Narrative:
The operator of Vehicle 1 states that Vehicle 1 was parked at the airpump in the parking lot behind the Speedway gas station at 2370 Commonwealth Ave when Vehicle 2 backed out of a parking space and made contact with the driver-side rear passenger door of Vehicle 1. The operator of Vehicle 1 tried to make contact with the operator of Vehicle 2 and heard her passenger say something along the lines of "go, go! Get out of here!" Vehicle 2 then drove away. The operator of Vehicle 1 was able to take a picture of Vehicle 2 before it left the area. I observed minor scrapes to the driver side rear quarter panel of Vehicle 1. I contacted the operator of Vehicle 2 by phone who states she was attempting to back out of her parking space but was blocked in by Vehicle 1 and asked the operator of Vehicle 1 to move his car so she could get out. The operator of Vehicle 2 states that the operator of Vehicle 1 told her to try and get out anyway and started putting air in his tires. The operator of Vehicle 2 states that she attempted to back out carefully and didn't feel her vehicle make contact with his vehicle so she left the parking lot. Due to the conflicting statements of the operators I was unable to determine who was at fault.

Narrative:
On Sunday 6/12/22 at approximately 1333 hours while assigned to marked unit n498 I was dispatched to the area of 832 Dedham Street for a report of a 2 car motor vehicle crash with no injuries. Upon arrival I spoke with the operator, GERSHON Andrew, of motor vehicle #1 (6HS292). GERSHON states he was traveling Westbound on Dedham Street toward Brookline Street when he approached the driveway at 832 Dedham Street and motor vehicle #2 started to pull out in front of him. GERSHON states as he saw the vehicle pull out he swerved into oncoming traffic to avoid the collision, however motor vehicle #2 struck the passenger side of his vehicle. After the collision GERSHON attempted to pull back into his lane of travel, but lost control causing him to overcorrect and go off the road on the westbound side of the road in front of 824 Dedham Street causing some damage to the front landscaping of the yard. Secondly, I spoke with the operator, JIN Zhien, of motor vehicle #2 (EV87SA). JIN states she was attempting to pull out of the driveway of 832 Dedham Street and didn't see motor vehicle #1. JIN states she was distracted because there was a lot going on inside the car. She stated she was not on her cell phone. Finally I also spoke with a witness, CURTIS Ron, who was travelling in the opposite direction and witnessed the crash. Ron stated he saw motor vehicle #1 travelling straight in the opposite direction on Dedham Street. He saw the Tesla (MV#2) attempting to pull out of the driveway at 832 Dedham Street and drive into the side of MV#1. Ron stated he also observed MV#1 swerve into his lane of traffic trying to avoid the collision and then spinning out into the front of 824 Dedham Street. Taking the witness, operator, and passenger statements into account as well as my observations, I determined the operator, (JIN Zhien) of MV#2 (EV87SA) is at fault for the crash and she has been issued Massachusetts Uniform Citation T2012918 C89 S8 Failure to Yield Right of Way.

The operator of MV1 stated she was having back pain and would like to be evaluated by paramedics. Fallon Paramedics arrived on scene to evaluate the operator of MV1 and proceeded to transport her to Newton Wellesley Hospital for further evaluation. Prior to the operator being transported, the operator and the passenger described the vehicle that struck them as a blue, rusty van. They stated they did not see the plate of the vehicle, but stated the driver side front end of the vehicle would have sustained damage. They also stated that they were unable to get a look at the operator of the other vehicle. Upon clearing, the passenger of MV1 stayed with the vehicle waiting for her father and a personal tow. The operator and passenger were advised that a report would be generated in regards to the incident. After clearing I searched the area yielding negative results of MV2. I also checked the neighborhood for cameras that would of captured the incident, yielding negative results.

