIPTION TYPE BOTTLE CONTAINING AN UNKNOWN LIQUID. OFFICER WILSON PLACED THE BOTTLE OF UNKNOWN LIQUID INTO A BAG AND HAD IT LATER EXAMINED AT THE NPD STATION BY DET. ROBINSON OF THE DRUG UNIT (HE DETERMINED IT TO BE NOT SUSPICIOUS AND IT WAS DISPOSED OF). THE VEHICLE WAS THEN TOWED BY TODY'S TOWING. THE CVS PAPER PRESCRIPTION PRINTOUTS WERE REMOVED AND PLACED INTO PROPERTY AND EVIDENCE. TOWED MV AND PROPERTY AND EVIDENCE FORMS WERE FILLED OUT. PICTURES OF THE VEHICLE AND DAMAGED TELEPHONE POLE WERE TAKEN BY OFFICER WILSON. OFFICER WILSON TURNED THE DISC OVER TO DIRECTOR SMITH, WHO DOWNLOADED THEM. AFTER THE MV INVENTORY, I TRANSPORTED MR SMALL TO NEWTON POLICE FOR BOOKING. AT THE STATION MR SMALL WAS REMOVED FROM MY CRUISER AND THE CRUISER WAS AGAIN SEARCHED AND I FOUND NO CONTRABAND OR WEAPONS. HE WAS THEN PROCESSED BY OFFICER JASON SCHLEGEL, BOOKED BY SGT O'CONNELL, THEN PLACED INTO CELL #3. MR SMALL WAS ISSUED CITATION NUMBER T0645459, IN HAND FOR 1.) OUI DRUGS CH90 SEC24, 2.) On 05/10/19 I met with Luiz A. Lopes who stated his vehicle ( Mass Commercial Reg# T83695 White Toyota Tacoma P/ U) was struck while parked in the lot around 07:00. Lopes said he didn't call the Police right away because he wasn't sure his car was struck there. The truck sustained a cracked front bumper and the fog light was popped out. We went inside of National Lumber and spoke with a manager who said he would contact G.M. Greg Assarian and have him look at the security footage. On 05/14/19 at approximately 14:00 the Police Station received a call from Lopes who just got off the phone with Assarian who found some security footage of the incident. I then traveled over to National Lumber and met with Assarian. He showed me the video and it appears that a newer grey four door Chevrolet truck backed into Lopes truck around 06:58 of 05/07/19. The Massachusetts plate is unreadable but an older White heavy set male gets out of the truck and walks into the store. After parking the truck the male can be seen checking his own truck bumper for damage. The male is wearing a baseball hat and sun glasses and cannot be identified on the video. The male does however walk with a noticeable limp. Assarian will show his picture to his employees and contact me if the employees are able to identify the male driver. I called Lopes back and apprised him of my findings. ******************UPDATE**************************************** As of today 05/20/19 I have yet to hear back from anyone at National Lumber so I will end this investigation and label it a hit and run crash.

On 05/15/2019, while assigned to N494, I, Officer Conary, responded to a MVA at 109 Adam Street, a public way in the City of Newton. Upon arrival, I observed a utility pole broken in half, wires hanging in the street, and also a transformer on the ground. Fire and medics responded. Other police units were able to block the street from traffic. I spoke to witness, HARRIS, who stated that she was traveling Southbound on Adam Street when she saw MV1 in the wrong lane traveling toward her at a high rate of speed. HARRIS stated that MV1 then turned into the utility pole located outside of 109. MV1 took out the pole, side swiped MV2 and then hit MV3 head on. Operator of MV1 stated that he was traveling Northbound on Adam Street when he sneezed. At this point, he said his eyes were off the road and the next thing he could remember was being in the parking lot of 109 Adam Street after the accident. There was significant damage to the front of MV1 with airbag deployment. Operator of MV1 was checked out by the medics for a head injury and signed a refusal. Operator of MV1 was asked if he had consumed any alcohol or taken any medication today and he declined. Officer Spinney (N491) asked if he was willing to do a Field Sobriety Test, and he stated yes. Operator of MV1 did not show any signs of intoxication. Operator of MV2 stated that he had parked his car outside of 109 Adam Street and was sitting in the driver seat when he was hit by MV1 and also the utility pole. Operator of MV2 was able to exit his car. He was evaluated by the medics and signed a refusal. MV2 has significant damage to the right side and windshield. MV3 was parked in the lot of 109 Adam Street facing Southbound. MV1 hit MV3 head on. There was significant damage to MV3 front end. The electric meter attached to 109 Adam Street was ripped off the house. There are no signs of damage to the house to report at this time. MV1 was towed by Tody's. Eversource arrived on scene. MV1, a City of Newton contracted school bus, was parked on the side of the road. MV2 was driving east past the school bus and misjudged how close his trailer(Ma Reg D43490) was and struck MV1. There were no students on the bus. I took pictures and TOT IT. Operator MV2 was unlicensed and cited with Ma Citation T1269943 for 90/10. 2 licensed operators showed up and too possession of MV2.