The operator of MV1 stated he was traveling on North Street, driving approximately 70 mph and a skunk ran across the street. The operator stated he swerved to avoid the skunk, hit the curb and lost control of the vehicle. He stated once the car rested against the garage to 105 North Street, he and the passenger got out of the vehicle. He stated the passenger told him to leave. The operator stated he walked down Farwell Street and after thinking about what happened he came back to the scene of the accident. The operator and passenger stated they were not injured. After speaking with the operator, I observed tire marks going South on North Street and followed them to the curb where I believe he struck which was located approximately 100 yards, in front of 129 North Street. From my observations, MV1 struck the curb located in front of 129 North Street. After striking the curb, MV1 spun sideways, continued traveling southbound, until the MV crossed into southbound lane, struck the curb and then the utility pole 14. After striking the curb the MV spun around facing north, struck the retaining wall, bushes and light pole, located in front of 107 North Street. After striking the light pole, the vehicle hit the garage door at 107 and 105 North Street, resting against 105 North Street. There was significant damage to the garage doors to 105 and 107 and damage to the support beam located between the residences. MV1 sustained major damage to the motor vehicle. Todys was notified for a tow. Photos were taken of all damage and submitted to IT

Narrative:
On 06/21/22 at 08:05 hours, I responded to 12 Marshfield Road for a City of Newton Dept. of Public Works vehicle involved in a crash with another vehicle. Marshfield Road is a public way maintained and owned by the City of Newton. At the time of the crash, the weather was sunny and clear and the road conditions were dry. Also, there was road construction going on as a company was grinding the roadways in the area for the City of Newton. Two detail officers were on scene and Ofc. Conary called in the accident to Newton Police Dispatch. On arrival, I spoke to the operator of M/V# 1 identified as Suzanne Ennis (MA D/L # S80758886) who was driving a 2015 Honda CRV color red bearing MA reg.# 769YR1. Ms. Ennis stated that due to the road construction and it being blocked at Walter Street and Jackson Street everyone was being funneled down (EB ) on Marshfield Rd by the detail officers. Ennis further stated that there was construction vehicle apparatus parked along Marshfield Road in the westbound direction which made the road narrow. She then attempted to pass a parked City of Newton Toyota Rav4 (M/V # 2) on the right of her when another pick up truck suddenly started traveling westbound. She says that she tried correcting her steering but made contact with the driver's side front quarter panel area of M/V # 2. I observed a minor black scuff mark to the front passenger side quarter panel area. M/V # 2 is a 2019 Toyota Rav4 color white bearing MA Official reg. # M5181A. It is owned by Enterprise FM Trust and being leased by the City of Newton Public Works. The Rav4 was parked legally on the right side near 12 Marshfield Road with a City of Newton employee sitting in the front driver's seat. The employee was Kimberly Ritcey who works for the engineering department for the Newton Dept. of Public Works. Ritcey reported no injuries. I observed minor scrape marks to the driver's side front quarter panel area. Photos taken of the scene and submitted to the I.T. Bureau.

The weather conditions were clear and sunny and the road conditions were dry at the time of the crash. On arrival, I spoke to the operator of M/V # 1 identified as Elizabeth Langston (MA D/L # S89458234) who was operating a 2013 Nissan Rogue color black bearing MA reg. # 3BMK31. Narrative:
On Thursday, June 23, 2022, while assigned to unit N492, I responded to the area of Homer Street and Lowell Avenue in Newton for a report of a Hit and Run Crash. The weather at the time of the crash was clear and sunny. The road surface was dry. Detective Sgt. Claflin was working a paid detail for Feeney Brothers at the intersection of Lowell Avenue and Otis Street. While monitoring the traffic in the area, Detective Sgt. Claflin heard what he believed to be a vehicle crash in his vicinity. Detective Sgt. Claflin looked across the intersection and observed a 2020 Honda Civic (MA: 7MR818) leaving the scene down Lowell Avenue (S) towards Commonwealth Avenue. This vehicle had damage to it's passenger side door area. Detective Sgt. Claflin also observed fresh damage to the rear driver side bumper area of a 2021 Dodge Ram (MA: 5CFR30) that was parked in front of 296 Lowell Avenue (S). Detective Sgt. Claflin then entered his personal vehicle and attempted to catch up to the Honda Civic that left the scene to check on their well-being. Detective Sgt. Claflin stated as the vehicle approached the intersection of Lowell Avenue (S) and Commonwealth Avenue, it proceeded through the intersection on to Homer Street with out stopping at the red light activated at this intersection. Detective Sgt. Claflin was finally able to stop the vehicle on Homer Street just after Commonwealth Avenue. I arrived on scene and spoke with the operator, Ms. Ludmila Gelman (S30392030). I asked Ms. Gelman about the events that took place prior to Detective Sgt. Claflin stopping her. Ms. Gelman stated she did not know what happened. I observed moderate damage to the front passenger side door area of her vehicle. The front passenger door mirror was damaged and folded in. The glass window from the front passenger door was shattered and missing. There was glass from the middle covering the entire front passenger seat/floor area inside the vehicle. I showed Ms. Gelman the glass inside her vehicle and the damage to her door and asked her if she knew what caused it. Ms. Gelman stated she did not know and that something must have hit her. I explained to Ms. Gelman the events that has just transpired as conveyed to me by Detective Sgt. Claflin. Ms. Gelman seemed to be confused and did not understand what happened. Ms. Gelman called her son Steven and asked me to speak with him. I explained to Steven the events leading up to me speaking with him. I explained to Steven I did not feel comfortable allowing Ms. Gelman to drive away from the scene. At Steven's request, I moved Ms. Gelman's car away from the intersection and parked it in front of 1103 Commonwealth Avenue for him to pick it up. Ms. Gelman reported no injuries and was transported to her residence by myself in unit N492. Ms. Gelman was given Massachusetts Uniform Citation 487210AB in hand for Chapter 90, Section 24 (Leaving The Scene Of Property Damage), Chapter 89, Section 9 (Fail To Yield, Red Light), and Newton City Ordinance Chapter 19, Section 75 (Fail To Use Care). Ms. Gelman was also advised I would be filing an Immediate Threat with the Registry of Motor Vehicles. A Request for Immediate Threat License Suspension/Revocation was completed and submitted tot he Registry of Motor Vehicles with supporting documentation via e-mail, DCUImmediateThreat@massmail.state.ma.us. I returned to the area of the crash and observed damage to the rear driver side bumper area of the involved Dodge Ram. The vehicle was unoccupied at the time of the crash. The registered owner, Mr. Zachary Maclaughlin, was advised. A copy of the issued Criminal Application was submitted to the Court Prosecutor with supporting documentation. Narrative:
On Saturday 06/25/22 at approximately 1508 hours while assigned to patrol sector n498 operating marked unit n503 I was dispatched to the area of Rt 9 Eastbound and Walnut Street (Both public ways in the City of Newton) for a report of a 2 car motor vehicle crash. Upon arrival I spoke with the operator,(BROWNE Sarah Ann) of MV#1(MA REG 514HH4) who states that she was stopped at the stop sign at the intersection of Rt 9 Eastbound. She was attempting to enter Rt 9 Eastbound waiting for traffic to clear when she was struck in the rear by motor vehicle#2. After speaking with BROWNE I spoke with the operator, (REED Ethyn) of MV#2, (NY REG JNZ6912) who states he was behind MV#1 also attempting to get on to Rt 9 Eastbound. He states he saw MV#1 pull forward and at that point he looked over his left shoulder to see if traffic was clear. He saw a clearing and began to accelerate forward not realizing that MV#1 had not yet entered traffic, striking MV#1 in the rear. While on scene REED gave me