MV1, a 1999 Ford Explorer, MA Reg: 7ZT136, collided with a tree on city property just outside of 134 Mt Vernon St. Operator, Jarrod Stomberg, immediately told me that he looked down at his phone to make a phone call and in that moment, ran off the road and hit the tree. There was airbag deployment. Jarrod signed a refusal with the medics and was driven home by a family member. He was issued in hand MA Citation T1441780 for 90/13B - Texting While Driving. The vehicle was towed by Tody's Towing. Pictures were taken of the scene and placed into ITs box.

On Sunday May 19th 2019 at 03:32, I responded to a single car accident at the intersection of Washington Street and Park Street. Operator of MV1 stated she was alone in the car and was coming from the Newton Corner rotary attempting to turn onto Park Street. She stated that she misjudged the right turn and went up onto the first median knocking down a crosswalk signal pole and the pole with the traffic signal and Park Street sign. She then went up onto the second median taking down another crosswalk pole and a street sign pole. Operator of MV1 stated she was fatigued and was not paying attention when the accident occurred. She was evaluated by Cataldo Medic 1 and signed a patient refusal. David Donahue of Todys Towing removed the vehicle from the accident scene. Large debris and the poles were placed onto the median and out of traffic. 494 and myself placed cones over each of the bases of the poles. Dagle and the City of Newton were notified about the damage and for the debris to be picked up in the morning. A total of 12 pictures of the damage was taken and turned into IT.

Narrative:
On 5/20/19 at about 1510hrs I was dispatched to 136 Evelyn Rd for an MVA. En route to the location with Ofc Gourdeau, it was determined by first arriving Ofc Gourdeau that a vehicle had crashed through a fence at the end of Troy Lane and came to rest in the backyard of 126 Evelyn Rd. On arrival, I located the vehicle operator, identified as Mr Stuart Phillips who was operating MA Reg 8VVP40, an '03 Jaguar S Type model. Mr Phillips was walking around the backyard after the collision and appeared coherent as to what had transpired. He sustained a laceration to the top of his head and was bleeding heavily. We sat him down in a lawn chair prior to medics arrival to evaluate. When asked what happened, he stated he "hit the gas instead of the brakes". I asked him where did the accident begin? He stated he was turning around at the end of Troy Lane (a dead end cul de sac) and crashed through the fence there. Mr Phillips was alert and speaking clearly. I asked him if he was on any medication? He stated he was taking Plavix only, a blood thinner. I asked about his medical history and he stated he was released from Spalding Rehab today for treatment from a stroke and was receiving occupational therapy. Medics arrived to evaluate and he was transported to NWH for treatment. An investigation of the crash path of the vehicle revealed the following based on tire tracks and damage left behind: The vehicle crashed through the fence at the end of the cul de sac belonging to 41A Helene Rd; Vehicle drove over that back lawn, clipped the back deck attached to the rear of the house; damaging the base of the deck and lattice below; Vehicle travelled over the patio, then crashed through shrubbery down an embankment leading to the backyard of 132 Evelyn Rd; Vehicle drove through backyard of 132 Evelyn, then continued along the side of the house where it drove over damaging three retaining walls and clipped a large tree; After driving over the third retaining wall, vehicle continued through the backyard of 126 Evelyn, causing significant lawn damage; Vehicle continued until it hit the back of the house at 126 Evelyn; there, it drove over the rear patio before it struck a ground level basement window and window well; It came to a rest there where the vehicle caught on fire under the hood. Witnesses helped extinguish the fire with a garden house (see incident report #19020129) until NFD arrived to knock it down. Significant front lawn damage to 126 Evelyn occurred as well as NFD was arriving on scene to what was first reported as a structure fire. Several photos of the area were taken by myself. The memory chip was TOT the I.T. bureau to be attached to this report. Tody's towing towed the vehicle out of the backyard by accessing the rear driveway of 132 Evelyn Rd. Mr Phillips cited for Negligent Operation and an Immediate Threat for License Suspension/Revocation faxed to the RMV. Troy Lane is a public way in the City of Newton.

On 05/20/2018 at 17:30 hours I was notified by Captain Anastasia of a motor vehicle crash involving car, and an electric scooter. Captain Anastaisa stated that the operator of the scooter was a 12 year old male who had sustained unknown injures and had been transported to Boston Children's Hospital via ambulance. Upon my arrival at the crash scene I made the following observations, Putnam and Winthrop streets are public ways in the city of Newton that are two way single lane non divided roadways. The roadway surface was wet from rain earlier in the day. Putnam St runs north to south and Winthrop St runs east to west. There is a stop sign at the end of Winthrop St at Putnam St. I observed MA reg 54MN41 a 2005 Buick LeSabre stopped in the south bound lane of Putnam St approximately 1/2 of the way into the intersection with Winthrop St. I observed approximately three feet of skid marks from the Buick's rear tires. I also observed at the crash scene a Segway Ninebot electric scooter that was on the ground near the Buick(cid:31)s rear passenger side door with its handlebars detached. I spoke with the operator of the Buick, Robert DeSouza who stated that on 05/20/2019 at approximately 16:50 hours he was driving south bound on Putnam St at approximately 25 miles per hour. DeSouza stated that he saw a man, later identified as Jose Estabil standing on the east sidewalk of Putnam St facing Winthrop St who was yelling and waving his arms at something on Winthrop St. DeSouza stated he looked to his right towards Winthrop St and his view was obstructed by a row of hedges. DeSouza stated that as he was looking to his right he began to apply his vehicle's brakes when he saw someone coming at me ". DeSouza stated that he heard a crashing noise from the rear passenger's side of his vehicle. DeSouza stated that he stopped his vehicle after the crash and saw a boy lying on the ground at the rear passenger side of his vehicle. DeSouza stated that he was not injured in the crash. DeSouza's vehicle had minor damage to its rear passenger side door, and did not require a tow. Witness Charlotte Hart stated that at approximately 16:30 hours on 05/19/2019 she was diving south bound on Winthrop St. Hart stated that she had to stop short on Putnam St to avoid a crash " with a boy on a scooter that was racing around on Winthrop St. " Hart sated that she told the boy on the scooter that he should not be ridding the scooter in the street. Witness Jose Estabil stated that he was walking on the east side walk of Putnam St across from Winthrop St. Estabil stated that he saw a boy an electric scooter on Winthrop St approaching Putnam St. Estabil stated that he saw DeSouza's vehicle driving south bound on Putnam St approaching Winthrop St. Estabil stated that the boy on the scooter made no effort to stop, slow or avoid the crash with DeSouza's vehicle. Witness Laurel Fransworth stated that she was driving north on Putnam St approaching Winthrop St when she saw the crash occur. Farnsworth stated a boy on an electric scooter on Winthrop St crash into the rear passenger side door of DeSouza's vehicle. Fransworth stated that she believed that the row of hedges at the end of Winthrop St obstructed DeSouz's vehicle. Rowan Delaney ( 02/27/2007 ) stated that on 05/20/2019 at approximately 16:00 hours he and his fellow F.A. Day Middle School student Thiaugo Rubino ( 03/04/2007 ) were having a race around the area of Winthrop St, Putnam St and Shawn St. Delaney stated that he was on foot running on sidewalks while Rubino was on an electric Ninebot Segway scooter. Delaney stated that Rubion was not wearing a helmet or any other safety equipment. I spoke with Delaney(cid:31)s father Royston Delaney, who stated that the scooter was his and that he was unaware that Rubino was using his scooter, and that he has never seen him ridding it before. Royston Delaney stated that the scooter is battery powered and has a maximum speed of 19 MPH. Royston Delaney stated that his son told him that only Rubino was ridding the scooter. Rubino was transported via ambulance to Boston Children(cid:31)s Hospital. On 05/20/2019 Rubino underwent surgery for a brain bleed. I spoke with Rubion(cid:31)s mother Sonia Rubino who stated that as of 05/21/2019 her son was under observation and in addition to the brain surgery her son had a broken arm, broken leg and a broken back. Based upon witnessed statements and my observations of the crash area I believe that Rubion was at fault for the cause of this crash. Myself and Officer Helms took photos of the crash area and the disks were turned over to the NPD(cid:31)s IT bureau for downloading.