registration papers that were not matching his vehicle, therefore, I queried the license plate, REED's drivers license and VIN number. REED's license plate, (NY REG JNZ6912) came back to a 1999 Brown Toyota Camry, however this license plate was attached to a 2011 White Honda Civic belonging to Luis Rios. Subsequently I queried the Vin number on the vehicle (2HGFA1F88BH525771) Which came back to the vehicle on scene, a 2011 White Honda Civic owned by REED with a suspended registration due to invalid proof of insurance. Finally I queried REED's California Drivers License (Y2616596) which came back as EXPIRED with a status of "Withdrawn Pending PDPS Clearance". While I was conducting the investigation Tody's was en route to tow the vehicle. Due to the damage from the crash the vehicle was inoperable. I informed REED the vehicle was being towed due to the damage and for not having insurance. I explained to REED I would further investigate the status of his license and the vehicle and Mail him the citation once my investigation was complete. At this time I am issuing Massachusetts Uniform Citations T3044941 and T3044942 for the following offenses: C90 S23 Attaching Registration Plates C90 S34J Operating a MV without Insurance C90 S9 Operating Unregistered MV C90 S10 Operating without a License I also confiscated the New York Registration plate, JNZ6912, and placed it into property and evidence locker #1. Vehicle was towed by Tody's Towing. Also see CC# 22022600

Narrative:
At approximately 1242 HRs, on Sunday, June 26, 2022, I was dispatched to 199 Boylston St. for a report of a two vehicle motor vehicle crash. upon speaking with the operator of MV1 (MA Pass:TC84GZ), he stated that he was traveling northbound in the parking lot of 199 Boylston St., in the travel section. It was not until a few moments prior to impact, that he observed MV2 driving across empty parking stalls and then ultimately striking MV1. Upon speaking with the operator of MV2 (MA Pass:2HXE78), she stated that she was attempting to park MV2. To this end, she was driving westbound through empty parking stalls and as she entered the travel section, struck MV1. The operator of MV2 could not offer an explanation as to why she did not properly yield the right of way to MV1. I noted damage to MV1's passenger side. The front passenger side door had a dent and scrapes and the right rear passenger side door had the door skin cut and dislodged, leaving a section approx. 1.5-2 feet long and the same wide, bent out and approx. 6 inches away from the body of MV1. I noted damage to the front left bumper cover and driving light of MV2. Due to safety concerns and to prevent further damage, the operator of MV1 began the process of securing a private tow for the vehicle. MV2 was able to continue to operate under its own power. I cleared without incident.

Narrative:
Mv#1 operator stated he was travelling on Elliot St E/B (right of way) passing the exit driveway of Negoshian's service station, 14 Elliot St. #1 stated at that time, a black Lexus SUV bearing MA reg H2158 (Mv#2) nosed out from the driveway and made contact with his passenger side rear quarter panel behind the wheel. #1 stated he pulled over on Elliot St however #2 did not stop and left the area. #1 described the operator as a W/M with dark beard and a female passenger. I observed #1 passenger side rear quarter panel which appeared to show fresh light colored scuff marks and light paint transfer. I queried the reported plate number of #2 which came back registered to Beverly Newman 16 Pickwick Rd W. Newton on a black Lexus SUV. Ofc Chieu responded to this address and located #2 there. The male operator was raised who identified himself as Peter Feig of the same address. The owner Ms Newman was the front seat passenger. I was able to observe a photo of the left front end of #2 and observed a light scuff mark where the grill meets the fender. I spoke to Mr Feig who stated he was unaware there was a collision at all. It appears the silver colored front grill of #2 made contact with #1. He stated he did remember #1 drive by at a high rate of speed. Feig was advised a report would be on file. #1 owner Mr Todd Miller was advised of my findings, satisfied and will contact his insurance company if needed.

Narrative:
On Tuesday, June 28, 2022, while assigned to unit N496, I responded to the area of Langley Road and Hamlet Street, Newton for a report of a roll over crash with 3 injured parties. The weather at the time of this crash was clear and sunny. The road surface in the area of the crash was dry. Langley Road and Hamlet Street are both public ways maintained by the City of Newton. I approached the area of the crash coming from Boylston Street and when I arrived my attention was drawn to two locations on Langley Road. I observed a female party laying prone on the sidewalk area of Langley Road (E) at the Hamlet Street intersection. This female party, later identified as Ms. Melinda Conroy, was being attended to by passerby's in the area. My attention was then drawn to an overturned vehicle resting half in the roadway/half on the sidewalk (W) in front of 323 Langley Road. As I began to run over to the vehicle, I observed a woman standing next to the vehicle screaming frantically. This party identified herself as the driver of the lone vehicle involved, Ms. Natalya Kabanovsky (S65512051). There were parties at the back of the vehicle yelling to me that there was a woman trapped under the vehicle and that they were holding the vehicle up to get her out. I ran over to the rear of the vehicle and observed a female party, later identified as Ms. Annette Sooper, lying underneath the vehicle in the roadway. There was a large pool of blood on the roadway as the result of a laceration to what appeared to be her head/face area. Due to the unknown stability of the vehicle resting on its roof, and due to the passerby's stating they were holding the vehicle up so it did not roll over onto Ms. Sooper, I reached under the vehicle from the rear, grabbed Ms. Sooper's person, and dragged her away from the vehicle to a safe location on the sidewalk. At this time, I observed a large laceration to Ms. Sooper's head and she stated she had suffered a leg injury. Newton Fire and Medics along with additional Police units arrived on scene and took over rendering aid to the victims. I then started to conduct my investigation into the crash. I spoke with the operator of the vehicle, Ms. Kabanovsky. Ms. Kabanovsky stated she was operating her 2005 Lexus ES330 (MA: 293TAB) on Hamlet Street (W) towards Langley Road. Ms. Kabanovsky stated as she approached the intersection, a female party (Ms. Conroy) ahead of her was running across Langley Road (S) at Hamlet Street. Ms. Kabanovsky stated she attempted to hit her brakes, but instead hit her gas pedal. Ms. Kabanovsky's vehicle crashed into Ms. Conroy and then she panicked. Ms. Kabanovsky stated her car then accelerated across the street and crashed. Ms. Kabanovsky stated she was not wearing a seatbelt at the time of the crash and extricated herself from her vehicle after it rolled over onto its roof. I requested Ms. Kabonovsky's license while speaking to her, but she was too upset to located it. I queried Ms. Kabanovsky's license and registration status through Newton Dispatch. Ms. Kabanovsky's license stated is expired as of 12/18/2016. Ms. Kabanovsky registration is active. I observed substantial damage to the entire front end, driver, and passenger side of Ms. Kabanovsky vehicle. Ms. Kabanovsky was evaluated by Newton Medics and complained of right arm pain. Ms. Kabanovsky was also visibly distraught and expressed concern over the two pedestrians involved in the crash. Ms. Kabanovsky was transported to Brigham and Women's Hospital for treatment. I briefly spoke with Ms. Melinda Conroy as she was being attended to by Newton Medics and Fire. Ms. Conroy stated she was running on Langley Road (S) and observed MV1 traveling on Hamlet Street (W) towards Langley Road. Ms. Conroy stated she believed MV1 was slowing down and coming to a stop. Ms. Conroy stated she waved at the vehicle and as she crossed the intersection, MV1 accelerated and crashed into her left side. Ms. Conroy stated she flipped over the vehicle and landed on the roadway. Ms. Conroy was conscious and alert when speaking to Newton Medics and was transported to Beth Israel Deaconess Hospital in Boston. I later spoke with Ms. Conroy after her release from the hospital. Ms. Conroy stated she suffered some bumps and bruises had no major injuries. Officer Pohlman spoke with Ms. Sooper prior to her transport to Beth Israel Deaconess Hospital in Boston by Newton Medics. Ms. Sooper stated she was walking on the sidewalk in front of 323 Langley Road after returning from Newton Centre. Ms. Sooper stated as she was walking, she observed MV1 hit Ms. Conroy and then travel across the street in front of her into a tree. Ms. Sooper stated she does not remember what happened after that. I spoke with Ms. Sooper's son at NPD HQ and was advised Ms. Sooper was admitted to the hospital and suffered a fracture of her left hip and required 6 staples to close a laceration on her head. Tody's Towing responded to the scene and removed MV1 from the roadway. Traffic Officer Wilson took pictures of the scene and submitted them to the IT Bureau. After speaking with all parties involved, Ms. Kabanovsky will be cited with Massachusetts Uniform Citation 494688AB in hand at her residence for Chapter 90, Section 10 (Unlicensed Operation), Chapter 90, Section 24 (Operate To Endanger), and Newton City Ordinance Chapter 19, Section 75 (Fail To Use Care). Ms Kabanovsky was also cited with Massachusetts Uniform Citation 494800AB in hand at her residence for Chapter 90, Section 13A (Fail To Wear A Seat Belt). A Request for Immediate Threat License Suspension/Revocation was completed and submitted to the Registry of Motor Vehicles with supporting documentation via e-mail, DCUImmediateThreat@massmail.state.ma.us.