Bicyclist was traveling north on Grant Ave with traffic on the right side of the cars. He was intending on traveling straight across Comm Ave. The unknown silver BMW who was traveling next to the bicyclist turned right onto Comm Ave eastbound and struck the bicyclist with rear right part of the car. The BMW continued east on Comm Ave. The bicyclist was knocked from his bike and sustained minor cuts to his legs. His bike was not damaged. He refused medical attention and left the scene prior to amb arrival. No pictures were taken because he left before I could take them.

MV1 had just gotten out of her MV in the driveway of 111 Hammondswood Rd. While between the door and the MV the MV started rolling backwards down the sloped driveway. The operator grabbed a hold of the top of the door and was dragged backwards across the street into the yard of 104 Hammondswood Rd where it came to a stop. The operator initaially claimed minor injuries but signed a refusal. This accident was caused by operator error as it appears that the car was not completely in park. There was minor damage(tire track mark) to the lawn. I attempted to contact the homeowner with negative results. I took pictures of the damage and TOT IT.

Tipruthai Thangthong stated that on 05/21/2019 at approximately 16:36 hours she was pulling into the driveway of her sisters home at 53 Rangeley Rd while operating her vehicle MA reg 2LVL61 a 2018 Honda Accord. Thangthong stated that her three old son Mighty Mettanant was a passenger in her vehicle. Thangthong stated that she was driving approximately 5 MPH as she drove into the driveway. The driveway runs east to west and Thangthong's vehicle was heading west into the driveway as the sun was in the Western sky creating a glare. Thangthong stated that she did no see anything in the driveway prior to her pulling into it. Thangthong stated that she felt the front of her vehicle strike what she described as " something " and stopped her vehicle. Thangthong stated that she put her vehicle in reverse and then into park and exited her vehicle to see what she had struck. Thangthong stated that she saw her two nieces, Kalla Mongkhonlertsirkul age three and Kelley Mongkhonlertsirkul age seven laying in the driveway in front of her vehicle. Thangthong stated that she then realized that her vehicle had stuck her two nieces as they were in the driveway. Both of the Mongkhonlertsirkul sisters were conscious and alert and were able to walk to an ambulance for transport to Newton Wellesley Hospital for treatment. Thangthong stated that she and her son were not injured in the crash. I observed no damage to Thangthong's vehicle. I responded to the Newton Wellesley Hospital and spoke with the Mongkhonlertsirkul sisters and their mother Piyada Kellum. Kellum stated that her oldest daughter Kelly is a student at the Franklin Elementary School . Kellum stated that her daughters told her that they were playing in their driveway when their aunt's vehicle entered the driveway and did not stop. I spoke with both of the Mongkhonlertsirkul sisters who told me that they tried to get out of the way of their aunt's vehicle but could not in time. The Mongkhonlertsirkul sisters stated that they were both struck in the back and fell to the ground between the two front tires of their aunt's vehicle. Kalla Mongkhonlertsirkul had scrapes to her right knuckles. Kelly Mongkhonlertsirkul had lacerations to her lower left arm and the left side of her face near her eye. I spoke with hospital staff who stated that there did not appear to be any broken bones or other internal injures. I took photos of the crash area and forwarded the disk to the NPD's IT bureau for downloading.

Vehicle 1 was travelling southbound on Brookline St, and took a right turn onto Lovett St. The operator of the bicycle crashed into the back right of vehicle 1 as it was taking the turn. There was minor damage to the rear of vehicle 1. I observed a dent with a small amount of blood on it. I observed a laceration on the right arm of the operator of the bicycle.