Narrative:
On 6/30/22 I responded to Newtonville Ave at Harvard St for a hit & run with property damage. A passerby observed MA commercial reg T54798 hit a traffic light and leave the scene. Upon arrival, I located the traffic light dislodged from it's pole and on the sidewalk. The plate given is registered to Piece by Piece Movers in Woburn. I spoke to manager Jacob Hart ( 978-855-3976) who informed me that the truck is sub contracted to a company called Speedy King Laborers, and that Hart is unaware of who the driver may be. Hart stated that the truck does have a GPS on it which was showing the vehicle stationary on Turner Terrace at the time of our conversation. I responded to Turner Ter and located the truck in question. The driver, Jean Rodriguez DOB 11/8/99, told me that he was aware that he hit the light but had notified his boss already. He stated the crash occurred as he was turning right onto Harvard St from Newtonville Ave on the way to a residential moving job. Rodriguez was informed that merely notifying his boss when a traffic light is struck down is not appropriate and that he could be charged with hit & run property damage. Rodriguez was apologetic and stated that he understood. Pictures were taken of the traffic light and Daigle was notified. The remaining lights at Harvard/Newtonville were on flash upon my clearing. I did not observe any damage to the moving truck however Jacob Hart was advised to inspect the property himself to be sure. He was provided this report number for reference. This incident appears to be a misunderstanding at this time.

Narrative:
On July 4, 2022 at approximately 06:56 hours I, Officer Guarino, responded to the area of Commonwealth Ave at Centre St for a report of a motor vehicle crash. Upon arrival, I observed the fire and medics on scene with a two vehicle motor vehicle crash, one of which was a rollover. MV1 was on the roof of its car in the northbound lane of Centre St. MV2 was in the Eastbound Lane of Commonwealth Ave. I spoke with the operator of MV2, Annika Morris-Kelly who told me that she was traveling Eastbound on Commonwealth Ave when she stopped at the red light. The light turned green and she began to go, as she proceeded, she noticed MV1 traveling southbound on Centre St and tried to stop but crashed into MV1. I spoke with the operator of MV1, Luymar Bezerra, who said that he was traveling southbound on Centre St and did not see the traffic signals due to the trees on the side of the road and continued through the intersection causing the crash. I asked Luymar for his license and registration. He provided me with a passport and a CT registration for his vehicle. Luymar said that he did not have a license on his posession and did not have a valid license within the United States. He said that he had a Portugese driver's license and has been in the country for less than a year. I was unable to confirm this information and issued a criminal complain against Luymar Bezerra on MA Uniform Citation T1447651 for MGL 90/10 Unlicensed Operation of a motor vehicle. I explained the citation to Bezerra, who said that he understood. All partied involved were seen by medics and signed a patient refusal. Both vehicles were towed from the scene by Todys.

Narrative:
Operator of vehicle one stated that while passing parked vehicle two the right side of the his vehicle scraped up against vehicle two's front driver's side bumper. Vehicle two was a City of Newton DPW truck that was parked in front of 367 Albemarle Rd waiting to block off the street for the Fourth of July fireworks at Albemarle field. Vehicle one's operator stated that he could not pull to the side of the road after the crash because of heavy traffic due to the Fourth of July activities in the area. He did stop at his residence approximately two blocks from the crash area. Vehicle one had damage to the passenger side front and rear as well as the rear bumper. None of the occupants of vehicle one stated that they were injured. The owner of vehicle one had concerns about the amount of room that the DPW tuck took up on the roadway. It should be noted that a City of Newton DPW worker measured out the length of the roadway from the truck's front bumper to the grass line and it was 11 1/2 feet. According to the General Motors web site the width of vehicle one is 6 feet 7 inches. Operator of vehicle two stated that he was sitting in the driver side of the truck when vehicle one passenger side scraped up against it, and that he was not injured. Vehicle two front bumper had damage to it. It took photos of both vehicles and forward the disk to the NPD's IT Bureau for downloading. I issued operator of vehicle one MA Uniform Citation T 3045462 and cited him for a violation of City of Newton Ordnance 19/75 failure to use care while passing. Albemarle Rd is a public way in the City of Newton.

Narrative:
On 07/07/22 at 11:44 hours, I (Traffic Unit # 523) responded to 68 Wyman Street Apt. # 5 for a past motor vehicle crash involving a pedestrian that occurred on 06/09/22 at 808 Beacon Street. This area of Beacon Street is a public way maintained and owned by the City of Newton. The weather at the time was 81 degrees and partly cloudy (wunderground.com). The road conditions at the time were dry. On arrival, I spoke to the pedestrian involved in the crash identified as Thomas Jones. He stated the crash took place on 06/09/22 approximately between the hours of 14:05 and 14:10. He further stated that this occurred at 808 Beacon Street while he was crossing Beacon Street near the Bank of America. He says that he pushed the button to activate the crosswalk yellow flashing signal lights. It should be noted that I am familiar with this location and it does have a marked crosswalk on both sides of 808 Beacon Street with yellow flashing signals that can be activated. Once activated, he says a vehicle traveling eastbound on Beacon Street stopped for him. He then entered the crosswalk from the eastbound side of Beacon Street going across the street with his walking cane. He kept walking in to the westbound travel lane of Beacon Street when he was suddenly struck by a motor vehicle. Thomas could not provide what type or color of the vehicle. As a result, Thomas fell forward and was knocked down to the ground on both hands and knees. He also says that his right cheek and eyeglasses struck the pavement which damaged the lens to his glasses. He sustained a bruised (black and blue) right eye. He says approximately seven days later he started having neck pain to which he has been receiving medical attention for. He also states an upper right side tooth implant fell out of his mouth. After the crash, he states he was helped up by two unknown bystanders. An elderly white female who was operating the vehicle that struck him approached him. Thomas says that the female told him that she did not see him crossing the street as she was looking down and not up at the time. She provided him with her name of Jill Levin and her telephone number before leaving. Thomas states he was wearing gray colored khaki pants, sneakers, and a light blue t-shirt at the time of the crash. Next, I attempted to call the number for Jill Levin and left her a message to call me back. At approximately 14:45 hours on this date, Ms. Levin came in to NPD Headquarters and spoke to me. I asked her if she was involved in a accident during the month of June. She stated that there was an incident on a Thursday approximately three weeks ago in June of 2022 at approximately 14:30 hours. She says she was driving her 2013 Lexus 450RX color gray bearing MA reg. # 6RK464 westbound on Beacon Street near address number 808. She saw an older male crossing in the crosswalk and she says that she stopped for him. The male then suddenly fell down in front of her car. She states that she never struck him with her vehicle. She then got of her vehicle and asked him if he needed any assistance to which he replied that he was fine and did not need anything. He provided his name to her. She then provided her name and phone number on a piece of paper. I asked Ms. Levin why she would provide her information to Mr. Jones if no accident occurred. She replied that it was the right thing to do as far as checking on him and seeing if he needed any assistance. I then inquired why Mr. Jones would alledge that she stated to him on scene that you did not see him crossing the street. Also, that you were looking down and not up. Ms. Levin denied ever stating this to Jones. I then went outside and looked at her Lexus 450RX to check for any damage to the front end of the vehicle. I observed two small scratches to the passenger side front bumper which appear unrelated. The marks were indicative of white paint transfer from having contact with another vehicle. Ms. Levin did not know where the marks came from. I advised her that I would investigate this further and check to see if there is surveillance footage from the Bank of America or other source. After, I attempted to call Bank of America and could not reach anyone there. I will check the area and go to the bank on 07/08/22 during my next shift. On 07/08/22 at approximately 09:10 hours, I went up to 808 Beacon Street and observed no other surveillance cameras in the area. I went in to the Bank of America and spoke to the branch manager. He showed me the multiple camera angles they have, but none show out in to Beacon Street. As a result of this investigation and the statements made by both parties, I believe that Mr. Jones was struck by Ms. Levin's vehicle. The fact that Ms. Levin got out of her vehicle to check on Jones and provide her information to him even though she claims no accident took place is highly unlikely. Therefore, I am issuing Ms. Levin MA Uniform Citation # 507419AB for Chapter 89/11 Crosswalk Violation. The citation was mailed out on 07/08/22. I spoke to Ms. Levin on the phone explaining a citation was issued and mailed to her.

Narrative:
On Monday, July 11, 2022, while assigned to unit N492, I responded to the area of Commonwealth Avenue and Temple Street, Newton for a report of a crash with minor injuries. The weather at the time of the crash was clear and sunny. The road surface was dry. Commonwealth Avenue and Temple Street are both public ways maintained by the City of Newton. I spoke with the operator of MV1, Ms. Rui Zhang (SA4940828). Ms. Zhang stated she was operating her 2016 Subaru Outback (1WRP35) on Commonwealth Avenue (W) towards Temple Street. Ms. Zhang stated she activated her right turn directional and was slowing down to take a right turn onto Temple Street. Ms. Zhang stated she began to take her right turn, a vehicle appeared on her right side and crashed into the front passenger side of her vehicle. Ms. Zhang her and her son Kenneth reported no injuries as a result of the crash. I observed damage to the front passenger side bumper/tire/fender area of MV1. Tody's responded and removed the vehicle from the roadway. I spoke with the operator of MV2, Mr. Thomas Conneely (S30459555) as he was being treated by Newton Medics. Mr. Conneely stated he was operating his 2019 Honda CRV (MA: 58252) on Commonwealth Avenue (W) towards Temple Street. Mr. Conneely stated he was traveling behind MV1 for some time and the vehicle was slowing down and speeding up down the length of Commonwealth Avenue. Mr. Conneely stated as they approached the Temple Street intersection, MV1 had stopped in the middle of the road and he believed it was taking a left turn on to Temple Street. Mr. Conneely stated he went to around the right side of the vehicle when it suddenly took a right turn into his vehicle as it was passing. Mr. Conneely said his vehicle then went airborne twice and he ended up in the yard of 1633 Commonwealth Avenue. Mr. Conneely and his passenger, Ms. Susan Conneely were transported to Newton Wellesley Hospital by Newton Medics for evaluation. Tody's towing reponded and removed MV2 from the property of 1633 Commonwealth Avenue. Ms. Nancy Ghabi stated she was operating her vehicle on Commonwealth Avenue (W) behind MV1 and MV2 at the time of the crash. Ms. Ghabi stated she observed MV2 to be traveling at a high rate of speed and observed it travel to the right of MV1 and try to go around it. Ms. Ghabi stated she two vehicles then crashed and MV2 ended up in the lawn of 1633 Commonwealth Avenue. Ms. Ghabi described the actions of MV2 to be "erratic". Mr. John Carey stated he witness the crashed as he was standing on the sidewalk in the area of 1633 Commonwealth Avenue. Mr. Carey stated MV1 was slowed down in the intersection and MV2 tried to go around MV1's passenger side. The vehicles then crashed and Mr. Carey believes MV2 did not attempt to brake post collision and MV2 ended up on the lawn of 1633 Commonwealth Avenue. Mr. Conneely will be cited with Massachusetts Uniform Citation 510670AB for Chapter 89, Section 4A (Unsafe Lane Change) and Newton City Ordinance Chapter 19, Section 75 (Fail To Use Care). Pictures of the property damage to 1633 Commonwealth Avenue were taken and submitted to the IT Bureau.
